eru Women’s Rep Florence Kajuju, Mbita MP Millie Odhiambo and Turkana County’s Joyce Emanikor have been named among the top performing female MPs in the 11th Parliament. A report by Mzalendo Trust titled “Debunking Myths: Women Contributions in Kenya’s 11th Parliament”, has also named Deputy Speaker and Sotik MP Joyce Laboso, Kitui South MP Rachael Nyama and Zainab Chidzuga (Kwale Couty) as the other top performers. Nominated MP Amina Abdalla also stood out in terms of performance while Senator Agnes Zani emerged top among her 18 nominated colleagues in the Senate. There are a total of 86 female law
makers in both Houses representing 21 per cent of members. But the MPs have been accused of making little contribution to debates. Early this year, National Assembly Speaker Justin Muturi proposed that the women’s representatives be done away with as one way of reducing overrepresentation in Parliament and bringing down the wage bill. “Despite the introduction of the two-thirds gender rule, women parliamentarians continue to be subjected to stereotypes, sexism and accusations of incompetence,” says Mzalendo Trust, prompting the move to analyse the contributions made by each female MP in the August House. Tunisia mediators beat Merkel and Pope to the Nobel Peace Prize The Tunisian National Dialogue Quartet has been awarded the Nobel Peace Prize for its role in helping the country’s transition to democracy. Announcing the prize, the chairman of the Nobel committee said the group had made a “decisive contribution to the building of a pluralistic democracy” after the 2011 revolution. They were among some 273 contenders for the prestigious prize. German chancellor Angela Merkel and Pope Francis were among those tipped. The Tunisian quartet was made up of four organisations: the Tunisian General Labour Union, the Tunisian Confederation of Industry, Trade and Handicrafts, the Tunisian Human Rights League, and the Tunisian Order of Lawyers. It was created in 2013 “when the democratisation process was in danger of collapsing as a result of political and
assassinations and widespread social unrest,” said Nobel committee chairman Kaci Kullmann Five. “It established an alternative, peaceful political process at a time when the country was on the brink of civil war,” she said. “It was thus instrumental in enabling Tunisia, in the space of a few years, to establish a constitutional system of government guaranteeing fundamental rights for the entire population, irrespective of gender, political conviction or religious belief.” She said the Nobel committee hoped that the prize would “contribute towards safeguarding democracy in Tunisia and be an inspiration to all those who seek to promote peace and democracy in the Middle East, North Africa and the rest of the world”. In the coast region, Chidzuga was hailed for being vocal on the Standard Gauge Railway project and land issues. In south eastern region, Nyamai emerged as the best performer having sponsored four bills on health-related issues. She was also found to have contributed immensely to the mining bill. Laboso stood out in the North Rift region being a key figure not just because of her immense contributions, but also because she is the first woman deputy speaker in Kenya’s Parliament, the report said. Nairobi MCAs’ lead in money gobbled up in allowances The latest Controller of Budget report has revealed that Nairobi Ward Reps consumed the highest amount of money in sitting allowances. The report indicates that the county spent Sh151.52 million on sitting allowances of the 128 MCAs, representing an absorption rate of 78.9 per cent of the annual MCA sitting allowance budget, an increase from Sh2.5 million spent in the 2013/14 financial year. The report indicates that the average monthly sitting allowance per MCA was Sh97, 994. The County’s total expenditure on domestic and foreign travel was Sh340.52 million compared to Sh134 million in the 2013/14 financial year, representing an increase of 253 per cent. The expenditure comprised of Sh135.00 million by the County Executive and Sh205.52 million by the Assembly. The Public Works and Infrastructure department had the highest expenditure of Sh1.16 billion, out of which Sh217.12 million was spent
on construction of access roads. The rest of the money Sh78.28 million was spent on routine maintenance of roads and Sh87.42 million was spent on installation of public lighting and street lighting. The second highest expenditure of Sh560.38 million was incurred by the Health department, out of which Sh260.00 million was used to rehabilitate various health centres in the county, Sh182.71 million went to the renovation of Pumwani Maternity Hospital kitchen and dining Hall. The report indicates that in the period under review, the county made progress to address challenges that affected budget implementation. There was improvement in local revenue collection by 11.65 per cent from Sh10.03 billion in the 2013/14 financial year to Sh11.5 billion in 2014/15. The county has, however, persistently utilised locally collected revenue at source contrary to Article 207 of the Constitution.

