Kenya will host the Second high-level meeting of the Global Partnership for Effective Development Cooperation, President Uhuru Kenyatta announced yesterday. The President made the announcement at State House, Nairobi, when he met members of the steering committee who briefed him on the preparation of the meeting slated for November 23-24, 2016. This will be the first time the meeting is held in Africa. Kenya will also next year host the Tokyo International Conference on African Development (TICAD), another high profile development forum that will attract investment and boost tourism. The Global Partnership for Effective Development Cooperation is a political forum that brings together governments, bilateral and multilateral organisations, civil society and representatives of parliaments, the private sector, financial institutions and trade unions, among other organisations, to discuss development.

The MPs have been at loggerhead with the commission after the antigraft body released a report exposing the legislators’ abuse of mileage claims and other malpractices within the Parliamentary Service Commission. Homa Bay Town’s Peter Kaluma said the secretariat is earning salary for doing nothing. “These people are actually just earning salary, they should be sent home,” Kaluma said. Kaluma said upon the confirmation of the EACC commissioners who were vetted a fortnight ago, he will implore the Legal Affairs committee to initiate an urgent way of sending the secretariat home. “All we need is to summon the commissioners and tell them to send the secretariat home,” Kaluma said. Early this month, the Anti-graft body released a damning report on how MPs are stealing millions of shillings from Parliament. According to the report, a Sh325 million inflated tender and some Sh25 million lost through unbanked revenue are only two of the shocking examples of looting contained in a 50-page report by the commission. These are surgeries that do not require hospitalization before and after operation. We’ll take stand on strike: Kuppet The Kenya Union of Post Primary Education Teachers (Kuppet) delegates will this Saturday meet to decide on whether to call for teachers’ strike next month over salary increment. The union is set to hold its Annual Delegates Conference beginning tomorrow in Bungoma to review its performance and discuss other issues affecting teachers in the country. Kuppet secretary general Akelo Misori said issues such as the teachers’ salary and the way forward come January will be extensively discussed by the delegates and a firm position taken. “I cannot speak for the members, or pre-empt the decision they will make, but definitely the issues of salary and way forward as from January next year will be decided on the card,” Misori told XNews this morning. “I will deal with the issues as raised by members on Friday and our position will be known,” he added. His remarks comes just a day after the union’s chairman Omboko Milemba said they will join their primary colleagues in pushing salary review or they will go on strike next month. Milemba said

EU discusses migrant crisis amid threat of terrorism Germany and several other nations are to discuss with Turkey ways of settling thousands of Syrian refugees ahead of the final EU summit of the year. Those attending the meeting will discuss a proposal to resettle Syrians straight from camps in Turkey. But German Chancellor Angela Merkel, the driving force behind the plans, faces resistance from other EU states. Thursday’s full EU summit in Brussels is set to focus heavily on the migrant crisis which has divided members. Record numbers of people have arrived in Europe this year, prompting some states to build fences and introduce border controls in defiance of the EU’s border-free Schengen area. The resettlement proposal would see EU countries accept Syrian refugees directly from Turkey under a voluntary scheme. It is hoped the plan will stop people making the dangerous sea journey to Greece and will be more palatable for EU members than obligatory quotas. Turkey and European leaders struck a deal last month in which Ankara tries to prevent migrants leaving in exchange for financial aid and political concessions. The wider EU summit will discuss European Commission plans to create an EU coast guard, and other ways to strengthen external borders. The fight against terrorism is also expected to dominate the summit after it emerged that at least two of the Paris attackers used the migrant route to travel to France.

A plan to expand the capital’s administrative control into the Oromia region has sparked deadly protests. The government has accused Oromo protestors of links with terrorist groups and trying to topple the state. Amnesty says the claims aim to justify repression of those protesting against feared land seizures. The Oromo make up Ethiopia’s biggest ethnic group, at about 27 million people. Oromia is the country’s largest region, surrounding the capital Addis Ababa. Authorities say five people have died in protests so far, but opposition parties and human rights groups say the number is closer to 40. Protesters also say they fear cultural persecution if what has been dubbed a “master plan” to integrate parts of Oromia into Addis Ababa go ahead.
