Online posts might jail you From Page 1

The media monitoring agency said bloggers John Mutuku, Abdul Majid Mohammed, Joseph Mwangi, Wycliffe Ojijo, Tony Lijodi, Esther Wanjala and Simon Mbugua have been engaging in hate speech.

The National Cohesion and Integration Act 2008 defines hate speech as using threatening, abusive, insulting utterances to stir up ethnic hatred against individuals or certain races or people.

Kyalo Mwengi, the Assistant Director in charge of Complaints, Legal and Enforcement Department said

the offence attracts a maximum five year jail term and fines.

Hate speech that amounts to inciting violence attracts a penalty of five years jail without option of a fine.

Those who stir ethnic hatred face a three year jail term or Sh1 million fine or both.

And while media monitoring has raised alarm bells over rising cases of hate speech on social media platforms, the commission has just investigated six cases which are in court, among them one against former Embakasi MP Ferdinand Waititu.

Mwengi says they face numerous challenges in carrying out their mandate as people use pseudonyms on Facebook. “People use different names on Facebook and this makes it harder to track them down,” he says. Initially, politicians who use rally podiums to whip up emotions were the targets but the vice has shifted to the media.

“Hate speech has moved from political rallies to social media with people posting online under various pseudonyms,” added Mwengi.

But the media monitoring agency says it has engaged Facebook

administrators for identification of the perpetrators of hate speech who will be prosecuted. While Kenyans enjoy the freedom of speech, the freedom is not absolute and must not infringe on the rights of others.

Youth who form the majority of social media platform users may not be aware of the penalties.

The Media Monitoring Committee has, however, issued guidelines for bloggers and has urged them to confirm the veracity of the content before going online in conformity with the NCIC Act and Sexual Offences Act.

Hate speech in Kenya is a criminal offence punishable by law. The enactment of the National Cohesion and Integration Commission Act in December 2008 prompted prosecution of perpetrators for their utterances.

Steven Ayieko of Opinion Yetu, a site that was used to track the opinions of people during the March 4, 2003 elections, said people have resorted to sarcastic hate speech to avoid the NCIC dragnet. “People should direct energies elsewhere instead of posting hate speech on social media,” said Ayieko.

Tanzanian witchdoctor jailed for conning woman of Sh9m A Tanzanian witchdoctor was yesterday jailed for three years for conning a businesswoman of Sh9million pretending that he could double the money.

Mr Amos Chipeta was also sentenced for an additional

three months for being in possession of witchcraft paraphernalia including bottles, knives and a cat’s skin.

He was sentenced alongside Mr Peter Christopher, who was also convicted for being

in possession of charms used in witchcraft.

Mr Chipeta was accused of obtaining the money from Ms Catherine Njeri on diverse dates between August and December 2012 after she approached them to double it.

The prosecutor said she was promised that her money would multiply to Sh50million after three months before quadrupling in six months. The witchdoctors also promised Njeri that they would use magic powers to

enable her become rich.

They claimed in their defence that the woman approached them to bestow her with power to be able to defeat her political opponents.

Police later raided their premises and found the

charms on February 1, 2014 in a rented house along Juja Road in Nairobi.

Senior principal magistrate Lucy Mbugua said the men played on the gullibility of the woman to steal her money and were not remorseful.

Toxic hippo dung threatening fish in the Mara river, scientists say Hippos in the Mara River may be posing a threat to the country’s fish supply due to their toxic faeces, scientists have said. Researchers from US-based Yale University and the Cary Institute of Ecosystem Studies, who have been studying the Mara water since 2008, say that hippo dung may be affecting water quality and threatening the fish population.

“Hippo pools are virtual cesspools in the Mara River, with each animal producing an estimated 22 pounds (9kg) of dung each day,” said the researchers.

To study these large and dangerous animals, they

have deployed small boats disguised to look like crocodiles.

When the Mara River is running high, hippo dung washes downstream.

However, when it is running low, the dung settles at the bottom of the pools, attracting bacteria and threatening the fish habitat, the scientists said.

They think that the bacteria uses up a great deal of oxygen, killing fish in the process.

The researchers estimate that about 4,000 hippos live and defecate in the river.

24hr alcoblow test plan The government could soon extend the administering of the alcoblow sobriety tests on the roads to 24 hours.

National Transport and Safety Authority (NTSA) chairman Lee Kinyanjui says this is to deter drinking and driving during the day especially by Public Service Vehicle (PSV) drivers now drinking and driving during the day.

Mr Ranguma, who is the chairman for Health and

Bio-Technology sub-committee of the governor’s council, said growing economies have adopted GMO products and it is time Kenyans followed suit.

