Graft suspects to know their fate soon, says EACC About 124 State officers named in President Uhuru Kenyatta’s graft “list of shame” presented to Parliament in March will soon know their fate, the Ethics and Anti-Corruption Commission (EACC) has said. Speaking to Capital FM EACC deputy secretary Michael Mubea today said the secretariat is finalising investigations into the 124 files involving high profile government officials who appeared in the list and will soon make public its findings. “Anxiety is not the best of a place to be, but we have to follow the process of investigations. We are hopeful that all the affected persons will know their fate in not so a distant future. I would urge them to keep their calm as we do our best,” he said. Some of the suspects being investigated have already complained

that the investigations are taking too long even as EACC and the Director of Public Prosecutions (DPP) blame “myriad of impediments” for slow probe. Though there seems to be headway in tightening the grip on corruption, the investigation and prosecution of high profile individuals has not been painless. “It’s been many months now, EACC has not yet forwarded my file to the DPP. I thought a decision would be made soon but no, I keep on hoping to see the recommendations made, I do not know up to when,” one of the suspects told Capital FM. Ombudsman wants CIC sent home The Commission on the Administrative of Justice (CAJ) has backed MPs on the fate of the Constitution Implementation Commission (CIC) saying it should wind up. CIC was created to oversee the implementation of the new constitution promulgated in 2010 and was supposed to be in office for five years, the period stipulated for the full implementation of the Constitution. However, MPs have since extended time for the implementation of key pieces of legislation by a year although CIC’s term come to an end in three months’ time. The legislators said the commission should be wound up and their role taken by parliament. And today, CAJ (also commonly referred to as the Ombudsman) backed the winding up of the commission, saying extending its term will set a bad precedent where constitutional commissions set up with specific mandate become perpetual offices. CAJ chairman Otiende Amolo who was also one of the drafters of the Constitution said once a commission has reached its term limit, its lifeline should not be

extended. Speaking today morning on Citizen TV, he said constitutional implementation is a process and not an event and the rest of the work remaining on the implementation of the Constitution can be done by other bodies. “Even if we extend the term of CIC, there is no day we will have fully implemented the Constitution, it’s a process which requires cooperation of various organs and not CIC alone,” said Amolo. The CAJ chairman said extending CIC term would require constitutional amendments which at this time is not good. “If we start amending the Constitution to extend the terms of constitutional commissions, then we will open a gate way to other amendments to the new document which is not good at the moment,” he said. CIC chairman Charles Nyachae who appeared on the show did not comment on the views to have the commission wound up although he has previously said his commission will not seek for an extension of its term beyond what is stipulated in the law. NGOs now furious over cancelled APRM meet Some Civil Societies are now demanding explanation from the government over the cancellation of the African Peer Review Mechanism (APRM) summit which was slated for this week in Nairobi. State House spokesman Manoah Esipisu on Sunday said that the decision to postpone the summit was influenced by “the keen interest expressed by member States of the African Union who are not members of the APRM in participating at the event.” The summit, was set to take place on September, following a call by President Uhuru upon his election as chairperson of the African Peer Review Forum in June this year at the sidelines of the 25th Africa Union (AU) meeting. The Summit which has now been postponed to January next year was to seek to formulate ways through which the mechanism can revitalise itself to strengthen governance in Africa. Mugo wa Wairimu ordered to surrender Fake ‘doctor’ Mugo wa Wairimu who is accused of raping his patients at his clinic in Githurai has finally been arrested. Limuru AP boss Stephen Ndegwa confirmed that they had arrested Mugo and that he was being held at the Tigoni police station. He was spotted by members of the public in a hotel at the town when police was alerted. More details on these developments were not yet available by the time we went to press. His arrested came just hours after Head of Serious Crimes investigations John Kariuki ordered him to immediately surrender himself to the CID headquarters. The suspect had gone into hiding on Monday after Inspector general of Police Joseph Boinnet ordered for his arrest following a TV expose that showed him raping an unconscious patient at his clinic. The developments came even as four recorded statements with the police. Detectives investigating the matter have appealed for more victims to come out and record statements to press charges against Mugo. They have assured witnesses and victims of protection if and when needed.

