Mobile home park takes Lexington to court

LEXINGTON — City representatives and Parkview Homes LLC are attempting to work out their differences in federal district court related to what the complainant is calling a “refusal” of its application for more units.

Lawyers representing the two entities met Feb. 19 in an attempt to resolve their issues, but ran out of time. A follow-up session is scheduled for March 4.

Parkview Homes LLC, owned by National Loan Acquisitions Company (NLAC), initiated the lawsuit against the city of Lexington in August. NLAC owns Parkview Homes after the previous owner reportedly defaulted on his loan payments.

“We stayed there all day,” said Kurt Glaser, city attorney. “We discussed a lot of the issues.

We came up with a list of things to research.”

The two parties were in separate rooms, while a judge moderated the discussion back and forth between them.

According to a letter from Glaser to Parkview dated Aug. 14, the city requested the applicant submit a detailed, comprehensive plan relating to the new units.

“From the information known to the city, your client is proposing a multimillion-dollar rehabilitation to the property,” reads the attorney’s letter. “That investment, including the proposed placement of 22 units, constitutes a major rehabilitation that requires your client to submit plans and specifications detailing the overall project.” The letter also addressed the city's request for the property to submit plans on its water system and Americans with Disabilities Act requirements for new units.

Instead of a rehabilitation plan, the city received a summons and complaint dated four days after Glaser’s letter, indicating it is being sued.

According to Parkview's complaint, the city's building code is pre-empted by federal law regarding manufactured housing.

“The city has impermissibly attempted to interfere and actually interfered with Parkview's protected property interest by wrongfully refusing permits for the placement of HUD-certified manufactured homes in the community,” reads the complaint. “Parkview has been injured in an amount in excess of $50,000 to be determined at trial.”

It happens each year, which is all one's nerves could stand.

Anxiety was at a pinnacle point for Centennial studs Tyler Shilson and Jake Bergeland as they sorted through their respective 138and 132-pound fields.

Bergeland began with 8-3 and 10-3 wins, before edging Eagan's Riley White 5-4 in the semifinals.

A MOMENT IN HISTORY: Raising a flag On Feb. 23, 1945, U.S. Marines raised the American Flag on Mount Suribachi, Iwo Jima. This moment is remembered with the iconic photograph of men working together to raise the second flag on the summit. But the battle was much more than one flag and that photograph.

Corporal John Grant, Marine Corps, of Linwood was part of the battle on Iwo Jima and died in action the next day, Feb. 24.

He was buried on the island, but his parents in Linwood brought his remains home for burial at Fort Snelling in 1948.

John's history of service is part of the Grant Family papers at the Anoka County Historical Society.

Parkview also complained at the city's attempt to address its water system.

“Specifically, the city has claimed that the community's water system is somehow deficient ... In fact, the community's water system is not deficient,” read the complaint. “It consists of a private well system that is operating at only a small fraction of its full capacity.”

In its answer to the complaint, the city denied the allegation and said city officials have received complaints from residents about the water system.

“They are the last entity in the entire city not connected to the [municipal] water system,” said

Glaser. “There is no water pressure. You can't take a shower there at 5 o'clock. The real emphasis of the city is to make it livable.”

Justin Templin, the lawyer representing the city in the lawsuit, said the city has the right to enforce water codes.

“There is a state plumbing code which maintains standards and a city code which maintains standards, and the city has the right to enforce both,” said Templin.

Lexington also denied the other allegations made against it.

“The city does not agree its efforts are pre-empted

by federal law,” said Templin.

Glaser said the litigation session on Feb. 19 brought up negotiation ideas between the two parties. He said Parkview asked the city if they could offer incentives for developing the site.

“We both decided there were more things we can explore,” said Glaser. “They understand why we are imposing safety standards.”

Parkview's lawyer, Thomas DeVincke, was out of the office the week following litigation and did not return phone calls as of press time.

Food drive provides relief

LEXINGTON — Childhood hunger exists locally, and the Circle-Lex Lions Club and Lexington Fire Department are partnering to do something about it.

On March 5, they will host a food drive at Festival Foods. The grocery store is providing $5 prepackaged bags of food that can be purchased and donated on the premises for the food drive. Coin boxes for cash donations for Power Packs are at the checkout counters at Down Under Liquor and Lexington Liquor. Donations will benefit the Centennial Food Shelf.

Power Packs are packages of food provided to local children identified as being in need via the Centennial School District. They are discreetly provided by staff members, who place it in the child’s backpack when no one else is present.