Court now summons Muthama A Nairobi court has today issued summons requiring Machakos Senator Johnstone Muthama to answer to charges of incitement and disobedience of the law. Chief Magistrate Daniel Ogembo issued the summons barely 24 hours after the senator failed to secure an order to bar his prosecution. The issuance followed an application by senior deputy director of public prosecutions Leornard Maingi. He said said activist Japheth Muroko alias Japhet Thuranira will face charges alongside the senator. “The DPP had made the decision to charge the two after receiving evidence linking them to incitement” Maingi told the court. The charge against the senator is that on September 23 at Uhuru Park, Nairobi, he uttered words in Swahili that have been translated as: From Friday neex week if teachers will have not
been paid nobody will go to work and whoever goes shall be stoned, “indicating that it was desirable to bring death and physical injury to person in Kenya.” Muroko faces a similar charge whose particulars have also been translated from Swahili to mean “we are saying, the motion being brought to impeach Uhuru, any member of Parliament who votes against it will be lynched.” The offence, according to the prosecution was committed on September 23 at Uhuru Park, Nairobi. Muthama and Muroko are expected in court on October 15 to plead to the charges. Stop politicising land bill, Matiangi tells MPs Acting Lands Cabinet Secretary Fred Matiang’i has urged MPs to stop politicising the Physical and Spatial Planning Bill and Community Land Bill 2015. He told the legislators that instead of turning the bill into a political debate, they should provide ways of making it better. “We should be talking of ways of making the bill better by pointing out at sections which needs improvements,” said Matiang’i. The bill seeks to amend various Acts including the Land Act, Land Registration Act and National Land Commission (NLC) Act and the Physical Planning Act. It also seeks to collapse the proposed Evictions Draft Bill and Historical Land Injustices draft Bill law under the amendment
bill instead of stand-alone Acts as favoured by the NLC. “The reason why the bill is before the Mps is so that they can have an opportunity to identify key areas that needs improvement but not politicize the bill in its entirety,” Matiang’i said yesterday. NLC chairman Muhammad Swazuri has faulted the objective of the bill, saying it is a ploy to render the commission weak and prevent it from independently discharging its mandate. Governors have also voiced their opposition to the bill, saying it was drafted without the input of key stakeholders. Last month, Council of Governors chairman Peter Munya wrote to Matiang’i threatening to move to court to challenge the proposed laws.

Kenyans convicted abroad can now serve their terms at home Kenyans convicted of criminal offences abroad can breathe a sigh of a relief as they will now be able to serve their sentences back home, thanks to a new law. President Uhuru Kenyatta has signed into law the Transfer of Prisoners Act aimed at facilitating arrangements for the transfer of persons serving sentences of imprisonment for criminal offences committed in Kenya or countries outside Kenya. The purpose of this Act is to facilitate the transfer of prisoners between Kenya and countries which it has entered into agreements with, to enable prisoners serve out their sentences in the countries of their nationality or in countries with which they have community ties. According to the law, a prisoner may be transferred upon a request or application to the government of Kenya by the sentencing country or by through application by the Attorney General on behalf of the prisoner. The transfer can be effected upon application in writing to the Attorney General by the convict serving a sentence in a prison of a sentencing State, the AG shall communicate such application to the sentencing

