‘Rape doctor’ to be detained for two weeks J ames Mugo Ndichu alias Mugo wa Wairimu who is accused of raping an unconscious patient will now remain in custody for 14 days as police wrap up investigations into the allegations. The prosecution had wanted him detained for 30 days pending completion of investigations but Senior Principal Magistrate Charity Oluoch allowed that he remain in custody for two weeks. He was arraigned before the court early today where prosecutor Jacinta Nyamosi applied for the extended custodial order. “In-depth investigations which require extraction of mobile phone records, phone details, forensic examination of the various clinics that he operated are incomplete, “the prosecutor said. She said that owing to the nature of crimes that the medic is alleged to have committed and the “vulnerability of the victim(s), it was in the interest of justice that he remains in custody. But it was Mr Wairiumu’s security that was of the major concern for both the prosecution and his defence lawyer Peter Macharia. Both parties concurred that releasing him

immediately may endanger his security. The members of the have been demanding Mr Wairimu’s arrest and possible prosecution. ‘’For purposes of the respondent’s own security it would be wiser to keep him in the custody of the police who are investigating this case,” Ms Nyamosi said. Mr Macharia concurred saying that Mr Wairimu had been tried in the court of public opinion and his security cannot be guaranteed. But he oppose the initial request to have the suspect detained for 30 days as the prosecution had earlier asked. “We are not opposing the extended detention of the respondent for the sake of his own security, the only opposition we have is the payer for 30 days it is certainly not warranted,” the lawyer said. He said the police having seized the suspects mobile phone and I-pad for cyber analysis and that his input in the on-going investigations was not required. He is to be detained at an undisclosed police station. The court also heard that Mugo is already the subject of a criminal trail before a Makadara court where he faces the charges of operating a theater illegally.

Rising cost of living Kenyans biggest concern, survey shows

Ipsos Synovate lead researcher Tom Wolf addresses the media during the release of the firm’s latest opinion poll on Wednesday. They survey indicates that rising cost of living , corruption and unemployment are the major concerns for Kenyans.

High Cost of living, corruption, unemployment and insecurity are the major concerns for Kenyans according to the latest poll survey released by Ipsos Synovate. The survey conducted between July 30 and August 9, 2015, indicates that Kenyans are becoming more concerned about the cost of living which has soared in the past years even as their income remain the same. While releasing the survey results on Wednesday morning, Ipsos lead researcher Tom Wolf said contrary to popular belief that majority of Kenyans are more worried about insecurity, those polled said their major concern is the cost of living. “The immediate thing that comes in the mind of most people is the rising cost of living (23 per cent), corruption (21 per cent), unemployment (17 per cent), insecurity (12 per cent) and drought (7 per cent),” he said. The survey indicates that many

Cord supporters are concerned with inflation and corruption, while Jubilee supporters mentioned unemployment. The poll survey also indicated that majority of Kenyans earn their income from agriculture with maize farming being practiced by a majority at 53 per cent, vegetable farming 21 per cent, coffee five percent and tea at three percent. Of the 2, 002 respondents interviewed during the survey, 43 per cent said they have no confidence in the Independent Boundaries and Electoral Boundaries Commission (IEBC) in conducting the next General Election. Wolf said those interviewed wants some changes in the electoral body before presiding over the 2017 elections. In terms of political parties’ affiliation, 71 per cent of Cord supporters have no confidence in the electoral body while 66 per cent of Jubilee supporters expressed their confidence in the commission.

The poll also indicated that half of all Kenyans either want no changes in the Constitution or do not know whether they do or not (or if they do, which changes they would support) at 24 per cent and 26 per cent respectively. Only a quarter of Kenyans believe the media is ‘completely free’, with nearly twice as many Jubilee supporters hold the view as opposed to their Cord counterparts at 30 per cent and 18 per cent respectively. In overall, the perceived decline in the performance of Jubilee government from the previous government are those of terrorism and corruption at 78 per cent and 67 per cent respectively. A total of 2, 002 respondents aged 18 and above were interviewed during the survey conducted in 41 counties. The margin-of-error attributed to sampling and other random effects is +/- 2.2 with a 95 per cent confidence level.

witnesses tampering The International Criminal Court (ICC) on Thursday made it public that lawyer Paul Gicheru and Philip Kipkoech Bett were arrested in July “for corruptly influencing ICC witnesses.” Judges of the Pre-Trial Chamber II unsealed warrants against the two, to reveal that they ordered their arrest on March 10, 2015 to stop them from interfering with witnesses and obstructing court proceedings. “The Pre-Trial Chamber II found that there are reasonable grounds to believe that Philip Kipkoech Bett, also known as “Kipseng’erya” hailing from and residing in Kenya, and Paul Gicheru, a lawyer based in Kenya, are criminally responsible for offences against the administration of justice by influencing prosecution witnesses.”