What Harper Lee can teach us

O

n Feb. 19, Nelle Harper Lee died of a stroke at age 89, leaving a lasting legacy. Her book “To Kill a Mockingbird” was first published in 1960 and immediately skyrocketed to success, winning a Pulitzer Prize the following year. Today, it is required high school reading across the country, included along with the literary greats such as Steinbeck and Shakespeare.

Although Lee continued to write after her success, she lacked faith in her work and never published again until 2015 when the “Mockingbird” sequel, “Go Set A Watchman,” was published by HarperCollins. Many of Lee’s friends knew that she was mostly blind Getting and deaf by this time, and doubted in Tune that she had fully consented to the publication of this work, which Jackie Bussjaeger was more of an unpolished and “lost” first draft of “Mockingbird.”

Her lawyer pushed it to publication and, despite its controversial origin, “Watchman” was one of the most popular releases of the year.

It is curious that Lee’s work should be drawn into national attention again so shortly after the death of Supreme Court Justice Antonin Scalia, since “Mockingbird” contains such a powerful message about the American justice system.

Lee created Atticus Finch, a lawyer of incredible moral standards, to represent the voice of justice in her novel. In the book’s famous courtroom scene, Finch addresses the jury in his final defense of Tom Robinson: “There is one way in this country that all men are created equal—there is one human institution that makes a pauper the equal of the Rockefeller, the stupid man the equal of an Einstein, and the ignorant man the equal of any college president.

That institution, gentlemen, is a court. It can be the Supreme Court of the United States or the humblest J.P. court in the land, or this honorable court in which you serve. Our courts have their faults, as does any human institution, but in this country our courts are the great levelers, and in our courts all men are created equal.”

Currently, Senate Republicans have refused to consider even holding a hearing to vet any candidate the president puts before them. It appears they want to wait for the next elected candidate to make the decision in order to avoid tipping the court to liberals. Minnesota Senator Al Franken (DFL), among others, has criticized the Senate Republicans for avoiding their obligation to the American people to provide a fully staffed Supreme Court.

Wherever the divisions in the Supreme Court lie, however hotly contested, this iconic passage from “To Kill a Mockingbird” reminds Americans that the true purpose of the court is to respect every case and every person as having an individual voice. Franken said that the American people have already spoken, in electing Obama in the first place and giving him the responsibility of choosing the next justice.

It appears that the Senate majority has lost sight of its responsibility to the American people. During this squabbling, its members are failing to adequately maintain the justice system to best serve the needs of the country. Perhaps a read-over of Lee’s work, or even a viewing of the Academy Award-winning film, could refresh their memory about the importance and respect that should be given to one of the country’s most revered institutions.

Regardless of who is eventually chosen to fill the vacancy (and when), Lee’s message will continue to ring true to generations of American citizens. This book reminds us all that while differences will inevitably arise between groups of people, we must always aspire to respect the voices and stories of others.

Legislature must plan for the future

T

he 2016 legislative session will begin on March 8. It will be a much shorter session than usual – only ten weeks – but there are still a lot of things Minnesotans expect us to address.

My goal as a senator is to create opportunities for all people to reach their potential; to satisfy their aspirations; to strengthen families; and create robust, vibrant and diverse comLegislator munities.

Our current legislative work must Lingo consider future events, such as reRoger Chamberlain tiring baby boomers – the “silver tsunami” – while managing limited resources. This eventuality will significantly impact every aspect of our culture.

We must properly prepare. We have to consider what our future will look like with every decision we make each year. Here are some of the more important issues the legislature will be wrestling with this session.

Education – I will support policies that provide parents and educators more options and control over educational decisions. A few

ideas: Expand existing tax credits to include tuition; extend support for site-based, teacher empowered schools; create new solutions for educating dyslexic children; eliminate mandates; and improve funding equality. Lastly, I do not support a universal preschool mandate. This proposal is almost universally opposed. We must focus on current needs and priorities. We should not create another burden for our schools and remove options from parents.

Healthcare – It is time to give Minnesotans needed relief and reevaluate MNsure. We were told it would improve healthcare, but all it has done is hurt families.

Numerous reports, some from the Legislative Auditor, have found serious problems with MNsure.

The program has caused huge increases in premiums and deductibles, while costing hundreds of millions of dollars. We have spent as much as $271 million providing public healthcare benefits to people who were not eligible for them!

MNsure has also failed to attract the consumers needed to maintain the financial viability of the system. People are working hard but losing ground. Republicans will continue to offer proposals that would improve fairness, save billions, and allow everyone access to quality affordable healthcare.

