TERMS AND CONDITIONS OF AUCTION The following, as amended by any posted notices, specific bills of sale or similar instruments relating to a transaction or oral announcements during the sale, constitutes the entire terms and conditions on which property listed in the catalogue shall be offered for sale or sold by Murad Auctions, the auctioneer conducting the sale on behalf of any consignor for whom we act as agent. DDFAA (as subsequently defined) is not an auctioneer and is not conducting the auction or arranging any resulting transaction. In these Conditions of Sale, “We” and “Our” refer to Murad Auctions. 1. As used herein the term “bid price” means the price at which a lot is sold to the purchaser and the term “purchase price” means The aggregate of (a) the bid price, (b) A PREMIUM PAYABLE BY THE PURCHASER OF 20% of the hammer price (or 25% if bidding via LiveAuctioneers.com online) and (c) unless the purchaser is exempt by law from the payment thereof, any Texas or local sales tax (or compensating use tax of another state) and applicable taxes. Murad Auctions has been authorized by the consignor to retain, as part of our remuneration, the premium payable by the purchaser. 2. On the fall of the auctioneer’s hammer, the highest bidder shall be deemed to have purchased the offered lot, and title to the lot shall pass to the purchaser, in accordance with all of the conditions set forth herein and thereupon the purchaser (a) assumes full risk and responsibility therefore (b) if requested will sign a confirmation of purchase, and (c) will pay the purchase price in full in cash for all lots purchased. To prevent misdelivery and inconvenience in settlement of a purchase, no lot may be transferred. All property shall be removed from our premises at the purchaser’s expense immediately following the sale. If not so removed we may, as an accommodation to the purchaser, transfer the property to a public warehouse or other premises under our control or the control of DDFAA at the purchaser’s sole risk and expense. Each sale made pursuant to these Conditions of Sale will be deemed to constitute a grant of security interest by the purchaser to us in, and we may retain as collateral security for the purchaser’s obligations to us or our assignee, any of the purchaser’s property in our possession, and we may apply against such obligations all monies held or received by us for the account of, or owing to, the purchaser. Each purchaser consents to the filing of public notices or our lien. Whenever the purchaser pays only a part of the total purchase price for one or more lots purchased, we may apply such payments, in our sole discretion, to the lot or lots we choose. Payment will not be deemed made in full until we have collected all amounts due in cash or good funds represented by cleared checks or cashier checks. If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to us and the consignor by law, including but without limitation, the right to hold the purchaser liable for the purchase price, we at our option may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or b) resell the property with a three day notice to the original defaulting purchaser, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs and expenses of both sales, our commission at our standard rates, all other charges due hereunder, attorney’s fees and incidental damages; or (c) take any measures it deems necessary. If Murad Auctions must resell the property, the original defaulting purchaser will be held responsible for any deficiencies in the purchase price, including any and all associated expenses including reasonable attorney’s fees, warehousing, commissions or any other costs associated with the default. No actions by us or any third party before or after the auction shall be deemed a waiver of any of the foregoing. 3. We reserve the right to withdraw any property at any time before the actual sale. Unless otherwise announced by the auctioneer at the time of sale, all bids are per lot as numbered in the catalogue and no lot shall be divided for sale. 4. The auction will be conducted by Louis Murad TXS 13362. We reserve the right to reject any bid 2
