TERMS AND CONDITIONS OF AUCTION The following, as amended by any posted notices, specific bills of sale or similar instruments relating to a transaction or oral announcements during the sale, constitutes the entire terms and conditions on which property listed in the catalogue shall be offered for sale or sold by Murad Auctions, the auctioneer conducting the sale on behalf of any consignor for whom we act as agent. DDFAA (as subsequently defined) is not an auctioneer and is not conducting the auction or arranging any resulting transaction. In these Conditions of Sale, “We” and “Our” refer to Murad Auctions. 1. As used herein the term “bid price” means the price at which a lot is sold to the purchaser and the term “purchase price” means The aggregate of (a) the bid price, (b) A PREMIUM PAYABLE BY THE PURCHASER OF 20% of the hammer price (or 25% if bidding via LiveAuctioneers.com online) and (c) unless the purchaser is exempt by law from the payment thereof, any Texas or local sales tax (or compensating use tax of another state) and applicable taxes. Murad Auctions has been authorized by the consignor to retain, as part of our remuneration, the premium payable by the purchaser. 2. On the fall of the auctioneer’s hammer, the highest bidder shall be deemed to have purchased the offered lot, and title to the lot shall pass to the purchaser, in accordance with all of the conditions set forth herein and thereupon the purchaser (a) assumes full risk and responsibility therefore (b) if requested will sign a confirmation of purchase, and (c) will pay the purchase price in full in cash for all lots purchased. To prevent misdelivery and inconvenience in settlement of a purchase, no lot may be transferred. All property shall be removed from our premises at the purchaser’s expense immediately following the sale. If not so removed we may, as an accommodation to the purchaser, transfer the property to a public warehouse or other premises under our control or the control of DDFAA at the purchaser’s sole risk and expense. Each sale made pursuant to these Conditions of Sale will be deemed to constitute a grant of security interest by the purchaser to us in, and we may retain as collateral security for the purchaser’s obligations to us or our assignee, any of the purchaser’s property in our possession, and we may apply against such obligations all monies held or received by us for the account of, or owing to, the purchaser. Each purchaser consents to the filing of public notices or our lien. Whenever the purchaser pays only a part of the total purchase price for one or more lots purchased, we may apply such payments, in our sole discretion, to the lot or lots we choose. Payment will not be deemed made in full until we have collected all amounts due in cash or good funds represented by cleared checks or cashier checks. If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to us and the consignor by law, including but without limitation, the right to hold the purchaser liable for the purchase price, we at our option may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or b) resell the property with a three day notice to the original defaulting purchaser, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs and expenses of both sales, our commission at our standard rates, all other charges due hereunder, attorney’s fees and incidental damages; or (c) take any measures it deems necessary. If Murad Auctions must resell the property, the original defaulting purchaser will be held responsible for any deficiencies in the purchase price, including any and all associated expenses including reasonable attorney’s fees, warehousing, commissions or any other costs associated with the default. No actions by us or any third party before or after the auction shall be deemed a waiver of any of the foregoing. 3. We reserve the right to withdraw any property at any time before the actual sale. Unless otherwise announced by the auctioneer at the time of sale, all bids are per lot as numbered in the catalogue and no lot shall be divided for sale. 4. The auction will be conducted by Louis Murad TXS 13362. We reserve the right to reject any bid 2

