The Summer Clerkship Guide, produced with much hard work by the UTS LawStudents’ Society (LSS), is a great resource. It will give you information about the firms, the process, and tips about how to go about preparing an application. You can also read about the experiences of former summer clerks. Importantly, the Guide will provide you with information about the proper procedures to be followed throughout the entire process. If you are not sure about your plans, then the Guide will still be useful in providing you with information about the type of firms involved and the experience of working in these practices. If you are unsure, it would be good to read the Summer Clerkship Guide alongside the Careers Guide, another valuable resource produced by the LSS, which will give you an insight into the broader range of careers available to a law graduate. I know from my conversations with law firms that UTS:Law students are well regarded. However, the clerkship program is highly competitive and there will be many more applicants than places. But do not be daunted by the level of competition. If you think this is the type of practice that interests you, then put in an application. Just be realistic. Even if you are not successful in obtaining a clerkship, the experience can still be valuable. Preparing your application can help you identify your strengths and refine how you present yourself. Make sure you do your research about the firms you are applying for and examine your own reasons for choosing to apply to each firm. Interviews provide useful practice and experience. They will give you an idea of what is expected at a law interview and a chance for you to see

how you manage the interviewing process. Take time after the interview to reflect on it: what went well, and what could have been improved. Use the tips in this guide as an aid for that reflection (as well as a guide to preparing for the interview). It is important not to be too hard on yourself; we can all look back on interviews and wish we had said something differently! So whether or not you decide to participate in the program, and whether or not you are successful, the clerkship period can assist you to think about the type of career you want and improve your application and interviewing skills. And for those of you who are successful in obtaining a clerkship, the experience will offer you the chance to consider whether this is the career path for you. The clerkship process can be quite an intense experience, and may seem even more so given the competition for positions and current media reporting about the graduate employment market. However, this needs to be kept in perspective. The clerkship program and the firms involved in the program represent only a very small share of the career and employment opportunities for law graduates. There are many other career opportunities, but you need to seek them out. The LSS and the NSW Law Society’s legalvitae site may help give you an idea. Graduate employment for law is well above the national average for all disciplines. So, if you think a summer clerkship is for you, go ahead and apply. Enjoy the experience: learn from it, and keep it in perspective. And finally, good luck with the process.

Penultimate students, the time for summer clerkship applications is here! The UTS LSS Clerkship Guide is here to answer all your questions and help you put your best food forward in the clerkship application process. In the following pages you will find tips and tricks from students who survived and thrived during their clerkships, detailed profiles on a number of available firms, and tips for the development your cover letters, curricula vitae, and preparing for interviews and psychometric testing. Whilst the clerkship process is highly competitive, I encourage you to be confident in your abilities and know that the legal education you have received at UTS:Law has prepared you well. Maximize your potential by giving yourself plenty of time to prepare, structuring your application towards your strengths, refining and personalising your CV and cover letter, and using your words wisely. Lastly, this time can be very stressful. Remember to look after yourself! You are also encouraged to take advantage of the UTS LSS Careers events throughout May to ensure you are in the best possible position whilst applying. The UTS LSS hosts a number of events to assist you in your application process: Skills Workshops are your chance to learn the skills you’ll need to succeed in the clerkship process from the very firms who will be reviewing these applications. From how

to write your CV and cover letter, to shining in your interview, developing your commercial acumen and perfecting your personal brand, the UTS LSS is committed to priming you for clerkships. As part of our Clerkship Seminar Series throughout May, firm representatives (HR, past summer clerks, current graduates and partners) will give an hour-long presentation on their firm, including culture, values and opportunities for clerks and graduates and answer any questions you may have. The Clerkship Seminar Series culminates in the Clerkship Networking Evening on the 16th May 2018, the perfect opportunity to practice your networking skills in preparation for firm cocktail evenings, clear up any final questions and get to know the firm before applications are submitted. We know that the summer clerkship application process can be daunting. We hope that this guide helps you make informed choices and arms you with the tools you need to make your application the best it can be. Within this guide you will find tips and tricks from past clerks to help you perfect your application, important dates in the application period and a range of resources to help you find the organization that resonates with you. Each firm offers something different – international exposure, practice areas, technology and innovation… the list goes on. Whilst the process can be intimidating, the summer clerkship experience is extremely rewarding, allowing you to gain valuable skills in the industry, putting skills from the classroom to practice in a workplace setting, and helping you figure out whether corporate law is the path for you. Remember that this is a learning experience. Make the most of it! Lastly, look after yourself! The Clerkship process can be overwhelming at times. Remember to take time out and keep things in perspective. There are many routes to a career in the law – clerkships are not the be all and end all. Law students are an incredibly diverse group – and their careers reflect this. I’d like to thank the incredible sub-committee – Grayson Gay, Victoria James, Katherine Spasich, Sabrina Ebrahimi, Eugenia Alabasinis, and Phoebe Armstrong for their ongoing hard work and invaluable assistance. What Is A Clerkship?

