The report by the International Policy Group (IPG) also says that President Uhuru Kenyatta’s Jubilee administration has lost the grip to fight graft in the country.

Titled Kenya’s Politicized Anti-Corruption Architecture’, it paints a grim picture in which individuals implicated in various scams retreat to their tribal cocoons to escape the hand of justice. In this regard, powerful cartels often implicated in corruption are said to hire the best lawyers with strong connections with

judges in order to get favourable results. “Cartels have hired well-networked lawyers who are also crafty and conversant with the processes in the corridors of justice to influence which judges hear specific cases thereby predetermining and compromising the outcomes of trials” IPG Executive Director Martin Nkaari said. Public servants eying political seats to quit a year to polls

MPs now want the Elections Act amended to require that public servants eying elective seats in general elections quit their offices one year before the polls. Currently, they are required to leave office six months to the elections. But the Parlaimentary committee on Justice and Legal Affairs chaired by Ainabkoi MP Samuel Chepkong’a said one year would be appropriate as already, labour laws require one to issue a threemonth notice before resigning which when added to the six months required by the electoral body translates to nine months, a period the committee rounded off to one year. “It means that you if you want to resign, you will need nine months, which is almost a year, I suggest that you leave it at one year. If there is anyone with a different view, let us meet on the floor of the House,” said Chepkong’a. The proposals were made during a

meeting with the Independent Electoral and Boundaries Commission where they submitted their amendments to the electoral law. IEBC had initially proposed that public officers exit public office six months before declaring interest in elective posts but according to the Vice chairperson Lilian Mahiri-Zaja consultations were still ongoing to determine the time frame. “The law has been that for general elections, the initial provision was seven months, it is now our proposal that we reduce that to six months because that is still adequate time for a public officer to disengage himself through resigning, retiring or any other way of ceasing to hold public office,” said Mahiri-Zaja. And when the members noted the commission’s reluctance to accept their proposal, they questioned whether the commissioners had personal interests; but the commissioners dismissed the

notion saying they would deliberate the matter further.“The proposal from the committee is that we allow for one year. And you know law making is the preserve of Parliament and members have given their view, so as long as we are safeguarding the mischief that was meant to be cured, we are okay,” Mahiri-Zaja added. Last week IEBC Chairman Issack Hassan also proposed to the committee a change in electoral law that would require MPs to hold a degree from a recognised university in order to contest in the 2017 General Election and the same for Members of the County Assemblies in the 2022 Election. And while MPs were hesitant to disclose why they were keen on setting the period at one year, pundits say, this is a strategy to ensure those seeking re-election can gauge their opponents in advance. Kenyan bankers arrested in Sudan Two Kenyan bankers have been arrested in South Sudan after they refused to release financial details of a government official suspended by President Salva Kiir. On Sunday evening, Kiir issued a decree via state television firing the governor of Western Equatoria Joseph Bakosoro, along with several others. Security personnel then arrested the governor without warrant and held him in a secret detention centre without charge. On Tuesday morning, security personnel went to a KCB branch in Juba and asked the operations manager to give the account details of the ousted Governor

Bokosoro. However, the manager refused saying it is against the law to produce someone’s bank statement without a legal letter from the attorney-general. Reportedly, the security personnel also went to Equity Bank requesting the bank account details for the wife of the governor, Angeline Bokosoro. The manager of Equity Bank also refused and was arrested too. The arrest will most likely lead to a diplomatic row between Kenya and South Sudan at the time when Nairobi is leading high level negotiations between President Kiir and former vice president turned rebel Riek Machar.

Pastor Ng’ang’a seeks to block his prosecution Apostle James Ng’ang’a moved to the High Court on Wednesday in a bid to block his prosecution on accusations of causing death through dangerous driving. Ng’ang’a through his lawyers Assa Nyakundi and Cliff Ombeta sought injunctive orders from Justice Weldon Korir pending the hearing and determination of his application. Justice Korir directed that the application be served on the offices of

the Inspector General of Police and the Director of Public Prosecutions (DPP) for an inter-partes hearing tomorrow. The DPP on Tuesday gave the green light for Ng’ang’a’s prosecution over the Limuru road accident that claimed the life of Mercy Njeri last month. From Page 1 He said the government now faces an immediate challenge of pursuing an anti-corruption agenda through largely uncoordinated, dysfunctional or corrupted institutions and in an intensely hostile political environment. “The government must stay on course and step up the fight against corruption by decisively moving to dismantle corruption cartels and networks and taking concrete measures to restore integrity of anti-corruption institutions,” he said. He gave the example of five Cabinet Secretaries who were suspended in March after their names appeared in the ‘list of shame’ President Kenyatta presented to parliament. He said leaders from their backyards protested the move saying it was politically instigated. When suspended Lands Cabinet Secretary Charity Ngilu appeared in court to answer to the allegations,

