atholic bishops have today threatened to lead mass demonstrations against the government if President Uhuru Kenyatta does not crack the whip on corrupt state officers within the next two weeks. They have also called on their faithful to boycott all government departments and offices that are stained with corruption as an indication of their dissatisfaction with the government’s lackluster move to fight graft. “Though the church respect the state, we are unhappy with their dismal handling of corruption cases in the country. We appeal to our members to boycott all government agencies that are stained with corruption.” Chairman of the Catholic Bishops Philip Anyolo who read their statement said. He was flanked by Cardinal John Njue where they reiterated their commitment on dialogue between the church and the state so as to address social economic pilferages which they say have escalated. “We as the church have a right and are just to be incorporated by all government ministries before any major decisions are made since all decisions have spiritual, cultural and economic implications” they said. The 27 bishops from all the arch dioceses in the country were speaking at a press conference after their plenary assembly at the University of Nairobi grounds. The catholic clergy too sought to enlighten Kenyans of their collective responsibility, to fight and guard against emerging trends and threats to the value systems terming them as cancerous to the unity and economy of the country. John Cardinal Njue also warned about the increasing incidences of hate speech urging the political elites to cease from harmful utterances that could lead to ethnic tensions in the country. Teachers dealt blow in pay dispute

The quest by teachers to have their salaries increased suffered a huge blow today after the Court of Appeal reversed an earlier ruling which had awarded them a 50-60 per cent pay rise. By the time of going to press, three out of the five-judge bench had declared an earier ruling by the Employment and Labour Relations Court “null and void” to effectively rule against the pay increase. Justices James Odek, Justus Azangalala and Philomena Mwilu all ruled that the lower court had no jurisdiction to rule on the pay rise. Justice Nduma Nderi had in July ruled that teachers salaries be increased by between 50-60 percent. But Justice Odek said the Trial Judge ignored the advice of the Salaries and Remuneration Commission (SRC) that the proposed pay award is unsustainable. He also observed that it is unconstitutional for the Teachers Service Commission (TSC) to make any payments without Parliament’s approval as doing so would amount to committing an offence. “It is unconstitutional to make any payments from the Contingency and Supplementary Budget,” said Odek.

Odek observed that no pay rise is legal if not advised by SRC. He agreed with the TSC and SRC stand that the proposed pay rise is unsustainable. “If a constitutional opinion is binding, then a constitutional advice is more binding, therefore, I find the SRC advice more binding,” ruled Odek. He said SRC has exclusive mandate to determine teachers pay

rise sustainability and not the TSC. Odek termed the June judgement “null and avoid” and implementing it was like directing the TSC to commit an offence. He also faulted the decision by the Labour Relations Court to backdate the teachers’ pay increment to 2013, saying by doing so, the court impaired TSC contractual and vested rights.

“The issue is whether backdating the pay impaired TSC contractual and vested right of TSC, it did as there was no Collective Bargaining Agreement (CBA) between TSC and unions and therefore backdating cannot apply in the absence of a CBA. He consequently said if any party is not satisfied with the ruling can proceed to Supreme Court. “If anyone is dissatisfied with this

ruling, the Supreme Court doors are open,” Judge Odek said. Mwilu observed that prior advice must be sought from SRC before TSC can make any adjustment on the teachers’ salary. Justice Azangala said the trial judge in the Labour and Relations Court failed to appreciate the implications of awarding teachers the pay rise. He further stated that the 50-60 percent has no basis. “The 30th June rulling is null and void and both parties to shoulder their own costs on the dismissal of the case,” Azangalala said. Teachers across the country were eagerly waiting on whether The Court of Appeal would uphold the decision made by Justice Nderi Nduma the Employment and Labour Relations Court which awarded them the 50-60 percent pay increment. The Teachers Service Commission (TSC) on June 30 appealed against the ruling by Justice Nderi Nduma. The pay dispute between teachers and the Government led to a nationwide strike for five weeks following a government hardline stance that it is not economically sustainable to implement the pay award.