According to a press release from the court, Gicheru and Bett were arrested by Kenyan police in July 2015 and were presented before a judge of the High Court of Kenya following the warrant of arrest issued by the ICC judges in confidentiality. The judges issued the warrants of arrest following the prosecution’s application on February 9, 2015 that the two and another individual were interfering with ICC witnesses. However, the prosecution later withdrew the warrant of arrest against the third individual. Bensouda said Bett and Gicheru were criminally responsible on six counts for interfering with six witnesses of the court. She detailed a scheme to demonstrate how the two interfered with the six witnesses and offered

money and also entice them to inform other witnesses of the scheme. According to the judges, she furnished the court with documentary evidence which included witness statements and correspondence between two and the witnesses. Bensouda told the court that the two were part of a systematically designed scheme meant to approach and corrupt ICC witnesses by bribing and inducing them using other means to make them recant their evidence. “The evidence indicates that the said scheme has been run in an organised manner and with a clear distribution of tasks.”

One-off devolution of health to blame for sector problems Commission for the Implementation of the Constitution (CIC) chairman Charles Nyachae has blamed failure to devolve health services in phases for woes witnessed in the sector across the counties. He said devolving health services ought to have been done gradually to allow counties time to put up mechanisms in place. “The National government was in a hurry to devolve the health function even before the County governments were ready. We are now paying the price,” he said. The CIC boss urged both the National and county governments to work together and resolve the outstanding issues. “Reverting the health function to National government is not the solution, instead the issues threatening the sectors can easily be sorted out if both the National government and counties work together,” he said. Both the national and the county governments have traded accusations on who is to blame for the current wave of health workers’ strikes witnessed in some counties. On Wednesday, Council of Governors chairman Peter Munya said the National government is entirely to blame for the current woes in the health sector. He accused National Treasury and MPs

of attempts to sabotage health operations in counties by denying them funds to pay salaries and finance operations. Munya claimed the Health ministry is out to portray counties as having failed to provide health care, and thus reverse the function to the National government. He said the Treasury had withheld salaries for doctors in the counties for the last six months, a move that has forced health

workers to go on strike. The Meru governor said the fact that a few counties had their doctors striking does not mean counties are unable to manage and deliver health care to Kenyans. Health Cabinet Secretary James Macharia waded into the debate, warning the counties that the national government would not sit back and watch the health sector plunge into crisis and urged the Senate and

the National Assembly to find a solution to the crisis. Nyachae, however, warned that trading accusations on who is to blame for the problems facing the sector will only negate the gains of the Constitution as far as devolution is concerned. “We should actually be talking about how to make devolution a success and how it can benefit the people,” said Nyachae.

Governors want Act amended to end strikes

The Public Funds Management Act of 2012 should be amended to end persistent county health workers strikes, governors have said. Council of Governors chairman Peter Munya urged the Senate to amend the Act to allow counties pay workers on time. The Meru governor maintained that the delay by National Treasury to release funds to counties is the main reason why the devolved units have been unable to pay medics in time. Munya told the Senate Health Committee that the challenges facing the health sector will only be solved if the law is amended to allow counties access money from Central Bank at the end of the financial year before the budget process is finalised. “I believe this is the lasting solution I can propose to end this row which is affecting the health sector,” he said. Munya, however, maintained that devolution of the health sector has achieved many positives milestones including hiring of additional workers, construction of extra health facilities, and installation of modern equipment and provision of specialized services.

Two MPs want the National Assembly recalled from recess to discuss the pay dispute between teachers their employer Teachers Service Commission (TSC) to end the strike which has paralysed learning in public schools for the last two weeks. Shinyalu MP Silverse Anami and his Magarini counterpart Harrison Kombe who are members of the House Education Committee said they are waiting for TSC to petition the committee over the salary deadlock, adding that they were ready to pass proposals to rescue the education sector which is now in a crisis. “I would like Parliament to be recalled like yesterday so that we can confront this matter and interrogate it and get our children back to school. If we

wait for the recess to end for us to carry out our oversight role, it will take time,” said Anami. The MPs also faulted the government for failing to honour the court ruling which awarded teachers a 50-60 per cent pay rise, yet it had effortlessly offered to bail out the national carrier Kenya Airways which recently incurred a Sh26 billion loss and the struggling Mumias Sugar Company which has been run down through corruption. The government offered a Sh1 billion bailout for Mumias Sugar and Sh4.2 billion for Kenya Airways, but has stated that it does not have the Sh17 billion required to implement the 50-60 per cent teachers’ pay rise. “We have no money for teachers but we have mon-