there was a rare show of unity as Wiper leader Kalonzo Musyoka joined her in a show of solidarity. Kalonzo and Ngilu have for years been political adversaries in the battle for supremacy in Ukambani and the former VP’s move to rally behind her elicited political debate. The same scenario was also witnessed when leaders from Central Kenya accompanied suspended Transport Cabinet Secretary Michael Kamau to court. And former director of the Kenya Anti-Corruption Commission Patrick Lumumba says the public is to blame for accepting corruption as a social norm and allowing it to thrive. “No amount of amendments of laws will help this country deal with corruption, the problem is with the public who have accepted corruption as a societal norm rather than a dangerous vice leading the country to its deathbed” Lumumba said. Prof Lumumba said institutions dealing with corruption in the country such

as the Ethics and Anti-Corruption Commission and the Office of the Auditor General have been undermined and the office holders are always under threat of being sent home when they unearth major corruption deals. “I see a good intention from the President to fight corruption in this country but not unless he gets public support, his actions will remain public mirage,” he said. According to Nkaari, the government must synchronize institutions dealing with corruption including the EACC, Judiciary and the office of the Director of public prosecutions in order to decisive deal with graft.IPG has also recommended the creation of a special anti-corruption unit within the police under the Criminal Investigations Department in order to return corruption offenses to mainstream criminal justice system. It also advised that the Chief Justice expedites the hearing of corruption cases brought before courts.

Smart people live longer than their less gifted counterparts Smart people tend to live longer than their less intelligent peers. Scientists now have a rough idea as to why this happens. By studying different sets of twins, experts have found a link between intelligence and life expectancy. From their research, a UK-based team of scientists has found that in 95 per cent of their case studies, the brighter twin tends to live longer, even if the siblings are not identical. The team used twins as the basis of their study because, they are more or less exposed to the same environmental factors, including housing, schooling and childhood nutrition. One research associate at the London School of Economics, also noted that people at the top of an employment hierarchy, such as senior civil servants live longer. This recent twist on the theory of longevity may explain why

Police bosses to meet over emerging crimes

some high ranking people within the Kenya government tend to outlive their low-ranking counterparts. Similar studies have been done across different nations and all of them have come to the same conclusion. One particular paper published in the Journal of Health Economics found that Nobel Prize winners outlived those who came close to winning by a small margin. A 2010 study confirmed that even with the same diet, socio-economic status and living standards, smart people are still likely to outlive their less intelligent peers. Though the scholars, including research associate Rosalind Arden, do not understand why this is so, their studies show that the link between intelligence and longer life is mostly genetic. This means that intelligence is not only a sign of a healthy mind, but of a healthy body as well.

Kaimenyi hints at paying teachers as court directed

Education Cabinet Secretary Jacob Kaimenyi yesterday gave the first hint that the government may eventually yield and pay teachers more money as was directed by the court should an appeal lodged at the Supreme Court end in the tutors’ favour. The Employment and Labour Relations Court in June awarded teachers a pay increase of between 50 and 60 percent on their salaries. But the ministry says it does not have money to pay and have sought to reverse the ruling with the final appeal now before the Supreme Court bench led by Chief Justice Willy Mutunga. Asked about what they will do next should the judgement end in teachers’ favour, Prof Kaimenyi said: “We shall cross

the bridge when that time comes but as a law abiding ministry and citizens, we really have no choice or rather, we must consider seriously whatever the court rules; that is the bottom line but I cannot speculate what will happen if the ruling is different from what we expect. Mine is to be very positive of a good outcome,” he said yesterday at an education forum in Nairobi. The pay dispute has seen teachers through their unions threaten to boycott classes when schools re-open next term. The Kenya National Union of Teachers (KNUT) has even warned that it could take the matter to the United Nations (UN) for arbitration. “We have already put in place measures and we need your

signatures to be posted at the UN portal,” Knut Secretary general Wilson Sossion told a Nairobi branch AGM last week. The union insist that their members must be paid as was directed by the court irrespective of the outcome of the latest appeal. But Prof Kaimenyi is urging for patience. He pointed out that the government has a right to appeal the court’s decision the same way as the teachers union. “Our plea to all parties is to give a chance to dialogue all the time and when the ministry speaks of encouraging dialogue and others choose not to do it, we feel very concerned. Again when it comes to due process or going to court, everybody including government has a right to go to court,” he said.

