hief Justice Willy Mutunga has today defended his tenure at the judiciary, saying he has completed his transformation agenda and can now set his eyes on retiring honourably. Dr Mutunga whose term constitutionally expires on June 22, 2017 is set to retire a year earlier to give the Judicial Service Commission (JSC) enough time to recruit his successor ahead of the 2017 General Elections. Speaking on Citizen TV programme Cheche earlier today, the

Chief Justice said he has already completed what he wanted to do at the Judiciary, taking satisfaction in restoring pride and regaining its independence. “Four years ago, the independence of the Judiciary was in doubt. Today, the independence of the Judiciary is fully asserted and the co-equal organs of government all know that the Judiciary is an organ of consequence; not to be taken for granted anymore,” he said. TSC finally releases teachers’ withheld September salaries

The Teachers Service Commission (TSC) has finally released the September pay for teachers. The salaries were paid just before the union’s Annual Delegates Conference that is set to take place on Wednesday (today) at the Safaricom Stadium in Kasarani. According to Kenya Union of Teachers (Knut) secretary general Wilson Sossion, all that is remaining now is the signing of a new Collective Bargaining Agreement (CBA) to improve the working conditions of teachers. “It is good that the September salaries have been paid. It is our right and now we have to get to the negotiating table with TSC and we hope that they will be serious this time and not take us in circles,” he said. President Uhuru Kenyatta last month asked TSC to release the withheld September salaries for teachers after a meeting with the two teachers’ unions at State House, Nairobi. Both Knut and the Kenya Union of Post Primary Education Teachers (Kuppet) had accused TSC of reneging on the President’s directive. TSC had over the weekend indicated that Sh10.8 billion has been requested from the Treasury to pay the salaries. The Commission’s chief executive Nancy Macharia said the action followed the advisory opinion by

Woman’s body discovered near Nairobi River The body of a 20-year-old woman who went missing Monday has been found in a shallow grave next to a river bank in Kinyago slums, Nairobi. Police say they have identified the suspect behind the killing but they are yet to know the motive. The suspect is still at large and efforts to trace him are ongoing. The woman’s body was discovered on the river bank of the slum by a group of children who were playing. She went missing on December 7 from the area where she stayed with her husband. The man had reported she was missing. The body was last evening removed and taken to the mortuary awaiting post mortem that will determine the circumstances under which she died. Elsewhere, a six year old boy drowned in a pool of water he was playing in with his friends in Luckysummer, Nairobi. The boy was playing and swimming in the water when he drowned. Police were called and informed of the incident long after it had happened and managed to remove the body to the mortuary. Police want parents and guardians to take care of their children whenever they are playing especially this festive season. And in another incident, several families were left homeless in separate fire incidents in three slums in Nairobi last evening. The fire incidents happened in Mathare, Mukuru and Kariobangi areas. Police say no one was injured in the incidents and suspect illegal power connections fuelled its spread. The fires were contained by locals and fire service engines that arrived late.

Mutunga, however, said challenges are still abound in the Judiciary and he is working to ensure everything runs smoothly. He cited delaying of completing some cases, inadequate funding and lack of enough judges and access to justice. “I am aware through the numerous complaints that we receive that some cases take too long than the stipulated time,” he said. Mutunga said the Civil Procedures Act stipulates that a case should not take more than 90 days before judgment is delivered. He attributed the long time taken to dispense justice to the low number of judges in the country. “We only have 125 judges countrywide serving a

population of over 40 million,” he said. In order to address the problem, Mutunga said judges are currently submitting daily performance work sheet detailing the number of cases they have finished and those that are still pending with reasons why. “We are working to ensure that people get justice at the right time, these daily performance sheet delivered by the Judges help us to know which cases have stayed for long and what can be done,” said Mutunga. He, however, urged that in order to reduce backlog of cases in the courts, cases dealing with family issues, small land disputes should be solved at the village level. “About family cases, I don’t think that they should be in court. They should be dealt with using alternative dispute mechanism,” he said. The Ethics and Anti-corruption Commission (EACC) has called on all Kenyans to join the fight against corruption, saying it cannot be won by one agency. The commission’s chief executive Halakhe Waqo said only concerted efforts from all Kenyans will make the war a success. Speaking during this year’s International Anti-corruption day, Waqo said no single agency can win the war on corruption.

