Fresh bid to halt Ruto’s ICC case MONDAY, SEPTEMBER 28, 2015

Developments in the case facing Kenya’s Deputy President William Ruto and the pursuit of Sudanese leader Omar al-Bashir have prompted a renewed bid from Africa to halt the processes.

An inaugural meeting of the OpenEnded Committee of Ministers of Foreign Affairs on the International Criminal Court took place at the Africa Union Permanent Observer Mission to the United Nations on Sunday, to chart the agenda.

Members of the committee from Burundi, Chad, Cote D’Ivoire, Eritrea, Ethiopia, Kenya, Libya, Sudan, South Sudan and Senegal attended the meeting which drafted eight recommendations they will pursue.

Top on the list is a petition to the Chairperson of the African Union President Robert Mugabe of Zimbabwe “to request the United Nations Security Council to inscribe on its agenda, the request for deferral of the proceedings against President Omar Hassan Bashir of Sudan and Deputy President William Ruto of Kenya.”

The committee under the chairmanship of Ethiopia’s Foreign Affairs Minister Tedros Adhanom Ghebreyesus will engage with the African Group in New York and the African members of the United Nations Security Council to develop a strategy for placing the deferral requests on the agenda of the UNSC. “The committee will engage with members of United Nations Security Council and particularly permanent members on the deferral requests as well as other concerns of the African Union on its relationship with International Criminal Court,” the members agreed.

“You cannot score a goal and then you are told it’s not a goal because the posts have been moved,” Murkomen said in drawing a parallel to the way the court has handled the Kenyan case.

DP Ruto and journalist Joshua arap Sang have already been granted leave to appeal the decision that allowed ICC Prosecutor Fatou Bensouda to use statements of recanting witnesses.

The judges concluded that the defence teams raised appealable issues that require an interpretation of the Appeals Chamber’s decision to avoid adverse effects on the case.

They based their explanation on several issues which included the possibility of the prior recorded statements affecting the outcome of the trial.

According to the judges, there was a high possibility that statements of the four witnesses would affect the outcome of the trial in view that they were not expert witnesses.

If the decision issued was found to be in error later, the judges explained that the prior recorded statements would not be relied upon when

determining the outcome of the trial.

In allowing the defence teams to appeal the decision, it was further noted that there would be interference with the fair and expeditious conduct of the proceedings.

“The chamber agrees with the defence that the identified issues relate to incriminatory evidence that has been admitted into the record and which could significantly impact the length of the proceedings,” they stated.

The defence teams argued that the amendment passed during the 12th Session of the Assembly of State Parties in 2013 was not to be applied retrospectively.

They also complained that it would infringe on the rights of the accused since there would be no opportunity to crossexamine statements made by the five witnesses.

Work boycott continues as teachers defy court order

Teachers today continued with their work boycott in defiance of a court order that last week directed them to resume duty immediately.

Instead, the tutors heeded the directive of their union which told them to stay put and wait for instructions before calling off the strike.

There was no learning in most of public schools around Nairobi as teachers stayed away.

Only a handful of pupils were seen at the Mbagathi Primary School compound playing with no learning taking place.

sitting in their classrooms unattended. A subordinate staff at the St Georges Primary school told X News that some teachers who went to the school today morning did not even have time for students but seemed to have checked in just to ‘survey the situation’.

“I saw a couple of teachers in the compound around 9am but none of them entered into the office nor the staff room. The first two came and stood by the office and were joined by another three. The only thing I heard them saying is that they might be back tomorrow after hearing what Sossion will

say today,” said the worker who requested not to be named.

The Employment and Labour Relations Court had on Friday suspended the four-week teachers’ strike ordering teachers to go to class immediately.

But The Kenya National Union of Teachers (Knut) yesterday told the teachers to stay put and wait for their final word as they analysed the court directive.