Address graft or else…, Uhuru told Several civil society organisations have given President Uhuru Kenyatta a 30-day ultimatum to sort out corruption in government or face unspecified consequences. In a six-point demand statement, the civil societies asked Uhuru, among other things, to order an immediate and systematic lifestyle audit of all public officials starting from the Cabinet to establish corrupt officials. The activists have told the President to set in motion a process under his office to review all public procurement done in the last three years for compliance with the law and value for money values. According to the civil societies, it will assist in curbing the runaway corruption that has been witnessed in the government, the last being the inflated prices under the ministry of Devolution. The civil societies said increasedlooting of public funds witnessed in government is as a result of incompetence of some of the Cabinet secretaries’ refusal to take charge of their respective ministries. They have called on Uhuru to imme-

diately disband and reconstitute his Cabinet. He said the trend by public officials to pass the buck to junior officers when faced with allegations of corruption is worrying. “We are enraged by the circus surrounding the corruption scandals under the Ministry of Devolution and Planning and demand that the Cabinet Secretary and all those implicated vacate their offices immediately to allow for swift investigations and sanctions,” he said. However, they regretted that

laws against corruption and institutions that have been set up to lead in the fight against corruption have not being able to executive its mandate because of sabotage from government. “We are, however, disappointed that these institutions lack the energy and support required for them to discharge their mandates.; The Anti-Corruption and Economic Crimes Act, the Public Officer Ethics Act, The Public Procurement and Disposal Act and all other relevant laws must be enforced expeditiously and to the fullest,” he said. They sanctioned parliament to audit the cost of goods and services in the entire public sector so that those defrauding Kenyans can be brought to book. Carry your own cross, Jamleck tells embattled Wa Iria Kigumo MP Jamleck Kamau has asked embattled Murang’a Governor Mwangi wa Iria to carry his own cross and defend himself before the Senate instead of blaming other leaders for his woes. While absolving himself from claims he was behind the Wa Iria’s ouster, the Kigumo MP said the governor has a chance to defend himself before the Senate. “I did not have a hand in the impeachment of the governor, he should just carry his own cross and seize the opportunity by defending himself before the Senate,” he said. Infrastructure sharing will cut cost, Matiang’i tells telecom Let’s share infrastructure if we have to cut transaction cost for consumers, Information Cabinet Secretary Fred Matiang’i has told telecommunication service providers. Matiangi said sharing of infrastructure among the companies will be the only solution to cushion customers from the high rates of transaction being experienced by the market. He said if infrastructural issues involving service providers in the sector are addressed, it would reduce capital expenditure, making the services affordable to consumers, besides adopting new strategies to reduce the cost of services. In a speech read on his behalf by the Ministry’s Director of Administration Henry Mung’asia during the launch of an Access Gap Study in Nairobi yesterday, Matiang’i encouraged sector support for innovation in content and application development to grow the local market. “Creation of value addition will enable Kenya translate growing mobile subscription into economic advantage,” said the CS. He challenged the Communications Authority (CA) to design projects that integrate the whole spectrum of Kenya’s ecosystem in the sector, as well as those that integrated communities’ needs to access ICT services. CA director general Francis Wangusi said the Communications Act created a Universal Fund to be supported by operators through contribution of 0.5 per cent turn over. He said it had translated to the Sh2.9 billion that the Authority had as at October 30 and which it sought to bridge the internet access gap following a study undertaken in the country. “In keeping with Vision 2030, the Authority aim was to provide access and use of ICT services by all Kenyans by 2018” he said. Wangusi encouraged service providers to meet set licence obligations that had been designed to expedite the achievement of reduced gaps to unlock the current connectivity challenges. He challenged the naysayers to be on the lookout because as a regulator, they were committed to creating a conducive environment for ICT to thrive through progressive regulations. Currently, the ICT sector boasts of over 83 per cent mobile penetration and 69 per cent internet dispersion whereas its contribution to GDP continued to rise.

