RODIN COMING SOON TO THE HOLBURNE

© CSG CIC Glasgow Museums Collection

There’s lots to look forward to at Holburne Museum in Bath this autumn... Gainsborough & The Theatre 5 October to 20 January 2019 Thomas Gainsborough (1727-1788) enjoyed friendships with the most famous stars of the Georgian stage, James Quin, David Garrick and Sarah Siddons as well as musicians, theatre managers and dramatists. This exhibition explores the artist’s relationship with the theatre and shows how he drew on friendships made in Bath to build up his business in London, where he moved in 1774. It brings together some of Gainsborough’s most intimate and immediate portraits of his many creative friends and celebrity colleagues, as well as taking us behind the scenes to explore the growth of the theatre, dance and the portrait business in Bath and London.

T

o those who love their garden design, the name of Piet Oudolf is as important as Beth Chatto, Vita Sackville-West and even Lancelot ‘Capability’ Brown. He has designed landscapes all over the world, including The High Line in New York, borders at RHS Wisley and the Serpentine Gallery in Kensington Gardens as well as dozens of others across his native Netherlands and beyond. Earlier this year he was even given the inaugural RHS Horticultural Hero award. So, well, he’s kind of a big deal. Imagine my surprise then when I learned only recenty that he has designed a garden not 45 minutes from my front door! I had to take a look. Based at Durslade Farm in Bruton, Hauser & Wirth is a stunning gallery and multi-purpose arts centre which showcases new and innovative exhibitions of contemporary art. Piet Oudolf’s main garden sits behind the gallery buildings and includes a changing programme of outdoor sculptures, and houses the Radić Pavilion, designed by

There were asters and heleniums, Japanese anenomes, perovskias and persicarias all in flower and looking fantastic with a palette of yellows, oranges, pinks, rusts, blues and golds.

The field was awash with insects; bees were swarming around the dark stemmed sedums, and butterflies hovered all around. You can see from the seedheads left to gently decay that a visit at any time of year would see the garden looking just as good and as we head “His main garden into autumn the grasses, with their here, Oudolf Field, seedheads gently swaying in the is not huge, just breeze, are beginning to dominate over 1.5 acres, yet it the setting. PLAN TODAY, PROTECT TOMORROW… The future has a way of arriving unannounced. Don’t let it catch you by surprise. Emma Taylor, a Partner at GOUGHS SOLICITORS discusses how a Lasting Power of Attorney can be used to help you plan for the unexpected. Who has to know about the LPA? Before your attorneys can act on the LPA they are required to inform the Office of the Public Guardian (OPG) and apply to have it registered with them. At this point they must also tell any person whom you may have stipulated should be told. When preparing the document you can stipulate up to five people who you would like to be informed.

Emma Taylor

Key points to consider when preparing a Lasting Power of Attorney What is a Lasting Power of Attorney (LPA)? A Lasting Power of Attorney is a legal document which allows you to choose someone you trust to make decisions on your behalf at a time in the future if/when you are unable to. Does one document cover everything? No - There are two types of LPAs. A Health and Welfare LPA, which deals with decisions such as consent to medical treatment, where you should live, your care plan etc. There is also a Property and Financial Affairs LPA, which deals with decisions such as buying and selling your home, managing your finances, using your bank account, etc. Who can I choose to be my attorney? You can choose anyone, but consider the person’s suitability and ensure you trust this person fully. In the case of a Financial Property and Affairs LPA they cannot be bankrupt at the time they sign the LPA and if they become bankrupt this could result in the LPA being cancelled. Can I choose more than one Attorney? You can choose as many attorneys as you wish but it is important that you consider the practicalities, i.e. how they will act together and can they all make decisions? You can also choose replacement attorneys should any of your attorneys be unable to act.

