ormer Finance minister David Mwiraria has been summoned to appear in court over the Sh10 billion Anglo-Leasing case. A Nairobi court issued the order today.

Mwiraria is expected in court on November 23 to answer to charges in which members of the Kamani’s billionaire family face criminal proceedings over the multi-billionshillings scandal.

The ex-minister has been absent from the proceedings due to his “failing health” and a hearing date for the case has remained suspended awaiting his recovery.

However, the order was issued after the Director of Public Prosecutions, through an assistant, Nicholas Mutuku told the court that four doctors who examined the former minister have stated that he is “fit to stand trial.” CONTINUED ON PAGE 2

MP’s rape case to be determined by evidence in court The High Court has today declined to order an inquiry into how a medical document in the rape case against Imenti Central MP Gideon Mwiti got into the hands of journalists.

The article which was published in a local daily touched on a complainant who the MP is alleged to have raped in his Nairobi office.

Justice Weldon Korir, in a ruling cautioned the media to ensure ethical standards are maintained while publishing such stories although he refrained from summon the authors of the article as had been requested.

The decision by the judge arose from an application seeking a clarification on how a medical report in the case found itself in the hands of journalists who published it before it was tabled in court.

The said report, according to lawyer Wilfred Nderitu who represents the victim in the rape case against the MP, created an impression that the author

had accessed the medical records of the victim.

Mr Nderitu informed the court that upon reading the said news item he raised concern seeking an explanation over how the confidential report was accessed and published beforehand.

“The article attempts to determine the criminal case outside the four corners of the judicial proceedings,” he said.

He also alleged that the article may have been written at the behest of “a person interested in the outcome of the case.”

However, Mwiti’s lawyer John Khamniwa had opposed Mr Nderitus application on grounds that the constitution guarantees media freedom and dragging the court into press matters “amounts to engaging in extraneous exercise.”

Mr Mwiti’s rape trial has temporarily been halted due to a petition he lodged before the High Court challenging the criminal case.

“Four doctors examined the first accused and their report indicate that he is fit to stand trial. We ask that he be brought to court within the reasonable time so that charges can be read to him,” the prosecutor said.

“The plea has to be taken so that the case can go on,” said Mutuku concerning Mwiraria.

He also told the court that the trial had been suspended over a pending petition at the High Court that challenged their prosecution, but “the suspects have since lost” appeal.

The former North Imenti MP is among former high-ranking government officials who are facing charges in connection with security contracts entered into by the government 10 years ago.

He had been questioned by the Ethics and Anti-Corruption Commission (EACC) before the DPP approved the charges against him and ordered for

his arrest. Mwiraria, however failed to appear in court in March with his lawyer Kioko Kilokumi telling Chief Magistrate Doreen Mulekyo that his client was unable to appear before her because of ill health.

He then applied to have the matter of his client taking plea come up after 90 days; the amount of time he said his client’s doctor needed to determine when he will be physically able to appear before the anti-corruption court.

His predecessor Chris Obure and six others who included three former Permanent Secretaries had already been charged.

At the same time a former suspect in the case over whose head an international warrant of arrest was issued has now become a prosecution witness.

The court heard that after Bradley Buckinfield, a US citizen, who had also been linked to the scandal, recorded statements with the EACC, he “crossed over” and will now be assisting the State in case.

Justice Korir stated that the courts cannot be swayed by reports appearing in the media saying the ruling and judgements depend entirely on evidence placed for determination.

He said being dragged into determining the authenticity and the veracity of the report would mean “holding lengthy proceedings in an attempt to establish sources of information and correctness of the same.”

“In order not to prejudice the parties’ right to take up this matter before the right forum for determination, I will withhold my opinion on the said article,” Justice Korir stated.

He said the parties in the case should rest assured that the decision will not be influenced by anything happening outside the litigation arena.

“For now it is important for this court to focus its attention on the petition before it. I will focus my energies on giving an answer as soon as practicable” the judge said.

