THE DEAL
Will Your Kids Inherit Your Debt? By Jason Alderman
M
any people finally get around to writing a will in order to safeguard their assets for their heirs. But what if you’ve got the opposite problem: Your nest egg was decimated by the recession, bad investments or simply living longer than expected, and now you’ve got a mountain of bills you can’t pay off. Will your kids inherit your debts after you die?
The short answer is, not in most cases. But there are situations where someone could be legally responsible for paying off your bills after death. Plus, aggressive creditors have been known to coerce heirs into paying off debts for which they’re not responsible, just to be left alone.

• If your child, spouse or other acquaintance is a cosigner on a credit card or loan (e.g., mortgage, car, personal loan), they share equal responsibility for paying it off. This is why you should always think twice before cosigning anyone’s loan.
• If someone is a joint account holder – that is, their income and credit history were used to help obtain the loan or credit card – they’re generally responsible to pay off the balance. • Widows and widowers are responsible for their deceased spouse’s debts if they live in a community property state.
Note that authorized users on your credit cards aren’t liable for repayment since they didn’t originally apply for the credit. Chances are they were simply “piggybacking” on your credit record to help build their own. However, to protect authorized users from being bothered by creditors after your death, you may want to remove them from your accounts. If you have outstanding secured debts upon death, such as a mortgage or car loan, your estate must pay them off or the creditor can seize the underlying asset. For example, if you were planning to leave your house to your kids, they’ll need to either pay off or continue making payments on any outstanding mortgage, property taxes and insurance, or risk foreclosure.
Depending on your state’s laws, there are a few types of assets, like life insurance proceeds and retirement benefits, which you can pass along to beneficiaries that generally won’t be subject to probate or taxation and thus may be safe from creditors.
Just be aware that if you name your estate as beneficiary for an insurance policy or retirement account, creditors can come after the money to pay off your debts. Thus, it’s usually wise to name specific individuals as beneficiaries – and back-up beneficiaries, in case they die first. Also, if your beneficiary is a cosigner on any of your debts, creditors can pursue him or her for any balances owed. Check with a probate attorney or legal clinic familiar with your state’s inheritance and tax laws. Free or low-cost legal assistance is often available for lower-income people.
Bottom line: If you expect to leave unpaid debts after you die, alert your family now, so that together you can plan a course of action. You don’t want to blindside your loved ones in the midst of their grief.

To agree to disagree? WHAT! By Dr. T “We have to agree to disagree” is NOT the answer! We are talking about LIFE & Death, Justice and Equal Protection Under the Law. We cannot agree to disagree where that is concerned.
It disturbs me that so many white people cannot see that what we are dealing with in Ferguson, Missouri or Staten Island, NY or Sanford, Florida or Los Angeles County, California has nothing to do with agreeing or disagreeing! When white people are determined to avoid the recognition that what we have in the U.S.A. is a systemic and institutionalized racism embedded and entangled throughout our nation’s governmental, civic, educational and social institutions, the privileges that white skin and complicit oblivion affords white America become something that is not only intensely frustrating but deeply disappointing. This neo-Apartheid infects and affects every part of life in America whether or not one wants to acknowledge it.
I have friends, who are white, and though we have had intimate conversations throughout the decades, we have worshipped together, broken bread together, raised children together and even wept together, they cannot understand why I am so disappointed in the “same old rhetoric” they spout out almost as a reflex that always comes down on the side of absolute oblivion with regard to the TWO Americas in which we live. It is painful to realize that if I were to become a victim of abusive policing or my son or nephew were victimized, would they EVER recognize it as an injustice or only a tragic event? They would not have my back because they would not recognize the need nor would they have the moral conviction to do so. It is not their battle to fight, and they do not recognize the loss of liberty and freedom for some as a threat to the freedom and liberty of all. For them we live in a country of laws and all you have to do is follow the law and justice shall, miraculously, be served. That type of magical thinking is a function of the privilege of having white skin in America.
Injustice is not something most white people have to live with as a part of their daily lives, nor do they have to teach their children survival tactics for when they encounter law enforcement. Our young people have to be educated concerning the “nature” of being Black in America when they come face to face with an historic legacy that required America’s Black citizens to go to jail, suffer for decades, get beaten, bitten by dogs, and even die just to be considered citizens of a nation which their blood and sweat built. There has never been equal justice in America.
Of course, there are whites who do “get it” and have dedicated their lives to the struggle for justice and equality for All people, and they would be the first to say there should be no “special” accolades given to them for that. Many of the whites that I know do not SEE the chasm that exists in this nation. They are not willing to recognize the deep and abiding problem that is the color-line that divides us. The SILENCE in the work place, the church house, schoolhouse, the neighborhoods and communities across this nation is extremely disheartening. Some of the anonymous blogs and social media commentary is frightening. The ignorance, hatred, and even disdain for Black people are rampant throughout white America. The “good” white folks I know are mostly silent and that is a painful silence to hear.

