Prosecution lawyer told the court today the Government has refused to submit evidence they claim could be crucial in making the decision on whether or not to proceed with the case.

The proceedings went on as Kenyatta sat pensively in court after making a historic appearance. Before entering the courtroom, Kenyatta was welcomed by a host of Kenyan MPs and supporters who included Foreign Affairs Cabinet Secretary Amina Mohamed and Narok Governor Samuel Tunai.

Stephen Collins, the actor who played Reverend Eric Camden, the virtuous father on long-running family drama 7th Heaven, is under investigation for child molestation. In a recorded marriage therapy session, Collins admits he exposed himself to several young girls between the ages of 10 and 13 in Los Angeles and New York. Following the release of the tapes by TMZ on Tuesday, Collins quit his position on the Screen Actors Guild board and was sacked from Ted 2. A law enforcement source told TMZ Collins is suspected of having “inappropriate sexual contact with at least three minor victims.” The Los Angeles Police Department has also reopened their investigation into Collins in collaboration with authorities in New York. Law enforcement in California received the therapy session recordings two years ago but closed
the case after finding “no verified victim.” The 67-year-old actor allegedly made a written confession to ex-wife Faye Grant in 2012, which sparked the therapy session. Grant secretly recorded the session under the advisement of her lawyer, who told her it was legal in California to record conversations in order to gather evidence on a person who has committed a violent felony. In the recording, a man with Collins’ distinct voice admits exposing himself to a 10-year-old relative of his first wife Marjorie Weinman. Collins and Weinman divorced in 1978. He also confessed to having touched the young relative. “There was one moment of touching where her hand...I put her hand on my penis,” Collins says. That incident of molestation was reported in 2012, and can still be prosecuted since the statute of limitations starts at the date of reporting.

Bogus medical colleges put on notice
Unprepared lawyers, police and probation officers delaying court cases
The reason the country suffers from so many backlogged cases is mainly caused by the unpreparedness of lawyers, police and probation officers, a survey by the Kenya Judiciary reveals. The survey states that cases involving lawyers representing the accused take an average of 274 more days to conclude compared to those without lawyers. With regard to the report, Chief Justice Dr. Willy Mutunga said; “Parties being unprepared accounted for 44.78 per cent of case delays.” “The Judiciary is also under staffed but managed to reduce case back log from one million
to 485,976 countrywide over the past three years alone,” Dr. Mutunga added. Speaking during an earlier address at the Law Society of Kenya (LSK) he noted that the survey was meant to review the Judiciary’s work methods and look into why cases were taking so long to resolve. Dr. Mutunga said that out of the sampled cases, slightly more than half had legal representation whereas about 48 per cent had none. It was found that about a quarter of all cases were backlogged because courts were not in session at the appointed time.
Government to invest Sh20b in police upgrade Interior Cabinet Secretary Joseph ole Lenku on Tuesday announced that the Government would in the next five years invest Sh20 billion in a police modernisation programme. The programme, according to Lenku, will include introduction of an insurance cover for all police officers, improving police’s remuneration, construction of houses and purchase of vehicles and communication equipment. Lenku said the investment will reflect on the country’s economic performance, and improve the chances of meeting some of the key Vision 2030 goals. Owners of unregistered medical colleges now risk prosecution after the government announced a countrywide crackdown on such institutions. Kenya Medical Laboratory Technicians and Technologists Board Chairman Abel Onyango yesterday said they would seek to close down bogus institutions offering technological courses without approval and prosecute their owners. He said only 56 institutions have been accredited countrywide with many students graduating from such bogus colleges continuing to be left out of the job market as their certificates are not recognised.
Theft suspect gunned down in Riara Police killed a robbery suspect today morning at a private residence in Riara, Nairobi. Police say the slain suspect was in a gang that had tried to gain entry into the private house and had tied guards on duty when an alarm was raised. The deceased’s accomplices managed to escape. This comes even after it emerged that officers could have mistakenly killed a colleague in what was thought to be a robbery incident in Kangemi on Tuesday.

FBI seeks public’s help in identifying man in ISIS decapitation video The Federal Bureau of Investigation (FBI) is now seeking the help of the public to identify an Englishspeaking militant who appeared to help execute Syrian soldiers in an ISIS recruitment video released last month. In the 55-minute video titled
“Flames of War,” the jihadist switches from classical Arabic to perfect English with a North American accent, and appears to orchestrate a mass execution of Syrian soldiers. And on Tuesday, the FBI reached out to the public on its website
where it posted a portion of the video and asked whether anyone has information about the jihadist’s identity. “We’re hoping that someone might recognize this individual and provide us with key pieces of information,” Michael Steinbach,
assistant director of the FBI’s counterterrorism division, said. The request is part of the FBI’s broader outreach to the public to help identify people seeking to travel overseas to fight with terror groups, and those who are returning from such fights.

