ubilee Coalition legislators have declared their support for Gatundu South MP Moses Kuria after the International Criminal Court investigators moved to question him following his admission that he was involved in fixing Deputy President William Ruto at The Hague based court.
ICC investigators have already contacted Kuria stating that they would want to meet him over the claims in order to establish whether they are accurate. The MP yesterday said he welcomes the ICC’s move and is ready to meet the investigators next week at Parliament buildings. At the same time, his colleagues in the Jubilee coalition threw

Nyachae reads malice in MPs’ refusal to extend CIC team term
Our tough stance against MPs’ attempts increase their salaries in 2013 could be the reason why the legislators declined to extend our terms, the Commission for the Implementation of the Constitution (CIC) chairman Charles Nyachae has said. Speaking when he appeared before Senate Committee on Legal Affairs, Nyachae also said the position taken by the commission on CDF in which they backed a court order declaring it unconstitutional has seen the bad blood between his team and the MPs. He, however, maintained he will call it quits when his terms end and will leave it to Parliament to appoint someone else to steer the commission to the end. “I will call it quit when my term ends and leave it to Parliament to appoint someone else to steer the commission to the end,” said Nyachae. Early last month, Nyachae termed the current law anchoring the Constituency Development Fund (CDF) as unconstitutional a position that was upheld by the High Court. Nyachae who was accompanied by his deputy Elizabeth Muli blamed the National Assembly
for using the extension debate to settle their differences with the commission for its stand on CDF and MPs’ salaries. He suggested that a committee be formed to amend the Constitution to create an avenue for seamless handover. In a separate statement on Wednesday, CIC in a statement, claimed the debate on the extension of the commission’s term in the National Assembly was personalised, actuated by vendetta and is not issue-based. “After having been given the privilege of serving Kenya in this critical season on this critical matter, we are concerned that the gains that have been achieved in the implementation of the Constitution stand the risk of being sacrificed on the altar of political, personal and other considerations,” read part of the statement. CIC term is expected to end on December 29, this year even as the National Assembly ponders on whether to extend its tenure by one year or not. Although Nyachae proposed to the committee for the extension of the commission’s term and subsequently to ensure seamless implementation of the Constitution to its end, he said he does not want to continue serving as the chairman. According to him, lack of goodwill from the two levels of government has been a major hindrance in full implementation of the Constitution.
The Senate has already called for the extension of CIC’s term saying it will not be possible to make laws required by the constitution without the commission. “The National Assembly has extended the time for enactment of the remaining Bills by a year. There is therefore a need to extend the commission’s term by at least two years,” said Busia Senator Amos Wako who chairs the Senate Legal Affairs Committee.

Mugo wa Wairimu who is accused of sedating a female patient before sexually assaulting he on a hospital bed in Githurai has today been charged with rape. James Mugo alias Mugo wa Irimu was charged at the Milimani Law Courts where he denied that on November 1, 2015 at Prestige Healthcare clinic in Githurai 44, Nairobi, he raped a woman whose identity has been shielded for legal reasons. The woman will now and shall be referred to by the acronym ABC during the trial. Mugo was also charged with administering a sedative “with intent” contrary to section 27 (1) of the sexual offences act. The prosecution said that on the same day, he administered four tablets of unknown drug on the woman with intention of overpowering her so as to engage in sexual activity. The “medic” faces further multiple counts of carrying out a business as
a pharmacist without due registration and operating an illegal clinic. He was also charged with stocking and using unvalidated laboratory agents at the said clinic. Mugo was also charged with employing an unregistered laboratory technician at his premise, an offence the prosecution says he committed on September 18, jointly with others who were not before the court. The prosecution asked the court to deny the suspect bail so that he be detained until the case is heard and determine. His lawyer Cliff Ombeta objected the request. A ruling on the request will be made on Monday. “It is for the suspects own security that we ask this court not to grant bail,” Prosecutor Jacinta Nyamosi told trial magistrate Daniel Ochenja. She said the public wanted to lynch Mugo and releasing him on bail may endanger his life. “The respondent was aware that he was a
subject of investigation and instead chose to go into hiding,” the prosecutor said. She said the suspect may be tempted to flee in light of the serious offences that face him. Nyamosi said Mugo’s security cannot be guaranteed outside prison walls. “He is at risk knowing the public outrage following the events that led to the investigations,” she said. The prosecutor said that investigations have revealed that Mugo is a subject of multiple charges as reflected in the charge sheet she presented in court. “The charges as preferred against the respondent are serious in nature and are as a result of numerous complaints made by individuals and regulatory institutions,” she said. Mugu was allegedly caught on camera while raping a sedated patient. He has also been charged with masquerading as a gynecologist at his Githurai clinic where he offered free medical check-ups.

