he National Assembly’s Justice and Legal Affairs Committee has stepped in to resolve a dispute between the Judiciary and a private developer over a piece of land near the Supreme Court building. This is after the Chief Registrar of the Judiciary

Anne Amadi told the MPs that the Judiciary cannot implement its planned expansion of the Supreme Court “because the parcel of land had been grabbed.” Amadi said the Judicial Service Commission (JSC) was in talks with the developer, whom she declined to name despite pressure from

legislators. “The Supreme Court is very old, but there is the space near the Supreme Court that hosts the Maasai Market during the weekend. That land apparently belonged to the Judiciary before but now it is registered in the name of an individual. But we have began the process

of reclaiming it so that we can have a proper Supreme Court at that space,” the CRJ stated. Committee chairman Samuel Chepkonga said they will take up the matter with the National Lands Commission (NLC) with a view of having the title revert back to the Judiciary. CONTINUED ON PAGE 2

Nkaissery urges governors to fund chiefs’ Barazas, not MCA trips Interior Cabinet Secretary Joseph Nkaissery has promised that the national government will start funding chiefs and their assistants to enable them organize public Barazas on security matters. Nkaissery said the administrators will be funded quarterly, challenging the county governments to support the move. “These are the people who live with the common man and we are working to find ways of funding them. We request you [governors] that instead of funding trips for your MCAs abroad to support this,” he said. The minister also said urged

President Uhuru Kenyatta and First Lady Margaret Kenyatta have launched a unique mentorship project that will benefit bright pupils from across the country. The project, known as Pupils Reward Scheme (PURES), was initiated by the President to motivate pupils to work hard in their studies and instil in them a sense of discipline, direction and patriotism. Through the project – the first of its kind in the country – beneficiaries will be allowed to visit State House to interact with the President and the First Lady. Speaking during the launch, President Kenyatta said the main objective of the project is to inculcate the spirit of service which has become rare in the Kenyan leadership and community at large. He said the project enabled young people to experience what it takes to be in government leadership and to offer services. “It is very unfortunate that in recent years as a country we have lost that spirit of service. We have embraced negative values that in so many ways have resulted in our children losing hope,” said the Head of State. The President observed that the negative values in the society are primarily attributed to leaders who do not exhibit the spirit of selflessness, service and sharing amongst the youth. “We have tended to personalize leadership as opposed to growing it, we have tended to think that leadership is inherited or belongs to a certain class of people to exclusion of others,” he said. The President said the programme will cultivate a desire amongst the youth to work hard to achieve the best and also aspire to get into public leadership. The first batch of beneficiaries comprised of 25 boys

and 23 girls from all counties who excelled in their Kenya Certificate of Primary Education (KCPE) exams last year. The students were accompanied by their teachers. The First Lady said the project signifies the President’s desire to mentor the younger generation. “Presently the Pupils Rewards Scheme is designed to allow children from all over the country to visit State House to meet with H. E. the President,” said the First Lady. Apart from interacting and learning from each other in an open environment as one people from one country, the First Lady said during the one week programme, the young performers will also visit various Government institutions including the National Youth Service headquarters at Ruaraka and Parliament buildings. She said this opportunity will open up the minds of the young people and encourage them to pursue careers in government or national leadership in the coming years. “I take this early opportunity to congratulate each and every one of you for the truly exceptional performance you displayed in your KCPE exams,” she told the beneficiaries of the project. Interior and Co-ordination of National Government, Cabinet Secretary Joseph Nkaissery said governors need to emulate the President by initiating similar projects in their respective counties. He said good mentorship has correlation with security adding that some of security challenges have been perpetuated by misguided and deviant use of the youth in the country. “What you are launching here today is a welcome initiative which will be an additional arsenal in the fight against crime and insecurity,” said the CS.

Kangata’s query was triggered by the presentation done by High Court Registrar saying Ford Foundation contributes towards capacity building and training for the Supreme Court.

“Chair, I can tell you here – through the capacity building and training aspect- is where the Europeans bring their philosophy to the Judiciary. They train on human rights, homosexuality. So the question begs why go for Ford Foundation? There are other people which can do. Chairman, this committee should demand all the details into what Ford (Foundation) actually funds,” he said. His assertion came despite the CRJ explaining that the United Nations Development Programme also gives funds for the ‘Justice at Last’ initiative which is aimed at clearing the cases backlog at the High Court while World Bank funding goes towards construction of law courts, ICT and case management. Chepkonga had earlier inquired into the curriculum used at the JTI. He was

apparently concerned by recent remarks by the Magistrates and Judges Vetting Board which noted that most of the recently appointed judges were poor at writing judgments. Amadi said the Judiciary needs 30 more judges to deal with lands related matters. The Judiciary recently hired 14 judges in a bid to ease the backlog that has been experienced in the halls of justice. There are also plans to construct 12 new High Courts and 10 new Magistrate Courts before September 2016. The Judiciary registered a 42 percent increase in revenue collected through fines and bonds, with Sh2.11 billion collected up from last year’s Sh1.4 billion. Amadi attributed the rise to the shift from a cash payment system to a banking transfer system.

