Energy wise, you couldn’t ask for a better time to do a ground breaking ceremony, especially for growing things,” Ellis said. A ribbon cutting ceremony announced the opening of Earth Wise Organic Farms with Jaime Farms June 20. Together, they have created a local organic farming co-op. As people were arriving for the ceremony, locals mingled, tasted strawberries from Pipes Canyon, put their names into a container for winning a basket of fruits and vegetables, and talked with Dr. Robert Ellis, ND, chairman of the Earth Wise Organic Farms board. With about fifty people in attendance, including the Yucca Valley Chamber of Commerce, Ellis said, “If each one of you told five of your friends, we are an instant success.”

There are 500 share openings for the co-op with 12 week co-op cycles. To keep the farm in a true organic style, everything will be produced in-house, including worm castings from a two acre worm farm on location and seeds from the plants being grown. Worm castings have been chosen for many reasons–from keeping the ground from going hot, and preventing ground water contamination as with other farm animal manures. This is especially important since the surface of the farm is only 110 feet above the underground aquifer. The well water that is being used to water the farm had quite a different taste than most of us have become accustomed to here locally. The taste had quite a delicious softness to it compared to the piped-in water. To conserve this water, instead of sprinkler systems being used, there will be a drip system installed, with PAGE 31

Laughing Man Ejected from Council Meeting Gets Last Laugh BY DEAN GRAY

Yucca Valley, CA - It was not the same raucous mob that filled the chambers in opposition to WalMart a few months back. This well-behaved crowd at Tuesday’s council meeting raising their hands in support of public speakers, instead of clapping. Toeing the line with near perfect assembly room manners, hardly anyone spoke out of turn. Nonetheless, against this backdrop of raised hands and orderly decorum, Yucca Valley Mayor Luckino often found the audience objectionable and ran the meeting as if he alone were holding back a mob. A contentious policy change in how the Mayor of Yucca Valley should be selected was beaten back. It took two hours and the issue was solved more by exhaustion than intention. Unless the council revisits the issue again, councilwoman Lori Herbel will take her turn serving the town as mayor. It was not lost on anyone that the change was proposed just before Herbel was scheduled to take her seat in an 18-year-long tradition of a rotation system for seat selection. It was a simple process never before contested. Herbel and others argued that, quite simply, some men did not want Herbel to advance and those men chose to change the rules. It was not that break in Yucca Valley tradition, though, that caught this reporter’s attention. It was a break in the traditions of free speech and, to a somewhat lesser degree, PAGE 30

Mayor Selection Unchanged Herbel Continues Tradition BY LYNDA HERRINGTON, JACKIE DEVEREAUX & DEAN GRAY

Yucca Valley, CA –Was it a matter of just “cleaning up the language” or was it a move to pull the rug out from under Councilwoman Lori Herbel’s right to a legal precession in office, thereby denying her the legal tradition of serving as mayor? The agenda topic giving so many people indigestion were the recommended change to municipal ordinance 2.05.210, which regulates how council members move into the Mayor Pro Tem and Mayor positions The debate which lasted a couple hours at Tuesday’s town council meeting included passionate public comment, and strongly-worded council commentary, and resulted in no change to that public policy. This counts as another win for Herbel and a bonus double victory for women and those who are speaking out about preserving the local quality of life.

The first hour was dominated by a city budget report presented with the aid of Old Testament parables about Joseph’s cows. However, many seats in the room were filled by those waiting to argue against the “good old boys network” which enjoys taking potshots at Herbel. The council meeting erupted with both the public and Herbel upset that the maledominated council was proposing changing the legal rotation of succession to the mayor’s position. That’s because Herbel is next in line for the position of Mayor Pro Tem, then rotating to mayor. In his comments, current Yucca Valley Mayor Frank Luckino spoke confidently about eliminating the “legal and traditional rotation in office,” and changing it to a “selection process” which was later criticized as a “popularity

contest” based on an “undefined quality of merit” and “the ability to lead a meeting.” Many public speakers objected to Luckino succeeding himself, a condition he boldly and blithely alluded to several times at the beginning of the meeting, but later withdrew as time wore on. The well-behaved crowd raised their hands in support of public speakers, instead of clapping. The silence was at times oddly deafening as screaming arms and hands frequently shot to the sky. Many in the community believed that the recommended changes would cause Herbel - the only female on the Yucca Valley Town Council - to be denied her move into the position of Mayor Pro Tem in December. This concerned most in attendance who expressed a belief that the PAGE 31

ARTIST IN FOCUS Jude Bischoff is an athlete, naturalist, father, dreamer, and artist who revels in the natural energy of the world around him. Trained as a fine artist, Jude received a Bachelor of Fine Arts from Bowling Green State University, but a new family and responsibilities sidetracked that chapter of his life for over two decades. Now, after raising two lovely and talented daughters and achieving a successful career in real estate, Jude has thrown himself back, completely and with abandon, into the world of art. Everything Jude does, he does with passion and fervor, whether mountain biking, rock climbing, experimenting with a new set of acrylics, drinking wine with his friends, or just gazing at the stars from the solitude of a desert campsite. Jude is an intense, complex, insightful, self-effacing soul whose hearty laugh and earthy handshake echo the inner strength that guides him on exotic, off-the-beaten path adven-

tures. His art exudes his love not just of nature, but of life itself. Through his powerful oils, bold acrylics, sensual water colors and increasingly through his mixed media works, he seems to channel the very essence of life, the unseen driving forces of the universe, into something seeable and knowable. And that gift of vision and insight is present in all fine art. Seeking to express the wild inside, Jude plays with the fire of fantasy and discovery, going deep into the dark forest of imagination where others would fear to tread. In fact, some of his more recent works have been literally put to the fire, as in burned over the embers.of desert campfires, by the light of a winking moon. Jude constantly seeks new adventures and new forms of artistic expression to share with others his love of being. And that is his gift to all of us. ■

