A Nelson couple are facing bankruptcy as well as losing their rural home this week after the High Court ruled they are liable for a 2009 fire that caused damage to forestry and another home. Steve Garnett and Tracey Lynch say the past three years has been like hell and a decision in the High Court last month was the final nail in the coffin of their dream retirement. At 61, Steve has lost everything and says he’s unable to start again. They say the system has let them down and they wanted to tell their story about how they lost it all. On November 24, 2009 Steve threw some ashes that had been sitting in one of the bed and breakfast cabins on their property out onto a grassy bank. The ashes had been sitting in the cold fire for 36 hours. Two hours later two men working nearby smelt the smoke and came knocking. Steve and the two men attempt-

The fire spread to neighbouring properties, burning down the home belonging to Caroline Wade and trees belonging to Nelson Forests Ltd. Steve still disputes that the ash was the cause of the fire because it was “like dust” when he threw it out. But it did start on their property and the insurers of Nelson Forests, along with the New Zealand Fire Service and the Waimea Rural Fire Committee went after Steve and Tracey for costs under Section 43 of the Forest and Rural Fires Act 1977. The couple’s property was insured but they didn’t have liability insurance on their two cabins because they were deemed a SEE PAGE 4

Police campaign to stop synthetic drugs Nelson police have begun a campaign to rid the region’s dairies of synthetic drugs, slamming them as “morally wrong” and urging locals to boycott stores that continue to sell them. The region’s community constables and Youth Aid officers started visiting dairies and other outlets known to have stocked synthetic cannabinoid products yesterday, explaining the dangers they pose and encouraging them to refrain from selling the products. Nelson Bays area commander, Inspector Steve Greally, says police have seen first-hand the devastating effects these drugs were having on young people and wanted those selling the drugs to show some responsibility. “These drugs may technically be legal, but that doesn’t make them safe. Retailers may say they are doing nothing wrong, but in my view it is morally wrong to be preying on the young people in our community and making money by selling them addictive and extremely harmful drugs. “My officers will be encouraging retailers to think about their responsibilities, not just as business people, but as

ers who were not selling the drugs which would identify them as a safe and responsible retailer. “We can’t stop the sale of these drugs, but people in the community can make a choice about where they go to buy their bread and milk. I know what my choice would be.” Salisbury Store supported the campaign and already has its anti-synthetic cannabis poster on display on the front window. Store employee Thavy Men says she had been approached by two people in the past to sell synthetic drugs but declined, on her brother’s recommendation. “They came and asked me but I didn’t buy it from them. I asked my brother at the other dairy and he said no do not sell them,” she says. Thavy says a group of customers had previously came in and asked whether the store stocked synthetic drugs. “About five people came and asked me. I’d say they were like in their 20s because one he had a beard.” Steve says he was confident the “reputable businesses” in Nelson would take the responsible option and stop stocking the products.

Warehouse is coming to town Confirmation that The Warehouse will be joining Kmart at a new retail complex on Queen St won’t be bad for local businesses, says the new chairman of Richmond Unlimited. It was confirmed on Friday that a new 3000m2 store is expected to open on 186 Queen St in July next year and will be designed as a “convenient one-stop family shopping destination”, bringing “lower prices closer to home for many local residents,” says Simon Turner, The Warehouse’s general manager for operations. Kmart had already announced its plans to open on the site, which is a Gibbons Construction development project, before the end of the year. But will that be bad for current Richmond retailers? Apparently not, according to Richmond Unlimited’s Nathan Smith. “It’s going to bring jobs to Richmond, it’s going to bring growth and it’s going to bring more people to Richmond which will filter out to the local businesses. You’ve got to see the positives here,” he says. “Money spent here stays here. Tourists that come into the town it’s going to bring them in. These big box companies have obviously seen the financial benefit of coming to Richmond, they wouldn’t put one here if they thought it would just go okay.” Nathan says that The Warehouse already has a target market that would shop there no matter whether the store was opening in Richmond or not, and that local businesses should focus on their own strengths in order to succeed. “Yeah there’s a convenience now that you don’t have to drive 15km to go to town but at the end of the day those people are always going to shop there.”

