CIC to go to court over unconstitutional bills MONDAY, OCTBER 12, 2015

The Commission for the Implementation of the Constitution (CIC) has vowed to seek judicial intervention should MP go ahead and pass two welfare bills before them. CIC has maintained that the two bills, the Publication of the Parliamentary Pensions (amendment) Bill and the Re-Publication of the Parliamentary Society of Kenya Bill before the House are unconstitutional. “We request the conscientious-minded MPs, who value and respect the Constitution, to reject the two bills. In the unfortunate event that they are passed, we will have no otherwise, but to seek legal intervention,” says CIC in a statement. The parliamentary pensions (amendment) Bill seeks to reduce the period of entitlement to pension by MPs from two terms to one term, it also seeks to reduce the age of entitlement to pension for MPs from 45 to 40. The Charles Nyachae-led commission has raised concern over the bills, maintaining that if passed in its current form will have a serious negative impact on the ever-ballooning State liability and are also unsustainable. CIC has also argued that the will violate the principle contained in Article 116(3) of the Constitution as it will confer a direct pecuniary benefits to MPs. According to CIC, there Bill

also violates Article 122 of the Constitution which bars MPs from voting in matters which they have an interest and the integrity principles in Chapter Six which bars State officers from participating in decisions where conflict of interest would arise. The bill also takes away the constitutional mandate of the Salaries and Remuneration Commission (SRC) which has the sole responsibility of determining the remuneration and benefits of State officers.

CIC has also opposed the re-publication of the parliamentary Society of Kenya Bill which seeks to create a welfare society for former MPs by law. The welfare society according to the bill is supposed to provide for the welfare of former MPs including providing psychotherapy for former MPs and facilitating them to undertake projects and enterprise welfare. According to CIC, there is no justification that such a

welfare should be funded from the ex-chequer and it also amounts to violation of Chapter Six of the constitution on self-interest legislation. The Commission also raised concerns over the National Assembly’s to pass the first amendment to the Constitution transferring the management of the Equalisation Fund from the National and county governments to a constituency-based

framework essentially enabling the fund to be run through CDF. According to CIC, the implementation of the framework under the proposed amendment would compromise the constitutional definition of marginalised areas which the fund was meant to address. The CIC said the amendment contravenes key principles and objectives of devolution including the need for integrated planning.

Ndeti raises alarm over women harassment Women leaders have decried the increasing cases of harassment and intimidation of women in the public service. According to the Chairperson of political parties’ liaison committee Wavinya Ndeti, women are being mistreated unlike their male counter parts in the public service. “We are witnessing a disturbing inclination in the manner at which women are being mistreated and their rights violated in total disregard of the new constitution. This is not acceptable” she said. She named Devolution and Planning Cabinet Secretary Anne Waiguru whom she said has had to deal with abuses and ridicule from the opposition following the Sh800 million scandal at National Youth Service (NYS). The opposition has called for Waiguru to step aside as investigations are carried out. But Ndeti wants the due process followed before the CS can quit office. She refuted claims by the opposition that Ms Waiguru is being shielded against prosecution by the President. “Let the law takes its course, if Waiguru is found culpable she should be prosecuted but let us not politicize issues to the extent that we have to harass, intimidate and abuse a woman in public” she said. She further notes that forceful removal of the former Chief registrar of the Judiciary Gladys Boss Shollei and the recent ouster of Deputy Inspector General Grace Kandi from their respective offices was disrespectful.

Ruto flies to Israel amid ICC row Deputy President William Ruto is in Israel to meet with the Country’s Prime Minister Benjamin Netanyahu in one of the latest attempts seen as piling pressure on the International Criminal Court (ICC) over the use of the amended Rule 68 in the ongoing Kenyan cases at The Hague based court. Although the details of the meeting with Netanyahu remains scanty, latest developments in the region points out that ICC could be one things the two leaders are set to discuss. A tweet on the Deputy President’s social media accounts reads, “In Israel for an official visit. I will have an engagement with PM @ Netanyahu, Agriculture Minister Uri Ariel and Knesset (parliament). Only last week, Ruto visited Uganda

