he Kenyan delegation in The Hague has registered a major victory after the Assembly of States Parties adopted a report reaffirming that recanted testimony against Deputy President William Ruto and Joshua Arap Sang will not be used. The resolution was adopted following intense lobbying by the Kenyan team which had earlier threatened to leave the conference. “Following the debate on the supplementary items “Review of the Application and implementation of Amendments to the Rules of Procedure and Evidence introduced at the 12th Assembly,” the Assembly recalled its resolution ICC-ASP/12/Res.7 dated November 27, 2013 which amended Rule 68 of the Rules of Procedure and Evidence, which entered into
force on the above date and consistent with the Rome Statute reaffirmed its understanding that the amended rule shall not be applied retroactively,” the resolution stated in part. Foreign Affairs Cabinet Secretary Amina Mohammed praised the resolution, saying it affirmed the assembly’s powers. “In making the resolution, ASP has exercised the legislative powers of the Assembly,” she said. She, however, expressed concern over what she termed “mistrust amongst States Parties” which makes it difficult to pursue a common agenda. “There are those who feared that this ASP was being urged by Kenya to overreach its mandate. Pope Francis has ended his three-day visit to Kenya with a stern warning against corruption, saying it is a path to death. In his address to the youth at the Kasarani Stadium Friday morning, the Pontiff openly talked about graft and asked Kenyans not to taste the sugar called corruption. “Corruption is not a way of life but a path to death, when we accept a bribe and put in our pocket, we destroy our hearts,” Pope Francis told a packed gathering at the stadium. President Uhuru Kenyatta and Nairobi Governor Evans Kidero led thousands of other Kenyans who thronged the stadium to catch a glimpse of Pope Francis. Pope Francis did not disappoint in his address when he condemned corruption in front of the leaders. “To end corruption, you must be the first to
change. If you do not change, the person next to you cannot change,” he said. The Pontiff urged Kenyans to pray so that God can give them courage to stay away from corruption. “Pray that God may give you courage to stay incorruptible, corruption robs us of peace, and how does one come out of this difficult situation of giving what you did not received?” he posed. A part from corruption, the pontiff also talked about wide range of issues affecting the country including tribalism and youth radicalisation. To tackle radicalisation in the country, Pope Francis told the government to provide the youth with education and jobs. “Young people leave their families, friends and lives behind so that they can learn how to kill, to stop them from being recruited, provide them with education and jobs,” Pope Francis said. Land grabbers robbing the poor Pope Francis pulled no punches in Kangemi when he took on private developers and water cartels in the slums. The Holy Father said it was regrettable that private developers grab even school land in what appeared to be a reference to the widely publicised protests against the grabbing of the Langata Road Primary School playground during which school children were teargassed. He said the greed of these private developers was confounding and wondered what would drive them to take away what little the less fortunate have. “This becomes even worse when we see the unjust distribution of land which leads in many cases to entire families having to pay excessive and unfair rents for utterly unfit housing,” he said. The Pope said it wasn’t acceptable for politicians to promise land reform simply to win votes or for those who hold political office to promise it simply for, “containment,” purposes. He said it was necessary for them to move beyond mere lip service and effect change. “We need to go beyond the mere proclamation
of rights which are not respected in practice, to implementing concrete and systematic initiatives. The social and environmental debt owed to the poor of cities can be paid by respecting their sacred right to the three Ls: Land, Lodging, Labour,” he said. On the subject of water cartels, he said it was deplorable to profit by stripping others of their dignity and right to water, sanitation and general cleanliness. “To deny a family water, under any bureaucratic pretext whatsoever, is a great injustice, especially when one profits from this need,” he said. The Holy Father said those of such greed had much to learn from the poor who in many cases are the greatest givers; sharing what little they had with their neighbours because they’d known need themselves. “Values grounded in the fact that each human being is more important than the god of money. Thank you for reminding us that another culture is possible. Values which are not quoted in the stock exchange, are not subject to speculation, and have no market price,” he said.
Pontiff preaches harmony, strong family values at mass Thousands of Catholic faithful celebrated Mass with Pope Francis on the second day of his official visit to Kenya. In his message the Pope called for unity, tolerance and strengthening of family values for a better society. President Uhuru Kenyatta, Deputy President William Ruto and First Lady Margaret Kenyatta joined the Catholic faithful in celebrating the Mass at the University of Nairobi sports ground. Thousands of enthusiastic Kenyans filled Nairobi streets from as early as 3:00 am despite the rains that pounded the city the whole night. The pilgrims streamed to the venue singing hymns and braving the chilly weather in readiness to celebrate the papal Mass. Uhuru Park and Central park were filled to capacity as faithful keenly watched and participated in the celebration through huge mounted TV screens. In his homily, Pope Francis called on Kenyans to continue embracing strong family values based on the word of God and African traditions. He said couples need to cherish one another to build an environment of stable families saying God’s desire is to have strong families built on the foundation of his holy word. “God wants all of us to build our lives in the foundation of his word, that is the charge the Lord gives to each of us,” said Pope Francis. He also challenged Kenyans to show
concern for the poor and learn to live in harmony and respect with one another. “May God bless all Kenyans with His peace, stand strong in faith. Do not be afraid, for you belong to the Lord. The Pope also urged the youth to build a just society that is inclusive. “Here in the heart of this university where the minds and hearts of the young are being shaped, I appeal to the young people of this generation to build a society that is more just and inclusive. May you always be concerned for the welfare of the poor,” he said. “In obedience to the Word, we are called to resist practices which foster arrogance in men, and hurt or demean women,” he said. The pontiff denounced abortion and corruption among other vices in the society. John Cardinal Njue expressed deep gratitude to Pope Francis for visiting Kenya and conducting public Mass. “We are greatly indebted to you for this gesture, your visit here has been a source of strength and spiritual nourishment,” said Cardinal Njue. He thanked President Kenyatta for ensuring the success of the Pope’s visit and constantly monitoring preparations for the pontiff. A celebratory mood pervaded the stadium as the youth and dignitaries danced to Kenyan gospel songs as they awaited the arrival of Pope Francis. The mugithi train was formed when the Master of Ceremonies invited the Bishops in attendance to dance to Evangelist Joseph Wasira’s Omundo Omulosi before asking the Head of State to join in. President Kenyatta then led the Bishops, the First Lady, his Sports, Arts and Culture Cabinet Secretary Hassan Wario and others in dancing in a line to the mugithi and Emmy Kosgei’s Taunet Nelel. The train came to a stop when the Pope arrived and the youth treated him to the Mexican wave they’d been practicing prior to his arrival, while he was at St. Joseph’s parish in Kangemi. It was one of the notable moments that have marked Pope Francis’ historic visit to Kenya. Illegal ivory, diamond trade fuelling conflicts, says Pope Pope Francis says that the illegal trade in ivory and diamonds fuels conflict and could destroy Africa’s environment. Speaking on the second day of his visit to Kenya, the Pope linked trafficking to “organised crime and terrorism”. He also warned world leaders not to let special interests prevail over common good in next week’s climate talks. The Pope earlier addressed a Mass in Nairobi where he urged people to create a “just” and “inclusive” society. He turned his attention to environmental issues when he was talking at the headquarters of the UN Environment Programme in the Kenyan capital. In his fourth speech of the day, the pontiff said that “Africa offers the world a beauty and natural richness” which inspired people to praise God. But that was being threatened, by “human selfishness of every type” as people’s poverty was being exploited to push them into the illegal trade of diamonds, rare metals, timber and ivory, he said. “We cannot be silent about forms of illegal trafficking which arise in situations of poverty and in turn lead to greater poverty and exclusion,” Pope Francis said. The pontiff, in Kenya on the first stop on a three-nation tour of Africa, also had a hard hitting message ahead of next week’s climate talks in Paris, saying it would be “catastrophic” if the needs of poorer nations were ignored. Repeating a warning from earlier this year he said: “The climate is a common good, belonging to all and meant for all.”

