Already the Commission for the Implementation of the Constitution (CIC) has threatened to seek judicial intervention should the bill be passed into law. “We request the conscientious minded MPs who value and respect the Constitution to reject the welfare bill. In the unfortunate event that these bills are passed, there is no doubt that the same will invite judicial intervention,” says CIC in a statement. The bill states that MPs play a crucial role in advancing the interests of their constituents, their parties and also exercise oversight of State organs and therefore there should be a legal framework which can be used to come to the rescue of members who find themselves with the prospect of having to be out of Parliament. Commission disowns Land Bill, says it was altered The National Lands Commission (NLC) has today disowned the Lands Amendments Act currently before Parliament and accused the state of not being committed to addressing the historical land injustices in the country. At a press conference attended by five commissioners at their

offices in Nairobi today, NLC says that the proposals they made to the Bill are conspicuously missing in the final document currently before parliament. “As a commission, we found out that the contents of the draft we presented to the Cabinet Secretary for Lands are totally different to

what we had drafted,” said NLC Deputy Chairperson Abigael Mukolwe. Other commissioners present at the press conference were Rose Mumbua Musyoka, Silas Kinoti Muriithi, and Samuel Kipng’etich Tororei. The land reforms being undertaken by the

The Charles Nyachae-led commission argues that the assumption that MPs suffer in retirement by virtue of their time in the public service and are therefore entitled to special privileges that is not available to other retirees is discriminatory and imprudent use of public monies. “Most MPs abandon their careers and spend most of their time in public service. It becomes quite difficult for such members to feel part and parcel of the ordinary civilian populations and their employment prospects are greatly reduced,” reads part of the bill. “It also becomes psychologically difficult for such members to adjust to life outside Parliament

and this affects them. There are stories of ex-legislators including their partners suffering nerve breakdown, divorce, heart attacks, alcoholism, school debts and even bankruptcy. This bill therefore seeks to rescue former MPs,” further reads the bill. The bill is sponsored by Eldas MP Adan Keynan and seeks to ensure former MPs receive the necessary counseling to help them get back to ordinary life. The bill establishes the Parliamentary Society of Kenya Board which is empowered to provide outreach programmes where former MPs can visit and speak at universities, academies, schools and voluntary groups to give their experiences, particular skills and a clear idea as to how Parliament works. The bill seeks to reverse the worrying trend where there are too many former MPs who cannot find their way around after losing a political seat.

Among the changes she said have been made in the current Bill include deletion of some functions of the NLC which have been given to the Cabinet Secretary for Lands, Land Information Management system and the proposal that NLC commissioners be appointed through the Public Service Commission. Mukolwe argued that Public Service Commission is an independent body just like the Lands Commission hence it cannot appoint the commissioners. Other changes made to the Bill include giving the land registrar powers to alter land registries. She also said that in the previous Bill, the County government, the National Land Commission and the local community all had their roles well spelt out but in the initial draft.

But now, their roles have been given to the Cabinet Secretary. “As a commission we just provide policies that we feel will bring sanity in the lands sector which is an emotive topic in this country,” Mukolwe said. “I want to tell politicians that the amendments we proposed were for the people of Kenya not NLC commissioners,” Mukolwe said. She warned the country is slowly sliding back to the old constitution in terms of management of land as most of the functions have now been given back to the Cabinet Secretary. “I know the law is being changed to take away our roles, but until then we will continue to do our role as required by the constitution,” she added. Last week, acting Lands Cabinet Secretary Fred Matiang’i urged members of parliament to stop politicizing the Physical and Spatial Planning Bill and Community Land Bill 2015. The Bill seeks to amend various Acts including the Land Act, Land Registration Act and National Land Commission Act and the Physical Planning Act.