“Growing economies are using biotechnology and their lifespans are far above ours,” he told a stakeholders’ forum at Nairobi hotel.

His sentiments were echoed by millers who called for a review of the ban to mitigate the ongoing shortage of maize.

Cereal Millers Association chairman Diamond Lalji said even the maize the gov-

ernment plans to import to plug the deficit may still be genetically produced. “We are importing from Uganda and Tanzania and their supply is inefficient. The only other countries with non-GM maize are Malawi and South Africa,” Lalji said.

The government banned GM products in 2012 and formed a taskforce to advise on their safety.

The National Biosafety Authority is expected to present the report to the cabinet next week before the government can approve importation of GM crops.

Residents against City redesign of Eastlands Residents of the Eastlands estates earmarked for demolition are up in arms against the county government project, which is part of the city’s Integrated Urban Development Master Plan.

They have threatened to stop the demolitions because they were not consulted on the planned regeneration of the area.

(Kera) Chairman Ezra Olack said they were left out of any talks and only learnt about the plans through the media.

“We were not involved and our opinions were not sought yet we represent over 15,000 residents who will be affected,” he said.

He said the association will go to court to challenge the implementation of the project.

Medics warn against using Wikipedia for self-diagnosis Scientists have cautioned against Wikipedia, saying its facts are 90 per cent wrong.

A study by US scientists say nine out of 10 health entries on the site contain errors.

Wikipedia, the sixth most popular site on the internet, can be edited by anyone and it is this open-access nature that has raised concern among doctors about its reliability.

The scientists compared entries about conditions such as heart disease, lung cancer, depression and diabetes with peer-reviewed medical research, and said that most articles in Wikipedia contained many errors and that patients should not use it as a primary resource.

They also analysed online articles for 10 other conditions such as osteoarthritis, back problems and asthma and discovered that 90 per cent of the entries made statements that contradicted with the latest medical research.

Dr Robert Hasty, the lead researcher of the study said: “While Wikipedia is a convenient tool for conducting research, from a public health standpoint patients should not use it as a primary resource. The best resource for people worried about their health is their doctor.”

James Heilman, president at Wiki Project Med Foundation disagreed with the findings saying that the study is not supported by the data provided.

He also expressed concern at the small sample size used in the research saying that it may not be representative.

The study was published in the Journal of the American Osteopathic Association.

Ex marketer wins Sh2m fertiliser grant A local entrepreneur has won a Sh2.2 million funding for an organic fertiliser project. Marion Atieno Moon, through her company, Wanda Organic, has won the funding from Acumen Fund East Africa, a program that finances ground-breaking projects in the region.

The business graduate, quit her job a marketer to do business and has come up with innovative ways to make organic fertilizer.

She received the funding under the 2013 ‘Innovation’ initiative.

Together with 20 other young people, Moon has been part of Acumen’s Sh25 million training program.

citymarkets Night travel ban ruins Muthurwa grocers’ business The ongoing tussle between the Ministry of Transport and the High Court over banning night travel has affected businesses of grocers at the Muthurwa market Judy Okemwa, a vegetable seller told XNews that most of the vendors rely on night buses to get their orders from farmers, but since the ban came into effect, they are incurring losses because most of the produce, which is perishable, is not fresh by the time they receive it.

“Since I started the business, I have been ordering my stock from my rural home where it has been ferried overnight and it reaches me here very early in the morning,” said Okemwa.

“It used to be fresh as opposed to nowadays where it arrives late in the day where about half of the stock has already gone bad,” said Mrs Okemwa.

The story is the same for Felix Mwangi, who sells onions in the market. He says since the ban, he has been struggling to maintain his business. He used to receive his stock at 3 am and sell it immediately to hotels and eateries.

She has since delved into the fertiliz-

er business, providing affordable and environmentally friendly compost to smallholder farmers at a time when a lack of supply is causing dwindling yields.

Moon says her clients are big horticultural companies since the cost of bio-organic fertilizer is too costly for smallholders.

“Currently, a 50-kilogram bag of bio-organic fertilizer cost Sh3, 400, but the price will reduce by half once this technology is deployed at the smallholder level,” Moon explains.

She plans to open several factories in rural Kenya in 2015. These facilities will help small scale farmers to access affordable organic fertilizer.

Sh50m lab set up to improve cotton production

Small business owners who do not register their enterprises are missing out on a many opportunities, the Institute of Economic Affairs (IEA) has said.

The law requires businesses are required to register for a trading license from the county council.

They should also register for turnover tax if they make less than Sh5 million a year. In Nairobi at least 51 per cent of businesses fall under this bracket, making up to Sh120, 000 a year (less than Sh10, 000 a month).