“We cannot rely on a single agency to fight corruption, everyone in the community and every institution has a role to play. We recognise that we can do more as a country if we pull our efforts together,” he said. “For us as country to reach zero tolerance level in curbing this menace, we require concerted efforts at all levels, individuals, national and regional,” he said. not heed the EACC summons since the information sort from him was already in the public domain and it will be unnecessary for him to do so. “Raila had already issued press statements where he gave out Eurobond figures, the hard copies of the financial statements in question are with EACC,” he revealed. Lobby sets up anti-graft team to stem region’s runaway corruption Open Society Initiative for East Africa (OISEA) has put up a committee of antigraft agencies to harmonise strategies to stem corruption in Kenya and the East Africa region at large. Suspects held over lions poisoning

Three suspects have been arrested over the poisoning of two lions in Narok and are expected to be arraigned in court. The dead lions are suspected to have consumed poisoned meat. One of the dead lions was identified while the other had been mauled by hyenas beyond recognition. A cub that was accompanying them was fine by yesterday afternoon. At the same time, there were three carcasses of vultures in the vicinity suspected to have preyed on the dead lions. The two dead lions were not among the pride of eight that had been reported and attended to yesterday but judging from the distances of about a kilometre radius, it could mean they had consumed the suspected poison from the same source. The remnants of the carcasses have been incinerated and buried to prevent further access by other animals. A report of suspected lion poisoning was made on Sunday around Governors Camp area by Narok County rangers and Governor’s Camp management. All the eight lions belonging to the Marsh pride are fine with no visible signs of poisoning. One of these was reported to be showing clinical signs of poisoning which, included severe in coordination, muscle tremors, profuse diarrhoea, papillary dilation, among others. Four others were reported to be showing mild signs. The one with severe signs was treated. This morning, the treated lion has been reported to have shown marked signs of improvement and has joined the rest of the group. All the eight were this afternoon observed to be together with no further signs of poisoning. Monitoring of the pride is ongoing. This morning another lioness was reported in a different location that had not been seen yesterday. A Kenya Wildlife Service veterinary doctor has conducted a post mortem examination in the presence of scene of crime officers. Samples will be ferried to the Government Chemist for toxicological analysis.

Trump risks disqualification over anti-Muslim utterances Donald Trump’s statement that Muslims should be banned from entering the United States “disqualifies” him from being president, the White House spokesman said Tuesday. “The fact is what Donald Trump said yesterday disqualifies him from serving as president,” White House press secretary Josh Earnest said in Tuesday’s press briefing. Africa to get Sh1 trn for renewable energy plans Africa Renewable Energy Initiative (AREI) has received more than $10 billion (Sh1 trillion) from the international community. The additional funding for the programme was announced during the ongoing cop21. At an event on the sidelines of the Paris climate meeting, the European Union, Sweden and G7 jointly pledged $10 billion. In particular, Germany will contribute $3.25 billion, France $2.2 billion, Sweden $500 million and Canada CA$110 million to the initiative. The ambitious initiative is an Africanled plan to add 10,000 MW of additional renewable energy which will provide clean power to millions across the continent. United Nations Environment Programme (Unep) Executive Director Achim Steiner said, “Africa’s renewable energy revolution will ensure access to clean, reliable and efficient energy, while ensuring we do not add to the greenhouse gas emissions we are gathered here in Paris to reduce. The Africa Renewable Energy Initiative aims to do just that.” “Such leadership from Africa, and the financial backing from the international community announced today, provides fresh hope that we can tackle the twin challenges of sustainable development and climate change,” she said. African Development Bank (AfDB) President Akinwumi Ayodeji Adesina said that through the initiative, Africa can sustain fast economic growth as well

as maintain a low carbon development pathway. “Africa is tired of being in the dark. The lack of electricity has put the brakes on Africa’s industrialisation,” he said. AREI was launched by representatives of the African Union, the African Ministerial Conference on the Environment, and the African Development Bank, among others. The initiative aims to help achieve sustainable development and enhanced well-being by ensuring universal access to clean and affordable energy in Africa. In its second phase, the initiative is targeting the mobilization of Africa’s

massive renewable resources, such as solar, geothermal and wind, to generate at least 300 GW by 2030, more than doubling current capacity. Approximately 600 million people have no access to electricity in Africa, with the figure expected to rise to 700 million by 2030 without further action, a 2015 Unep report found. As a result, many rely on wood or other biomass to cook and heat their homes, leading to hundreds of thousands of deaths each year from indoor air pollution.