Muthama charged with incitement

Machakos Senator Johnstone Muthama was today charged in a Nairobi court with incitement and disobedience of the law. Nairobi chief magistrate Daniel Ogembo however released the Senator on a cash bail of 100,000 pending the hearing of the case on February 16, 2016. He had been summoned to answer the charges after the public prosecutor recommended his prosecution. Muthama was charged alongside activist Japheth Muroko alias Japhet Thuranira. The charge against the senator read that on September 23 at Uhuru Park, Nairobi, he uttered words in Swahili that have been translated as: From Friday next week if teachers will have not been paid nobody will go to work and whoever goes shall be stoned, “indicating that it was desirable to bring death and physical injury to persons in Kenya.” Muroko faced a charge translated from Swahili to mean “we are saying, the motion being brought to impeach Uhuru, any Member of Parliament who votes against it will be lynched.” The said utterances were made during Cord rally held at Uhuru Park on 23 September 2015.

ICC allows AU to join Ruto case The African Union has been allowed to join defence teams of Deputy President William Ruto (pictured) and journalist Joshua arap Sang in an appeal seeking to overturn a decision which permitted the prosecution to use prior recorded statements of five witnesses who recanted their evidence. This was after the Appeals Chamber on Monday granted the African Union Commission’s request to submit observations on amendment to Rule 68. The AU was granted up to next week to file written submissions as amicus curiae in the decision in which the trial chamber allowed the prosecution to use prior recorded statements of the witnesses who recanted their testimony. “The Appeals Chamber considered that the observations the African Union wishes to make may be desirable for the proper determination of the first issue on appeal without prejudice to the weight, if any, to be

Kenya unveils raft of measures to address climate change Kenya will undertake a range of mitigation and adaption measures in achieving low carbon resilient development to address climate change, Environment ministry has said. The country aims to reduce its greenhouse emissions by 30 per cent by 2030 through mitigation actions. Speaking during a climate change public awareness forum hosted by the European Union (EU), Environment Cabinet Secretary Prof. Judy Wakhungu said the country will integrate and undertake climate change actions in 17 broad priority sectors. “Kenya was among the first

countries to submit an ambitious intended Nationally Determined Contribution (INDC) to the UNFCCC secretariat in July 2015 because we want to advance our resilience in climate change,” she said, adding that it is the first time the country has submitted a climate change contribution at the international level. “We hope to adopt an ambitious and new legally-binding international agreement on climate change applicable to all countries” said the CS. Wakhugu said her ministry has named various sectors that if adapted, will revolutionise the resilience to

climate change. It included energy, forestry, agriculture and waste. “Kenya has already introduced a range of low carbon climate resilient options across many sectors. Ranging from renewable energy, use of biomass and sustainable land use management” she added. Wakhungu acknowledges that climate change is a global challenge that requires global response and actions by all countries. Zimbabwe now drops prosecution against lion killer The US dentist who sparked an international outcry after killing a lion in Zimbabwe will not be prosecuted because he had obtained the legal authority to hunt, officials say. Walter Palmer admitted to killing Cecil the lion in July but has always denied that he acted illegally. Zimbabwe’s Environment Minister Oppah Muchinguri said he could not be charged as all his “papers were in order”. Mrs Muchinguri said Zimbabwe would now review how it issues hunting licences. The environment minister had previously called for Mr Palmer to be extradited and face prosecution. However, it appears that Mr Palmer broke no laws when he killed the lion using a bow and arrow.

Netherlands’ board to issue final crash report on MH17 The Dutch Safety Board is to publish a final report on why Malaysian Airlines Flight MH17 broke up over Ukraine in 2014, killing all 298 on board. Preliminary findings say it was hit by “high-energy objects from outside the aircraft”, fuelling speculation that a surface-toair missile was responsible. The West and Ukraine say Russianbacked rebels brought down the Boeing 777, while Russia blames Ukraine. But the report will not say who was to blame. Russia is to issue its own report. The plane - flying from Amsterdam to Kuala Lumpur - crashed in rebelheld eastern Ukraine on 17 July 2014 at the height of the conflict between government troops and the pro-Russian separatists.