Second court win elates trans-gender campaigner Kenyan transgender activist Audrey Mbugua is an elated woman after the High Court ordered education authorities to amend the name on her high school certificate she acquired when she was a man. Judge Weldon Korir gave the Kenya National Examinations Council 45 days to change the name on the certificate from Andrew Mbugua to Audrew Mbugua without marking her gender. “We threaded the eye of the needle. Thanks everyone for the support,” tweeted Ms Mbugua, who also described it as a huge watershed moment in an interview with Reuters news agency. The court also ruled that Ms Mbugua will not pay for extra costs incurred by the council for the changes. This became Ms Mbugua’s second legal victory. In July, the High Court ordered the authorities to register her lobby group, Transgender Education and Advocacy. The court ruled that refusal to do so had no legal basis and was an abuse of power. Ms Mbugua was recently nominated for a human rights award by the Netherlands Ministry of Foreign Affairs. Voting is on until October 10 for the December 9 award.

Africa’s future looks bright, says W. Bank African economies will continue to grow despite obstacles facing the region, ranging from Ebola and terrorism, the World Bank has said. In their growth projections for Africa, World Bank says the weaker than expected global growth and the declining commodity prices will not stop Africa’s regional GDP from growing to 5.2 percent yearly in 2015-16 from 4.6 per cent in 2014 as was expected. This is according to the World Bank’s new Africa’s Pulse, a twice-yearly analysis of the issues shaping Africa’s economic prospects. Significant public investment in infrastructure, increased agricultural production and expanding services in African retail, telecoms, transportation, and finance, are expected to continue to boost growth in the region.

Police arrest five suspects after City carjacking attacks
Five suspected gangsters and a matatu crew are in police custody after a series of carjacking attacks in Nairobi last night. The five suspects were arrested after they carjacked a matatu along Ngong Road. They were arrested at the Kibera slums where more than 30 mobile phones and unknown amount of cash was recovered from them. Police say the gang had carjacked and commandeered a bus towards Ngong Road where they robbed passengers of valuables. The bus was heading for Kangemi when six of the passengers commandeered the vehicle towards Ngong
Road before robbing the travellers. No one was injured. In another incident, a matatu driver was arrested today after he went to report that he was carjacked last night and passengers robbed along Thika Road. The driver says the vehicle was heading for Kasarani when some of the passengers commandeered the vehicle to Huruma where the robbery took place. It is not clear why the matatu driver took time to alert police immediately. There have been allegations that matatu crews often collude with thugs who pose as passengers before robbing travellers after commandeering vehicles.
It could soon be possible to eat as much ice cream, cookies and cakes as one wishes without the risk of weight gain. This is after a team of scientists discovered a pill that could circumvent the gain. University of California scientists led by Sean Curran of the Davis School of Gerontology and the Keck School of Medicine have discovered a new way of suppressing obesity that accompanies high-sugar diets. They have pinned it down to a key gene that pharmaceutical companies have developed drugs to target. So far, Curran’s work has been solely on the worm Caenorhabditis elegans and human cells in a petri dish -- but the genetic pathway he studied is found in almost all animals from yeast to humans. Next, he plans to test his findings in mice. Curran’s research is outlined in a study that was published in Nature Communications on
October 6, 2014. Building on previous work with C. elegans, Curran and colleagues discovered that certain genetic mutants -- those with a hyperactive SKN-1 gene -- could be fed incredibly high-sugar diets without gaining any weight, while regular C. elegans ballooned on the same diet. “The high-sugar diet that the bacteria ate was the equivalent of a human eating the Western diet,” Curran said. He was referring to the diet favored by the Western world that is characterised by high-fat
and high-sugar foods, like burgers, fries and soda. The SKN-1 gene also exists in humans and is called Nrf2, suggesting that the findings might translate, he said. The Nrf2 protein, a “transcription factor” that binds to a specific sequence of DNA to control the ability of cells to detox or repair damage when exposed to chemically reactive oxygen (a common threat to cells’ well-being), has been well studied in mammals. Pharmaceutical companies have worked to develop small-molecule drugs that
target Nrf2, in the hope that it will produce more antioxidants and slow down aging. Though the promise of a pill to help control your body’s response to food is enticing, it is not without risk, Curran said. Increased Nrf2 function has been linked to aggressive cancers. “Perhaps it is a matter of timing and location,” Curran said. “If we can acutely activate Nrf2 in specific tissues when needed then maybe we can take advantage of its potential benefits.”

His sample was among those that tested negative. He, however, awaits a re-run of his blood sample after three days.

Turner Broadcasting, the parent company of global TV powerhouse, CNN, plans to sack 1,475 workers as part of a ruthless strategy to save resources and raise profits. Turner has been struggling to cope with the global digital revolution and how it has changed how viewers watch TV. The digital revolution, also called the Third Industrial Revolution, is the change from analogue, mechanical, and electronic to digital technology given the growing popularity of digital computers and digital record keeping. The power producers plan to raise the country’s capacity to over 6,700 Megawatts by 2016 from the current 1,664. The additional capacity is meant to reduce the frequency of blackouts and reduce the cost of power. However, manufacturers, such as cement makers, worry the move is more than the country requires and that the additional power may go to waste. They also claim some of the electricity being generated is wasted, especially at
night when demand is not high. But Energy and Petroleum Cabinet Secretary Davis Chirchir has assured consumers that the energy generated is just enough to meet the demand. “We don’t want to be in a situation where we cannot be able to meet the demand envisioned,” he told reporters last week during the launch of a web-based portal targeting large power consumers like manufacturers. Through the portal, manufacturers will be able to advise Kenya Power on the amount of new or additional power they need to either expand their existing production capacity or start new factories.