In his own words My art reflects the extreme energy encountered in negotiating the outdoor landscape and the joy I find in exploring both outer and inner worlds. This can be found anywhere from hiking under a magnificent sugar pine tree to flying over a jump via a mountain bike. These paintings respond to life’s dance and fire within. Jump from a tall cliff into an icy alpine lake, trail run over a mountain pass or climb the northeast arête of Bugaboo spire. Graze your hands through the desert’s red rock floor. Do you feel the dance? The natural world swims through my paintings like a fat bellied fish in a surreal colored mountain stream. At its heart is a profound connection to the known and the great-unknown. The natural universe—icy restless peaks, opaque water pools, the exceptional humanity and beauty of human endeavor and the supernatural universe— the spirit world casting its energy through rocks, ravines, chasms, and human behavior. The seemingly disparate images I paint—turtles, tongues, dogs, ducks, bearded wise men, etc. demonstrate the untamed spirit that flows through all things and that presents itself freely in dreams and imagination. “Jude paints bold in-your-face images”, said a friend describing my work. I feel a painting should speak for itself. I may at times use words or phrases in a painting, but only as an aside to the visual impact of the image. Every line, brush stroke, color field represents a myriad of ideas and thoughts brought together like a series of seismic eruptions forming an immense mountain. A geologist told me Mammoth Mountain did not exist 100,000 years ago. My latest painting did not exist two weeks ago. ■

While I know Lori Herbel hits a rough spot with the annexation question, she is still the most reasonable of council members and is about to be dumped from a traditional succession on the town council. This typifies the type of shenanigans that makes me fight against being taken over by the town council. However, if there any way to demoralize the “operators” on YV town council and, thereby, help dissuade them from pursuing a future “hopeless” election on annexation this would be a chance. As bad as “Sphere of Influence” is, annexation will be worse. Showing support for Herbel could, I believe, help the Mesa in the long run. The Mesa’s problems are immediate but we are locked toward the future whatever that may hold. Please forward to all and try to show up. And speak if possible. TOM’S BIZ TIPS Is Any Publicity Really Good Publicity? BY TOM GREEN

You have heard the phrase, “Well, at least bad publicity is better than no publicity at all.” Is that really true? Well, actually No. The buying public has become more intelligent in some ways and they realize that business advertisers can buy publicity when they want it.

... most small businesses fall flat on their face when it comes to generating this type of publicity ... Where the general public remains gullible is when it comes to the various media and many still watch and listen to them with their skepticism guard down. This is where FREE publicity comes in handy and works well for small businesses promoting their wares on a shoestring. This is the good news. The fact is that most small businesses fall flat on their face when it comes to generating this type of publicity, even though it is really pretty easy to get. Everyone of you should have in your marketing plan to get FREE publicity on a regular and consistent basis. Here are 8 simple things to remember and follow to get the free publicity you deserve.

Vacation used to be a luxury, but in today’s world, it has become a necessity. Author Unknown

#1 YOU MUST GENERATE SOMETHING NEWSWORTHY ABOUT YOUR PRODUCT OR SERVICE.

Remember that a key job of newpapers, radio, TV and all media outlets is to bring news to their audiences. #2 YOU MUST CREATE AND CARRY OUT A SOLID PUBLICITY PLAN Most small businesses don’t like to plan or are just too darn busy making payroll to stop and create a plan. However, this is what’s required. Research your audience, media available, and the message you want to project – then implement the plan. #3 USE A BIT OF FOCUS AND TIME MANAGEMENT. If you think you are going to followup with every media source and get to the right person, you will do nothing else. My suggestion is you start with 5% of the plan being a direct contact and 95% being a strong consistent Direct Mail campaign. #4 PERSISTENCE Along with focus and time management is persistence. No one wants to hear it yet a consistent, persistent good plan that you

chunk and tweak may not be a secret, but it is the secret. #5 INGENUITY You’re competing with everybody else, so you have to use Ingenuity. A marketing guy I once knew was trying to get past the gateway secretary and knew the CEO was a runner. He sent the CEO some new running shoes with his message inside. #6 ONCE YOU GET THE FREE PUBLICITY, PIGGYBACK IT TO MORE SALES One simple one I have used is “As Seen On TV”. You can also reprint the article as you see in many restaurants entrance. There are many other ways to piggyback. #7 TAPPING INTO COMMUNITY SERVICE. For example, donate half your sales to something. #8 MEASURE YOUR RESULT. I talk about this all the time yet few businesses track properly, if at all. Set up an easy system for tracking–and do it. I hope this outline gets you started getting the free publicity you deserve. To your business success. tom@americanfreejournal.com ■

LIVING LONGER The Ten-Second Miracle BY ART KUNKIN

JUNE 25, 2009

7

A vacation trip is one-third pleasure, fondly remembered, & two-thirds aggravation, entirely forgotten. Robert Brault