Judge Abuodha to rule on teachers’ September pay

Industrial and Labour court judge Nelson Abuodha will on November 20 rule on his directive that teachers who were on strike in September should receive their pay. The Teachers Service Commission (TSC) has applied to have the directive stayed pending the hearing and determination of an appeal they have lodged challenging the directive. Abuodha heard arguments on the application on Thursday with TSC insisting that it was a matter of urgency as the education sector risked being plunged back into chaos. In a sworn affidavit, TSC chief executive Nancy Macharia told the court that teachers unions had threatened to go slow or go back on strike should their members not receive their September salaries. But Macharia insisted that TSC could not be expected to pay salaries for services not rendered. “Section 19(1)(c) of the Employment Act allows an employer to deduct wages for each working day the whole of which the employee, without leave or other lawful cause, absents himself from the premises of the employer or other place proper and appointed for the performance of his work,” she cited. Forcing TSC to pay the September salaries, Macharia said, would be unfair to the taxpayers. “In the event we make the Sh13.75 billion payment for services not

27 Kenyans to be deported from Somalia over illegal stay

Burundians flee as four are killed in Bunjumbura Parts of two districts in Burundi’s capital, Bujumbura, have been temporarily sealed off after fighting left four people dead. Residents have been seen fleeing the affected districts to find shelter elsewhere. The killings are part of a cycle of violence that began in April with protests against President Pierre Nkurunziza’s thirdterm bid. The president has pledged to crack down on those behind the trouble. In Wednesday night’s violence, officials say two people were killed in an exchange of gunfire with police. A third person was killed by gunmen described by police as “insurgents” - and it is not yet clear what caused the death of the fourth person. The districts of Mutakura and Cibitoke are well known for their demonstrations against Nkurunziza’s plan to run for the presidency again. In July, he won a third term which opponents described as unconstitutional. Since then, there has been a series of killings of supporters and opponents of the government, including the assassination of a senior general. Analysts say in some areas of the capital, street protests have now turned into armed resistance. The president has given people who hold illegal weapons until Saturday to give them up, otherwise he has said security forces will use all means available to end the situation. Those fleeing the affected areas were carrying mattresses and cooking pots as they left. Some of them told him they were leaving because of what they feared could happen after Saturday’s deadline passed.

A Somali court has ordered the deportation of 27 Kenyans found to be in the country illegally. This is the first time in 25 years that Somalia is to expel foreigners for overstaying their visas. The men have also been fined $10 (about Sh1000) for each day they were in the country illegally. Job opportunities for foreigners have opened up as peace has gradually returned to Somalia. Judge Hashi Elmi Noor said the case was a warning to others who are found to be in the country illegally. It is not clear how long the deportees had stayed in Somalia. Correspondents say that a growing number of foreigners are taking up jobs in the construction and hotel industries, while others are getting teaching jobs in colleges and schools. According to a recent Somali law, work permits are now mandatory for all foreigners and employers are urged to give first priority to

Somali nationals. The government is trying to create job opportunities for young people, but the damage to the education system caused by the civil war has left many without crucial skills. Years of anarchy in Somalia followed the downfall of President Mohammed Siad Barre in 1991

and more than a million Somalis fled the country as a result, with nearly half a million ending up in Kenya. The current government, backed by the African Union, is slowly gaining control of Somalia as it battles with the Islamist militant group al-Shabaab.

The Kenyan government has accused some Somali refugees of links to al-Shabaab, which has staged several attacks in the country. About 400 Somalis were rounded up and sent to Mogadishu from the Nairobi’s Eastleigh area which is home to many ethnic Somalis.