enforcement in Kenya under this Act of a sentence of imprisonment imposed by a court of a sentencing country,” read part of the law While serving a sentence of imprisonment imposed by a sentencing country that is enforced under this Act, a prisoner who is transferred to Kenya under this Act may be detained in a prison, hospital
or any other place in Kenya. A prisoner shall be entitled to any remission or reduction of the sentence of imprisonment imposed by the transfer country for which the prisoner would be eligible in accordance with any applicable Kenya law if the sentence were a sentence of imprisonment for an offence against a law of Kenya.
Choppers hired in examinations preparations The Kenya National Examinations Council (Knec) has put in place measures to ensure national examinations are not affected by the El Nino rains expected to begin any time this week. Appearing before the National Assembly Education Committee yesterday, Knec senior deputy Secretary Ambia Noor said the council has hired helicopters to transport examination materials to affected exam centres to curb hitches. She said adequate personnel have also been dispatched to administer, invigilate and supervise the exams. “We have dispatched the advance instructions and all the examination stationery that are required for the administration of the examinations and the timetables and answer booklets – to be specific – are in the distribution centres as we speak. All the exams especially KCSE and KCPE have been printed packed and ready for dispatch,” she said. She also said measures have been put in place to curb any form of exam malpractice. “For exam malpractice, we have put several measures in place. First of all during the administration of exams with effect from October 12, we have 500 officers on the ground from different arms of government, mainly the Education ministry which are monitoring the exams real-time,”
she said. The main KCSE papers start next week, while KCPE will commence early next month. Education Cabinet Secretary Jacob Kaimenyi said 25,000 examiners have been engaged to administer the examination to students countrywide, after resisting pressure to postpone exams, due to the (now suspended) teachers’ strike. He warned that stern action will be taken against schools that do not register their candidates for national examinations, adding that the ministry is aware of schools that fail to register students, causing complications during the exam period. “If you are supposed to register
students and you fail, you will face the full force of the law. If the students are prepared for the exams, it is the institutions which should help them register therefore it is a crime if they do not do so,” he said. Noor also called on both students and parents to be vigilant and let the council know in the event of any registration delays and hitches. “Knec solely depends on the information we receive on the online data base and from county directors of education, sub-county education officers and school principals. If nobody tells us that their candidates were not registered, then the council would not

Meanwhile, the Teachers Service Commission (TSC) has indicated that it will permanently employ the relief teachers who had already started teaching before the end of the month long strike that paralysed learning in public schools countrywide. The commission’s chief executive Nancy Macharia said the teachers were fully qualified and would be absorbed into the teaching profession. She said the budget to be used to pay the teachers will not be affected by the return to work of the striking tutors. She indicated that the commission will liaise with its county directors to ensure no teacher is left out. “If there are people who have already gotten letters and most likely gone to school before the injunctions, then they can continue teaching in these schools because the budget is there for those people who have left due to natural attrition,” she said. China faces smoking death epidemic: Study
A new study has warned that a third of all men currently under the age of 20 in China will eventually die prematurely if they do not give up smoking. The research, published in The Lancet medical journal, says two-thirds of men in China now start to smoke before 20. Around half of those men will die from the habit, it concludes. The scientists conducted two nationwide studies, 15 years apart, covering hundreds of thousands of people. In 2010, around one million people in China died from tobacco usage. But researchers say that if current trends continue, that will double to two million people -mostly men- dying every year by 2030, making it a “growing epidemic of premature death”. The study was conducted by scientists from Oxford University, the Chinese Academy of Medical Sciences and the Chinese Center for Disease Control. But co-author Richard Peto said there was hope - if people can be persuaded to quit. “The key to avoid this huge wave of deaths is cessation, and if you are a young man, don’t start,” he said. While smoking rates have fallen in developed countries - to less than one in five in the US - they have risen in

people - about a quarter of the population said to be smokers. While more than half of Chinese men smoke, only 2.4 percent of Chinese women do. The average smoker in China smokes 22 cigarettes a day with the government collecting about 428bn yuan (£44bn, $67bn) in tobacco taxes a year.

India anger at Saudi arm chopping India’s foreign ministry has complained to the Saudi Arabian authorities following an alleged “brutal” attack on a 58-year-old Indian woman in Riyadh. Kasturi Munirathinam’s right arm was chopped off, allegedly by her employer, when she tried to escape from their house last week, reports say. Ms Munirathinam was working as a domestic help. She is recovering in hospital.Her family has alleged that she was being tortured by her Saudi employers. Saudi authorities have not commented on the incident yet. Indian Foreign Minister Sushma Swaraj wrote on Twitter: “This is unacceptable. We have taken this up with Saudi authorities. Our embassy is in touch with the victim.” “Chopping of hand of Indian lady - We are very much disturbed over the brutal manner in which Indian lady has been treated in Saudi Arabia,” Ms Swaraj added. The family of Ms