“This strike is not about to end as long as there is an active appeal

Kihiu Mwiri murder suspects remanded for seven months Sixteen people suspected to have killed four officials of the troubled Kihiu-Mwiri land buying company have been remanded for seven months. The company’s former and current shareholders were arraigned in court today where Judge Jessie Lessit allowed that they be remanded until the hearing of the case begins on May 2, 2016. They include Joseph Thiong’o, Henry Ngugi Karuga, Julius Kanyiri, John Njoroge, Harrison Marubu, Joseph Muiruri, Bernard Murigi and Mr Josephat Macharia. The others are Mary Mburu, Joseph Nyamu, Patrick Ikuu, Samwel Njeru, Peter Mungai, Zacharia Mutwe, John Kamau and Peter Murigi. They were charged with the murder of Paul Mahihu Bernard, Zachary Chege Kirau, Peter Kimani Kuria and Josephat Kibe. The prosecutor also linked them to the deaths and disappearances of 10 others.

They were, however, not required to plead to the charges pending a mental assessment.

NEWS BRIEFS Mwiki matatu operators protest poor state of road The main Kasarani-Mwiki road was today morning blocked by a group of matatu operators protesting its poor state. The operators started their protests at about 5am catching many commuters unawares. Police and locals said there are no operations on the road as the protests affected movement of vehicles. The protestors abandoned their vehicles on the road while demanding that authorities start constructing the road immediately. Police arrived there and started to plead with the protesters in vain. Several towing vehicles have been summoned to the scene by police to help in removing those used to barricade the road. Police have now resorted to using force to open the road. The users of the road have been protesting its poor state in recent months with today’s dissent the third.

Several touts and drivers were arrested during the protest and locked up in police custody.

Police say they will talk to the relevant authorities to address their grievances.

Apart from children and families illegally crossings the border, the US has to deal with the shipment of illicit drugs and this week, Nkaissery had been on a threeday learning mission at El Paso on the US-Mexico border together with PS Monica Juma to better understand how officials deal with border patrol and control.

Davis & Shirtliff new water pump boost to Tana River residents Davis &Shirtliff, East Africa’s leading supplier of Water and Energy equipment, has completed the installation of an industrialsized water pump to improve the supply of clean water in Wenje Division, Tana River County.

The developments come at a time when as many as 16 million Kenyans have no access to clean, safe water, according to the Water Aid organisation. Meanwhile, less

than half of urban Kenyans have access to safe water.

The firm in conjunction with Wenje Parish and Mission Care from Ireland has installed a submersible water pump, powered by 133 solar panels that will in turn, supply residents with 21KW of power.

The group says the installation will enable the Maroni Community to pump large quantities of water

for longer periods, sparing them the long distances they previously had to walk to get to water while curbing incidences of waterborne diseases.

“Our people walk as far as 15 kilometres in search of water from the crocodile-infested river,” said Father Peter Ndegwa of St John The Baptist, Wenje Parish.

“We installed two boreholes in two villages for domestic use, and

put up a diesel pump to supply water to farms for irrigation, but it could only help on a small parcel of land and the effort did not solve the problem, therefore we searched for help from Mission Care from Ireland,” he said during a recent address ahead of the announcement.

To make the switch to ground water, the village invested in a borehole whose yield is able to

supply enough water to irrigate 16 acres of crops.

The firm’s engineers installed the panels, connected them to the pump, and installed a 10,000 litre water tank in the centre of the village to hold water for domestic use.

The project included an irrigation plan by the Director of Irrigation Development Services Tana River County.

US firm to set up Sh450 billion solar power plant in Kenya

US energy company, SkyPower, will double the Sh225 billion it agreed to invest in Kenya to develop solar power to a massive Sh450 billion.

President Uhuru Kenyatta announced today during a breakfast meeting hosted for him by the Business Council for International Understanding in New York.

SkyPower Global chief executive Kerry Addler also said the firm will invest huge sums of money to set up a research laboratory in the country to advance solar energy.