Earlier on Thursday the Pope celebrated Mass at a university campus with tens of thousands of people who had waited in the rain from the early hours of Thursday morning. Pope Francis made a plea for traditional values and urged Kenyans to work for peace and reconciliation on his first trip as pontiff to Africa, amid a rise in militant violence. Before the Mass, Pope Francis met religious leaders from other faiths and other Christian denominations, who he said should be “prophets of peace” in a violent and hate-driven world. Referring to attacks carried out by the militant Islamist group al-Shabaab in Kenya, he said that God’s name “must never be used to justify hatred and violence”. Although security remained very tight for the Mass, the pontiff played down security fears, joking that he was “more worried about the mosquitoes”.

Kenya and Africa believe that rather than institutional isolation propounded by some delegations, this ASP has demonstrated that what is needed to effectuate this system, is institutional collaboration,” she said. “We are, therefore, confident that a court wedded to this understanding shall respect the powers of the Assembly as an equal governance institution based on the principle of separation of powers and in deference to judicial independence,” said Mrs Mohammed. She said while serious doubts have been cast on the credibility of the commitments of this Assembly, it has become quite clear that Kenya and Africa continues to hold the Rome Statute framework as a critical bastion of justice. “Good faith, cooperation, and mutual respect have today triumphed over cynicism and bias. Our faith in the Rome Statute system which had been jolted can, however, only be reinforced if this negotiation’s outcomes receives judicial imprimatur in Court,” she said. She said Kenya had initially proposed for adoption by the Assembly comprehensive language, which more completely captured the consensus from two years ago. “It is imperative to note that not one State Party has contradicted our position that two years ago, the agreement was that the amendment would not be applied to the Kenyan Situation,” she said. Mohammed said the proposals were couched in specific text which has been modified to accommodate the views and concerns of other delegations. “In exercise of the legislative powers of the ASP in article 112 of the Rome Statute, this 14th Assembly after painstaking negotiation, has provided unambiguous
clarity to the temporal scope of the application of rule 68, and that it does not apply retroactively to the cases that had commenced before November 2013, including all those in the Kenyan Situation who were under investigation or prosecution at that time,” the Foreign Affairs CS said. While welcoming the ASP’s approval, Senate Majority Leader Kithure Kindiki said the new resolution will have a huge impact on the Kenyan cases at the ICC. “We have also had the support of other countries outside Africa from the Caribbean, Europe to other parts of the world. We also want to say that although we know that a number of people and organisations did not support us, that now is behind us. It does not matter anymore,” he said National Assembly Majority Leader
Aden Duale was equally elated at the win registered by Kenya and what it means for Ruto and Sang. “Kenya’s interpretation of Rule 68 has prevailed and therefore any use of recanted evidence cannot and must not be acceptable at the International Criminal Court. Now that the ASP has confirmed that Rule 68 cannot be applied retroactively, it means that it cannot be applied to the Kenyan cases,” Duale stated. The deadlock, which lasted hours, delayed the conclusion of the ASP meeting and tension was high as Kenyans waited on the final decision of the ASP Bureau to see if the bid by the Government to secure a resolution favourable to Ruto and Sang was successful or not. Kenya argued that the additional text left room for the judges to exercise their
discretion, opening the possibility of prejudicing the fairness of trials against Ruto and Sang. Several informal sessions during the ASP that Kenyan representatives exploited to lobby their cause appeared to have borne no fruit, neither were the painstaking negotiations in the ASP Bureau that was handling the requests by Kenyan officials. Kenya sought that the use of the recanted evidence not to be applied retroactively in the cases facing Ruto and Sang. ICC Chief Prosecutor Fatou Bensouda was allowed by ICC trial judges to use prior statements of five witnesses who recanted their evidence in the past, a move that has been strongly opposed by Ruto and Sang as well as the government as a miscarriage of justice.