There’s a growing body of research that finds taller people actually earn a higher salary than their shorter colleagues. LiveScience, along with several other research journals, has found that across the world, a person will make an extra Sh77,400 based on their height. Even in Kenya, the number of tall, successful moguls seems to be higher than that of their much shorter peers. Scientists believe that every extra inch a man has in height is worth almost $800 (Sh77,400) a year in increased earnings. A new study has found that the sharpest jump in earnings takes place between men who are 5 feet, 4 inches tall and 5 feet, 6 inches tall. The Atlantic notes that in Western countries, a four or five inch difference in height is associated with an increase in salary of between 9 and

In fact, some researchers believe taller people in officers earn more because they have better “emotional intelligence, social skills and self-confidence.” Another theory suggests that taller people are treated better, which in turn, gives them more emotional stability and a better work ethic. The most recent study, which is a new paper by US-based economists, implies that it may be a combination of all these factors. Taller people are perceived to be more intelligent and often seen as more powerful, says one study, published recently in the Economic Record. “Our estimates suggest that if the average man of about 178 centimeters (5 feet 10 inches) gains an additional five centimeters (2 inches) in height, he would be able to earn an extra $950 (Sh92,000) per year,” said study co-author Andrew Leigh, an economist at the Australian National University.

Nairobi rains to cease next week The heavy rains that have characterised Nairobi’s weather patterns will reduce in coming days. The North-western and Southern parts of Central Rift Valley are also likely to experience a cessation of the Long Rains, beginning this week. The Metrological Department says residents in these areas will experience relatively warm weather patterns. However, Deputy Director Peter Ambenje, said the rainfall is expected to continue over several

parts of the country. He noted that Western and Coastal regions will continue receiving rainfall until the end of next month. “We are not expecting anything like we saw last week in Nairobi, but for Nairobi and Central, we expect heavier rains in the fourth week of the month,” he said. Heavy rains have been experienced in the city over the last few weeks claiming the lives of a number of people.

A stakeholder meeting to deliberate on the measures to combat the alarming rate of cholera spread is scheduled for today. The meeting will bring together county executives in charge of health from all the counties, as well as the Ministry of Health officials from the national government. The main agenda of the meeting will be to come up with short term measures to curb the disease that has so far claimed the lives of more than 65 Kenyans across the country. In at least 11 counties that the disease has been reported more than 3,000 people are said to be affected, with Nairobi having 16 deaths so far and more than 320 cases. The disease has also been reported in Bomet, Nakuru, Murang’a, Homabay, Migori, Kirinyaga, Baringo, Embu and Mombasa counties, with many counties banning hawking of food in their major towns. 30 remandees at the Shimo La Tewa Maximum Security Prison have also been placed in isolation following a cholera outbreak that has so far killed three inmates. Coast Region Prison Commander James Kodieny, says those suspected to have contracted the virus are receiving treatment in an isolation ward at the facility. Kodieny said the situation is now under control after the county government intervened. “The situation is under control, we have isolated them and we are controlling the situation. We are dealing with a bigger problem than just the prison problem,” said Kodieny. This brings to 66 the number of people who have died from the Cholera outbreak in various parts of the country. Acording to the Kenya Red cross, eight cases were reported on February 9 from Nairobi County, out of which one was confirmed dead. As on February 10, 2015 a total of 94 cases have been reported, nine of which ended in fatalities.

Haco executives busted for fraud Tiger Brands, South Africa’s biggest consumer foods manufacturer, has revealed that executives at its Kenyan business committed fraud to reach targets as it reported flat first-half earnings. Action had been taken against senior personnel at the

company’s Haco Industries branch in Kenya, Reuters reports. Tiger Brands, which is a leading South African maker of energy drinks, cereal, rice and pasta, had bought a 51 per cent stake in Haco back in 2008. Following the announcement,

Tiger Brands CEO, Peter Matlare told investors on Wednesday that the matter was being dealt with. Matlare said Geoffrey Kiarie, Haco’s now former MD, had left the company and that the company planned to take legal action against him, says a recent

report by Reuters. “They were key executives right at the top. It was difficult to pick this up,” Matlare explained. He also noted that a team of auditors had failed to uncover the irregularities. Haco’s top executive allegedly inclined his colleagues to pre-

