uspended Energy and Petroleum Cabinet Secretary Davis Chirchir will have to wait even longer before he can be cleared of corruption allegations that forced him to step aside in March. This is after the Director of Public Prosecutions Keriako Tobiko today recommended that his file be left open pending further investigations. Mr Chirchir was put under investigations alongside Kenya Power managing director Ben Chumo over allegations that Kenya Pipeline Corporation (KPC) transferred Sh90 million to Kenya Power for unknown business contracts and that money mysteriously disappeared from the account of Kenya Power without trace. It is alleged that both Chirchir and Chumo used their positions to fraudulently obtain the money. The Ethics and AntiCorruption Commission (EACC) had recommended that Mr Chirchir’s file be closed for lack of evidence. “EACC investigated the allegation and recommended that the inquiry be closed without any further action for lack of evidence of criminal

In the circumstances, the DPP directed that the inquiry file be left open pending the outcome of the further investigations being conducted,” he said. The DPP has also directed EACC to conduct further investigations against Mombasa Governor Ali Hassan Joho whom the commission had recommended be cleared for lack of evidence. Joho was being investigated for irregular allocation of Mwembe Tayari Public Market in Mombasa to private owners. “Upon independent review of the file, the DPP noted a number of critical areas that needed to be covered before a final decision can be made. County services could stall as cash crunch bites Services could stall in counties if the National government goes ahead with plans to divert development funds meant for the devolved units as a result of the cash crunch, the Council of Governors has warned. Council chairman Peter Munya has consequently criticised the government’s move to cut on its spending to address the ongoing liquidity challenge. He said such a move will cripple activities at the counties, adding that most governors will not be able to pay salaries of county staff. Munya, who is also the Meru governor, said the government’s strategy to only release funds for recurrent expenditure will
stall service delivery at the counties. He said county governments like the National government are also in a cash crisis because they do not have money to pay salaries, service debts and even pay contractors. Munya said development projects in most counties have stalled due to lack of funds. He said the National government is yet to release funds to counties for August, September and October a situation that is putting the county governments and suppliers at loggerheads. The governors urged President Uhuru Kenyatta to convene an urgent meeting to discuss the state of the economy, the depreciating
shilling and the increasing public debt. Munya, who made the call, said President Uhuru should convene the intergovernmental summit, a forum where governors meet with the Head of State to discuss matters affecting the counties. He said it is high time the meeting which is supposed to be organised twice, was held to discuss the cash crisis and other issues affecting county operations. No summit has been held this year. Last week, Treasury Cabinet Secretary Henry Rotich blamed the current cash crunch on challenges in revenue collection, but said the situation would

