At Monday night’s Jan. 10 regular Cherryville City Council session, Council members heard the audit report from Butler and Stowe about the city’s audit, ending June 30, 2021, from Mr. Robert Adams, who is one of the managing partners with that firm. Mr. Adams noted his firm met with the audit committee members on Thursday, Jan. 6 to review the audited financial statements for the year ending with the aforementioned date. Wrote Mr. Adams in a brief handed to Council members, “Our opinion on the financial statements for

the year end was a clean opinion, which means: (a.) the City has met the audit requirements of the North Carolina General Statutes, and (b.) the financial statements represent the financial status of the City at June 30, 2021.” Adams also noted some of the financial highlights are as follows: “… (a.) the City ended the year with combined assets exceeding the liabilities by $20,361,000; (b.) the City received funding of the voter-approved bonds and recorded the receipt of $3,653,000 in the General Fund and $5,944,000 in the Water and Sewer Fund; (c.) the unassigned fund balance of the General Fund was $1,080,621. This represents funds available to the Council without restriction. This is an increase of $298,000 over the prior year; (and)
(d.) the two enterprise funds, Electric and Water & Sewer, had a combined income of $524,027 for the year ended June 30, 2021.” Adams spoke to the audit committee – comprised of chairman Jon Abernethy, Mayor H.L. Beam, staff members Brian Dalton (City Manager) and (Finance Director) Dixie Wall and volunteers Pam Harris and Scott Harrill – about future challenges and opportunities for the city and the Council going forward into the coming fiscal year, which include, among other things, budgeting and cash flowing the debt service for the bonds. He noted, in closing his remarks in his brief, that, “…the improvements to the City’s infrastructure and other funding opportunities made possible by the Cares Act and American Rescue
Plan will provide the city and the City Council with great opportunities to improve the city and enhance the lives of its citizens.” City Manager Brian Dalton said of the report by the auditors that it was a “very good” report for Cherryville. Council approved the 2021-2022 Budget Amendment items brought up by Dixie Wall then considered the appointments to the Architectural Review Board, approving the recommendations as read. The Council then heard an update on Piedmont Lithium’s progress from Mayor Beam as well as an update by City Manager Dalton on the City’s purchasing cards that have been issued to the department heads. Melanie Massagee According to a media release from Gaston County officials, on Sunday, Jan. 9, 2022 Gaston County EMS suffered a devastating loss of one of their valued team members, Lt. Melanie Massagee. Ms. Massagee began her service, noted the media release, in Gaston County with the Bessemer City Rescue Squad in 1978. She later joined Gaston County EMS as a volunteer Auxiliary member and later, in 2007, joined full time. Melanie was currently assigned to B-Shift as the Lieutenant on that shift. Melanie was known for her giving personality, dedication to ensuring no one was left unheard or went without. Melanie was a friend to all who knew her.

A unanimous three-judge panel has upheld North Carolina’s new congressional and legislative election maps. The panel of two Republican Superior Court judges and one Democratic colleague rejected critics’ arguments that mapmakers engaged in unconstitutional
partisan and racial gerrymandering. The 260-page order also grants the State Board of Elections’ request to resume candidate filing for 2022 elections on Feb. 24. The Court finds that the plans are amply supported by a rational basis and thus do not violate the Equal Protection Clause.” The decision does not endorse the maps themselves. “This Court neither condones the enacted maps nor their anticipated potential results,” the judges wrote. “Despite our disdain for having to deal with issues that potentially lead to results incompatible with democratic principles and subject our State to ridicule, this Court must remind itself that these maps are the result of a democratic process.” The court also warned against judicial overreach. “Redistricting is a political process that has serious political consequences,” the judges wrote. “It is one of the purest political questions which the legislature alone is allowed to answer. Were we as a Court to insert ourselves in the manner requested, we would be usurping the political power and prerogatives of an equal branch of government. Once we embark on that slippery slope, there would be no corner of legislative or executive power that we could not reach.” “Indeed, under Plaintiffs’ rationale, we could require the Governor to ensure that the partisan makeup of his political appointees matched or closely resembled the percentage of votes that his political opponent received.” A state Senate redistricting leader responded to the ruling. “Now that a bipartisan court unanimously validated the maps, the people of our state should be able to move on with the 2022 electoral process,” said Sen. Warren Daniel, R-Burke, in a prepared statement. “But the sue-‘til-blue organizations and their lawyers will probably appeal to the conflict-riddled state Supreme Court because its 4-3 Democratic majority was won with the help of a six-figure donation from the very organization funding this case,” Daniel added. “Eric Holder’s organization donated $250,000 to elect Justice Anita Earls, who has not yet recused herself even though this case is funded by that same organization – her largest campaign backer. “And another justice, Sam Ervin, is on the ballot but hasn’t recused himself even though this case will decide the rules and timeline governing his own reelection,” Daniel said.