Head of Serious Crime Unit John Kariuki said they expect investigations to be complete by Monday next week when they shall announce the case’s progress. “In four or five days we will make an announcement on the way forward, but we need more witnesses and victims because we believe they are out there,” he said. Kariuki, however, did not reveal the nature of evidence so far recorded, but said a team of officials from the Kenya Medical and Dentist Practitioners Board and that of nurses had joined the probe. The team visited the clinics in Githurai and Zimmerman as part of their probe into the allegations. Kariuki asked Mugo to surrender himself to the authorities’ failure to which police will arrest him as soon as investigations are complete. “We will get him at the right time. Right now we are compiling the required evidence before we go for his statements and later forward the file to the Director of Public Prosecutions (DPP) for action,” he said early today, just hours before the authorities caught up with the suspect in

Limuru. The team from DCI took over the file from their Kasarani counterparts and started collecting evidence on the allegations. Kenyans have expressed frustrations at the police’s failure to arrest Mugo who has since gone into hiding. But Kariuki assured the public of a thorough and professional investigation into the saga is being undertaken and urged for calm. He said they are investigating several allegations including rape. The office of the DPP had ordered police to investigate and forward to his office Mugo’s file for action. Detectives have so far obtained a copy of the video that was aired by Citizen TV showing a man believed to be Mugo sedating and raping a woman who was on a bed in his clinic. Armed police were still manning the clinic after a mob tried to attack and burn it on Monday. More ICC headache for Sang I nternational Criminal Court (ICC) chief prosecutor Fatou Bensouda now wants the case against radio journalist Joshua arap Sang re-characterised to include individual criminal responsibility for the crimes committed during the 20072008 Post Election Violence. The prosecution has requested the trial chamber to notify Sang and his defence team that there was possibility of ‘re-characterisation of the mode of the liability of his case’. “The prosecution requests that the chamber give notice to the parties and participants pursuant to the regulation 55(2) of the court of the possibility that the legal characterisation of the individual criminal responsibility for all counts may be subject to change to include liability under articles 25 (3) (b) or (c) of the statute, and that such notice be given prior to the filing of any ‘no case to-answer’ submissions,” the prosecution requested. The application is meant to tighten Sang’s charges to allege that he induced or aided commission of the crimes. According to the Document Containing Charges (DCC) and the pre-trial brief, Sang’s case was that he ‘contributed’ to the crimes committed by a group of persons in a network that had a joint common plan. The prosecutor argued that though the case was at an advanced stage, re-characterisation of a case is allowed during trial as long as the chamber notified the parties of its intention at trial stage. “The participants must be given an opportunity to make submissions at an appropri-

The Director of Public Prosecutions acted on 58 files, of which there was recommendation for prosecution in 32 files. The DPP agreed with EACC’s recommendation to close 13 of the files. And Mubea admits it was the first time that the commission received such a huge chunk of cases at the same time. “We had 124 cases and that is what we are investigating. The first challenge was the volume of work, there was a lot of public expectations which sometimes can be unrealistic,” he explained saying investigators, prosecutors and lawyers were over stretched. “The man hours we had to spend on those investigations

and of course the low numbers of investigators and lawyers within the commission… we were working from Monday to Sunday, there was no break at all,” Mubea said. The commission was also concerned that the corruption cases had been politicised. Emily Kamau who heads the Corruption and Economic Crimes unit in the Office of the DPP said the corruption cases are complex because they touch on top office bearers. This, she says, makes it difficult to dig up for evidentiary documents or even record statements from witnesses who are usually juniors or colleagues of the individuals under investigation. “So they are sympathetic to them and they would want to help them get away with it. Rotich: Central Bank is on track to strengthen shilling The government is taking deliberate policy measures to support the stability of exchange rates in Kenya, Treasury Cabinet Secretary, Henry Rotich has said. Speaking at the Annual Barclays Africa Forum in Canary Wharf, London, CS Rotich said initial intervention through the direct sale of foreign exchange to commercial banks in periods of short-term exchange rate had slowed down the speed of depreciation of the exchange rate. “Kenya Shilling weakened against the Dollar due to global strengthening of the US Dollar on the international market

and high dollar demand by importers in the domestic market to finance imports of capital goods due to ongoing public investments,” explained Rotich. He said the Central Bank of Kenya (CBK) had taken measures to resolve the crisis, including raising the Central Bank Rate (CBR) in June and July by a cumulative 300 basis points to 11.5 per cent. He also revealed that the government has a $688.3billion (Sh72.5 trillion) precautionary facility with International Monetary Fund (IMF), adding that the proceeds will replenish what CBK has spent as reserves

and support exchange rate stability. Rotich said that Kenya has positioned itself for economic transformation, which he added will be supported by stable, sound economic policies characterised by innovation and regional outreach. “I wish to reiterate that immense investment opportunities exist in most of the leading sectors such as agriculture, tourism, financial and insurance, wholesale and retail, manufacturing, ICT and business process outsourcing plus the recently discovered oil and minerals sectors,” Rotich told the Forum.