Many things in my life changed two years ago when I realized I had probably found the secret of living for hundreds of years, hopefully without experiencing the illnesses and suffering normally associated with aging. For example, although approaching 80 years of age, I began once again to actively plan new projects, plus I developed a renewed interest in learning more about the communication tools by which living with other people becomes easier. Thus, it was with great pleasure a few weeks ago that I purchased for twenty-five cents at a second hand store a 1998 book called “The Ten Second Miracle” by psychologist Gay Hendricks that teaches a wonderful tool for living in happiness. The Ten Second Miracle is a one sentence insight, often a question, addressed to another person but sometimes to oneself, that cuts through the upset caused by a strong negative emotion to bring almost instant relief. In this short article I can only summarize Hendricks’ simple method for creating an alternative to having a long argument and/or sustained bad feelings. In the book, however, he has the space to give hundreds of examples of exactly what to do and say in specific circumstances to create such an instant miracle. The basis for the Ten Second Miracle is the knowledge that there are only a few basic

LOVING CARE In-Home Services

There are only a few basic negative emotions that accompany a problem As Hendricks explains, fear is experienced in the stomach. During the hundreds of thousands of years during which the human body has evolved, the body has learned to stop the digestive process when the body feels fear. Energy is then diverted to the urgencies of fleeing or fighting and the stomach feels strange. Anger similarly is expressed in the

negative emotions that accompany a problem or misunderstanding. Furthermore, these emotions are always expressed in the physical body in discomforts and facial expressions. The key to producing the desired miracle is to train oneself to withdraw from the tension of an argument or problem for ten seconds while identifying which of the emotions is being expressed by yourself or another person.

body through discomfort in the muscles of the neck and upper back. Sadness and longing are felt in the chest. Then, having identified one’s own emotion and the emotion of the other person, the Ten Second Miracle begins when the person consciously wanting to turn the problem in a positive direction pauses and shifts from argument mode to gently asking a question about the emotion itself or taking responsibility or making a truthful statement about your own deep feelings. For example, “I’m scared of being alone.” Hendricks says “the truths that change people’s lives can be spoken in less than ten seconds, using only one breath… The breakthrough occurs the moment you say ‘I take full responsibility for what went wrong in my marriage’ while simultaneously giving room for the other person to take full responsibility. The type of responsibility that heals people’s lives never, ever involves blame.” Then, if the other person is touched by the insight and responds in a non-argumentative mode, the Ten Second Miracle continues and healing starts. Of course, if the other person doesn’t respond, the miracle process may well just stop. However, at the very least, you have deepened your own knowledge of how to turn negative emotions into positive emotions and you are likely to succeed better at the inevitable next opportunity. May you have many Ten Second Miracles in your own life from now on! Art Kunkin is the journalist who founded the alternative weekly newspaper, The Los Angeles Free Press, 1964 to 2009. Art’s book, “The Secret of Immortality Finally Revealed” is available through his web site, www. alchemyrevealed.com and at his blog, www. artkunkin.com. JOSHUA TREE - 29 PALMS Roto-Rooter Yourself Naturally Using Herbs to Cleanse the Kidneys BY CHARLA SHAMHART

Yucca Valley, CA - Herbal cleanses are popular now as people who are health conscious attempt to improve their overall health. The best known cleanse you may hear about is the “colon cleanse. However, many do not realize that doing this type of intestinal cleanout FIRST can put stress on a much more fragile system of the body; your kidneys. Your kidneys are designed to remove acids and are one of the most delicate system in your body. Kidneys were not supposed to have to deal with large amounts of protein, acids added to processed foods (but those vinegar and salt chips and other tangy additives are so yummy!) Sodas? It takes 28 to 30 ounces of good, pure water to neutralize just 1 ounce of soda. Why do the kidneys have to work so hard? Because the blood must remain at a very specific pH (the acid alkaline scale) or you will die! So the lungs, skin and kidneys work very hard to insure your very survival. Proper deep breathing is important because your lungs are designed to expel the majority of weak acids left over from digesting and metabolizing fresh vegetables, fruits, whole grains and a very small amount of protein. The acids that your lungs cannot re-

move are next addressed by your skin as you sweat. Bathing daily is very important to remove these acids which can cause premature aging of the skin because of their caustic nature. Did you ever hear anyone say we need to use soaps that do not remove the acid “mantle on the skin? This is a current popular myth. However, we are alkaline by design and acid by function. Acid on the skin is not good for you and will be replaced immediately by sweat containing more acids. But even more than what we eat, according to my teacher and mentor Dr. M. T. Morter, Jr., DC and founder of BioEnergetic Synchronization Technique (B.E.S.T.), your negative THOUGHTS and FEARS create strong acids instantly. If these acids are not quickly removed from the blood, the kidneys will manufacture ammonia to neutralize them and save themselves from being damaged by these strong acids. And ammonia causes chronic PAIN in the body. Did you ever hear someone say that they are too alkaline already and do not need to eat alkalizing foods or use supplements to become more alkaline? Their body is already in crisis mode!