68

THEWESTWILTSMAGAZINE

When should I think about preparing a LPA? A LPA can only be signed whilst you are capable of understanding the implications of the document. It is therefore important to think about making a LPA long before incapacity becomes an issue. The document does not have to be registered or used until such time as you need it to be. In fact a Health and Welfare LPA cannot be used until such time as you have lost capacity. How do I go about preparing a LPA? Preparing a LPA may seem like a daunting process. However, our Private Client team will be happy to prepare all the necessary documentation for you. We will meet with you to discuss your requirements and to answer any questions you may have.

“A Lasting Power of Attorney is a legal document which allows you to choose someone you trust to make decisions on your behalf ” I have a third party mandate on my bank account, so I don’t need a Lasting Power of Attorney... A third party mandate is an instruction from you to your bank or building society telling them that you would like someone you’ve chosen to have authority to carry out everyday banking transactions on your behalf. It will usually require the completion of a form with your bank and a visit in person to show you are capable of signing the form. The third party may then need to identify themselves to your bank and sign papers to verify their signature.

legal & financial | A third party mandate is only valid whilst you have mental capacity. If you lose capacity the third party will no longer be able to carry out transactions on your behalf. If the individual continues to do so they will be in breach of the terms of the mandate and could face a potentially costly accusation of fraud. In contrast, a LPA allows you to appoint someone to deal with your property and financial affairs and is valid even if you do lose capacity. A third party mandate is also limited to whichever bank you set it up with and it rarely permits anything more than everyday transactions. A Property and Financial Affairs LPA gives your attorney the authority to deal with not only your bank account, but anything that is related to your property and finances. Although a third party mandate can be useful and is often a very effective way to deal with temporary situations, it has clear limitations. A LPA however can cover all of your financial affairs and continues to do so even if/when you are unable to. What is the difference between an Attorney, an Executor and a Trustee? An Attorney is someone who has been selected and appointed by you under a LPA to make decisions about your finances and/or health and welfare when you are no longer able to yourself. An Executor is the person chosen by you to carry out the terms of your Will, after your death. An Attorney can act only up until death and an Executor can act only from the point of death onwards. The role of a Trustee/s is to manage any ongoing Trusts which may arise from a Will and to hold onto any assets for the benefit of the beneficiaries. BLOOD RUNS THICKER THAN WATER JESSICA DAVEY, a Paralegal at Wansbroughs Solicitors in Devizes, provides advice on valid Wills and Lasting Powers of Attorney.

F

amilies can be complicated and the rise in “blended families” introduces a modern strain to the existing hurdles of life. The term “blended families” roughly translated means families consisting of a couple and their separate children from prior relationships. Whilst very common in today’s society, what happens when the bank of mum and dad becomes the bank of step-mum and dad? What happens when step-mum isn’t as keen to provide towards her step-daughter’s university fees? What happens when step-dad does not want his estate to be shared between his wife’s family? The law is becoming increasingly full of examples of warring blended

£62,500 each as the brothers, branded “greedy” by the Judge, were ordered to pay £200,000 in legal fees. A common misconception is that the Wills of married couples are binding on one another, however this is not correct. The survivor of the two is entitled to change their Will following the death of their spouse, leaving loved ones potentially unaccounted for. Another fall out arising from blended families is who should be appointed as Attorney in Lasting Powers of Attorney. Former Match of the Day host Jimmy Hill appointed his third wife as joint attorney with his solicitor, leaving

“The law is becoming increasingly full of examples of warring blended families such as the case of the Powell brothers last year.” families such as the case of the Powell brothers last year. Richard and Jonathan Powell attempted to prevent their stepmother getting an extra £25,000 from their father’s estate. They claimed their disabled father was unfit to make his final Will, which left £125,000 to his second wife. They argued that an earlier Will should stand, which would have seen their stepmother receive £100,000. The feud cost them their entire inheritance of

his children from his first marriage with no say over his treatment or finances. Once Mr Hill lost capacity, the only way his children could have had any influence over his affairs would have been to make a lengthy and expensive application to the Court of Protection. We must therefore think very carefully about those we trust to be in charge of our wishes when we are no longer in a position to make our own decisions.