Poor people tweet obscenities while rich people tweet about politics

Wealthy people tweet about politics, progress and development while poor people curse, swear and post about issues that disgust them, new research has revealed. A University study has discovered that, Twitter, one of the world’s leading social media networks, can be used as a tool to determine how rich or poor a person is. Result from the study confirmed a number of obvious assumptions, including the fact t=hat in many cases, educated people on Twitter are likely to earn more money than their less-scholarly counterparts. It also presented some new information that sheds light on the personality traits, emotions, and language expressed by people with different incomes. The study, led by researcher Daniel Preoţiuc-Pietro from the UK-based University of Pennsylvania, analyzed over 5,000 users and

over 10 million tweets posted on the social network. His team of researchers was able to predict people’s socio-economic status based on what they said on Twitter and the sentiment of their posts. It was determined that lower income users tend to swear more, and express a variety of emotions that include sadness, surprise, and disgust more frequently than higher income users. On the other hand, the researchers found that people with higher incomes tweet more about politics and NGOs. “Those of lower socioeconomic status use Twitter more as a communication means among themselves,” Preoţiuc-Pietro said in a statement. “High-income people use it more to disseminate news, and they use it more professionally than personally,” he added.

Ngunyi denies contempt charges, freed on bail Political scientist Mutahi Ngunyi has denied for counts of ethnic contempt for tweets targeting the Luo community. Ngunyi who appeared before Chief Magistrate Daniel Ogembo earlier lost a bid to block the prosecution. He was freed on a Sh500, 000 surety bond or a cash bail of Sh200,000 in the alternative, pending hearing of the case on January 13-14 next year. The analyst was summoned to court last week following an application filed by the Director of Public Prosecutions Keriako Tobiko. In the meantime, a court will rule tomorrow whether Machakos Senator Johnstone Muthama will also face charges of incitement to violence and disobedience of the law. Muthama who has been summoned to appear in court on Thursday is also seeking to block his prosecution arguing that the charges

Most sex workers are in nairobi, estiMates show A new estimates released by the Ministry of Health shows that Nairobi County hosts nearly a quarter of the female sex workers in Kenya. About 29, 494 of the estimated 133,675 female sex workers in the country are based in Nairobi with North Eastern hosting the least number of about 2,030 female sex workers. According to the estimate, about 39 per cent of sex workers in Nairobi do not believe that abstaining from sex will guarantee them HIV protection with another 23

per cent not believing HIV can be managed. Findings by the National Aids Control Council indicates that at least three out of 10 female sex workers across the 47 counties are infected with HIV. Because of this, the Health ministry and other partners are now seeking ways of how to involve this population in putting HIV infections in check. Distribution of condoms and provision of treatment facilities are among efforts being made to halt the spread of the disease.

Kenya Aids Strategic Framework 2014/15 to 2018/19 have since initiated a priority intervention programme where reformed sex workers are being used to reach their peers with information on HIV. HIV/Aids analyst at the United Nations Population Fund (UNFPA) Dan Okoro says the number of twilight girls is increasing proportionally to the rate of HIV infection. “Nearly 30 per cent of new infections are among female sex workers and their reproductive health

needs are unmet because their work is stigmatised. This is a hidden population that many of us ‘love to hate’ but can greatly determine our fate,” said Okoro. He said the situation is worsened by the fact that the said population is mobile and defaults on treatment, putting their lives and those of their clients at risk. Some of the older and experienced sex workers say they work alongside girls as young as 14 whom they say are ignorant on how to protect themselves from HIV.

Nominated Senator Emma Mbura has called for more decisive action in eradicating drug abuse at the coast. She has asked Coast leaders to follow in the footsteps of their Mount Kenya region counterparts who took more decisive and elaborate fights to confront consumption of second genera alcohol in central. “As we applaud President Kenyatta’s directive on the immediate crackdown on drugs, dealers and their dens at the Coast. It must be business unusual now not business usual for the crackdown to be a success in saving the youths from the drugs” she said. She also want the government to arrest the real drug peddlers and barons so that they can be brought to book. “We cannot be arresting the drug users only leaving the drug peddlers and drug barons free, remember there is no supply if there is no demand,” she added.