from any bidder. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, or in the event the auctioneer doubts the validity of any bid, the auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, our sales records shall be conclusive in all respects. 5. If we are prevented by fire, theft or any reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid therefore by the purchaser and shall in no event include any incidental or consequential damages. 6. Some lots are offered subject to a “reserve,” which is an undisclosed minimum price below which the lot will not be sold. If a lot is offered subject to a reserve, the auctioneer may implement such reserve by bidding on behalf of the consignor, whether by opening bidding or continuing bidding in response to other bidders until reaching the reserve. 7. ALL STATEMENTS CONTAINED OR IN ANY BILL OF SALE, INVOICE OR ELSEWHERE, OR MADE BY THE AUCTIONEER, AS TO AUTHORSHIP, PERIOD, CULTURE, SOURCE, ORIGIN, MEASUREMENT, QUALITY, RARITY, PROVENANCE, IMPORTANCE, EXHIBITION AND LITERATURE OF HISTORICAL RELEVANCE OR PHYSICAL CONDITION ARE QUALIFIED STATEMENTS OR OPINION AND NOT REPRESENTATIONS OR WARRANTIES. All deliveries will be shipped COD unless otherwise agreed to by purchaser and Murad Auctions. If packing and handling of purchased lots is done by us, it is done at the entire risk of the purchaser. We are not liable for any acts or omissions of carriers or packers, including those we may recommend. Such carriers or packers may carry their own insurance and any claim for loss or damage should be addressed directly to them. No items will be shipped unless we specifically agree to do so. 9. Unless prior arrangements have been made with Murad Auctions, there may be a seven day waiting period if purchasing artwork with a personal or company check. To avoid delay of this sort, bidders are encouraged to prearrange check approval or establish a line of credit with Murad Auctions by calling (214) 720-4044 no later

than noon on Saturday, October 27, 2018. There will be no exceptions. Bank card purchases will be honored at our option. 10. These Conditions of Sale and the purchaser’s and our respective rights and obligations hereunder are governed by Texas law. By bidding at an auction, whether in person or by agent, telephone or other means, the purchaser or bidder agrees to be bound by these Conditions of Sale and to consent to the exclusive jurisdiction of the state courts of, and the federal courts sitting in, the State of Texas. All of our obligations under these Conditions of Sale and the obligations of purchaser to pay, are performable in Dallas, Dallas County, Texas. 11. These Conditions of Sale shall bind the successors and assigns of all bidders and purchasers and inure to the benefit of our successors and assigns. No waiver, amendment or modification of the terms hereof (other than posted notices or oral announcements during the sale) shall bind us unless specifically stated in writing by us. If any part of these Conditions of Sale is for any reason invalid or unenforceable, the rest shall remain valid and enforceable. 12. As a service to those wishing to place bids, we may at our discretion accept bids without charge in advance of sale by telephone, or in writing on bidding forms available from us. “Buy” bids will not be acceptable; all bids must state the highest bid price the bidder is willing to pay. As noted above, a premium payable by the purchaser will be added to the bid price. In the event identical bids are submitted, the earliest will take precedence. Absentee bids shall be executed in competition with other absentee bids, any applicable reserve and bids from the audience. Successful absentee bids may not be acknowledged, but sale results and selling prices for any lot may be obtained by telephoning us during normal business hours. We assume no responsibility for failure to execute these bids for any reason whatsoever. 13. As a convenience to our clients, we furnish pre-sale estimates for all lots included in the catalogue. These are intended as an approximate guide to current market value, and should not be interpreted as a price or as an appraisal. The final bid may well be less or more than any estimate printed. 14. Robert T. Brousseau was a passionate collector of Early Texas Art. He began collecting in the 1990’s, on the brink of what has now become an enthusiasm for many regional collectors. Perhaps what spurred Brousseau’s interest in collecting was his first visit to David Dike Fine Art in 1994. Brousseau visited the gallery and acquired two great American impressionist paintings, a Guy Wiggins and a Johann Berthelsen. On that visit, Brousseau also eyed the painting Edward Eisenlohr, “Peaceful Hour” (lot 91), which was subsequently acquired. Brousseau’s purchase after that was of the Robert Wood, “Texas Mesa’ c. 1930 (lot 101.) This began Brousseau’s farsighted collection of Texas art. Brousseau was always a passionate collector and loved to research and find works that had been exhibited or were of significant background. This could be attributed to his education and upbringing. Born in West Point, New York, he grew up in a decorated mil-