It took more than 25 years before they successfully formed a labor union. Over the next ten years, BSCP fought for recognition by the American Federation of Labor and improved working conditions for porters. The BSCP exemplifies the importance of organized labor in the nation’s history. As the country gears up to celebrate American workers, the contribution of the African American laborer is a significant part of the conversation. Celebrating Labor Day In and Around Richmond
There is an array of Labor Day celebration options in and around the city of Richmond. Whether you enjoy a historical reenactment or a festival-like atmosphere, you don’t have to travel far to find Labor Day fun.
Start your weekend with the Chesterfield County Fair. Running through August 30th, the festivities offer plenty of activities for every age group. Music will fill the area on Friday and Saturday nights, with grandstand concerts. Foodies can enjoy all types of cuisine, including fried carnival foods and homemade recipe contests. There are amusement rides for the kids and even some educational opportunities with an agricultural focus. On Sunday, Patrick Henry’s “Give me liberty” speech will be reenacted at St. John’s Church in Richmond. The event is free, taking attendees back to days of George Washington and Thomas Jefferson. Glen Allen is the place to go for a little relaxation on Labor Day, with a wine and cheese pairing. For $10.00, The James River Cellar Winery will offer various combinations of cheese, along with its award winning wines. Don’t forget about Kings Dominion’s 40th anniversary celebration, which includes a concert by R&B artist Jason Derulo on Friday. Pair
that with rides for all ages, from the kid friendly adventures of Planet Snoopy to the thrilling Intimidator. Visitors can also enjoy the Waterworks water park, which is included in the park admission price. Kings Dominion is open throughout the Labor Day weekend from 10:30 a.m. to 10:00 p.m. Saturday and Sunday. The park closes at 8:00 p.m. on Monday. Heading East to Celebrate
If you prefer to spend Labor Day basking in the sun, Virginia Beach is brimming with weekend activities. The Rock and Roll Half Marathon takes place on Sunday, and it includes a national recording artist on the main stage. The American Music Festival is also scheduled, filling the oceanfront with sounds of rock, R&B, and jazz music. With a combination of regional and national acts, visitors will be tapping their toes and snapping their fingers all weekend. Then, when you are ready for a good meal, head over to the Founders Inn, where the annual “Porkout on the Patio” is offering pulled pork and BBQ ribs in a relaxing environment. You don’t have to fight the beach traffic though. Williamsburg is bringing awareness to Chesapeake Bay conservation with an annual crab race. In addition, The Taste Tradition starts Friday at the Williamsburg Lodge, where area chefs prepare contemporary dishes. You can end the night by enjoying a symphony under the stars. Starting at 8:30 p.m., guests can enjoy beautiful music while gazing at the nighttime sky. Enjoying the Mountains and Valleys
If the mountains are more to your liking, the Bland County Fair continues through Saturday with good food, contests, and rides. Stuart invites visitors to a Labor Day gospel celebration. The foothills of the Blue Ridge Mountains will be filled with sounds of praise on Friday, Saturday and Sunday as gospel bluegrass groups perform. The Shenandoah Valley is hosting the Patsy Cline Music Festival on Saturday, offering tours through the Patsy Cline Historic House and an outdoor concert at night. The Highland County Fair and the Shenandoah County Fair are also on tap for the Labor Day weekend.