Russian plane ‘had bomb in hold’ UK investigators looking at what caused a Russian airliner to crash in Egypt believe a bomb was put in the hold prior to take-off, the BBC has learned. The UK government suspended all flights to and from the Egyptian resort of Sharm elSheikh two days ago. The move came after it said the incident was likely to have been caused by terrorism. It had received intelligence based on intercepted communications between militants in the Sinai Peninsula. However, both Egypt and Russia have said it is too early to draw conclusions. The Metrojet Airbus A321 was flying from

Sharm el-Sheikh to St Petersburg when it came down in Sinai on Saturday, killing all 224 people on board. Most of the victims were Russian. Britons stranded in Sharm el-Sheikh since then are due to begin returning home, but will only be allowed to bring hand luggage. Although British officials have not ruled out the possibility of a technical fault bringing the plane down, they think that is increasingly unlikely. New intelligence was received on Wednesday and the UK government’s Joint Terrorism Analysis Centre has spent the past few days assessing what caused the plane to come down. Security service investigators suspect

The government needs to consider budget cuts to counter the high interest and exchange rates that are hurting consumers, businesses and the economy, the International Monetary Fund (IMF) has said. Though Kenya’s economy is performing better than the rest of sub-Saharan Africa, interest rates remain high and a weakening shilling does not bode well for consumers. Some banks are offering lending rates upwards of 25 per cent. The Fund says the economy will continue to grow comfortably despite external shocks. A strong economy translates to higher average incomes, allowing consumers to enjoy more goods and services and enjoy better standards of living. It also contributes to lower unemployment, less government borrowing and improved public services. IMF Kenya Resident Representative Armando Morales, however, says the government needs to consider budget cuts to counter the high interest and exchange rates. “Kenya has an advantage because they are not an oil exporter and China is not one of their main export markets. The slowdown in

China and the fall of oil prices will cause little harm to the country’s economy,” he said. Morales said he does not expect any major revision of the country’s growth forecast. The IMF had revised its forecast for Kenya’s growth to 6.5 per cent this year from 6.9 per cent in an earlier announcement. He said the budget approved by government considered a lower level of interest and exchange rates and in order to maintain the same deficit the government needs to reassess the priority of spending and identify areas of spending that are not productive. Morales has since urged the government to manage perception by giving information to the public to avoid rumours and speculation. Among the sectors supporting Kenya’s growth in the last five years include construction, IT, trade, financial and education. Some of the new trends in the first half of 2015 include agriculture over performing while transport recovered, financial, trade and ICT slowed slightly, manufacturing is still lagging behind and the real estate boom has reversed.

Colorado mints Sh7.5 trillion from high marijuana sale Since legalisation of Marijuana in Colorado three years ago, the country has voted a tremendously in favour of spending taxes raised from the sale of weed. Marijuana was legalised in Colorado in 2012 and the state has collected over Sh 7.5 trillion ($73.5 million) between January and July 2015, sources reveal. The raised kitty has been allocated to fund school constructions as well as

catering for substance abuse programmes in the state. However, Colorado had voted on spending Marijuana taxes before but an excess of tax revenue made by the industry made another vote necessary. The bill ‘Proposal BB’ determined how to spend $66million of the taxes collected. Voters approved spending Sh 4 trillion ($40million) on construction of new schools and Sh 1.2 trillion ($12million)

on drug prevention and addiction programmes. A further Sh 1.4 trillion ($14million) will be for discretionary spending by lawmakers. If voters had rejected the bill, the excess money would have been returned to taxpayers though a tax credit. Marijuana growers would also have received tax rebates. In two previous bills, voters have also chosen to spend marijuana taxes on school developments.

