Strife-torn Haiti Gets New Prime Minister Mr Joseph stepped down on Monday and said Mr Henry's appointment would pave the way for elections in September. Speaking at a ceremony in Port-auPrince, the new prime minister called for unity. OAS Mission Begins Deployment to Observe the July 26 General Elections in Saint Lucia

he Electoral Observation Mission (EOM) of the Organization of American States (OAS) today began its deployment to observe the General Elections in Saint Lucia scheduled for July 26. The Mission is headed by the Secretary for Access to Rights and Equity of the OAS, Maricarmen Plata. A Panamanian national, Secretary Plata has extensive experience in developing initiatives focused on the analysis and promotion of international public law and human rights. RIDGETOWN, Barbados: The Government of Barbados has called on the United States Government to show moral leadership and end the sixty-year-old economic Embargo imposed on the People of Cuba. The embargo has achieved nothing but an unjustified punishment of Cuba and unleashed a series of painful outcomes for its people. A statement from the Minister of Foreign Affairs, and Foreign Trade Senator Dr. Jerome Walcott, said, "The Government of Barbados is of the view that the time has come for the United States to take action. It has not succeeded in isolating Cuba from the rest of the right-thinking nations in the international community. Ending the Embargo is MORALLY RIGHT. Now is the time for the United States of America to show leadership." The following is the full text of the statement by the Government of Barbados: On Sunday, July 11, 2021, a series of street protests took place in Havana and several other Provinces in the Republic of Cuba. Media coverage showed Cuban nationals calling on their Government
for greater help and response to their needs, given the increasingly difficult socioeconomic circumstances being experienced by our sister Caribbean island. These difficulties have been exacerbated by the longterm impact of the COVID-19 pan-
demic. The long-standing Embargo imposed on the people of Cuba over six decades ago by the Government of the United States needs to end. In more recent times, the many punitive economic measures instituted by the then Trump Administration have only exacerbated Cuba's difficulties and impeded the Government's response to its citizens' pleas for help. Barbados and other members of the Caribbean Community have repeatedly raised their voices in unison at the United Nations, Organization of American States, and other international fora, calling for an end to the Embargo and the resultant inhumane consequences it has wrought on the good people of Cuba. The Government of Barbados believes that the time has come for the United States to take action. All the Embargo has achieved is an unjustified punishment of Cuba and unleashed a series of painful outcomes for its people. It has not succeeded in isolating Cuba from the rest of the right-thinking nations in the international community. Ending the Embargo is MORALLY RIGHT. Now is the time for the United States of America to show leadership. Almost half a century ago, the first four
independent CARICOM Member States decided to establish relations with Cuba. Since then, our Community has enjoyed several years of strong friendships, in some cases familial ties, and mutually respectful interactions with the Government and people of Cuba. There have been many areas of technical cooperation and people-to-people exchanges over the years. The people of our Community have embraced Cuba as a valuable and respected member of our family of Caribbean nations. Specifically, over the last year alone, no less than 14 Cuban medical teams traveled across the Caribbean and played invaluable roles in helping our countries to combat and control the COVID-19 pandemic. Helping us in our darkest hours is an example of true friendship. The primary objective of Barbados and our CARICOM partners is to improve the lives and livelihoods of the Caribbean people through the development of a strong, resilient and sustainable regional economy and society and to maintain our Caribbean region as a Zone of Peace. We believe that free and unfettered relations with Cuba and all countries in this hemisphere, including the United States of America, would be greatly helped by ending the Embargo. Whatever political or ideological differences that may exist between the United States and Cuba does not, cannot, and should not justify the actions that result in such great, grave, and disproportionate consequences for the Cuban people. New York Haitian-American Leaders and Organizations Send Letter to President Biden Concerning Haiti

