PASTORAL LETTER & CHURCH MEETINGS Over the last few months, I have had to visit various people and places in order to get certain things checked up. A visit to the opticians meant new glasses, a visit to the doctor resulted in having to undergo surgery (well-deserved praise for all staff in ward 5 at Dr Gray’s). Add to this, my car needed servicing and some repairs carried out, as did my daughter’s laptop. I even had to speak to someone regarding pensions, although hopefully I won’t be requiring that for a good few years yet. It is interesting how we take care, look after, and get sorted out all of these things and many more besides, doing exactly what the doctor, optician, mechanic or IT specialist suggested. It is not going to be much use getting the advice from those who know best and then just carrying on regardless. But what of our spiritual well-being?

What time do we take to consider our spiritual condition and what action do we take to remedy any defects? Indeed, where do we go for a spiritual check-up? A church, a minister? They will hopefully help, but ultimately, we turn to the word of God, to the Bible, for it is there we find both our condition and the cure. In Romans 3:23 we read of our condition: “for all have sinned and fall short of the glory of God”. That is, there is no-one who has not at one point or another sinned and therefore fallen short of God’s standard for us that is the condition we all face. It appears to be a pretty depressing condition, and it is, BUT the good news of the gospel is that there is a cure indeed - the good news of the gospel is the cure. Further on in Romans, we read in chapter ten verses nine to ten: “if you confess with your mouth, Jesus is Lord

and believe in your heart God raised him from the dead, you will be saved”. It would have been foolish of me to ignore the advice given to me by the doctor. There was a problem that had to be dealt with, there was something giving me a problem that needed to be taken out. Likewise, spiritually, the Bible teaches us that sin is the condition and that Christ is the cure. We can go on ignoring the advice and face the inevitable consequences or even now, as you read this, you can take the advice of God’s word and confess your sin and believe in Jesus Christ, who not only died but rose again so that all who believe will be saved.

ExTRACTS FROM THE MINuTES OF THE MEETING OF 14TH AuGuST 2012 OF ELGIN COMMuNITy COuNCIL Dave Gowans spoke on:

Flood Alleviation Broadly speaking, progress is good. Some areas have problems and some are going better than expected. At the east end of the scheme, where the Tyock Burn ties into the Lossie, good weather and favourable geology has aided good progress. Upstream, there have been conflicts with Scottish Water utilities. Planned diversions are in hand. Work is on-going on Pansport Bridge. Voids in the wall at the Mansion House caused delays but this will not impact the completion date. Works at Glen Moray will start in October, 2 years ahead of schedule and the distillery’s co-operation is appreciated. Deanshaugh Playing fields – The £6m savings reported in local media is not accurate. Savings of around £4m were identified during the project planning and reduced the cost of the project overall.

Project Timescale The Chair asked if the works were still approx. 5 weeks behind schedule overall. A planned time and cost re-programming is to be carried out which will better answer this question.

Deanshaugh Football Pitches Murray Ross asked about the possibility of laying pipes now in order to make it easy to install cabling for floodlights. Dave Gowans answered that the flood alleviation funding is not available for amenities but, if they were to be installed, it would make sense to know the design early. Cllr Divers had raised this matter at the Children’s and Young People’s committee and it is under consideration.

Red Bridge George P Littlejohn asked what will happen when the bridge is removed. Dave Gowans advised that the abutments of this listed structure will be retained and a high quality, 3m wide prefab bridge will be installed and painted sympathetically.

Drains Gordon Methven said a number of residents had raised the issue of drains not being able to cope, leading to flooding in spite of alleviation works. Dave Gowans ad-

vised there are problems in parts of Moray. The Moray Council has to assess surface water risk in conjunction with Scottish Water and create a management plan for the Findhorn, Nairn and Strathspey District. Meantime, urgent matters are taken up with Scottish Water as the combined sewers are their responsibility. Cllr Leadbitter further advised that it appears Scottish Water drains are inadequate in some areas but it is difficult to prove to them that these drains surcharge first. Cllr Divers advised that this matter has been raised to them many times. Agreement appeared to have been reached last year, but since then Scottish Water’s priorities have changed to large cities.