President Vladimir Putin said Russian planes were easily identifiable and the jet’s flight coordinates had been passed on to Turkey’s ally, the US. Turkey’s president said earlier if it had known the plane was Russian “maybe we would have warned it differently”. Mr Putin was speaking after meeting his French counterpart and pledging closer co-operation against Islamic State. IS claimed the 13 November attacks in Paris which killed 130 people. Russia and France have agreed to co-operate more closely in fighting terrorism in Syria. The two countries will exchange intelligence on Islamic State - and co-ordinate air strikes. But differences remain over the fate of the Syrian leader. President Hollande made it clear that Bashar al-Assad could play no role in his country’s future. President Putin said that was up to the Syrian people to decide. And there is no sign of the kind of “grand coalition” against terror that France had been calling for, one that would include America. Speaking at a news conference after the talks, President Putin even suggested that Turkey had shot down the Russian bomber this week after receiving information about its location from the US. missile from a Turkish F-16 fighter jet. The Turkish military said it sent several warnings to the jet before firing, some 17 seconds after the plane entered Turkish air space. A surviving Russian pilot said he had received no such warning and was adamant they did not stray out of Syrian air space. Turkey’s President Recep Tayyip Erdogan has rejected calls by Russia to apologise, saying Turkey does not need to say sorry for the violation of its airspace. However, he told France 24 television: “If we had known it was a Russian plane, maybe we would have warned it differently”. But Mr Putin insisted it was “impossible” for Turkey not to have known it was shooting at a Russian
plane. “It’s got insignia, and you can see that very clearly”. He went on: “In advance, in accordance with our agreement with the US, we gave information on where our planes would be working - at what altitude, and in what areas. Turkey is part of that coalition and they had to know it was the Russian airforce working in that area. “If it was an American aircraft, would they have struck?” Mr Putin told the news conference he was ready to co-operate more closely with the US-led coalition “but of course incidents like the destruction of our aircraft and the deaths of our servicemen... are absolutely unacceptable”. Earlier on Thursday, Russia’s military suspended all
communication channels with the Turkish military, including a “hot line” to help avoid air accidents. Russia’s prime minister also warned the government was planning wide-ranging economic sanctions against Turkey within the coming days. He warned that food products, Turkish interests in Russia and a number of joint investment projects could be affected. Russia has also advised its nationals against visiting Turkey, and urged those already there to return home “due to the terrorist threats that remain on Turkish territory”. Turkey and Russia have important economic links. Russia is Turkey’s second largest trading partner, while Turkey is the biggest foreign destination for Russian tourists.

France holds memorial for Paris victims
France is to hold a national memorial service for the 130 people who died in the Paris attacks two weeks ago. Friday’s service in central Paris will bring together 1,000 people, including President Francois Hollande as well as survivors and victims’ families. A minute’s silence will be held and the names of all the victims read out. Attackers with assault rifles and suicide belts targeted a number of sites in the capital. Islamic State later said it was behind the assault. In a series of coordinated attacks on 13 November, the gunmen opened fire on restaurants and bars in the city and stormed a concert hall, where 89 people were shot dead. Three more attackers blew themselves up outside the Stade de France stadium in Saint-Denis, north of Paris, after staff denied them entry to a football match between France and Germany. More than 350 people were injured in the attacks - the worst in recent French history. During Friday’s service at the Invalides complex, President Francois Hollande will address the victims’ families. He has asked citizens across the country to “participate by decorating their homes with the blue-white-andred flag”. “We have tried to suggest something that will let every French person take part in Friday’s ceremony,” government spokesman Stephane Le Foll said. However, not all the victims’ families have accepted the invitation to attend the service at the grand complex that houses a military museum and Napoleon’s tomb. The family of one victim told French media they had refused, saying not enough had been done to protect the nation in the wake of other attacks earlier this year. At least nine people are believed to have been directly involved in carrying out the latest attacks.

French joblessness reaches record levels: The number of jobless in France rose to a new record in October even as the wider measure of people looking for work showed tentative signs of stabilising. Figures from the labour ministry showed 42,000 additional people were out of work last month, bringing the total number of jobless to 3.59m. The increase was the biggest monthly jump in at least two years and will doubtless deal a blow to President Francois Hollande’s pledge to set the economy back on track and create more jobs. The I-REIT provides an instrument for investing in the real estate market, which offers both liquidity and a stable income stream. The IPO of the investment, dubbed Stanlib Fahari Income-REIT, kicked off trading at the Nairobi Securities Exchange (NSE) earlier today. Stanlib Fahari I-REIT, the first of its kind in the Kenyan market has received a significant amount of interest from investors, local and foreign, institutional and retail. “This demonstrates the appetite for investable assets in this market,”
Stanlib Fahari I-REIT CEO Anton Borkum said while commenting on the listing. “We are excited to be able to offer Kenyans an investment opportunity to own a stake in prime property within a regulated, stable incomeearning investment vehicle. We believe that this maiden listing will set the foundation for future I-REIT listings in this market,” he said. The IPO, which sought to raise Sh2.6 billion, exceeded this threshold, by garnering a successful placement of Sh3.6 billion, following the commitment from both institutional and retail investors alike. World Bank targets Sh1.6 tr to help Africa fight climate change World Bank Chief Dr Jim Yong Kim wants Sh 1.6 trillion ($16 billion) to help the African continent deal with climate change. The scheme will prevent millions of Africans from sliding into extreme poverty through by boosting continents resilience to global warming as well as the increasing renewable energy. The African Climate Business Plans will be presented at COP21, the global climate talks in Paris aiming to reach agreement on how to limit global temperatures increase to two degrees Celsius. “The thing that we wanted to make sure was that Africa wasn’t forgotten in the midst of these conversations,” Dr Jim Yong Kim, the president of the World Bank told the BBC. Yong has promised to make sure the conversation is not just about reducing emission but also put measures in place to cope with the consequences of warming. However, data shows that the continent emits 3 per cent of the world’s greenhouse gas emissions yet even the smallest rise in global temperatures could have far-reaching consequences in sub-Saharan Africa. Research by the Bank found that without measures to help countries prepare for climate change, 43 million people, mostly in Ethiopia, Nigeria, Tanzania, Angola, and Uganda could fall into extreme poverty by 2030. This will be due to droughts, increasing food prices, and stunting children’s growth. The World Bank is committing a third of the money ($5.7bn) from the International Development Association (IDA), the arm of the World Bank Group that supports the poorest countries. World Bank chief said looking ahead to climate talks in Paris, reaching a deal won’t be easy though he ascertains that he is optimistic about it. “There’s not a single country in the world that wants to be the stumbling block to getting to an agreement.” Adding that “We think that there is a path to get there.” But if previous climate summits are any guide, Dr Kim’s optimism may be sorely tested next week in Paris.