MPs wrestle Sh6 billion fund from governors’ control
A constitutional amendment seeking to place the Sh6 billion Equalization Fund under the management of the constituencies has now been referred to the Senate. This is after 246 Members of the National Assembly voted in support of the Bill sponsored by the Samburu West MP Lati Lelelit. Only two MPs of the 248 present in the Chamber voted against it. “The Ayes have it and therefore
the Bill will now be read a third time and thereafter referred to the Senate for consideration,” House Speaker Muturi said after announcing the results of the vote. MPs from marginalised areas celebrated, as this means they and not their respective Governors will have a say on which projects will get priority. Before MPs went on recess in August, the amendments were defeated as they were supported by 216 MPs out of
the 233 (two thirds of all MPs) required. Muturi said he had allowed extra time for voting on the Bills in view of the fact that members have just returned from recess. The fund was established under Article 204 of the Constitution to assist marginalised areas attain the same level of development as the rest of the country. The money, equivalent to 0.5 percent of total national
revenue, is kept by the Treasury and remitted to areas targeted for intervention as determined by the Commission for Revenue Allocation (CRA). The intervention targets basic services including water, roads, health facilities and electricity. The fund is a 20-year programme that will be wound up on August 27, 2030. CRA has allocated Sh3.4 billion to 14 counties for the next three years after which a review will be done.

Teachers mull options as court orders end of strike Details have emerged of a meeting between a leading labour unionists and officials of the Kenya National Union of Teachers (Knut) during which the latter was advised to take advantage of last week’s ruling and return to work. According to the source who wish not to be named, the union leader advised Knut top brass to call off the strike and take advantage of the court’s order for the formation a conciliatory committee to push for the teachers’ pay increase. It is understood the union leader, who is well versed with labour relation issues, said the last Friday’s ruling by Labour and Industrial Relations judge Nelson Abwodha was beneficial and practical for teachers in the salary dispute saga. The argument was that teachers obey the court order and let the conciliatory committee do its work on how best the 50-60 pay increase can be effected. “They were going to have the best chance next year to call for another strike and even put to task their employer Teachers Service Commission (TSC) over the court ruling,” said the source. Abwodha ordered teachers to suspend the ongoing strike

The Deputy Inspector General shall be a person who:
(a) is a Kenyan citizen; (b) holds a degree from a university recognized in Kenya or equivalent qualifications; (c) has had a distinguished career in their respective fields; (d) meets the requirements of Chapter six of the constitution; (e) has served the Police Service for at least fifteen years and has knowledge and experience in matters relating to any of the following disciplines:(i) criminal justice; (ii) policy development and implementation; (iii) finance and public administration; (iv) strategic management; (v) security; (vi) law; (vii) sociology; or (viii) Government. (f) is a serving police officer of or above the rank of Assistant Inspector General. NEWS BRIEFS Zimbabwe to ban electric water heaters Zimbabwe is to ban the use of electric water heaters and require all newly built properties to use solar power, as it tries to tackle big power shortages. Energy officials say existing electric heaters - or geysers - will be phased out over the next five years. They hope to save up to 400 megawatts of electricity - equivalent to the output of an electrical power plant. Blackouts have dogged Zimbabwe, despite the fact that 60% of the population have no access to electricity.
Burkina Faso coup leader ‘in custody’ Gen Gilbert Diendere - the leader of last month’s short-lived coup in Burkina Faso - is in the custody of the country’s security forces, sources say. Some reports suggest he earlier surrendered at an unnamed diplomatic mission in the capital Ouagadougou. Interim President Michel Kafando was reinstated last week after intervention from the army and West African leaders. The presidential guards’ unit that carried out the coup is to be disbanded.
South African King jailed for kidnap A South African king has been sentenced to 12 years in prison for a series of charges including kidnapping, assault and arson. Buyelekhaya Dalindyebo, from Nelson Mandela’s Thembu ethnic group, was jailed by the Supreme Court of Appeals. He had approached the SCA to overturn a 2009 court ruling on the matter, which had sentenced him to 15 years. The charges relate to a dispute he had with some of his subjects more than two decades ago.
Rwanda ‘training’ Burundi rebels Burundi has accused neighbouring Rwanda of training rebels seeking to destabilise the country. It is hosting Burundi’s failed coup leader, and helping rebels launch cross-border attacks, Foreign Minister Alain Nyamitwe said. Rwanda denies the allegation, and says Burundi is trying to deflect attention from its own problems. The two governments have a tense relationship, with both countries sharing a similar ethnic make-up.