Five of the biggest banks in the world to be fined for rigging currency markets On Wednesday, five of the world’s biggest banks will be charged by US and British authorities over rigging of currency markets. They, Barclays, JP Morgan, Royal Bank, Citigroup and UBS are expected to be hit with a combined bill of more than $5 billion (Sh482.92 billion). Some of the banks will pay for their traders allegedly

manipulating the $5 trillion (Sh484.46 trillion) a day foreign exchange market to about $10 billion (Sh965.8 billion). JPMorgan, Citigroup, Barclays and Royal Bank of Scotland are expected to plead guilty to the criminal charges. The impact of guilty pleas could jeopardize their U.S. operations and they are therefore seeking assurances

from U.S. regulators that they will not be barred from certain businesses if they plead guilty. Barclays is expected to reach settlements with some British and U.S. regulators and their penalties could be significantly higher than the other banks and top $2 billion. (Sh193.6 billion). They had set aside $3.2 billion (Sh309.8 billion) to cover any forex fines.

Kenyans deposited Sh2.4 trillion in first quarter 2015 The number of unbanked Kenyans appears to be falling as lenders encourage consumers to adopt alternative forms of banking. During the first quarter of 2015, Kenyans deposited some Sh2.41 trillion in commercial banks. This is a jump from Sh2.33 trillion worth of deposits in the previous quarter, ending December last year. The latest statistics from the Central Bank of Kenya (CBK) attribute the 3.4 per cent rise to branch expansion, remittances and increased use of alternative banking services. “Since the roll out of the agency banking model in May 2010, commercial banks have continued to contract varied retail entities to offer basic banking services,” the CBK said in a recently released statement. As at March 31st, 2015, there were 16

commercial banks that had contracted 34,381 active agents which had facilitated over 149.4million transactions valued at Sh817.7billion. “Interest on loans and advances, fees and commissions and interest on government securities were the major sources of income,” the CBK added. The sector’s deposits continued to be the main source of funding for banks in the first quarter of 2015. The banking sector recorded a pre-tax profit of 37.3 billion shillings in the first quarter of this year compared to 36.3 billion shillings, which the banks made in the quarter ending December 2014. The Kenyan banking sector is expected to remain stable and resilient towards the rest of the year.

Israeli ambassador to Kenya, Yahel Vilan says Kenya was picked among other African countries due to its strategic position and its porous borders with troubled nations.

Some of the Israeli companies include Dignia, Magal S3, Mer Group, Security Division, Mifram, NICE, and ORAD. Others include Terrogence, Supercom and X-test. Terrogence is a private web intelligence company that focuses on detecting and verifying terror. “Israel has developed expertise tactically in almost all aspect of

homeland security,” Vilan said. “We don’t want to limit ourselves in this,” he told journalists on Wednesday. “We will engage the Government of Kenya at a later stage.” The companies have vast experience in issues of security ranging from terror, cyber crime, VIP protection and intelligence gathering for both civilians and the military.

Ambassador Vilan was addressing journalists after opening the Israeli Homeland Security Business Seminar in Nairobi. A group of Kenyan investors have put together the capital and real experience to launch, a 400 –acre mixed use development in Limuru. It will be one of Kenya’s largest private developments, and will be a new model that will open way for Kenyan industries to take part in funding the country’s largest building projects. However, recent reports of a death at Alliance Girls High school sent chills on almost everyone’s spine. How can a child die at school? Who is taking care of their health? Why wasn’t she rushed to hospital but more importantly, why wasn’t the parent notified? The student’s mother has maintained that she will not sue the school but told XAccess that she feels it was a case of negligence. Another similar incident happened at Chewoyet high school where a student was sent to the hospital alone and died in the queue. While these cases may seem remote it begs the question; are schools neglecting their students? “Most of the schools are not giving much attention to the students as some are shut up while some cases are hidden from parents.” Joseph Ndafa a high school parent told XAccess. “If something happens to the child the parent is not notified until when it is too late, if they fall sick they are only given medicines such as Panadol without even being diagnosed, this is very disturbing.” He adds. Many parents are now claiming that school administrations are only concerned about academics and do very little to take care of the student’s health and in some cases security. However, some teachers also blame absentee parents who send their children to school and go AWOL even when needed. A spot check by XAccess confirmed that the most schools have qualified nurses who are responsible for the students and when interviewed seemed knowledgeable all saying they offered first aid, treated minor ailments but referred students to hospital where it became apparent that they were too sick. Who then is to blame? A partnership between teachers, parents and the government will go a long way in securing the health and security of our students. Rigid rules and finger pointing coupled with non-existent facilities need to be a thing of the past. As the debate rages on let us spare a moment of silence for the departed souls and a prayer for the parents who lost their children. A lasting solution could not be more timely.