However, the I-REIT Scheme may undertake secondary offers as and when the need arises. Prospective investors should note that there is currently no active secondary market for a REIT in Kenya,”Stanlib said in a statement.
Barclays slapped with Sh11b fine over its ‘elephant deal’ An elephant deal executed three years ago has landed Barclays £72 million (Sh11.1 billion) in penalties after city regulators concluded that the bank ran the risk of being used to launder money. This was the largest deal of its kind in history that Barclay’s wealth management operation had executed where the names of the clients were so sensitive and were kept confidential even inside the bank where Barclays made a £ 50 million (Sh7.7 billion) profit per each deal handled. For deal to be classified internally as elephant, it has to be worth £20 million or more but this was worth £1.9 billion (Sh292 billion), so large that it aroused the interest of the Financial Conduct
Authority (FCA). However, the FCA found out that instead of conducting a thorough check on the clients, Barclays relaxed its assessments, breaching its own controls hence resulting largest fine for financial crime failings. In total, this makes it the seventh penalty imposed on the bank since 2009 bringing its penalty bill from the FCA and its predecessor, the Financial Service Authority to nearly £500 million (Sh77 billion). Mark Steward, the FCA’s new director of enforcement and market oversight, said: “Barclays ignored its own process designed to safeguard against the risk of financial crime and overlooked
obvious red flags to win new business and generate significant revenue. This is wholly unacceptable.” One manager described it as “the deal of the century” and the clients were offered up to £37.7 million (5.8 billion) in compensation if the bank failed to comply with confidentiality restrictions. A safe was used to store details of the clients in hard copy – rather than on computer files – but “few people within Barclays knew of the existence and location of the safe”. However, according to Barclays FCA made no finding that Barclays facilitated any financial crime in relation to the transaction or the clients on whose behalf it was executed.
etax filing tops list of reforms
Electronic tax filing and payments were the most common tax reforms undertaken by countries worldwide during the past year, according to the latest edition of the Paying Taxes report from the World Bank Group and PwC (PricewaterhouseCoopers). As a result, paying taxes became easier for medium sized companies globally, but the focus has moved from reducing tax rates for companies to embracing technology and relieving their compliance burden. The report also shows that low-income economies continue to face the biggest reform challenges. The World Bank’s announcement came
ahead of the Kenya Revenue Authority’s (KRA) move to open negotiations with County governments in a bid to begin revenue collection on behalf of the devolved units. The Authority has been engaging with individual County governments on various areas of collaboration, as it seeks to provide revenue collection agency services as provided for under the Public Finance Management Law. The move will allow the State to collect unprecedented amounts of tax revenue, which can go towards the country’s development, thereby improving the living standards of Kenyans while supporting employment opportunities.
The Authority is reviewing its award winning iTax platform system to make provisions for the collection of County specific revenues. The Paying Taxes 2016 report finds that the electronic method of tax compliance are more effective and even more convenient than analog procedures. The study found that on average, a model company makes 25.6 tax payments per year and takes 261 hours to comply with its tax requirements, a drop of two hours compared to last year. Over a 10 year period covered by the study, the global average time to comply has declined by 61 hours and the number of payments sub-indicator by 8.2 payments.

The World Trade Organisation’s (WTO) plans to lift trade barriers between particular countries are deadlocked and ministers are unlikely to find a way out of the stalemate when they meet in Nairobi next month, the organisation’s Director-General Roberto Azevedo has said. WTO has been trying but failing to agree on a worldwide package of trade reforms since a meeting in Doha in 2001 hatched an ambitious plan for knocking down trade barriers. Since then, the Geneva-based organisation has still managed to agree a few changes to the global trading rules, Reuters reports. “We clearly are stuck in the negotiations at this point in time. I think it will be very difficult to reconcile the views. I would say impossible at this point in time,” Azevedo told a news conference on Thursday. Two years ago, the WTO agreed to standardise and streamline customs procedures. The meeting in Nairobi could still see agreements on other issues, such as an end to tariffs on IT exports. The lifting of tariffs could see the cost of imported consumer electronics fall. Brazil and the European Union
are also leading a push to end agricultural export subsidies. Azevedo said some of these initiatives may not take shape and changes are “unlikely to happen”. He added that the biggest potential winners from a global trade deal would be the poorest countries, most of whom are excluded from regional trade talks going on elsewhere, such as the US-led Trans-Pacific Partnership. The WTO is an international
intergovernmental organisation dealing with the formulation and implementation of international trade rules. It also deals with the arbitration of trade disputes between its members. The organisation seeks to raise the standards of living of those residing in its member States, ensuring full employment, large and steadily growing the volume of real income. The business of the WTO
is conducted through the Ministerial Conference, which is the highest decision making body of the organization. The Conference is held every two years. In between the Ministerial Conference, the affairs of the organization are managed by the WTO General Council. The 10th WTO Ministerial Conference will be held in Nairobi, Kenya from December 15to December 18, 2015.
East African startups travel to Silicon Valley Two East African Startups, including Kenyan mobile medicine verification service, Sproxil and Ugandan renewable energy startup, SolarNow were among the region’s incubators that travelled to Silicon Valley in the US as part of the SAP Social Entrepreneurship Fellowship programme. The 100-day programme for social entrepreneurs in East Africa was launched in April by global software and tech solutions firm SAP in collaboration with non-profit venture capital firm Acumen, designed to help the companies grow and scale. As part of the fellowship, startup entrepreneurs travelled to Silicon Valley to take part in a leadership development programme before returning to execute their plans for growth in their respective countries. The selected enterprises, which represent a variety of sectors all take innovative approaches to addressing the problems of poverty.