Clerkships are internships offered by participating law firms to university students. They are designed to provide university students with work experience and training in different legal practice areas, and to give greater insight into the legal profession. Throughout their clerkships, students receive technical training and support, which will help them make more informed career decisions.

Generally, clerkships are held over the summer break in NSW between December and February. Students in their penultimate year are eligible to apply. These programs vary in length and run anywhere between 4-15 weeks. Many of the firms use clerkships as the first stage of their graduate recruitment process and summer clerks are often offered graduate and paralegal positions at the conclusion of their clerkship. The 2018 NSW Summer Clerkship program is coordinated by the Law Society of New South Wales, with each participating law firm running its own separate application process. More information about the clerkship program, dates and the contact details for each firm can be found on the Law Society’s website.

Law firms specialise in various practice areas such as commercial litigation, bankruptcy and insolvency, property law and intellectual property law, and each has different acceptance criteria. It is recommended that students conduct extensive research on the firm before applying for a clerkship, in order to understand a firm’s culture, ensure that they meet the selection criteria, and choose a law firm whose goals align with their future aspirations. When selecting students most suitable for the role, law firms will consider students’ academic achievements in conjunction with their practical experience and involvement in extracurricular activities such as clubs and societies, sports, mooting and volunteering. For those students who do not obtain a clerkship or are not interested in commercial law, there are a number of alternative avenues available. These opportunities include unpaid internships at Community Legal Centres, paid or unpaid work experience at boutique or mid-tier law firms, as well as graduate recruitment opportunities.

The clerkship process is very competitive. Each year, approximately 1200 students apply to Sydney’s leading law firms. Generally, each leading law firm only accepts 20 applicants, however, this number can fluctuate. It is not uncommon for a law firm to recruit up to 40 clerks one year and the next year to only choose 15 clerks. Due to these trends, some students may opt to look for clerkships interstate, where there may be more opportunities including federal government internships in Canberra. Due to the highly competitive nature of the process, it is vital that students approach the application process in a prepared and professional manner.

Summer Clerkships: A Practical Guide.

APPLICATION PROCESS: COVER LETTERS As the saying goes, always put your best foot forward. Your cover letter is usually what recruiters will look at first, so take the opportunity to make a good first impression. It’s very important that you don’t just regurgitate your CV. Instead, clearly articulate why it is you are applying to that particular firm, and why you are different from the ocean of other applicants vying for the same position. Make it obvious that you have chosen that firm for a reason - pick something specific, such as their exposure to particular areas of law that interest you, or the opportunity to move overseas within the firms through their international offices. It is always a good idea to include a sentence or two about yourself that does not involve the law. This helps the recruiters gauge your personality outside of the world of law, and determine whether you are the right cultural fit for their firm. Hot tip: “If you have an interesting hobby or have been involved in something fun at University, then don’t forget to include this in your application. Law firms are looking for unique and diverse individuals not robots.” – Dasha Konnova (Linklaters summer clerk 2017/18)

CV Recruiters have to carefully assess thousands of CV’s every clerk season, so keep it clear, organised and concise. If you’re stuck for how to approach layout, check out the UTS Careers Website and CareerHub for helpful resources and information on how to meet with a Recruitment Advisor. You want your CV to be succinct and high-impact, so always introduce your strongest selling points first and avoid being unnecessarily descriptive. Two pages is a good target for length, though slightly longer can be okay. Some firms have strict restrictions on page length, so make sure you check their requirements first. QUESTION RESPONSES First and foremost, check your grammar and ensure that there are no errors or typo. Recruiters are looking at your ability to express yourself, and a silly mistake can really impact their impression of you. Second, do your research. Firms can tell when you copy and paste your responses