rooklyn, NY: In a recent letter, Assemblymember Rodneyse Bichotte Hermelyn, together with state and local leaders, urged the Biden administration to create an easier pathway for Haitians seeking political asylum by lifting the refugee admission ceiling; temporarily halting the deportation of Haitian migrants from the U.S., and supply the people of Haiti with humanitarian aid in the form of food assistance and additional COVID-19 vaccine doses. The letter read, "There is a crisis in Haiti that demands our immediate attention as Americans and begs the continued action of your leadership." Why Congress Must Make the Child Tax Credit and Earned Income Tax Credit Expansions Permanent BY KELLY CAMPBELL CIVILRIGHTS.ORG
N
ow more than ever, it is imperative for Congress to pass legislation to make permanent the child tax credit (CTC) and the earned income tax credit (EITC) expansions enacted in March 2021 through the American Rescue Plan. Tax credits can function as vital tools for financial relief to the communities who need it the most. Making these two credit expansions permanent has the ability to lift millions of people above the poverty line, helping families cover the cost of food, rent, transportation, child care, and more. The American Rescue Plan increased the full amounts of the CTC and the EITC and expanded the pool of possible recipients. The full amount of the CTC, $3,600 for children under 6 and $3,000 for children 6 and up, is now available to nearly all families — from those with no income to those making less than $150,000 a year. The EITC is now available to more working people, including young adults 19- to 24-years-old and working people over 65 who were previously ineligible.
Working people without children living in their homes can receive nearly triple the maximum benefit available from the credit. These changes should not be viewed solely as emergency responses to the COVID-19 pandemic. Rather, they are a necessary investment in families and low-income working people, especially those in communities of color. Systemic racism and decades of structural inequality in almost every area of life — including education, health care, housing, and employment — have resulted in economic disparities that have severely threatened the lives and well-being of far too many people in the United States. We
have failed as a nation to invest in the kinds of communities that will help people to live their best lives. Congress must make the expansions of the CTC and the EITC permanent. Permanently enacting the CTC would help ensure that all families have the resources to sustain safe and healthy lives and would lift 4.1 million children above the poverty line, over half of whom are children of color. Similarly, the current changes to the EITC would allow more than 17 million low-paid working people previously excluded from the benefit — including 2.8 million Black workers, 2.8 million Latino/a workers, and 678,000 Asian American
workers — to receive financial assistance through the tax credit. In other words, these credit expansions have made and will continue to make monumental improvements in millions of lives, including access to broadband, a heated and/or cooled home, car repairs, or even child care during summer months. The two credit expansions becoming permanent would make basic human needs more accessible to families and working people who often face systemic barriers to accessing goods and services that many in America may take for granted. Here are just a few ways these tax credits can be critical in helping low-income people and families access basic needs: A single mother of two living under the federal poverty line can afford to heat the family home and provide the children with fresh fruits and vegetables. A family with special needs children now has the financial resources to pay off debt, cover any needed repairs, and purchase learning resources for the children. Federal Gun Trafficking Legislation Announced
Child Tax Credit/ continued from page 4 appointments and to buy groceries put the EITC payment toward a family car. The wife’s 45-minute commute to work has been reduced in half. This extra time enabled her to register for classes at the local community college. No matter who we are, where we come from, or what’s in our wallets, most of us believe that our family’s health and wellbeing come first. This past year has put significant strain on many families, and that strain was felt even more acutely by families who were already struggling to make ends meet. The expansions of the CTC and the EITC will provide an additional lifeline to low-income families, disproportionately families of color, to help ensure that they have the support they need to build better lives. Making these expansions permanent can provide small differences that have immense impacts on these families and lowincome working people, whether it’s assistance with children, mortgage bills, or the next month’s rent. Any inaction from Congress on making the expansions permanent after they expire under the American Rescue Plan could have drastic results. Not making these changes permanent would force these families back into poverty — an unconscionable policy choice that would especially harm communities of color, but would ultimately harm us all. In
order for the tax credit expansions to be as effective as possible, it’s critical that eligibility be expanded to include all of us, including immigrant families. The EITC is currently unavailable for families with just one head of household without a Social Security number, and the CTC is unavailable to children without Social Security numbers. Allowing these families and individuals to receive the tax credits are important steps toward investing in our communities and ensuring everyone living without financial security receives the resources and support they deserve. The first payment of the child tax credit starts entering bank accounts — July 15, 2021 — and will continue on the 15th day of every month until December (unless the 15th of that month falls on the weekend).l Kelly Campbell is a summer 2021 legal intern at The Leadership Conference on Civil and Human Rights.