Kenya Power to set subsidiary for telecom Kenya Power is in a new bid to set up a subsidiary to handle its telecommunications business which includes a fibre optic network laid across the country. In a statement to newsrooms, Kenya Power Chief Executive Officer Dr Ben Chumo said the new subsidiary firm will handle Kenya Power’s telecoms business as well as spearhead the transformation of its energy research institute into a fullyfledged university.

“The purpose of such a subsidiary being to operate and run the business of the company’s telecommunications business unit,” read part of the statement. Kenya Power has since 2010 fixed over 1,800 kilometres of fibre optics along its high-voltage power lines traversing through 24 of Kenya’s 47 counties and is seeking to extend this to all regions. The State-owned utility firm earned Sh259.4 million in
revenue in the year ended June from leasing out extra capacity on its fibre optic network, an income line it now intends to grow to Sh1 billion by 2017. The new subsidiary will also oversee the elevation of the Kenya Power’s Institute of Energy Studies and Research, which is located in Ruaraka, into a regional power training hub. Kenya Power in 2002 was licensed as a network facility provider by the communications sector
regulator allowing it to its lease excess broadband capacity to players in the telecoms industry. The firm does not, however, use all the capacity and has over the years been leasing out the extra capabilities to mobile telecommunication firms and Internet service providers. Its current customers include Safaricom, Liquid Telecom, Jamii Telecommunications, Wananchi Group and Airtel.
Banks urged to support small businesses A Kenya Financial Sector Deepening (FSD) programme has urged Commercial banks to support smaller enterprises. The (FSD) programme, which was established in early 2005 to support the development of financial markets in Kenya as a means to stimulate wealth creation and reduce poverty, has noted the growth of local lenders and their potentially significant role in reaching out to smaller enterprises. Working in partnership with the financial services industry, the programme’s goal is to expand access to financial services among lower income households and smaller enterprises. It operates as an independent
trust under the supervision of professional trustees, KPMG Kenya, with policy guidance from a Programme Investment Committee (PIC). Current funders include the UK’s Department for International Development (DFID), the Swedish International Development Agency (SIDA), and the Bill and Melinda Gates Foundation. “The banking sector has been significantly modernised and strengthened since the 1980s and 1990s when it faced problems of under-capitalisation, high levels of non-performing loans, weak corporate governance, and inadequate competition, among other issues,” said the recently-
released report. Reforms adopted over the past decades have substantially improved the stability and efficiency of the Kenyan banking system yet access to banking services like loans remains beyond the reach of many consumers. “Today banks are generally well-capitalised with an overall capital adequacy ratio of 20 per cent in 2014, considerably higher than the 12 per cent required by the prudential guidelines. While the government still has a significant stake in Kenya Commercial Bank (KCB) , Kenya’s largest bank by size of assets, as well as other banks, such as National Bank of Kenya (NBK).
Turing Pharmaceuticals, the company that sparked an outcry by raising the price of its HIV drug in the US by 5,000 per cent, says it will cut its price for some users. The drug company, run by CEO, Martin Shkreli, bought the rights to 62-year old drug Daraprim and increased the price per pill from $13.50 to $750. Turing said it will cut the price by 50 per cent for hospitals and offer financial assistance to individuals. However, the company will keep its list price at the new higher level. In September Turing promised to reduce the price. The pill costs around $1 for patients in Europe, the BBC reports. In statement Turing’s Chief Commercial Officer Nancy Retzlaff defended the company’s move, saying that reducing the listing price would not have translated into saving for patients.
LG to pump Sh870b for slimmer televisions Electronics company LG Display Co will spend more than 10 trillion won (Sh870 billion) producing slimmer, cost effective screens, the manufacturer has said. LG wil spend the cash building a new plant and expanding the production of a newer type of display that can be used to cut power use, make thinner devices and show brighter colors. The facility will produce organic lightemitting diode (OLED) displays for larger televisions, smartwatches and automotive displays targeted to start in the first half of 2018, Seoul-based LG Display said today. The technology has been touted as a possible replacement for liquid-crystal displays (LCD) used in smartphones. Techmaker, Apple plans to adopt OLED for iPhones from 2018, the Nikkei newspaper reported Thursday without attribution. LG Display in August said it planned to spend about 10 trillion won over three years.