Imperial bank large depositors to know fate in March 2016 The fate of Imperial Bank’s large depositors whose accounts holds up to £880 million (Sh135 billion) still hangs in the balance after the Central Bank of Kenya announced a deal to pay customers with not more than Sh1 million. CBK governor Patrick Njoroge has said the bank will have a clear picture by March on how to deal with Imperial Bank depositors who had more than Sh1 million. The governor told Reuters that he was strengthening supervision in the wake of the Imperial Bank case, saying mergers would help create resilient institutions from the one-trick ponies found in parts of the banking sectors. The central bank had announced that it had reached an agreement with DTB to give some 44,300 small depositors

Sh80 billion ($80 million) subject to a maximum of Sh1 million. The remaining 5,700 account holders will have to be patient until the end of March 2016 when the CBK will release a detailed plan of their payments. However, depositors with up to Sh1 million at the bank who accounts for 90 per cent have started receiving their monies back in full but larger depositors must wait for a full examination of the books before they receive additional cash. “We expect that this work will be done and completed by the end of March next year, and at that point we can decide on a way forward,” Njoroge said. Paying small depositors first allowed us a bit of time to examine and verify all the loans and deposits at the bank, he added.

Branch International shakes up mobile money market Branch International Inc, a financial services company and the group behind an app that lets users access loans via their mobile phones, has announced plans to plant itself deeper into the Kenyan market. Branch has been operating in the country for more than 6 months now and already has 10,000 active users. The group has disbursed over $1 million (Sh102 million) in loans so far. As one of the latest entrants in the country’s mobile money industry, Branch has positioned itself as one of the leading localized apps on Google’s Play Store (having scored 4.1 stars out of 5, according to recent rankings). The group, headed by CEO Matt Flannery, is now looking to grow its customer base as Kenya’s mobile money revolution continues to take shape. Flannery is also the Co-founder of Kiva.org, a non-profit organization that offers loans to entrepreneurs. “Branch aims to be the number one mobile lending solution in Kenya,” said Head of Branch Kenya, Andrew Huelsenbeck. Branch then uses this information to assess a person’s creditworthiness and provide a seamless experience when applying for a loan.

American mining firm to sack 85,000 workers US-based mining firm, Anglo American has said it will sell huge chunks of its business and shrink its workforce by nearly two thirds due to fallen share records in the company. These amendments will lead to the sacking of 85,000 employees, reducing the staff from 135,000 to 50,000. The group has been forced to restructure following a collapse of commodity prices that have slashed the profits. Thirty-six countries have kick-started an initiative to promote the use of geothermal energy in developing economies as a cleaner alternative to oil, gas and coal. The Global Geothermal Alliance (GGA), launched on the sidelines of the UN climate talks in Le Bourget, aims at a six-fold increase in geothermal electricity production and a tripling of geothermal-derived heating by 2030. It seeks to reduce pollution while driving down the cost of power for consumers and power producers at large. The GGA is an initiative led by the International Renewable Energy Agency (IRENA) to increase geothermal electricity generation and the direct use of geothermal heat. Members of the GGA include: Kenya, Bolivia, Burundi, Chile, Colombia, Costa Rica, Djibouti, Ecuador, Egypt among others.

This is part of the company’s retail expansion plan in line with the firm’s long term drive towards delivering the best service experience for customers, Airtel has said. The shops have been recognized for their exclusive Airtel Premier lounges where premier customers get access to first class treatment upon presentation of the Airtel money premier visa card. These lounges arelocated in Parkside shop, Sarit shop, Oval shop, Koinange street shop and Moi avenue shop in Mombasa. Airtel Kenya CEO Adil El Youssefi says the launch of more shops has been a significant achievement for the company.

The creator of the famous crypto-currency known as Bitcoin is a 44-year-old Australian man, sources have claimed. According to a report from worldrenowned tech journal Wired, an Australian cryptologist named Craig Steven Wright is the mind behind the digital currency that is used in countries across the globe, including Kenya, China, the United States, the UK and other parts of the European Continent. Earlier reports by other outlets had claimed that a man known as Satoshi Nakamoto had creted Bitcoin. However, one Dorian Nakamoto (birth name Satoshi) ended up suing one outlet, claiming that h was not, in fact, the person responsible for creatingthe currency. Now Wired claims that Bitcoin creator “Satoshi Nakamoto” is a pseudonym used by Wright.

UK property firm St Paul’s delays NSE listing till 2016 UK property firm St Paul’s Property Trust Plc has pushed its listing on the Nairobi Securities Exchange (NSE) to early next year. The firm, which will be the second real estate company to list on the NSE, attributed the decision to interest rates and volatility seen in the equity markets. The firm had initially planned to list this month but the current atmosphere of unsteady equity markets and particularly volatile interest rates, would not be conducive to an immediate listing, St Paul’s Property Trust Plc Chairperson Patrick Walker said. Walker added that the firm will be coming to the market in the New Year as a full Initial Public Offer (IPO) rather than the originally planned more narrow placement. The proceeds of the IPO will be invested immediately into identified properties that fit the secure investment model proposed. The firm mainly invests in prime properties outside central London whose main tenant is the government and related agencies. This will give Kenyan investors exposure to the UK property market and the highly stable commercial let-to-government sector. “Feedback has suggested that our proposal is particularly attractive to a wider market and internationally, as it provides .