rooklyn, N.Y.: U.S. Senator Kirsten Gillibrand, joined by Brooklyn Borough President Eric Adams, stood in front of Brooklyn Borough Hall to announce the Hadiya Pendleton and Nyasia Pryear-Yard Gun Trafficking & Crime Prevention Act. Named for two teenage girls in Brooklyn and Chicago, IL, the bill seeks to address the illegal transfer of guns across state lines by establishing gun trafficking as a federal crime. The bill would provide law enforcement and prosecutors with the tools to go after those directly involved in the illegal movement of guns across state lines, gun dealers acting ille-
gally, individuals who organize the gun trafficking rings, and those who conspire to traffic guns. Senator Gillibrand will be reintroducing the bill this week. According to the Bureau of Justice Statistics, there are more than 400,000 gun crimes committed resulting in about 14,000 homicides each year. Estimates from the New York Attorney General’s office have found that in 9 out of 10 of these crimes in New York City, where the gun has been successfully traced, it originated from out of state. Effective March 31, 2021, the new law allowed adults aged 21-years-old and over to possess up to 3 ounces of marijuana for recreational use or 24 grams of concentrated forms of the drug. Also, people with certain marijuana-related convictions became eligible to have their records expunged immediately. While the new law drew criticism from New York City Police Commissioner Dermot Shea, who was concerned about the longterm effects and impact that legalizing marijuana would have on crime, many community leaders and local politicians supported the new law. Senate Majority Leader Chuck Schumer’s proposal to decriminalize marijuana use on a federal level is still in draft form, and he hopes to gain support among other Democrats and lawmakers. Schumer’s proposal moves beyond the recent law, which legalized recreational marijuana use on a state level, to decriminalize marijuana at the federal level. Senator Schumer hopes to accomplish this by having marijuana removed from the list of federally controlled substances. Schumer addressed the press, “…this is going to be a process…I don’t have the votes necessary at this point, but we have a large majority of our caucus for it.” According to public polls reported by the press, 60% of Americans say recreational and medical marijuana use should be legalized. In comparison, 31% of
Americans suggest only medical marijuana use should be legalized, and the others who were surveyed indicated that marijuana use should not be legalized. Cannabis Administration and Opportunity Act On July 14, 2021, Senator Chuck Schumer and Democrats Cory Booker of New Jersey and Ron Wyden of Oregon announced the Cannabis Administration and Opportunity Act. The Act, if passed, removes marijuana from the Controlled Substances Act (CSA) and allows states to determine their cannabis laws, similar to the way alcohol is federally regulated. Currently, 37 states within the United States have already decriminalized marijuana, with 18 states having completely legalized marijuana. If passed, “…the legislation would not only decriminalize marijuana but also expunge nonviolent marijuana-related arrests and convictions from federal records. It would also allocate new tax revenue which would come from marijuana sales and businesses would have the freedom to sell marijuana without the risk of federal punishment.” Furthermore, the proposal to decriminalize marijuana on a federal level is seen as aiding in the discussion of criminal justice reform. A disproportionate number
of Black and Brown people were affected by arrests due to marijuana possession. The bill also calls for investing money into restorative justice programs in Black and Brown neighborhoods. According to released statements concerning the bill, “By ending the failed federal prohibition of cannabis, the Cannabis Administration and Opportunity Act will ensure that Americans, especially Black and Brown Americans, no longer have to fear arrest or be barred from public housing. Also, there will be no prohibitions to federal financial aid for higher education for using cannabis in states where it is legal.” Maritza Perez, a supporter of the bill from the Drug Policy Alliance, stated, “Congress is finally catching up with where the general public has long been. Meanwhile, those who are convicted of marijuana-related offenses face life-altering consequences, making it hard to get a job and receive public benefits.” While those opposed to the bill, including President Joe Biden, stand firm in their views. “I’ve spoken in the past about the president’s views on marijuana. Nothing has changed, and there are no new endorsements of legislation today, “said Jen Psaki, White House Spokesman. Senator Chuck Schumer, Cory Booker, and Ron Wyden continue to seek support for the proposed bill to decriminalize marijuana on a federal level. Marijuana Amnesty and Immigrants New York’s legislation allows adults, age
21-years-old and over, to possess up to 3 ounces of marijuana for recreational use or 24 grams of concentrated forms of the drug. People with certain marijuanarelated convictions will have their records expunged immediately. This is a big deal for people who may have previously had limited access to employment due to a criminal record or those who feared that a marijuana-related conviction would negatively affect their immigration status. New York’s leading Immigration expert, Brian Figeroux, founding partner of the Law Firm of Figeroux and Associates and Ask the Lawyer Radio Program, warns immigrants that even though the Governor is offering “…amnesty for those of you convicted of marijuana possessions, you still have to do a New York post-conviction Criminal Procedure Law (CPL) 440 motion hearing in New York State to reverse the charge. Immigration court would not recognize that amnesty. They will still look at the crime for your conviction on any drug marijuana-related issues. You are inadmissible if you have more than one marijuana charge. You need to talk to a lawyer if you want to get your Green Card or become a U.S. citizen. You must speak to an attorney to determine if you qualify for amnesty and whether your case qualifies for a 440 Motion to vacate the judgment. If your case qualifies for a 440 motion hearing, your legalization gets back on track for your Green Card or to become a U.S. citizen.”l

In a few years, you realize that you must do more than just provide food and security for your little one. You have the responsibility of shaping him into the man that you want him to become, and you must start early. The next generation is counting on you to raise your son as a good partner to be, so be mindful of your actions and conversations with him. This is the 21st century where equality is asked, taught, and expected. You, as a parent, must mold your son into a respectful, decent, kind, humble, caring, and responsible human being and no one but you can do that. He sees you as a role-model and considers your behavior to be correct and normal, so it is on you what you teach him as right and wrong. It might get difficult at times, but remember your long-term goals and that every action you do now will contribute to it in some way. Here are some tips for good parenting to a son: 1.Teach Him How to Handle Emotions Teach him that it's okay to have emotions
and how to handle them healthily. In past generations, the word 'manly' has always been defined as quiet and unemotional. Strength does not really come from hiding emotions but understanding them and politely expressing them. Do not dismiss his emotions — respect his emotions, ask him if he wants to talk, listen to him, and share your own experiences or advice. Share your feeling and thoughts with him too so he knows it is okay to talk to you and that you are friendly and approachable. Teach him that it is okay to jump in excitement, or cry when he is hurt. You might just be trying to calm him by making him stop crying, but this might send an opposite message, which
is to hide and suppress his emotions. This can be very damaging to his relationships in the future, especially romantic relationships. Be empathetic but let him express. 2.Teach Empathy Empathy is a very strong and powerful skill that can greatly help in building friendships and relationships. When boys understand how the other person is feeling or might feel, they will not take extreme steps like bullying them. They will be respectful and kind. The best way to teach this is to guide them on how to behave when such situations turn up. If you see an injured puppy while returning home from the supermar-

Failure to do so might tarnish his confidence and make him feel that he has let you down. Congratulate and praise your son for completing his tasks and mention the skills that he employed which you feel helped him in doing so. It doesn't matter if he fails at a task, exam, or competition, praise his efforts and make him feel good for doing his best. This will make him feel accomplished and also develop sportsmanship.