They are asking the government to secure them compensation from the family, and also help pay Ms Munirathinam’s medical expenses. “Ever since she went to work with this family in July, things were not alright. My mother was not even allowed to speak to us over the phone, she was not given proper food and was forced to work long hours,” her son S Kumar told BBC Hindi. “When she tried to escape the harassment and torture, her right arm was chopped off by the woman employer. Now my sister can’t even sit and do simple things on her own, as her spinal cord has also been injured,” her sister S Vijayakumari added.

Kenya, Ghana moot economic tie
Kenyan and Ghanaian officials are set to meet in November with the aim of opening new economic frontiers to boost development. President Uhuru Kenyatta and his Ghanaian counterpart John Dramani met earlier in the year and agreed on protocols regarding ICT, farming and tourism to establish a co-operation between the two countries, CNBC Africa reports. “We are not talking about small numbers despite the fact that a lot of these informal traders are small scale traders on an overall basis, we are still looking at very big numbers,’’ said Sarah Warren, Structured Trade Transactor at Rand Merchant Bant. Warren said there are regulations that are aiming to formalise the informal sector in the EAC to curb the movement of unprocessed goods across the value chain which does not benefit traders. “There are some clear benefits, they would increase tax revenues because often this kind of trade evades normal tax procedures,
also for security processes, tracing them back and moving them in the banking sector.” Brands and Beyond managing director James Ngomeli said there are a lot of opportunities in the intra-trade between the two countries. “Ghana is mainly an import country and Kenya has a lot of talent,” he said. African journalists to be feted at CNN Multichoice Awards Several outstanding African journalists will tomorrow line up for the 20th CNNMultichoice Awards in Nairobi. Five Kenyans have been selected as finalists in the prestigious event which is now in its 20th year. “Personally, it is fulfilling that an idea that we nurtured not to enrich ourselves, but to help human kind has
had such a profound impact for this long,” said Edward Boateng (pictured), Founder of the CNNMultichoice African Journalist Awards. CNN international executive VicePresident and managing director, Tony Maddox said this year’s competition received entries from 39 countries across the continent, including French and Portuguese speaking Africa.
“The quality and breadth of entries is a testament to the CNN MultiChoice African Journalist Awards’ position as the most prestigious recognition for journalism across the continent. I salute the finalists for the great work that they have done and look forward to seeing their future achievements,” he stated. Boateng says that the narrative of journalism in Africa has
changed from the 1990s, adding that new technology has transformed the landscape and the working tools are much improved. “There are fewer one party dictatorial states, journalists have more freedom to do their work and there is more legal protection; there is more private ownership of media and this has led to a more competitive industry,” he said.
VW boss offers ‘sincere apology’ to US Congress Volkswagen’s US boss has made a sincere apology for installing defeat devices to cheat emissions tests on its diesel cars. According to BBC, Michael Horn, chief executive of VW’s US operation admitted that VW has broken the trust of its customers, dealerships, employees as well as the public and the regulators. However, he said the decision to use the devices was not made by the company’s board, but by individuals. “My understanding is that it was a couple of software engineers who put these in,”
Mr. Horn said. Horn says that three people have been suspended following the scandal, but their identity are withheld for legal reasons. The executive was giving evidence before the House of Representatives Energy and Commerce committee Many of the committee members were sceptical. New York Congressman Chris Collins said: “VW is trying to get us to believe this is the work of a couple of rogue engineers. I don’t believe it.” At one point, Mr Horn himself said he found it hard to believe. “I agree it’s
very hard to believe. And personally I struggle to believe it as well.” VW will offer a financial package to American dealers to help them through the crisis, but expects it will take “one to two years minimum” to fix the US cars. “Let me be very clear: we at Volkswagen take full responsibility for our actions and we are working with all the relevant authorities in a co-operative way.” German prosecutors launched their investigation into the scandal last week after receiving about a dozen criminal complaints
from citizens and one from VW itself. However, Mr Horn said he was told about problems with VW’s diesel cars meeting US emissions tests after the publication of a study by West Virginia University. “I was informed that Environmental Protection Agency (EPA) regulations included various penalties for non-compliance with the emissions standards and that the agencies can conduct engineering tests which could include ‘defeat device’ testing or analysis,” he said.