All set for opposition rally at Uhuru Park The Coalition for Reforms and Coalition is set to hold a series of public activities beginning with tomorrow’s rally at Uhuru Park to push the government to pay teachers.

ODM Director of Political Affairs Opiyo Wandayi said the government has failed to listen to all other avenues of resolving the teachers strike hence have now resorted to the public activities.

“Cord has been forced to do this rally because the government has failed to even adhere to the courts, because

as the opposition we have to play our role,” said Wandayi.

Apart from tomorrow’s rally, the opposition is also organizing a series of other public activities to push the government to find a solution to the teachers strike.

He said the details of other activities will be released later as he urged the public to come out in large numbers tomorrow in solidarity with teachers.

“We will do whatever it takes for the President of this country to pay teachers.

Tomorrow’s rally is just one of them, other activities are in the offing,” he said.

And today, Cord legsilators inspected the venue as they called on the public to throng the park to express to the President, the gravity of the matter.

“People should come out and stand against the injustice being meted on our teachers and the impunity of the executive of defying a court order,” Wandayi added. The Ugunja legislator said court orders cannot be negotiated by anybody and the best thing the government can do is to implement them.

“When the executive is negotiating a court order, then it’s a worrying trend that must be corrected at the earliest opportunity,” he said. He also faulted the decision of the government to close schools saying such a move signals a country that is failing in its social responsibilities.

“When things such as education and health are grinding to halt in a country, then it signals a strong message that we are slowly being classified as a failed state,” he warned.

Wandayi said things are getting worse in the education sector while the government has no quick solution.

“The teachers strike has been handled in a very reckless manner,” he added.

Governors petition Senate on county funds transfer delay The Council of Governors has petitioned the Senate over the delayed disbursement of money to the counties dating back three months.

Council chairman Peter Munya said for the months of July, August and September, several counties had not received their monthly allocations, adding that even protest letters to the National Treasury had not yielded any fruits.

“Counties are grinding to a halt,” he said.

According to the Public Finance Management Act and the disbursement schedule by the Senate, the Treasury is expected to wire the money to each county by the 15th of every month but according to Munya, this has not been done.

“Out of 47 applications for the July disbursements, 17 counties have not received the July disbursements in their accounts,” said Munya.

He said 38 counties had not received their August allocations while only one county had received its share of revenue for the month of September. “It is easy to see how county governments’ are straining in the provision of services to its citizens who undoubtedly expect quality services. These delayed transfers have continued to cause costly challenges to counties,” he added.

“Most counties face serious consequences because we are supposed to pay salaries and we do not have the money, then when you

He challenged the Treasury Cabinet Secretary Henry Rotich to explain the cause of the delay since so far none had been given to them.

The Meru Governor also said most development projects in the counties had stalled due to lack of cash to pay the suppliers, adding that counties were not able to provide adequate health care with finance challenges biting. “The council therefore demands that the National Treasury releases all the pending counties’ share of revenues for the months of July, August and September 2015 before the end of this week,” he said.

Accusing the National government of sabotage, the governors threatened to sue the National Treasury for failing to comply with the law and to also seek the court’s indulgence in directing it to cater for the interest and penalties accrued by the counties from the delay.

“We cannot be subjected to the National government’s failures by facing the consequences of revenue shortfalls when the National government in itself is consistently paying salaries on time to its workers before the end of every month,” said Munya.

SRC: Pay cut won’t solve teachers pay row A pay cut by 50 per cent will not solve the ongoing teachers pay crisis, the salaries and remuneration commission –SRC has said.SRC Chairperson Sarah Serem has said the money required is more than what will be availed after the pay cut as proposed by Budalangi MP Ababu Namwamba.Serem has insisted that the teachers must wait for a job evaluation before determining their pay.

“Our advisory on remuneration is binding according to the constitution. The advice MUST be taken wholly,” she said.