In a bid to combat the rapidly expanding trade in illegal timber under a new deal, the five nations have given various mandates to their respective forest protection agencies. Through the Zanzibar Declaration on Illegal Logging, a bill that was signed on Wednesday at a global gathering in South Africa, the countries’ representatives have vowed to improve communication between customs authorities and collaboration among forest officials from the east and southeast African nations, Reuters reports. construction of the road joining Lokichar and Nepal which will cost over Sh 52.5 billion. Some $1.2 million dollars will fund the road joining the Sudan border and Kenya’s Eldoret town commencing in May 2016 and projected for completion by February 2019. “This development will increase inter-border trade between Kenya and South Sudan as well as linking

Turkana County to the rest of the country. We see the prices of commodities coming down,” said Turkana County Governor Josphat Nanok. Through the ministry of ICT, Kenya entered into an MoU with South Sudan through the Ministry of Telecommunication and Postal Services in January 2015 in relation to the construction of the optic fibre cable.

Just last week, we were literally on top of the world thanks to our athletics champions who put us on the spot during the Beijing IAAF championships. Barely a week later, our beloved country is battling with untold chaos. Fake gynecologist Mugo Wa Wairimu started off the week after it was revealed on Sunday night that the self-proclaimed women reproductive health specialist is actually a quack who instead of helping women visiting his clinics in Zimmerman and Githurai 44, sedates them and rapes them in their

unconscious state. This revelation has caused deep trauma nationwide, with his former patients having to carry around the burden of knowing they might have been defiled by Mugo without having the slightest clue. This alongside the disturbing evidence video has been the talk of the week, but the rapist doctor not having been arrested for his perverted atrocities yet. The #MugoWairimu still sits pretty. But Mugo is not the only man in the frying pan. Former Kenya Airways CEO Titus Naikuni is the latest victim of the Kenyans on Twitter wrath.

Following the 25 billion shilling loss registered by the national courier this year, Kenyans now want Naikuni arrested for running down the airline during his tenure as chief executive. Bungoma County seems to be doing extremely well in matters finance, so much that the county government decided to set aside some 1 Million shillings for the purchase of ten wheelbarrows which were allegedly purchased at a whopping Sh 109,000 each! Even so, Kenyan women (and a few men) have wised up and started local social media pages solely dedicated to catering for cooking related issues such as tantalizing recipes, where to get particular ingredients and advise on where to make changes for a dish gone wrong. On the two most prominent pages for Kenyan foodies (Cook Eat Kenya and Ideas on Cooking Recipes) you will find thousands of followers, mostly women seeking to acquire skills on how to keep their men hooked to their cooking, and probably surpass the famous ‘mum’s cooking is the best’ stereotype among men. Unlike other Facebook accounts

set up for the sake of amassing many subscribers so as to earn money out of advertisement and publicity services, ‘Cook Eat Kenya’ and ‘Ideas on Cooking recipes’ are strictly monitored pages, with active admins who filter abusive or non-food related posts ensuring that the pages stay clean. Apart from recipes on indigenous Africa foods, the pages also provide tutorials on making pastries, salads and snacks with a special emphasis on presentation. Even for food, the first impression matters and most of the posts on these all-things-food accounts are accompanied by impressively garnished servings that more often than not get lazy ladies on their feet and into the kitchen. Coastal hotel to get fresh water from Davis and Shirtfliff Leading water and energy solutions provider, Davis and Shirtliff has commissioned the development of a plant that will turn salty sea water into fresh water, supplying consumers with a basic human need that has often been in scarce supply in some parts of the country. It will generate up to 3,000 litres an hour of pure water from raw sea water in a move that will likely inspire other regions that suffer from saline conditions across the country to do the same. The installation of the Sh11.8 million plant has been driven by the need to ensure a reliable water supply for the resort’s 46 luxury apartments in an area where the municipal water supply is irregular. “After drilling a borehole on the site located on the coastline, we found that it was too saline for human consumption, and the only treatment available was reverse osmosis,” said Stanley Theuri, the CEO of Shanzu Beach Resort.

BIZ BRIEFS Nairobi ranked most expensive city for hotel stay

Nairobi has been rated third most expensive city in Africa in terms of hotel accommodations, according to a new survey produced by hospitality research firm, STR Global. The survey indicates that the average rate for a hotel room in the first six months of 2015 was $144.76 (Sh15, 200). This compares with $215.75 (Sh22, 700) for a room in Lagos and $231.78 (Sh24, 400) in Addis Ababa which tops the list. “A great deal of the reason for the difference in rates across African cities is simply supply and demand,” explained STR Global Director of Business Development Thomas Emanuel. “Addis Ababa has a shortage of top quality hotels. However, with the Ethiopian economy growing at a rapid rate of more than 10 percent per annum for the whole of the last decade, with more conferences coming to the city by virtue of its status as the seat of the African Union and with Ethiopian Airways on a similar growth trajectory to the country, thanks to new routes and increased passenger numbers, there is a high demand for premium hotel rooms,” he added.

Reverse osmosis is a technique that filters solvents, bacteria and viruses out of water. It is a process particularly suitable for treating salinity and is also used in manufacturing in cases where pure water is needed. Through the partnership with Davis and Shirtliff, Shanzu Beach Resort will provide fresh water to holiday makers at the resort.