Western Link Road Dave Gowans advised Designing Streets, Scottish Government policy is about creating a sense of place, however, traffic also has to move in communities. Proposals for each element of the design as was, were taken from the recent workshop and sent to the consultants, Jacobs. Detailed feedback on these proposals is awaited. Dave Gowans thanked the many stakeholders who came to a very productive workshop. Proposals being looked at by Jacobs include: - Changing the proposed roundabout at the north end of the scheme to phased traffic lights - The cut-off portion at the top of the existing Wittet Drive to be extensively traffic calmed - Narrowing Wittet Drive to introduce areas of parking and landscaping, all of which help control traffic speed - Junction with Mayne Road to be signalised for safer crossing - Bridge over railway should be kept as narrow as possible - Road south of bridge to be kept as narrow as possible and alignment moved further east with the possibility of a layby for those visiting The Wards - The Roundabout at the junction with Edgar Road to be replaced with a curved junction, to be prepared in advance for signals, should these become necessary due to future development - Edgar Road to be moved further north to facilitate parking on the south side of the street and to narrow off junction mouths on southbound roads, to better facilitate

pedestrian crossing. Meanwhile the Acting Chief Executive and Director wish to express to the public the message that there is a need for this road. A public exhibition has been proposed for 7-8th September in Elgin Library to show not only design elements of the route but its context in the Economic strategy. James Wiseman wished to add that the feelings of ENAF, ESAF and Elgin Designing Streets Action Group were that the workshop wrapped up abruptly and felt like a foregone conclusion. The Chair echoed these sentiments but would be satisfied if all the information was taken forward. Dave Gowans advised that it is often the case in these workshops, that the creative work of the day has to come together rapidly at the end. George P Littlejohn said that R&T will continue to look at the issue in the round.

STAGECOACH UPDATE Service renumbering: as of next week, the leading ‘3’ of service numbers will be dropped. This is being widely promoted and Graeme Leslie welcomed suggestions for further locations to send new timetables to disseminate the information. Elgin – Kinloss – Forres service: will return to an hourly service from 2-hourly, as a result of Moray Council funding. Service Changes: as previously mentioned, from next week, buses will not route down Glover Street or Lossie Wynd, but will go along Alexandra Road. Buses will depart Kingston earlier in response to residents’ requests. There will be other minor changes to improve reliability on certain routes. Forres – Nairn – Inverness: timetable to change later in the year to prevent buses bunching up nearer Inverness. Services 11 from October will give a direct service to Springfield Retail Park Bus-stop improvements: continuing 305 Evening Service to South Lesmurdie: this is still under consideration. George P Littlejohn enquired whether westbound buses that have signage saying something along the lines of “Nairn, connections to Inverness” terminate in Nairn. These buses do go to Inverness and the operational reasons for this signage were explained. The reprint of this timetable will help make this clearer.

I had the great pleasure of hosting a Moray Sports Summit, bringing together young athletes, parents, coaches, club officials, politicians and others, to look at Moray’s current and future sports facility needs. The meeting was incredibly positive, but I would like to give a special mention to the young athletes who stood up in front of a large audience and stated their experiences and their views on the issue in a very well-considered, confident and, above all, persuasive way. The audience reaction said everything about their abilities as confident young men and women, whose talents off the sports field are as good as those on!

I have received over a thousand of these postcards, clearly demonstrating the support and the affection that people have for their local Post Office. There are many, many postmasters, in Moray alone, who go well beyond their duties in support of the communities they are at the heart of. That fact is widely recognised and I fully back their campaign.