Mandera leaders threaten to ditch Jubilee over census appeal case
Mandera county politicians have threatened to stage a mass walk out from the ruling Jubilee coalition over the contested 2009 census results which is now a subject in the Court of Appeal. Led by area governor Ali Roba and senator Billow Kerrow, the leaders have accused President Uhuru Kenyatta of continued remarks that the county was enjoying a huge share of the counties’ budgetary allocation. The leaders have asked the Jubilee government to withdraw a case it has sued area leaders on the controversial census results. Kerrow says the 2009 census results were announced countrywide but the government cancelled Mandera outcome over claims of exaggeration forcing them to go to court in 2013. Kerrow said the Sh9 billion the county
received during the 2015/16 financial year was not enough to cater for its recurrent and development expenditure. “The allocation they gave us is a drop in the ocean, we have been marginalised for 50 years yet when we are allocated funds to improve livelihoods, the president is complaining,” he said. Roba warned that selective allocation of funds will isolate the region from the rest of the country as youths continue wallowing in abject poverty. He said that the outcome of the appeal court that is due this will determine whether the region continues being in the Jubilee government. “It is the president who directed the Attorney General Githu Muigai to appeal against a case we had won in court which shows that this government is acting against people who brought it to power,”
said Roba. He wondered why the government does not have confidence in its own institutions such as the Kenya National Bureau of Statistics which carried the exercise in 2009. “The results can only be nullified through another census and not through protracted court battles,” said Roba. In the 2009 census results, Mandera county population was put at 1.1 million, the region is third on counties receiving the lion share of budgetary allocations among the 47 devolved units. Former member of the Judicial Service Commission (JSC) Ahmednasir Abdulahi (pictured) has asked Chief Justice Willy Mutunga to reign on corrupt judges at the High Court. Ahmednasir claimed that corruption is rife at the High Court and the Chief Justice should crack the whip. “Things are in a sorry state of affairs at High Court, it’s a crisis which must be addressed urgently” he said. He claimed most of the judges that perpetuate corruption at High Court were recruited under the new Constitution. “It is sad that these are young men and women that we had a lot of hope that they will adhere to the code of conduct anchored in the Law profession,” said Ahmednasir. To resolve the situation, he has told Mutunga to scrutinise all judgements that have raised eyebrows. “The only way to resolve the situation is to conduct a scrutiny of all judgements made, then the corrupt judges will just be known,” he said. Ahmednasir, however, did not mention any one of the judges he claimed are corrupt. He also urged
the Law Society of Kenya (LSK) to work together with the Chief Justice to end corruption. “There are about 20 lawyers in the country that are known to be corrupt, LSK should de-register them,” said Ahmednasir. He said the lawyers collude with the judges to make favourable judgements in total disregard of the law. “It is these lawyers who approach the judges to make favourable ruling over certain cas-
es,” he said. “While I was still at the JSC, I participated in making various reforms in the Judiciary, we tried to look for the best judges in the country, but unfortunately things have remained the same,” added Ahmednasir. Controversial ‘doctor’ James Mugo Ndichu alias Mugo wa Wairimu has finally been released from prison after depositing a title deed for the Sh5 million bond he had been granted. Nairobi Senior Principal Magistrate Joyce Ghandani ordered prison authorities to release the suspect who has been in the cells for the last two weeks after he failed to raise Sh1 million cash bail he was granted on October 5. He had been released on a bond of Sh5 million with an alternative cash bail of Sh1 million by Chief Magistrate Daniel Ogembo. He then deposited the title
deed which the authorities have verified and satified. “The investigating officer has already confirmed the authenticity of the surety given by the accused,” Assistant Director of Public Prosecutions Jacinta Nyamosi told the court. “I have verified the title deed presented by the accused herein. It has been certified by the relevant government department as genuine,” Senior Principal Magistrate Ms Joyce Ghandani said while ordering his release. Mugo is facing rape charges alongside 11 other counts of operating unregistered clinics and administering a

He has been in police custody since September 11 after his sensational arrest, sparked by public outrage over a video showing a man sexually abusing a sedated woman in a hospital examination table. The prosecution had opposed his release on bail fearing he could interfere with witness. Although the magistrate said they had not given sufficient evidence to back the claims, he warned Mugo that his bond terms will be cancelled should he contact witnesses in the case.