Outrage as gunman singles out Christians in deadly US shooting The gunman who opened fire at Oregon’s Umpqua Community College singled out Christians, according to the father of a wounded student. Before going into spinal surgery, Anastasia Boylan told her father the gunman entered her classroom firing. “I’ve been waiting to do this for years,” the gunman told the professor teaching the class. He shot him point blank, Boylan recounted. Others were hit too, she told her family. Everyone in the classroom dropped to the ground. The gunman, while reloading his handgun, ordered the students to stand up and asked if they were Christians, Boylan told her family. “And they would stand up and he said, ‘Good, because you’re a Christian, you’re going to see
God in just about one second,’” Boylan’s father, Stacy, told CNN, relaying her account. “And then he shot and killed them.” Boylan, 18, was hit in the back by a bullet that traveled down her spine. While she lay bleeding on the floor, the gunman called out to her, “Hey you, blonde woman,” her mother said. She played dead -- and survived. The massacre on the Umpqua campus Thursday left 10 people dead and seven wounded. The gunman also died, although it’s unclear whether he was shot by police or committed suicide. Also unclear is whether his death is included in the count of 10 killed. Speaking to reporters Thursday night, Douglas County Sheriff John Hanlin refused to say who the shooter was. “I will not name the shooter,”
Hanlin said. “I will not give him the credit he probably sought.” Multiple law enforcement officials familiar with the investigation identified the gunman as Chris Harper Mercer, 26. One law enforcement official said the shooter had body armor with him and was heavily armed, with a large amount of ammunition -enough for a prolonged gunfight. Authorities recovered three pistols and one rifle at the scene, one official said. Authorities credited a quick response by law enforcement for keeping the death toll from climbing higher. News of the shooting quickly reverberated through Washington and the 2016 campaign trail. Democratic front-runner Hillary Clinton called for “sensible gun control measures,” while Republican presidential contender
Ben Carson said more gun control is not the answer. A visibly upset President Barack Obama, delivering the 15th statement of his presidency addressing gun violence, said these incidents are becoming all too regular. “Somehow this has become routine,” he said. “The reporting is routine. My response here at this podium ends up being routine, the conversation in the aftermath of it. We’ve become numb to this,” he said. “Our thoughts and prayers are not enough. It’s not enough. It does not capture the heartache and grief and anger that we should feel, and it does nothing to prevent this carnage from being inflicted someplace else in America -- next week, or a couple months from now.”
Five girls ‘bomb’ Nigerian city Five young girls were behind a series of deadly explosions in the north-eastern Nigerian city of Maiduguri on Thursday evening, security sources say. Fourteen people, including the girls, died and 39 were injured in the attacks at a mosque and house of vigilante leader, the military said. More than 100 people died in similar attacks in the city two weeks ago. Maiduguri is where Boko Haram Islamist
militants were first based when they began their insurgency six years ago. Some 17,000 people are said to have been killed in that time and attacks by the group have intensified since Muhammadu Buhari became president in May, vowing to defeat the insurgents. Correspondents say people were waiting for the last evening prayers when the suicide bombers struck the mosque. Officials fear that the number of those who
lost their lives is likely to rise, they add. Witnesses and security sources said some of the girls were as young as nine. The attacks in Maiduguri, the capital of Borno state, come as the military says it is winning the war against Boko Haram. The security forces have in recent months reclaimed territory captured by Boko Haram fighters and freed a number of people kidnapped by the militant group.