Hugging and kissing must also be normalized; boys find it very affirming that their father is proud of them and is there for them.
7. Let Him Build His Personality If you have a daughter and a son, do not differentiate their upbringing. Every child is indeed unique and has different requirements, but by teaching sewing and cooking to your daughter and not your son, you are denying the opportunity for your son to have basic skills. Let your child choose his toys and clothes, for his happiness is all that matters. If your son likes playing with Barbie instead of G.I. Joe, that will not make him feminine. It is just a small choice made by a child who does not grasp the concept of sexual differentiation, which itself is a toxic concept developed by a patriarchal society that does not believe in equality and healthy relationships. Do not force him to get into physical sports if he likes music or painting more. Encourage him and be there as a support system that he can always lean on. Even if he is into sports, expose him to softer pursuits too. Let him decide for himself. Teach him to do household chores or ask for help when you are doing them. These are great ways to make your son selfdependent as an adult instead of having to rely on someone else for minor tasks. Raising a child is not an easy task, but remember, consistency is the key to success. Don't expect to get the results overnight. Be persistent in your actions such that it becomes a habit for you and your family to have healthy relationships among yourselves and with others.l

Everything You Need to Know About Real Estate Transfer

he ownership of every piece of land in the United States is recorded and held at the County Recorder’s office. When ownership changes hands, this also needs to be reflected in the public records. This process of transferring interest over a real estate asset is known as conveyance. A transfer deed is a document that acts as the proof of conveyance. In other words, it’s the transfer of the ownership of a property. It has a property description that adheres to legal norms and identifies the current and subsequent owners. It also acknowledges the transfer between them in a language that legally specifies it as a deed. It should be noted that a deed is different from a title. It is the vehicle through which the transfer of ownership takes place and not a legal right to the property, partial or complete. When Is a New Deed Required? Aside from selling the property to a new buyer, a transfer deed might be required in a few other scenarios. For instance, transfer deeds are required as proof of transfer if someone is planning to transfer property to a family member or to a business at no cost or if someone is planning to fund a living trust. Changes in the names of the title of the property may also require a transfer deed as documentation. Transfer deeds are usually carried out between the buyer and the seller with the help of a lawyer. In either case, if you are the real estate agent for the buyer, it’s a good idea for the buyer to include you in the process as a witness. The witness is an important role should there be a conflict over the transaction in the future. Types of Deeds There are essentially three types of transfer deeds that are based on the particulars of the deed, such as what the grantor can convey and the warranties included in the deed. A general warranty deed is one of the most common forms of transfer deeds. It provides the greatest conveyance and protection to the buyer because it explicitly states that the property is free of liens and the seller holds no claims to its ownership. The buyer also reserves the right to sue the seller should this claim turn out to be false. A special warranty deed guarantees less than the general warranty deed. In this type of transfer deed, there is no guarantee against title defects or encumbrances that may have been present when the seller received the property nor does it obligate the seller to do anything further once the title is transferred. Special warranty deeds
are frequently used by temporary holders of real estate assets such as corporations, trusts, or other fiduciaries who do not use or occupy the land for their own benefit. A quitclaim deed is a particular type of special warranty transfer deed that carries no warranties at all. It merely conveys the interest that the grantor had in the property, whatever that may be. Quitclaim deeds are used to transfer rights where there is ambiguity over what those rights are in the first place. This is mostly commonly used to clear up title problems or to transfer property within a family or between spouses (especially after a divorce).

Joint Tenancy and Tenancy in Common When more than one person is purchasing a property, it is important to determine how these joint owners will take the title. There are two common types of shared ownership—joint tenants and tenants in common. The type makes no difference in most of the rights and duties of the coowners, but it does affect how the asset would be treated upon the death of a coowner. In the case of joint tenancy, when one of the co-owners dies, the share of the deceased passes automatically to the surviving joint tenants, regardless of the existence of the deceased owner’s will. In contrast to this, in the case of tenancy in common, the share in title of a dead coowner is passed on to their heir or the people named in the deceased’s will. Recording the Deed The last step in the conveyancing process is recording the deed, mortgage, or any other instrument in the county where the property is located. Even though it is commonly called the county recorder’s office, land registry office, registrar or register of deeds, the name of the county office involved with recording real estate instruments varies from state to state. This last step of recording the deed is extremely important because the owner’s interests are not fully protected unless and until the document is recorded. In addition to this, the sequence in which the deeds and other documents are recorded also determines the priority of various claims against the property. Conclusion Transfer deeds form the legal backbone to a buyer’s or owner’s right to a property. Poorly made transfer deeds or the absence of one could severely impact the right to property ownership. Even though these documents are generally short, as a real estate agent, it is important for you to understand their value and acknowledge their significance in the legal system.l