“We would rather pack up and go if our advisory opinion is not appreciated. We will conclude the Job evaluation exercise by the 2nd quarter of 2016,” she added.

She says SRC is hoping to conclude the harmonization of all the allowances public officers including the teachers earn.

“Kenya is not getting a return on its investment in public servants, “She said.

Budalangi MP Ababu Namwamba is set to table a proposal at the National Assembly next week to have a pay cut for all public and elected leaders. Namwamba says he is filing a Motion seeking a 50 per cent salary cut for MPs and other highly paid public officers starting with the President, to lower the public wage bill.

NEWS BRIEFS Blast near Somali presidential palace leaves scores dead A car bomb has exploded at the gate of Somalia’s presidential palace in the capital Mogadishu killing at least six people, witnesses say. A conference debating the nature of Somalia’s election in 2016 had just ended in the compound. Presidential guards and a Turkish national are believed to be among the dead, as most delegates had left.

It is not yet known who carried out the attack but al-Shabaab has targeted the palace before.

The militants lost control of Mogadishu in 2011, but often carries out attacks in the city.

The presidential palace is the seat of government and many top government officials live and work there.

Jail delays hanging of paraplegic man in Pakistan The planned hanging of a paraplegic prisoner in Pakistan has been delayed, his lawyer has said. Abdul Basit could not be hanged in compliance with the jail manual because he is in a wheelchair, a magistrate said when ordering the postponement. Pakistan’s prison guidelines require that a prisoner stand on the gallows.

Rights groups have said hanging a handicapped person would constitute cruel and degrading treatment. Abdul Basit, 43, is paralysed from the waist down and uses a wheelchair after becoming ill in prison. Pakistan reintroduced the death penalty in December 2014 and has hanged 239 people since. At the time, the government said it was a measure to combat terrorism after the Taliban massacred more than 150 people, most of them children, in a Peshawar school.

Tourists abducted in Philippines by armed gunmen

Two Canadians, a Norwegian and a local woman have been kidnapped from a tourist resort in the southern Philippines, the military has said. An army spokesman said they were taken by gunmen late yesterday from the Holiday Oceanview resort on Samal Island, near Davao City on Mindanao. The attackers, who have not been identified by police, left by boat, Capt Alberto Caber told reporters. He said it appeared the four were targeted rather than taken at ransom. Since the 1990s the southern Philippines has seen sporadic incidents of kidnapping by Muslim militant groups.

Ministry warns of El-Nino diseases

Health ministry has warned that cases of malaria and other waterborne related diseases may rise due to the expected enhanced El Nino rains.

Information from the meteorological department indicates that there is a likelihood of the outbreak of Rift Valley Fever in North Eastern parts of the country and the Coast.

Director of Medical Services Nicholas Muraguri has therefore urged the counties to map out flood or landslide hotspots including key infrastructure and facilities that may be affected.

Muraguri has also urged the county governments to conduct stakeholder mapping and convene health sector stakeholder meetings for contingency planning.

The ministry has advised county government to create stockpile of medical supplies depending on the risk of the disease outbreak for regions to manage the expected outbreaks.

The ministry has also warned that some health facilities could be affected by flashfloods as some of them are located in vulnerable areas a

move it said could render the facility inaccessible during the period.

Nairobi County government has already assured city residents that it is well prepared to deal with any eventuality as a result of the El Nino rains expected at the onset of next month.

Governor Evans Kidero had earlier warned that though the county has rolled out several mitigation measures, it may not be possible to prevent the destruction and inconveniences that come with such heavy rains.

goSwiff, KCB ink deal to go mobile A global mobile commerce and marketing solutions provider have inked with KCB a strategic deal to offer a new mobile payment facility targeting Kenyan merchants.

ans of the epic fantasy film ‘Game of Thrones’ had a lot to celebrate Sunday night after the show stole the ‘show’ at the 67th Prime Time Emmy awards held in the Microsoft Theatre in Los Angeles.