The cartel, Mutunga said, had set up parallel “courts” outside the law courts, blocking traffic offenders from prosecution.
Parents introduce minors to alcohol, new study reveals Shocking statistics have revealed that 68 per cent of minors indulging in alcohol and sexual activities in the country have been introduced by their parents and relatives. The report conducted and released by IPSOS Synovate shows that 36.7 per cent of minors taking alcohol are aged between 12 and 18 years. This are a majority of secondary school students and those joining tertiary institutions. Further, the statistics showed that most guardians have no time with their siblings and do not even understand that they indulge in alcohol. Woman wants justice for repeated assault by ‘untouchable’ UN staffer
A woman who claims to have been repeatedly assaulted by a foreign national working for the United Nations has written to the world body demanding justice. Speaking from her hospital bed at the Nairobi Women’s Hospital in Hurlingham, 26-year-old Ruth Gakii called for UN to “come out and condemn” the violence she claims was meted out on her by her Papua New Guinea partner and father of her three-year-old son. “The man works as a legal officer for the United Nations. That’s why you cannot sit down and reason with him. He just likes to sue everybody,” she says. Okoa Dada Kenya Founder Diane Okello, who took up her cause, said it’s critical for the UN to come out “strongly” against such vices. “How can UN Women for example have any moral standing when it has animals among its ranks?” she posed. Gakii has accused the man of having repeatedly assaulted her “even when I was pregnant; complicating it and forcing me to undergo a caesarean section.” She claims that the man,
with whom she’s embroiled in a child custody battle, kicked and punched her, “without provocation” when he dropped her son off at her Jacaranda Gardens residence on Sunday. “He accused me of being disrespectful when I moved to change my son out of his wet clothes.” The self-professed “hustler,” who deals in beauty products says it was not the first time he had struck her, but also not the first time she reported the matter without action being taken. “I reported the incident to Kiambiu Police Station the same day, but as far as I know he remains a free man with my son in his custody.” In response, Foreign Affairs Principal Secretary Karanja Kibicho told Capital FM News that diplomatic immunity did not shield foreign nationals from criminal prosecution as it was a courtesy Kenya extended and could withdraw under compelling circumstances. Police arrest two terror suspects in Mombasa Police in Mombasa have arrested two terror suspects among them Luqman Mohammed Shee, a key leader believed to be behind killing of police officers and informers in the coastal city. Luqman had in the past evaded several police dragnets within Majengo and Old Town. Regional DCI boss Henry Ondiek said officers acting on intelligence information ambushed the two and seized several weapons (swords), drugs and a military jacket. He said a police officer was stabbed in the hand during the arrest when they raided the hideout in Majengo. The two suspects will be investigated over terrorism and other criminal activities where innocent people have been stabbed and later robbed of valuables in the Coast region. According to police, Luqman is a close ally of Mohammed Soshi aka Ismael Mmanga, Mahir Khalid Riziki, Hamisi Mwacheti aka Rasta aka Bilal and Abubakar Majani who are all members of al-Shabaab Jeysh Ayman group. Soshi is believed to be behind the recent killing of a police officer guarding a bank in Bondeni before he allegedly snatched his G-3 rifle. The offenders will be granted time, place and adequate facilities to pay fines or bail before being locked up, the National Council on Administration of Justice has said. The council says all traffic offenders will pay fines instantly via a pay bill number before being issued with receipt to appear in court to answer

US VP Joe Biden rules out White House 2016 race US Vice-President Joe Biden has announced he will not run for the Democratic nomination in the 2016 White House race. Biden said his family was ready after the death of his son earlier this year, but he had now run out of time. He said it would be a mistake for Democrats to turn their backs on President Barack Obama’s record. Democrats seeking an alternative to frontrunner Hillary Clinton had been urging the 72-year-old to run. Though he will not be a candidate, Biden said he “will not be silent”.
“I intend to speak out clearly and forcefully on where we stand as a party and where we need to go as a nation.” He said any candidate would be making a “tragic mistake” to reject the Obama legacy and urged an end to political bickering. “I believe we have to end the divisive, partisan politics ripping apart this country,” he said as he stood in the Rose Garden of the White House, accompanied by his wife Jill and President Obama. Probe finds India beef lynching was planned A commission of inquiry in India has concluded that the lynching of a man over rumours he kept and consumed beef was premeditated and not spontaneous. A panel from the National Commission for Minorities visited the village of Bisada, near Delhi, where Mohammad Akhlaq, a Muslim, was beaten to death. It said a Hindu temple had been used to plan the attack. Government ministers from the Hindu nationalist BJP have said the incident was a spontaneous expression of anger. In recent weeks three Muslim men have been killed by Hindus accusing them of eating or smuggling beef.
Calais migrants set to receive heated tents Women and children at a migrant camp outside the French port city of Calais are to be given heated tents by the end of the week, officials say. Interior Minister Bernard Cazeneuve said the measures were to protect some of the 6,000 people at the camp from cold temperatures as winter approaches. Another 460 police officers are to be deployed there from Thursday, he added.
White House now condemns Assad over Moscow trip The White House has strongly condemned a visit to Moscow by Syrian President Bashar al-Assad. A spokesman criticised Russia for putting on a “red carpet welcome”. “We view the red carpet welcome for Assad, who has used chemical weapons against his own people, at odds with the stated goal by the Russians for a political transition in Syria,” White House spokesman Eric Schultz told reporters.

