resident Uhuru Kenyatta today flew to Juba, South Sudan to attend an Intergovernmental Authority on Development (IGAD) mini-summit to witness the signing of a peace deal by President Salva Kiir.

Mr Kiir is scheduled to sign the deal later

today, after he failed to do so last week in Ethiopia.

The International community has put pressure on Kiir with both the US and the UN warning that they are ready to “act immediately” should he fail to sign the deal with rebels.

Kenya seeks enjoinment in Ruto’s appeal in ICC case WEDNESDAY, AUGUST 26, 2015

The government has said it will seek to be enjoined in an appeal challenging use of evidence of prior statements in the case against Deputy President William Ruto and journalist Joshua Arap Sang.

Attorney General Githu Muigai told Capital FM News that Trial Chamber V (a) botched a promise made to Africa that an amendment to Rule 68 of Rules of Procedure and Evidence would not be applied retrospectively.

“We will seek to be enjoined even on the appeal filed by the Ruto defence because we think it is a very important question on how the court operates,” Prof Muigai opined.

In November, 2013, a Kenyan delegation of top government officials including the Attorney General, Director of Public Prosecutions and Foreign Affairs CS Amina Mohamed put up a spirited effort to block passage of the procedural rule which would allow prior recorded statements being used in court.

Kenya lobbied other African member states to reject the amendment.

However, Kenya was later convinced to pass the amendment after a promise that Rule 68 would not be applied retrospectively.

It was on that basis that together with other African countries, they supported the amendment.

“Officials of the court who were the ones championing the reform of the rules undertook to every delegation they were selling the amendment to that this rule would not apply retroactively,” Muigai recalled.

When ICC Prosecutor Fatou Bensouda asked the court to allow her to use evidence of six witnesses who had recanted or withdrawn, it did not occur to the defence teams of Ruto and Sang or the Government of

“This comes as a great shock… it is a surprise. It is also acting in total violation of undertakings given to the state parties,” Muigai complained.

According to him, the ruling was in contradiction of treaties in relation to application of amendments to rules and procedures that control them.

He argued that the ASP resolution contained an express waiver of the rule from ongoing proceedings with or without a promise.

“The treaty is clear about the nonretro-activeness of any amended rules. No one – even without any undertakings to Kenya or to state parties the treaty itself prohibits the retro-activity of any rule amended during its pendency.”

Korir Sing’Oei who is Legal Advisor, Executive Office of the Deputy President and who was part of the

delegation that represented Kenya during the 12th session of the ASP was dismayed that last week’s ruling undermined the good faith on which treaties are anchored on.

“It’s in breach of trust. Treaties are based on good faith and this cannot be wished away. What the court has done is really to abuse our good faith,” he said.

“When we were negotiating we were given full assurance that this will not apply on Kenyan cases.”

In his view, the Trial Chamber’s

decision was ‘a slap on the face’ of Kenya but also a setback in honouring and respecting principles that other treaties are anchored on.

During the 25th Africa Union Summit held in Johannesburg, South Africa in June this year, President Uhuru Kenyatta termed the prosecution’s application seeking for the application of Rule 68 as a violation of the understanding reached at the ASP. “It is a very unfortunate ruling. It was not an assurance made to Kenya alone but to Africa. Africa through AU spoke about Rule 68 in July sessions in SA. It cautioned the court against applying Rule 68. What we have seen from the court is a direct attack to the entire continent of Africa,” Sing’Oei argued.

Bensouda in her application argued that six of the witnesses who had recanted or withdrawn had been corrupted by persons acting on behalf of the accused persons.

She said the evidence of the six witnesses was key in demonstrating to the court the full picture of the 2008 Post Election Violence and persons responsible for the attacks that left over 1000 people killed.

With high expectations that the defence teams will move to the appeals chamber, interpretation of the amendment to Rule 68 remains controversial based on the agreement reached at the ASP and the dilemma of arguments of witness interferences presented to the court by the prosecution.

KQ aircraft resale ‘flopped over kickbacks’ - Kamanda Details are now emerging over how national carrier Kenya Airways lost over Sh13billion in an offer to purchase aircraft bought under the Mawingu project and which are now rendered redundant.