from one application to another, so get started early and invest some time into tailoring your answers to suit the firm’s individual values, strengths, and goals. Finally, be genuine. Don’t just emulate passages from their website, provide a personal insight or opinion where you can. Hot tip: “Remember that sometimes less is more. It is a lot harder to write a concise cover letter or application that has all the relevant information than to plug in sentences that you think make you ‘look smart’. Being able to synthesise content in a meaningful way displays a commercial mindset that all firms look for in a candidate.” – Dasha Konnova (Linklaters summer clerk 2017/18) PSYCHOMETRIC/APTITUDE TESTING Increasingly, law firms are utilising methods such as psychometric and aptitude testing as a way to indicate problem solving and analytic skills. While these tests can be daunting, try to think of it as another opportunity to demonstrate your strengths. Different firms use different tests, but a few of the more common ones are the verbal reasoning test, the critical thinking test, and the Watson Glaser test. Half the challenge is becoming familiar with the style of questioning, so make sure to do a few practices before you take the real thing. 1. Be prepared. This is a no-brainer. Get to know the firm inside out. Their values, the work they do and their culture.

2. Know who you are. This one seems obvious, but often students are so caught up on memorising the law firm website or their current deals, that they forget the little things like to re-read their application before the interview. Know the firm, but also brush up on a few things about yourself that you can talk about. For example, think about some experiences you easily can draw on in an interview to demonstrate certain skills or strengths you have. 3. Prepare some questions to ask them. The interviewers want to know that you have a genuine interest in their firm, so make sure you have a few questions up your sleeve to put to them throughout the interview. For example: What is the approximate size of most teams within a practice group at your firm? Does your firm offer international secondments? 4. Take a breath. Literally. Before every answer you give, even if you have prepared a response to that exact question, take a moment to really consider what they are asking and the best way to approach a response. Rushing your response leaves you looking nervous, flushed and disorganised. 5. Be yourself. Corny, I know. But one of the most common complaints of recruiters is when interviewees tell them only what they think the recruiters want to hear, rather than being honest. Obviously, present yourself as eager and professional, but if they ask you a question about your hobbies or interests, keep it light and don’t turn every single sentence into a spiel about commercial law.

Hot tip (2): “In the interview context, try to have three parts to any answer. If you are asked the question of ‘why X law firm?’ then be prepared to give 3 non-generic reasons. This will ensure that you remain concise and clear and don’t carry on. They will ask you to elaborate if they require more detail.” – Dasha Konnova (Linklaters summer clerk 2017/18)

Psychometric testing: What Is It?

WHAT IS PSYCHOMETRIC TESTING? The term “Psychometric testing” actually refers to a vari-

ety of tests – and firms will use different styles of testing. As a general rule, these tests look at mental abilities and behavioural style. They are not IQ tests.

Aptitude tests are designed to measure work-related cognitive capabilities. They are structured in a way that only 1-5% of the population can solve all the questions within the given time frame.5 These tests assess:

WHY IS IT USED? Firms often use psychometric testing to: Measure your suitability for the role Identify hidden characteristics and abilities Inform questions for interviews Work out a development plan during employment The weight that is placed on the results varies between law firms. WHICH FIRMS USE IT? Several law firms use psychometric testing as part of their clerkship application process. These include: King & Wood Mallesons Clayton Utz - logical ability assessment via psychometric testing provider, TalentQ1 PwC - online aptitude test2 Herbert Smith Freehills - occupational personality questionnaire3 MinterEllison - numerical, verbal, and abstract reasoning tests4 This is not a complete list. Check the firms’ website to see whether their application process involves psychometric testing.

Abstract reasoning: the ability to quickly recognise relationships, trends and patterns in organisational data, such as identifying and predicting the next shapes in a logical pattern. Verbal reasoning: these test your ability to read passages of information, identify correct statements; and logically condense it into a simpler form. Numerical reasoning. These measure numerical reasoning skills, including the ability to quickly recognise relevant issues from numerical data e.g. graphs, tables, and charts. These tests DO NOT assess mathematical capabilities. Personality tests These tests are designed to assess behavioural styles, personality characteristics, opinions and attitudes. Typically, this involves measuring an individual’s attributes against the firm’s core values and culture in order to work out whether someone will be a ‘good match’.6 Questions often involve selecting the extent to which you agree with a statement, ranging from strongly disagree to strongly agree. E.g. I like to work independently 1. Strongly disagree 2. Disagree 3. Neutral 4. Agree 5. Strongly agree HOW TO PREPARE 1. Find out what different law firms are looking for in candidates, such as desirable attributes and values. This information is often available in the job description. Alternatively, ask recruitment staff. 2. Familiarise yourself with the different types of psychometric tests and the styles of questions that the