Transportation – I support a Republican plan to inject an additional $7 billion over ten years into roads and bridges, without tax increases. This can be accomplished by reallocating existing taxes, improving efficiencies at the Department of Transportation, and through a smarter use of debt.

Taxes – With a $900 million surplus we need reevaluate our tax structure and fi nally provide tax relief for Minnesota families. We are taking too much and wasting too much. We should start by exempting Social Security and veterans’ pension from state income tax. It is also time to begin discussing a fair or flat tax plan for Minnesota.

Debt – Any borrowing should focus on important infrastructure, such as roads, bridges, and critical sewer and water systems.

These are just a few common sense ideas that will create opportunities for all Minnesotans while improving the vitality of our communities. By 2020, retiring baby boomers will have a significant impact on our culture. We don’t need to fear this, but we must be smart about how we prepare for this event.

The other Centennial wrestlers that took part in the individual portion of the tourney found the going mighty tough.

Senior Mike Matheson (145 pounds) lost twice to finish 31-11, and Aiston Degeest lost his lone match to end 26-13.

John Noll (160) lost his only match and was 28-10, while Justin Mohlin ended 27-15 with a loss.

Deante Book lost his lone match and was 9-4 at 220-pounds, and Sam Byrd ended 20-18 at 285 with a loss.

Two team losses Anoka was in control from the outset in a 44-24 victory over the Cougars in the opening round of Class AAA team action.

The Tornadoes began the match against Centennial with a trio of pins and a decision to build a lead too big for the Cougars to overcome.

Anoka won nine of the 14 matches, with Centennial winning five. Bergeland (132 pounds), and Mohlin (182), notched pins. Shilson won 15-0 at 138, Noll 12-4 at 170 and Book 5-2 at 220.

Minnetonka edged the Cougars 34-32 in the consolation round, securing a come-from-behind victory with wins at 220 and 285. Both teams won seven matches, with the Skippers taking the initial four, and the Cougars reeling off six straight victories.

COON RAPIDS – The Centennial boys swim and dive varsity team ended their season on Saturday, Feb. 27, placing fourth at the 7AA Section Championship meet. The Cougars finished with 253.5 total points.

Centennial started out by finishing third (Lucas Baufield, Ivan Newham, Matt Wiege, Skye Matson) in the 200 medley relay. In the days first individual race, the 200 free, Lev Deshitsa placed fifth and Baufield seventh. In the 200 IM, Newham took third and Jonah Carlson placed sixteenth. In the 50 free, Matson finished fifth and Wiege twelfth.

In the 100 fly, Wiege placed ninth and Aaron Brouillet finished twelfth.

The Cougars swam well in the 100 freestyle, with Baufield placing fourth, Deshitsa tenth, and Charley

Swanson fifteenth.

In the 200 free relay, Centennial placed sixth (Wiege, Charlie Sylvester, Swanson and Deshitsa).

In the 100 back, the Cougars nabbed sixth (Matson) and twelfth (Carlson).

In the 100 breaststroke, Newham finished third, Reece Gulbrandson twelfth, and Andrew Tran sixteenth.

The Cougars finished the day placing third in the 400 free relay (Baufield, Deshitsa, Matson, Newham).

In the one meter diving event, Riley McNamara placed fourth and Luke Welsch placed ninth. With his fourth place finish, McNamara will compete at the state meet at the University of MN Aquatic Center March 3-5.

Tyler’s outstanding Section 4AAA showdown earned him a berth in the individual portion of the state tournament. The Cougar senior won the 138 pound section class to improve to 39-3 for the season. He has also ran cross country and was part of the trap team.

Tyler has participated in seven marathons and been named four time all conference, two time all state, two time section champ, two time all tournament state team and received the Spotlight On Scholarship Award. Tyler maintains a 3.8 GPA and is an academic letter winner. He also volunteers as a wrestling coach and helps with MN USA girls wrestling.

Centennial boys basketball team combats cancer

CIRCLE PINES — When Logan Mercado was diagnosed with cancer, his whole basketball team shaved their heads.

Logan Mercado was gearing up for his junior year of basketball season when a pain in his right knee caused him to sit out.

“We thought it was going to end up being a torn meniscus, because he had that before,” said Logan's mom, Victoria Mercado. The doctor determined it was a strain. But when it didn't get better, Victoria pushed for an MRI. They finally got an order for an MRI, which happened to be on Logan's birthday, Dec. 15. Within a couple hours the doctor called and said they had found a large tumor. It turned out to be a rare form of bone cancer.

“Our lives changed forever,” said Victoria. “We didn't for a second even think it would be something

like that. By catching it when we did his chances are much better.”