The management of the Mega properties Franchise, in a media briefing, revealed the company’s intentions of maximising the Western Kenya region’s strategic position to venture into a multibillion property development initiatives. The project Manager Hatibu Gonna said they are determined to make Kisumu Kenya’s Dubai a move that will also completely change the face of Kisumu’s Central Business District (CBD). Apart from Kisumu, the firm is said to be also targeting other towns including Kakamega and Kitale in the Mega Plaza mall. The development of the Mega properties franchise is now being expanded to an ultra-modern office apartment to keep up with growing demand for retail in the country. The new design, according to Mega Properties management, will feature two new towers, one comprising of 16 floors while the other comprise of 17 floors, and will be accessed through eight lifts and two elevators on the ground floor. “The mall being the heartbeat of lakeside city, will offer a wide variety of services mainly in retail, information and communication bureau, banking, insurance, health
and beauty, hospitality amongst others,” Gonna said. The new building is also expected to encompass four distinct blocks and a middle foyer. This, the management says, will ensure additional car parking facilities on the first, second and third floors totaling to a maximum of 400 cars. The new facility will provide quick access to stores, cafes,
restaurants, coffee bars and diverse entertainment options for Kisumu residents. Each floor comprises of shops on the lower ground and mezzanine floors, while offices will be from the fourth floor upwards. The average footfall to the mall is 25,000 to 30,000 per day. A unique car parking facility for tenants exists between the first,

Retailers hope to reap big on ‘Black Friday’
Retailers in the UK are embarking on the ‘Black Friday’ shopping phenomenon with analysts predicting record sales.Consultants Experian and online retail group IMRG forecast online purchases will hit £1.07bn, the first time they have passed £1bn in one day. Last year’s Black Friday saw shoppers fighting over bargains, websites crashing and delivery companies struggling to cope. Visa Europe says £1.9bn could be spent online and in-store on its cards alone. The discount day originated in the US, where it takes place the day after Thanksgiving and kick-starts the Christmas shopping period. Many UK retailers put online deals live from midnight onwards. Last year, Amazon sold more than 5.5 million items on Black Friday at a rate of 64 items per second. Ebay is expecting nine million British consumers to log on during the 24-hour period and for 25 items to be sold every second. Some stores will be opening their doors from early in the morning. These include Argos shops and a selection of Tesco, Sainsbury’s and Currys PC World stores. Earlier this year, retailer John Lewis warned that UK firms would have to rethink the heavy discounting of Black Friday, but it has decided that it has little option but to compete with other retailers and will be offering in-store and online promotions.
Standard Chartered Developer sets up tree nursery to posts loss as banks add coolness, value to properties lowers interest rates
Standard Chartered Bank has seen its nine-month pretax profit fall by 20 per cent partly due to bad loans and a steep rise in operating costs. The Bank made a profit after tax of Sh6.1 billion for the year ended September 30, down from Sh8.19 billion the previous year. Meanwhile, group’s pretax profit fell to Sh8.96 billion for the nine-months ended September 30, from Sh11.22 billion the previous year. The losses come at a time when several local lenders have been prompted to lower their interest rates, following a warning from the National Treasury over the unfavourable fees. Standard Chartered said that it has launched a strategy aimed at increasing the lender’s revenue. Key among its initiatives are moves aimed at restructuring its Commercial Banking Business
and enhancing customer service by upgrading its digital retail products. The strategies come just as the overall cost of banking loans is set to fall, according Cabinet Secretary Henry Rotich. Speaking late last month to members of the National Assembly’s Budget Committee, Rotich assured consumers that steady inflation and cautionary systems were in place to make sure the interest rates come down. Since his announcement, KCB and Equity Bank have lowered their interest rates and more lenders are expected to follow suit. The move is a reprieve to borrowers as the previous rates were deemed too high for the country’ harsh economic environment. Earlier this year, the Central Bank of Kenya raised its benchmark lending rate to 11.50 per cent.
Real estate developer Sultan Palace Development Limited has set up a tree nursery and 15.5 acres of garden to complement its 43-acre beachfront property, contributing to environment conservation and simultaneously adding value to its properties. The garden will have a combination of indigenous and exotic shrubs, palms and trees, including some rare species, to support the tropical conditions and coastal architecture of the development. General Manager Liu Tiancai said the indigenous and exotic plants have more impact than just aesthetic value, adding that they play a critical role in coastal protection and environment conservation. “Many of our indigenous forests have been cut down for development. So, by trying to plant as many indigenous trees as possible, Sultan Palace Development is trying to replace some of the flora and fauna that has been lost,” he said.
Liu said on the seafront, they will use a selection of palms trees and shrubs that are hardy enough to tolerate the salt-laden winds and the harsh ocean front conditions. “The garden will create a microclimate that is meant to positively contribute to the environment in general. The trees and shrubs will act as protection against any future invasion from the ocean such as from strong winds and floods. The use of indigenous and water-wise plants reduces the impact of the development on the environment vis-a-vis water usage,” he said. The growing of coconut and other indigenous and exotic trees along the coastal landscape is crucial and a long term measure in stemming the devastation caused by global warming and climate change. Trees and shrubs act as a buffer for strong winds that characterise the Kenyan coast, and absorb solar radiation far more than building structures.
Shade trees can significantly reduce air temperatures indoors during the hot season, as trees intercept and soak up the sun’s heat while transpiring cooling moisture into the air. Landscaping of this nature, where natural coral boulders and rocks are used to create rockery gardens, will also aid in getting maximum returns from the investment at the same time as minimizing negative effects on the environment. “It is important to note that a wellmanicured property with appealing landscaping is often a selling point. Often people tend to focus more on the inside, but it is critical to note that first impressions, even from the outside, matter,” said Liu. A Society of Real Estate Appraisers Survey revealed that 95 per cent of the appraisers responding to the survey believed that landscaping adds to the dollar value of residential real estate, while 99 per cent of them said it enhanced the sales appeal of residential real estate.