NIC bank new branches target SMEs
NIC Bank has opened a new branch in Industrial Area as part of its ambitious expansion plan to reach more customers and grow its Small and Medium-sized Enterprises (SME) business. The new Lunga Lunga branch, located in Square Mall, Industrial Area, is the first of two expected in the fourth quarter of 2015 to be opened in Nairobi. These will bring the total number of branches in Kenya to 27. The bank will also open two new branches in yet to be named counties early next year as part of its strategy to grow its footprint across the country. The move comes after the Central Bank of Kenya (CBK) announced that the banking sector is expected to remain stable and resilient in 2015.“We have a strategy to increase our footprint across the country and indeed the region, this is one of many branches in the pipeline. EMBU County now to focus on development, job creation

Governor Martin Nyaga Wambora said as the region’s government focuses on improving the living standards of its residents, his administration is also seeking to create employment opportunities in Embu. The county government has made major strides in terms of infrastructure development, starting with the rehabilitation of 273 roads and the completion of 8 bridges. He said the administration is setting up funds to not not only create jobs, but also support innovation and entrepreneurship. “We have facilitated the issuance of loans through a joint loan board
worth Sh9 million to more than 200 business men,” said the governor during a recent address. “We have conducted market needs assessment and mapping for all market in Embu County so as to come up with a comprehensive plan on their repairs, construction and upgrading,” he added. Wambora said his administration would work towards boosting agricultural production in the county. The sector currently provides employment to 85 per cent of Embu’s rural population. He has since promised to support the sector, adding that his administration is currently setting up a value chain for some of the region’s most financially-viable crops, including coffee, bananas, mangoes, passion fruits and macadamia nuts.

EAC gets Sh4.3bn grant for integration The Federal Republic of Germany has committed Sh4.3 billion to the East African Community as grant to support regional integration in East Africa. Sh1.2 billion of the grant will cater for establishment of a regional network of reference laboratory for communicable diseases whereas the same figure will be used for Integrated Water Resource Management of Lake Victoria. However, Sh1.9 billion was commissioned for technical
assistance to support the economic integration process including a contribution to the EAC partnership fund, a programme focussing on institutional strengthening of the EAC Secretariat as well as supporting the Customs Union, Common Market Protocols and Monetary Unions. Speaking during the negotiations, the EAC deputy Secretary General in charge of Finance and Administration Liberat Mfumukeko applauded Germany
for its support spanning for years since the re-establishment of the cooperation. “We have truly benefited from the support which has catalysed other development partners to support our projects and programmes’ said Mfumukeko. “Germany has given the EAC a permanent home by financing the construction of the new headquarters that today houses the Secretariat, the Court and the Assembly under one roof, easing the EAC Organs interactions and
communication’’, he added. Mfumukeko highlighted the success achieved through Germany support in the realisation of the fully-fledged Customs Unions, the Common Market and strategies towards the realisation of the Monetary Union in the succeeding programme. Head of the German delegation Georg Rademacher said their support underlines the importance they give to the East African Community.
Boost as East Africa ’s foreign investments rise
Africa has become a major business opportunity for overseas investors, according to ICAEW’s latest Economic Insight report. Where aid was the traditional source of finance, the continent has seen a dramatic fivefold increase in Foreign Direct Investment (FDI), with Nairobi topping the list as the most attractive destination. The report commissioned by the Institute of Chartered Accountants in England and Wales) (ICAEW) dubbed Africa Q3 2015 report and produced by the Centre for Economics and Business Research Limited (CEBR), provides a snapshot of the region’s economic performance focusing specifically on Kenya, Tanzania, Ethiopia, Nigeria, Ghana, Ivory Coast, South Africa and Angola. According to the report, drawing on estimates prepared by the World Bank, the total level of external financial inflows into Africa has increased from $40.4bn in 2000 to $192bn in 2013. This is largely attributed to the inward FDI from China with investment mainly going into primary resource sectors and infrastructure. “China has approached African economies in a very different way to Europe, focusing less on official aid and engaging more aggressively through foreign direct investment and trade. This has been a game changer for the development industry, forcing European countries to rethink their strategy of connecting with the continent,” said ICAEW, Middle East, Africa and South Asia regional director Michael Armstrong. This is partly attributed to closer regional integration in the East African Community (EAC), which has involved harmonising investment regulations across the region and reducing red tape. Despite this low level of investment overall, Nairobi still tops the list as Africa’s most attractive destination for FDI. This is
predominantly motivated by the fast-growing middle class that is setting the stage for a booming consumer market. Furthermore, in addition to a growing entertainment and media industry, Kenya is also emerging as a global leader in the financial services sector thanks to mobile money systems such as M-Pesa. ICAEW economic adviser and the report’s author Danae Kyriakopoulou said the economic development naturally varies across the continent, Africa’s regional outlook as a whole remains bright with a number of projects expected to bolster growth.