The continuing TV series which is in its fifth season scooped a total of 12 awards, including best drama series for 2015 beating other exemplary shows such as ‘House of Cards’ and ‘Orange is the new Black’. Apart from the big win in ‘Game of Thrones’, the HBO television network also scooped several other awards in the categories of best comedy writing which went to the network’s show Veep’ (which finally knocked out ‘Modern Family’ after a five year successive dominance in the category), and best directed limited series which went to ‘Olive Kitteridge’.

Even as HBO basked in the Emmy glory, Viola Davis earned herself a page in the book of

We were not surprised when Peter Dinklage won the Emmy for best supporting actor in a drama series, since has managed to capture a special place in the hearts of ‘Game of Thrones’ die-hards playing the role of Tyrion Lannister, the witty imp of Westeros. Others who now have an Emmy to their name are Tony Hale who won in the category of outstanding supporting actor in a comedy while Julia Louis-Dreyfus won in the category of best lead actress in a

comedy. Uzo Aduba won in the category of best supporting actress in a drama series, with Richard Jenkins winning the award for outstanding lead actor in a limited series. His female co-star in ‘Olive Kitteridge’ Frances McDormand won the outstanding lead actress in a limited series award. The Emmys are done and dusted, focus now shifts to the 43rd American Music Awards slated for November 22nd. Meanwhile the London Fashion week is turning on the heat, literally.

It consists of a bridge, tunnel and an artificial island, which connects Copenhagen to the Swedish city of Malmo. All this took only five years to build.

Circumcision among the Ameru

nitiation is a very important practice among the Ameru. This stage marked the entry into adulthood. At the age of sixteen most of the boys were usually ready for this practice and they were prepared prior to the event.

Normally, one did not undergo this rite alone, as there were other boys who were of the same age. Before they were ready for this rite, they would have undergone several feats of endurance among themselves. Each village had boys they were preparing for the rite and each group selected a leader amongst themselves. There was a very strict code of discipline that was met with punishment when it was broken. The punishments ranged from small fines to being removed from the group. Before the big day, the boy was required to visit all his distant relatives. His parents would give him directions then his friends would accompany him as they walked in a single file singing. The songs they sang were poetical narratives that passed the messages on what he had gone through, that which he anticipates and asking forgiveness from anyone that he had wronged.

On the eve of circumcision, they sang and danced. The songs were to instill courage and mock those who were scared to go through the rite. They hardened the boys, as they got ready to face the circumciser’s knife. Young men who had already undergone the rite conducted the dances. They danced with swords and clubs, chains of jiggles fastened to their legs. A man of moral conduct was then chosen to be in charge of taking care of the boy after circumcision. This man was not supposed to be age mates with the boys’ father.

ackline Chirchir is a girl with many talents. From making jewelry to custom making furniture for her clients, her love for this art started almost like a joke. Like all normal girls she would go and buy her jewelry from the stalls and when she did not find that what she wanted, she could get the second choice and later transform it into a timeless piece. “It started out gradually, what I mean is that I used to buy jewelry and stuff from the Nairobi stalls and just pimp it up to fit what I liked and slowly my friends noticed and would want to have the same pieces and voila! it became a business. With time,

the business expanded from just making jewelry to other bigger stuff like furniture.” She tells X Access Jacky describes her art as different and unique. Different because unlike other jewelry makers who make everything from scratch, she goes out and finds the pieces that are not so attractive to the buyer and transforms them into master pieces. Her art is unique because it always has the African touch. Materials used here vary as it depends on the piece she is making. “For the jewelry I recycle stuff like belt buckles and buttons. Lets just say more or less what I can get my hands on. For the furniture I mostly use African kangas and vitenges,” she says. The time she takes on a given piece depends fully on

her schedule. With a crowded schedule, some projects may take longer but it is safe to say that it takes about a week. As for her inspiration, Jacky believes that there is so much that we can pick from day to day. It is not necessary to go far in order to find inspiration. Her inspiration comes mainly from the environment.