“Where Arts and Crafts meet Junk and Treasures

There are many herbs used to cleanse the kidneys, but some work more gently and thoroughly than others. One of my favorite combinations is cornsilk and ground up watermelon seeds. A blend of these begins to dissolve the sludge that clogs the tubules of the kidneys eventually causing poor kidney function or leading to stones. Taken over a period of 2 weeks once or twice a year, these herbs can improve kidney function dramatically for many. I never use juniper berries, a popular kidney remedy, as the essential oils in juniper are a strong kidney irritant. Japanese Umeboshi vinegar –used frequently in food–or a glass of water assists proper calcium assimilation so the kidneys do not get clogged up with improperly stored calcium. The use of a natural vinegar (not the distilled white variety) is especially important on steamed greens, many of which contain oxalic acid. In the cooked form oxalic acid is known for forming kidney stones, yet greens are important to our health and not everyone wants to eat all of them raw. When stones have already formed, if they are not life-threatening I have utilized gravel root, also known as queen of the meadow, in combination with hydrangea root with clients who choose to clear the stones naturally instead of medical intervention. Please note that herbs properly brewed into fresh tea are often more effective than herbs in capsules, which tend to lose potency quickly. Also, boiling water, not stomach acid, is a good solvent for certain herbs to release their healing potential. Understanding how to prepare herbs, how much to use, proper combinations and potential side effects is very important. Charla Shamhart is an herbalist with over 40 yrs. experience. She offers private sessions in herbal and nutritional wellness, Breath of Life Trainings, weekly meditation classes, spiritual guidance and energetic clearing for homes and businesses. She will offer an herb workshop at The Center of Life, 7491 Barberry Ave. in Yucca Valley on Saturday, July 18 from 4-6 pm. Please call 760-401-0689 for registration or more information. â–

YUCCA VALLEY Letters to the Editor PAGE 5

Pro Tempore and then to Mayor has been a fixed rotation based on seniority. The intent is clear in Municipal Code 2.05.210: “It is the intent of the council to rotate the position of mayor and mayor pro tempore through the legislative body to provide each council member the opportunity to serve.” [Italics added] According to Town Attorney Haubert, rotation “… has been the tradition in Yucca Valley even before the adoption of Section 2.05.210”. Now, after 18 years of orderly successions, four members of the Town Council are about to vote to rescind this municipal code and replace it based on their discriminatory and exclusionary judgments: “must be earned”, “represents policy consensus”, “serves at the pleasure of the Council”, etc. Why now? Could it be that in December Councilwoman Herbel will rotate to the position of Mayor Pro Tempore and subsequently to Mayor? Could it be that Herbel’s solitary opposition to the flawed Wal-Mart EIR shamed the Council for its embrace of the Staff’s dereliction of “due diligence” by recommending approval of the flawed EIR? Could it be that the Superior Court struck down the flawed Wal-Mart EIR with stinging criticism of the Town Council, observing that Herbel’s “… concerns of evidence of inaccuracies and omissions … fell on deaf ears and the decision was made that very evening to adopt the project. “ Could it be that Herbel alone on the Town Council represents a constituency dedicated to conservation, sustainable growth, native plant protection, dark night skies and clean air? Could it be that Lori Herbel is being discriminated against by her male colleagues simply because she is a woman? Please voice your opinion on this important issue in any way you can. Sincerely, David Fick, President Morongo Basin Conservation Association www.mbconservation.org ■

PALM SPRINGS SCREENING ROOM

A vacation is what you take when you can no longer take what you’ve been taking.

Another look at great films for home theater BY ROBIN E. SIMMONS

EL CID: A WARRIOR OF PEACE? It was a long wait for a proper, high resolution, anamorphic DVD of this epic medieval tale of passion and chivalry. No doubt a Bluray is in the works, but the DVD transfer is stunning, the sound is rich and full. This is rousing entertainment on the grandest scale and is worthy of another look. It’s hard to understand why this film took

so long to arrive on DVD. Some have suggested the subject matter has been an issue in our over-sensitive, shrinking world of religious violence. Or perhaps our discomfort with nebulous concepts of love, forgiveness and peace. But most likely it was simply a matter of rights and licensing.

The relevance of this film remains current. It is a monumental artistic achievement of world cinema. On a personal level, this terrific film provoked me into thinking about how belief systems, especially about the nature of God (or Allah) -- benefit or harm our world. The essence of the conflict between warring Castilians and Moors and an invading Muslim threat is unflinching in the opening scene as the North African holy warrior Ben Yussuf quotes “the Prophet” as promising to conquer the world in the name of Allah. But the real conflict is the idea that there can be peace -- and perhaps even love -between those who hate. This is exemplified in the troubled and intimate story of Rodrigo (Charlton Heston) and Ximena (Sophia Loren). It begins simply enough with a knight on his way to meet his bride when destiny forces a detour. El Cid, the legendary hero of Spain was a real person named Don Rodrigo Diaz de Bivar. He lived around 1035 A.D. Although he spent much of his time fighting on the side of the Moors, he became identified as the best incarnation of the true Castilian Christian spirit. His name came from the Arabic “sayyid” meaning “lord” or “chief.” Charlton Heston and Sophia Loren are perfectly cast as larger than life figures of flesh and blood. Their reported on-set confllcts probably added a degree of on-screen realism. They are wonderful together. Too bad Heston and Loren were not able to do a full, shared commentary. Anthony Mann’s direction is robust and true to the theme. The movie has a fine sense of composition that the terrific on-location cinematography only enhances. Numerous action-filled vistas fill the screen, richly detailed and beautifully photographed. No CGI elements can rival the texture of a real place captured on celluloid. The incredible flow of stunning images and the magnificent Miklos Rozsa score are a reminder of what movies can do when they tackle a worthy tale and go all the way. EL CID is about a real hero who selflessly followed his moral compass. It’s also a reasonably true adaptation of the essence of the numerous medieval tales, plays and poems -- unlike the mangling of both poem and hero “Beowulf” in the recent movie of the same name. Amazing that this magnificent paradox of a tale -- after all, El Cid was a warrior and peacemaker -- continues to be told for a thousand years. The extras on the second disc include interesting featurettes on producer Sam Bronston, director Anthony Mann and composer Miklos Rozsa as well as vintage radio interviews with Heston and Loren and a “making of” documentary. HIGHEST RECOMMENDATION. Questions/comments? RobinESimmons@aol.com ■