He also added that Kmart’s decision to pick Richmond over Nelson highlighted the growth in the region. Meanwhile Gibbons managing director Scott Gibbons says he is delighted to be working with a renowned New Zealand company and labelled it as “another significant anchor tenant”. He says Gibbons Construction is progressing well with the development works onsite and has multiple local sub-contractors from the Tasman region working on the project. At its peak it is anticipated that the project will have a workforce in excess of 100 across the different trades which will provide a significant injection into the local economy. The Richmond Warehouse is expected to create approximately 60 new jobs and it will be the fourth of its kind in the Top of the South, with stores already in Nelson, Motueka and Blenheim.

But because Steve was honest and said the ash came from one of the cabins – which is their business – they weren’t covered. If the ash that started the fire was from their own home they would have been. Last month they lost their case and were ordered to pay close to $1.5 million. The property is worth only $550,000 and $100,000 of that is mortgaged, plus they have to repay legal aid fees. They had been given until Monday to pay but they don’t have the money so are expecting to be kicked off their land

this week. It will be the end of their rural dream and say it’s an incredibly harsh punishment for something that was – at absolute worst – an accident. In another case, an 18 year old man was sentenced to 18 months in jail for arson and insurance fraud for burning down a Westport home on purpose. His associate, a 34 year old woman, received 250 hours of community work for conspiring to commit arson. Neither was fined. Steve and Tracey argue their sentence is much worse, and described it as being “wiped off the face of the earth” and say around a million dollars they invested in their property on Dry Weather Rd is now lost. They also say they were steamrolled by the system. On legal aid, they say their one lawyer didn’t stand a chance against the might of the two top law firms working to bring them down. “The legal fees of these firms will be more than what our property is worth to them. They will get next to nothing other than ruining us,” says Tracey. Steve and Tracey’s lawyer, Rob Ord, said in a statement that the law needs a major overhaul. In his judgement, Judge Miller wrote he believed Steve to be a “decent” man but didn’t believe his testimony that his ash was cold. Steve says it’s too late for them now. They will attempt to appeal the case to the Court of Appeal, but he isn’t holding out much hope and believes that by the time you’re reading this the wheels

Community nominations to close Locals have just a few more days to ensure their favourite voluntary groups are part of Nelson Tasman’s biggest celebration of volunteers. Entries for the TrustPower Nelson Tasman Community Awards close at 5pm on Friday 17 May and there is more than $6000 up for grabs. The TrustPower Nelson Tasman Community Awards, run in partnership with the Nelson City and Tasman District Councils, recognise and reward voluntary groups and organisations for the outstanding con-

tribution they make to their community. Last year 134 entries for the community awards were received. So far this year 72 have groups have been entered. TrustPower community relations representative Teresa Partridge says she is excited about the groups that have been entered so far but believes there are still many groups providing services, activities, support and events in the community that are not recognised for the invaluable work they do.

“These awards are a fantastic opportunity to recognise and honour some of the Nelson and Tasman districts hardworking and generous volunteers and it means we get the chance to share with the community all the wonderful things that this district’s volunteers are doing for the benefit of many. So this is your chance to say ‘thanks’ to these volunteers by entering them in the TrustPower Community Awards. Artists host exhibition All 70 members of the Tasman Visual Art Group will showcase their talents at a winter exhibition this weekend. The group hosts two exhibitions each year, giving the members an opportunity to sell what they have been working on to the public. Lois Morgan, who is a founding member of the group, says while there will be a larger percentage

of paintings, there is still plenty of variety. It has been going since 2002 and started to give artists in the Tasman District an opportunity to be part of a group. The top 12 high school musical acts to contest the Nelson Smokefreerockquest final have been named, following Saturday night’s heats at the Theatre Royal. This year’s event has seen the addition of the solo/duo category, although just two from this category will contest the final at the Theatre Royal on Friday night. Laura Mae of Nelson College for Girls, and Livvy and Anna from Garin College will be joined by ten bands in the final. Those bands are; Slim Conviction, Garin College and Nayland College; Third Wheel, Nelson College for Girls, Nayland College and Nelson College; The Black Spots, Garin College, Golden Bay High School and Nelson College for Girls; Sermon of the Dammed, Nelson College and Nayland College; Paper City, Nayland College, Garin College and Nelson College; Oh Blok, Garin College; Room To Breathe, Motueka High School and Nelson College; Two Day Crisis, Waimea College; Sustain, Garin College; One Notch Higher, Nelson College for Girls, Nayland College, Nelson College and Broadgreen Intermediate. SFRQ founder and director Glenn Common says the standard of the bands that played off on Saturday reflected the increasing sophistication that SFRQ organisers have noted in recent years. “Over the 25 years we have been running Smokefreerockquest there has been a massive sociological shift for young people,” he says. “The access they have to music, both the amount and range, is amazing. For us, this has resulted in an eclectic range of genres at any one time, rather than one trend dominating for a short period.” At the regional final, first and second place for the solo/duo will be announced, as will the top three placings for bands, and a range of other