MCA killed in road crash A Bomet MCA died in a lethal road accident while three others sustained serious injuries when a lorry collided head-on with a private car they were travelling in last night. Cecilia Towett, Nyongores ward representative died in the 8pm crash near Eor Ekule trading centre along the Narok-Mai Mahiu highway. Their car was travelling to Bomet from Naivasha while the lorry was heading to Nairobi from Narok. Witnesses said the lorry was speeding and was overtaking, when the accident occurred. Two of the lorry’s occupants and Towett’s driver survived with injuries. Narok police commander Abdi Galgalo who confirmed the incident, urged motorists to observe traffic rules. Towett’s driver was taken to Narok County Referral Hospital and later transferred to Tenwek Mission Hospital in Bomet County. The body of the MCA was taken to the Narok hospital’s mortuary while the wreckage to Ntulele police station. Bomet Governor Isaac Rutto later visited the scene.

Work begins on Mwiki/Kasarani rd Nairobi City County has finally commenced the rehabilitation of the Mwiki Kasarani road, barely two weeks after ridents of Mwiki and Kasarani area demonstrated over the dilapidated state of the 8km stretch. “Today we commenced the 3 months rehabilitation of the 2km section of the road. The works will involve reprocessing of the existing road and construction of a hand packed stone base as well as installation of a lined drain together with road edge restraint. NEWS BRIEFS Turkish air force pounds rebels The Turkish air force has pounded Kurdish militants a day after a deadly bomb attack on a rally for peace in the capital Ankara. Planes hit Kurdistan Workers’ Party (PKK) targets in both the south-east and over the border in northern Iraq. Saturday’s twin bombing in Ankara killed at least 95 people, making it the deadliest such attack ever. Security sources say they suspect the so-called Islamic State (IS) group was behind the attack. The air force struck after the government rejected a new ceasefire announced by the PKK on Saturday. Tensions in Turkey were already high, with a general election looming on 1 November. Two senior security officials who spoke to Reuters said the initial signs were that IS was to blame. “All signs indicate that the attack may have been carried out by Isil,” one of the unnamed sources said. “We are completely focused on Isil.”

Mexico releases file on 43 students The Mexican attorney general has made public the file on last year’s disappearance of 43 student teachers who clashed with the police. Arely Gomez Gonzalez released more than 80 volumes of material. The case has prompted protests across Mexico, increasing pressure on President Enrique Pena Nieto. Relatives dispute his government’s account that police in Guerrero state handed the students over to a gang who killed them and burnt the bodies. The attorney general’s office said the document had taken around 100 investigators seven months to compile. But an international panel of experts said it had found many flaws in the investigation.

5 Nato personnel die in Kabul crash Five people, including two RAF personnel, have been killed in a helicopter crash in Afghanistan. The Puma Mk2 helicopter crashed as it was landing at Nato’s Resolute Support mission headquarters, Kabul. Nato has not released the nationalities of the other victims or the five left injured. A Ministry of Defence spokesman said the crash was “an accident and not the result of insurgent activity”. The families of the British victims have been informed, the MoD said. They have asked for a period of grace before their names are released.

Putin defends Syria strikes President Vladimir Putin has defended Russia’s military operations in Syria, saying the aim is to “stabilise the legitimate authority” of Syrian President Bashar al-Assad. Mr Putin told Russian state TV Moscow also wanted to “create conditions for a political compromise” in Syria. He denied that Russian air strikes were hitting moderate opposition groups rather than Islamic State militants. Syrian forces are said to have made significant advances against rebels. Government gains in Idlib, Hama and Latakia provinces were on Sunday reported both by Damascus and opposition activists. The main battlefront is currently close to the key highway that links the capital with other major cities, including Aleppo, and Mr Assad’s forces are believed to be seeking to cut off rebels in Idlib. In the interview with Rossiya One TV broadcast on Sunday, President Putin said Russia’s aim was to “stabilise” the government in Damascus. He stressed that without Moscow’s support for President Assad there was a danger that “terrorist groups” could overrun Syria. Under Australia’s tough asylum policy, any irregular migrants trying to reach the country by boat are intercepted and held in centres on Nauru and Manus Island, Papua New Guinea. The government says this deters people-traffickers but there have

been criticism of the conditions at the camps. The 23-year-old Somali woman is reportedly more than 12 weeks pregnant. Abortion is allowed in some circumstances on Nauru but not in the case of rape. The Australian government had come under pressure to allow her to enter the country to terminate the pregnancy. “Our client is relieved that there has been a resolution to this sensitive matter,” her lawyer George Newhouse told the Sydney