Kenya gets Israel backing in war against terrorism

The Israeli government has pledged to support Kenyan government in its fight against terrorism. Israel’s Prime Minister Benjamin Netanyahu said they are ready to give resources and expertise training to the Kenyan security personnel to win the war against terrorism. Netanyahu made the remarks yesterday when he met Deputy President William Ruto who is in Israel on official visit. He said both Kenya and Israel have similar problem when it comes to terrorism and cooperation between the two countries is key in winning the war against terrorism. “The security of Kenya is of value to its neighbours. We are ready to give resources, expertise and training, terrorism must not be allowed to fulfill their mission anywhere in the continent,” said Netanyahu. “We must nip the fundamentalists in the bud. Africa too must ensure there are no cells. That is what we need to do, we should not relent.” Netanyahu said terrorism has resulted in global turbulence with the rise of ISIS, stressing that communication and sharing of intelligence is key in combating the problem. Ugandan army to leave South Sudan Ugandan troops will start leaving South Sudan by the end of this week, according to the head of the Ugandan force in the country. AU condemns Boko Haram attacks in Chad, Cameroon The commission of the African Union (AU) has condemned the killing of civilians by Nigeria’s terrorist group Boko Haram in the countries of Chad and Cameroon. The attack left 50 people killed and hundreds injured in the refugee camp in the villages of Baga Sola, Western Chad and Kangaleri in the far north

region of Cameroon on October 10 and 11 2015 respectively. In statement, AU chairperson Dr Nkosazana Dhlamini-Zuma condemned the terrorist group’s heinous act. “The commission condemns in the strongest terms possible the barbaric attacks perpetrated by the Boko Haram against

innocent civilians in a market and in a refugee camp in the village of Baga Sola, Western Chad, and in the village of Kangaleri, in Cameroon,” said DhlaminiZuma. She also expressed the AU’s condolences to the families of the victims and wished speedy recovery to the wounded. “We reaffirm AU’s solidarity

with the governments and peoples of Chad and Cameroon, as well as of the countries of Niger and Nigeria that have been affected by the activities of the Boko Haram terrorist group” she said. Dhlamini said AU will work closely with the countries of the Lake Chad Basin Commission – LCBC (Cameroon, Chad,

Nestlé in Sh40m coffee project Nestle has set aside Sh40 million targeting women and youth to scale up coffee production in the country. The said kitty will go towards a three-year training programme aimed at encouraging women and the youth to participate in coffee farming and lead farmer’s cooperatives as part of its commitment to promote gender equity and youth involvement in agriculture. The company wants to reduce the gap between male and female representation in cooperative management and enhance sustainability through unveiling of new generations. “In the initial phase of the training we had targeted about

1000 women. We now have about 10, 000 female coffee farmers who represent about 30 per cent of the farmers we engage in the Nescafé Plan initiative,” said Nestlé East Africa managing director Ciru Miring’u. Miring’u, said the number of women taking up leadership roles in the farmer’s cooperatives has doubled. The training programme rolled out today is part of Nestlé’s global Nescafé Plan initiative to offer training and technical support to about 41,000 coffee farmers across Central and Eastern Kenya. Nestlé held the first session of the training yesterday in Embu where 35 women and youth from

KenGen posts Sh8bn annual pre-tax profit The country’s main electricity generator KenGen has posted a pre-tax profit of Sh8.69 billion representing a 109 per cent jump for the year ending June due to high electricity sales. A statement from KenGen said that its performance was fuelled by the increase in geothermal and wind power. “Profit before tax increased ... propelled by capacity growth, improved performance and tax credit from capital allowances enjoyed by the company following the commissioning of 280 MW geothermal plants, well heads and Ngong Wind,” it said. In July, KenGen announced plans to add another 450 megawatts (MW) to the grid from wind and geothermal in the next three years at a cost of Sh7.3 billion.

It further said electricity jumped to Sh25.6 billion up from Sh17.4 billion recorded the previous year during the same period. The hike was as a result of the rise per share which rose to Sh5.24 up from Sh1.29 during the year to June 2014. Furthermore, the operating costs rose to Sh8.41 billion from Sh7.02 billion due to operating and maintenance of the new plants. The country depends heavily on renewable power such as geothermal and hydro power and aims to expand installed capacity to about 6,700 MW by 2017 from the current 2,500 MW. KenGen is also aiming to halve electricity bills from between Sh17.5 and Sh18.5 per kWh within the next three to four years.