itary family; his father Colonel Andre Ringodd Brousseau was a U.S. Air Force pilot. As children, he and his siblings vacationed in San Antonio, visiting his grandparents who lived in Terrell Hills. These visits nourished his love for the Texas landscape, and inspired his interest in collecting Texas art. Brousseau graduated from General H.H. Arnold High School in Germany. He went on to attend Georgetown University where he graduated cum laude and Phi Beta Kappa from the university’s School of Foreign Service. He then attended law school at Duke University where he received his JD with distinction and was a member of the Duke Law Journal. He earned an LL.M from Columbia University. He also studied international law in Paris and at The Hague and was a published legal author. He practiced law with Baker Botts in Houston, and went on to a distinguished career in academia: Associate Professor at Mercer University; visiting Associate Professor at University of Texas at Austin; Tulsa School of Law; and Professor of Law at Dedman School of Law, SMU, Dallas. After his professorship he joined the firm Stutzman, Bromberg, Esserman & Plifka in Dallas where he was partner for 27 years. Brousseau’s sister recalled his brilliant mind and love of language. He had a vast vocabulary, spoke five languages and wrote elegant prose. These passions, combined with his aca-

demic and legal backgrounds, informed his connoisseurship. He researched each painting he pursued or found for his collection. Investment was not a driver for his collecting goals; rather he sought quality and the best possible example of an artist’s work. Brousseau was a voracious reader, and his library was deep in history, literature and books on Texas art and artists. One of his well-researched acquisitions was the Adrian Brewer work, “Bluebonnet Field in Texas,” 1927, (lot 136), which was in the Edgar B Davis Wildflower Competition of 1927. Other examples include his paintings by Julian Onderdonk and Tom Stell. Brousseau was consistently a generous lender of his works to exhibitions in order to advance public interest and education of Early Texas Art. Perhaps what started this was the 1998 exhibition at the Longview Museum of Fine Arts show: The Brousseau Collection. Carolyn Fox-Hearne was the director of the museum at the time and approached David Dike about putting together an exhibition of Early Texas Art. Fox-Hearne’s first stop in seeking works for the show was Brousseau’s home on Beverly Drive in Dallas. She was greatly impressed by the collection and decided from that tour, she need not look further; thus The Brousseau Collection exhibition was curated. After that show, Brousseau went on to lend his works to other exhibitions including the Texas Impressionism show curated by Michael Grauer at the Panhandle Plains Historical Museum (traveling) 2012-2014; the Texas Artists show in 2000-2001 at the Michelson Museum of Art; the Father & Son: Barney & Martin Delabano show in 2001; and Celebrating Early Texas Art: Treasures from Dallas-Fort Worth Private Collection, 1990-1960 in 2005 at the Fort Worth Community Art Center; and Lucien Abrams: An Impressionist from Texas show curated by Michael Grauer and Old Jail Museum (traveling show) 2013-2014. He also allowed many of his works to be illustrated in the Dictionary of Texas Artists, 1800-1945, by Paula L. Grauer and Michael R. Grauer © 1999, Texas A&M Press. Brousseau passed away on March 30, 2018. He left behind his beloved son, daughter and grandson whom he loved greatly. He also left a legacy of collecting Early Texas Art. He was a great friend to many. Looking back, David Dike is not sure whether Brousseau truly understood the importance of his collection and its impact on the advancement of collecting Early Texas Art. It is the hope that legacy can live on in many collections through the paintings available in the following lots.

This painting will be included in the forthcoming catalogue Raisonne, which has been underway since the early 1990s and includes over 500 works by Gentilz. This watercolor is the same composition of an oil painting that has not been located. Gentil and his family lived in France before moving to America and eventually he helped establish the Castroville Colony in Texas in the 1840s where he served as a mapmaker. He taught at St. Mary’s Institute in San Antonio. He painted botanical illustrations and colorful regional genre scenes of the area, scenes he is best known for. The author of this catalogue and contributor of this information is Martha Utterback.