We have done our best to perform that duty, regardless of the consequences.” The judges produced their ruling Tuesday, meeting a deadline set by the N.C. Supreme Court. The ruling followed a four-day trial last week. The state’s highest court had ordered both the trial and the Jan. 11 date for a final ruling. The same Supreme Court order establishing that deadline gave the losing parties in the case two business days to appeal the ruling. That appeal will bypass the N.C. Court of Appeals and move directly to the Supreme Court. Within moments of the ruling, the Southern Coalition for Social Justice vowed to appeal. SCSJ represents one set of plaintiffs in a case that combines multiple lawsuits. Democrats hold a 4-3 majority on the state Supreme Court. Legislative defendants asked last week that Democratic Justice Sam “Jimmy” Ervin IV recuse himself from the case. Ervin is the only sitting justice running for re-election this year. Plaintiffs in the case also had called last month for the disqualification of Republican Justice Phil Berger Jr. Berger’s father, leader of the state Senate, is a named defendant in the case. Neither Ervin nor Berger has responded publicly to the recusal motions. Berger rejected a recusal request made for similar reasons in another case. The three-judge panel’s ruling spells out the current restraints on lawmakers drawing N.C. election maps. “[T]oday there are four objective constraints delineated in the North Carolina Constitution: (1) apportionment of the district by population such that the representative or senators in each district shall represent, as nearly as may be, an equal number of inhabitants; (2) A contiguity requirement; (3) a Whole County Provision; and (4) a Mid-Decade Provision,” the judges wrote. “At no point has restriction of redistricting for partisan advantage ever been made part of any North Carolina Constitution.” The judges rejected plaintiffs’ arguments that new N.C. election maps violated various portions of the N.C. Constitution. “Plaintiffs would have this Court infer that it was the intent of the framers of the 1971 Constitution, by including the Equal Protection Clause and Free Speech Clause in the State Constitution, to limit the legislature’s ability to redistrict for partisan advantage to some degree,” the judges wrote. “If the framers did intend to limit the partisan advantage that could be obtained through redistricting, ‘it is reasonable to presume it would

Brown, Hovis picked to lead Gaston Board in 2022 At its annual organizational meeting on Dec. 14, 2021 the Gaston County Board of Commissioners selected Riverbend Township Commissioner Chad Brown to serve as the board Chairman for 2022. Brown, who is entering the final year of his third term on the commission, has twice previously served as the board’s chairman.
He also previously served as mayor for the Town of Stanley. Commissioner Bob Hovis, representing the Crowders Mountain Township, was selected as Vice Chairman. Hovis, who previously served as the mayor of Bessemer City, is in the middle of his second term on the board.

Former CHS grad Faith Anthony recently made the President’s List at Cleveland Community College with a 4.0 grade point average. Also, Mia Dattoli earned a spot on the Dean’s List at Coastal Carolina University. Dattoli is a Management major from Cherryville.