Vet Centre thanks community for support

It’s been a whirlwind adventure for the busy Vet Centre Richmond on Gladstone Rd, while services are still continuing as normal, renovations are underway after the big flood swept through town. The team would like to thank the staff, friends, builders, electricians, student volunteers, neighbours and customers who showed up on the night and following days with shovels, mops, and rolled up their sleeves to help. This enabled the clinic to open the doors by 9am the next day - and even better that none of the animals got their paws wet. The clinic cat Mogwai, being the only animal in the building was very kindly taken in by the next door neighbours. There’s been a lot of hustle and bustle at the centre in the aftermath, with builders coming in and out to fix a few things. While it’s been busy they have been kind enough to complete the work at night so as not to disturb the day to day operations

of the centre. Mogwai loves meeting and greeting clients and patients, so needless to say he is enjoying the extra attention. In-between the hive of activity a class of proud puppies has just graduated, leaving with a wealth of knowledge and their very own certificate; this now makes way for brand new classes. There is a class held every Tuesday and Thursday from 6pm to 7pm, so get in quick and secure your spot. While things are getting back to normal, the team has noticed it’s starting to cool down. With the onset of winter fast approaching, the clinic is now offering 15% off all winter beds. These are extremely cosy for all dogs or cats and really suit older pets who suffer from bad joints that get worse in chilly weather. Wednesday May 8 Custodian Bob Stewart says he was absolutely chuffed with the response he received to an open day after the disused railway tunnel in the Spooner’s Range was featured in the Waimea Weekly. The tunnel was unlocked for visitors on Sunday attracting more than 500 people who were keen to walk the 1352 metre tunnel. It is now closed until October. Wednesday May 1 The Nelson Bays Harmony Chorus performed at the New Zealand Barbershop singing competition in Queenstown two weeks ago. The 37 members that made the trip down secured a sixth ranking up against nine other groups from around the country during the competition. There were 15 boars and 3 stags weighed in on the day with Craig Barker weighing in at first place with an 80kg whopper, Richard Marshall coming close with a 67.5kg second placing and Roger Buschl taking home third place with a 57kg boar. The average weight class went to Louis Thompson with a 46.5kg boar, biggest tusks went to Pearl Maddock and heaviest stag went to Murray Foulsham with his 108.5kg winner.

Vandals wreck dinosaur sculpture A dinosaur sculpture that has been situated on Hoddy Rd for 20 years was vandalised on the weekend and its current owners say it will have to be taken down. Levis Johnson, who died three years ago, constructed the 12 foot high dinosaur in the 90s “as something to do” and decided to put it out on the front of his Redwood Valley property for everyone to see when they drove past. But Denise Morgan, who lived on the property with Levis, discovered the damage on Sunday morning and claims someone must have vandalised it over night. She says it is the second time this has happened within the space of a month. “Now he’s about half the size. The first time they bent him over, twisted him round and pulled his arm off,” she says. “I don’t think I’ll repair it. We’ve told the police but what can they do?” Michele French, Denise’s sister, labelled the dinosaur sculpture as a local icon. “Bus drivers will drive down and point it out to passengers. We were talking to some neighbours yesterday and they were devastated that the dinosaur was wrecked. The fact it’s just been there for so long.”