Global Zero hunger drive receives renewed boost

The United Nations’ Sustainable Development Goals (SDGs) have seen renewed support as human rights organisations and world leaders move to achieve one objective--an end to global hunger. Prompted by humanitarian-led initiatives and the UN, world leaders committed to 17 Global Goals to achieve 3 extraordinary things in the next 15 years, including an end to extreme poverty, fighting inequality and injustice and fixing climate change. In September, ahead of the World Food Day that was celebrated just days ago, the UN released a report dubbed Transforming our world: the 2030 Agenda for Sustainable Development. The organisation urged all countries across the globe to adopt the SDGs through their Agenda. “This Agenda is a plan of action for people, planet and prosperity. It also seeks to strengthen universal peace in larger freedom,” said the UN. “We are determined to end poverty and hunger, in all their forms and dimensions, and to ensure that all human beings can

fulfill their potential in dignity and equality and in a healthy environment,” the organisation added. The group said the 17 Sustainable Development Goals demonstrate the scale and ambition of this new universal agenda, adding that they seek to build on the Millennium Development Goals

and complete what they did not achieve. The agenda that aims to bring an end to world hunger has more recently received renewed support through the Global Goals organisation. The goal is the second in the list of 17 others, making it one of the most pressing issues to be

addressed. In Kenya alone, more than 18 million people live in extreme poverty and the World Food Programme (WFP) notes that an estimated 1.3 million suffer from food insecurity. Global Goals has stated that food production across the globe will need to increase by at least 60 per cent over the next 3 decades.

Prompted by humanitarian-led initiatives and the UN, world leaders committed to 17 Global Goals to achieve 3 extraordinary things in the next 15 years.

Varsities to scale up mushroom farming The Jomo Kenyatta University of Agriculture and Technology (JKUAT) is producing and commercialising sterilized substrate as well as offering free agriculture extension services in a bid to woo smallholder farmers into growing mushrooms. The inventiveness by JKUAT is aimed at luring more smallholder farmers to produce 700 tonnes more to satisfy the high domestic demand since Kenya produces only 500 tonnes annually against its ultimatum which stands at 12,000 tonnes. However, according to a recent

study by Egerton University, Kenya has the capacity to produce six times its current rate and dethrone Egypt as the leading exporter of the delicacy across the continent only if smallholder farmers are well equipped with pertinent skills and progeny to producing mushroom. This comes at a time when almost 95 per cent of commercial mushrooms across the country is produced by only two large scale growers. Scientist’s claim that mushrooms does not only require fewer resources to grow but also has

higher yields and nutritional values compared to contemporary crops mostly grown by smallholder farmers across the country. Furthermore, mushrooms take just 2-3 weeks to mature where an eighth of an acre can raku up to one tonne with a kilo retailing at Sh 600. Study revealed that most smallholder farmers are shy to adopt mushroom farming due to high initial production cost made worse by scarcity of spawn and high risks during the whole production process, factors that

hinder the production of the crop most. Besides free training, Egerton University introduced short course programmes on mushroom production for willing farmers in Kenya. The training focuses on Oyster and Button mushroom production with emphasis on spawn production, handling; cultivation ; harvesting procedures; diseases and pests management; Post harvest processing; value addition; marketing and economics of mushroom production.

Blackberry is currently one of the world’s least popular smartphones, new numbers have revealed. The company has admitted that its handsets are performing poorly in markets across the globe, including the United States, the UK and even in sub-Saharan Africa. The phone-maker’s CEO John Chen said he would pull out of the device market if things didn’t pick up soon since Blackberry sales currently account for less than 1 per cent of the global smartphone market. However, the company has managed to remain somewhat profitable, though it is not making as much revenue as it competitors. Blackberry recently proved its resilience with today’s release of a new model dubbed Priv by Blackberry. Chen has said he wants to sell five million Privs in a year, which is a small margin when compared with Apple which sold 48 million iPhones in its last quarter.