ou are a model, a mom and a modeling agency owner. How do you handle all these? I should consider myself privileged because I work at home and I am blessed to have a very loving husband, Jimmy Geeraerts. In addition to this it takes a lot of sacrifice and dedication to be a mom (and expecting another child), to handle my agency, Mochez Models and to coordinate fashion events. What is your typical day like? Normally, I wake up as early as 6am, where mommy duties take center stage. By 8am office duties take over. This includes coordinating with designers and models. But things thicken and need extra hard work when coordinating a fashion event. Like tomorrow I will be coordinating Fashion Week at Garden City Mall. Why fashion? I find fashion quite natural; to me it’s a calling. It brings out the art designed in fabric to life. It’s also my full time job this is what butters my bread. Which events have you been associated with? I have handled many fashion events. I was delegated with runway coordination for Fashion High Tea, FAFA, and Palmers among other high profile events. In a year I can coordinate more than 10 events comfortably. Can you tell us about Mochez Models and your fashion career? With Mochez Models It’s all about
giving others a chance, further to this it involves a lot about the runway, casting, coordinating designers and choosing outfits for the next fashion event. As a model I consider myself lucky, to have come this far having shared the runway with the likes of Ajuma Nasenyana and Cecilia Mwangi. I have also had the opportunity for feature in Vogue Italia and the New York Times. What is your take on the fashion industry currently? It has picked up. Today there are many stylists, models, agencies and events unlike in 2005 when I was beginning. The opportunities are also there. In addition, people have also caught up with the sense of dressing; red carpets are glamorous these days. What other projects are involved in? Currently I am involved with Pamba Mali. The project concerns itself with helping women in Kisumu with organic cotton seeds and other farming materials. I also participate in Afro Fusion Tuesday, which is currently on a short break. It’s an African music themed event bringing together a DJ and artiste and a percussionist. What is your word of advice for up and coming fashion startups? I would hint to them, you will need a lot of dedication and hard work, don’t just wake up and start, it is about passion. And for upcoming models watch out there are some fake agencies that could waste your talent.

There are more and more confrontations, not only between regional powers but between major ones too. The downing of a Russian bomber by Turkey - whether it happened over Syria or Turkish territory - is a sign of how tense nerves are, of how explosive the situation is. Turkey has had an allergic reaction to Russia’s airstrikes against the Syrian opposition and occasionally IS. It has reacted particularly
sensitively because it thinks that Russia is deliberately targeting the Turkmen rebels fighting against Assad. This is like striking Turkey, for which the spiritual bonding of Turkic peoples remains a major goal. Like striking the Turkey that sees itself as a friend of all of Bashar al-Assad’s opponents and that had long accepted the triumph of IS. For too long, as we now know - and not only since Paris but since the attacks in Turkey itself. Global politics has become disorganised. Power relations
are unclear. Not only is there the threat of IS-led terrorism, but the ongoing, unsolved refugee crisis has Europe and many other parts of the world on tenterhooks. Pope humility, big lesson for divided Kenyans The visit of Pope Francis to Kenya offered many lessons, however, what struck many Kenyans is the humility and tolerance that the Pope exhibited and preached in all his address to various congregation. Yesterday, when the Pope met various religious leaders in Nairobi, I realised that we Kenyans make fool of ourselves. We fight, criticise and oppose those who do not subscribe to our doctrines. We spew venom to those who pray with the rosary, condemn those who worship on a

We have made politics to be a contest of warlords instead of a being a friendly competition. Unfortunately we are quick harshly judge those whom we do not share political leanings, our
differences sometimes turn to fightkillings. But those politicians we fight for are always dining together, their children marry each other, they have joint ventures in business. The Pontiff has taught Kenyans and the whole world that we were born from different mothers, have different backgrounds, have different colours and have different names. Kenyans pay taxes to government not Opposition Accusations against Cord leader Raila Odinga of impoverishing Kibra and his followers from Western sounds illiterate, medieval and far-fetched. These Kenyans like their colleagues from “politically correct” regions are entitled to government services because they pay taxes to the government not Opposition. Every Kenyan has a constitutional right to vote for candidates of their
choices in every election and therefore it is not only stupid, but also alien for someone elected to punish citizens who pay taxes for voting as per their wish. If Jubilee wants to blame Cord for problems in the Opposition perceived zones, the government should allow the Opposition to collect tax from these same zones and use it to initiate development. If taxes are still collected by the government
of the day, none should run away from responsibilities. Developing a country is a sole responsibility of the government. Jubilee therefore must stop showing seeds of sycophancy in the country. The mantra of working with the government of the day to get goodies is total rubbish and Kenyans must not buy it. Uhuru got it wrong in naming new Cabinet team It is unbelievable that it had to take numerous graft shake-ups and the resignation of former CS Devolution Ann Waiguru for President Kenyatta to initiate Cabinet reshuffle. In terms regional and gender balance, the new line-up is unconstitutional because it does not meet the two-third gender rule which a constitutional requirement and does not reflect the face of Kenya. I don’t know who advises the President Uhuru Kenyatta on matters such as the composition of the Cabinet or it is his own choice. If the President is a listening leader, he still has time to clean his mess and re-constitute a team that is above
board. He should not miss any opportunity to unite Kenyans as he has always said that one of his key agenda is to see that the country is more united. Public appointments is one of the best way of the government of the day to strike both regional and gender balance to curb the general feeling that some Kenyans have been left in the cold. But with tyranny of numbers in Parliament, we all know what to expect. All the new entrants whether fit or not will be endorsed and we will complain for a few days, accept and move on. State should recover stolen cash from the corrupt The resignation of former Devolution Cabinet Secretary Anne Waiguru’s resignation over alleged corruption in the ministry should be the beginning of serious onslaught against corruption. It is only fair for a public officer to step aside and pave way for investigations whenever his/ her office has been implicated in corruption-related claims and we hope our leaders begin practising it, we do not want a
situation where officers get sick as a result of pressure mounted n them to quit over scandals. My appeal to President Uhuru Kenyatta is that he should now move a step further and initiate a process through which stolen money and property can revert to the public. Steeplechase king Kemboi appointed to IAAF commission WEEKEND EDITION, NOVEMBER 27-29, 2015
Four time World Championship 3000m steeplechase King, Ezekiel Kemboi has been appointed to the prestigious International Association of Athletics Federation (IAAF) Athletes’ Commission. Kemboi, who also boast of Olympics gold (2012) in the distance joined six other Athletes appointed to the position by the IAAF Council for the period 2016/19 Besides Kemboi, who wrote history as the first man to have won four world golds, are Fabiana Murer from Brazil, world marathon record holder Paula Radcliffe of Britain, Alina Talay of Belarus, USA’s Ashton Eaton and Michael Frater from Jamaica. Kemboi struck gold at the 2004 Olympics. After three successive silver medals at the IAAF World Championships, Kemboi won his first world title in 2009. He has since gone on to win three more world titles as well as the Olympic title in 2012. Murer is a Brazilian pole vaulter. She won the world indoor title in 2010 and the world title. Before that, she had taken bronze at the 2008 IAAF World Indoor Championships and more recently she took silver at the IAAF World Championships Beijing 2015. She has set numerous South American records along
the way, her best being 4.85m. Radcliffe, a Briton won six more medals – including two golds – at the IAAF World Cross Country Championships. But it was on the roads where she achieved her greatest successes. She twice broke the world marathon record, reducing it to 2:15:25, and recorded three victories at both the London and New York marathons. She won the world half marathon title in 2000, 2001 and 2003, and the world marathon title in 2005. Talay is a Belarus sprint hurdler, who won her first international title in 2011 at the European Under-23 Championships. The following year she took bronze at the IAAF World Indoor Championships and gold at the European Championships. Following two European indoor titles, Talay took bronze at the IAAF World Championships Beijing 2015. Eaton from America combined events athlete first came to global attention in 2010 when he set a world indoor heptathlon record, which he has twice improved upon and currently stands at 6645. After getting the decathlon silver medal at the 2011 IAAF World Championships, he has since won decathlon gold medals at the London 2012 Olympics, as well as at the 2013
and 2015 IAAF World Championships. He also won the 2012 and 2014 world indoor heptathlon titles. Eaton has set two decathlon world records, including the current mark of 9045. Frater from Jamaica is a sprinter. He took silver in the 100m at the 2005 IAAF World Championships in Helsinki. After finishing sixth in that event at the 2008 Olympics, Frater formed part of the victorious Jamaican 4x100m team, setting a world record of 37.10. He took further 4x100m gold medals at the 2009 and 2011 World Championships and the 2012 Olympics, setting two more world records in the process. A new chairperson will be decided by the commission when they hold their next meeting in January/February 2016. Frank Fredericks, the out-going chairperson, will continue in an honorary capacity to assist the commission during the transition and in their general contact with the IAAF Council. The IAAF Athletes’ Commission is made up of 18 members, 12 of whom are elected by their peers and six appointed by the IAAF.