Some NYC Healthcare Workers Face Vaccine Requirements or Weekly Tests. Teachers Could Be Next BY ALEX ZIMMERMAN CHALKBEAT

fter announcing that certain healthcare workers would be required to get vaccinated or submit to weekly coronavirus testing, Mayor Bill de Blasio is now considering the same for other city workers, including teachers, he said Wednesday. “It makes sense to start, show how well it works, and keep going from there,” de Blasio told reporters when asked if such a directive would be issued to teachers, police officers, or other city workers. “We are definitely looking at other possibilities.” With rates of coronavirus infections in New York City rising as the more contagious Delta variant takes hold, fresh questions are emerging about how officials will encourage staff and students to be vaccinated before the first day of school on Sept. 13. It’s a high-stakes issue, as positive cases among unvaccinated students or staff could complicate the city’s plans for every student to learn in person this fall,

and time is running out to fully vaccinate students and staff before school starts. At least 58% of education department employees have received a minimum of one vaccine dose, according to city data from earlier this month. That figure does not include staff who received shots outside the city, meaning the true number is likely higher. By comparison, about 70% of all New York City adults have received at least one dose. Fighting to Keep Schools Open Increasing the number of educators who
are vaccinated may be a key component of successfully reopening schools this fall. Last year, positive cases resulted in thousands of classroom and building closures, which upended schedules and forced in-person students to temporarily switch to remote learning. City officials are not planning to offer a remote option this fall, raising questions about how the city will avoid significant disruptions if teachers or students test positive. The latest guidance from the Centers for Disease Control and Prevention says that students or staff who are vaccinated
don’t need to stay home even if they test positive as long as they are asymptomatic. City officials, however, have yet to say what rules will apply for city schools or how instruction will be delivered if teachers or students have to stay home. Since the vaccines are not yet authorized for students younger than 12, it’s possible most city students will be unvaccinated when they return to classrooms this fall. About 44% of city residents between 13 and 17 years old are vaccinated, according to a health department spokesperson. (Figures for 12-yearolds were not immediately available.) It’s unclear how aggressive city officials will be in issuing vaccine requirements before the school year starts and there are thorny legal and political considerations. The new protocols for healthcare workers at city-run hospitals and health clinics don’t mandate vaccines outright and allow staff to get tested weekly instead. testing each week, and department officials previously indicated they were planning to have roving testing at smaller samples of schools rather than regular systemwide testing this fall. Emergency Compromise William Schaffner, an infectious disease expert at Vanderbilt University Medical Center, said there are good public health reasons to mandate vaccines, as they are safe and substantially reduce the likelihood of infection, hospitalization, and death. But de Blasio’s compromise for healthcare workers, allowing testing in lieu of vaccination, may be necessary politically, he said. The vaccines are authorized by the federal government on an emergency basis, and it’s not clear when the vaccines may receive full approval. “The objection that it’s not a fully licensed vaccine will come up milliseconds after such a policy [mandate] is announced,” Schaffner said. “It would sure be nice to have that off the table, and then it becomes a vaccine like any other vaccine.” The city’s teachers union did not say if they would support a vaccine mandate. “Thousands of UFT members have already been vaccinated through programs sponsored by the union, the city,
11 and the state,” Alison Gendar, a teachers union spokesperson, wrote in an email. “We will be working with the city, state, and our own independent medical experts on safety protocols for this fall.” September Quickly Approaching City officials declined to outline what factors they’re considering in stepping up vaccine or testing requirements for educators or when they would make a decision. Health officials said they’re working with pediatricians and pursuing other avenues to increase the numbers of vaccinated children, including outreach and mobile vaccine clinics at family-friendly spots. But there is limited time to coax staff and students to be fully vaccinated before September. The school year starts in fewer than eight weeks, and the current two-dose vaccines take between five and six weeks to take full effect after the first shot. Federal Judge Strikes Down DACA: What You Need to Know BY AARON REICHLIN-MELNICK IMMIGRATION IMPACT
In 2018, after the Trump administration had already been blocked from ending, DACA, Texas and seven other states sued to overturn the original DACA program. The case was assigned to Judge Hanen, the same judge who had previously struck down the DAPA program.