Students storm SA Parliament in fees row University students stormed the South African Parliament in Cape Town and trapped lawmakers inside to protest fee increases set to take effect next year. University of Cape Town youth groups rallied students for yesterday’s protest, which started on campus and snaked toward Parliament, about a mile away. “The group of protesters was massive,” said Jabulile Newman, 21, a university junior who attended the demonstrations. Students stormed Parliament grounds, pushing past guards and forcing open the gates. Once inside the grounds, they sat in front of the
building to block Parliament leaders from getting out. Police at the scene “started throwing grenades and firing tear gas,” Newman said. Protesters said police used force to try and disperse crowds “The protest was peaceful, but we were met with violence from the police,” said Aziz Matthews, 23, a senior at the university. “We had our hands raised to show we were not a threat and sat down many times to listen to speeches.” Over a dozen universities in the nation are shut down because of the protests. Students are using the hashtag #FeesMustFall
to rally and share experiences on social media. Protests against fee increases have raged since Monday as students barricade various entrances to campuses nationwide, including UCT and the University of the Witwatersrand in Johannesburg. Demonstrations escalated on Tuesday as students teamed up nationwide to protest the 10 per cent fee hike, which was later decreased to 6 per cent. “I can speak for a lot of students and say the university fees are exorbitant,” said Matthews. “My parents pay my university fees, but if they raised it, they would find it very difficult to pay.”
Germany reaffirms Holocaust culpability Germany has insisted it was responsible for the Holocaust, after Israel’s prime minister claimed a Palestinian leader told the Nazis to kill Europe’s Jews. Chancellor Angela Merkel said Germans were “very clear in our minds” that the Nazis were responsible. Benjamin Netanyahu had said Hitler had only wanted to expel Jews from Europe, but that Grand Mufti of Jerusalem Haj Amin alHusseini told him: “Burn them.” His remarks have been condemned by Israeli historians and politicians. But on Tuesday speech at the World Zionist Congress in Jerusalem, Mr Netanyahu claimed Husseini had provided the idea. “Hitler didn’t want to exterminate the Jews at the time--he wanted to expel the Jews,” he told the congress. “And Haj Amin al-Husseini went to Hitler and said: ‘If you expel them, they’ll all come here.’ “’So what should I do with them?’ he (Hitler) asked. President Uhuru assured Kenyans that his government has embarked on ensuring sustenance of macroeconomic stability through low inflation, sustainable fiscal

Firms cry foul over Safaricom’s dominance operator to quit the country after India’s Essar Telecoms sold its yuMobile business last year. Safaricom, in which Britain’s Vodafone has a 40-per cent stake, has dismissed accusations it hampers competition, saying it does not abuse its dominance. Safaricom’s revenues from calls amounted to a 91.63 per cent of the total market share in 2014, while its closest competitor, Airtel, had 8.33 per cent, according to data obtained from the Communications
Authority of Kenya (CAK). In text or short messaging services, Safaricom had more than a 90 per cent share of total market revenues from that segment, the regulator said. In mobile data, or internet services, Safaricom’s revenues were 85.50 per cent of the market share in 2014, while Airtel had 14.43 per cent, Orange had 0.01 percent and Equitel, operated by Equity Bank’s subsidiary Finserve, had 0.06 per cent.