Angry South Africans march against President Jacob Zuma Thousands of protesters are marching in South Africa to demand President Jacob Zuma is sacked. The latest protests are a reaction to him sacking two finance ministers last week, further damaging confidence in the economy. This comes on top of claims of widespread corruption, recent student protests and a succession battle in the governing African National Congress. The marchers are using the hasthag #ZumaMustFall on social media. The #ZumaMustFall hashtag is a modification of #FeesMustFall which was used to organise protests against a rise in university fees. Before that, #RhodesMustFall was used to demand a statue of British colonialist Cecil Rhodes was removed from the University of Cape Town’s campus. “It feels like the start of something big,” a woman in her 50s told BBC’s Karen Allen in Johannesburg. It’s the first protest she has been on since she saw friends and family killed during the 1976 Soweto uprising. For her it was important to join the demonstrations with her teenage daughters “for the sake of their future”. So along with thousands of others she is protesting to register her displeasure at the ANC leader, who some increasingly see as a political liability.

Cancer is not just ‘bad luck’ but down to environment, new study suggests Cancer is overwhelmingly a result of environmental factors and not largely down to bad luck, a study suggests. Earlier this year, researchers sparked a debate after suggesting two-thirds of cancer types were down to luck rather than factors such as smoking. The new study, in the journal Nature, used four approaches to conclude 10-30% of cancers were down to the way the body naturally functions or “luck”. Experts said the analysis was “pretty convincing”. Cancer is caused by one of the body’s own stem cells going rogue and dividing out of control. That can be caused either by intrinsic factors that are part of the innate way the body operates, such as the mutations that occur every time a cell divides, or extrinsic factors such as smoking, UV radiation and many others that have not been identified. The argument has been about the relative importance of intrinsic and extrinsic factors. The team of doctors from the Stony Brook Cancer Centre in New York approached the problem from different angles, including computer modelling, population data and genetic approaches. They said the results
consistently suggested 7090% of the risk was due to extrinsic factors. Dr Yusuf Hannun, the director of Stony Brook, told the BBC News website: “External factors play a big role, and people cannot hide behind bad luck. “They can’t smoke and say it’s bad luck if they have cancer. “It is like a revolver, intrinsic risk is one bullet. “And if playing Russian roulette, then maybe one in six will get cancer - that’s the intrinsic bad luck. “Now, what a smoker does is add two or three more bullets to that revolver. And now, they pull the trigger. “There is still an element of luck as not every smoker gets cancer, but they
have stacked the odds against them. “From a public health point of view, we want to remove as many bullets as possible from the chamber.” There is still an issue as not all of the extrinsic risk has been identified and not all of it may be avoidable. Kevin McConway, a professor of applied statistics at the Open University, said: “They do provide pretty convincing evidence that external factors play a major role in many cancers, including some of the most common. “Even if someone is exposed to important external risk factors, of course it isn’t certain that they will develop a cancer - chance is always involved. “But this study demonstrates again that we have to look well beyond pure chance and luck to understand and protect against cancers.” Dr Emma Smith, from Cancer Research UK, said: “While healthy habits like not smoking, keeping a healthy weight, eating a healthy diet and cutting back on alcohol are not a guarantee against cancer, they do dramatically reduce the risk of developing the disease.”