Born Dec. 11, 1934 in Gaston County, Rusty noted Boozie was a shooter for 73 years and the group President since 2007, replacing Howell Stroup. Rusty added wryly, “We are like the Supreme Court; once you’re an officer you pretty much stay there.” Wise said Boozie did go to the other group when it was formed in the mid-1950’s but didn’t stay long and came back to the original shooters group. He was, Wise said, “…instrumental in getting the shooters statue and mural uptown as well as the annual host dinner which started in 1982.” Rusty continued, “Boozie’s philosophy – as well as the group’s philosophy – is continuing and preserving the history of the shooters. He will be dearly missed but his leadership will continue on through his son, Mike Dellinger, as well as all the other officers of our group.” In addition to being the President and Boozie was also the Crier for the Cherryville New Year’s Shooters; was an avid sports fan and major supporter of Little League; an excellent farmer and specialized in growing strawberries. It was noted in his obituary in the Cherryville Eagle that, “He had a green thumb and could make anything grow. He enjoyed reading and was a history buff, and was “…well known for his sense of humor and his one-liners that could always get you laughing. He was a great man who will be deeply missed by his family and his community.” The obituary continued, “In addition to his parents, he was preceded in death by his wife, Rachel Travis Dellinger; brother, Hoyle Dellinger; sister,

The Hebrew people addressed God by special names to describe His interactions with His creation. One of those names was Adonai which essentially communicates His Lordship of all. As LORD, God alone must be our only source of authority on every single matter of life – especially matters like hell and heaven. Now, God communicates with you not through Facebook posts, emails, or even through newspaper articles. God communicates to His creation through His Holy Word. And Adonai’s Holy Word teaches us that – humans were placed in a perfect paradise by their Lawgiver. This place was called Eden. While there, humans worshiped,
worked, ate, rested, and ruled. A compassionate, wise, and righteous Father warned humans about the consequences of sin. But assuming we could handle the consequences, we forfeited our place with God in a foolish attempt to become like gods as rulers over good and evil. So, sin entered the world and, as it turns out, we humans are quite miserable at choosing what is good and what is evil. Sin is anything that we say, think, or do that breaks God’s law. Sin brought separation, death, and consequences. The most well-known consequence of sin is death. When a human dies, we are permanently placed in the eternal location we desired on earth. You see, the New Eden
is only available to perfect people. But no human that has ever lived has ever been perfect apart from Jesus. So, God says we must confess Jesus as our perfect substitute and rich redeemer. Only through faith can you or I enter into right-standing with the Creator. So, the key to life is found not in obedience to rules, religion, or the government, but in the confession of our inability to be perfect apart from the Messiah. Humans who decide to believe they can continue being rulers of what is good and evil are given what they want: eternal separation from the Lawgiver. The Bible calls this place hell. In other words, those who reject Christ are given exactly what they
want, an eternal, conscious, and literal separation from the Creator. But I have some good news! Someday lawbreakers like you and me will be ushered into a new Eden – not because we obeyed a set of religious rules, but because of the grace available to us in Christ through confession, repentance, and faith! Praise Adonai! There we will spend an eternal, conscious, and literal union with our Father. There we will work, eat, rest, rule and worship! I personally want to spend eternity with people just like you so I implore you, repent and believe on the Lord Jesus Christ! (Genesis 1-3; Romans 10:9; Revelation 2122.