Instead of playing basketball this winter, Logan has been undergoing chemotherapy treatment. But his basketball team has found ways for him to stay in the game.

They all got together with Logan and shaved their heads in solidarity with him. They also put on a “Hope for Logan” night at a home game Jan. 29.

The team sold T-shirts and wristbands to raise funds for medical expenses. They hosted a shooting competition raffle. They asked fans to wear purple, Logan's favorite color. Some of the opposing team's fans — the Maple Grove Crimson — even wore purple that night.

“I just couldn't believe the support of the community,” said Victoria. “And the boys — that they realize how serious it is.”

Logan made an appearance in the middle of the court. His mom was thankful he had the energy to go to his own benefit night, since he had just come out of

chemo the day before.

The event “made him still feel a part of the team,” said Victoria. “Basketball is his passion. For him not to be able to play this year but still be a part of things was just huge.”

Logan's sister Lexie, a freshman and gymnast, sat out of her gymnastics meet on Hope for Logan night and watched her brother's benefit game.

Her gymnastics team was competing in the same building.

“Her whole gymnastics team dedicated their night to him, too,” said Victoria. “Her team was wearing the shirts also.”

Logan's treatment could take a year, but has been quite successful so far.

“The treatment is going well,” said Victoria. “The chemo does seem to be working. He is definitely a fighter.” The support of the community and his basketball team has helped.

“They will always be in our hearts, that is for sure,” said Victoria.

Mustangs oust Cougar boys basketball Sixth-seeded Centennial gave third-seeded Mounds View all it could ask for in the Section 5(4A) boys' basketball playoffs this past week.

The Cougars worked to a 33-24 halftime advantage, only to have the host Mustangs race back for a 69-67 quarterfinal victory.

Tyler Peterson paced Centennial with 21 points, Josh McGreal added 15 points, and Theo Johnson 12. Zeke Thompson broke free for a game-high 29 points for Mounds View, and Nate Albers added 18 points.

Mounds View joined top-seeded Osseo, No. 2 Champlin Park, and No. 4 Park Center in the section semifinals.

Centennial finished the season with a 10-17 record, while the Mustangs improved to 21-6.

foods that children can prepare for themselves: individual packets of microwaveable macaroni and cheese, oatmeal packets, microwaveable lasagna, individual cups of soup, individually wrapped snacks like Jell-O packs, pudding cups, granola bars, crackers and raisins.

The Circle-Lex Lions Club has held a food drive annually for over 20 years, but Ginny Hestekind brought a new passion to the effort.

“I preached ‘no hungry kids’ in the 5M7 [Lions] district,” she said. As the youth outreach director for the district, Hestekind presents a new challenge to 50 clubs each year for youth outreach motivation.

The Lexington Fire Department became involved in the food drive after working with the Lions Club at the department’s open houses, held each year

during Fire Prevention Week in October. Lions Club members devoted time in shifts to stir booya and serve hot dogs at the events.

“We worked with Ginny a lot,” said Fire Chief Gary Grote, who has been with the department since 1993.

“They reached out to the fi re department for the Easter egg hunt and it sort of grew from there.” Grote noted that the fi re department wanted to help the Lions Club more. “We want to work with them to help the community as much as possible. That’s what we’re all about.”

Volunteers from the Lexington Fire Department and Circle-Lex Lions Club will be greeting the public and gathering food and cash donations at Festival Foods until 4 p.m. Cash donations will be dropped into fi refighter’s boots.

“I’m proud of the CircleLex Lions Club and Lexington Fire Department

for the time donated to the project,” Hestekind said. “They are all some of the best volunteers a community can have — fi refighters and Lions.”

According to a brochure prepared by the Centennial Food Shelf, one in five Minnesota families with children will experience hunger or food insecurity.

Approximately one-third of those served by the Centennial Food Shelf are children. In addition, hunger is known to have a negative impact on learning.

In October 2015, 647 power packs were provided to children in the Centennial School District. To date, more than 280 power packs are distributed to Centennial students each week during the school year.

Volunteer opportunities with the Centennial Food Shelf include transporting power packs to various Centennial schools, breakdown and recycling of

packaging materials, event coordination, fundraising projects and more.

For standard monthly needs the following donations are encouraged: cereals, chili, coffee and teas, canned fruits, tuna, pastas, boxed potatoes, spaghetti sauce, ketchup and mustard, salad dressing and baking supplies, as well as laundry soap, hand soap, paper towels, toilet paper and facial tissues.

The food shelf is able to purchase more food per dollar than members of the general public can, so monetary donations to the organization go further and are greatly appreciated.