HOROSCOPE ARIES (March 21 to April 19) A change of season reinvigorates the Lamb, helping to overcome the effects of a recent slower-paced period. This is a good time to restate your feelings for that certain someone. TAURUS (April 20 to May 20) You might not like using your authority to correct a workplace situation, but that’s what being placed in charge is all about. Besides, you have people ready to lend support if need be. GEMINI (May 21 to June 20) Your creativity continues to run high and helps guide you to make some fine choices in the work you’re doing. Keep the weekend endfree f for those special people in your life. CANCER (June 21 to July 22) Don’t be surprised if you experience a sudden spurt of energy strong enough to pull you out of that recent period of indecision and put you back in charge of your own goals. LEO (July 23 to August 22) This is a good time for Leos and Leonas to set new goals regarding health, educational choices and possible career moves. The plans you make now could be a blueprint for your future. VIRGO (August 23 to September 22) You might have much to offer a potential employer, but it can all be overwhelmed by too many details. Let the facts about you speak for themselves without any embellishments. LIBRA (September 23 to October 22) This is a good week to balance your responsibilities

to your work-a-day world with your obligations to the people in your private life. Expect news that could lead to a change in plans. SCORPIO (October 23 to November 21) A changing attitude on the part of a once determined adversary could cause changes down the line. Be prepared to take advantage of an unexpected new opportunity. SAGITTARIUS (November 22 to December 21) You’d be a truly wise Sagittarius to be skeptical about an offer that doesn’t answer all your questions. Even a colleague’s testimonial doesn’t replace facts that aren’t there. CAPRICORN (December 22 to January 19) It’s a good idea to avoid spending on unnecessary purchases this week in order to keep a money reserve against a possible upcoming (but, fortunately, temporary) shortfall. AQUARIUS (January 20 to February 18) More information is what you should demand regarding that workplace situation that recently came to light. Don’t be surprised at who might turn up as one of your supporters. PISCES (February 19 to March 20) You might still be in a “treading water” mode, but by midweek, a shift in your aspect favors taking a more active role in pushing for the changes you feel are necessary. Good luck. BORN THIS WEEK: You exude a warm, caring attitude that comforts everyone who comes into your life. ■ (c) 2009 King Features Synd., Inc.

Indio, CA- Exactly one week before the '70's Prog Rock band YES takes the stage at Fantasy Springs' Special Events Center, the Casino announced ticket sales for September's concert by Crosby, Still and Nash. It seems ironic that while many of the Havy Metal "Hair Bands" of the eighties trying to make their comeback on the Casino Circuit often come across as sad parodies of themselves, and yet groups twenty years older have found the maturity to reinvent themselves, fnding a new life in old songs. Like a vintage wine, the flavor of these performances become more complex, layered with significance, nostalgic without settling for sentimentalism. Far and away the longest lasting and the most successful of the '70s progressive rock groups, Yes proved to be one of the lingering success stories from that musical genre. The band, founded in 1968, overcame a generational shift in its audience and the departure of its most visible members at key points in its history to reach the end of the century as the definitive progressive rock band. Yes has retained the same sound, and performed much of the same repertory that they were doing in 1971; and for their trouble, they found themselves being taken seriously a quarter of a century later. Their audience remains

huge because they've always attracted younger listeners drawn to their mix of daunting virtuosity, cosmic (often mystical) lyrics, complex musical textures, and powerful yet delicate lead vocals. Forty years into their creative partnership, Crosby, Stills & Nash take to the road to entertain fans new and old. The three legends of rock hit the stage at Fantasy Springs together, Friday, September 25, 2009. Tickets went on sale Friday, June 19. Prices start at $49. Crosby, Stills & Nash were revered as one of the world"s first supergroups Each principal band member came from another hugely successful group (The Byrds-Crosby, Buffalo Springfield-Stills, The Hollies-Nash), but later joined together to form CSN. As the story goes, the three singer-songwriters first harmonized while spending time either in Joni Mitchell's living room or Mama Cass Elliot's dining room. (Crosby and Nash swear it was the former. Stills contends it was the latter.) The bond they made as artists and friends seared deep and is still apparent after 40 years. Some of the group's songs include "Wooden Ships," "Guinnevere," "Helpless," "You Are Alive," "Southern Cross" and many more. DESERT HOT SPRINGS BY GABRIEL KING