He said the firm decided to double its investments and donate 3600 solar street lamps to Kenya as a result of the government move to create a business friendly environment for investors.

“We are impressed by how the government professional approach and pro-business measures therefore want to increase our investment in Kenya,” he said.

SkyPower signed the Sh225 billion investment agreement in solar energy at the Global Entrepreneurship Summit 2015 as part of its response to US President Barack Obama’s advocacy for closer business relations between America and Africa.

President Uhuru said business partnership between Kenya and US has

scaled up after President Obama’s visit Kenya.

He told the meeting attended by the chief executives of more than 50 major companies that Kenya has improved its business environment since last year after meetings with US business leaders.

He said to make Kenya more open for investment, his government has enacted several legislations including the Companies Act and the Insolvency Act. The President said the government has adopted a policy to focus on managing and improving power distribution while facilitating private operators to play the lead role in energy production.

The Head of State said the government will guarantee purchase of power generated by private operators and will improve distribution networks to increase connectivity.

Uhuru said opportunities for US firms are massive in Kenya and the wider East African region.

He said Kenya and Uganda have finally settled on the LAPSSET project and private investors should gear up to take advantage of the opportunities.

“The environment for doing business is changing and there are huge opportunities for US companies to get a foothold in Kenya. It is a case of put in your foot first,” said the President.

My inspiration comes from all around, make up strikes me. I have managed to follow Mario; Kim Kardashian’s make-up artist and our very own Muthoni Njomba the brand ambassador of Maybelline. She is quite an inspiration. Steve Koby too inspires me, he is such a humble make-up artist and his work is really good as well.

Who are some of the famous designers and people you have worked with?

I have worked with very many models and designers like Sally of the school of fashion and design, Katungulu, Noor, among others.

I have also worked with some celebrities and music artistes but they prefer to remain anonymous.

John and Joyce’s celebration of love A wise old Russian proverb says that when two people are madly in love, the aura of love is felt even when neither of them are in the vicinity. This was the case last Saturday, the day Joyce Ndung’u and John Machanje said ‘I do’. From early morning, it was evident that it was going to be a beautiful day and even the weather obeyed the rule of love, with the sun shining bright and keeping the rain at bay; nothing was going to ruin this special day.

John and Joyce picked Shrine of Mary Help of Christians Don Bosco Church in Upperhill as the sanctuary where they would be united, and family and friends turned up in large numbers to bear witness to the union of the two who chose the colors purple, white and hot pink as the theme of their wedding. The impeccability of this color combination was manifested through church décor and of course, the bridal and groom party. The ladies stunned in pink tops and purple and pink kitenge patterned skirts, but they were not as stunning as the bride who wore a creative combination of peplum and mermaid designs as the top and bottom respectively. Meanwhile, the gentlemen stood out in pure white, head to toe, including the dashing towering groom.

Contrary to the infamous African timing tradition, John and Joyce were well in time for the church service which didn’t take too long, given the strict

adherence to routine observed by the Catholic faithful. In no time, John and Joyce were pronounced man and wife, officially closing the doors to anyone romantically eying either party.

After the church ceremony, the guests made their way to Thomas Bernado House located along Lang’ata road while the newlyweds and their bridal and groom party retreated for an exclusive session to capture the beautiful moments in stills. At the reception, food and drink were more than enough and the couple went out of their way to provide appetizer bites before the main course, something you don’t experience in every other wedding. As Joyce and John arrived from the photo session, jubilant dancing supervened as is the Kenyan practice for wedding receptions, especially since this was a Luhya-Kikuyu wedding.

It took the intervention of the MC to get everyone back on their seats ready for the speeches, gift presentation and cake cutting, which was followed by the tossing of the bouquet by the bride, which no one actually caught, but a swift lady managed to pick it from the ground.