LINO LAKES — Over 100 attendees gathered for the performance of a Native American culture-oriented play at Centennial Middle School on Feb. 19.

The play, “Bring the Children Home,� written and directed by Minneapolis resident Marcie Rendon, includes singing and spirits, and tells the story of a child born into a violent and uncertain world. It portrays the importance of family and the guidance of elders to exhort youth to a beneficial and positive life path. The play embodies allegorical references and fully developed characters with original, fresh language.

The performance was enacted by Raving Natives Productions, a group that Rendon was able to develop by applying for and receiving grant money. The actors range in ages and Native bloodlines, from Ojibwa to Dakota and Meskwaki, from age 12 to much older. Centennial’s American Indian Education Program invited the troupe to come perform. “It was a real treat to work with a full stage and lighting,� Rendon noted, as their troupe is used to performing in fairly informal settings.

Rendon said she was inspired to write the play when living with her family in the Phillips neighborhood in Minneapolis as the city was going through a gang war. Rendon was motivated by “the number of young people I saw caught up in that level of violence,� she said. She also wanted to bring Native theater performance to the Native community. “Our people aren’t used to attending theater,� she noted. She said there is no Ojibwa word for art, even though Native people created beauty on what they wore, told stories, danced and made other beautiful crafts.

Rendon later achieved a B.A. in American Indian studies and a B.A. in criminal justice from Moorhead State University, as well as an M.A. in human development from St. Mary’s University. Though she has no formal education in writing, her resume boasts a host of writing residencies in which she published and produced plays and poetry. She completed an internship with the St. Paul Pioneer Press, has written songs and short stories, and has made educational presentations. Despite her lengthy resume, Rendon is humble when discussing her work. “In 1991 I decided to make my living as a writer,� she said. “I just started finding writing jobs.� This involved submitting her work to multiple places and walking into newspaper offices to make offers. “I read lots of ‘how-to’ books.�

Her current projects include a short play that has been translated into Ojibwe, a murder mystery, and a piece for the St. Paul History Theater, written with one of Raving Native's performers Tom LeBlanc, an internationally acclaimed Dakota poet, playwright and songwriter. The piece requested by the theater was about “The Hanging of the 38,� the largest mass execution in United States history that took place in Mankato during the effort to eradicate the Dakota from the state. Thirty-eight Dakota people were hung by order of President Abraham Lincoln, and three or four of LeBlanc’s relatives were incarcerated at that time.

1.0 CALL TO ORDER Acting Chairperson Wilson called the regular meeting of the School Board to order at 6:30 p.m. in the District Office Board Room.

The following board members were absent: Burns. 4.0 APPROVAL OF THE AGENDA Acting Chairperson Wilson acknowledged approval of the agenda with one additional item under 13.01 Dates to Note to set a Special Meeting prior to the February 8 Work Study Session. Acting Chairperson Wilson also noted that in agenda item 5.0 Election of Officers, if only one person is nominated for a position, it will not be necessary to have a roll call vote. 5.0 ELECTION OF OFFICERS Chairperson – Christina Wilson was nominated by Timm. 6.0 RECOGNITIONS High School English Teacher and theater director Mark Quinlan recognized the student award winners as actors in the fall production of The 25th Annual Putnam County Spelling Bee. The production received four honorable mention group honors and one outstanding group honor. Students receiving outstanding performance in a leading role honors were Will Rafferty, Courtney Klein and Adam Drabek. Students receiving honorable mention performance in a leading role honors were: Isabelle Sorenson and Sammy Latterell. Nate Averbeck and Nathan Navratil receive evaluator shout-outs, a new distinction which gives recognition to those students who caught the attention of the evaluators. Director of Technology Mike Christensen recognized 2015 Technology and Information Education Services Exceptional Teacher Award recipients Erin Chapman and Chris Kopp. 7.0 PUBLIC FORUM: None. 8.0 SUPERINTENDENT REPORT: Superintendent Dietz reported that members Lodico and Guthmueller along with Director Bergert presented at the 2016 MSBA Conference for the third year on Branding and Marketing. Executive Director Huffman and CEA President Scarr also gave a presentation on self-funded insurance. Superintendent Dietz congratulated member Guthmueller for being elected to an additional three year term on the Board of MSBA at the conference.