Morning Herald. “She is now in Australia and the Commonwealth government has agreed to provide her with medical treatment.” But an opposition politician hit out at the woman’s treatment. “You’ve got to wonder why a young woman’s very distressing situation had to become so public and the prime minister had to be pleaded with by the Australian people,” said Greens senator Sarah Hanson-Young, AAP reported.

South Sudan rebel ‘may take up arms’ again A major rebel leader in South Sudan has told the BBC he may have to take up arms again, despite the signing of a peace agreement six weeks ago. Gen Johnson Oloni said the government was undermining the deal with attacks on civilians and a plan to re-draw state boundaries in the country. Tens of thousands of people have died and millions have been displaced since the civil

war began in 2013. South Sudan gained independence from neighbouring Sudan four years ago. Gen Oloni told the BBC the peace deal was unlikely to work. He said he was incensed at what he saw as the wrongful occupation of his tribe’s land by government forces. He also said he was angered by a plan - announced earlier this month by President Salva Kiir -

Kilifi farmers welcome Animal health clinics Kilifi livestock farmers are set to benefit from improved livestock breeds following the introduction of free livestock health clinics in the county. Kilifi county government, in partnership with the KCB Foundation and Kenya Veterinary Association, will conduct animal health drives, which will see more than 35,000 livestock vaccinated, de-wormed and treated for minor

ailments to end the outbreak of livestock diseases that has engulfed the county. The initiative is part of the ‘Mifugo ni Mali’ livestock project, which the Foundation has been implementing to empower farmers from Arid and Semi-Arid Lands (ASAL) to reap maximum returns from their produce. “The need for increased livestock production is pressing, given

the rapidly growing demand for animal products and the important contribution of livestock to the incomes and welfare of the farmers,” said KCB foundation manager Rachel Gathoni. As part of the agreement between the KCB Foundation and Kilifi County, the livestock programme will see farmers benefit from free loans through cooperatives, trainings on best farming practices

and sponsorship of various livestock initiatives. Similar health initiatives have taken place in Baringo, Kwale and Taita Taveta counties, where KCB Foundation under the Mifugo ni Mali programme have kicked off activities. Speaking during the launch, Kilifi Livestock and Fisheries county executive Mwalimu Menza expressed confidence in the

initiative, saying it will replenish the diminishing numbers of livestock as a result of diseases. “Our livestock farmers practice open grazing, exposing animals to diseases due to their free movements,” said Menza. He said livestock farmers in the region should take advantage of the free livestock health clinics to improve their animals’ health and productivity.

Australia has brought together local alumni from Australian governmentfunded mining and energy courses in Nairobi to network and exchange ideas on how to develop the extractives industry. The Mining for Development Alumni Forum is focused on building inclusivity among alumni and experts from the private sector, government and civil society. Speaking during the official opening of the Forum, John Feakes, Australian High Commissioner to Kenya said he is excited about the impact of the forum in Kenya’s mining sector. “Australia has made a strong commitment to supporting local mining, and I look forward to seeing

My sound of music is called ‘chung ha’, chung is a luo word meaning stand and ha’ is the emphasis meaning straight. So ‘chung ha’ is standing straight in the mind and I am expressing it through my music. What music have you done recently? My latest music is called Miel Kidala. ‘miel’ means to dance and ‘kidala’ means traditionally so in the music we going back to the basics where we make traditional dancing vogue again. Tell us about your latest track and who produced it. Miel Kidala was produced by Bizi B both the audio and video at S-Bar International studios based in Donholm. The song is fused with traditional instruments such as Orutu that was played by the Kenge Kenge band. The idea of the song is just to show the youths that diversity in cultures is also cool. What or who inspires your music? My music is inspired mainly by the urge to contribute something positive to the society, to my country and to the world in general and I believe my music is the tool to achieve that. I am also inspired to do music so that I can get a means of livelihood to pay the bills, get some money to buy food and also to be a role model to my peers. The person who inspires me is Jesus Christ.