A Wealthy Place Did you know that the wealthiest place in the world is the graveyard? It’s full of books that never were written, songs that were never produced, businesses that were never created -all worth billions and billions of dollars. Yes, the cemetery has a plethora of talents, skills, and visions that died with people who never utilized them. God is looking for a return on the investment he has made in us. Jesus gives a parable about 3 people who were given a certain amount of talents. Two out of the three were productive with what they had been given. One decided to hide their talent out of fear. The owner was not happy with the one who hid his talent. He was rebuked severely and punished because he was unfruitful. However, the first one who increased what was given to him, received a different message. Jesus says in Matthew 25:2021, “So he who had received five talents came and brought five other talents, saying, ‘Lord, you delivered to me five talents; look, I have gained five more talents besides them.’ His lord said to him, ‘Well done, good and faithful servant; you were faithful over a few things, I will make you ruler over many things. Enter into the joy of your Lord.’” We have all been given gifts and talents to serve God and be a blessing to those around us. Being productive with these gifts will help us to enjoy the life we have been given! PRAY THIS PRAYER: “Father, you are great indeed! You are clothed with majesty and splendor. My mouth is filled with your praise, and with your glory all the day. I adore you as my Creator. You made me and have given me special abilities and skills. Forgive me for comparing myself to others instead of recognizing my own unique qualities. Help me to grow, develop, and nurture what you have invested in me. I want to be fruitful, multiply, and increase what I have been given for your glory. May everything I say and do represent you well. In Jesus’ name I pray. by DAVID BASS Carolina Journal Two of the Tar Heel State’s school choice programs have saved taxpayers between $74.1 million and $154.3 million through fiscal 2018, according to an updated analysis from the school choice advocacy organization EdChoice. Those figures translate to between $3,373 and $7,022 in local and state taxpayer savings for each student enrolled in these programs. “These savings result from many of the students who exercised choice who
would have been enrolled in a public school if these choice programs did not exist – and enrolled in public schools at a much larger taxpayer cost,” wrote Martin F. Lueken, director of the Fiscal Research and Education Center at EdChoice. For the 40 school choice programs across the U.S., the cumulative impact in cost savings is between $12.4 billion and $28.3 billion in net savings for local and state taxpayers. In North Carolina, Opportunity Scholarships are valued at up to $4,200 a year and help low- and

The CHS ladies got their second win of the season as they downed the Lady Rams at Nixon Gym by a score of 40-38. Coach Carrie Dalton’s women led the Lady Rams at half-time, 22-10. The leading scorer for the CHS ladies in this matchup was junior Ragan
Hovis with 13 points. Senior Terayha Bess got in the double digits with 11 points on the night. Krista Davis and Gabbie McCorkle each had 6 points apiece, followed by sophomore Ceniya Powell and Evionna McDowell, who each had 2 points apiece. In men’s varsity action the Ironmen started slow, but built up some momentum and led the Rams at half-time by a score of 3633; only a three-point lead. The CHS men held on and got the win, 76-48 at the end. The leading scorer for the Ironmen was Carson Kelly, with 30 points, followed by Landon Hahn with 18 points and Khanye Kennedy with 11 points.
Darrien Floyd had 4 points and Jack Mulvey had 3 points in last week’s action. Five CHS players had 2 points apiece. They were: Carter Spangler; Numarius Good; Chase Hunt; Gavin Cease; and Cooper Sloan. There was game slated for Friday, Jan. 14, but the CHS Ironmen teams are next up in action as they are slated to play two away games: one played on Tuesday, Jan. 18, at East Gaston, and the other on Friday, Jan. 21, at Thomas Jefferson (JV @ 4:30; VAR @6 p.m. They are back home at Nixon Gym on Monday, Jan. 24, versus NCSD; VAR starting @ 6 p.m. (Additional info/stats by Susan L. Members of the event’s executive committee met Oct. 13 to finalize plans for the annual event, which is now in its eighth year, and is directed by longtime Cher-
ryville assistant basketball coach Dr. Bud Black. Both girls’ and boys’ games are scheduled, and the event will occur after the North Carolina High School