from any bidder. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, or in the event the auctioneer doubts the validity of any bid, the auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, our sales records shall be conclusive in all respects. 5. If we are prevented by fire, theft or any reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid therefore by the purchaser and shall in no event include any incidental or consequential damages. 6. Some lots are offered subject to a “reserve,” which is an undisclosed minimum price below which the lot will not be sold. If a lot is offered subject to a reserve, the auctioneer may implement such reserve by bidding on behalf of the consignor, whether by opening bidding or continuing bidding in response to other bidders until reaching the reserve. 7. ALL STATEMENTS CONTAINED OR IN ANY BILL OF SALE, INVOICE OR ELSEWHERE, OR MADE BY THE AUCTIONEER, AS TO AUTHORSHIP, PERIOD, CULTURE, SOURCE, ORIGIN, MEASUREMENT, QUALITY, RARITY, PROVENANCE, IMPORTANCE, EXHIBITION AND LITERATURE OF HISTORICAL RELEVANCE OR PHYSICAL CONDITION ARE QUALIFIED STATEMENTS OR OPINION AND NOT REPRESENTATIONS OR WARRANTIES. WE AND CONSIGNORS MAKE NO REPRESENTATION AND WARRANTIES AS TO WHETHER THE PURCHASER ACQUIRES ANY COPYRIGHTS, INCLUDING BUT NOT LIMITED TO, ANY REPRODUCTION RIGHTS IN THE PROPERTY. No employee or other agent of Murad Auctions, the auctioneer, David Dike Fine Art, L.L.C., Dike Management, LLC, David Dike Fine Art Auction, David Dike Fine Art or of David Dike (collectively “DDFAA”) is authorized to make on behalf or that of the consignor any representation or warranty, oral or written, with respect to any property. All deliveries will be shipped COD unless otherwise agreed to by purchaser and Murad Auctions. If packing and handling of purchased lots is done by us, it is done at the entire risk of the purchaser. We are not liable for any acts or omissions of carriers or packers, including those we may recommend. Such carriers or packers may carry their own insurance and any claim for loss or damage should be addressed directly to them. No items will be shipped unless we specifically agree to do so. 9. Unless prior arrangements have been made with Murad Auctions, there may be a seven day waiting period if purchasing artwork with a personal or company check. To avoid delay of this sort, bidders are encouraged to prearrange check approval or establish a line of credit
with Murad Auctions by calling (214) 720-4044 no later than 5pm on Friday, October 2, 2020. There will be no exceptions. Bank card purchases will be honored at our option. 10. These Conditions of Sale and the purchaser’s and our respective rights and obligations hereunder are governed by Texas law. By bidding at an auction, whether in person or by agent, telephone or other means, the purchaser or bidder agrees to be bound by these Conditions of Sale and to consent to the exclusive jurisdiction of the state courts of, and the federal courts sitting in, the State of Texas. All of our obligations under these Conditions of Sale and the obligations of purchaser to pay, are performable in Dallas, Dallas County, Texas. 11. These Conditions of Sale shall bind the successors and assigns of all bidders and purchasers and inure to the benefit of our successors and assigns. No waiver, amendment or modification of the terms hereof (other than posted notices or oral announcements during the sale) shall bind us unless specifically stated in writing by us. If any part of these Conditions of Sale is for any reason invalid or unenforceable, the rest shall remain valid and enforceable. 12. As a service to those wishing to place bids, we may at our discretion accept bids without charge in advance of sale by telephone, or in writing on bidding forms available from us. “Buy” bids will not be acceptable; all bids must state the highest bid price the bidder is willing to pay. As noted above, a premium payable by the purchaser will be added to the bid price. In the event identical bids are submitted, the earliest will take precedence. Absentee bids shall be executed in competition with other absentee bids, any applicable reserve and bids from the audience. Successful absentee bids may not be acknowledged, but sale results and selling prices for any lot may be obtained by telephoning us during normal business hours. We assume no responsibility for failure to execute these bids for any reason whatsoever. 