The IEA, however, notes that most small business owners in Nairobi have registered only for the trading license, which costs about Sh1,000, and not the turnover tax, which has left them as informal enterprises. “Being registered implies paying taxes, which is a burden on business operators,” says David Owiro, an officer for the Institute of Economic Affairs.

He says that registration for tax purposes has benefits such as accessing formal markets.

“Moreover, registration acts as insurance against the risk of business suspension by government agencies and inspectors,” says Owiro.

This is a benefit most businesses could use since, in Nairobi, 52 per cent of the small businesses have employees.

Cotton farmers and textile industry players are set to benefit from a Sh50 million cotton laboratory.

The Cotton Development Authority says the lab will be used to ensure that Kenya’s supply meets international standards.

The CDA says this will revive the textile sector, which has been stunted by poor yields and competion Kenya Agricultural Research Institute (KARI) says Kenya has the potential to produce over 2500 kg of cotton per hectare, way beyond the current 300Kg that small holders produce “With this lab, we can help guarantee the market quality and pay our farmers premium rates,” acting CEO of the Cotton Development Authority, Antony Gikandi, said The sector produced cotton worth Sh702 million last year though KARI notes that it can do up to Sh1.4 billion or more.

Strategies by the government to revive the sector have seen the price of a kilo of cotton increase from Sh32 in 2010 to Sh65 in 2014.

The move follows an initiative by the government to revive two irrigation schemes (Bura and Hela) as it moves to increase local cotton production.

FAFA Gala night on at The Oval

The Festival for African Fashion and Arts (FAFA) gala night is on tomorrow at The Oval in Westlands Nairobi from 6pm.

FAFA is an organisation that seeks to promote peace by bridging gaps through fashion. Proceeds from this annual event dubbed Fashion for Peace, which was started in 2008 during the post-election violence, are donated to people affected by conflict.

Serena bitter after Grand Slam ouster Defending champion and world number one Serena Williams was bitter after her shock second worst Grand Slam defeat going out of the French Open in the second round.

Spain’s Garbine Muguruza managed 6-2, 6-2 win over the top seed on Wednesday. Serena’s defeat came an hour after sister Venus went out 2-6, 6-3, 6-4 to Slovak teenager Anna Schmiedlova. Venus match in the third round was eagerly anticipated.

It was the earliest exit for a defending champion at Roland Garros since 2005 when Anastasia Myskina of Russia went out in the first round.

With Li Na losing in the first round on Tuesday, Serena’s defeat marks the first time in the Open Era that the top two seeds

had failed to get to the third round at a major.

Wednesday’s defeat was Serena’s worst at a Grand Slam in terms of games won and was only the second time she had been beaten at a major in the round of 64.

The last time that happened was on her debut at the 1998 Australian Open.

“Nothing worked today,” said 17-time major winner Serena who hit just eight winners and a huge 29 unforced errors with five double faults.

“I just couldn’t serve. But you can’t be on form every day. I hate to be off at a Grand Slam but it happens. It’s not the end of the world.

Brazil trains with Brazuca for the first time Neymar could soon have the world at his feet if he inspires Brazil to glory on home turf.

The Barcelona star got a taste of the ball he hopes to win the World Cup with during training at Brazil’s training base on Thursday.

Chelsea’s Oscar and former team-mate David Luiz were among the players who used the Brazuca ball in training alongside Neymar as the squad were assembled on the pitch for the first time since joining up for the World Cup. Goalkeeper Julio Cesar has backed the official World Cup ball, playing down possible worries over the performance of the adidas-made Brazuca.

“The ball is a good one, we had contact with it today,” the former Inter Milan and Queens Park Rangers player said of the Brazuca.

“I think the outfield players are going to like it too,” he added.

He and other players criticised the Jabulani ball, which was used in the South Africa World Cup. That ball, he said, was too light and moved about in the air. “It was ‘terrible, horrible, like a ball you buy in the supermarket,” he added.

Julio Cesar had a miserable campaign at the 2010 finals where his mistake contributed to Brazil’s elimination by the Netherlands at the quarter-final stage.

he World Cup is kind to some, and cruel to others. Zico was one of Brazil’s outstanding players in those years of frustration between 1970 and 1994 when the game’s biggest trophy eluded them. Zico, a working-class hero, a skinny kid from Rio’s poor suburbs who was on a mission. But his prodigious work ethic - first on the training field, last off it - was never quite enough to land the World Cup. Indeed, in his last chance at the trophy, in 1986, he may

have proved too eager for his own good. He had suffered a serious knee injury and asked the coach not to take him to Mexico, because he thought he wasn’t going to be fit enough. He was talked out of it, and worked around the clock to be fit.