Boost as NGOs in developing countries urged to apply for Sh2.6m CFH grant The Conservation, Food and Health Foundation (CFH) is currently accepting applications for its first round of 2016 grants. The group is offering up to $25,000 (Sh2.6 million) to non-profit organisations in the developing countries that are focusing in one of the three field; conservation, food and health. The application deadline will be on January 1, 2016. “The foundation supports projects that demonstrate strong local leadership,

promote professional development in the conservation, agricultural, and health sciences, capacity of local organisations, and address a particular problem in the field,” said the group’s spokesperson Rashmi Kanti. The average grant size is $17,000 (Sh1.7 million). Grant request can be made for maximum $25,000 (Sh2.6 million). CFH will support organisations from developing countries whose activities are of direct and immediate benefit to a given nation.

The group said those applying for the grants must attract additional support and hold promise for continuation or impact beyond the period of the foundation support. HF Group donates security container to Komarock

The container will be used as a Chief ’s office and will also accommodate two Administration Police officers. HFDI has invested Sh420,000 into the project as part of its corporate social responsibility programme. HFDI executive director James Karanja said the police post will serve about 50,000 residents living in the Komarock area.

“HF Group has a long standing relationship with area residents and today’s donation is our way of enhancing their living standards,” said Karanja. Komarock MCA Samuel Irungu welcomed the donation which he said would support ongoing initiatives to improve security in the area. “Komarock has not had a chief ’s office in the last 10 years. This will

address the security concerns of area residents,” he said. Meanwhile, Komarock Phase 5C will be developed on a 23.5 acre piece of land of which five acres will be set aside for a public school. The project will have three phases and the construction of the apartments will take 24 months per phase from the date of handing over the site to the contractor.

The HF Group, through its foundation, has also established a skills development entre at Komarock 5C site for apprenticeship training for students undertaking vocational training. The programme targets youth from local communities and segment of youth residing nearby a construction site.

is name might be a mouthful, but Bukina Faso journalist Hyacinthe Boowurosigue Sanou is smiling all the way to fame (and to the bank) after he was declared the man of the night on Saturday on winning the coveted CNN Multichoice African journalist in an awards gala held at KICC and graced by President Uhuru Kenyatta. Sponsored by A24 Media, African Development Bank, Dow, Eco bank, GE, IPP Media and MSD, the CNN Multichoice African Journalist awards have in the past drawn winners from all around Africa and Kenya has not been left behind in the list of big winners. Just last year, our very own photojournalist, Joseph Mathenge, brought glory to Kenya when he emerged the CNN

MultiChoice African Journalist of 2014. Mathenge scooped the award for capturing the 2013 Westgate mall attack moments in a portfolio dubbed ‘Images of Terror.’ This year’s winner, Boowurosigue Sanou, on the other hand focused his work on telling the story of power obsession in Africa and on the steps that can be taken to counter it, embarking on documentation of the ousting of Blaise Compaore who ruled Bukina Faso with an iron fist for 27 years. The CNN Multichoice African Journalist award features multiple categories namely Culture Award, Dow technology and innovation reporting award, Eco bank Economics and Business Award, Environment Award, Features Award, GE energy and Infrastructure Award,

All about the Swahili people

T

he Swahili people came to be as a result of intermarriages between the Cushitic herdsmen and the Bantus. Over time, these people spread along the coast where they formed different cultural variations and dialects. Today they mostly live in the coastal towns in Kenya and Tanzania. The Swahili culture is greatly influenced by the Arabic culture. In the Arabic culture, Islam is the widely practiced religion that is the same for the Swahilis. The Islamic customs govern almost all aspects of the Swahili culture including food, clothing and lifestyle. The children born in this community must attend Madrassa religious classes where they study the Quran and learn the Arabic language. Marriage marks the transition from childhood to adulthood and is always arranged. In most cases, the parents of the bride are the ones who choose the groom. Their traditional wear for men is usually the kanzu, which is a long white or beige robe. Their women wear long black dresses referred to as buibuis. They also cover their heads with the hijab. They largely speak Swahili or Kiswahili, which was adapted from the Bantu and enriched with some vocabulary from the Arabic, Portugese and Hindu languages. Swahili dialects include, Amu which is spoken by those from Lamu, Mvita spoken by those in Mombasa, Pemba and Unguja spoken by those in Zanzibar. The standard version of the Swahili language is the national language in both Kenya and Tanzania.

