State Supreme Court issues opinion on appointment

Three courts have now weighed in on whether Anoka County followed state statute when reappointing a manager to the Rice Creek Watershed District (RCWD) Board of Managers.

The Minnesota Supreme Court has now issued an opinion that reverses the decision of the Court of Appeals and remands the case to the District Court for proceedings consistent with the Supreme Court’s opinion.

The conflict between the city of Circle Pines and Anoka County stems back to 2019 when the county published notice of a vacancy on the board because Columbus resident Patricia Preiner’s term was expiring in January 2020.

(Preiner has served on the board of managers since 2008.) In October 2019, the city of Circle Pines submitted a list of three nominees to the county to fill the vacancy. (The cities of Blaine, Lino Lakes, Centerville, Lexington, Spring Lake Park and Fridley also supported the city of Circle Pines’ list of nominees.) The city of Columbus notified the county that it supported Preiner for reappointment. In June 2020, the county reappointed Preiner.

Circle Pines asked the District Court to hold that the county violated the statutory process when it reappointed Preiner, while the county requested that the court uphold its reappointment decision.

Circle Pines declares Down Under property public nuisance

CIRCLE PINES — If you live in Circle Pines or drive through the city, you likely have come to know where the Down Under property is and what it looks like.

The property, located at 10100 Lake Drive, has sat vacant since around 2010. The property is owned by brothers Timothy Pawlik and Thomas Pawlik. The men’s parents, Joe and Jan Pawlik, acquired the property from the city back in 1975.

Back in January 2019, the city passed a resolution ordering the repair, removal or razing of the structure, which the city deemed a “hazardous property” under Minnesota Statute 463.17. The building was ultimately demolished in April 2019.

City Administrator Patrick Antonen explained that the city’s building official, Rum River Consultants, recently conducted an inspection and declared the property a public nuisance. Several code violations remain on the property, including a

temporary fence that has been up for well over 180 days. He also said that what is left of the building’s basement is in dangerous condition.

“It’s a significant problem,” Antonen said. “The city has the ability to take care of that public nuisance.”

Antonen added that both of the owners as well as the attorney who represents them have been contacted via certified mail regarding the city’s declaration and its plans to conduct a public hearing. The hearing is SEE DOWN UNDER, PAGE 6

DNR BRIEF Declining water levels affecting boat launches and retrievals

Low water levels resulting from belowaverage rainfall in much of the southern third of Minnesota in June and July are making boat launching and retrieval challenging at many lakes and rivers, especially in the Twin Cities metro area. When water levels decline, less of the boat ramp is underwater, which reduces the length of the ramp available for a successful launch. As a result, there is a greater chance of backing a

trailer past the end of the ramp when launching. Ramps can be extended in some places to reduce this risk, but this is not effective where shallow water persists well beyond the boat ramp.

Another low-water hazard to consider is the possibility of a prop-wash hole at the end of a boat ramp. Prop-wash holes are caused by power loading, which happens when boat operators use the motor to load the watercraft onto the trailer instead of cranking the boat onto the trailer with the winch. The motor

scours a hole in the sand and gravel at the end of the boat ramp. Unsuspecting boaters can back into the prop-wash hole with their trailer.

To successfully launch boats in lowwater conditions: • Check the ramp, especially the firmness of the gravel at the end of the concrete ramp and the water depth.

• Use smaller watercraft or a different waterbody if the ramp you normally use is too shallow.

• Expect delays at public access sites

and be patient with boaters who are having difficulty launching.

• Watch for obstructions in the water near the access, like large boulders or tree stumps.

Moving forward on to the next chapter

A

s college students we are told internships will give us real life experiences to prepare us for our future careers. As I reflect on my first internship, I can’t help but face the paralyzing anxiety that comes with the thought of my future.

As someone who has always had a fairly good head on my shoulders, who kept straight A’s all throughout high school and has continued to keep good grades throughout college, I often challenge myself. Why do I care so much? What is this going to get me other than a diploma that now qualifies me for 35% of America’s jobs? Because I know that diploma does not guarantee happiness in my future career.