Eventually, it was time to call it a day and as the elder generation headed home, the more youthful party animals headed to the Splash Water World at Carnivore for the after party.

espite the heavy traffic that hit Nairobi’s Ngong road yesterday, hundreds of motoring and fashion enthusiasts were undeterred as they made their way to the Ngong Race course for what is arguably the classiest event on the local motoring calendar; Concours D’ Elegance. Themed ‘elegance is forever’, the commercial bank of Africa sponsored event showcased vintage, elegance, fashion, fun, and entertainment. The motor show parade being the main event kicked off in the early hours of the afternoon with competitors availing their vintage machines to the judges who scrutinized the automobiles as they took notes and made their judgement. This year’s

event saw a record 24 competitors from outside Kenya with a rare entry of a Yamaha Vmax motorcycle from Rwanda and a massive fifteen competitors from the Ugandan Bikers Association who literally rode on their motorcycles from Kampala to the Concours venue in Nairobi. Other key competitors were from Tanzania and South Africa and of course the host country Kenya.

To cue them was capital FM’s mix Master DJ Joe Mfalme who immediately after the awarding ceremony and the fashion show kept the after party alive with his great music mixes. The ever amazing trio that is Elani hit the stage a few minutes to 7pm amidst cheers and shouts from the anxious crowd that had waited for the moment. Fabulously dressed in Ankara print tops and white trousers by their designer, the group hit the stage on a high note with revelers singing along to their hit songs such as Kookoo and Barua ya dunia, hapo zamani nikupende

among others. The trio performed two new tracks that they are yet to release, one of the tracks features hip hop sensation Octopizzo who performed his rap verse via video link. Elani’s ability to engage the crowds and involve them in their performance is an art that has catapulted the group to the top seat in live performances. Although the show was not marked to go late into the night, the trio kept on entertaining and thrilling the fans who asked for more and more.

With a record of over one hundred automobiles and motorcycles competing at this year’s event, the premier motor show expects even more entries at the next Concours D’Elegance come next year.

Centre for Disease Control (CDC) said the transfer of aflatoxin across the food chain should not occur and advised farmers to invest in modern storage facilities to avert food spoilage and its health hazards.

CDC estimates that globally, 4.5 billion people living in developing countries are affected by aflatoxin annually.

Kintu Kidda of Buddu Province in Buganda Kingdom sets off on a journey to visit the capital to pledge allegiance to the new Kabaka. He travels with an entourage of men, among whom is his adoptive son Kalema. Kalema is going to try his luck in the capital as his real father had requested. On their way to the capital, Kintu in a feat of anger, strikes Kintu on the head and kills him.

After returning home, Kintu cannot bring himself to tell Ntwire, Kalema’s father what really happened. Ntwire utters out a curse that puts Kintu’s household in suffering that spans through generations.

The current generation cannot explain the spate of misfortunes and mental illness that is plaguing their family until they make the connection with what happened generations ago.

YOURSAY Social media wrong on Nana Gichuru’s demise I find it unfair that when society loses Nana Gichuru, instead of mourning with the family and adding our little faith to their little faith so that they may find strength to accept that their daughter, cousin, niece, or sister has passed on, we go on social media and place our bets on all manner of possibilities that could have caused her death.

It is a strange thing to see how individuals will use or misuse the Bible and religion to justify their prejudices and crystallise their religious piety.

Some are saying that “Oh, Nana’s posts on social media are what the scripture talks about in terms of the power of the tongue; she called death on to herself.” Really? When

Martin Luther King Jr. stood on the pulpit one Sunday morning, towards the end of his sermon he cried: “Like anybody, I would like to live a long life. Longevity has its place. But I am not concerned about that now.

I just want to do God’s will.

And He’s allowed me to go up to the mountain. And I have looked over. And I have seen the Promised Land. I may not get there with you. But I want you to know tonight, that we, as a people, will get to the Promised Land!” A few days later, Dr. King was assassinated, was this the power of the tongue at work?

How come these words have been described as “prophetic” as opposed to suicidal, as some have described Nana’s

last social media posts.