They accused the teachers’ employer of reneging on its word after settling for the 5060 per cent offer to lower the teachers’ earlier demand of 300 per cent. People, buildings and planes fell from the sky. Terrified strangers became friends as Americans united on a day that changed the world forever. Today, like every other anniversary after it happened, a resilient

nation will look forward to the future, but remember the past. Here are the main events that will pay tribute to the many lives lost on September 11, 2001: At the World Trade Center, where most victims were, bagpipers and drummers will provide solemn tunes to accompany the ceremony. The names of the dead will echo as those gathered read them out and mark moments of silence at the specific times when the planes struck and the towers tumbled. The first plane hit the north tower at 8:46 a.m. The second one struck at 9:03 a.m. In this attack, 2,753 people died when terrorists intentionally crashed American Airlines Flight 11 and United Airlines Flight 175 in the north and south towers. Of

those who perished in these attacks and the collapse of the towers, more than 300 were firefighters who ran into the building while others rushed out. Dozens more were police officers. Hundreds of miles away, a passenger jetliner crashed near Shanksville at 10:03am. Crowds will mark a moment of silence at that exact time and read out the names of the victims. Forty passengers and crew members aboard United Airlines Flight 93 died when the plane crashed into the field. It is believed that the hijackers crashed the plane in that location, rather than their unknown target after the passengers and crew attempted to retake control of the flight deck. At sunrise a flag will be unfurled over the side of the Pentagon.

Kenya ranks low in OBI’s global ratings The fifth edition of the Open Budget Index (OBI) report says Kenya is weak in providing the public with opportunities to engage in budget making process. The report assessed 102 countries across the globe using internationally recognised criteria to rank on a 100 point scale where Kenya scooped 48 out 100 as far as transparency of budget information is concerned. “Kenya’s score is however a little higher than the global average score of 45,” said

IMP’s Country Manager Jason Lakin. Uganda however performed better on being transparent scoring 62 out of 100 considering it substantial as Rwanda scored only 36 out of 100 recording the worst performance. Kenneth Waithiru an official in the National Treasury acknowledged the challenge of public participation; “Engagement of the public in the budget process is really low, at County and National levels and we are working

towards encouraging more Kenyans to participate in such.” However Kenya scored well in budget oversight by the Audit scoring 67 out of 100 where the supreme audit institution termed it as adequate. “The constraints being considered on the ability of the auditor to audit securityrelated expenditure on the new audit bill being discussed in Parliament will restrict the Audit’s freedom and capacity to fulfil its mandate,” Lakin stated.

According to the report, the legislature provides adequate oversight during the planning stage of the budget cycle and no oversight during the implementation stage of the budget cycle. “We recommend that the executive receive prior approval by the legislature before implementing a supplemental budget,” said John Mutua, Head of Programme on Public Finance Management at the Institute of Economic Affairs.

Local airline begins campaign against ‘flying is for the rich’ Kenyan airline, Jambojet have launched a campaign targeting first time flyers in a bid to highlight the benefits of low cost air travel over other modes of transport. Dubbed ‘Invitation to Fly’, the campaign will heavily rely on testimonials of first flyers encouraging them to share their personal experience on how flying their lives since a majority of them include traders, students, tourists, government, civil and private employees. According to Jambojet CEO Willem Hondius, since the airline launched operations in April last year, the number of passengers has been gradually increasing. “With this campaign, we are aiming to not only demystify flying but also create better understanding of how lost cost flying works,” said Hondius. Jambojet seeks to eliminate the frills normally offered on

flights such as food and drinks so as to keep the cost of air ticket low. “The value proposition of low cost flying is there for all to see. Flying cuts travel time especially when one plans their travel in advance.” He explained. A bus ride between Nairobi and Mombasa normally takes eight hours and costs an average Ksh2500. A flight over the same distance takes one hour with Jambojet charging a minimum fare of Ksh3,450 per ticket one way depending on how early one books their flight. Since its launch last year, Jambojet now flies to seven destinations; Nairobi, Mombasa, Kisumu, Eldoret, Malindi and Ukunda and has flown over 500,000 passengers, a number which is set to double as more Kenyans appreciate the benefits of low cost flying.