Press It does not guarantee that I will ever find my dream job and it sure intern as heck does not guarantee that I know what I’m doing with my life.

Ella Roberts In all honesty, I am scared of the known burnout that most journalists experience. I am scared I will not be good enough, that I will not be successful and that I will not make enough money to provide for a family. There is no test or training that can make me any more qualified than the person next to me. These are just some of the things I am constantly wrestling with as a college student.

Because I have been living in my parent’s home for two months, where I resided all throughout high school, I have also come to realize I am growing up. It’s a strange feeling– growing up and reflecting on the many friendships and relationships that have come and gone. In the past three years, my life has changed drastically.

Sometimes I cannot begin to process it. Often, I become overwhelmed with the conflicting feeling of being stuck between two different worlds.

The one I once lived in and the one I currently live in. I’m not sure if this pull back and forth is a side effect from being a part of the COVID-19 graduating class or if it’s the loss of a childhood best friend who lived in my neighborhood, or the boy who passed away in a car accident on the back roads I take to get to work everyday. Never in a million years did I think I would have so much vengeance towards my hometown and at the same time, feel this tug to come back and live it all over again.

Amidst all the confusion, a huge lesson I have learned is that God isn’t continuously telling us what to do as we search for ourselves. He gently reminds us who we are. He continues to rewrite our lives in beautiful and unexpected ways, knowing the next version of us will usually be better than the previous one.

As I enter my junior year at Bethel, I am filled with gratitude to know that I have a second home where I can truly discover myself, continue on my faith journey, surround myself with good company, make mistakes without facing judgment and best of all provide me the opportunity of this internship.

Something better is just around the corner

T

he past two years have been a whirlwind for me at the Minnesota House of Representatives. I was able to work through my committees and represent our district and our values. We passed legislation that replenished the Unemployment Insurance (UI) trust fund and we stopped significant tax increases.

And we passed an historic Legislator standalone, veterans bill Lingo that received Donald Raleigh incredible bipartisan support in the House and Senate in Minnesota.

This new law funds a grant to aid veterans and their families who are facing homelessness, to help them with temporary housing, and the design, construction, furnishing, and equipping of new veterans’ homes in Bemidji, Montevideo, and Preston, Minnesota.

Governor Walz asked me to speak to the press about the bill during the bill signing and I shared that this is the type of work that we were elected to accomplish.

Bipartisan legislation that focuses our attention on a problem that we can solve. I also shared that my next

priority in the Veteran’s Committee is addressing the need for a renewed commitment to mental health and preventing the tragedy of suicide that is plaguing our community.

I am also proud to have authored a bill that protects our police officers and their families, and it received overwhelming, bipartisan support and was signed into law.

As we all know, there have been some significant events that have occurred over the past two years in our communities. We watched them unfold and read about them almost every day. These events seem overwhelming at times. It seems like every story you read leads you to another story of tragedy—some have called this “doom scrolling” where you scroll to the next story of doom and so on.

But there is a feeling that is starting to emerge, one of hope and optimism. Most of the press and social media we read will lead you to nothing but bad news stories, however, there is coming a renewed sense that something better is just around the corner.

There is hope for the future, a change in what we expect from our community, and a renewed commitment to working together.

This is not to say we should ignore reality. Instead, it is to point out that there is optimism and a coming return of pride in our state and nation. Our country was founded on guiding principles that go beyond

simple headlines. We are a people set apart and a nation built upon a promise. And that promise is what binds us together as a nation. It is the promise of an America where anything is possible.

To get there we must return to the rule of law. We must hold criminals accountable. We must support the protectors who serve our community as police officers, fire fighters, and emergency responders. And we as a nation, and a community, must return to the subtle art of communicating with each other, working together, and listening to understand, not simply yelling at each other over our keyboards.

It has been an honor to serve as your State Representative over this past legislative session. I hope to take the lessons I have learned, the relationships I have developed, and the hard work of crafting well written bills into the next session.