firms you’re applying to use. Check their website, or speak to experienced clerks. 3 . PRACTICE PRACTICE PRACTICE: There are a variety of practice tests available online: see www. psychometricinstitute.com.au. 4. Ensure your mental and physical wellbeing is strong, by making sure you eat well and get lots of sleep before the day of your assessment. 5. Strengthen your numerical, logical reasoning and verbal reasoning skills. This can be achieved by reading widely and revising how to interpret charts, graphs and tables.7

It is a good idea to address in your application form why you were unable to apply for, or complete, a clerkship in your penultimate year. That’s where we come in. Once you’ve completed your studies, our national Graduate Program gives you the perfect foundation for your legal career. Our 2.5 week orientation program is designed to ensure that you’ll hit the ground running. It consists of PLT+, local training and a national orientation week in Sydney. Our rotations will help you discover different areas and find the right fit. Herbert Smith Freehills occupies a high position in the directories and the collective student imagination, but those weren’t the only reasons I decided to join the firm. I was also looking for a place which genuinely values developing its people and has a sense of humour – friends of mine who had been clerks highly recommended the experience, so needless to say I was keen on joining Herbert Smith Freehills from the outset. The final selling point was actually having the opportunity to meet people from the firm at various stages of the process. The firm has a uniquely relaxed approach to its interviews, which are conversational and conducted oneon-one rather than behavioural or by panel. All the people made me feel welcome and the firm really seemed like a place where people took their professional work seriously, but were personable and always willing to have a laugh.

If you have absolutely no idea what area of law you want to work in, the clerkship is perfect for you. I was placed into Employment, Pensions and Incentives during my first rotation and Environment, Planning and Communities during my second. Despite having no prior knowledge or experience in these areas, I soon developed a working understanding of them and thoroughly enjoyed the learning process. Both groups work with highly specialised legislative frameworks, and so they undertake a mix of transactional, advisory and litigious work. As a clerk, this meant that I was given lots of different tasks, including legal research, helping to draft advice, correspondence, witness statements and court documents, as well as assisting with relevant aspects of due diligence. Highlights of my time in both groups include being a part of meetings with a pro bono client about to appear in the Fair Work Commission, presenting on updates to planning law, attending judgment for a regulatory prosecution in the Land and Environment Court, and taking a trip to Newcastle with my team to meet with environmental regulators for a client. These were fantastic learning opportunities that gave me an exciting insight into what commercial lawyers do on a daily basis.

While it’s challenging, you’ll have experienced giving advice under pressure and received some great feedback. Don’t stress – the exercise isn’t there to judge whether you make the cut to receive a graduate position, but to give you an opportunity to identify both your strengths and some areas in which you can improve; and

lawyer) and a buddy (a graduate). These are the people who are there to help when you don’t even know where to begin on a task. Everyone is genuinely interested in your learning and development, and in my experience always took the time to explain the factual and legal context of a matter even if it wasn’t needed to perform the task at hand.

Clerkship program

There’s nothing more important than finding a role and an organisation that’s right for you and there’s no better way to really get to know our profession than gaining practical, hands-on experience. Our vacation clerkships will immerse you in our business, networks and the international world of law. We encourage students to participate in our vacation clerkship program and we fill the majority of our graduate positions through this program. As a vacation clerk, you will be given extensive training on all aspects of the firm, drafting and research skills. Current lawyers and partners will speak to you about what they do and the nature of work in each part of the firm. You’ll attend workshops and presentations that will give you an insight into the depth and breadth of our practice areas and international reach. You’ll be invited to a range of events giving you the opportunity to network with partners, associates and graduates, as well as with your fellow vacation clerks.

Our structured four week program helps clerks learn through a combination of hands-on experience, training, coaching and observation. Students who complete a clerkship are eligible to be considered for a position in our next graduate program, commencing in 2020.