‘African countries borrowing could lead to huge crisis’

African governments have grown accustomed to amassing foreign debt in a reckless manner that could see a number of the continent’s countries fall into financial ruin. The current borrowing trend appears troubling, according to a number of local economists. This s due to the fact that in 2015, Africa’s sovereign debt levels rose to 44 per cent of GDP, a 10 per cent jump from five years ago when Africa’s debt-toGDP ratio stood at 34 per cent. In the 1970s and 1980s, Africa faced a similar debt crisis. “This prompted the adoption of structural adjustment austerity programs, spearheaded by the World Bank and IMF, which were meant to stabilize African economies,” states a Quartz report. In 1996, African countries were given a lifeline through various debt relief programmes and in 2005, they received aid through the Multilateral Debt Relief Initiative (MDRI), which wrote off existing debt in exchange for economic reforms.

Bankers convicted of conspiracy to commit fraud in New York Two bankers have been convicted of manipulating inter-bank lending rates. British traders, Anthony Allen and Anthony Conti, who both worked for Dutch lender Rabobank, were charged with conspiracy to commit wire and bank fraud and committing wire fraud, by a New York jury. The duo was accused of misreporting the London interbank offered rate (Libor) as it related to the US dollar. Allen and Conti, along with other traders around the world, lied about how much it cost them to borrow from other banks. During the trial their attorneys argued that what they had done should not be considered fraud because the panel collecting the data knew that many bankers lied about the rate.

A growing demand for internet connectivity has seen data service providers spread across the country at an unprecedented rate. The demand has seen Kenya transform into the country with highest bandwidth per person in Africa. On average, Kenya has the fastest internet speeds and some of the lowest connectivity costs. “Investment in the continent’s connectivity is creating multiple benefits that Kenya demonstrates as a clear example of a virtuous circle, where each investment accelerates the next, with an ever increasing footprint of beneficiaries,” said Liquid Telecom Kenya CEO, Ben Roberts. Roberts was speaking with regard to a report dubbed Lifting Barriers to Internet Development in Africa released earlier this year. The report says Kenya has outdone itself in ensuring it tackles infrastructure barriers that have hindered it from emerging as a leader in the internet market. At the beginning of 2015, the Communications Authority of Kenya (CAK) noted that internet penetration in Kenya stood at 52.3 per cent, placing it in the lead board in the region. The 4G standard, which represents the 4th Generation of mobile communication services, will allow users to access wireless connectivity at much higher speeds. The developments come at a time when other service providers have

gone to great lengths to appease consumers through package deals that include unlimited internet access and cheaper internet bundles among other incentives. Safaricom has since raised its fullyear income forecast due in part to a sharp rise in new subscribers. The demand for data, among other

services, ensured that Safaricom’s revenue jumped by 23 per cent to 97.22 billion, the telco aid on Thursday. Safaricom Chief Finance Officer, John Tombleson said the company has attracted 3.25 million new customers over the past year.

ho is Henry Ominde? I am a young dynamic 21 year old, passionate about music, singer and song writer. A member the Juukua band based in Mombasa. I am also a student studying Business Management. What inspired you to do music? Music stems from the heart. To me, it’s a calling that was further nurtured by self-drive and unification through love that music brings out. So far Juukua has released two songs and the third one was released last week. What are they about? Yes we have released three songs, the first one is called Expression, the second song is Minwa that seeks to honour our mothers and the latest release is Nyamala which is written in Swahili and Giriama. It seek to tell people to relax and encourages them in their day to day life. Your Band Juukua focuses on afro fusion. Why? Basically I would say we are African and proud of our roots. The band members have different tastes in music genres, I am a fan of Jazz but we sat and agreed that fusing these different genres into Afro-Fusion is the best way forward. Sauti Sol is one of the bands that inspired you. What difference will you bring into the industry that Sauti Sol has not? Difference…first the kind of message in our music is unique and it target the now upcoming generation. Even if we are inspired by them (Sauti Sol) we w i l l n o t