Kilimambogo false alarm

tudents at Kilimambogo Teachers College were attending their evening preps last Sunday when suddenly the lights went off. What followed was screams and shouts and near stampede as everyone imagined the worst. The panic-gripped students ran in confusion around the college with some sustaining serious injuries as they ran out of the school through a barbed wire fence. The students were scared and unsure of their security, and attempts by the College security officers and administration to stop them fell on deaf ears as they preferred to seek refuge in the nearby village. Intensive efforts between the security personnel and area residents have helped to bring back all the students.

Gospel musicians need a prayers There have been countless fights in the gospel industry lately. From artistes stealing songs of others to producers receiving bribes. Some gospel artistes have been spotted with alcoholic drinks in hand. Then the next day you will hear them sing about how alcohol is bad and not Godly. The gospel industry is not about spreading the gospel anymore. It is about how much money I make and how many followers I have on social media. The industry has deviated from

God and into more material things. It needs prayers an overhaul and mentors. The older generation in the gospel industry needs to educate and mentor the young ones who are starting out on how to behave and stay on the path of righteousness. MPs and Senators don’t need convoys MPs and senators don’t need convoys, not if they’re going to cause traffic jams and act like they own the road whenever “mheshimiwa” is going out for lunch. I understand that there are important meetings between that some of our leaders must attend on the other side of town, but many of them are notorious for rushing through traffic at around 1pm. I’m asking the government to reduce the number of vehicles in a convoy. By my

count, it looks like some politicians are ferrying their entire clan across the city! Who needs six vehicles to get from Parliament to the Ministry of Health building? These politicians act like they own the road when it is our taxes that pay for the fuel in their cars, the food on their table, the school fees for their children and their outdated, unfashionable, yet somehow expensive suits.

Build good water drainage systems In the past few weeks Nairobi has been experiencing ‘flooding’ in some of its environs thanks to the heavy rains. It has been chaos ever since the flooding begun; roads have been impassible, traffic has never been worse, there was also an extent to which various houses got flooded. This should be a wakeup call to the bodies concerned that the drainage systems in the city and other towns should be reconstructed to avoid any future mishaps for reoccurring. Omwela vows to revamp Rugby 15s

Kenya Rugby Union boss, Richard Omwela says he will ensure Rugby 15’s has significant growth during his tenure. Omwela spoke as Kenya prepares to warm up for the Africa Rugby Cup with test friendly match against Portugal on May 30 at the RFUEA grounds. Omwela says the 15s team, under South African coach Jerome Paarwater, will be given all the necessary support in order to raise the standards of the game in the country. “As a board we shall give the coach and the entire technical bench the necessary support like never before. We want growth in all levels of the sport in the country,” he said. “There is no way we can expect results where we have not invested and put a lot of effort, I have had meeting with the coach and

Sunderland manager Dick Advocaat will decide on his future next week after guiding the Black Cats to Premier League safety with a draw at Arsenal. The Dutchman wept tears of joy after a goalless draw at Emirates Stadium that meant the last relegation place now lies between Newcastle and Hull. Advocaat was appointed until the end of the season when he took over from the sacked Gus Poyet in March. “I have to think about everything,” he said when asked about his future. Advocaat has one final game in charge, at Chelsea on Sunday, and would not make any further immediate commitment. But the former Netherlands coach did reveal that if he does quit Sunderland now, it would be his final job in management - as it will be if he continues on Wearside. “I will give an answer on that next week. If you don’t mind I will keep that to myself,” added the 67-year-old. Advocaat explained he was moved to tears of emotion at the final whistle by the achievement of pulling Sunderland out of trouble - and by the reaction of his longtime right-hand man Bert van Lingen. “It was emotions,” he said. “In 25 years we have done everything together. “He started crying and I did the same. He said ‘let it go’ so I said ‘why not?’” Advocaat added: “It is not about me. It is about everyone who is involved in the

club, the owner Ellis Short and the people in the office, the players. “The easiest way to work with the team is to start from day one with everyone believing and they did that. “Nobody was expecting we would do it here against a great team but if you do it on your own, like we did, it gives me a special feeling.” He added: “It was the way they worked, organised, the tactics. “I kept saying we would stay up if you believe in the players and the qualities you have. “I said to the players they were not here because they were nice guys - I told them they were here because they were good players.” Sunderland’s point means Hull City or Newcastle United will join Burnley and QPR in being relegated to the Championship on Sunday.