early a decade after the U.S. Department of Homeland Security created the Deferred Action for Childhood Arrivals (DACA) program to provide protections to undocumented immigrants brought here as children, Judge Andrew Hanen of the Southern District of Texas struck down the program on July 16, ordering U.S. Citizenship and Immigration Services (USCIS) to stop issuing any new DACA benefits. Although Judge Hanen did rule that DACA itself was illegal, in recognition of the impact of terminating DACA on the 616,000 people who currently benefit from the program, he did not require the agency to terminate any DACA protections or stop renewals while his decision goes through the appeals process. People who only recently submitted initial applications will not receive approvals from USCIS. Background DACA recipients vary in age and come from countries all around the world, but the typical DACA recipient is a 27-year-

old woman from Mexico. And while nearly 42 percent of all DACA recipients are 25 or younger, the oldest DACA recipients will turn 40 next year. Given the progam’s requirements, all DACA recipients have been in the United States for at least 14 years. Many of them have been here for much longer. The first major legal challenge to the DACA program came in 2014, two years after its creation, when Texas successfully sued to prevent the Obama administration from implementing Deferred Action for Parental Arrivals (DAPA) program, which would have expanded DACA-like
protections to the parents of immigrant youth. In 2017, after President Trump took office, Texas and several other states threatened to sue DHS to block DACA itself if the Trump administration did not terminate DACA. Citing that litigation threat, the Trump administration then attempted to terminate the DACA program. But that termination was halted in a successful challenge that made it all the way up to the Supreme Court, which in 2020 ruled that the Trump administration had gone through the wrong process to end DACA.
What did Judge Hanen rule on July 16? In his decision, Judge Hanen ruled that the Obama administration had gone through the wrong process in creating DACA, but also that the DACA program itself violated the law. His decision conflicted with multiple other federal courts who have ruled on DACA’s legality, including federal courts in New York and California, all of which have found that DACA was a lawful exercise of the president’s authority to grant deferred action. Judge Hanen’s decision was rife with anti-immigrant talking points, fully accepting the plaintiff states’ arguments that undocumented immigrants are a burden on the states and take jobs from other Americans, despite robust research showing that DACA recipients grow the continued on page 13

Because he found that the program has been put into place contrary to the Administrative Procedure Act, he sent it back to the agency and left open the possibility—however small—that DHS could find some way to protect Dreamers through different measures.

"All the culprits, perpetrators and sponsors must be identified and brought before Haitian justice," said Mr Henry. "I hope that exemplary and dissuasive sentences will be pronounced. The nation expects no less from its leaders," he added. "Never again will we have to relive such a tragedy."l
What does the decision mean for those with DACA or those who have applied for DACA? Because a federal judge in New York has ordered USCIS to accept new DACA applications, Judge Hanen did not order the agency to outright reject new applications. However, he declared that USCIS cannot issue any new DACA protections or process those applications. Within 48 hours, USCIS notified all new applicants that it was cancelling their appointments for biometrics processing. Those who had already had their biometrics taken will likely see their applications put on hold indefinitely. Individuals who currently have DACA will not be affected by the decision at this time, as Judge Hanen allowed renewals to continue while the case goes through the appeals process. In addition, his decision should not affect those DACA recipients who are seeking
advance parole to travel abroad. What’s next for DACA? Immediately after President Biden took office, he issued an executive order directing the DHS to “protect and fortify” DACA. Last month, DHS indicated that the agency intended to codify DACA through a regulation, which was likely going to come this fall. Hanen’s decision makes that process significantly more difficult because of his stated belief that DACA itself is illegal. Nevertheless, the Biden administration confirmed that it still plans to move forward with an implementing regulation. While the Department of Justice has indicated that it will appeal the decision, the appeal would go to the 5th Circuit Court of Appeals, which in 2015 upheld Hanen’s original decision striking down DAPA. The only way to finally end the limbo that DACA recipients find themselves in
is to pass permanent protections through Congress, and there is a unique opportunity to do so today. Congressional Democrats have indicated widespread support for passing immigration relief through the budget reconciliation process. The Biden White House has also come out in support of that plan. However, the use of budget reconciliation is not certain. It would still require 51 votes in the Senate, and it remains unclear whether the Senate parliamentarian will allow it. Thankfully, there is historical precedent, as the Senate in 2005 voted in favor of using the reconciliation process to expand access to certain green cards. Without congressional action, undocumented youth who participate in the DACA initiative will once again fall back into limbo, waiting on bated breath for a court decision that could throw their lives into chaos. They deserve better.l