Her art is different from the rest because she only does unique pieces for her clients “The fact that you can not get a replica of a piece, I make each piece unique on its own.” When starting out, capital was her biggest challenge as she was still in school.

But it all in the past now, she reckons art is picking up today because people are slowly learning that it is not all about the sciences.

takes up a new mission, that of teaching his half human half monster grandson how to show his fierce vampire side while his parents are away on a trip.

Dracula does this with the help of his friends who put the boy through a monster training boot camp but things get messy when Dracula’s cranky father decides to pay a visit to the hotel and sees how soft Dracula has become.

Telcos invest in health services to achieve goals of Vision 2030 initiative Local telecommunications companies are betting on health services to help the country achieve the millennium development goals, which are part of the Vision 2030 initiative.

In a bid to reduce the mortality rates of children and mothers, one of the tenets of the initiative, mobile service providers have opted to invest in maternal care.

Two health centres in Migori and Kakamega counties are the latest facilities to benefit from the move.

The facilities have already received fully equipped maternity wings in a close to Sh4 million investment by the Safaricom Foundation.

The initiative follows similar moves by Orange Kenya, among other service providers aimed at improving the country’s healthcare systems.

The two facilities, including Chebwai SDA Dispensary in Kakamega and Anjego dispensary in Migori received maternity equipment and a fully equipped

maternity wing respectively.

Safaricom Foundation Trustee Rita Okuthe noted that the two investments would enable mothers from both communities readily access the much needed maternity services.

She noted that previously, mothers from both Chebwai and Anjego communities would have to travel long distances to access maternal health services which was too expensive for majority of them.

“We are keen to ensure mothers

and infants survive and stay healthy during childbirth and early childhood when services are most lacking and the majority of deaths occur,” she said.

Statistics indicate that Kenya loses nearly 7,000 mothers annually due to pregnancy-related complications.

It has also been revealed that a majority of these deaths are preventable if mothers have easy access to maternity services.

Chris Kirubi: investors to rescue KQ, not debtors

Top Kenyan business magnate and industrialist Dr Chris Kirubi has bought two million KQ shares as a way of rescuing KQ back to its profitability saying the national carrier needs investors not debtors.

The businessman bought Sh 11 million worth of stock in the airline declared a Sh 25 billion net loss, the highest ever in Kenya’s corporate history.

“Like a fireman who goes into a burning house to save what he can, I have decided to buy Kenya Airways shares,” Dr Kirubi said.

“We cannot wait too long, the loans are hurting the company, travellers are finding new routes and the shilling is depreciating; the sooner we start supporting the carrier, the better,” he added.

Kirubi has asked the government and Kenyans to be patient with the carrier as it raises to its former glory as he called for a professional diagnosis on what brought down the National Carrier.

Volkswagen on the hot seat over emission tests probe

The US has, in the past, established a set of rules that require vehicles to emit a specified amount of carbon into the atmosphere

Since the investigations began, Volkswagen was ordered to recall half a million cars in the US on Friday alone. all German diesel cars if issues are found, the BBC reports.

The US-based Environmental Protection Agency (EPA) found that software in several diesel cars could deceive regulators. In addition to paying for the Friday recall, VW faces fines that could add up to billions of dollars.

The company’s executives may also be facing criminal charges.

Volkswagen CEO Martin Winterkorn apologised after the scandal emerged and said he

would offer his support to the German transport ministry’s investigation into the carmaker.

VW has stopped selling the relevant diesel models in the US, where diesel cars account for about a quarter of its sales.

These developments come just months after it was announced that the popularity of Volkswagen modes will contribute in growing the sales of personal vehicles in Kenya.

