LEXINGTON — City representatives and Parkview Homes LLC are attempting to work out their differences in federal district court related to what the complainant is calling a “refusal” of its application for more units. Lawyers representing the two entities met Feb. 19 in an attempt to resolve their issues, but ran out of time. A follow-up session is scheduled for March 4. Parkview Homes LLC, owned by National Loan Acquisitions Company (NLAC), initiated the lawsuit against the city of Lexington in August. NLAC owns Parkview Homes after the previous owner reportedly defaulted on his loan payments. “We stayed there all day,” said Kurt Glaser, city attorney. “We discussed a lot of the issues. We came up with a list of things to research.” The two parties were in separate rooms, while a judge moderated the discussion back and forth between them. According to a letter from Glaser to Parkview dated Aug. 14, the city requested the applicant submit a detailed, comprehensive plan relating to the new units. “From the information known to the city, your client is proposing a multimillion-dollar rehabilitation to the property,” reads the attorney’s letter. “That investment, including the proposed placement of 22 units, constitutes a major rehabilitation that requires your client to submit plans and specifications detailing the overall project.” The letter also addressed the city's request for the property to submit plans on its water system and Americans with Disabilities Act requirements for new units. Instead of a rehabilitation plan, the city received a summons and complaint dated four days after Glaser’s letter, indicating it is being sued. According to Parkview's complaint, the city's building code is pre-empted by federal law regarding manufactured housing. “The city has impermissibly attempted to interfere and actually interfered with Parkview's protected property interest by wrongfully refusing permits for the placement of HUD-certified manufactured homes in the community,” reads the complaint. “Parkview has been injured in an amount in excess of $50,000 to be determined at trial.”