copy paste what they are doing. All we are asking is for the world to lend us their ears and we will make a difference. In your portfolio you mention that the band has undergone turbulent times. Tell us about that. Yes, Enos, Victoria, Juliet, Winnie and I have undergone a baptism by fire scenario, before we got to where we are now. Penetrating the industry is quite hard but now we have come this far and hopefully we will get further. How far exactly have you come? We have managed to have a concert in Nairobi where the audience received us well. We are also planning for another concert this month at the Bliss Resort in Nyali. We also hope to return to Nairobi for another concert early next year. How did you overcome the challenges? We stayed focused and persistent. Nothing comes easy and on behalf of the Juukua let me thank friends and family and our fans for standing with us. How did the audience in Mombasa and Nairobi receive you? Afro-Fusion in Mombasa has not flamed up properly but we are getting there. Nevertheless, Nairobi was quite a thrill. We were overwhelmed by people during our concert at Choices. What’s your parting shot? I would like to tell the youth to tap into their talents. Finally I would like to thank fans and request that they keep supporting upcoming young talent.

YOURSAY Proposed land laws are neither hurried nor actuated by mischief, good for country My attention has been drawn to Michael Oliewo’s article in the Business Daily of Friday, October 23 claiming that the Community Land Bill, the Physical and Spatial Planning (sic) Bill and the Land Laws (Amendment) Bill have been hurriedly prepared. While I don’t hold brief for the government, as a licensed surveyor and a member of National Assembly Lands Committee, I disagree with his George Oner position. The article is replete with appeals to emotion such as “the public was not amused”… It is full of false syllogisms such as “the NLC enjoy(s) powers that are deemed to be over and above its “contemporaries”. The article is also patently loaded with wrong interpretations of the Constitution and the law. This is why the article cannot go unchallenged. Oliewo acknowledges the turf wars between the ministry and National Land Commission is a source of public concern yet he fails to see that these wars arise out of the very mix-up of roles that the Land Laws (Amendment) Bill seeks to clarify. Had he read Article 67, he would realise that the Constitution does not confer on the NLC the wide powers that it seeks or bandies around. For instance, the role of NLC in relation to the registration of land is limited to advising “the National government. Reasonable Kenyans have time and again stated that NLC’s argument is based on the mistaken belief that the National Land Policy was imported lock, stock and barrel into the Constitution. Article 66 concerns the State’s power to regulate land use generally, subject to legislation to be passed by Parliament. Suffice to state that nothing in the Land Laws (Amendment) Bill seeks to interfere with the

eight functions conferred by article 67(2) (a) to (h) to the NLC. The author then goes on to harp on things that are not really the subject of any of the three Bills pending before the National Assembly, such as the NLC’s independence and its power to summon witnesses. Articles 249(1) and (2), as well as 252(3), are cited in support of the arguments for preservation of NLC’s independence and superiority over other commissions. None of this is of concern to the National Assembly at this point in time. Whatever “extrapolation of the deficiencies in the current statutes” has not only been provided by the Executive and the National Assembly over the 5 years or so that debate on land reforms has been going on, but it is also common knowledge amongst stakeholders. Regarding the County Land Management Boards, counties such as Nairobi City County rejected this structure. Furthermore, care should be taken in the implementation of the Constitution to avoid a proliferation of agencies duplicating functions. On the appointment process for the NLC commissioners, discerning readers should look at Article 250 on the composition, appointment and terms of office of commissions. The constitutional fallacy that there is a one-size-fits all appointment process for these commissions and offices needs to be exposed. As a legislator, I believe in the freedom of Kenyans to contribute to governance reform. However, such contributions should be objective, well reasoned and constructive. Mr Oner is the MP for Rangwe constituency and a licensed surveyor.

Let us judge ourselves before judging leaders The latest diatribe against Devolution Cabinet Secretary Anne Waiguru over unending corruption allegations in her ministry is a clear indication that as Kenyans, we are quick to point fingers at who we think is wrong or right, but never stop to think, analyse and ask hard questions about the wrong things happening around us.