During an appearance before the National Assembly Transport and Infrastructure committee and the Senate committee on Kenya Airways inquiry,

Acting transport Cabinet Secretary James Macharia said the airline was now making fresh attempts to sell off at least four aircraft which were grounded as the costs of operating them were high.

“We have spoken to the management and they are selling four aircraft; some of them 777 and others 737s.

Transport Committee Chairman Maina Kamanda revealed that he was privy to information over how an offer to purchase the four aircraft had been rejected by the airline after the company

“You need to get the information right and get to know that the four aircraft at one time had been advertised for sale and got the highest bidder, but because some people who requested a commission did not get it, they cancelled the deal. They advertised it after a few months and got half

Macharia said the matter was public knowledge but however declined to go into the details saying they were investigating it and within two weeks, the ministry would pronounce itself over what transpired.

During an earlier appearance by the Kenya Airways management, the same issue emerged that the airline had

an initial offer of $322 million (Sh33 billion). However the airline’s Finance director Alex Mbugua said the best offer they had received now was 185 million dollars (Sh19 billion).

Macharia said he was working with the National Treasury to investigate cases of financial impropriety as a forensic audit of the company’s books told a different tale adding those found guilty would be penalised.

“The balance sheet has a lot of queries and need to be investigated; the assets and liabilities do not match the revenue,” said Macharia.

He however said no talks took place.

“We were not negotiating anything.

They have to do everything to avert the strike,” he said as he came of the meeting.

TSC had planned to use the opportunity to persuade the teachers to allow the schools re-open as negotiations go on.

Among the fears of the ministry is the interference any strike is likely to cause for national examinations later in the year.

But Mr Misori says exams are not the concern of teachers and that the ministry should instead discuss with Kenya National Examinations Council (KNEC) issues with the examinations body.

Polio vaccine for October The government is set to launch the second phase of polio vaccination campaign in the boarder counties at the end of October this year. The campaign, which targets, 1.5 million children under the age of five years will be carried out for one week. Mandela grandson in rape case given bail

A South African court has granted bail to one of Nelson Mandela’s grandsons who has been charged with raping a 15-yearold girl earlier this month. His lawyers said he did not want to be tried as a “Mandela” but as a “normal person”. He cannot be named until he formally pleads to the charge. The 24-year old is accused of raping the teenager in the toilets of a bar in Johannesburg. His bail was set at $535 (about Sh55 000) and he was ordered to surrender his passport.

During the hearing, his lawyers disputed the age of his accuser, arguing that she was 16 and that sex was consensual.

Clashes in CAR kills 20 people

At least 20 people have been killed in days of sectarian clashes in the Central African Republic, and 15 others have been injured.

The violence in the central Bambari region started last Thursday when a Muslim youth was killed by members of a Christian militia. The United Nations peacekeeping mission has intervened.

Tens of thousands of people have died in sectarian violence in the Central African Republic, sparked by a coup in 2013.

France train attack ‘was well prepared’ An attempted attack by a heavily armed man on a train in France last week was premeditated and well planned out, according to a French prosecutor. Ayoub El-Khazzani, 25, was carrying 270 bullets for his assault rifle and a bottle of petrol, prosecutor Francois Molins told reporters on Tuesday. The Moroccan’s phone showed that he had watched a jihadist video shortly before launching the attack, Mr Molins added. Prosecutors have now filed formal charges against him.

Women in polygamy suffer more abuses, says study

A study by a US researcher has indicated that women in polygamous marriages are more likely to undergo through physical abuse compared to those in monogamous marriages.

The research furthers indicates that abuse rates were also reported to be substantially higher for Kenyan women who say their partners are alcoholics than for those who do not make that assertion.

A team of US academics led by University of Kansas economics Prof Elizabeth Asiedu analyzed the results of that survey along with similar data collected in Ghana, Malawi and Zimbabwe.

Abuse of wives was found to be more common in Kenya than in any of the three other African countries. The overall rate was 28 percent for Kenyan women, compared to 13 percent in Ghana, 14 percent in Malawi and 21 percent in Zimbabwe.