ake Kuria was the go to guy back in High school when letters had to be decorated for the cool finish. He seduced girls on behalf of all his friends (and foes) by drawing beautiful flowers, portraits or scenic finishes. Most of the time the girls were wowed. Sadly they were never his! Jake went on to try his hands on many other forms of art but eventually settled on tattooing. Three years ago, after training from one of the tattoo gurus in Kenya, he started his journey in the tattoo industry. After purchasing his own tattoo kit, he started doing house calls which meant going to wherever the client was. Jake decided to

be modest as he described his art. “Every artist has his/ her own way of drawing, I love shading. The immense detail that comes out from a little shading at the right spot to the right limit makes one’s tattoo stand out from the rest. But what I always want my clients to remember is that I did what they asked. It’s their tattoo in the end and I have a responsibility to have the best of what they want,” he tells X Access. For the red and green ink, he uses intenze and for the black and greys he uses Kurusumi. The other important materials are the gloves and needles, which he must guarantee their hygiene before he begins working

on a client. The amount of time he takes to complete a session depends on the design of the tattoo. On average it could take an hour. Some tattoos require a second or even third visit depending on the details. Jake is inspired to better his art every time he receives a call from a satisfied client. It makes him want to do even better on the next one. The fact that the industry brings in good money is his other source of inspiration. The budding body art specialist really hates coming face to face with drunken clients. “They are restless and can get hurt, it interferes with the results and quality”, he tells us with a smile.

Kenya to sell one-year Sh20bn amortised bond to reduce debt

Kenya will offer a one-year amortised bond for up to Sh20 billion on October 21 during its monthly auction, the Central Bank has said. The move to sell the amortised bonds is an indication that the government wants to stagger the repayments due to worries that it will have too much debt maturing

in the same period in 2016. The central bank’s tightening stances has led the country pay higher yields on debt after shortterm interest rates jumped to above 21 per cent last week. Reuter’s reports. The amortised bond will be on sale until October 19, the Central Bank said, and the funds from the

sale will be used for budgetary support. Unlike regular one-year bonds where all the debt is repaid at the end of 12 months, the amortised bond will be redeemed after six months, while 50 per cent will be repaid on 26 July 2016. Alex Muiruri, a fsixed income analyst at Kestrel Capital, said the government was likely to

expect lower interest rates on the amortised bond than on the 364day Treasury bills, sold with a yield of 21.5 per cent at auction last week. “It’s a smart move on the side of the government, but I think the pricing will be the same as the 365-day bonds. It won’t change,” he said.

Poverty on decline, but future still bleak: report The number of poor people living in extreme poverty in Sub-Saharan Africa has fallen by 7 per cent with ongoing initiatives set to raise the incomes of consumers. The region has seen its extreme poverty rates drop from 42 to 35 per cent in recent month although it is now home to half of the world’s poorest people, who live on less than $1.90 (Sh195) a day. According to a World Bank report released last week, sub-Saharan Africa is making a steady, albeit slow climb towards ending extreme poverty within its borders. Countries such as Kenya have made major strides in the recent past, but for many poor people in East Africa’s largest economy, it is a drop in the bucket. Experts from the International Monetary Fund (IMF), one of the world’s biggest lenders, say that eliminating global poverty by 2030 will be a colossal challenge.

World Bank President Jim Yong Kim pegged the current poverty reduction numbers on economic growth in the developing world and investments in education and health. Kenya, for instance, has embarked on a number of development and construction projects that have created employment for thousands of people. Initiatives such as geothermal power development, the construction of the Standard Gauge Railway and the restructuring of water delivery systems are set to improve the livelihoods of many Kenyans. However, World Bank Economist Philip Schellekens has said across the globe, 700 million are still live in the “extremely poor” bracket with many of them residing in hard to reach locations and major conflict zones. He said lifting these people above the poverty line will be a challenging goal by 2030 but not one that is impossible to achieve.