mother and her six children were recently kicked off a flight following a family vacation because her 2-year-old daughter refused to keep a mask on her face. During publicized news interviews, the mom stated, "She never wore masks this entire few months. I would never make her wear a mask. She's a baby.", referring to her 2year-old daughter. The latter would not keep a mask on her face flying from Orlando, Florida, to Newark, New Jersey. She said her children were confused, scared, and crying as they had to get off their flight. YC's "Hometown Heroes" Parade celebrated essential workers who supported New Yorkers throughout the COVID-19 pandemic on July 7, 2021. New COVID-19 Vaccine Warnings Don’t Mean It’s Unsafe – They Mean the System to Report Side Effects is Working BY JUSTIN VESER THE CONVERSATION
W
hile the COVID-19 vaccines currently available in the U.S. have been proved to be safe and effective, recent reports of rare adverse events, or side effects, have raised concerns. On July 12, 2021, the Food and Drug Administration approved an update to the Johnson & Johnson COVID-19 vaccine fact sheet to include an increased risk of the rare nerve condition Guillain-Barré syndrome. This follows previous reports linking the J&J vaccine with a rare blood clot. While reports like these can be scary, they’re a sign that the vaccine safety reporting system is working. They also highlight how the relative risks of rare side effects like these need to be put into context. As a pharmacist who has been managing operations for the University of Virginia Health System’s COVID-19 vaccine program for the past seven
months, I’ve seen how uncertainty and fear over potential side effects can drive vaccine hesitancy. Understanding how information about adverse events is collected and what it means for vaccine safety may help people make informed decisions about their health. Tracking safety before, during and after approval The FDA enforces rigorous testing and approval processes that manufacturers must follow before a new vaccine can be
made available to the public. Regardless of whether a vaccine is approved through the typical FDA approval process or an Emergency Use Authorization (EUA), the steps required to test a new drug for safety and effectiveness are the same. An EUA can get a vaccine to the public more quickly by streamlining the regulatory process, but no shortcuts are taken. Every step is taken to ensure the vaccine is both safe and effective. Vaccine clinical trials occur in four sequential phases. In the first three phas-
es, study investigators are the ones who identify, quantify and document safety issues. Phase 1 typically introduces the vaccine to fewer than 100 people over several months under controlled conditions. Typically, the majority of potential adverse events are identified in this stage. After the FDA reviews phase 1 data and deems the vaccine safe enough to be studied further, the vaccine moves on to phases 2 and 3, where it will be given to larger numbers of people over longer periods of time. Here, investigators determine optimal dosage and screen for rare side effects. If phase 2 and 3 data meets FDA approval standards, the vaccine will then move on to phase 4 and become available to the public. The vaccine is observed over much larger populations and extended periods of time, and manufacturers are required to regularly check and report potential safety concerns to the FDA. between the shot and a side effect. But that doesn’t mean the risk of getting that side effect is very likely, or that it outweighs the benefit of getting vaccinated. These risks, while real and potentially life-threatening, must be viewed in context with the much larger risk of negative outcomes from the diseases vaccines protect people from. For example, 1%7% of patients who take cholesterol drugs called statins are likely to experience potentially harmful muscle injury. However, these drugs are still taken by millions of people because they are highly effective at preventing heart disease and stroke. And in the case of Guillain– Barré, about one in 100,000 people, or 0.001%, develop this condition yearly in the U.S. from any cause. By comparison, the U.S. has had more than 33 million cases of COVID-19, and over 600,000 deaths caused by this disease.
ple may be hesitant to take on any more risk than they have to. But there are safety nets in place to monitor the COVID19 vaccines, and they are still working as they should. The COVID-19 vaccines are proven to be overwhelmingly safe for most people. More than 40,000 patients participated in J&J’s clinical trials before the company applied for emergency use authorization, mirroring Pfizer’s and Moderna’s study sample sizes. Some 0.4% of participants in the J&J trial experienced serious adverse events unrelated to COVID-19 infection. In contrast, the trial demonstrated that people who get the vaccine are 85% less likely to get severe COVID-19 than those who remain unvaccinated. The extremely rare side effects associated with the COVID-19 vaccines were discovered because safety reporting tools were used appropriately. Being aware of the risks of a treatment, however rare, can help people make health decisions that work best for them. However, these risks must be viewed in context. And in the case of the COVID19 vaccines, they must be weighed against the consequences of remaining unvaccinated and letting the pandemic rage on.l

The Vaccine Adverse Event Reporting System (VAERS) is a national safety monitoring system run by the FDA and Centers for Disease Control and Prevention. While certain types of adverse events, such as injuries during vaccine administration and serious complications, are mandatory for health care providers to report, anyone can submit a report. Recent adverse events associated with the COVID-19 vaccine, including Guillain-Barré and thrombosis for Johnson & Johnson and myocarditis for Pfizer, were identified through VAERS. Serious adverse event risk from vaccines is small A rare adverse event may take months or years to identify for a simple reason: It’s rare. For some drugs that are less commonly used, new safety data takes longer to discover because a relatively small number of patients use the drug. For example, though the shingles vaccine Shingrix was approved 2017, it wasn’t until March 2021 after over 3.7 million patients had gotten the shot that the FDA announced a potential increased risk of Guillain-Barré. And it still hasn’t been confirmed that the Shringrix vaccine causes the nerve condition. For cases like the COVID-19 vaccine, however, millions of people will receive the drug shortly after it’s released to the
public, and new issues or patterns often emerge more quickly. This can lead to two problems. First, not every reported adverse event is directly related to the vaccine. For example, many of the tens of millions of people who have received the Pfizer vaccine have likely experienced a sunburn. People might report that they experienced a sunburn to VAERS, but the vaccine has no effect on your skin’s ability to protect against the sun. VAERS is very clear that it “is not designed to determine if a vaccine caused a health problem, but is especially useful for detecting unusual or unexpected patterns of adverse event reporting.” Correlation does not imply causation. Second, a plausibly identified adverse event does not necessarily make the vaccine unsafe. According to CDC, there have been 100 preliminary reports of Guillain–Barré out of 12.5 million J&J doses, or 0.008% of people who received the vaccine. Administering one vaccine to a huge sample of people can make it easier to identify a possible connection