Visa, a global payment technology company has introduced the first of its kind technology framework designed to work with the Europay MasterCard Visa (EMV) to help and ensure open interoperable solutions globally. The new specification biometrics with chip card transactions to enable palm, voice, iris or facial biometrics is intended to prevent fraud and enhance security payments. The architecture Visa has designed enables fingerprints to be securely accepted by a biometric reader, encrypted, and then validated. The specification supports “match-on-card” authentication where the biometric is validated by the EMV chip card and never exposed or stored in any central databases. Users can optionally validate the biometrics data within their secure system for transactions occurring in their own environments such as their own ATM’s.

Airtel has introduced an online platform where its post-paid customers will be able to conveniently make their bill payments.

Through the website “airtelairtime.com”, Airtel customers can now utilize several payment channels to pay their bills using VISA, MasterCard and Mobile money. “At Airtel, we strive offer innovative solutions that give our customers personal comfort and the desired convenience as they continue to enjoy our distinctive post-paid services,” said Airtel Kenya CEO Adil El Youssefi. “We understand our customers’ value for time, therefore, this mobile payment solution will enable them save time and money by conveniently allowing them pay for their postpaid bills. With this online payment platform, our customers will reduce the need to visit Airtel customer service shops in order to make payments for their bills, he explained. For customers to be able to make postpaid payments, they will be required to visit the site from their web browser put their payment details.

UK gives Sh105 million to deal with drought in Kenya The UK Department for International Development, through the London-based International Institute for Environment and Development (IIED), has given $1 million (Sh105.5 million) in a bid to fight the ongoing drought plaguing parts of the country. The groups have encouraged community members in Northern Kenya to identify investments that would build their resilience to climate change by offering to finance these projects. One of the initiatives, dubbed the Isiolo adaptation pilot project, has been backed using the funds, Reuter reports. The funds come at a time when Northern Kenya has become increasingly prone to droughts, a problem that has depleted livestock, water and pasture, vital commodities for people in the region. Now, a two-year effort to bring together a range of adaptations is helping pastoralists manage drought better and protect their animals, incomes and families.

MPs’ salaries too high for our economy Kenyan legislators have been ranked the second-highest paid lawmakers in the world, beating their counterparts from the developed economies such as US, Britain and Japan.

A study by the UK-based Independent Parliamentary Standards Authority (Ipsa) and the International Monetary Fund (IMF) showed the MPs’ basic pay, which excludes allowances, is 76 times Kenya’s GDP per capita

The politicians earn a basic salary of Sh6.39 million per year but Kenya’s per capita income is much lower than that of rich countries, translating into comparatively high pay for the MPs. What is good for our leaders, let it be good for teachers too!

Uhuru should snub the New York summit I applaud Kenyans for Kenya (KFK) US Chapter chairman Peter Makanga on his advice to President Uhuru Kenyatta to postpone his UN trip to New York and instead deal with the ongoing teachers’ strike. SPORTS BRIEFS IHF suspends Kuwait handball Federation The International Handball Federation (IHF) has suspended the Kuwait Handball Association (KHA) with immediate effect.

The decision of the council came after exhausting all possible remedies following Kuwait failure to organise an electoral General Assembly to legitimate the federation’s governing body. Over the last eight years, the IHF has undertaken efforts to harmonise the KHA statutes to be in compliance with the IHF’s and those of the IOC Olympic Charter before constituting the KHA Board of Directors.

The current board whose term of office was terminated already in 2012 has lost its legitimate status. The non-recognised KHA board did not succeed in organising the General Assembly to approve the Statutes and the subsequent GA to organise polls.

IHF Council, upon authorisation by the Kuwait Olympic Committee and Asian Handball Federation, appointed an interim committee to carry out the convocation.

Kenya Pipeline and Kenya Prisons women’s volleyball clubs have only two legs to complete their national league matches ahead of national play offs set for November in Mombasa.