We have an awesome community, one that is an example to the rest of the state. I am proud to be of service to my community and look forward to working with and for each of you.

Sen. Chamberlain receives Guardian of Small Business Award

PAID LETTER Commonsense candidate

The state’s major small business organization, the National Federation of Independent Business (NFIB), recently presented Sen. Roger Chamberlain (R-Lino Lakes) with the prestigious Guardian Roger Chamberlain of Small Business Award.

Chamberlain earned the award with a 100% score on the NFIB Minnesota Voting Record for 2021-22. The Guardian of Small Business Award is reserved for legislators who vote consistently with small business on the key issues identified by small business owners. Minnesota lawmakers who voted with small business on key issues 80% or more of the time during the 2021-22 legislative session earned the NFIB Guardian of Small Business Award.

It makes no sense. The Democrats hope to reduce violent crime with more restrictive laws on gun ownership for law-abiding citizens at the same time they want reduced sentences and no bail for criminals.

The results are more violence, not less. Just observe recent crime in the Twin Cities: the revolving door in Hennepin and Ramsey counties has put criminals back on the street, released without bail or given probation when they should be in prison. Predictably, they’re committing more violent crimes.

Sadly, Democrats in the Minnesota House have played politics with public safety. One year ago, they voiced support or stood silent as Minneapolis voted to dismantle the police department in spite of a record crime wave. In the legislative session, their ideas for reducing crime included $55 million in grants to nonprofits, and hiring “violence interrupters” to help keep peace. How about stiffer penalties for carjacking? Rejected.

Going after law-abiding gun owners, as candidate Susie Strom proposes, as a solution to stop gun violence in Minnesota when her party is reducing penalties for criminals and dismantling police departments is incompetent. It will put Minnesota on a trajectory mirroring Chicago. For my money, Elliott Engen is the only commonsense candidate.

Mayor Rob Rafferty administers the Oath of Fire Service to the city’s newest firefighters, Jacob Bogdanovich, Brian Pevito and Brian Kisch.

Centennial Middle School seeks Promise Fellows

• The city will dispose of its current IN-700 postage machine and lease an iX-5 postage machine from Quadient for five years. The first year will cost $5,233. The city will pay $11,090 to lease the machine for five years.

• American Legion Post 566 is gearing up for Blue Heron Days Aug. 19-20. The Legion plans to fence off a portion of its property for an event, which will include live music from 4 to 8 p.m.

• Both a ribbon-cutting and a grand opening are planned for the Rookery Activity Center this fall.

Both events will be held Saturday, Sept. 24.

• Community Service Officer Zachary Beddow is now a police officer with the Lino Lakes Public Safety Department. His hourly rate of pay will be $36.66, the starting step of six steps within the union wage schedule. Beddow graduated from Metro State University with a bachelor’s degree in law enforcement this spring and has met all of the Minnesota Board of Peace Officer Standards and Training (POST) mandates.

• A contract is now in place for the next three school years for the Lino Lakes Public Safety Department to provide a school resources officer (SRO) at Centennial Middle School. Previously, the contract has been renewed on an annual basis. The Centennial School District reimburses the city of Lino Lakes for all hours worked by the SRO. The reimbursement is based on hourly wages, including all applicable benefits costs.

The next City Council meeting will be at 6:30 p.m.

Monday, Aug. 8, in the Council Chambers at City Hall. Immediately beforehand, there will be a work session at 6 p.m. in the Community Room at City Hall.

Centennial needs reading, math, early learning tutors

In response to the unprecedented educational challenges posed by the COVID-19 pandemic, five reading tutors, two math tutors and one early learning tutor are being sought to begin serving in Centennial Schools in August. Overall, Reading Corps, Math Corps and Early Learning Corps are recruiting 1,700 tutors throughout Minnesota.