WTO delegates agree to remove tariffs on IT items Exporters of information technology products under the World Trade Organisation (WTO) membership yesterday agreed at the WTO’s 10th Ministerial Conference, in Nairobi, on the timetable for implementing a landmark deal to eliminate tariffs on 201 IT products valued at over Sh130 trillion annually. Negotiations were conducted by 53 WTO members, including both developed and developing countries, which account for approximately 90 per cent of world trade in these products. However, all 162 WTO members will benefit from the agreement, as they will all enjoy duty-free market access in members States eliminating tariffs on these products. The list of 201 products was originally agreed by the ITA participants in July. “I am delighted to mark this breakthrough here today at the Ministerial Conference”, said WTO Director General Roberto Azevêdo. “This is a significant achievement. Annual trade in these 201 products is valued at Sh130 trillion per year, and account for approximately 10 per cent of total global trade. Eliminating tariffs on trade of this magnitude will have a huge impact. It will support lower prices — including in many other sectors that use IT products as inputs —

Investment in renewable energy projects, mainly solar power-based initiatives, rose to nearly half of the total investment despite a sharp decline in private investment in energy, transport, and water infrastructure in developing countries, an update released by the World Bank Group’s Private Participation in Infrastructure Database has revealed. Total private infrastructure investments for energy, transport, and water sectors in 139 emerging economies dropped from Sh5.3 trillion in first six months of 2014 to Sh2.5 trillion in the first six months of 2015 due to a decline in the number of projects in Brazil, China, and India. The top countries by private investment totals were South Africa, Colombia, Mexico, Chile, and Brazil. These five countries together attracted Sh1.2 trillion, representing 47 per cent of global commitments in the developing world in the first half of 2015. Regionally, Latin America and the Caribbean region led followed by Sub-Saharan Africa, Europe and Asia and the Middle East and North Africa.

Shareholders back KenGen Sh28bn expansion plan Kenya Electricity Generating Company (KenGen) shareholders on Wednesday approved the firm’s Sh28 billion rights issue slated for next year to fund the company’s expansion projects. The shareholders unanimously approved the rights issue during their annual general meeting held in Nairobi and also agreed to the board’s plan to issue up to Sh7.8 billion shares, revoking an earlier decision to issue up to Sh2.2 billion ordinary shares. KenGen managing director Albert Mugo said the firm will now seek approvals from the Capital Markets Authority (CMA) with a view of launching the issue by June next year. “The government has said we can go ahead. We are working with the transaction advisers to produce an information memorandum and we are looking at the second quarter of 2016 for the launch,” said Mugo. The firm expects to raise Sh20 billion from the government, its major shareholder with over 70 per cent shares, with the rest of Sh8billion to be collected from the minority shareholders. The power generator appointed Standard Investment Bank, Renaissance Capital, Dyer & Blair and Faida Investment Bank as its transaction adviser. Also approved in the annual meeting, the firm’s plan to spend Sh166 billion to put up wind and geothermal power plants in the next two years to generate an estimated additional 460 megawatts to the national grid. The funds will be sourced from bilateral lenders in form of loans while a small portion of the funding will come from the company’s internal resources. “The country’s demand for power by 2020 is expected to cross the 3,000 megawatts mark. We do not want to miss future growth opportunities simply because the capital required now seems unaffordable,” said Mugo.
WB okays Sh153bn Indian toilets funding The World Bank has approved a Sh153 billion ($1.5 bn) loan for a state-led sanitation programme in India, where millions of people have no access to toilets, the bank said Wednesday. The said mortgage will be disbursed over a period of five years and will be used to support government’s efforts of providing toilets in villages ending the practice of open defecation by 2019. By providing toilets across rural areas, the ‘Clean India Mission’ not only aims to achieve an open free defecation communities, but also to improve the management of both liquid and solid waste. Reports indicate that 500 million Indians especially in rural areas continue to defecate in the open despite decades-long efforts to encourage people to stop these unhygienic habits. According to Onno Ruhl, the
