Be warned: An insulting SMS will land you in jail Sharon Mazini, a 25-year old student, found herself in trouble this year with the law. In what she terms as an “unexpected circumstance,” she was arguing with a former ex-boyfriend through SMS when, in a burst of anger, she told him he looks like a witch doctor. “Once I told him that, he did not reply and I thought I had won the argument,” she says. “He was so offended that he reported me to the police,” she says. The Kenya Communication and
Information Act 1998 Section 29 (a) stipulates that anyone who sends a message that is grossly offensive or of indecent, obscene or menacing nature will be charged in court. If someone sends a message that they know to be false for the purpose of causing annoyance, inconvenience or needless anxiety to another person will be liable on conviction to a fine up to Sh50, 000 or three months in prison or both.