New path for playcentre Greenacres starts junior programme The Brightwater Playcentre has been held in the old Spring Grove school house for many years and has seen a lot of changes in its time. A few weeks ago some of the children helped lift a large number of paving slabs which had been made unsafe due to tree roots resulting in a patch of bare land and a dilemma of what could be done to fix it. The Richmond Small Bore Rifle Club is on the hunt for more members to join its competition team. Following on from the very successful learn to shoot programme for owners of .22 sporting rifles and high powered airguns held over the summer months, the club is looking for more small bore shooters to join in the winter programme. The local competition involves shooting against four other clubs. From this a representative side is selected to attend South Island and national

competitions, giving shooters a chance to vie for New Zealand selection. Club spokesperson Warwick Sidwell says age is no barrier in shooting and the club is open to both male and female members. “All gear is supplied, all you have to do is turn up at 7:30pm on a Monday night,” he says. Warwick says the club’s policy is to keep costs as low as possible. Anyone who is interested in shooting or has a family member that wants to experience the challenge of shooting, please contact Warwick on 547 9414 or Paul on 544 4117 and arrange a Monday night to that suits you.

Car Rally Results The old adage “if all else fails, read the instructions” could have easily been applied to almost all the crews that took up the challenge of the annual Club Waimea Car Rally held recently but, adults being adults, the majority showed a distinct inability to follow straight-forward simple instructions, or did they honestly believe they knew more about where they were meant to going and what they were meant to be doing than the organiser. By allowing local knowledge and ‘overactive brains’ to override common sense, many crews were soon well off-course, a course that initially went round in circles in upper Richmond before heading off on a bit of a tiki-tour through Hope, Moutere, and Mahana before returning to Richmond. Off-course is really an under-statement considering some of the distances covered and reports of crews going round and round in ever-decreasing (or in some cases, everincreasing) circles as far away as Motueka but more especially in and around the Old Coach Road/ Dominion Road area. Run by the same organiser for

the fifth year running, one would have thought regulars of the event would have got a bit of a handle on the way his warped mind worked, but in an effort to keep one step ahead of crews, a return to basics with a couple of curved balls thrown in just to keep them on their toes seemed to throw them off the scent. This certainly appeared to have the desired effect, so that obeying simple instructions and carrying them out in the correct order was most certainly the downfall of most crews. Although fun was the name of the game, reports indicate that there were some rather ‘heated in-car discussions’ over the just under 90km journey that should have seen crews retuning to the finish in well under three hours, however, while the major compliant seemed to revolve around dehydration setting in, the general consensus was that most thoroughly enjoyed the afternoon’s jaunt and the challenge despite the pitfalls - or at least that’s what they were telling the organiser. Hey, it couldn’t have been too bad as no-one was yelling for a divorce lawyer at the end of the afternoon!

Truly a game for all ages

Anyone can play the wonderful game of indoor bowls, it is truly a game for all ages. It can be played as a serious competitive sport or as a social activity, there is no uniform or equipment required other than flat soled shoes and a smile, so it is an affordable, fun sport to play and a great way of meeting new people. The indoor bowling season runs from February till October this year and is played in the Club Waimea Hall. So why not give the game a go over the winter months? Coaching is provided for new members and club night is held each Monday evening, with play starting at 7.15pm in the Club Waimea Hall. If you would like more information on the indoor bowling section at Club Waimea then please contact Athol Curtis on 544 8046 or just come along to Club Waimea on a club night, new members will be made most welcome.

Every year there is an expedition of historic interest, with this year’s one being Ellis Road Brightwater because it’s full of interesting buildings. The group had permission to enter five buildings and were given a full tour of two houses. There is great interest in historic buildings as demonstrated by the large group this year.

Don’t wait to be asked, precious angels just step in and say “can I, mow the lawns, take you shopping…?” Finally if you meet me in the street , don’t avoid me, don’t tell me how good I look, do ask me how I feel, do ask if I need a hug, do mention my loved one’s name. Waimea B start season with win The Nelson Netball 2013 season got underway at Saxton Courts in perfect weather conditions on Saturday. Players were keen to get the first game under their belts and begin to acclimatise themselves with the outdoor surface. Competition was keen with a number of the grades having very little margin between the three games, which is a credit to the Grading Committee. The closest game in Grade 1 was Waimea College B’s 31–23 win over the more seasoned Richmond Robbie’s Bar & Bistro Black.