The two clubs have been out of domestic league competition for the better part of the year after contributing majority of their first team players to the national team for various assignments that culminated with a gold medal win in the just concluded African Games in Congo, Brazzaville.

As result, the clubs had asked Kenya Volleyball Federation (KVF) to give them automatic ticket to the play offs, a request which was turned down, leaving them with no option but to honour the remaining matches starting with the eighth leg in Eldama Ravin this Friday.

Pipeline, who are the national defending champions have only played a single match this year and will have three fixtures in Ravin.

They will have matches against Nairobi Water, Oserian and KCB while Prisons, third on the log with eight points from three matches.

Kenya Commercial Bank is currently top of the women’s league with 15 points from five matches followed by Bungoma county on nine.

National men’s division One leaders Kenya Ports Authority and Kenya Prisons have booked their places in the play offs. KPA who have lost only a match from their last 10 outings will be without James Ontere who has since moved back to his base in Japan as they face Western Prisons, and Bungoma county. Prisons, second on the log with 23 points, six less than KPA on the other hand will be up against Vihiga county and Cooperative Bank.

Kenya Defence Forces who completes the top four position will have a tricky match against General Service Unit who is currently seventh with16 points.

to win the newly introduced class (Pee Wee) ahead of Hayley Calder who collected 47 while Wahome Mutahi sealed the podium dash on 41 points.

Andre Antoine beat Isaac Kuria and Andrew Kenneth to grab the MX1 class in another scintillating podium dash. A puncture costed Mikhail Berman the podium after he filed to start the third round despite winning the first two heats of MX. He ended up finishing 4th even after getting the start gate ready to tackle heat three but realizsd his rear tyre was flat.

Diego Costa charged with violent conduct The Football Association (FA) has charged Chelsea striker Diego Costa with violent conduct and Arsenal’s Gabriel Paulista with improper conduct after Chelsea’s 2-0 win over Arsenal on Saturday.

Costa, 26, put his hands in the face of Arsenal centre-back Laurent Koscielny prior to clashing with Gunners defender Gabriel, 24, who was charged with improper conduct. Both clubs were also fined for failing to control their players.

Arsenal have confirmed they will appeal against Gabriel’s dismissal and threematch ban.

Having confirmed the match officials did not see the incident, the FA supplied video footage to a panel of three former elite referees.

They each had to independently rule on Costa’s actions to be an instant red card for the FA to proceed with the charge.

If Costa accepts the charge he will serve an automatic three-match suspension with immediate effect but, if he contests it, an independent regulatory commission will rule.

Chelsea face Walsall, Newcastle and Southampton in their next three domestic fixtures.

Referee Mike Dean booked both Costa and Gabriel for their spat, before the latter was dismissed for kicking out at the Blues forward.

rsenal and Manchester City will seek redemption and hope to end their two consecutive loses when they play Tottenham and Sunderland respectively in a Capital One third round fixtures.

Arsenal relatively good start to the season and mental strength will be put to test, following their dis app ointing 2-0 premier League loss to Chelsea last weekend. A trip to White Hart Lane will definitely bring some chills in Arsene Wenger’s spin considering they will meet a side yet to lose a match in their last six games this season.

Arsenal also lost to Dinamo Zagreb last Wednesday in the Champions’ League. Manchester City which also lost last weekend will seek to bounce

back by heaping further misery on Sunderland manager Dick Advocaat.

The Sky Blues made an impressive start to the season winning their first five games without conceding a goal, but they have come crashing back to earth in the last seven days following a successive 2-1 home defeats to Juventus in the Champions League and West Ham in the Premier League.

Sunderland too are having their own problems this season. They are yet to record a win in the league and have already conceded 13 goals in six games. The situation is even made worse with the absence of suspended Younes Kaboul following his sending-off at Bournemouth, but skipper John O’Shea is available after recovering from illness.

Eliaquim Mangala is a fitness doubt for City after being withdrawn at halftime against West Ham, as is David Silva with a calf problem.
