TheWarrenCircuitCourthas ordered WKUtoproduce“minimallyredactedcopies”ofsexual misconductinvestigationsunderTitleIXrequestedbytheCollegeHeightsHeraldin2016 Thisruling fromCircuitJudgeChrisCohroncomessevenandahalfyearsaftertheuniversitysuedtheHerald, seekingtokeeprecordsoftheinvestigationssecret
In2016,theHeraldrequesteddocumentsfor“allinvestigativerecordsforallTitleIXinvestigations intoallsexualmisconductallegationsincluding:sexualassault,sexualharassment,sexualexploitation, and/orstalkingleviedagainstWesternKentuckyUniversityemployeesinthelastfiveyears”Atthe time,theuniversitydeniedthisrequest
Followingthisdenial,theHeraldappealedtotheKentuckyAttorneyGeneral’sOffice,whichordered thedocumentstobeturnedover“withtheexceptionofthenamesandpersonalidentifiersofthe complainantandwitnesses”InsteadofturningovertherecordsasorderedbytheAttorneyGeneral, WKUappealedbysuingthestudentnewspaperintheWarrenCircuitCourt