In polygamous marriages--the same figure as in Malawi. The rate of polygamy was found to be slightly higher in Ghana, 17 percent of marriages--and lower in Zimbabwe--10 percent.

can Sociological Association annual meeting, also found that Kenyan and Zimbabwean women with higher levels of education were at less risk of physical abuse from their husbands.

“The assumption is that women who are more educated are more likely to be economically independent and are more likely to have power in relationships,” Christobel Asiedu said.

But the study also found that level of education had no effect on incidence of abuse in Ghana and Malawi.

Wives in Kenya with jobs outside the home had lower rates of abuse than did those without jobs. But no correlation between employment and abuse rates was found in the three other countries.

One of the study’s goals was to show that risk factors for domestic violence differ throughout Africa, Christobel Asiedu noted. She said she hoped policymakers will keep that finding in mind when drafting preventive measures.

He is however expected to append his signature on the peace pact during the Juba summit. President Kenyatta, who is the IGAD Rapporteur is expected to witness the signing of the deal.

He will be joined by Ethiopia’s Prime Minister and IGAD chairperson Hailemariam Desalegn, Uganda’s Yoweri Museveni and Sudan’s Omar Al-Bashir.

IGAD has been mediating talks to end the 20 month old civil war between Kiir’s government and a faction led by the rebel leader Riek Machar.

Mr Kenyatta and his delegation departed Jomo Kenyatta International Airport shortly before 9am and was seen off by the Chief of Defense Forces Gen. Samson Mwathethe and senior government officials.

TradeMark EA sets pace to improve business within EAC A new board of members of Trade Mark East Africa will work as advisors to represent diversity and present a balance of representation to deliver Sh176.3 billion (USD 17 billion) that would reduce the costs of doing business in the East African Community.

The non-profit company announced the appointment of a new board of directors comprising individuals from EAC and will not be employees of the company neither will they be shareholders in the company.

“The newly appointed board will work as advisors of Trade Mark East Africa which will ensure dealing with matters affecting the company,” said Ali Mufuruki, the incoming chairperson.

According to the CEO Trade Mark East Africa Frank Matsaert, out of 500 applicants’ only ten board members who proven track records in their respective professions were selected to bring expertise in the developing sector, executive management and the donor

community of the company.

“We did rigorous interviews to obtain the people we settled on. First, diversity was needed as we required equal presentation of all the communities in the region.

Second, we needed people with first-hand information on matters trade, governance and even leadership,” he said.

The new board will intensify its work to implement over 150 projects across the region including port modernization projects at Dar es Salaam and Mombasa port, improvement along key Central and Northern transport corridors’.

“Our other projects include creating thousands if not millions of jobs in the country, a project we know is doable,” said Mufuruki.

Other board members include Patrick Obath from Kenya, Anthony Mazoera from Burundi, an American independent consultant Earl Gast and Uganda’s Jacqueline Lutaya.

GS1 Kenya, a global barcode provider company and tracing services for consumer products, wants to make locally-manufactured alcohol traceable in making Kenya’s genuine alcohol from getting counterfeited.

“GS1 will first need to identity and verify the raw materials used to make the alcohol and ensure that they are in good condition to process alcohol,” explained the company Chairman, Sospeter Kioko in a recent announcement.

According to him the firm shall identify whether the raw materials are the proper ingredients for

making alcohol while upon verification of the ingredients, GS1 will then investigate the wholesalers and retailers who will be selling the alcohol.

They will determine whether or not the traders are licensed to do distribute the goods and whether they have the proper equipment for storing the alcohol.

“This will helps us monitor the movement of the alcohol so as to ensure that it is safe and the product is kept safe while the consumers are safeguarded too,” said Kioko.

The final stage of identification will be checking the mode of transport used to move the

alcohol from one point to the next one to ensure that its safety is retained.

The initiative comes at a time when Kenya is increasingly becoming an emerging market for global alcohol brands.

“By making alcohol traceable, we will be safeguarding the genuine alcohol in the market, which will in turn ensure that Kenyans drink quality alcohol,” added Kioko.