ho is DJ Rillance? I am a deejay under Bugika Entertainment and has been in the scene professionally for 3 years. Why did you ditch the group ‘Kelele Takatifu’? I didn’t ditch ‘Kelele Takatifu’. I wanted to combine the many aspects of music hence choosing to become a DJ. Deejaying gives you freedom and the ability to sample diverse musical backgrounds. Take us through your career path. Sincerely it has not been easy. The dynamics of being a DJ in Kenya are quite hard considering the politics and stereotype that comes with it. I have loved music and played instruments. During my high school days, we formed a rap group by the name ‘Kelele Takatifu’. I started off as a DJ at my friends’ house parties using virtual DJ. More so, I watched deejay tutorials by the legendary DJ Angelo (UK) and learned to use the machines. While still in campus I was signed by Bugika Entertainment and as they say the rest is history; I say the rest is the future! What is your source of inspiration? Music, it has always been in me and one of my greatest sources of inspiration. Tell us about Bugika Entertainment and how you are affiliated? Bugika Entertainment is an agency that deals in brand promotions,
events and deejay management. I played as a warm up DJ for headliners during Bugika parties. The relationship and confidence in me grew bigger and I secured a place in the outfit. You are the official Tusker Malt DJ, how did you land this gig? Bugika entertainment pitched for the gig after a long relation with previous East African Breweries Limited (EABL) brands such as Guarana and Tusker lite that were a success. What are your roles as the official Tusker Malt DJ? I have to play at the Tusker Malt Gigs I am allocated and also Mcee about the drink and the promotions it has. I am also required to post on my social media platforms about the upcoming Tusker Malt gigs and push the hashtag #TheTasteofLegends and to embrace the drink and associate my brand with it. What has been the highlight of your career? The countrywide Tusker Malt promos have propelled me to greater heights not forgetting the Smirnoff and Tusker Lite events. Moreover, I have done international shows in Durban and Johannesburg South Africa. These too have helped me grow. Apart from the Tusker Malt gig, what else are you doing? MCSK officials in the dock for fraud Music Copyright Society of Kenya (MCSK) officials including the CEO Maurice Okoth were today arraigned in court over fraud allegations. The officials were arrested yesterday but released on bail. The chief executive officer Maurice Okoth together with others were accused of embezzling MCSK funds through a company that belongs to a close relative. Mr. Okoth was first accused of corruption by gospel artiste almost a year ago when it was discovered that MCSK was not remitting artiste’s dues fully and that Mr. Okoth had built a Sh. 60 million house for himself.