Family perish on grisly road accident

A family of four was last evening killed in an accident involving a lorry and motorbike near Kibunja shopping centre on Nakuru - Eldoret highway. The dead included a 60 year old man, his wife and two daughters, all whom were his pillions passengers. Police say the motorbike was hit by a speeding lorry after it abruptly popped on the highway from a feeder road. The four died on the spot. The lorry driver did not stop following the accident but was intercepted and arrested some 20 kilometres away, at Salgaa.

Woman dies oddly in Ruaraka as man poisons self Police are investigating an incident in which a middle aged woman collapsed and died at a factory in Ruaraka area, Nairobi. The woman was on duty at one of the factories when she collapsed. She was rushed to a nearby clinic but was pronounced dead upon arrival. And in Kayole, a man died after swallowing poison in a quarrel with his girlfriend. In Embakasi, a man was found dead in a guest house in an incident whose cause is yet to be established.

‘Dozens drown’ fleeing Boko Haram Reports in Nigeria say as many as 60 people may have been killed after a raid on a village in the north-east by suspected Boko Haram militants. The attack on Kukuwa in Yobe state happened last Thursday but details have only just emerged from survivors. Some of the villagers who died are said to have drowned while fleeing gunmen. Correspondents say the fact that it took five days for any news to come out demonstrates how dire the security situation is in Yobe.

Cholera hits Dar es Salaam Three people have died of cholera in Tanzania’s commercial capital, Dar es Salaam, since Saturday, amid fears that this could be the worst outbreak in the city since 2009. Thirty-four people, including 14 children, have been admitted to hospital for treatment. Isolation wards have been set up in the most-affected areas, as medical staff take steps to prevent the waterborne disease from spreading in a city with a population of about five million. People living in densely populated areas that do not have proper sanitation are most at risk. Public alarm was raised on Saturday when the first death, of a 27-year-old woman, was reported.

Gabon leader in inheritance pledge Gabon’s President Ali Bongo has pledged to give away all the money he inherits from his father, to set up a foundation for the country’s youth. “In my eyes we are all heirs of Omar Bongo,” he said in a national address. The will of his father, who ruled for 41 years until his death in 2009, is yet to be settled. He reportedly left a fortune worth many millions of dollars.

China arrests 15,000 cyber criminals China’s central government has arrested 15,000 people for alleged cybercrimes as part of a sweeping six-month probe called “Operation Clean Internet,” according to a statement from the Ministry of Public Security. The ongoing campaign, launched in July, is aimed at stamping out cybercriminal gang networks and improving overall cybersecurity. The agency says it has already investigated 7, 400 domestic cases, a majority of which involve hacking and the theft of personal and financial data.

While it is estimated that as many as 10, 000 Kenyans seek treatment in either India or South Africa at an approximated annual cost of Sh10 billion, the proposed Tesla Cancer Hospital to be constructed at Ridgeways in Nairobi at a cost of Sh2 billion seeks to end this trend. “I applaud the effort, devotion and dedication made by Tesla Cancer Hospital in coming up with this state-of-the-art facility that will go a long way to supplement the services being offered by other cancer treatment centres in the country,” First Lady Margaret Kenyatta who presided over the ground breaking ceremony yesterday said. The landmark medical facility, a specialized state-of-the-art cancer hospital and the first of its kind in East and Central Africa, will incorporate diagnosis and treatment of cancer patients, surveillance and research. Fighting as S. Sudan deal fails Rebels have accused South Sudan’s government of resuming military attacks, a day after President Salva Kiir failed to sign a peace deal aimed at ending the civil war. Rebel leader Riek Machar said the government had chosen war over peace. But Mr Kiir’s chief negotiator said the deal was a double-cross that could not be implemented as the rebels are split. South AfricA’S diSAbled “excluded from School’ An estimated 500,000 disabled children are being excluded from South Africa’s education system, US-based Human Rights Watch (HRW) says in a report. HRW says the government has discriminated against disabled children in its allocation of school places. Children are excluded from mainstream schools and forced to wait years for places at special schools, it says. The government said it was disappointed by the report, which “trivialised” efforts to help disabled children. In a statement, South Africa’s Department of Basic Education said that HRW had failed to include the ministry’s submissions to the final report. “It is almost as if there is an attempt to sensationalise the very real and very serious challenges faced by learners with special needs,” it said. The department said it was “working at various levels of government to educationally enrich the lives of children with disabilities”. But campaigners say the government needs to admit that it is not providing quality education to all of its children.