World Bank India director, most of the deaths in the country are as a result of poor sanitation geared by low income. “One in every 10 deaths in India is linked to poor sanitation,” said Onno Ruhl, adding that lowincome households bear the brunt of poor sanitation and the “project would result in significant health benefits for the poor and vulnerable, especially those living in rural areas.” However, some of the kitty will be used to boost India’s Ministry of Drinking water and sanitation. Kenya economic growth slower than expected: IMF The International Monetary Fund (IMF) has said Kenya’s economic growth for the year 2015/16 is slower than expected. The Fund trimmed its forecast for Kenya’s economic growth on Wednesday, projecting Gross Domestic Product (GDP) would expand about 6 per cent next year after growing at a seemingly dismal 5.6 per cent in 2015. The IMF, which has a mission visiting the East African country, had previously estimated that GDP would grow by 6.5 per cent in 2015 and 6.8 per cent next year. “The growth acceleration in 2015 is slower than projected,” Vitaliy Kramarenko, the IMF head of mission to Kenya, said in a news conference. He said this was due to delays in planned road infrastructure spending, weaker tourism receipts, and volatile external capital flows. A team from the International Monetary Fund (IMF), led by Kramarenko, conducted discussions on the authority’s second review on the economic programme and supported under a 12-month precautionary Stand-By Arrangement (SBA)
and a 12-month Standby Credit Facility (SCF) arrangement from December 2 to December 16. “The economy is projected to continue to expand robustly, although at a slower-thanprojected pace. Real GDP is projected to grow by 5.6 per cent in 2015 driven by public
infrastructure spending, buoyant credit growth, and strong consumer demand,” said Kramarenko in a statement issued during the conclusion of the mission. “Kenya’s growing integration in global financial markets has created significant opportunities,

China launches over 10-day battery life smartphone A new smartphone with a battery life of 10 to 15 days will hit the Kenyan market next month, a Chinese firm has announced. Smartphone users have expressed reservations with the battery life of their devices, leading to the advent of countless battery-s aving apps, portable power banks and cases that provide additional battery life -- with Apple’s aforementioned Battery Case being the most high-profile example. The Oukitel K10000 is crammed with a 10,000mAh battery, which should hold almost four times the charge of a Samsung Galaxy S6, and five and a half times the charge of the iPhone 6. A full charge takes about three and a half hours, according to Oukitel, a Chinese gadget maker. Smartphone software has gotten better at managing apps and programmes to conserve battery life over the past few years, but not
many manufacturers have upgraded battery capacity itself. Oukitel says it’s doing both. The K10000 has a “super smart standby” mode, and “intelligent power consumption management,” and is the “world’s largest battery capacity smartphone,” the company claims. BIZ BRIEFS KQ’s boss appointed to trustees board in continental agency Pan-African marketing organisation Brand Africa has appointed Kenya Airways Marketing Director Chris Diaz as one of its Trustees as it seeks to position Africa as a favourable investment destination. Diaz has been described as a renowned marketer who leads the marketing function at the airline and has been instrumental in its evolution as one of Africa’s leading carriers. Diaz joins the seven-member Board of Trustees, which is led by Brand Africa Founder and Executive chairman Thebe Ikalafeng, of South Africa. The appointment comes two months after Diaz’s reappointment by President Uhuru Kenyatta to the board of Brand Kenya, which is charged with the responsibility of showcasing and promoting Kenya’s image as an investment hub in Africa.
Liberia joins WTO at 10th Ministerial Conference Liberia has joined the World Trade Organisation (WTO) becoming the eighth member of the Least Developed Country (LDC) bloc to join the organisation since 1995. The approval of Liberia’s accession marks the WTO’s 35th completed accession process, the organisation said in a statement following the ceremony on Wednesday. The process was completed at the 10th Ministerial Conference of the WTO taking place in Nairobi, after formal approval by the member ministers. Welcoming the move, Liberian President Ellen Johnson Sirleaf, who is attending the Nairobi meeting termed the move a great milestone for Liberia, which will open the country to the global trade. “These are very demanding negotiations. The process is complex and includes structural reforms across many areas,” WTO director-general Roberto Azevêdo said in a statement yesterday.
Over 2,600 clients to claim Sh4.5Bn from idle bank accounts The Swiss banking industry has released the names of holders of dormant accounts, in the hope they will come forward to claim over $44 million (Sh4.5 billion). More than 2,600 names were released on dormantaccounts.ch the site that deals with such cases. New Swiss banking regulations mean that if an account containing more thsn the 500 Swiss Francs (Sh51,000) has been left dormant for 60 years, ownership of the funds reverts to the state, the BBC reports. Roughly 80 safety deposit boxes have also been gathering dust since 1955. The deadline for submitting a claim is one year from the date of publication of the account holder’s name. Swiss Bankers Association chief executive Claude-Alain Margelisch said the new regulations -which took effect in January -- also create legal clarity about dormant assets.