Airtel in new satisfaction initiative to boost growth Airtel Kenya has embarked on gauging its customers’ satisfaction in an initiative aimed at driving the company’s growth. The telecommunications firm has conducted surveys at grassroots levels to determine the needs and preferences of their subscribers. Company staff from its Nairobi headquarters, led Airtel chief executive Adil El Youssefi, visited various customer segments to gain a better understanding and appreciation for their consumers and retailers in the market.

The fact finding mission covered various places in Nairobi which including Buruburu, Umoja, Pipeline, Kiserian, Ongata Rongai, Gikomba, Kibera among other markets and estates. Ober 200 Airtel staff had interactions with customers, Airtel Money agents and shop attendants, gaining insights into the key business drivers and opportunities for growth. “We regularly conduct voice of the customer research visits such as this to hear about the changing

needs of our customers.” Said Youssefi in a recent statement. “The market visits are part our ongoing efforts to revamp Airtel Kenya’s customer experience strategy. Our focus, as a business, is to anticipate and meet both customer needs and wants,” he added. The initiative follows an announcement by the firm to pump Sh19 billion into its Kenyan operations over the next three years. The group had said in an earlier

briefing that the investment seeks to offer the most reliable and quality network, products and services in the market. Airtel officials confirmed that the investment plan will cover network upgrades for its voice and data services, shops, and brand equity development, customer service quality improvement staff training programs and community development programs across the country.

Kenya, China sign local nuclear power deal Kenya and China have signed a deal as part of plans to have a local nuclear power station by 2025, the Kenya Nuclear Electricity Board (KNEB) has said. The board said Kenya is planning to set up its’ first nuclear power with a capacity of 1000 MW by 2015 with ambitions to boost it to 4000MW by 2033 and to make nuclear electricity ‘a key component of the country’s energy’ production. The Memorandum of Understanding, signed in China, will enable Kenya to “obtain expertise from China through training and skills development, technical support in areas such as site selection for Kenya’s nuclear power plants and feasibility studies,” the KNEB statement said. “Already Kenya has signed a nuclear power cooperation agreements with both Slovakia and South Korea with more than 10 students studying nuclear power engineering in South Korea as part of the deals. Bahati substation in Kenya’s Nakuru County was commissioned by state-owned power company, Kenya Power. The $3.6 million (Sh380 million) power project is expected to considerably improve the power supply network, which services the Bahati commercial and social hubs, Kenya Power said in a statement. Kenya Power’s managing director and CEO, Ben Chumo, said that the Bahati substation will improve the quality of power supply to the residents of Wanyororo and Kabatini markets, Murunyu, Ndundori Township and surrounding areas. Chumo added that the newly commissioned project will provide additional transmission capacity and reduce losses in the line through the reduction of the length of feeder lines, the utility’s statement reported. “We are making steady and sure progress in an effort to accelerate electricity supply to over 70% of the national population by 2017 and universal connectivity by 2020. This new substation is one of the projects we are implementing so as to meet this goal.”

Kenya win first ever badminton medal in Congo

It seems the diversification of sports is slowly paying off for Kenya at international competitions after the country won its first ever medal in Badminton at the ongoing Africa Games in Congo, Brazzaville. After Kenya won the first ever gold in field sport through Julius Yego and the first ever gold in men’s 400m hurdles courtesy of Nicholas Bett two weeks ago during the International Association Athletics Federation (IAAF) in China, another first arrived yesterday.Pair Mercy-Joseph Maithya and Lisa Martin, a student of Kisumu Girls Secondary School grabbed a Bronze in the women’s doubles badminton, the country’s best ever performance in the discipline in the game’s history. With more expectation pegged on Athletics team that left for Congo yesterday ahead of the Athletics calendar on Sunday, the country’s first medal in the 11th edition of the games came from unlikely quarters. Kenya beat Nigeria at the third and fourth playoffs after they lost to Seychelles in the semis. Even as the Badminton team was writing history, things were not the same for Karate team that lost point ration. Kenya lost the medal bracket despite beating beat Ghana 5-0. Kiplagat seeks Chicago marathon first medal