Florence McClung painted Triple Underpass in 1945, by which time she had secured a national reputation as both a painter and a printmaker. The acquisition of one of her paintings by the Metropolitan Museum of Art in early 1940, elevated her stature among the Texas Regionalists, who had been forging an original style dedicated to their local environment for nearly a decade. Triple Underpass is now back in Dallas for the first time in nearly 30 years. Triple Underpass portrays an elevated view of Dallas’s western façade with the eponymous landmark as the focal point. Historically important as a major engineering achievement of its time and for its location at the western edge of Dealey Plaza (the site of the city’s birthplace in the 1840s), the Triple Underpass was constructed between 1934 and 1936 as both a railroad bridge and a point of convergence for Elm, Main and Commerce streets to improve vehicular traffic into the city’s business district. It is internationally recognized today for its emotional link to President Kennedy’s assassination in 1963. This is the only known painting of the Triple Underpass prior to his assassination. McClung’s image speaks to the clarity and particularity of Dallas’s cityscape. The view is compressed, but carefully orchestrated to record the massing and fenestration of buildings, such as the Texas School Book Depository, the Dallas County Records Building, and the Old Courthouse. Her close attention to the distinctive character of each edifice reflects civic pride for the city’s modernity and historic past. As evident by the numerous American flags waving from the rooftops, McClung has also imbued the scene with an overarching sense of patriotism for the nation’s military prowess in the waning months of World War II. In the Triple Underpass’s streamlined features, McClung found not only the perfect subject to assert her stylistic affinity for Art Deco industrial design, but also an image to counter the perception of her as an artist solely dedicated to the vernacular landscape. Interestingly, for a painting ostensibly about a vehicular thoroughfare, she chose not to include automobiles. Instead, a lone pedestrian appears on the sidewalk at right, as if to underscore the point that regardless of the subject’s natural or fabricated elements, McClung intended her art to speak to the relationship of man to the environment.

McClung included Triple Underpass within a body of mostly new work in oil and pastel that she selected for her second solo exhibition at the Dallas Museum of Fine Arts, held in March 1945. Patricia Peck, reviewing the show for the Dallas Morning News, acknowledged her preference for the earthy grandeur of the artist’s generalized landscapes, failing to recognize in the actuality of McClung’s cityscapes, an evocation of man-made beauty. – Rebecca Lawton

Lobby Frescos, 1937 (Design Rejected), Howard Cook gouache on paper 7 x 20 1/2 signed: Howard Cook $2,000 - $4,000 In 1936, Howard Cook won a nationwide competition held by the Public Works of Art Project for the mural commission for the new San Antonio Post Office being built across from the Alamo. Cook was paid $12,000 ($217,000 in today’s dollars) for the commission which he began in 1937 and took two years to complete. The 16panel mural is entitled San Antonio’s Importance in Texas History and it depicts scenes ranging from the Spanish conquistadors to the arrival of the Southern Pacific Railroad. Technically, the panels are frescoes and, at the time of completion, were the largest in North America. This study, done in 1937, is a proposed rendering of the east wall. Cook used South Texas cowboys and locals as models for his subjects. Of the three cowboys in the left foreground, one was the author J. Frank Dobie, and another was the last living cowboy from the first Chisholm Trail cattle drive in 1867. The goats in the right foreground were moved to another panel and the two prominent goats became the subject of Cook’s award-winning 1937 lithograph Nanny and Kid.

New York City native, Seymour Fogel studied at the National Academy of Design in New York and the Art Students League under Leon Kroll and George Brandt Bridgeman where he mastered realism and executing the human form. Diego Rivera took him on as an assistant to complete a mural at Rockefeller Center. In the 1930’s Fogel traversed the country by train rendering imagery from the Great Depression, these works have landed in collections such as the National Gallery in Washington, D.C. and the Ogden Collection in New Orleans, LA. The Works Progress Administration commissioned him several projects in New York, Washington D.C., Minnesota and Arizona, as a result his figurative works from the 1930’s focused on social realism.

In 1946 started his professorship in the art department at the University of Texas at Austin where he joined the ranks of forward thinking modernist painters. This first decade of modernist outpouring included 6 series: pastiche, mother and child, seraphic, limestone, flagellant and multi-style.