Kenya Airways (KQ) has signed a new six-year partnership with Spanish international travel firm, Amadeus, which gives the national carrier access to a global network of travel agents. The renewed agreement will see the national carrier continue to access the travel agency sales channel to grow its international customer base. KQ Head of Revenue Management Hellen Mwariri exuded confidence in the move, terming it timely in their effort to grow their shrinking international business. “This deal demonstrates boost our confidence, Amadeus adds value to our business as a technology partner and distribution channel to the global travel industry. Travel agencies remain an important sales channel for us, particularly as we grow our business,” said Mwariri. Last year, Amadeus helped the Kenya Airways book more than 1.6 million international customers and are now projecting a 21 per cent increase by mid next year. “The pact ensures that the airline’s complete product range will be bookable by travel agents
worldwide, allowing both parties to deliver great value to travellers in coming days,” said Amadeus East Africa general manager Juan Torres. KQ has been on a loss-making streak blamed on a range of issues including an aggressive expansion plan that has left it in losses, massive debt and inflated air ticket pricing. The carrier posted a record Sh25.7 billion net loss in the
year ended March, sending shareholders’ net worth to a negative Sh33.9 billion. The costly tickets have been blamed for driving business away to stronger rivals such as Ethiopian Airlines whose charges are lower. A fare assessment done by the Centre for Aviation showed that the national carrier charged about Sh230,000 on the NairobiLondon route, compared to
Ethiopian Airline’s charge of Sh94,900 and South African Airways’ Sh88,700. A Senate enquiry has called for the shake-up of the airline’s management in a bid to reverse the record loss and as a condition for the government’s anticipated bailout. The East Africa office is based in Nairobi and serves Kenya, Uganda, Tanzania, Djibouti, Rwanda, Burundi, South Sudan and Malawi.

Russia to cancel its trade pact with Ukraine Russia President Vladimir Putin has signed a decree that will exclude Ukraine from a free trade zone that includes former Soviet countries fron January 1. Putin cited extraordinary circumstance affecting the interest and economic security of Russia. However, Ukraine is planning to join an EU free zone from January despite the tension between Russia and Ukraine having remained high since Russia annexed Ukraine’s Crimean peninsula last year. The announcement according to the Russian Interfax news agency will annul a Russian deal with Ukraine dating back to 2011. According to Russia, the Ukraine-EU deal could lead to European imports coming across its own borders, but Ukraine President Petro Poroshenko should expect some economic damages as a result of the verdict. “Ukraine is aware of these restrictions and the expected damage to the Ukrainian economy. But we are ready to pay this price for our freedom and our European choice,” he said. Meanwhile, the Ukraine government has warned to ban trade with Crimea in 30 days’ time. Russian economy minister Alexey Ulyukaev told BBC that Russia was still open to negotiate with both Ukraine and the European Union. “Negotiations will take place, of course,” Ulyukaev said, adding that Russia had not “closed the door” on a deal if there is “good will” among the participants.