The survey ranked self-employment as the major source of revenue across the country accounting for 30 per cent of household incomes. Ipsos’s social, political, economic and cultural survey indicates that agriculture ranks as the second source of household income accounting for 26 per cent while private sector wage employment comes third with 20 per cent. According to the survey which interviewed 2,058 people from eight regions of the nation, public sector wage employment was ranked fourth representing an 8 per cent of total household income. “Other sources of income in the country include being given money by others at 4 per cent, while unknown sources tie with those who do not know being at 2 per cent,” states the survey. Regionally, in North Eastern, 66 per cent of citizens get their household income from livestock, while only 18 per cent depend on selfemployment.

Smith & Wesson gun-maker profits shoot up amid soaring crime rates One of the World’s leading gun makers Smith and Wesson has nearly tripled its profits in the three months to October compared to the same period last year. The firm said its net inflows reached Sh 1.4 billion ($14.2 m) for the period under review as compared to Sh 530 million ($5.2m) for the same quarter the previous year. The US gun-maker said its net sales rose up by 32.1 per cent to Sh 14.6 billion ($ 143.2m) with its firearms division contributing Sh 1.8 billion

($18.4 m) representing a 24.6 per cent hike. The company said its overall results had beaten expectations and that it would now raise its 2016 guidance for income and revenue. Cash flow for the six months to October was also positive, despite a build-up in inventory in the lead up to the Christmas shopping season, the firm reported. “Our balance sheet remains healthy as we ended the second quarter with cash of Sh 5.5 billion ($54.1m)

State must come clean on the Eurobond saga The government should come clean on how the Sh250billion proceeds from the controversial Eurobond was spent. While National Treasury has tried to hoodwink Kenyans with their inconsistence figures, Kenyans will be shocked that the same government is still borrowing to finance projects.

If indeed the proceeds from Eurobond was well utilised as claimed by Treasury Cabinet Secretary Henry Rotich then the government would have not been on a borrowing spree. It’s not wrong to borrow, but the impact of any loan must be felt throughout the country. The government cannot borrow colossal sums

KDF should probe killing claims against officers The Kenya Defence Force (KDF) has been in limelight for human rights abuse, yet the government has continuously defended it. Recently, President Uhuru Kenyatta defended KDF against claims of illegal charcoal business during their peace keeping mission in Somalia.

Today, KDF through its spokesman David Obonyo has defended the forces against any involvement in extra judicial killings in Mandera County where more than 25 bodies have been exhumed. For KDF to instil discipline in the soldiers, they should conduct their own probe into

A goalkeeper has been slapped with Sh13, 678 fine for digging up a penalty spot. Augsburg goalkeeper Marwin Hitz received the bill from Cologne for damaging their penalty spot in a Bundesliga match on Saturday. The 28-year-old scuffed up the spot in protest of a decision to award a penalty to the home side. After pulling his unfamiliar antic, Hitz went ahead to save the spotkick after the taker, Anthony Modeste lost his footing. Hitz later apologised for his actions during the 1-0 win, but he was sent the bill nonetheless. The fine is expected to covers the cost of a piece of turf and two hours’ work to replace it. The Switzerland international confirmed he will pay the bill and make a donation to a children’s hospital in Cologne. Augsburg are sending Cologne a club branded lawnmower to help with the repairs.

Indoor tour set to replace IAAF series

German, Scotland, Sweden and USA will host the newly-launched IAAF World Indoor Tour, 2016 whose winner will pocket Sh2 million in prize money in both the men and women’s categories. The event has four competitions which have been regularly staged at the IAAF Indoor Permit meetings in previous years. The four meetings will all be staged in February 2016 and are: Germany will open the first stage of the event on February 6 at Karlsruhe indoor meeting followed by - New Balance Indoor Grand Prix in Boston, USA), on February 14. Stockholm will host Globen three days later with a final leg being staged on February 20 in Glasgow, Scotland. The tour, which will have half of the individual indoor championship disciplines as tour events each year across a two-year period, contains several innovative features, including a points system and prize money. Beginning with the 2016 edition in Portland, athletes will automatically qualify for the next edition of the IAAF World Indoor Championships as a ‘wild card’ entry*.

