Why Raila has refused to honour summon by EACC

F

ormer Prime Minister Raila Odinga has refused to honour summon by the Ethics and Anti-Corruption Commission (EACC) because he feels the antigraft agency as currently constituted lacks the legal capacity to carry out investigations. EACC on Tuesday summoned Raila to record a statement with their detectives following his claims that Sh140 billion of the

Eurobond cash cannot be accounted for. But Raila has since refused to honour the summon, saying EACC is not legitimate under the Constitution because it does not have commissioners. “I will not go to the so-called Integrity Centre. I will not be compelled and I will not be blackmailed. There can be no commission without commissioners,” Raila told four EACC

officers who visited his office at Capitol Hill in Nairobi yesterday. The officers had gone to issue him with fresh summon to appear before the commission on Monday and record his statement failure to which he risked being arrested and prosecuted. Kiunjuri, who was the first of the seven new Cabinet nominees to be vetted, said President Uhuru Kenyatta had noted his potential in leading the ministry before picking him. He defended his nomination, saying it was based purely on his ability to deliver and not for political reasons. “I am coming in because President Kenyatta saw the potential in me,” Kiunjuri said. Top on his agenda if confirmed is solving the current dispute between the National and County government over allocation of funds and roles. Kiunjuri said being a seasoned politician, he will handle both the issues raised by the government and the Opposition effectively. “I’m not easily swayed and always firm in the decisions I make, any decision that I make I look at the interest of the country first. I am patriotic,” he told the MPs. The fallout between the former Assistant Minister for Water and Irrigation and Charity Ngilu who was the then Minister during the Coalition government came to haunt him during the vetting.