“I had to do lots of exercises. I couldn’t train with my teammates and I trained separately on a machine to build up my muscles.” He was only fit enough to make second-half substitute appearances but when he came on against

France in the quarter-final his pass instantly split the opposition defence and led to a penalty to Brazil. He stepped up to take it but says: “I wasn’t in the same rhythm as the other players, which maybe contributed to the fact that I hit it differently from usual, and their keeper Joel Bats made the save. “But if I hadn’t taken it then it would have been Socrates. When the match went to a shootout, he missed, and I scored.” Brazil lost and Zico’s last chance as a player at the World Cup

had gone. His first shot at the trophy had come eight years earlier, in Argentina. OUT: Harmburg striker Rafael van der Vaart is out of the Dutch team for the World Cup due to Injury.

Netherlands star Rafael van der Vaart has been ruled out of the World Cup after suffering a calf injury.

The Hamburg midfielder had been named in Louis van Gaal’s 30-man preliminary squad but will not make the final 23 after suffering

a setback during training in Portugal on Wednesday. A statement from the team read: “Rafael van der Vaart will miss the World Cup in Brazil. The Oranje international has strained a calf muscle in his right leg and coach Louis van Gaal has therefore decided not to include him in his final selection.” Van der Vaart, who has won 109 caps for his country, was

a key part of the Netherlands side that finished as runners-up to Spain in the last World Cup but has had to contend with fitness troubles and a loss of form in recent months as Hamburg battled to avoid relegation from the Bundesliga. The Dutch are already without midfielder Kevin Strootman face Spain, Chile and Australia in Group B this summer.

Kenyan up against on-song Rupp in Prefontaine Classic

A strong team of Kenyan runners will be out to oust home favourite Galen Rupp in Friday night’s Prefontaine Classic, the third of the 2014 IAAF Diamond League meetings Rupp has set two national records this year, and with good conditions, he is likely to lower his US 10,000m best of 26:48.00.

Rupp, a 27-year-old native of Portland, has asked for a fast pace on track where he has won at high school, collegiate, and professional level.

In January, he ran away from the fields over shorter distances to set US indoor records at two miles (8:07.41) and

5000m (13:01.26).

Rupp will race against a world-class field that includes Kenya’s 23-year-old Paul Tanui, the bronze medallist from last year’s IAAF World Championships in Moscow.

Tanui also won silver at the 2011 IAAF World Cross Country Championships and set a personal best of 26:50.63 over 25 laps of the track at the 2011 Pre Classic.

Bedan Karoki is another 23-year-old Kenyan with great Pre Classic memories. He finished third in the 10,000m at the 2012 meeting, which also served as the Kenyan Olympic Trials for the

year. Karoki finished fifth in London and sixth at Moscow 2013.

Karoki returns to the track after two impressive half marathon wins in recent months. Kenneth Kipkemoi and Emmanuel Bett are two more world-class Kenyans in the field.

Kipkemoi, 29, is a sub-27-minute runner who made the Moscow 2013 final after carrying the 2012 African Championships race. Bett, also 29, won at the 2012 IAAF Diamond League finals in Brussels in what remains his personal best of 26:51.16.

He was the fastest man in the world over the distance that year.

In 2012, with Manuel behind the wheel, the Tick finished 17th out of 65 after covering a over 60 km and crossing 13 of the 14 checkpoints.

Being one of the smallest, less-fancied cars, this earned the team the best new entrants’ prize. At the race held at Il Ngwesi in Laikipia, Terry Child covered 47.678km to win the title.

Last year, the team dropped to position 40 out of 65 in Ol Doinyo Nyoike after their car rolled thrice.

But despite the drama, Team 53 completed 12 of the 14 checkpoints after covering over 28 km.

Keeper Fabianski joins Swansea on free transfer Swansea City have signed goalkeeper Lukasz Fabianski from Arsenal after the keeper’s contracts with the London club ran out.

The 29-year-old Poland international will join the Swans on a free transfer, when his contract with the Gunners expires at the end of June.

Fabianski’s last game for Arsenal will prove to be the FA Cup win over Hull City, bringing a sevenyear spell with the club to a close.

“The main reason I came to Swansea was because I want to be the number one goalkeeper,” he said.

over the future of first-choice keeper Michel Vorm who has been linked with a move to Liverpool.

Vorm has been Swansea’s firstchoice keeper since joining in 2011, but has been heavily linked with a move to Liverpool.

Harambee Stars take on Comoros at Mitsamihuli International Stadium in Moroni this afternoon aiming to advance to the second round of the 2015 Africa Cup of Nations qualifiers.