Orange mobile to exit Kenya amid stiff market competition
Orange SA, the French multi-national telecommunications corporation is in the last phase of its plan to sell its 70 per cent stake in its Kenya business. Treasury Cabinet Secretary Henry Rotich said yesterday the Telco is wrapping up talks with an unnamed buyer. He indicated that Orange “wants to exit so they are selling their 70 per cent.” “They are in final negotiations, Rotich, who oversees the government’s 30 per cent shareholding in Orange Kenya, told Reuters. Orange subscribers will likely retain their mobile phone numbers as new management takes over the operations the same way Airtel took over Yu Moblie’s 2.7 million subscribers during its exit last year. The firm is now the second international operator to quit Kenya, due to rigid competition from the other services providers such as Safaricom and Airtel.
Hackers steal info from 15 million mobile subscribers Hackers have stolen the personal information of about 15 million customers and applicants using the services of USbased telecommunications company, T-Mobile. The hackers managed to access the names, birth dates and social security numbers of the mobile service provider’s clients The breach took place at a unit of Experian, a credit agency Experian which T-Mobile uses to process information on its subscribers. “Obviously, I am incredibly angry about this data breach,” T-Mobile chief executive John Legere said. He said the company would review its link with Experian. “I take our customer and prospective customer privacy very seriously. This is no small issue for us,” he said in a statement issued just hours ago. He told customers that neither T-Mobile’s systems nor network were part of the intrusion and the breach did not involve any payment card numbers or bank account information.

ho is the new Abbi? Where have you been? I am the new Abbi, actually, just another me at another time, though essentially myself at the core. I have been living, loving and being. I guess everybody needs a break from the daily hustle and bustle. While taking my break, I enjoyed many other aspects of myself….I enjoyed travel and a bit of writing…I guess the creative streak is ever nearby. What prompted the rebranding and the new look you? I am as I am now…and hopefully so, every other moment. As such, nothing particular prompted it… as life must already be in motion always. I guess, every new moment is as magically new as allowed to become. I am my ‘Abbinewness’…ha ha…and I love it!!!! You just released Ninasi, tell us about the song and the video? What inspired it? Love! The greatest force there is, as they say it, is behind the song´s inspiration…The song is a celebration of passion, love and attention to that delicate part of man within….for Love is the strength and weakness we balance on the scales… Who is Vqee and how did you land on her as a collaboration partner? VQEE is my friend and sister… She is a wonderful Kenyan singer based in Denmark. As a person, we share many interesting things…like passion for the arts. She was central to introducing me to my producer; a funny and talented Danish guy, Claus Seest who happens to be her husband. So, Vqee is my family. What is your connection with
Fluffy studios and why did you chose them for the Ninasi project? Fluffy studios is blood and bone… soul and spirit… A production house between Claus Seest and myself. I guess fluffy was meant to be from the very beginning… I love the vibe there. Should we expect your sound to change now that you don a new look? I understand the question…yet, art, or, expression, is at times beyond the thinker, and is simply open to the receiver. I am happy taking this journey with Claus at the Fluffy space, and shall allow the inspiration to flow freely….Should my sound change? Well, newness is one of my habits. What inspired the concept for the Ninasi video? A few things compounded into the final beauty of the song. Vqee and I as artists very happily sang our song. Claus Seest as producer composed the music and Kibby, CEO-Son Of A Beat, teamed up with Claus on the video shooting and editing. They are a great duo together. What else are you currently working on and with whom? I am happily focusing on my new album…and working closely through it with Claus Seest, as a Fluffy Studios production. Well, I am also enjoying writing and gaining a lot of interest in film. Musically, what should your fans expect from you? Good and refreshing new vibes…I am happy to let it flow as it comes. Kenya drops 15 places in latest Fifa rankings Harambee Stars are six places shy of breaking the country’s worst ever placement in the Fifa world ranking after they dropped 15 places down in the latest ranking. The standards of football in Kenya is only better than 78 of the 209 Fifa member nations worldwide after they moved further down to 131 place, six places shy of a record 137 placement posted in 2007. In Africa, Kenya is placed 40th, placing Sam Nyamweya lead federation and his ever disappointing Harambee Stars only above 14 of the 54 Confederation of Africa Football (CAF) member nations. Stars also dropped five places in the continental rankings from last month to position 116 and with the national football elections coming up and a trip to Mauritius next week for the 2018 Fifa World Cup qualifier match, things are
not rosy for a side that has starved local fans match victories. According to the latest standing and any slip up against Mauritius will surely see them hit the mark. The team was expected to report for residential training on today at the Kasarani Stadium to begin preparation for their Mauritius clash.