Micro-credit firm offers school fee solutions
Education continues to be regarded the gateway to success and it is on this knowldege that a number of banks and lenders have chosen to offer services tailored for those who cannot afford to pay their school fees. One such lender, Milango, a microfinance institution that has partnered with USAID, Kenya Commercial Bank and the Youth Enterprise Development Fund, among others, is offering borrowers a product known as ‘Somesha Loan’. The product provides loans of between Sh3,000 and 100,000 to those who want to pursue an education, particularly at the college level. “This product also extends to other educational courses such driving school and short courses, training,” said a statement from Milango. The Somesha Loan is given to Milango clients with existing businesses in a group set up. “It can be a first loan for a client who feels that school fee is the most pressing issue,” says a statement from the lender. The loan has a 1 year term, allowing borrowers to pay an interest rate of 2 per cent per month of the amount borrowed once the 1 year term expires.

A uvula piercing is a body piercing through the conic projection that is in the middle of the tonsils. Keane’s book promises drama

Not for the first time will Roy Keane have crossed a line that leaves him in extremely dangerous territory. If he offended the fair-minded majority in his first autobiography with the admission that it was his intention to severely injure Alf-Inge Haaland in 2001, his reflections in his latest book, The Second Half, will spark yet more controversy. On Clive Clarke’s heart attack He admits to an ‘evil thought’ about the former Sunderland player, whose career was cut short by a heart attack when he was on loan at Leicester in 2007. He admits
to using news of Clarke’s sudden illness to deflect the attention away from the 3-0 defeat his Sunderland side had just suffered against Luton. “I said that football results didn’t really matter,” he writes. “And I had the evil thought, I’m glad he had it tonight, because it would deflect from our woeful performance.” He also concedes that, having once joked that he was surprised “they’d found a heart”, he “sometimes forgot” he “wasn’t the only person with parents and children”. Keane’s second book, skilfully ghosted by Roddy Doyle, offers the kind of insight that will disturb as

Giro d’Italia, Tour de France a double possible in 2015 Organisers of the Giro d’Italia say the route for the 2015 race could favour a rare Giro-Tour de France double. No rider has won both races in the same year since Marco Pantani in 1998, but Alberto Contador and reigning Tour champion Vincenzo Nibali are expected to target the feat next year. The 2015 Giro, which runs from 9-31 May, features five mountain stages, seven ‘flat’ stages and a time trial. “The Giro-Tour double can be done,” race director Mauro Vegni said. Michael Phelps, the 18-time Olympic swim champion who was arrested last week for drink driving, has been banned for six months by USA swimming board and dropped from the 2015 World Championships. The punishment came six days after Phelps was arrested in his Baltimore hometown and charged with driving under the influence of alcohol. He also faces charges of excessive speed and crossing the centre line while driving inside a tunnel. On Sunday, Phelps said on
Twitter he would be taking a break from swimming and “take some time away to attend a program” for treatment of unspecified personal issues. USA Swimming executive director Chuck Wielgus said Phelps’ actions required “significant consequences.” “Michael has publicly acknowledged the impact of his decisions, his accountability especially due to his stature in the sport and the steps necessary for selfimprovement,” Wielgus said.
“We endorse and are here to fully support his personal development actions.” The discipline meted out, which includes forfeiture of Phelps’ funding from the federation for six months, is based on US Swimming rules that prohibit conduct “detrimental to the image or reputation” of US Swimming or the sport. Di Matteo named Schalke boss Roberto Di Matteo has been appointed Schalke manager after the Bundesliga strugglers sacked Jens Keller following a torrid start to the season. The Italian, who won the Champions League as boss with Chelsea in 2012, has been without a club since
he was sacked by the club in November of the same year. Di Matteo, who was replaced at Stamford Bridge by Rafa Benitez, was still being paid Sh18.9million a-week by the Blues until June 2014. He has signed a three-year deal with the Royal Blues in Germany.

Italian football president banned for racism The president of the Italian football federation (FIGC), Carlo Tavecchio, has been banned for six months by European football governing body UEFA for making racist remarks. The 71-year-old caused controversy during his election campaign in July by referring to “eating bananas” when discussing foreign players though he later apologised. The ban means Tavecchio cannot hold any UEFA position and will be barred from the next congress in March 2015. He will be unable to carry out his duties as a member of UEFA’s Youth and Amateur Football Committee and has also been told by the governing body to “organise a special event in Italy aimed at increasing awareness against racism.” However, Tavecchio will continue as head of the FIGC after the federation’s internal