Richmond looked decidedly rusty and found themselves 6–10 in arrears at the first break. Once Richmond settled and found their

rhythm they were more competitive. Their passes had better weight, the shots were falling for shooters, Julie Jackson and Ashleigh Della-Bosca. Missed shots were rebounded well for the second opportunity. Mid courters – Mel Shirley, Monique Pessione and Marjolein Edwards all contributed well and proved to be useful links through court. While Waimea recorded the win and played well in stages they will go from strength to strength during the season under the watchful eye of coach, Lyn Olsen. While three of the girls are from last year’s

well performed 10A team, Kelsi Hylkema and Emma Deighton return for their second season in the team they still are working at developing their combinations. Goalkeep, Emma read the play well to pull in four well timed intercepts and she was well supported by Anika Paton, while Hannah Taylor applied the pressure on the outside of the circle. Kelsi lead her team by example when she netted 21 from 25, while the converted defender Courtney Zwart could be well pleased with her efforts in the offensive circle.

Waimea lose Press Cup derby match Waimea College ended Saturday’s Press Cup game with more cards than points, going down 32-3 against rivals Nelson College. The game unusually started with a penalty, as Nelson College was told by the referee it had taken too long to arrive for kick off. While the decision meant both teams would not perform their respective hakas, it was probably a sign of things to come with the second half dictated by numerous penalties. In total five cards were dished out during the game with prop Dan McLauchlan sent off for his second bookable offence. Levi McPherson scored the only points for the visitors as Nelson led 20-3 at half-time. This weekend Waimea will travel to Timaru Boys’ High School while Nelson and Nayland College will play out third local derby in as many weeks. That match is at Nayland College and begins at 12noon.

Rabbits get revenge The Richmond Rabbits faced the Tahunanui Tigers for the second time this season. Having lost to the side in the first round of the TRL, the Rabbits were determined to prove that it is still the top team in the competition. The game started off well with Maloni Lama going over the line in the first few minutes. While an injury 10 minutes into the game saw a reshuffle of players and positions, it did not deter the Rabbits who continued its dominance to hold an 18-4 half time lead. The second half saw the Rabbits run away with the result, scoring a total of six tries to win 50-12. The Rabbits head over to Blenheim to face the Wairau Taniwha this weekend.

The Waimea Old Boys second division side continued its strong start to the season, beating Huia 34-3 at SportsPark Motueka in glorious conditions on Saturday. Waimea started well and had two penalties on the board early thanks to skipper John Higgins who give the side a 6-0 buffer in the first 15 minutes. Right winger Dallas Saunders was the next on the score sheet, dotting down for a try after the backs and forwards combined to put him away in space on the 25th minute mark. Huia replied not long after with a penalty of its own as Waimea went

into the half-time break with a 11-3 lead. The visitors had the better of the second half too with John striking two more penalties and a try either side of a five pointer from Lee McBrydie and player of the day Mitchell Bateman. Only one of those second half tries were converted. Scott Ford stood out in the forwards with his lineout ability and strong ball carriers and overall it was a good performance. This weekend the side will face last year’s defending champions Murchison at Jubilee Park. Murchison has also had a strong start to the season despite some fresh faces in its champion squad.

The tone was set from the kick off as Waimea received the ball and opted for the territory, booting the ball down into the opposition half. Moutere’s fullback fumbled the kick, as he re-gathered it, hoping to find touch with the resulting kick. However, it was charged

down by winger Josh Rutledge who then gave the ball to second five Marty Banks who ran unopposed for the final 20 metres to score a try in his first ever touch for Waimea. Marty, who played first five for Buller in the Heartland Championship, would later thrive on debut, scoring two more tries in the rout. Waimea had a field day on the counter attack with Moutere unable to stop the rampant backline and physical forwards.

Pivot Billy Guyton converted all ten tries and scored two of his own, taking his match day points tally to 33. Up front the players to impress were ball running prop Jerome Va’a and Fijian international lock Tevita Cabuvati, the latter having a solid all round game. Along with Billy and Marty, fullback James Lowe had another strong performance and played a key part in sparking plays from the back. His day was epitomised by a brilliant in-

dividual run down the wing later in the match. Although the home side managed to score its biggest points haul of the season, a worrying note will be the 21 that was allowed to be scored against the side, which has only lost one game all season. The side now moves on to Accessman Stoke at Greenmeadows this weekend in a match that doubles as a Tasman Trophy and a Car Company division one fixture. Kick off is at 3pm.

Draft Tasman District Council Reserves General Policies Tasman District Council is calling for submissions on the Draft Reserves General Policies document which has been prepared to consolidate policies that apply to all reserves and and/or land administered by Council.