Cook 6-8 mins. Stir in curry paste. Add stock and bring to boil for 10 eam. Bring back to boil. Cool and purée purée in mins. Add cr cream. blender until smooth. Chill until needed – for up to 3 days. For the rice: 200g Thai jasmine rice 400g water 2 whole cloves Boil gently until water has been absorbed. Cover with lid or cling film. Set aside and cool. Dreaming of... ...South Island, New Zealand

Although it takes 24 hours to get there by plane, the South Island of New Zealand is a beautiful and rewarding place to visit and to do it any justice stays should not be shorter Cable Car Queenstown than about 2 weeks (and another 2 weeks for the North Island is required). We started by flying through Los Angeles and Auckland and we arrived into Christchurch for our first night. After the devastation of the earthquakes in February then June 2011, they are getting back on their feet and are eager for people to return to help with the economic plight of Christchurch. Although the devastation is still fully visible and the Central Business District (or CBD as it’s known locally) is out of bounds, there is still plenty to do here. You can take a punt on the River Avon which flows through Hagley Park and around their botanical gardens or visit the museum which has a large and varied display of local culture and a very emotional display of messages, all in the shape of hearts from around the World after the earthquake. We then drove from Christchurch to Lake Tekapo and were stunned by the beauty of the azure blue waters glinting in the sunshine. We stopped at the Church of the Good Shepherd which is a must for photo opportunities. Lake Tekapo has been given World Heritage Status for its night sky. Mt John Observatory provides night sky tours if you enjoy star watching! We then drove down to Dunedin and along the Otago Peninsula where you can look for the Yellow-Eyed Penguins, Fur Seals or the Albatross colony. Larnach Castle is also well worth a visit. From there we moved on to Te Anua and took a cruise along the Lake to see the Glowworm Caves. This is a fascinating underground adventure through a 15,000 year old cave system to the Glowworm Grotto to see hundreds of tiny Glowworms do a fantastic light show! Suitable for all ages. Next stop, Milford Sound where we took a cruise. The Milford Road is a stunning alpine drive. Visitors need to allow plenty of time to make the drive, if travelling independently, as this is a steep and windy highway. At 119km (approx 75 miles) from Te Anau to Milford Sound, the sealed road takes a minimum of 2 hours driving without allowing for stops. Visitors to Milford Sound will not be disappointed. Its truly spectacular scenery has remained unchanged throughout the ages. Water is what makes Fiordland such a lush place with countless lakes, rivers, streams and waterfalls. You should be prepared to enjoy some rainfall during your stay. Queenstown is the “adventure capital�. For serious adrenalin junkies you can bungy jump, canyon swing (recommended!), take a jetboat tour (exhilarating, fun and wet!) or mountain biking. For the not so adventurous, you can take the Skyline Gondola, have a meal in the restaurant with fantastic views over Queenstown, ride the Luge, which is great fun, or take a cruise aboard the iconic TSS Earnslaw on Lake Wakatipu to see a working farm at Walter Peak. Other activities available include walking on Glaciers, travelling in 2nd World War DUKWs (amphibious trucks with seats) and any number of death-defying trips in white water, in and out of boats. Queenstown has it all. With a fantastic choice of hotels, restaurants and activities – there is something here for everyone. A busy and tiring time but would do it all again in a flash!

An Overriding Interest An owner of a property may feel that they have the right to absolute control over their land and what is carried out on it. However, there are some circumstances where they are subject to the rights of others, for example, the use of an established right of way, which can include pedestrian, vehicular and other modes of transport. Such rights may be created by Deed and recorded in the Title Deeds but they can also be created in a number of ways, prior to or during ownership, which are not mentioned in the Deeds and are then known as an ‘overriding interest’. A right can be established by ‘prescription’ ie, it has been exercised by others as a result of continued and uninterrupted use over time. The required time used to be in excess of 40 years but this has now been reduced to 20 years by Statute. A right may be deemed to be a public right of way as it passes from one public place to another public place and it has again been exercised for, in excess of, 20 years. Further, the public also now have wide rights of access and to carry out activities on, across and over land and water under the Land Reform (Scotland) Act 2003 in conjunction with the Scottish Outdoor Access Code. None of these rights will show up in the Title Deeds, nonetheless, a landowner is unable to take steps to prevent the exercise of the right or even to try and deter members of the public from exercising their rights, however these may have been created. The moral of the tale is, when purchasing a property, ensure that you carry out a thorough inspection of the land, as often, a wellworn path or track can be apparent on the ground.