What’s your greatest achievement in your music career? I founded an event in the community called Umoja talanta that takes place every first Sunday of the month and has been going on for the past two years. The latest one just happened yesterday.Through the event we have helped many young people to believe that they can earn through artistic talent. Apart from music, what else do you engage in? eople find love in all manner of places and for Godfrey Matheri and Joan Wahito, the US was where their love sprung and bloomed. “While looking to get enrolled in an arts college in the US, I was staying with my relatives who had relocated there in the 90s after winning a green card, and that is where I met Godfrey,” says Joan as the couple takes us down memory lane. “I had landed a lucrative employment deal with an international NGO and I had to attend a probation training course at their headquarters in the States before getting fully absorbed into the organization,” says Godfrey who continues to reveal that it was during his stay there that he met Joan at a coffee shop. “I heard her making an order for some snacks and from her accent, I knew she was from my home country. It is always nice to see someone from home in a foreign land,” he adds. Godfrey decided to approach Joan there and then and as Joan recalls, it was a moment worth a thousand dollars. “I was waiting in line for the snacks I had ordered when this guy (Godfrey) came and stood in front of me and greeted me in my mother tongue. I had not come across anyone from Kenya apart from my relatives who I was staying with, so you can imagine my shock when Godfrey pulled this stunt,” says Joan as Godfrey adds that he was just trying his luck. “She could have been from any community and when she responded to

my vernacular greetings, I knew this had to be a sign.” Godfrey and Joan kept in contact throughout their stay abroad and their ‘homie’ friendship slowly turned into a romantic involvement which they maintained even after Joan decided to return home, where she waited for Godfrey’s return. Back home, the couple continued seeing each other and by the time their relationship hit the four year mark, Godfrey knew that Joan was the only one he wanted to be with for the rest of his life; he therefore proposed late last year and Joan said yes! 10 months later and it was Godfrey and Joan’s wedding day, a day that boasted of blue, grey and yellow as the theme colors for the brides’ maids, groomsmen, and the church and reception décor. The bride as usual wore a splendid white off shoulder flowing gown embellished with sparkling crystals here and there while the groom had on a grey suit with a maroon tie. The wedding ceremony was held at Kingdom Ministry Centre at the heart of Mwiki, a venue that also hosted the reception later in the afternoon where the newlyweds and friends shared a meal, dances and a delicious fruit cake before the day came to an end and everyone left at their own pleasure .The couple left for the UAE for their honeymoon. Congratulations to Mr. and Mrs. Godfrey Matheri. ‘The groom literaly carried his new found love.

Two-thirds of Africa, about 13,400 hectares of irrigation-equipped land is in North Africa where water withdrawals as a share of total renewable water resources is 219 per cent in northern Africa, but only one per cent in Sub-Saharan Africa. Egypt, for instance, has wellstructured water management

systems that employ good harvesting of rain water. According to rainwaterharvesting. org, Egypt has preserved indigenous rain water harvesting technologies including underground tanks to collect rainwater. By implementing such simple and innovative ideas, Kenya can put more land under cultivation, producing enough food for its people and the entire continent as well.

Centre Mollete Achieng stood tall on defence, Racheal Opinya got her hustle going early and Susan Manya controlled the offense well from tip off to help the Swords cut through the Sharks soft flesh with a 40-33 win. Masaku whose impressive start to the season was put to a halt once again by the minnows, the Swords, had a rookie Felmas Adhyambo in their starting five and Strathmore took that advantage, leading throughout the first quarter which ended 7-5 in their favour. Athletes begin Africa XC slots scramble at Ndaalat Scramble for slots in team Kenya for next year’s Africa cross country championship begun yesterday during the 7th edition of Ndalaat Gaa Cross Country championship in Uasin Ngishu County. Nicodemus Kipkirui and Caroline Chepkoech tested their strengths and endurance ahead of the national trials for the bi-annual Continental race when they both won the senior men (8km) and women (6km) races respectively in Ndaalt Gaa races which also debuted the Kids Athletics race being introduced in Kenya for the first time. Kipkirui clocked six seconds better than Bernard Kipkemoi to win the men’s race in