More trouble for Ingwe as tribunal calls off election AFC Leopards elections which were set for December 13 has been suspended by Spots Dispute Tribunal. The tribunal suspended the forthcoming polls called by one of the faction fighting for the leadership of the club. The group, led by Mathew Opwora were told to stop the process until the case before the tribunal is determined. Interestingly, it is the Opwora’s group, which “ascended to power” at the den after former leadership of Allan Kasavule resigned creating a power vacuum. Opwora registered the club with Sports Registrar before Dan Mule faction through an AGM held early in the year install themselves as the club leaders, prompting Opwora to move to the tribunal. On Tuesday, the two attorneys representing the warring factions were engaged in accusation and counter accusation during the hearing of the case at Tribunal. The case was adjourned after the two failed to agree on which business to transact with Mule’s lawyer Silvia Matasi accusing Morris Osundwa, appearing for Opwora of creating confusion’ after he failed to serve them with proper documents. It took the court about 15 minutes to give direction after Matasi and a Miss Kamande

who was appearing for the Registrar said they were not ready to proceed with the case. “Please be advised that no more games will be entertained by this tribunal. The players of this country are suffering and we want to conclusively deal with this matter,”tribunal vice chairlady Ellynah Shiveka ordered the two parties. “After consultation, the court orders that concerned parties to be served with all relevant documents before Friday midway. The full hearing has been set on Wednesday, December 16. Election cannot take place until the matter is determined,” added Shiveka. Kamande asked for the tribunal indulgence to allow her time to submit her replying affidavit, arguing that her client (Sports Registrar) who is the ninth respondent in the case was “unaware of the case”, adding that she had no time to go through the papers which she was “served just now” Osundwa accused Kamande of taking the judicial process for a ride explaining that he, in fact served the registrar on November 17, 2015. Mule’s lawyer argued the registrar is a party but not an interested party and should be ordered to appear before the court

Fury stripped of IBF title days after big win

World heavyweight champion Tyson Fury has been stripped of his International Boxing Federation (IBF) title less than two weeks after the historic win over Wladimir Klitschko. The Briton, 27, had to agree to fight the IBF’s mandatory challenger Vyacheslav Glazkov, but will instead face Klitschko in a rematch. Fury beat Klitschko on point on November 28 to claim three versions of the heavyweight crown. “Our challenger was Vyacheslav Glazkov, but instead Fury’s gone and signed a re-match clause with Wladimir Klitschko,” Lindsey Tucker, championships chairman at the IBF said. Fury, who is unbeaten in 25 professional contests, retains the WBA and WBO versions of the heavyweight title, while the WBC belt is held by American Deontay Wilder. The 31-year-old Glazkov, also a Ukrainian, has won 21 of his 22 professional fights. The contract for last month’s title fight in Dusseldorf included a clause for a rematch, for which the date and the venue have to be decided, and Klitschko - who had been world champion for 11 years - announced last week he would take up the option.

FKF board orders fresh sub-branches polls over hitches The Football Kenya Federation (FKF) electoral board has ordered fresh polls in sub-branches that did not hold polls last Friday. The new elections will be held on December 15 for the positions which had ties in North Eastern and for the sub-branches where elections were not held due to one reason or another. Only 41 of the 62-sub branches successfully held the election conducted last Friday across the country. This is according

the certified election report and analysis of results from the electoral Bureau, Institute for Education in Democracy (IED) released by the board on Wednesday evening. The affected branches include Baringo, Butere/ Mumias, Dagoreti, Isiolo, Kiambu, Kilifi, Kirinyaga, Kisumu, Kuria, Machakos, Makadara, Meru Central, Migori, Mombasa, Moyale, Nakuru, Nandi North,Tana River, Transmara, Transnzoia West, Vihiga and West

Pokot. However, where candidates were unopposed, no elections will be held. After the sub-branch polls are done with, the board will announce the dates for branches and National elections which were temporarily stopped. Elections were successfully carried out in Nyando,Kakamega, Busia, Bondo, Bungoma, Embakasi, Embu, Homa-Bay, Kajiado, Kaloleni, Kamkunji,

Kasarani, Keiyo, Koibatek, Kwanza, Lamu, Langata, Lugari, Makadara, Malindi, Maragwa, Mbeere, Meru-North, MeruSouth, Mt. Elgon, Muranga, Mwingi, Nandi South, Nyamira, Nyeri, Rachuonyo, Starehe, Suba, Taita Taveta, Teso, Tharaka, Thika, Transnzoia East, Westlands, Kisii and Siaya. The winners from the 41 sub branches will be required to collect their certificates from the Board’s secretariat located at the International House.