Initially only available in the US, YouTube Red will cost $9.99 (about sh 1000) a month and will have no adverts. After Kenya,Liquid Telecom extends fibre internet upgrades across Africa Leading internet service provider, Liquid Telecom has announced that its Fiber to the Home (FTTH) service is now available to homes and businesses in Kigali, Rwanda just days after it completed its fibre protection protocols in Kenya in preparation for resultant floods caused by the infamous El Niño currents. The move was revealed during the Council Africa Summit in Kigali, Rwanda on yesterday. Liquid Telecom’s FTTH builds are currently taking place in Kenya, Rwanda, Uganda,
Zambia and Zimbabwe with more than 100km of new fibre laid every week. The service is already live in Zambia and Zimbabwe. With speeds of up to 100Mbps, the fastest Internet access ever available in the country, Liquid Telecom is investing more than $35 million (Sh3.6 billion) laying Rwanda’s first FTTH network. The company said in a statement that it had recognised the country’s role as an Internet services hub for East and Central Africa. The FTTH
build will continue in Kigali and will expand to other cities in the near future. Liquid Telecom’s FTTH service provides home connections comparable to those typically enjoyed by large multinational corporations, enabling consumers to use features such as live TV streaming, uninterrupted videoconferencing, realtime online gaming and both uploading and downloading of large files. BIZ BRIEFS High Internet cost leaves urban poor women behind men
The high cost of connectivity and their lack of skills has caused poor women in cities in developing countries to be 50 per cent less likely than poor men to use the Internet, new research has revealed. A survey from the Web Foundation, established by British World Wide Web inventor Tim Berners-Lee, released on Wednesday, found that while 59 per cent of such men surveyed by use the Internet, just 37 per cent of women do so. “Most poor urban women are confined to a technology ghetto that does little to help them break out of the real ghetto of poverty and gender discrimination,” said Anne Jellema, Web Foundation’s chief executive, adding that governments need to make digital skills the right of every girl and boy as part of a wider commitment to quality education for all.

CBK to inject Sh10 billion into market The Central Bank of Kenya (CBK) has sought to inject Sh10 billion into the money markets through a reverse repurchase (repo) programme, saying that liquidity was skewed. The reverse repo, which is the rate at which the central bank borrows money from commercial banks within the country, is the first since August last year and runs contrary to the central bank’s current monetary tightening stance though it did not post results of the offer immediately. It is a monetary policy instrument which can be used to control the money supply in the country. However, business owners have said the CBK may have been seeking to help smaller lenders, who have found it difficult to borrow from their larger counterparts after the seizure of Imperial Bank, a second-tier lender, last week. The weighted average interest rate on the interbank overnight borrowing market jumped to 14.8 per cent on Monday from 13.9 per cent on Friday.

Your child is only five years old and your biggest problem is the hawkers vending confectionaries along the streets who might tempt your little one to drain your pocket with sweets and cakes. When you feel your child tugging at your arm, you know that the hawkers have won but when you look down at them ready to say a big no, you realize that what your five year old wants is one of the I phones displayed on the open shelves along the street because sweets and gums are for children and smart phones are for big people. Welcome to the 21st century. How we got here doesn’t matter because we are already in the legendary tech age. What matters now is the question of whether your child is really ready to own a smartphone. Parents who grew up in poverty and found a way to turn their lives around
live by the virtue of giving their children what they themselves never had as children, but is this really wise? Whichever your answer, the matter of fact is that we always need to handle every situation in life with moderation especially where technology is involved. So when do you know that it is time to get your child a smartphone especially in this generation? For the purposes of security, there is really no age limit for mobile phone ownership among children who may need to call their parents and the police but let’s face it, when in danger, the first instinct is to scream or run into hiding and not making phone calls. This means that the main use of smartphones among children is communication with friends and in this case, the bottom line lies on the rule that you need to ascertain that the child is ready for the responsibilities

internet. That should be the least of your worries because your children can easily obtain such material for as low as 30 shilling from movie vendors. Today, bigger problems lurk behind the shadows of smartphones communication and internet access abilities such as cyber stalking, cyber bullying, molestation and extortion especially with the advent of online dating sites. Apart from ensuring that your child can responsibly use a smartphone based on their own intelligence, you can put other measures such as safety control apps on browsers and messaging software and going through the phones on demand to ensure that the smartphone does not negatively impact your child’s life. But here is a simple solution; the smartphone is not for children, period.