World half-marathon record-holder Florence Kiplagat will be seeking her first marathon title majors on October 11 in the Bank of America Chicago Marathon but without elite pace makers. British distance runner Paula Radcliffe’s husband wants her backed by the World Anti-Doping Agency (Wada) even after British has been strongly implicated in doping allegations. Radcliffe’s husband and Coach Gary Lough said Wada must “protect clean athletes” after the ex-long distance runner denied cheating after her data was made public by a report on New York Times and German TV. The ‘backing’ claims comes amidst public claim by a British MP during a parliamentary select committee last Tuesday that London Marathon winners and “potentially British athletes” were under suspicion of blood doping. The 41-year-old Briton has defended three ‘abnormal’ blood results after her data was made public though Lough says he wanted Wada to “come out and state there is no case to answer”. Radcliffe, who still holds the marathon world record, said she has been “almost abused” by calls for her to release her blood data, following the Sunday Times’ allegation on doping in athletics. “I am probably not happy with how Wada have handled this situation,” Lough told BBC “I think this is a special circumstance and want them to come out and say this case is under review and there is no case to answer. “That would definitely help us - that would be the only outcome of the investigation.” Radcliffe was not specifically named, but issued a statement saying she had been “effectively implicated”. Asked whether Radcliffe should have come out earlier to defend herself against rumours, Lough said it was “the last thing they wanted to be associated with” and that initially, they “did not know what they were dealing with”. The new elected president of the International Association of Athletics Federations (IAAF), Sebastian Coe has previously called the Sunday Times investigation a “declaration of war” on athletics. Coe has backed Radcliffe saying he “absolutely believes” she is clean.

enjamin Ayimba is the new Kenya Rugby 7’s team head coach. Ayimba, who parted ways with the Kenya Rugby Union (KRU) in 2011 made a return to the technical bench in a one year contract that will see him take over from South African Paul Treu who resigned early this year. Acting coach Felix Ochieng, who finished the season with the squad after True left, was shown the door after a successful selection process of 14 coaches including four foreigners who applied for the job. Newton Ong’alo will take over as the new team manager from Steven Sewe. The first test for the new technical bench will be to guide Kenya to the 2016 Rio De Janeiro Olympics to be held between November 14 and 15 in South Africa. They walk into an already determined squad released early this week by the union as they plan to take on Zimbabwe and Namibia in a single slot Olympics qualifier. Ayimba is Kenya’s most successful local coach having guided the national sevens team to the Rugby World Cup Sevens semifinals in Dubai 2009, a season Kenya will be remembered for beating

the then champions Fiji in the quarters. He also guided Kenya to their first ever World Sevens Series final, when the team lost 26-7 to South Africa on 5 April 2009 in edition to a 6th overall finish in the 2008/2009 series. Meanwhile, Kenya will only field one team during the 20th edition of Safari Sevens that is slated for October 2 at the Safaricom Stadium, Kasarani. Kenya Rugby Union chairman Richard Omwela did not give any explanation why the union decided to trim down the number of local teams from three to one only, saying there will be additional team ‘if one of the 16 guest teams fails to travel.’ So far KRU has only Sh30 million to run the event after Safaricom came back to sponsor the event, but Omwela remained optimistic that they will be able to raise the Sh21 million deficit. It is due to the tight budget that might have forced the union to enter only one local team in the event that has attracted 16 foreign teams. 2016 Olympics host Brazil will be among the 16 foreign team that will converge at Kasarani which will be hosting the event for the third

year running. Participation of Brazil will be precisely to ‘play and learn how to plan for international tournaments’ ahead of them hosting Olympics games according to Omwela. Past winners Welsh Warriors, neighbours Uganda, Namibia, Western Province, Zimbabwe, Portugal, Spain, Canada, England, Tunisia, Australia, Argentina, Italy and Samurai are among other teams expected in Nairobi. Safaricom came back to rugby after they opted out five months ago citing corruption at KRU, but with a myriad of conditions. First Safaricom did not take the title sponsorship despite contributing Sh30 million, more than 70 per cent of the total budget of Sh 51 million needed to run the event. KRU will have to look for the deficit though Omwela revealed that they are in talks with other co-sponsors ‘who were just waiting for Safaricom to come on board before jumping in.’ In what could only be interpreted as a cautious approach, the Telco Company that lost more than Sh21 million of their last sponsorship of Sh90 million only committed themselves for one year until it is fully satisfied that KRU has transformed and

are ready to handle sponsorship money. “We have been satisfied so far by what the union has done to bring some sanity in governance and administration. This however does not mean that we will be less vigilant in our demands for proper governance,” said Sylvia Mulinge, Safaricom consumer business director. Some of the directors of the union were accused of embezzling money and awarding supply contracts to questionable companies and individuals after they were bestowed with the responsibility of running the event, something that the chairman who took over from Mwangi Muthee said will not happen again. This year, the event will be run by a committee of 10 members headed by KRU chief executive Ronald Bukusi “Over the years we have closely monitored events at the union and highlighted our growing concerns with the lack of transparency and accountability of certain members of the board whose actions have brought the game into disrepute: a situation which jeopardises the Safaricom brand and which makes our continued sponsorship impossible,” he said.