After more than two-anda-half-hours, the fifth Republican “debate” in five months concluded with the most important moment of the night. Donald Trump committed himself to not running as an independent if he fails to win the nomination. After a night of clichéd theatrics, Trump’s statement made this debate noteworthy. Before it, viewers had been subjected to an endless string of half-baked ideas. The moderators had probed. Do you really want to close the internet Donald? “I wanted to get our brilliant people from Silicon Valley …and penetrate the internet and find out where Islamic State is. …I certainly don’t want people who want to kill us using our internet.” The candidates said deranged things that Rand Paul, now
comes across as the man of sense. “Trump says we ought to close ‘that internet thing’… like they do in North Korea? Rubio says we should collect all Americans’ records, all of the time; the Constitution says otherwise.” When Christie, who may become the party’s flavour of the week after an assertive performance, talked tough on shooting down Russian planes, Paul piped up: “If you’re in favour of World War Three, you have your candidate. What we want in a leader is someone with judgement, not someone jumping up and down saying ‘Yes I’ll shoot down planes!’” It was a night of two-way tussles: Paul vs Christie, Trump vs Bush, Cruz vs Rubio, with Carson, Fiorina and Kasich largely forgotten. But issues were usually
used as a peg for a character attack. Paul concluded his condemnation with a crack at Christie “…someone who might shut down a bridge because he doesn’t like their friends,” a reference to the furore which derailed his candidacy in 2013. Trump and Bush surpassed the pair. When Trump attacked CNN, Bush chimed in, “If you think this is tough, try dealing with Putin! This is a tough business.” “Oh yeah, you’re a tough guy Jeb. You’re tough,” goaded Trump. “You’re never going to insult your way to the Presidency” In these debates candidates are given podium slots based on their polls. Solve port crisis to avert loss of revenue Transport and Infrastructure ministry and the Transitional Authority (TA) should act speedily to deal with the controversies surrounding the control of the Port of Mombasa. The Port that generates billions of shillings in revenue for the National government has been targeted by Mombasa county government. Just like airports, the port is considered a border point equipped with customs, immigration and security services all which are under the National government. By passing the controversial Mombasa County Port Authority Bill, 2014 authorising the County to collect revenues from the port has
elicited the debate on who between the county and National government should control the port. Putting the port under the County government in my view will interfere with national government functions. Concerned constitutional institution should lay system if any on a ratio of sharing the revenue to ensure, like in the case of the Maasai Mara in Narok County, that the local community benefits from some of these natural resource. Move to recover stolen property long overdue The latest revelation that assets worth millions acquired illegally using the siphoned funds from the National Youth Service (NYS) is being recovered is a boost to the ongoing war against corruption. This is the kind of news that every patriotic citizen wants to hear apart from the perpetual narratives and rhetoric from President Uhuru and the Ethics and Anti-corruption Commissions (EACC). During the Jamhuri Day celebration, President Uhuru said there are more than 300 cases
underway and that property worth billions of shillings would be recovered. Money stolen and hidden in foreign account should also be targeted as a more ruthless measure to tame graft. Africa must push for its agenda at WTO summit There already are signs that the 10th World Trade Organisation (WTO) Interministerial meeting may not have the desired outcome for the African nations. This is after developed countries’ representatives said a deal was likely not to be sealed as a result of conflicting interests between the developed and developing countries. It is said that some developed countries
even sought to change the agenda of the conference to ensure they do not discuss any issues in trade relations affecting the developing countries. In light of this, the developing countries must not compromise on their agenda. They should bargain for what is beneficial to them and give them comparative advantage. However, if the big nations fail to compromise and
hold on to their imperialist traits, poor countries should abandon the talks and unilaterally resolve to trade among themselves. Ban on Alcohol, CD ads not good for country The ban on TV ads on alcohol and condoms by the Kenya Film and Classification Board (KFCB) is insincere and not in the interest of the people. In common knowledge and principle, the now banned ads on alcohol are to encourage responsible drinking and use of branded and safe products. Banning of this ads could welcome back the second generation alcohol the country has been grappling with. Any argument that the ads encourage underage drinking is a misconception that gives room for parents and the society to run
away from their parental role. Again, banning ads on condom could open the floodgates to HIV infections, unwanted pregnancies among other effects amounting to myriad challenges in the war on HIV/Aids in the country. Banning the ads is pointless and baseless. KFCB should consider answering the question on the safety of the society other than making hasty decisions. Bayern Munich boss Pep Guardiola says he will give “clarity” on his future at the Bundesliga champions next week. The 44-year-old Spaniard, who has been linked with Manchester United has led Bayern to two titles since taking over in 2013, but will be out of contract in June. He would not answer questions about his future on Tuesday, but indicated an announcement would soon follow. Spanish newspaper Marca on Wednesday reported that Guardiola has already told Bayern he will leave the club. The Madrid-based publication claims he believes both he and the club would benefit from a change of scenery because his intense work ethic can wear players down. Reports in Spain last month claimed the former Barcelona coach had agreed to leave Bayern at the end of the season to take over at Manchester City. Ex-IAAF chief son in doping charges suit The son of former International Athletics Associations Federation (IAAF) chief Lamine Diack is among four officials set to face a disciplinary hearing this week over an alleged doping cover-up. Papa Massata Diack, a former consultant for the IAAF, and ex-IAAF anti-doping director Gabriel Dolle are charged with breaches of the IAAF’s code of ethics. Former All-Russia Athletic Federation chief Valentin Balakhnichev and coach Alexei Melnikov are also in the dock. None are expected at the three-day hearing, which starts on Wednesday. The charges relate to the payment of about £435,000 that Russian former London Marathon winner Liliya Shobukhova allegedly made to have her doping violations covered up. Her 38-month ban from track and field was reduced by seven months after she turned whistle-blower for the World Anti-Doping Agency. A decision from the hearing, which will be held in London, is expected in early January. Russia have been banned from International Athletics competitions after a report by Wada’s independent commission alleged they were guilty of “state sponsored doping”.