Company opens new honey market for local farmers A bee keeping company has urged local farmers to venture in apiculture to meet the global demand for honey. To cater for the shortage, Honey Care Africa, a Kenyan social business firm guides farmers on the set up process and provides a ready market for honey at impressive prices. “We have created a supply chain which links farmers from East Africa with honey buyers from international markets,” said Madison Ayer, Honey Care Africa’s CEO. However, bee farming is
cheaper since one only requires one square-metre of space, a langstroth hive and a government National Bee keeping Station which cost Sh4,000 only. On average, honey is harvested once a year, but in places with plenty of forage, bee-keepers can draw honey from their hives once every four months. The forage types that African bees prefer include banana, eucalyptus, coffee, orange and acacia. The beauty of the venture is that there is no wastage since other than
honey, which is considered to have medicinal value, the subsequent wax can be shaped into candles or purified to make petroleum jelly. The drained combs make briquettes, which provide fire for cooking. Honey produced in Africa makes its way to the United Arab Emirates (UAE) the world’s richest honey market, fetching around Sh2,000 per kilogramme, but the price could go up to Sh5,000 if the honey gets the Fairtrade and organic certifications.
Data from the United Nations Commodity Trade Statistics show that Kenya imports honey worth Sh23 million from Tanzania, Egypt and Australia. Honey making process is slow and impossible to technological replicate attributing to the shortage of the product. A USAID report shows that Kenya produces approximately 7,300 tonnes of honey annually, 700 tonnes less than what Tanzania cultivates against estimated potential of 100,000 tonnes for the two Eastern African Countries.
Mobile phone boom in Africa faces sharp decline: Report The number of mobile phone users in Africa is set to slow sharply in the next half decade, a report by GSMA, a global body and association of mobile operators and related companies has said. The decline will mark the end to the boom in an industry that has contributed greatly to the continent’s growth, experts have argued. The study, released yesterday indicates that subscriber growth will slow to 6 per cent between 2015 and 2020 compared with a 13 per
cent rise growth experienced in the first half of the decade. The slowdown has been blamed on a lack of commercial logic in setting up network coverage in some rural areas, where more than half of the continent’s population lives. “I am bit surprised by this development because I expected strong growth to continue because the penetration rate in Africa is still well below 100 per cent,” GSMA’s Africa director Mortimer Hope said. “Some areas especially in remote, rural
communities are not economically viable for mobile phone companies to deploy their network because of the low spending power of people living there leading to the decline,” he added. By the year, 2020, roughly 500 million people, who represent 50 per cent the continent’s population, will have subscribed to a mobile service. On average, GSMA has found that globally, an average of 60 per cent of the world’s population have subscribed to a mobile phone service.
BIZ BRIEFS World Bank to fund Kenya, South Sudan transport project
The governments of Kenya and South Sudan recently inaugurated a new project that will upgrade a critical trade route connecting the two countries. Through the East Africa Transport, Trade and Development Facilitation Project, a 309km stretch of land will be rehabilitated, creating a safe route for goods and people along Lokichar – Nadapal/ Nakodok part of Eldoret-Nadapal/Nakodok road in the north-west region of Kenya. The international lender revealed the initiative is part of a $500 million (Sh51.6 billion) World Bank Group (WBG) loan. The cash will also support other activities designed to improve the livelihoods for those living in the region, and increasing regional competitiveness. “The upgrading of the corridor will improve transport and trade between Kenya and South Sudan,” said Governor Josphat Nanok.
Online pay TV firm, Netflix hikes prices for new customers
Netflix Inc, the world’s dominant paid online video service, is raising the price of its most popular streaming subscription by $1 (Sh103) a month to $9.99 (Sh1,030) in November for new customers in the US, Canada and parts of Latin America following a similar move in Europe this year. Netflix is arguably the most popular pay TV service in the world due to its favoured television programmes, which have attracted audiences from as far as Eastern Europe, China, Kenya South Africa and the UK. The hike comes at a time when developing countries have established their own pay TV services for consumers as governments across the globe push for digital migration. Netflix already has a presence in South Africa and has made plans for expansion. Known for its critically acclaimed shows, the network is likely to topple most entertainment providers in the continent should it choose to venture into the region.
Apple now removes online store apps over security concerns
Apple Inc has removed ‘a few’ applications from its App Store, expressing concern over the security of some users. The company said the apps threatened users’ security by installing certificates that can expose data to monitoring by third parties. However, the company has not specified the precise number of apps at issue. “Apple is deeply committed to protecting customer privacy and security,” an Apple spokeswoman said in a statement. “We are working closely with these developers to quickly get their apps back on the App Store, while ensuring customer privacy and security is not at risk,” she added. Apps with so-called root certificates user data to servers where it can be analysed opens the door for network providers to review encrypted traffic leaving users vulnerable to data breaches, Reuters reports. Among the apps removed was Been Choice, which has attracted attention for its ability to block advertising in apps.

Ngunyi Luo poverty claim could be right
I do not think political scientist Mutahi Ngunyi was entirely wrong on the post claiming that approximately 82 per cent of Luo’s in Bondo are living beneath the poverty line. However, if that constitutes the ‘hate speech’ charges then he should just go to court with the data to
justify the claims he made. I think where the problem is, Mutahi is not a Luo and should not lecture them, but leave it to the Luo leaders to embrace the issues. Mutahi could also have stated clearly the reason behind poverty because the past and the incumbent governments have