This painting fits in the “pastiche” style, conveying styles of his greatest influences of this time both cubist Pablo Picasso and color palate of Piet Mondrian; Fogel draws on both to create his own style. Picasso’s stylistic influence on Fogel work in this painting are uncanny. This marks his first foray into modernism, which Fogel mastered in this period and beyond.

212. LOUIS OSCAR GRIFFITH (Am. 1875-1956)

Lots 210 - 212 were murals painted on the walls of the home of Benjamin and Harriett Grandstaff in Stevens Park Estates of Oak Cliff in Dallas. Harriett was a Dallas artist and former Frank Reaugh student. Reaugh recalls the Grandstaff’s home in a letter to L.O. Griffith. Harriett went on to have a successful career as a fashion illustrator in Dallas for Sanger Brothers and Neiman-Marcus. What made their home unique was her home studio. Rebecca Lawton wrote a piece on these murals. In her essay Lawton discovered that Dallas Morning News writer Maurine Osburn wrote a piece on their home and studio on June 8, 1930. It “described the studio as ‘cozy and comfortable,’ but also noted that it was ‘unusual’ in one repect: its walls displayed paintings by the Grandstaff ’s artist-friends ‘that could never be stolen.’” – Source Essay by Rebecca Lawton

Hiram Williams was professor Emeritus at University of Florida and had an extremely prolific and widely exhibited career in abstract expressionism. His works hung at the Guggenheim and was purchased by the Museum of Modern Art, where he was recognized by Dorothy Miller. Most recently his paintings, including this work hung at the University of Florida’s Harn Museum of Art. In Katie Robinson Edwards book: Midcentury Modern Art in Texas © 1994, the University of Texas Press, Edwards writres: “Williams contended with the influences of Picasso, Arshile Gorky, and the British painters Graham Sutherland and Francis Bacon. Williams felt that his paintings conveyed a ‘general note of Abstract Expressionism’ and ‘were becoming almost academic’ – according to the biography by Robert Larson.” This painting was part of a series created in 1958-59 as a result of a University of Texas grant, where he joined faculty in 1954. Edwards explains in her book that Donald Weisman wrote an essay on this series. Edwards writes: “The twenty-eight completed canvases range from 4x6 feet to 8x12 feet. Thus, they matched the grand scale of some Abstract Expressionist works, but nearly all of Williams’s were figurative. A dark-suited man, his body distorted by motion, recurs throughout what Williams calls his “Guilty Men” series. The motif offered an indictment of postwar white-collar culture and its concomitant alienation. In lieu of Cubist fragmentation, Williams’s unsettling figures are uncannily integrated. The painter traced his “problem” back to 1947, when he desired to make “whole figurative images without fracturing that image (as in cubism).” Williams noted further: “Fracturing has become a device. Break the picture into little squares and you have painted ‘Modern.’ Undisciplined students, ignorant of what painting is about, learn to break up their pictures, and immediately expect to bask in fame as painters.” William’s work was influenced by his experiences during WWII. Constance Ctumin wrote in her article in 2000, “Summer’s End Signals Beginning of New Art Season,” that: “These paintings are not at all horrific. Painted in warm creamy tones they are sometimes even comical, resembling a chorus line of dancers at rest or in need of a serious workout. Sometimes a torso is rendered in such severe economy, it resembles Chinese calligraphy.”

Folio; Edition of 500, 1986. Size overall 29 1/2 x 23 1/2 inches, Fort Worth, TX natives and twin brother duo of painters created this folio in 1986 depicting landscapes and birds of Texas. The folio contains 137 sheets, 50 of which are 50 images of the birds and landscapes. Commentary by the twins precedes each of the plates. The foreword in the folio is by Harry Tennison, followed by a written introduction by Stuart Gentling and an essay titled A Collection of a Texas Bird Glimpser, by Texas author John Graves. This copy is in excellent condition.