Superintendent Dietz noted that Executive Director Huffman has requested that a Special Meeting be set for Monday, February 8, 2016 at 5:30 p.m. to approve a construction bid. tronic fund transfers (wire transfers) as permitted by Minnesota Statute 471.38 and submit a list of such transfers at the next regular School Board meeting after the transfers take place. 9.16 Authorization to Lease, Purchase and Contract for Goods and Services – Authorize as permitted by Minnesota Statute 123B.52 the Superintendent of Schools or the Executive Director of Business Services to lease, purchase, and contract for goods and services, within the budget as approved by the School Board provided that any transaction in an amount exceeding the minimum amount for which bids are required ($100,000 per Minnesota Statute 471.345) must first be specifically authorized by the School Board and must fulfill all other applicable legal requirements for school district contracts. 9.17 Authorization to Make Payments in Advance of School Board Approval – Authorize the Superintendent of Schools or designee/Executive Director of Business Services to make payments in advance of School Board approval when payment of claims cannot be deferred until the next School Board meeting approval under the following conditions and to include such payments in the next list of bills submitted to the School Board for approval: Payments of claims which cannot be deferred until the next School Board meeting without the loss to the district of a discount privilege, or because of contract terms, purchase order terms, or a vendor’s standard terms which are part of a contract, in accordance with Minnesota Statute 123B.02, Subd. 18; payments of claims within the standard payment period as defined in Minnesota Statute 471.425. 9.18 Authorization of Petty Cash Accounts – Authorize the use of imprest funds (petty cash accounts), that the Superintendent of Schools or designee/Executive Director of Business Services be appointed as custodian of such funds, and that their only uses be for the payment of proper claims against the district, excluding salaries and personal expenses, which it is impractical to pay in any other manner, and for travel expense advances, all as permitted by Minnesota Statute 123B.11. 9.19 Official Newspaper – Approve the continuation of the Quad Press as the legal publication for the school district for 2016. The cost per column inch for 2016 will be $8.64. 9.20 Election Clerk – Authorize Jody Josephson to act as the official election clerk and Bev Goertzen as the assistant election clerk for all school board elections in 2016. 9.21 State and Federal Programs – Approve the Superintendent of Schools as the school district’s representative for the Title Block Grant, Indian Education (Title VII) Grant, Safe and Drug Free School (Title IV) Grant and other competitive grants in Centennial Schools. 9.22 School Board Meeting Schedule – Approve the meeting schedule for 2016. Other meetings, as needed, will be added. 9.23 School Board Member Compensation – Approve the School Board member compensation for 2016: Chair - $5,600; Vice-Chair - $5,000; Clerk - $5,400; Treasurer - $5,000, Directors - $4,800. 9.24 2015 Mileage Allowance Rate – Travel allowance for district employees effective January 1, 2016 will be 54 cents per mile. The mileage allowance is tied to the Federal Tax Mileage Rate from the previous calendar year. 9.25 Minnesota State High School League Foundation Grant – Mr. Brian Hegseth, Centennial High School Activities Director, is applying for a grant from the Minnesota State High School League Foundation. Any funds received will be used for high school athletes’ concussion baseline testing and coaches’ education. The MSHSL Foundation requests School Board action to approve the grant request. The Superintendent of Schools recommended the School Board approve the Consent Items as detailed in the enclosure. Motion by: Guthmueller, seconded by: Lodico, Ayes: 5, Nays: 0, motion carried unanimously. 10.0 RESOURCE MANAGEMENT 10.01 High School West Mechanical Equipment Bid - On January 19, 2016 the district opened bid package #18 for High School West Mechanical Equipment. A copy of the bid tab, recommendation from Nexus, and the Executive Director of Business Services recommendation are included the school board packet. The Executive Director of Business Services recommended award of this bid package as per the letter from Nexus included in school board packets. Motion by: Culp, seconded by Timm, Ayes: 5, Nays: 0, motion carried unanimously.