Jerry Hudson, Area IV Legion baseball commissioner, noted recently that two players with Post 100 teams were selected last year as the Junior Legion and Senior Legion Players of the Year. The Junior Legion player is Will Blackburn (#10), while the Senior Legion player is Zach Wilson (#6). So far as is known, Hudson believes this was the first time that the Junior and Senior Player of the Year were from the same Post. It is not presently known whether the two young men
will receive an award, a plaque, or a trophy, but that such could be awarded probably during the season in front of their many Legion ball fans. Commissioner Hudson also mentioned that Post 100 will host the N.C. Baseball Hall of Fame Induction Ceremony on Saturday, March 5, 2022 at the American Legion Building (cost is $10/person). Sam Homesley and Mike Robinson from Post 100 are two of the four inductees. Blackburn, NCAL Jr. Player of the Year was coached by his Head Coach, Mr. Stan Haynes.
Will pitched and played multiple positions for Post 100 Juniors. This was his first year of Legion ball. He is a junior at Lincolnton High School (Class of ‘23) and plays baseball for Head Coach Brad Gates. Wilson, NCAL Sr. Player of the Year, was coached by Head Coach of the Seniors, Bobby Reynolds. Zach played two seasons for the Senior team. It would have been three, but the 2020 season was canceled. He played shortstop, catcher, starting and relief pitcher. He is a 2020 graduate of Burns High where he played for Head Coach Alex Leonhardt. He played his freshman year for the Yetis of Cleveland Community College in Shelby. He has now transferred to Tusculum University in Greeneville, TN, where he will be on a Pioneers team that includes former Post 100 players Wes Reynolds and Colson Miller. Former Post 100 Player and Assistant Coach Caleb Narron is now an Assistant Coach at Tusculum.

Tax Breaks for Caregiver of Elderly Parents Dear Savvy Senior, Are there any tax breaks that you know of for family caregivers? I help financially support my 82-year-old mother and would like to find out if I can write any of these expenses off on my taxes. Supplemental Sam Dear Sam, There are actually several tax credits and deductions available to adult children who help look after their aging parents or other relatives. Here are some options along with the IRS requirements to help you determine if you’re eligible to receive them. Tax Credit for Other Dependents If your mom lives with you and you’re paying more than 50 percent of her living expenses (housing, food, utilities, health care, repairs, clothing, travel and other necessities), and her 2021 gross income was under $4,300, you can claim your mom as a dependent and get a nonrefundable tax credit of up to $500. If you happen to split your mom’s ex-
penses with other siblings, only one of you can claim your mom as a dependent, and that person must pay at least 10 percent of her support costs. This is called a “multiple support agreement.” The IRS has an interactive tool that will help you determine if your mom qualifies as a dependent. Go to IRS. gov/help/ita, scroll down to “Credits,” and click on “Does My Child/Dependent Qualify for the Child Tax Credit or the Credit for Other Dependents?” Medical Deductions If you claim you mom as a dependent and you help pay her medical, dental and/or long-term care expenses, and weren’t reimbursed by insurance, you can deduct the expenses that are more than 7.5 percent of your adjusted gross income (AGI). So, for example, if your adjusted gross income is $80,000, anything beyond the first $6,000 of your mom’s medical bills – or 7.5 percent of your AGI – could be deductible on your return. So, if you paid $8,000 in med-
ical bills for her, $2,000 of it could be deductible. You can also include your own medical expenses in calculating the total. You should also know that your state might have a lower AGI threshold, which means you might get a break on your state income taxes even if you can’t get one on your federal income taxes. To see which medical expenses you can and can’t deduct, see IRS Publication 502 at IRS.gov/pub/irs-pdf/ p502.pdf. Dependent Care Credit If you’re paying for in-home care or adult day care for your mom so you are free to work, you might qualify for the Dependent Care Tax Credit which can be worth as much as $4,000. To be eligible your mom must have been physically or mentally incapable of self-care and must have lived with you for more than six months. To claim this tax credit, fill out IRS Form 2441 (IRS.gov/pub/irs-pdf/
f2441.pdf) when you file your federal return. Flexible Health Savings Accounts If you have a health savings account (HSA) or your employer offers a flexible savings account (FSA), you can use them to pay for your mom’s medical expenses if she qualifies as a dependent. But be aware that if you use an HSA or FSA to pay for your mom’s medical costs, you can’t take a tax deduction on those expenses too.