Desert Hot Springs, CA – Building fees agreed to in the normal open democratic process are being undone. The cost of new construction is to be shifted to existing residents instead of newcomers to town. The Building Industry Association wants city money and is gutting the public art program by robbing it of funding. Two councilmen are in control. Details of the BIA deal concocted by two council members are beginning to emerge. The result of secret negotiations are now documented. These closed door negotiations have opened the door to the recently passed Art program being undone and run the risk of your taxes being raised by

undoing the recently passed Development Impact Fees. The Art Program and the Development Impact Fees were created using multi-year-long democratic process where the peoples representatives (cultural Affairs, Planning Commission and City Council) deliberated in open meetings with public input. This process used principles based upon our democratic representative government given to us by our founding fathers. This is a sacred process our country was founded upon. Councilmen Karl Baker and Scott Matas have thumbed their noses at the founding fathers of this nation and the people of our city by circumventing this

sacred democratic legislative process. They have done so by meeting with the BIA in secret behind closed doors to undo our Art program and our Development Fees. This is especially upsetting in that our city is the only city in the valley with has no real public art and our city has one of the lowest valley development impact fees. Studies prove the cultural value of public art and the enhancement of property values. This fired up the public last year to achieve progress that now appears ready to be abandoned just one year later, before the program collects one penny. No wonder top BIA executive director Fred Bell had PAGE 25

DESERT HOT SPRINGS Extreme BIA Influence a smile on his face last year when his opposition gained no traction against a public clamoring for art and fair development fees. The effects of our past city leaders cow-towing to the BIA is crumbling infrastructure amidst a lack of culture and beautification similar to our neighbor cities. One must ask, why has Baker and Matas continued this tradition? What have they to gain by eliminating these gains and keeping our city impoverished? The council that not long ago adopted changes the BIA does not like is the same council. What’s different? Why is there now a powerful imperative to snatch defeat from the jaws of victory? Below are the BIA submitted changes it wants to the art in public places ordinance and development impact fees. It calls those changes settlement offerings. That’s fancy talk for taking discussions behind closed doors under the guise of litigation. 1. One of the “settlement offerings” is a BIA contention that a “New-Construction Fee” still on the city’s books should be repealed. 2. The BIA contends all development impact fees paid over the last 7 years should be refunded because of a “New-Construction Fee” that is on the city’s books. It

it is seeking “alternate measures” for the arts program. (No details of the BIA alternate measures have ever seen the light of day. The debate is going on, in the dark, behind doors) 6. The BIA seeks up to a 33% reduction in Development Impact Fees. (It is not clear if that number is 33% less than the original $15,000 amount fancy talk recommended by the city consultant or 33% for taking lower than the lower fee of $11,085 by the City Council) discussions 7. On April 2, 2009, the BIA met with behind closed doors Matas and Baker, behind closed doors and without the public able under the guise to take part in the debate to debate changes of litigation. to development impact fees and art in public places. City Money league ball park and work is underway to complete a soccer park in time for the start of the AYSO youth Soccer season. In the last nine months, the city has managed to pave 20 miles of residential streets with seventeen more miles underway and schedule to be done in three months. A city police force has been expanded by eight sworn officers. Those officers were obtained from cities in California that reduced their police forces to try and make budgets balance. In the budget just approved, Desert Hot Springs made room for four more police officers to be hired. All that would seem to point to a city with deep pockets and a population of the well-to-do. Not so. By all accounts Desert Hot Springs is a poor city. Its median annual income is between

PAGE 8

$28,000 and $32,000 a year depending on the data used. It’s among the poorest cities in California. Part of the relief the city saw in the city budget was a recently passed utility user tax by the voters in the last election. That two makes Desert Hot Springs unique. In the same election where California voters overwhelming rejected tax increase measures, voters in Desert Hot Springs approved the tax increase by a 75 percent margin. It’s not all without worry that the budget picture will not change for the worse, however. A threat looms and it comes from the state capitol where California legislators and the Governor are trying to close a $24 billion and growing state budget deficit. To help balance the state budget, the legislature

has its eyes on dipping into city coffers. If it funds are raided by the state, said Daniels, Desert Hot Springs, a city that has dealt effectively with a seriously falling economy and the resulting loss to city revenues, could find itself trouble. The city has cut city administrative staff positions, taken advantage of savings by offering early retirement and taken other cost savings measures. Daniels said at Monday’s budget meeting, “This was a very difficult budget to balance. We don’t know what the Legislature is gong to do,” he said. “We’re doing it by osmosis and sometimes intuition.” What could make it impossible, said Daniels, was a state that can not seem to get its act financial act together such as Desert Hot Springs has. ■

Temple Inspection Reports officials were worried about the temple’s structural condition and said the city had hired a contract inspector to examine the building. Daniels told the newspaper that the inspector reported that the building would need new electrical and ventilation systems and that bathrooms did not meet Americans with Disability Act standards. In that interview, however, Daniels made no mention of concerns over Gleason’s caution that he was not qualified to perform a structural inspection and that he did not want to be held liable for his assessment of the structure. Months after the purchase of the building, the agency contracted for a structural engineering inspection, B.G. Structural Engineering, concluded most of the building was unsafe and must be torn down. Following receipt of the engineer’s report, Acosta delivered the news to the redevelopment agency board. In that report, Acosta told the agency the remaining section, a 3,000 square foot west wing, might be sal-

vaged. Acosta then unveiled a preliminary construction plan detailing an estimated $1.5 million worth of work to renovate the west wing. Acosta’s report that the west wing was safe conflicts with findings in the report by B.G. Engineering. The report states no structural inspection had been conducted and that the west wing predates at least 20 revisions to the California structural building code. Brian Gottlieb, owner of B.G. Structural Engineering and the person that performed the structural inspection, said testing of the block walls and foundations is needed before it can be determined the west wing is safe for occupancy. However, in the interview with the Desert Sun, the newspaper attributes a statement to Daniels that “the newer, nearly 3,000-square-foot west wing is up to code.” It is not clear why Daniels assessment of the west wing’s condition differs from that of Gottlieb. Explaining the agency purchase of the building and the revelation that much of the building would need to be