It will also make manufacturers liable in case consumers are harmed by the alcohol.

Although Huddah

and Vera rarely fight over men like Kim and Amber, the two never lack something to feud over. Both being selfproclaimed (drama) queens, Huddah and Vera attract spectacle all around and when their current beef loses flavor, they look for ways to heat things up. The two girls started brawling back in 2013 and judging by the

unkind words they hurl at each other every now and then, it is difficult to believe that they were once inseparable friends. 2015 has seen the worst of catfights between the two and especially in the period since July where things have become pretty intense.

In July, Huddah posted a photo of an extremely green farm with rosy fresh produce in display, claiming that that the farm belongs to her and it is the source of her livelihood.

Of course, no one believed her but the trolling didn’t start until Vera came out to say what everyone else was thinking out loud, with hard evidence that the photo by Huddah had actually been lifted off the internet. Surprisingly, Huddah did not issue a comeback…at the time.

Last weekend however, she took to the internet to attack Vera, asserting that Vera was persistent on pimping her out to Nigerian men even though Huddah had no interest in such deals. Huddah further shared private messages between Vera and herself as proof of her accusations.

CS Amina woos Swedish investors Cabinet Secretary Amb. Amina Mohamed has encouraged Swedish investors to deepen their ties with Kenya by venturing into agroprocessing, which she says will generate revenue given its export potential.

Mohamed said that the move would support Kenya’s efforts towards bridging trade deficits with other countries, including Sweden.

Speaking during a meeting with Ms. Isabela Lövin, Minister for International Development Cooperation of Sweden, in Stockholm, the Cabinet Secretary said Kenya is Sweden’s third-largest trade partner in Africa but faces a huge trade imbalance.

“In 2014, Kenya’s exports to Sweden amounted to

Sh2.8 billion while imports were worth Kshs 6.3 billion, resulting in a massive trade deficit of Sh3.5 billion,” noted the Ambassador.

The CS has therefore called for more Swedish investments in Kenya in the area of value addition for export.

“For us to benefit more from international trade, our exports must increasingly shift from raw materials to processed products through higher value addition. Investments in agricultural start-ups, agribusiness and agro-processing will yield attractive returns for investors and at the same time facilitate job and wealth creation in the country,” said the Cabinet Secretary.

Uchumi set for turnaround with Kipng’etich as new CEO The Chief Operating Officer at Equity Bank, Julius Kipngetich has been given a new mantle as Uchumi’s new CEO in a move that is expected to boost the company’s earnings.

It has been revealed that his appointment may be part of a strategic move to bolster shareholder confidence as he raises prospects for improved performance within the company.

“There is a business strategy review process going on,” Uchumi’s media consultant, Kepha Bosire reveled to Reuters.

Kipngetich is expected to outperform his predecessor, who revived the retail chain in 2006.

“There is a lot of work going on to try and improve stocks in the shops. There is also a reorganisation to try and get the right people on board to drive the business,” Bosire noted.

Kipngetich joined Equity after a successful career as the Chief Executive Officer of Kenya Wildlife Service, where he served for eight years.

two days after he returned from Entebe, Mr Kenyatta told off opposition chief Raila Odinga that the deal was good and that it was “economical”. National Assembly’s Majority Leader Aden Duale who was among MPs on the President’s entourage has also acknowledged on national television that a deal was signed. Somebody listening to the tendentious KenyaUganda sugar deal from the other shore will erroneously conclude that Kenyans, like the Biblical Israel, sit by the meat and milk pots all day long, eating and drinking to the full, but do we?

Bilateral trade deals are good, especially between neighbouring nations since it fosters genial relationship, but I think it would be

prudent to barter meat and milk for sugar only when the natives have plethora of the said commodities beyond their consumption.

IGAD has failed to deliver on S.Sudan crisis It was great of Kenya’s president Uhuru Kenyatta to urge South Sudanese leaders and citizens currently living in Kenya, to come back home and help in rebuilding and restoring peace in the country.

peace which was misplaced and entrusted to be mediated by East Africa regional bloc known as IGAD assuming that durable and lasting peace solutions would be found. IGAD fell short of its responsibilities and obligations to address the root causes of the conflict.