No teaching experience is needed. Reading Corps and Math Corps tutors are fully trained and serve on site at the school for 35, 25 or 18 hours a week. All tutors receive a stipend every two weeks, plus up to $4,500 to pay for college tuition or student loans. Those who are 55 or older may choose to gift their education award to their child, grandchild, stepchild or foster child. Many tutors also qualify for additional benefits like free individual health insurance and child care assistance.

Her foster mom says she is the sweetest girl and she likes to cuddle during her downtime.

We’ve had two of the driest months I’ve ever recorded. My 0.61 inch of rain in June set a station record and I totaled only 1.52 inches in July for a two month total of 2.13 inches. Normally I would expect 9.38 inches. As I look back into years past, whenever we’ve had dismal rainfall in June and July, August has provided a nice rebound.

The state on the whole received some nice rainfall totals this past week but the Twin Cities has missed out.

Sunday’s series of passing storms provided only 0.15 inch of rain and was just enough to dampen the grass as the ground remained very dry below the surface. Here’s to hoping that history will repeat itself and we see a rebound in rainfall in August.

Ex-Cougar featured on NHL website after return to good health

Will Francis, former Centennial hockey player whose career was interrupted by a serious illness, was the subject of a feature story on the National Hockey League website, upon his return to good health.

The 6-foot-5, 207-pound defenseman, currently a Minnesota-Duluth player and a draftee of the Anaheim Ducks, had recently completed his final chemotherapy session for Acute Lymphoblastic Will Francis Leukemia, 848 days after the initial diagnoses, at Fairview Masonic Children’s Hospital.

His father, Jeff, commented: “Typically after treatment, he would want to go home and get some rest. You know, he’d go in, take it and grind through it. That day, I think he was smiling until 10 o’clock at night. We went out on the lake with the family and he jumped right in the water. It was just one of the best days you could ask for.”

Francis made all-conference for the Cougars in 11th grade as a rugged, high-scoring defenseman, then switched to juniors hockey with Cedar Rapids in the USHL. He had a plus-nine rating during 59 games with Cedar Rapids in the 2018-19 season and was drafted by the Ducks in the sixth round in 2019.

However, he was limited to 10 games the following season.

Francis fell ill during a family outing at their cabin near the Canadian border on March 13, 2020, and was diagnosed with ALL, beginning his long journey of treatment.

Will Francis recently completed two-plus years of chemotherapy for ALL.

“There were a lot of question marks and uncertainty but with the support of my family, friends and faith, we were able to go about it the right way,” Francis told the interviewer. “Anything is possible that you put your mind to. I think I just used it to grow mentally. I grew as a person.

An outpouring of support included messages of encouragement from hockey luminaries Bobby Orr, Scott Niedermayer, the late Guy LaFleur, and Ducks captain Ryan Getzlaf. “I think it just helped me tremendously,” he said.

After his long-awaited go-ahead from his doctors, Francis journeyed to California to join the Ducks Development Camp in June.

Ducks coach Dallas Eakins observed: “Adversity affects us all in different ways and I think adversity has certainly given him the mindset that he can

achieve anything. We use all these words like discipline and commitment, but those words mean something a whole lot different to him because it wasn’t a hockey game or a career, it was his life.”

Francis made a brief appearance with UMD this past season, playing in five games, including two playoff games. He will resume his college career this coming season.

Council tables amendment to city code, pauses for public input

CIRCLE PINES — Since May, the City Council has had repeated, indepth conversations about whether it should allow massage therapy businesses to operate within a residential area. Now, the council would like to hear from residents.

The topic first came up when a resident visited the council to speak during open mike. She explained that she moved back to the city during the pandemic but wanted to now start up her small, in-home massage therapy business.

Currently, massage businesses are only permitted to operate within commercial or mixed-used zones within the city and are prohibited in residential areas. Many other in-home businesses are allowed to operate within the city and do not require licenses. Some businesses, like auto repair shops, are strictly prohibited within residential zones.

“After a lot of discussions, it seems like the council would like to allow massage businesses in residential neighborhoods with some conditions,” City Administrator Patrick Antonen explained. “City staff is still recommending not making this change. This could open the door to other businesses in residential areas if we choose to license businesses in residential areas … It is kind of a precedent-setting move that you need

to take very seriously.”