Should the Supreme Court Have Term Limits? BY PAUL M. COLLINS, JR. ARTEMUS WARD THE CONVERSATION
P
ressure on Supreme Court Justice Stephen Breyer to step down will likely grow now that the court’s session has ended. Breyer, 82, joined the court in 1994. His retirement would allow President Joe Biden to nominate his successor and give Democrats another liberal justice, if confirmed. Supreme Court justices in the U.S. enjoy life tenure. Under Article 3 of the Constitution, justices cannot be forced out of office against their will, barring impeachment. This provision, which followed the precedent of Great Britain, is meant to ensure judicial independence, allowing judges to render decisions based on their best understandings of the law – free from political, social and electoral influences. Our extensive research on the Supreme Court shows life tenure, while wellintended, has had unforeseen consequences. It skews how the confirmation process and judicial decision-making work, and causes justices who want to retire to behave like political operatives.
Problems with lifetime tenure Life tenure has motivated presidents to pick younger and younger justices. In the post-World War II era, presidents generally forgo appointing jurists in their 60s, who would bring a great deal of experience, and instead nominate judges in their 40s or 50s, who could serve on the court for many decades. And they do. Justice Clarence Thomas was appointed by President George H.W. Bush at age 43 in 1991 and famously said he would serve for 43 years. There’s another 13 years until his promise is met. The court’s newest member, Donald Trump’s nominee Amy Coney Barrett, was 48 when she took her seat in late 2020 after the death of 87-year-old Justice Ruth Bader Ginsburg. Ginsburg, a Clinton appointee who joined the court at age 60 in 1993, refused to retire. When liberals pressed her to step down during the presidency of Democrat Barack Obama to ensure a like-minded replacement, she protested: “So tell me who the president could have nominated this spring that you would rather see on the court than me?” Partisanship problems Justices change during their decades on

the bench, research shows. Justices who at the time of their confirmation espoused views that reflected the general public, the Senate and the president who appointed them tend to move away from those preferences over time. They become more ideological, focused on putting their own policy preferences into law. For example, Ginsburg grew more liberal over time, while Thomas has become more conservative. Other Americans’ political preferences tend to be stable throughout their lives. The consequence is that Supreme Court justices may no longer reflect the America they preside over. This can be problematic. If the court were to routinely stray too far from the public’s values, the public could reject its dictates. The Supreme Court relies on public confidence to maintain its legitimacy. Life tenure has also turned staffing the Supreme Court into an increasingly partisan process, politicizing one of the nation’s most powerful institutions. In the 1980s and 1990s, Supreme Court nominees could generally expect large, bipartisan support in the Senate. Today, judicial confirmation votes are almost strictly down party lines. Public support for judicial nominees also shows large differences between Democrats and Republicans. Life tenure can turn supposedly independent judges into political players who attempt to time their departures to secure their preferred successors, as Justice Anthony Kennedy did in 2018. Trump appointed Brett Kavanaugh, one of Kennedy’s former clerks, to replace him. The proposed solution Many Supreme Court experts have coalesced around a solution to these problems: staggered, 18-year terms with a vacancy automatically occurring every two years in nonelection years. This system would promote judicial legitimacy, they argue, by taking departure decisions out of the justices’ hands. It would help insulate the court from becoming a campaign issue because vacancies would no longer arise during election years. And it would preserve judicial independence by shielding the court from political calls to fundamentally alter the institution.

Partisanship would still tinge the selection and confirmation of judges by the president and Senate, however, and ideological extremists could still reach the Supreme Court. But they would be limited to 18-year terms. The U.S. Supreme Court is one of the world’s few high courts to have life tenure. Almost all democratic nations have either fixed terms or mandatory retirement ages for their top judges. Foreign courts have encountered few problems with term limits. Even England – the country on which the U.S. model is based – no longer grants its Supreme Court justices life tenure. They must now retire at 70. Similarly, although many U.S. states initially granted their supreme court judges life tenure, this changed during the Jacksonian era of the 1810s to 1840s when states sought to increase the accountability of the judicial branch. Today, only supreme court judges in Rhode Island have life tenure. All other states either have mandatory retirement ages or let voters choose when judges leave the bench through judicial elections. Polling consistently shows a large bipartisan majority of Americans support ending life tenure. This likely reflects eroding public confidence as the court routinely issues decisions down partisan lines on the day’s most controversial issues. Although ideology has long influenced Supreme Court decisions, today’s court is unusual because all the conservative justices are Republicans and all the liberal justices are Democrats. In April 2021, President Biden formed a committee to examine reforming the Supreme Court, including term-limiting justices. To end the justices’ life tenure would likely mean a constitutional amendment requiring approval from two-thirds of both houses of Congress and three-fourths of U.S. states. Ultimately, Congress, the states and the public they represent will decide whether the country’s centuries-old lifetime tenure system still serves the needs of the American people.l Paul M.