Factions accuse sports registrar of ‘sleeping on the job’ after it allowed registrations from two groups Sport Dispute Tribunal has promised to make a ruling before Christmas on a case in which two factions claiming AFC Leopard leadership are locked in wrangles. Speaking after an appeal hearing yesterday, tribunal vice chair Ellyna Shiveka slammed the Sports Registrar (SR) after the registrar claimed they lack proper legislation to handle the registration process. Registrar Rose Wasike, through lawyer Ann Kamande failed to convince the tribunal why they accepted two applications from the warring faction claiming ownership of AFC Leopards, one led by Dan Muli and another by Mathew Opwora. Kamande told the tribunal that the Registrar’s hand ‘were tied’ due to lack of legislations on what should be done in such case after she failed to explain how or what will happen to the two application received by the Registrar’s office and why they received the second application from Opwora’s group despite Muli’s group submitting their application month earlier. “The orders they are seeking are non-efficacious. They had time to make their applications, but they did not until after the collapse of the deadline date. They slept on their rights, therefore AFC Leopards is not existent,” argued Kamande in her submission. “Their applications is ‘just application’ like any other, but my client said her hands are tied due to lack of legislation though she submitted the application to various organs for vetting,” argued Kamande. “Wouldn’t it be more efficacious to wait for the legislation? Having declared July 31 as the deadline day for submission of application; on what ground therefore did you receive the forms for application if you still have no laws
for direction?” Njeri Onyango, a member of the Tribunal posed a question to Kamande. “I want you to tell your client (SR) that she has put the cart before the horse by accepting the application” Onyango added. Morris Osundwa, appearing for Opwora, in his submission raised issue with the legitimacy of the officials who are supposed to run the club. Osundwa, who wants the tribunal to give direction on the matter based his argument on section 47 of the Sport Act (No sports organisations will be allowed to participated in the local or international competition without dully registering with the Act) adding that the old officials failed to transit the club in line with Sports Act requirement. In his submission Osundwa quoted a letter dated January 16 by Wasike, which confirmed to them that AFC Leopards was deemed ‘non-existent’ after they failed to beat the July 31 deadline for registration. But Muli’s advocate, Sylvia Matasi, opposed the appellant submission, arguing that they are not registered members of the club. “The group did not follow the requisite procedure to call for a SGM,” said Matasi in her objection further quoting a section of the club’s constitution which requires one calling for such meeting to write to the club Secretary General and half of the members spelling out the reason for such a meeting. Osundwa, however, argued that they genuinely ascended to power after an SGM held at the Railways Club constituted a caretaker committee to run the club. Matasi in her defence objected the claims and called on the tribunal to scrutinise the list of members who attended the said meeting to see if they met the quorum.