UN, agencies strike cash deal to sort out refugee crisis The United Nations, the World Bank and the Islamic Development Bank have announced plans to raise billions of dollars to tackle the refugee crisis in the Middle East and North Africa. The agencies will issue new bonds to help displaced people and support reconstruction in the war-torn regions. The organisations announced the proposal on Saturday after policymakers from across the world met to discuss solutions to crises in countries that include Syria, Iraq, Yemen and Libya. World Bank President Jim Yong Kim said more than 15 million people had fled their homes, sending a massive influx of refugees into countries like Lebanon and Jordan, Reuters reports. The initiative will ask donor countries to provide guarantees for bonds raising money for certain projects, including reconstruction projects among other moves to resettle the refugees, explained Kim. Computer giant Dell in Sh6.9trn EMC takeover US computer giant Dell has agreed to buy data storage company EMC for Sh6.9 trillion ($67 billion). EMC shareholders will receive Sh3411 per share, Sh 2475 of which will be in cash. If approved by regulators, the deal would be the biggest in history between two technology companies. Mr Dell will be chairman and chief executive of the combined

group that, Dell said, would be the world’s ‘largest privatelycontrolled, integrated technology company’. The exact cost of the deal will depend on the value of shares in VMware, the software company controlled by EMC. VMware will remain an independent, listed company. The price per share agreed represents a 20 per cent premium on Friday’s EMC closing share price of Sh 2867 EMC shares were up about 4 per cent in pre-market

trading on Monday. The deal is expected to close sometime between May and October 2016 though analysts suggest the deal is a brave move by Dell. “Dell wants to become the old IBM Corp, a one-stop shop for corporate clients,” said Erik Gordon from the University of Michigan’s Ross School of Business. “That model fell apart a couple of decades ago. Reviving it would be a stunning coup for Dell.”

The Weetabix Food Company, one of the largest breakfast cereal manufacturers in the World, has unveiled of a £1.6 million (Sh253 million) project to modernise its manufacturing plant which will in turn, increase its production capacity by 60 per cent. The move comes amidst growing demand for Weetabix products from consumers. The company reports that their products have become a staple in 1 out of every 5 urban Kenyan homes. The manufacturer celebrated its 40th year in Kenya, last week during a reception dinner at the Villa Rosa Kempinski, where the group hosted a delegation of investors from Bright Foods Group led by their chairman Yong Jie Lyu, Baring Private Equity (Asia) and Weetabix Food Company chief executive Giles Turell amongst other global company leadership luminaries. The delegation unveiled the company’s recent investment at the Nairobi Plant during a factory tour where they renewed their commitment to invest in the country.

CBK to run Imperial bank after unlawful business allegations Central Bank of Kenya (CBK) has announced that it is putting Imperial Bank Limited under management for 12 months following reports of illegitimate business practices within the lender’s ranks. CBK today said authorities had been alerted regarding what the Bank is terming as “unsafe or unsound business conditions of the lender,” Reuters reports. It said it had appointed the state’s Kenya Deposit Insurance Corporation to take over management of the bank. The move, said the CBK in a statement, was made in the interest of its depositors, creditors and members of the public.

Mr Perfectionist, Kirui to attempt Amsterdam course record on Sunday Two-time world championship marathon gold medallist Abel Kirui will attempt Amsterdam Marathon course record with hopes that his new time will earn him a slot in Team Kenya for the 2016 Rio Olympics in Brazil. “I am preparing to challenge the course record,” said Kurui, otherwise referred to as Mr. Perfectionist by his peers. “This is the only time I am preparing for a race without any injury concern. I was just coming back from injury, but unfortunately I developed a stomach pain which weakened my energy a little bit,” the Administration Police officer remembers his last outing in the Netherlands where he finished a disappointing sixth last year. It seems he has learned from that upset, a stomach pain suffered in this race last year going into his second attempt on the

podium in Dutch: “I saw the area which I need to work on, like the last 37km to 40 km.” added Kirui on a video interview posted on the Race official social media account. History may repeat itself for Netherlands who faces being knocked out of a place in the France’s Euro 2016.