The said revenue, has allegedly been held by Safaricom for three months and Ringtone now wants the revenue directly sent to artistes and not first handed over to MCSK whom he termed as ‘corrupt individuals’. Ringtone has been battling MCSK claiming that the organization is misappropriating musicians’ funds. A successful meeting between Safaricom and Ringtone is said to have reached an amicable solution.

SPORTS BRIEFS Shabana want Western Sugar docked points over ineligible players Shabana FC registered their cry with the Football Kenya Federation (FKF) about their match against West Kenya Sugar played on August 2 at Awendo Green Stadium, citing the fielding of two ineligible players by their opponents. According to Shabana coach Andrew Kanuli, West Kenya Sugar fielded a goalkeeper and midfielder who were till then listed as St. Josephs players and that the Kisii-based side should be awarded three points plus two goals on that ground. “We had registered our appeal and it will only be fair if we are awarded the points because West Sugar Kenya fielded ineligible players against us and the rule is clear,” he said. If they get the points, Shabana FC will leapfrog Oserian FC to settle at position 10 with 39 points on the FKF table standings.
Kass Marathon gets bigger with over 10,000 expected
More than 10, 000 runners are expected to take part in this year’s Kass Marathon event set for November 15 in Eldoret, Uasin Gishu County. This will be double the number registered for last year’s 8th edition challenge in a town monickered “The City of Champions”. The local but lucrative event that awards winners of the main marathons both men and women Sh1.5 million is taking a notch higher in representation. The organisers of the event, led by chief executive Julius Lamaon
has hailed the growth of the event, adding that it will soon turn into an international. “The event is growing every year and we are expecting a big this year. The attraction on participants is amazing and we are going big,” Lamaon summed. Former 5000m World Champion Benjamin Limo currently the County Athletics chairman said with the registration starting in earnest in all Kass FM offices countrywide, elites’ runner from foreign countries are expected as it grow in status.
“We are seeing it attracting between 6,000-10000 participants I can assure you. And with event on its current status, the foreigners have shown interest. Solskjaer to face Celtic in Europa after Molde appointment
Former Manchester United striker Ole Gunnar Solskjaer has signed three and a half year deal as he start a second spell as Molde coach, a day before facing Celtic in the Europa League. Solskjaer, 42 played for Molde before leaving for Old Trafford where he spent 11-years. He had a season as a player with Molde before his transfer to Manchester United in 1996 and returned to the club after coaching the reserves at Old Trafford. Solskjaer, capped 67 times for his country, had most recently been coaching youths at Clausenengen, the Norwegian club where he began his playing career. Ex-CAF official Adamu under probe by Fifa Former Confederation of Africa Football (CAF) presidential hopeful Amos Adamu from Nigeria is under investigation by Fifa’s ethics committee.Adamu is alleged to have breached Fifa’s code of ethic, but no further details were provided, football’s world governing body revealed yesterday. “I do not know (about the investigation),” Adamu told BBC Sport. “I am not even aware of it.” The 62-year-old also said he had not been contacted by the Ethics Committee about the case. Adamu was a member of Fifa’s executive committee for four years until 2010, when he was banned from all football activities for three years over claims he asked for money in exchange for World Cup votes. Adamu’s suspension expired in October 2013. He was a high-ranking government official for Nigerian sport for 20 years and was once considered to be a leading candidate to succeed long-serving Issa Hayatou as president of the Confederation of African Football.