10.02 HRA Post Retirement Memorandum of Understanding with CEA - The Centennial School District is recommending partnering with the CEA to extend the date when CEA members need to notify the district they are retiring to benefit from the HRA sick leave buyback program. In Article X- Group Insurance, Section 8, Subd. 1, Item 5, it states; Teachers who have elected the a one-time contribution to a Health Reimbursement Account (HRA), and who are eligible to participate in the sick leave buy back option, can elect to buy back an additional 10 days of sick leave in the year they plan to retire provided the retirement notification is received by the school district prior to January 15th of that year. The notification date would be extended until February 19, 2016 to provide more time for those considering retirement to make a decision. This extension is a one-time extension only and is extended for the 2015-2016 school year only. The Director of Human Resources recommended the approval of this MOU. Motion by: Lodico, seconded by Timm, Ayes: 5, Nays: 0, motion carried unanimously. 11.0 SUPPLEMENTARY ITEMS 11.01 Review of Policies: First Reading - Centennial ISD Policy 208 states the school board shall review policies at least once every three years. The superintendent shall be responsible for developing a system of periodic review, addressing approximately one third of the policies annually. In addition, the school board is required to review the following policies annually: 410 Family and Medical Leave; 413 Harassment and Violence; 414 Mandated Reporting of Child Neglect or Physical or Sexual Abuse; 415 Mandated Reporting of Maltreatment of Vulnerable Adults; 506 Student Discipline; 514 Bullying Prohibition; 522 Student Sex Nondiscrimination; 524 Internet Acceptable Use and Safety; 616 School District System Accountability; and 806 Crisis Management. In addition, Policy 5030 Professional Growth Activities needs to be repealed as it is covered under statute and is no longer necessary. Policy 5030 Professional Growth Activities will require a second reading and approval to repeal. No changes were made to the following policies we are required to review annually: 414 Mandated Reporting of Child Neglect or Physical or Sexual Abuse, 415 Mandated Reporting of Maltreatment of Vulnerable Adults, 514 Bullying Prohibition, 522 Student Sex Nondiscrimination, 524 Internet Acceptable Use and Safety and 616 School District System Accountability so no second reading/action is required. Redline changes have been made to policies 410 Family and Medical Leave, 413 Harassment and Violence, and 506 Student Discipline. These three policies will be brought for a second reading and adoption at the February Board Meeting. Policy 5030 Professional Growth Activities will also be brought back for a second reading and approval to repeal. Policy 806 Crisis Management will replace the existing Centennial Crisis Management Policy 3135. It is being revised and will be brought forward for readings and adoption at a future board meeting. The following School Board Members was absent: Lodico. 3.0 APPROVAL OF THE AGENDA Chairperson Wilson acknowledged approval of the agenda. 4.0 PUBLIC FORUM: None. 5.0 RESOURCE MANAGEMENT 5.01 High School West Mechanical Equipment – Displacement Ventilation Units Bid Award - On January 19, 2016 the district opened bid package #18. At the time of the bid opening, the apparent low bid for the Displacement Ventilation Units was for an unspecified alternate Cabinet Displacement Ventilation Unit. Nexus refrained from approving the bid until an evaluation of the alternate equipment could be done. Nexus found that the design/application approach of the unspecified alternate units was different than the basis of design and therefore was not acceptable. Nexus and the Executive Director of Business Services recommended awarding this portion of the bid package for Displacement Ventilation Units to Midwest Mechanical, the apparent second low bidder. Motion by: Culp, seconded by: Burns, Ayes: 5, Nays: 0, motion carried unanimously. 5.02 Authorization to Purchase Properties - The district’s Long Range Facilities Plan included future site work at the high school to allow us to gain additional student and staff parking, reroute traffic flow and expand the fields. In order to accomplish this, the district needs to acquire 4 properties on 103rd Lane NE. The acquisition process is defined by statute and requires negotiating a purchase price in advance of the eminent domain process. We are using a relocation services company to work through the requirements of the process. Two signed purchase agreements were brought to the Board for approval. $197,000 was the mutually agreed upon price for the property owned by Jerry Boles at 4816 103rd Lane NE, Blaine, Minnesota and $174,900 was the mutually agreed upon price for the property owned by Katherine M. Parsons at 4756 103rd Lane NE, Blaine, Minnesota. The District is in the process of negotiating with the owners of the other two properties. Administration recommended that the Board accept the recommendations of legal counsel and the relocation counsel and accept the

offers to purchase and complete the transactions so we may acquire these two properties. WHEREAS, the City of Circle Pines, Minnesota (the “City”) is a member of the North Metro Telecommunications Commission, an organization formed with the Cities of Circle Pines, Blaine, Centerville, Ham Lake, Lexington, Lino Lakes and Spring Lake Park, Minnesota (together with the City, the “Joint Cities”) by the execution of a Joint and Cooperative Agreement for the Administration of a Cable Communication System (the “Agreement”) for which the general purpose is to monitor the operation and activities of cable communications (the “Project”) as more particularly described in the Agreement; and B. WHEREAS, Minnesota Statutes, Section 412.301 authorizes the City Council to issue capital notes within existing debt limits for the purpose of purchasing capital equipment; and C. WHEREAS, said statute also provides that if the amount of the capital notes to be issued to finance such equipment exceeds 0.25% of the estimated market value of taxable property in the City, they shall not be issued for at least ten days after publication in the official newspaper of a council resolution determining to issue them; and if before the end of that time, a petition asking for an election on the proposition signed by voters equal to ten percent of the number of voters at the last regular municipal election is filed with the administrator, the capital notes shall not be issued until the proposition of their