Economic ties key focus on Kenya-Japan Business forum An investment seminar to strengthen economic ties between Kenya and Japan has been flagged off this morning by Cabinet Secretary foreign affairs and international trade Amb. Dr. Amina Mohammed at a Nairobi hotel. The Kenya-Japan Business Forum, aims to follow up on the promise by Japan to invest in key vision 2030 flagship projects as well as enhance commercial exchanges and relationships among businesses and entrepreneurs from the two

countries. Other areas where focus will be mounted are on the introduction of direct flights to and from Japan in bid to boost trade and tourism as well as the inevitable push for the expansion of the Mombasa port for ease of imports and exports. Speaking at the event, CS Amina Mohammed lauded Japan for its continued support through the country’s agencies. She noted that Kenya, being Japan’s regional headquarters, was delighted to work closely with the over thirty nine

companies associated with the eastern country. She further welcomed news that confirmed Kenya will host the Tokyo International Conference on African Development (TICAD) summit next year. This will be the first time the summit is held on African soil. The seminar will run for the whole day today with presentations from both sides. Areas to be covered in the presentations include overview of investment opportunities

in Kenya, Vision 2030 flagship projects, the role of the private sector in foreign direct investment, Japan’s commitment to promoting economic development in Kenya and the Diaspora’s role in linking Japan’s industry players with Kenya’s business opportunities, among others. The seminar will be followed up with a round table meeting at statehouse tomorrow to discuss the implementation of various resolutions from the forum.

Sh120 million boost for leather industry Nairobi’s Kariokor’s leather products (an SME) will see a revival after the ministry of Industrialization and Enterprise Development allocated it some Sh 120 million to attract local and foreign investors through a Sh 7billion leather city in Machakos County. For the last three decades, the leather cluster has been struggling with poor production technology, low quality leather and access to markets to increase global market share since Kenya’s leather imports takes up to 85 percent supply. The industry has also been grappling with quality control, management systems, production skills and high cost of credit to compete both locally and globally. The money, the government said, ‘will uplift dairy production since there will be quality control labs that will allow branding and marketing system in Kenya.’ Kariokor is the largest leather products market in East Africa with over 200 vending stalls employing up to 7,000 workers producing 1.7 million shoes, 2.2 sandals, 4.8 million wallets among other products including bags, bracelets and key holders. The sector is already experiencing tremendous growth at 10.3 per cent and the government is coordinating with law enforcers to reinforce procurement of locally made leather boots by the armed forces and police force.

Kenya Revenue Authority (KRA) has announced a raft of new guidelines targeting local ethanol traders to curb the illicit production and consumption of spiritbased alcohol. Under the new guidelines, persons intending to acquire ethanol shall

While undertaking a complete bathroom renovation may be quite expensive, you can use an old ladder as storage space for bathroom laundry before you save up for a full upgrade.

Following the amendment of the Retirements Benefits 1997 to allow Income Drawdown as an alternative to annuity, the ‘platinum drawdown plan’ will allow retirees to re-invest their retirement benefits for higher and more secure returns. The product is available to individuals aged 50 years and above with retirement benefit savings under a registered scheme with the Retirement Benefits Authority. Speaking during an event to unveil the product, Britam’s Group Managing Director, Dr. Benson Wairegi said that the new product was borne out of research focused on developing products that are suited to the growing needs of the market. “The unveiling of this plan is in line

with Britam’s quest for continuous improvement and innovation. There has been increased demand from the market on how retirees can make their pension income work for them after retirement, hence the diversification,” Dr. Wairegi said. But the Tribunal found Sholei within the law to ‘seek justice’ at the high court after National Olympic Committee of Kenya (NOC-K) arbitration failed. “Mr. Sholei has further pleaded that the respondent assertion that he has breached the constitution by not exhausting the internal mechanisms set up by the federation is misplaced and aimed at misleading the tribunal,” read part of the ruling.

Tennis Kenya will not review the prize money for this year’s Kenya Open Tennis Championship despite receiving Sh9 million sponsorship for the annual event from Britam Insurance. Last year, some players raised issues with the prize money where the winner of the men’s singles took home Sh90, 000 while the opposite gender is awarded Sh10, 000 less of the Sh1.2m total prize money.