But Osundwa argued that AFC Leopards ceased to exist after July 31 2014 deadline and that they were rightfully and within the constitution of the club to constitute the caretaker committee, five months after the club failed to register. “Your honour it is clear that we as a club cannot attract any financial support from any institution or even the government unless we are a legally registered entity. That is the requirement,” Osundwa pleaded. “AFC Leopards is registered under the Societies and we are illegally engaging in Sports Activities,” said Osundwa, adding that the defendant had not made any application with the Sports Registrar. This, he said coupled by the fact that Allan Kasavuli and George Aladwa’s group resigned, they are the legally constituted body that owns the club. But Matasi brought to the attention of the tribunal a meeting held on June 15, (AGM) which she said ratified the members who were co-opted in the club after Kasavuli resigned. She further submitted that the complainant are running the club with full knowledge that there are officials mandated by the members to do so. “The respondent applied for application knowing well that another application had been made earlier. This is malicious and the argument that we had not applied for registration does not hold water,” said Matasi. But even as she was tearing apart Osundwa’s submission in her respnse, Matasi was put to task by the tribunal to explain what happened between the time the registrar notified the club that it will ceases to exist after July 31, 2014 and when they made their application. Matasi submitted that the club has not ‘died’ before asking the tribunal to rule that new officials be elected to run the club.

E’to’o lands coaching job with Turkish side Former Cameroon captain Samuel Eto’o has been appointed interim playermanager at Turkish side Antalyaspor. The 34-year-old striker, who joined the club on a three-year contract in June, has been given three matches to impress at the helm. He takes over from Yusuf Simsek, whose contract was terminated by mutual consent on December 7. Antalyaspor will make a decision about whether to give Eto’o the role permanently after the winter break. Eto’o will be guided and assisted by Mehmet Ugurlu, who is the club’s technical director, as the Cameroonian takes his first steps into
management. The move is an unexpected one the former Barcelona, Inter Milan and Chelsea player, who has been involved in a number of controversial and damaging disputes with his country’s football federation as well as team-mates. One of his former international team-mates, Patrick M’boma, admitted he was “surprised Eto’o has gone into management so soon”. But he revealed Eto’o, who he played alongside in two Africa Cup of
Nations-winning sides, has long-held ambitions in that area. “I know it was in his plans to be a manager - he told me many years ago,” M’boma told BBC Sport. “But from what I know he has no experience. I hope he will be a good manager but I do not know.” “He has the personality and the knowledge, but I am not sure he will have the patience. If he can improve on the areas where he is weak he could be a success.” Elsewhere, history will be made in Somalia this week when a football match played in the country will be broadcast live on television for the first time. The General Da’ud Cup final between Somali military club Horseed and Somali police Football Club Heegan FC will be screened on Somali National Television. Somali Football Federation president Abdiqani Said Arab described the first time live coverage as “a breakthrough”. The country is recovering from decadeslong unrest and lawlessness. Said Arab added: “We had long dreamed of getting our matches watched live. This is almost the realisation of our age-old dreams. “This will be a test, but if we are successful in this endeavour, we will try to get our matches go live in the months to come.” General Da’ud Cup is the second most watched sporting event in Somalia and it is held annually in the remembrance of the founder of Somalia’s Armed Forces, General Da’ud Abdulle Hersi. The late General Da’ud died in 1965 and the Somali Football Federation has been organising the annual football event since 1972.

The new product, dubbed “responsible gambling” will see players commit a limited amount of money for betting for a certain duration. “While we are here for business, which is gambling-we want to have a responsible game. We will allow our customers a certain limit of cash in your account of which you cannot exceed. This is aimed at controlling addiction and excessive spending,” said mCHEZA chief executive Peter Karimi during the launch. The new online gambling firm will only have football in 144 leagues from around the world in their betting matches for the first six months of operation before moving to other sports such as Athletics,
rugby and volleyball. mCHEZA join the likes of Sportpesa and BetWays in the ever expanding betting Kenyan market. At the same time, mCHEZA will give the less fortunate budding football talents a chance to show case their talent early next year and possibly attract the eyes of international scouts. PricewaterhouseCoopers estimated that Kenyan gaming industry generated more than Sh1.98 billion in revenue in 2014. By 2018, the report authors, total gaming in Kenya, South Africa and Nigeria will be worth Sh37 trillion.