WHEREAS, the City proposes to issue its General Obligation Capital Notes, Series 2016A (the “Notes”) to finance the Joint Cities share of the costs to finance the acquisition of capital equipment for the Project (the “Equipment”) in an amount which exceeds 0.25% of the estimated market value of taxable property in the City; and E. WHEREAS, each member of the Joint Cities will issue its General Obligation Capital Note, Series 2016A to the City in order to pay each member’s share of the debt service on the Notes; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Circle Pines, Minnesota, as follows: 1. Purpose. That it is necessary and expedient for the City Council to issue the Notes pursuant to Minnesota Statutes, Section 412.301, in an amount not to exceed $2,065,000 for the purpose of financing the acquisition of the Equipment.

2. Amount. The amount of the Notes is hereby determined and declared to be in excess of 0.25% of the estimated market value of taxable property in the City.

3. Publication. The Administrator is authorized and directed to publish this resolution in the official newspaper of the City.

4. Time. At least ten days shall elapse after publication in the official newspaper of the City of this resolution before the Certificates may be issued.

Local man authors book on international dating

LINO LAKES — When it comes to international Internet dating, David “D.W.” Bauer wrote the book on it — literally.

In 2014, the Lino Lakes resident traveled to Ukraine during a civil war to date women he met online. He chronicled his experience in the justpublished book, “Three Extraordinary Women of Ukraine and One Foolish Man.” The ebook spent a week as number one in the Amazon category “Best Sellers in Belarus and Ukraine Travel Guides,” Bauer said.

A licensed soil scientist for MnDOT, Bauer grew up in the Alexandria lakes area of Minnesota with a fishing pole in hand most of the time, he said. He didn’t Internet date until a separation and divorce in 2014 caused him to seek something “different.” Also an independent film writer and producer, he had worked on a screenplay about a Minnesotan meeting a Ukrainian woman online, so he was familiar with the concept of international Internet dating. Ukraine was a natural choice: he’d helped host a group of Soviet students visiting Minnesota during high school.

“It was an exotic adventure,” the 43-year-old said. “It was a very positive experience in a business filled with warnings of scams.”

Bauer had a list of behaviors that he said would make him cautious: no webcam, different personalities over several chats or letters, immediate sexual chat, forgetting major details about him, asking for gifts or money.

When he went to Ukraine, he gave his itinerary to friends, stayed in reputable hotels, and registered as a visitor with the U.S. State Department, which provided info on street crimes common in Ukraine.

“This was my first international experience traveling alone,” Bauer explained. “I was not part of a tour and only knew a little Russian language.

I’ve been to Mexico, Canada, and Jamaica with others, but this trip took a lot more courage. I gained a lot of confidence.”

Despite economic upheaval, he said, there was a lot of romance in Ukraine, especially in Kiev where he saw couples walking in the parks, enjoying each other’s company. He was surprised by the amount of art, often inspired by famine, war and revolution.

“It seemed to be a way for the people to cope with their tragic history,” he remarked. “The Chernobyl museum and the Great Patriotic War museum

were among the best history museums I have seen in my life. They were visually interesting and evoked emotion.”

While people were friendly once he engaged them, Bauer said, they did not lead with a smile. Most employees seemed genuinely happy to do their jobs, including airport security. Once, Bauer responded to a customs agent’s questions in Russian: “I speak English, a little Russian. I am an American woman.”

“I have trouble with gender in Russian,” he explained.

While in Ukraine, Bauer dated three women whose names were changed for his book — and became friends with all three. He’s kept in touch with all of them since his trip, but one — Maria — much more than the others.

“My date with Maria was amazing. I thought 20 minutes had passed and it was really 3.5 hours,” he said. “I think about her most days and she writes

His advice for others? “This is an expensive journey. Trust your instincts and spend only what you can afford. A relationship abroad will take time. Be suspicious of quick things. Be honest about your life, because the assumption is that you are rich.”

While the amount he spent on the dating agency is private, Bauer said it was a small fraction of the $25,000 that one agency charges for everything, including legal and immigration support. He recommends that men who are serious about international Internet dating have several thousand dollars to spend, and be able to make longer trips to get to know the other person better. There’s also the need for money so that the woman can visit her family after coming to America.

“Some men feel most of the women on these sites are potential scam artists,” he commented. “The women I met did not seem desperate. They enjoyed the attention of Western men, liked being taken to restaurants, and enjoyed receiving gifts. They were not looking for a hero to rescue them. They were reluctant to leave Ukraine and their families unless they fell in love. My book is an open look at following my heart overseas.”