The best way to guard against a family feud over inheritance, or your affairs if you have lost capacity, is to make sure that you have an up-todate and drafted Will and Lasting Powers of Attorney, having carefully considered who is best placed to make decisions for you. MEET JOE COKANASINGA

A bright new star has emerged at Bath Rugby over the opening rounds of the Gallagher Premiership - 20 year old winger Joe Cokanasinga.

M

ore than a few eyebrows were raised at the back end of last season when it was announced that Joe Cokanasinga was arriving from London Irish on a supposed big money deal. People questioned whether the new arrival would even make the first team, such is the competition for places in Bath’s back three. In the opening few games of the new season though, Cokanasinga has made quite an impression in the number 11 shirt with his powerful running, great workrate and two spectacular tries against Harlequins at The Stoop. Instead, now many are now wondering whether Eddie Jones may finally have found the great hulking wing he’s been looking for - at 6ft 3in and 17st 9lbs Cokanasiga certainly possesses the requisite dimensions and his acrobatic finishes have shown he has an eye for the tryline too. When Cokanasinga arrived, he was following a well trodden path to Farleigh House from London Irish - new teammates Max Lahiff, Matt Garvey, Anthony Watson, Jonathan Joseph, Darren Allinson and Tom Homer have all made the same journey, as has forwards coach Toby Booth. With the Exiles getting relegated at the end of last season, it was always unlikely they would be able to keep hold of an England under-20 international who was starting to get picked in senior international training squads. Joe needed to continue in the Premiership to press his claim, and

Cokanasinga has made a great start to his Bath career

“When Cokanasinga arrived, he was following a well trodden path to Farleigh House from London Irish” thankfully for Bath fans, he opted for the blue, black and whites. After such an exciting start, Todd Blackadder will no doubt feel he’s unearthed a true gem. After a poor start at Ashton Gate against Bristol Bears, Bath’s attack has more recently started firing, and we’ve seen a high tempo offloading game causing teams problems. Jackson Willison has made a similarly

good impression to Cokanasinga, whilst the likes of Zach Mercer, Dave Attwood and Sam Underhill have all made impressive starts to the season. October’s matches, against Exeter Chiefs in the Premiership and Toulouse and Wasps in the Champions Cup, will no doubt give an even greater indication of where Bath find themselves this season. • bathrugby.com

NOW THAT TAKES THE BISCUIT

I

only have to write one of these pieces every month so you would think, what with everything that goes on in the world, picking a subject to write about would be fairly easy. Not so boys and girls. I find it very difficult to come up with something that I’ll be able to write about in a humorous and relatively interesting way. This month was no different and as we slid toward deadline day and I still had nothing I was panicking a bit and then I remembered a quote I heard once regarding writing…. write about what you know. I

much possible btw) it would more than likely be a savoury cracker, probably with some cheese and hopefully with some of my friend Natalie’s auntie’s homemade Brinjal pickle! It has to be said though - and I have considered this - that sweet biscuits are better with a cuppa. With coffee I prefer a ginger nut, something with a bit of spice and a decent structure to allow for dunking. With tea something with a little less flavour goes down well; a Digestive perhaps or a Rich Tea… not very sexy but traditional and they get the job done. I don’t really

It is hard and brittle and frankly has no place in the biscuit aisle of the supermarket…it should be in the DIY section with the other bathroom tiles. A new one I’ve seen and have not tried yet (as I’m not sure it will work) is a lemon Jammie Dodger. I know it’s a ‘first world problem’ but I’m having to think long and hard about this before I commit to a purchase and frankly, if I have to take that long to decide my gut feeling is that it’s probably not going to work.

A thing that is sort of bad, but also sort of good as well, in the biscuit world is the proliferation of double packs. Trying to buy a single pack “With coffee I prefer a ginger nut, something with a bit of spice and a decent of Custard Creams or Bourbons is nigh on impossible these days….in structure to allow for dunking.” the supermarket I use anyway. “They didn’t have single packs…honestly” therefore started to think about the dunk in tea for some reason, I prefer is a phrase that can often be heard things I know most about….it didn’t a dry biscuit on such occasions so in our household, although not at take long….food!!