“The salinity challenge is considerable at the Coast, with both institutions and home owners constantly searching for solutions that best fit their situation. This has demanded that we develop innovative, tailormade approaches to accessing clean water,” said Alec Davis, CEO of Davis and Shirtliff. The seawater reverse osmosis

plant at Shanzu Beach Resort is a first-of-its-kind installation by Davis and Shirtliff for a hotel at the Coast. The commissioning at Shanzu Beach Resort is expected to be the first of many such installations by Davis and Shirtliff at the Coast and in other areas with highly mineralised water sources.

Manual Visa application extended to keep tourist numbers high The government has announced that manual visa application at the port of entries into the country will continue until the newly introduced e-visa is fully operational. President Uhuru Kenyatta said though the e-visa was already active, manual application at the entry points to the country will continue concurrently so as not to bar last minute visitors coming in to the country. “We have had a number of challenges on the implementation of the e-visa and I have therefore ordered that application of visa on arrival to the country continues as it were,” the President said. The President made the remarks yesterday in

Italy during the opening of a Business forum between the Kenyan and Italian business communities. The forum is among a series of activities the country has lined up in Milan to mark the Kenya week in the ongoing Milan expo that has attracted over 150 countries. The Kenya Tourism Board (KTB) has said that the resumption of manual visa applications, which had ceased operations from September 1, 2015, bodes well for travel agents and tour operators. Both parties had raised concerns on the possibility of a drop in tourist numbers as a result of challenges associated to the new system.

At the same time, the President also announced that discussions were at an advanced stage to introduce direct flights from Milan to Kenya. “Malindi international airport will be able to handle direct flights from Milan and we shall discuss on making this a possibility,” he noted. Italy is the country’s fourth biggest source market for tourists, bringing in about 50,000 visitors to Kenya every year, the KTB has said. The President’s visit to Italy has also seen him position Kenya as a key investment, tourism and export destination. He told the Italian business community that his government has put in place relevant infrastructure to spur investment in all sectors of the economy.

The World Bank has recognized Kenya for championing gender equality within its employment sector. Poor planning and policies evident in many nations are keeping women from working in jobs of their choice while blocking their access to credit or leaving them unprotected against domestic violence, according to a World Bank report released on Wednesday. Among those facing the most obstacles are women in North Africa and the Middle East, the Thomson Reuters Foundation reports. The World Bank Group’s report dubbed ‘Women, Business and the Law 2016’, studied laws in 173 economies and confirmed that out of those, 90 per cent have at least one law impeding women’s economic opportunities. It has been revealed that women are legally barred from certain factory jobs in 41 economies, and in 29 economies they cannot work at night. In 18 economies, women cannot get a job without permission from their husband, it said.

China faces food crisis as commodity prices rise China, one of Kenya’s biggest trade partners, is experiencing a sharp rise in food prices, which has pushed up inflation in to a oneyear high in the world’s second largest economy. The crisis has been blame on falling commodity prices and slumping demand. Uhuru must act and avert the looming crisis

Yesterday’s ultimatum issued by workers unions that they will join teachers in a nationwide strike beginning next week if the government fails to implement a salary increase of between 50 and 60 percent for the educationists is very worrying. And in all likelihood, they will join the strike if nothing is done between now and next week. Yesterday’s rally at Uhuru Park brought together all the

unions representing various workers in this country. Should they go on strike, then most operations will be paralysed. This is why the government must do all that it can and avert the looming crisis. Kenyan athletes jet out to Congo for medals hunt World 400m hurdles champion Nicholas Bett led a strong contingent of Team Kenya athletics unit that jetted out today noon in pursuit for medals in the 11th African Games Athletics competitions which kicks off on Sunday. The team departed for Congo Brazzaville today to launch the their hunt for glory as they hope to keep up with their Beijing counterparts that won seven gold, six silver and two bronze. Tribunal chairman John Ohaga challenged Wambugu on why he sued National Olympic Committee of Kenya (NOC-K) and not Ouma who replaced him, but he maintained that it is the committee that employ team officials. The court which sits at the NSSF Building in Upper Hill ordered NOC-K lawyer Tengu Madara to serve Wambugu’s defence team within 10 days (from Tuesday) with the complainant lawyers being directed to reply in seven days before the ruling due in October.

Former Fifa executive Chung Mong-joon of South Korea has also indicated that he will run in next year’s election, as has Liberian FA president Musa Bility. Referring to the previous election, Ali added: “I was the only person who dared to challenge Blatter, I ran because I believe that Fifa needs change. “I had the courage when others feared. Seventeen-time Grand Slam champion Federer did not face a single break point as he beat Frenchman Gasquet 6-3 6-3 6-1 in just 87 minutes.