PAGE 8

torn down, Acosta said, “Any real estate transaction is a risk.” He said the temple purchase outweighed the risks by helping to ease blight, reported the Desert Sun. Justification for the purchase price was the promotion that the building would be useable immediately to serve the needs of the community and would be less costly than new construction. Recent estimates for repairs and remodeling exceed new construction costs. Also quoted in the Desert Sun article is Sam Spinello, owner of Spinello Commercial Real Estate Inc. who is quoted in the article as saying, “If you have a plan, stick with it.” It is not clear from the article if Spinello agreed with plans to purchase the temple building without first obtaining a structural inspection or if he agreed with plans to put another $1.5 million into the project. Spinello was a participant in a city council study session along with other real estate professionals asked to render an opinion on whether the city should go ahead with downtown redevelopment plans. That study session did

not involve discussion of the temple building. The city of Desert Hot Springs purchased the Jewish Temple in early 2008 for $1.4 million. A series of controversial revelations have plagued that decision. The building sits empty going on two years with no plans for use. Seller Rabbi Alon Barach has used his windfall profits to relocate to Israel where he has reportedly purchased a hotel. Barach also reportedly purchased a home in Desert Hot Springs. Both purchases followed the sale of the Temple Building by the Temple Barauch Hasham, Inc. to the redevelopment agency. ■

AMERICAN FREE JOURNAL & DESERT VALLEY STAR

Laughing Man Ejected Luckino’s break from decorum in limiting free speech. It was later in the meeting the mayor reacted harshly by quashing our precious first amendment rights that we will soon celebrate on Independence Day. We discovered that it’s not speech that can get you in trouble in Yucca Valley, it’s laughter. However, it’s doubtful the founders of America would be amused about what happened Tuesday night. Long-time Yucca Valley resident Bill Souder was speaking from the podium and offering his public comments, when a man in the audience laughed. The mayor scolded Souder, demanding he be serious. Then, suddenly, the mayor had the man who laughed physically removed from the meeting without even the courtesy of a warning. It was unclear if it was the mayor’s dislike for humor or his distaste for opposition to the subject on the agenda that caused this. The offense? Laughter! It was not a loud “hee-hee” nor a rowdy “harrumph,” not even a squeaky giggle, but instead, a single, subtle, quick “ha-hah” that Luckino found intolerable enough to order the Sheriff to eject the man who was enjoying the speaker’s attempt at rhetorical whimsy. San Bernardino County Sheriff’s Officer Miller could not recall any previous town council incidents of audience member ejection. A quick survey of officials and other attendees found no such incident in memory, especially considering it was such a short winded frivolous laugh and not some loud guffaw. This writer, and other journalists consulted, who have attended civic and government meetings for decades, cannot recall one incident of a laugh resulting in ejection. Souder did not actually tell a joke. Public comment, limited to three minutes, is the source of infrequent but

often refreshing comic relief, usually welcomed. Currently, as far as we know, there are no laws or policy prohibitions judging humor a criminal offense - even if delivered successfully. Other laughs were heard both before and after Souder’s remarks. Bill Horn was especially entertaining. Other comedic attempts did not lead to censure or ejections. It was not clear why the mayor singled out and interrupted Souder, censoring his public comments by demanding public comments not be humorous. The demands of the mayor led to a loud “Boooooooo!” from someone in the audience, originating from a source impossible to identify, but someone who obviously appreciates free speech and attempts at humor. Members of the audience and the council became irritated by the two hour drama. The mayor later ejected another man who asked, “Why don’t you put it to a vote of the people.” Sheriff Miller (again) found the subject cooperative as he was silently led outside the

Handcuffs and weapons were not needed in either case of expulsion, the officer explained. The event which caused the mayor so much consternation was his proposal to change the order of rotation of mayor, thereby denying councilwoman Lori Herbel her turn at serving in the leadership position, a traditional rotation awarding her the mayor seat in 2010. The mayor seemed awkward at times, often shifting uneasily as speaker after speaker railed against the

council’s move to deny Herbel her opportunity to serve. The current mayor mugged displeasure with a clenched jaw as the male dominated council was accused of orchestrating a misogynistic coup of discrimination against women. To the mayor’s credit, he later re-admitted both ejected men into the meeting and apologized. Both Mayor Luckino and Mayor Pro Tem Chad Mayes claimed the issue was “much ado about nothing” in a failed attempt to sweep the issue under the rug. Suggestions to continue the matter failed, as the only purpose it would have served was to endure those tense negotiations yet again. Both civic leaders complained about the onslaught of emails and phone calls objecting to their move to deny Herbel the tradition of serving as mayor. Mayes spent considerable time explaining in a loud stern voice how hurt he was to be “considered a bigot” and used this indignation to attack those critical of his proposal to rob the traditional rotation of the mayor’s seat from the woman sitting at his right. Herbel made considerable points in establishing her credibility as a fearless community leader. Her unrelenting style focused on relevant issues while forcefully, but calmly, avoiding offending strong personalities sitting beside her. By staying focused, Herbel firmly grasped the importance of the occasion, using strategic measures to add another win to her growing list of accomplishments. What Herbel brings to the table as a civic leader is enhanced by her in-depth study of staff reports and documentation. Little escapes her attention. Time and again, Herbel has made headway against greater odds and more experienced entrenched powers. She has risen to the o c c a s i o n w i t h d i g n i t y, engendering a respect for her independent perseverance and accomplishment as a leader, and has a growing base savoring the last good laugh. ■