13. As a convenience to our clients, we furnish pre-sale estimates for all lots included in the catalogue. These are intended as an approximate guide to current market value, and should not be interpreted as a price or as an appraisal. The final bid may well be less or more than any estimate printed. 14. This painting is accompanied by a letter of authenticity from Harry Halff, author of the book: Julian Onderdonk: A Catalogue Raisonne. Julian Onderdonk is notably one of the most highly valued Texas impressionist painters of the early 20th century. His career began early, as Julian was the son of Robert Jenkins Onderdonk, a prominent portrait painter and teacher of the San Antonio area. Robert Jenkins helped organize and attended the Arts Students League of New York in 1875. Julian moved to New York in 1901 and showed early distinction for his skills as he studied under William Merritt Chase during which time he was awarded first prize in a student exhibition. Julian stayed in New York and became a prolific painter and had a partnership with a dealer in New York City who sold many of his works. Julian returned to San Antonio in 1909. It was during this time, and the years following his return that his affinity for the Texas landscape and his mastery of painting it shined. In the Land of the Spanish Oak in Southwest Texas, Onderdonk takes a simply filled landscape of Spanish Oaks and depicts the sunlight splayed on the sculptural undulation of the terrain, and renders the vibrant colors of the foliage into a dynamic landscape. The pale sky is covered in an array of cool and warm tones that meet the horizon line in a complex colorful play on evening shadow. This rare painting portrays Onderdonk’s masterful talent as an impressionist painter and his proficiency for color. 1910 marked an active period for Onderdonk in painting production, exhibitions, and travel. He exhibited works at the San Antonio Women’s Club. He left for a trip to New York to collect paintings and bring them home to be exhibited at the Dallas State Fair Exhibition in October of 1910. In November he exhibited works at the San Antonio International Fair. He also exhibited two works at the National Academy of Design Annual Exhibition in New York. During this time he was listed as teacher of drawing and painting at the Wasson School at 206 Lexington Avenue in San Antonio, Texas.

NOTE: Texas painter, Tom Lea made his way to China as an accredited artists’ correspondent for Life Magazine during WWII by way of his friendship with Texas Art collector C.R. Smith who headed the Air Transport Command. Smith had written to Lea explaining Lea could fly anywhere the ATC flew. As a result, Lea flew around the world documenting the backroads of war, and ended up in China. Henry Luce who was the founding publisher of Life magazine asked Lea to paint the Chinese countryside while there.
The following is an excerpt from the book: A Picture Gallery by Tom Lea, on page 78: “In 1943 Tom Lea made a long and exhaustive trip to China as an artist correspondent for Life magazine. After a few disagreeable days in Chungking he grew irritable and homesick. However, a trip to the countryside along the Yang-Tze River revealed, a dreamlike majesty to the misty flow of the great river through the quiet land so anciently known and lived upon and used and shaped and loved by generation after generation after generation.”

Everett Spruce moved to Dallas in 1926 with the encouragement of Olin Travis to study at Travis’s Dallas Art Institute. While at the Institute, Spruce studied under Travis and Thomas Stell. In 1931, Spruce began work as a gallery assistant at the Dallas Museum of Fine Arts moving on to become the assistant to the director and registrar from 1935-1939. In 1940, Spruce moved to Austin to teach at the University of Texas where he remained until 1974. He taught at UT first as instructor of life drawing and creative design, then professor of art and served as chair of the art department from 1949-1950. He was awarded the grant from the Ford Foundation for creative and experiential study. These active years for Spruce marked a time when his works were widely collected by museums including the Metropolitan Museum of Art, the Museum of Modern Art, and the Whitney Museum of American Art to name a few.