Coe not off the hook despite quiting Nike International Association of Athletics Federation (IAAF) president Sebestian Coe is not off the hook yet despite ending his 38-years, Sh10 million a-year ambassadorial paid role with US sportswear giant Nike. Coe on Thursday resigned following ‘conflict of interest claims’ over the 2021 World Championships going to Eugene, Oregon, where Nike is based. It comes amid a recent wider doping and corruption scandal in the sport, which Coe has vowed to clean up. Speaking at a news conference in Monaco following an IAAF council meeting, Coe said of his Nike role: “The current noise level around it is not good for Nike or the IAAF. I have stepped down from my ambassadorial role with Nike which lasted 38 years.” Coe also announced he would resign as British Olympic Association chairman after the Rio 2016 Olympics. British Culture, Media and Sport select committee member Damian Collins said Coe still had questions to answer while Conservative MP Collins, who had
called on the peer to cut his ties with Nike, said on Twitter doing so was “the right decision”. Labour’s shadow sports minister Clive Efford was also critical of Coe and said: “Coe is a member of the House of Lords and a former MP - and as such he should know all about standards in public life and conflicts of interest. “It is disappointing that he waited until he w a s
forced to resign as an ambassador for Nike, particularly when he needs to be seen to have clean hands to deal with corruption in world athletics.” A BBC investigation revealed this week it had uncovered emails suggesting that when Coe was IAAF vice-president, he lobbied former president Lamine Diack with support for Eugene. The US city wasawarded the 2021 world championships in April without a bidding process, despite interest from the Swedish city of Gothenburg. Coe was elected IAAF president in August. When asked about the allegations earlier this week, Coe told the BBC he “did not lobby anyone” over Eugene’s bid, but “encouraged them to re-enter another bidding cycle as they had a strong bid”. On Thursday’s Monaco news conference, Coe said: “I have sought advice from the IAAF’s ethics committee to review my interests and was told I could retain my positions in Nike and (sports marketing company) CSM as long as I do not seek to influence any decisions that could influence them.

Legend, Nyantika to grace Gusii 10km race Legendary Nyantika Maiyoro will sit on the dais overlooking his old house, donated to him by his former coach, Senior Chief Musa Nyandusi inside the Kisii Municipal Stadium as one of the guest who will grace the Kisii 10km road race Sunday. Nyantika is remembered for winning the 1953 Indian Ocean Games (3000m) in Madagascar despite starting the race late when other runners had run more than 100 metres and representing Kenya in the first Olympics appearance in 1954. He retired in 1964. The house was re-possessed by the Gusii Municipal Council after his retirement as a stadium manager before former Prime Minister Raila Odinga ordered
the house to be returned to the octogenarian. Nyantika will join other Athletics legends from the region such as Hezekiah Nyamao, father to emerging kingpin Mike Mokamba who will also grace the occasion. Nyamoa was part of Kenya’s squad that won gold at the 1972 Munich Olympic Games alongside Charles Asati, Robert Ouko and the late Julius Sang. While Spurs have only lost one of their 13 matches this season, the Blues have registered only four wins which place them 10 places below the host. Spurs will rely on in the in-form English prospect Dele Alli, Christian Eriksen and red-hot Kane to press Chelsea while the Blues will hope Eden Hazard whose form has improved in the last two games, Diego Costa and Fabregas to search for their fifth league win this season. Defender John Terry is set to miss the derby after being stretched off against Maccabi with an injury. Ramires is also a major doubt after picking a knock in the same game.