CIVIC BEAT
FUNdraising Good Times Ice Bucket Challenge
In
the heat of summer having a bucket of ice water thrown on you may not be a bad thing. It’s a phenomenon that’s sweeping the nation – contagious fundraising spurred on by social media, sports celebrities, television hosts, movie stars and international performers. Everyone – it seems – is in on it. Well, except for the two of us. We are enjoying the summer heat with no ice water – but we’re giving to ALS anyway. Here’s the reason: we want to be “in with the in crowd.”
We’ve known of ALS – otherwise known as Lou Gehrig’s Disease – for decades. But no one has ever asked us to give to The ALS Foundation. There are so many worthy non-profits to give to, and like most people we have a limited budget. But, how could we not give when the nation is gripped with the ice bucket challenge?
In case you don’t know, here’s a quick overview of the challenge: someone challenges you to give to ALS. If you don’t, you have to have a bucket of ice cold water dumped on you. Even better: have it video-taped and posted on social media. Once you complete the challenge you have to challenge others to give or get wet. Here’s the thing: many people are doing both. It’s fun. The videos are hysterical. And the money is pouring in. The numbers from their recent press release are astounding. “As of Tuesday, August 19, The ALS Association has received $22.9 million in donations compared to $1.9 million during the same time period last year (July 29 to August 19). These donations have come from existing donors and 453,210 new donors to The Association.”
And ALS knows receiving gifts is just the beginning. “Our top priority right now is acknowledging all the gifts made by donors to The ALS Association,” said Barbara Newhouse, President and CEO of The ALS Association. “We want to be the best stewards of this incredible influx of support. To do that, we need to be strategic in our decision making as to how the funds will be spent so that when people look back on this event in ten and twenty years, the Ice Bucket Challenge will be seen as a real game-changer for ALS,” she continued. The ALS Association is committed to communicating with donors and the public about future plans to spend the unprecedented amount of money it has received over the past few weeks.
So, should your nonprofit or college go viral with a “gimmick” to raise millions? Here are our thoughts: put the fundamentals in place first. If you can’t track and thank your donors, you don’t want thousands of donors: that can become a viral disaster instead of success.
Next week: more about the fundamentals.

For Older Adults, Regular Exercise May Stem Aging Effects StatePoint
O
ne out of every three adults over 65 years old falls each year, according to the Centers for Disease Control and Prevention. And for older adults with dementia, the risk of falling is three times higher than those with no cognitive impairment, according to the AARP Bulletin. However, research supports the notion that many of the physiological changes related to aging -- such as loss of balance -- can be prevented or postponed with regular exercise. With this in mind, it’s no surprise that many senior living communities are making comprehensive health and wellness programs available to their residents.
“We’re seeing residents increase their mobility, endurance and balance, and improve their range of motion and fitness levels,” says Katie Westberg, national director of Life Enrichment at The Goodman Group, a company that has developed a new fitness program for its senior living and health care communities. Additionally, Westberg cites that participants feel better and are having fun, showing quick results to their overall well-being, “Many of the residents involved in our FIT Functional Fitness program start seeing long-lasting and significant strength training benefits within an eight to 16 week period.” The experts behind the FIT Functional Fitness program, a new, national, personalized functional fitness program developed by The Goodman Group in partnership with a physical therapist and board certified geriatric specialist, are offering some tips for older adults looking to improve their

well-being and restore their vigor.
• Engage in exercises that can improve your core strength, balance and cardiovascular health. If you live in a senior living community, inquire about on-site programs. Additionally, many community centers and health clubs conduct exercise classes designed specifically for senior health. • Invest in a stationary bike. It’s easy to incorporate this activity into your day while watching TV, listening to music or talking to your family, and pedaling lowers blood pressure, according to AARP. • Consult your physician before getting started. Your exercise routine should take into account your current health level and functionality as well as your physical needs.
• Food and health are directly correlated, so pair your exercise with healthy eating. The FIT Functional Fitness program at The Goodman Group, for example, incorporates local, organic, seasonal produce as well as lean protein alternatives and plant strong ingredients in their menu options. • Stick to it. Results may come quickly, but a long-term health benefit requires commitment.
For more information about senior fitness and health programs, visit www.TheGoodmanGroup.com. While you can’t stop time, research shows that with exercise, you may feel better, longer.