No vacation goes unpunished. Karl Hakkarainen

Mayor Rotation “old boys network” was going too far in controlling politics of the Hi-Desertand that certain “men” have it in mind to be spiteful by not allowing Herbel her “rightful” turn to advance. While Herbel supporters in the community spoke on the subject, the obvious discomfort stemmed from the belief that council members were being gender discriminatory, or smokescreening it with reactions against environmental activists who have supported Herbel. “This is an insult to the voters’ intelligence. The voters should be allowed to vote for the Mayor. This allows for the fox to guard the hen house,” Ray Packard said. “I am ashamed of this attitude,” said Joyce Metcalf. “Everyone should be given a chance. These changes give the perception of discrimination,” Bill Horn said. “These are foul smelling politics,” Charla Shamhart said. “How can you list the ability to run a meeting [as a condition of nomination, if they are not given a chance to run the meeting?] These are not good criteria,” Bill Souder said. “This makes the men on the board look bad and it gives the appearance of discrimination.” Eric Mueller said. “Don’t change horse mid-stream,” said Carl Schmitt. “I think you [Luckino and his ilk] stepped in it, in this situation,” David Thick said. “What is this, the Salem witch trials? This should not be considered,” said William Hanson.

Sixteen other members of the community showed their opposition but chose not to speak. Only Isaac Hagerman may have been trying to speak in support of Mayor Luckino’s proposal to change the existing ordinance, but his comments appeared discombobulated and weak, and they fell on deaf ears. “I am offended at being called a bigot, “said Chad Mayes, Yucca Valley Mayor Pro Tem. “There was no ill-will toward anyone… There is some wording in the previous ordinance that left it unclear, I admit the timing seems bad, but again there is no ill will. Whether we accept this ordinance or not, the rotation will not change.” “When we bring up these issues of discrimination, we digress,” said Luckino who vainly tried to steer the meeting towards his objectives. During more than an hour with half of dialog hearing council members went back and forth on the subject, circling the subject, and repeating quotes made from the previous meetings over and over, hoping they would somehow appease the crowd. Finally, Council member George Huntington, who had largely sat silent throughout the brouhaha, simply suggested revising the current ordinance’s paragraph “C” and making it clearer. Members discussed this with one another and with Douglas Halibert, Yucca Valley Town Attorney, and agreed. ■

Fresh Food drips every 8 inches, saving approximately 60 percent in water use. “I have been a part of the National Ground Water Association water management courses, and have logged over 200 hours in certification classes for training in water conservation,” Ellis said. The growing fields have abundantly rich soil due to the fact this land was used in the 1950s to grow alfalfa. To break the wind on the plant, the crops will be planted in a ‘S’ or snake shape, a method used in Europe, to break the wind from themselves. There will be no pesticides used on any crops. “If the critters stop by to have lunch, well, there’s gonna be a smörgåsbord,” Ellis said, “The goal is to develop a garden to shift critters to a different area.” One hundred and sixty acres have been dedicated out of the 640 acres owned, to the organic farm. There will be over 300 plants throughout the year, depending on the season. There should be something of different colors every time you drive by or stop in. “I would like the community to stop by anytime and check out the farm,” Ellis said. The growing cycle is 11 months out of the year. Each co-op is $32.00 for twelve weeks, paying for the microbial sterilization of the boxes, vegetable,

and fruit, and for supplying the boxes or coolers used. This equates to approximately $2.67 per week. The fresh fruit box is $35.00 per week and includes, 2 pints of strawberries, 2 lbs. of peaches, 2 lbs. of oranges, 1 lbs. cherries, 1 watermelon, 1 cantaloupe, 2 lbs. of apples, and 2 lbs. of tomatoes. The fresh veggie box is $40.00 per week and carries 1 bunch of carrots, 1 bag of lettuce mix, 1 lbs. of broccoli, 1 lbs. of cucumbers, 1 lbs. of Summer squash, 2 lbs. of peppers, 2 lbs. of potatoes, 1 lbs. of eggplant, 1 bunch of asparagus, 3 ears of corn, 1 lbs of green beans, and 1 bag of spinach. A mixed box of fresh fruit and vegetables costs $45.00 per week and is stocked with 2 pints of strawberries, 2 lbs. of peaches, 2 lbs. of oranges, 2 lbs. of apples, 1 watermelon, 2 lbs. of tomatoes, 1 bag of lettuce mix, 1 lbs. of cucumbers, 2 lbs. of peppers, 3 ears of corn, 1 lbs. of green beans, 1 lbs. of Summer squash, and 1 bag of spinach. “These prices versus in the grocery store are substantially less,” said Ellis. To join the co-op, the website is www.earthwiseorganicfarms.com, or call Dr. Robert Ellis at 760-542-9780. To visit the farm the address is 3698 Sunfair Drive in Joshua Tree, California. ■