Dorothy Hood was born in 1918 in Bryan, Texas. She is known today as one of the foremost female Texas painters, producing some of her most significant and large-scale works while in Houston. She had spent periods of time between Mexico and Latin America which influenced her layered and evocative approach to painting. Her social circles included Latin American and European artists, painters, and writers. She was married to Jose Maria Velaso Maidana, the Bolivian composer. In recent history, the Art Museum of South Texas presented a major retrospective of her work: The Color of Being/El Color del Ser in 2017. This exhibition showcased some of her largest most important paintings taking over 11 galleries of the museum. Her works can be found in the following collections: Museum of Fine Arts Houston; McNay Art Museum; National Museum of Women in the Arts, Washington, D.C.; and the Laguna Gloria Art Museum. Jennie Haddad remained a Dallas based artist after studying with Abstract Expressionist master Hans Hoffman in Provincetown and New York City. She had an acclaimed career winning several awards and was shown in several exhibitions, including one curated by Clement Greenberg. Haddad was born in Lebanon in 1906, she and her family moved to Provo, Utah in 1912. After her father’s death when she was nine, she and the rest of her family moved to Canadian and then Amarillo, Texas. She later moved to Tyler, Texas and married Joseph Haddad. Jennie’s interest and talent for art began while only in third grade. Other students were instructed to illustrate church windows, and Jennie depicted a Madonna, for which she won first prize. While working in the candy shop she would sketch on candy wrapper, and she began sketching what she saw. After marrying Joseph, in 1943 Haddad started driving to Dallas every week to study with Otis Dozier at the Dallas Museum of Fine Arts. Her early paintings resemble the work of John Marin, she never studied with him, rather, she admired his work. She always carried a sketchbook with her and drew what she saw in nature. Haddad’s husband passed away when she was 47, after that she moved to Dallas and began studying art at SMU. In 1956 she went to Provincetown to study with Hans Hoffman. In the October 19, 1983 Dallas Times Herald article titled: Abstract Realism, Jennie Haddad’s paintings reflect her unique view of the real world, staff writer Bill Marvel quotes Haddad reflecting on her time with Hoffman: “I clicked with Hans Hoffman and that turned out to be one of the best things that could have happened to me.” In 1958 Hoffman retired and reduced his class size to 12, Haddad was one of those chosen 12. Haddad’s work is linked to Louise Nevelson, Helen Frankenthaler, Robert Motherwell, Mark Rothko and Franz Kline. She spent her summers in Woodstock and winters in New York where she studied at the Arts Students League. Jennie Haddad returned to Dallas and brought her paintings back from New York. One of her takeaways from Hoffman was that he told his students to: “Work from nature and that is good.” In 1979 the University of Dallas held a retrospective of her work, curated by the highly regarded art critic Clement Greenberg. Over the years her work was well represented by Ruth Wiseman Gallery in Deep Ellum of Dallas, Adams-Middleton Gallery in Dallas as well as represented by international art dealer, Ron Hall. Her works are abstract, and she comments on an endearing aspect of her oeuvre, that had three periods. In the 1983 Dallas Times Herald article, Marvel sites Haddad on her periods: “At first there was a real lot of action. Then I began to see a lot of color in space, using colors to create negative as well as positive space. In the third period I’m trying to continue so that I can do as I please. I don’t like to repeat myself. I would go mad if I copied myself over and over.” 54

New York City native, Seymour Fogel studied at the National Academy of Design in New York and the Art Students League under Leon Kroll and George Brandt Bridgeman where he mastered realism and executing the human form. Diego Rivera took him on as an assistant to complete a mural at Rockefeller Center. In the 1930’s Fogel traversed the country by train rendering imagery from the Great Depression. These works have landed in collections such as the National Gallery in Washington, D.C. and the Ogden Collection in New Orleans, LA. The Works Progress Administration gave him several commissioned projects in New York, Washington D.C., Minnesota and Arizona. As a result, his figurative works from the 1930’s focused on social realism. In 1946, Fogel started his professorship in the art department at the University of Texas at Austin where he joined the ranks of forward-thinking modernist painters. Bror Utter was a founding member of the Fort Worth Circle, and was a contemporary of Dickson Reeder. He was active in the Fort Worth community teaching at the Fort Worth Art Association among other groups. He received his formal training at the Fort Worth School of Fine Arts and at the Colorado Springs Fine Arts Center. Throughout his painting career he took several trips to Europe where he studied the culture of Rome, Naples, Florence, and Venice; undoubtedly the subject of this painting was inspired by the Italian cultural influence. He actively exhibited throughout his painting career. Today his works can be found in the following permanent collections: Amon Carter Museum of American Art, Fort Worth; Colorado Springs Fine Arts Center; Dallas Museum of Art; Denver Art Museum and at the Modern Art Museum, Fort Worth.