Longtime Planning and Zoning Chair Mike Kula expressed his opinions on the proposed changes to City Code Chapter 308: “I have a hard time with this proposed amendment for a lot of reasons. I think zoning laws are really important. I think as property owners we expect to be able to rely on what the zoning is for the property we own, and hopefully the value that it either maintains or accrues over a period of time,” he said. “We are going to essentially remove elements that come from our zoning ordinance to expressly permit a business that currently is not permitted in residential zoning areas.

That bothers me as a homeowner in a residential area.”

Council Member Dean Goldberg said he would not be in favor of the proposed changes. “There is an ordinance specifically on commercial sauna and massage services and it is 14 pages long, and previous city councils came up with this for a very specific reason,” he said. “The ordinance specifically outlines the reasons why it was developed.”

Both Kula and Goldberg expressed concern that the council was considering making changes to the ordinance when city staff recommended not doing so. Kula said, “When you get a recommendation from staff, that’s the gold seal of approval, and we take that very seriously: To read the words ‘We

strongly recommend denial.’ I don’t think I have ever seen that word ‘strongly’ used in a recommendation from staff before,” he noted.

“Whatever you do now, 20 to 30 years from now it is going to have a ripple effect on the city.”

Goldberg added, “We are going in the face of our staff who are advising us to not accept these changes. I can’t tell you how strongly I disagree with this. … I do not think it builds upon the city in any positive way.”

Council Member Steve McChesney said he felt like the massage industry was being singled out. “You can have many home-based businesses … chiropractic, accounting, hair care.

This was the only thing under health and beauty that was prohibited. To me, I think we should allow it as long as it falls within our zoning stipulations and some of these (conditions) we are going to discuss,” he said. “It feels to me like we have arbitrarily picked out massage therapy to ban it in residential areas.”

McChesney was referring to a list of eight conditions that the council considered as a part of the first reading of the ordinance July 26.

Council Member Jennifer Rauner suggested setting up a public hearing for residents to weigh in on the topic.

“I really think we need to get feedback from a larger sampling of citizens,” she said.

Council Member Matt Percy pointed out just because the council

is considering making changes to the ordinance now doesn’t mean changes can’t happen again in the future.

“This doesn’t mean this ordinance is set in stone for the next two to three decades. We are not drafting the Constitution here. We are trying something new, which I think is good and healthy,” he said. “If it turns out it is not working, we can always bring it back and reamend these ordinances.

We have to keep in mind that we have that flexibility if things don’t work out the way we thought they would.”

Ultimately, the council decided to table the discussion for a future meeting. The list of conditions in the amendment to city code will be further refined, and a public hearing will be held so residents can weigh in on whether massage businesses should be able to operate within residential zones and, if so, what conditions need to be in place.

Antonen said the hearing will likely take place this fall.

The council discussed some further additions to the ordinance amendment that would regulate how many clients can be seen in a day, parking, hours of operation and limiting the number of massage businesses that can operate within a residential zone.

STATE SUPREME COURT : Circle Pines wins watershed disagreement The District Court ruled in favor of the county Oct. 28, 2020, and upheld Preiner’s reappointment. The court agreed with the county that the statute (Minnesota Statutes section 103D.551) unambiguously allows the county the discretion to appoint a manager from any city that fails to submit a list of nominees. The Court of Appeals affirmed that decision June 21, 2021.

On July 20, 2022 the Minnesota Supreme Court issued its opinion, which reads in part, “Interpreting the statute to require counties to choose from city nominees unless they do not meet the fair representation requirement in subdivision 3(c) —and to always consider fair representation when making appointments—honors the purposes of the statute. This interpretation encourages cities to participate in the process of nominations because their nominees must be considered.

It also makes the counties pay attention to cities by requiring prioritization of their nominees.

The case will now be remanded to allow the District Court to reconsider its application of the law to the facts in light of the statutory interpretation of the Supreme Court.