An Injuries and Illnesses Surveillance Study was first put into place during the 11th edition of the IAAF World Championships in Osaka 2007 and has been repeated in Berlin 2009, Daegu 2011, and Moscow 2013.

Similar studies have also been completed at numerous other IAAF competitions including editions of the IAAF World Indoor, IAAF World Junior and IAAF World Youth Championships.

The IAAF has recently published papers summarizing the results in peer-reviewed scientific journals (Clinical Journal of Sports Medicine and British Journal of Sports Medicine).

It is noteworthy to mention that between 10-14 out of every 100 competing athletes suffered a sports injury during the previous IAAF World Championships and, on average, while nearly seven out of every 100 competing athletes suffered an illness during Berlin 2009, Daegu 2011 and Moscow 2013.

The IAAF is part of the IOC Injury Study Group that has set the basis for injury and illness surveillance in Olympic sports. The IAAF Medical and Anti-Doping Commission is committed to making our sport safer for our athletes and is increasingly emphasising the protection of athletes’ health.

Bett puts AK on notice with rare gold win His name was nowhere when the list of favourites for the 400m men hurdles world title was written or read in the run-up to the Beijing IAAF World Championships.

Now, Nicholas Bett has made himself known after his outstanding Day Four performance when he gave Kenya the first gold medal at any race below 800m at the grandest stage of all on Tuesday.

His 47.79 world winning time was a new national record, all the more overwhelming considering he was running in the unwanted lane 9. He obliterated the previous record held by

Eric Keter that stood for 22 years by 0.44 seconds.

“I decided to run very fast because when I slowed down in the semis, it was hard for me to clear some of the hurdles.

Hurdles is not an easy event and I gave it my best and I’m happy and proud to be the first Kenyan to win this event at the World Championships.

“I dedicate this to my twins, a boy and a girl and I hope it will motivate other short distance athletes not to lose hope and make Athletics Kenya to take hurdles more seriously,” Bett said after the race.

“I’m happy for David Rudisha but the

performance of the day for Kenya is surely Bett’s victory in the 400m hurdles.

No one would have thought a Kenyan can win a short distance race, let alone the hurdles.

“This means we need to rethink how we prepare for next year’s Rio Olympics if you consider gold could come from Javelin. Bad news as Zakary, Koki fail doping tests

oyce Zakary, 400m Kenyan record holder and African 400m hurdles silver medalist Francisca Koki have failed doping tests in Beijing, China.

Kenya’s Sports website Sportsnewsarena. com broke the devastating news, which came barely four hours after Nicholas Bett won Kenya’s first gold in the men’s 400m hurdles. The two leading Kenyan sprinters both tested positive for an unknown substance though it is most likely to be Nandrolone.

The 29-year-old Zakari may have been informed of the result prior to the semifinal which saw her pull out of the race despite topping her heat in 50.41 seconds and was primed to be one of the finalists in the women’s 400m.

If the doping allegations stand, Zakari’s national record of 51.14 she posted last month during the national trials which erased 31 years record posted by Rose Waitherea (51:56) may also be nullified.

Koki on the hand was washed out in her qualifying heat finishing a distant seventh in 58.96 the second slowest time from the heats.

Koki too may lose her national record, also posted at in July after lowering 24 years old record by Rose Tata Muya (55.94).

Joseph Kinyua, the team manager said he was only informed during the technical meeting that: “She told the coach she had issues with IAAF.” Seven years ago, Zakari’s Kenya Prisons teammate Elizabeth Muthoka, the then national champion was banned for two years after she tested positive for Nandrolone. Muthoka had been tested at the 2008 national championships and was selected for the Beijing Olympics after she lowered the long standing national record to 50.8 seconds. Her performances were cancelled soon after and she was banned for two years. The two failed tests put the spotlight back on Team Kenya whose preparations have been clouded by controversy following recent media reports on doping in Germany and England. The reports allege that doping continues in Kenya and that there was widespread corruption within the Kenyan set-up to cover-up positive tests.