a time of 24:13:7. Kipkemoi timed 24:19:3 to finish second ahead of Isaac Kipkoech who returned 24:21:9. Former Africa cross country champion Chepkoech cut the ribbon first in a time of 20:45:5 followed closely by Gladys Chemweno in a time of 20:52:2 and in third place was Lilian Cheruto in a time of 21:08:2 in the women’s race This year’s edition introduced the IAAF Kids Athletics programme, the first in Kenya, aimed at encouraging young children to participate in athletics events. Hamilton eyes third world title after Russia victory Lewis Hamilton victory in Russia yesterday, his ninth win in 15 races this season, has moved him to within touching distance of a third world title. Hamilton is 66 points clear of Ferrari’s Sebastian Vettel, and 73 ahead of Mercedes teammate Nico Rosberg, who retired early from the race in Sochi. With a maximum of 100 points available in the remaining four races in the USA, Mexico, Brazil and Abu Dhabi, the size of the task facing Hamilton’s pursuers is clear. To look at it in another way, if Hamilton wins in Austin, Texas, on October 25, Vettel needs to finish second to keep the championship alive. Rosberg, meanwhile, has to beat Hamilton at the Circuit of Americas to have any hope of maintaining even the slenderest of interests in this season’s title race.

Italy beat Romania at Sandy Park to book 2019 event slot Italy secured a bonus-point win over Romania at Sandy Park to finish third in World Cup Pool D and book their place at the 2019 rugby tournament. Leonardo Sarto, Edoardo Gori and Tommaso Allan scored first-half tries for Italy after Florin Vlaicu’s penalty had given Romania an early lead. Alessandro Zanni went over for Italy soon after the restart, but two tries from Adrian Apostol and one from Valentin Popirlan ensured Romania ended with their spirits high. Police had taken the lead via David Oluoch, but Muhoroni levelled the scored with 10 minutes left on the clock before the drama ensued six minutes later.

Kenya progressed to the second round of 2018 World Cup qualifier after a barren draw against Mauritius at Safaricom Stadium, Kasarani, a team they beat 5-2 away in the opening fixtures last Wednesday. Gor Mahia striker Michael Olunga performance at club level and against Mauritius came into sharp focus after he missed several chances that could have seen Stars take an early lead in the game. The game started with drama after the kick off was delayed after pitch attendants failed to properly tie the goalkeeper net, forcing Mauritius goalkeeper Jean Louis to donate part of his seven minute to help correct the gawkiness of the pitch attendant. Olunga had a chance to give Kenya the lead, but the ball defiantly rolled off his left foot with only Louis to beat in the 19th minute after he was set free by skipper Victor Wanyama with a

defence splitting pass on the right wing. Olunga sharpness upfront was tested again, but just as the first opportunity, the Engineering student misjudged his steps allowing Louis to snatch the ball from his foot after he lost balance inside the box just three minutes later after missing the earlier opportunity. Kenya survived a scare in the 35 minute when Boniface Oluoch was forced to come out of his area to rescue the team from a deadly Mauritius counter attack just few seconds after Brian Mandela had hit the cross bar with a header. Kenya’s constant attack on the opponents bore no fruit and substitute Allan Wanga was denied by the post and Ayub Timbe was twice denied by Louis who corrected his earlier mistake when he handled a back pass following pressure from Kenya’s forwards. Wanyama resultant free kick did not threaten the opposition much.

Coach Bobby Williamson will have only three weeks to prepare the squad for the second round match against another Iceland nation, Cape Verde set to be played between November 7 and 17. Meanwhile, Tottenham Hotspurs have not given up hopes of landing the signature of Wanyama. Spurs are reported to be preparing a bid for Wanyama who led Kenya to the second round of Russia 2018 world cup qualifier against Mauritius yesterday in Nairobi.