Finally, we may recall that in the US, some people would argue that a black man was inferior by nature because of Noah’s curse upon the children of Ham. In addition, some went to the gospel to find evidence of why a black man is inferior-Apostle Paul’s dictum became a watchword, “Servants, be obedient to your master,” and so the black man would be seen a lesser human being. We can always find validity to an argument by turning to the Bible.

Let Nana Gichuru rest in peace. In the end, death is not a full stop, but a comma that punctuates life into a better significance. She is in a better place now.

DPP’s directive to Opposition leaders over Kuria’s ICC remarks far-fetched, ill-intended

Calls by Director of Public Prosecution (DPP) Keriako Tobiko for Opposition leaders to record statement with the police after Gatundu South MP Moses Kuria named them when he confessed of having procured and coached witnesses against Deputy President William Ruto in the ongoing case at the International Criminal court (ICC) is not only illegal by also laughable.

First even though the article 157 of the Constitution allows DPP’s office to commence and institute criminal proceedings against any person at any court save for the martial courts, the mandate does not overlap to ICC cases.

Cases against Ruto and journalist Joshua Sang are beyond our scope and the DPP cannot

purport to be investigating the same cases.

It is also a legal occurrence world over that once a suspect pleads guilty and confesses of having committed a crime, legal bodies such as the DPP’s office can only do the obvious, investigate the suspect and charge him I accordance with the law. After Kuria confessed that he procured false witnesses against Ruto, he becomes the cardinal suspect, therefore Tobiko must summon him before turning their attention to other suspects.

Tobiko therefore lacks the locus standi to summon or directs Cord leader Raila Odinga, Narc Kenya leader Martha Karua and Kisumu Senator Anyang’ Nyong’o to record statement of Kuria’s utterances.

Church mediation calls on teachers pay row late

The move by Catholic clergy to mediate between teachers and the government over the teachers’ strike is late and will not help solve the situation at hand.

The role and voice of the church in the society and national matters was once again lacking as the situation in

the education sector got worse.

Many people will be asking where was the Church in the first weeks when the issue could have easily be handled through the mediation.

Apart from the spiritual nourishment, the Church should take strong stance on matters of importance.

The Church should have been the first to fire salvo at the government for failing to respect the court decision to pay teachers the 50-60 per cent pay increase. It’s time the church re-evaluate its role on matters of national importance and be effective at it.

Lewis Hamilton said it felt “unreal” after victory in the Japanese Grand Prix moved him level with his boyhood hero Ayrton Senna on 41 race wins. “For me to win here at a race where I loved watching Ayrton drive and to match his wins, it does not feel real at the moment,” said Hamilton.

He defended the first-lap overtake of Nico Rosberg, which forced his Mercedes teammate wide and he dropped to fourth before fighting back to second. Hamilton is now 48 points clear of the German in the title race. “The inside line is the inside line, so it was my corner,” said Hamilton. “I can imagine Nico was running out of road but that is what happens when you are on the outside.” “It got really close on the exit of Turn Two and I had to back out of it there and that cost me the race,” said Rosberg.The Sunday event was Hamilton’s 162nd race, one more than Senna started in a career that ended tragically at Imola in 1994.

The Brazilian won twice at Suzuka in 1988 and 1993 and Hamilton’s victory was also his second at the circuit.

1928 Phoenix Ford in fifth win of classic motor show Phoenix Aviation’s 1928 Ford Tudor and Sati Jabbal on a 1925 DKW motorcycle retained their titles of the 45th edition of the Africa Concours d’Elegance over the weekend at Nairobi Racecourse.

Fourth overall was a 1951 Phoenix Aviation Jaguar Mark V with a total of 271 points.

Thousands of spectators who braved the afternoon’s scorching Sun at the racecourse were treated to some exhilarating displays of motoring artistry.

This is the fifth time the Phoenix Ford has won the coveted title, with previous impressive scalps taken in 2009, 2010, 2013 and 2014.

The crowd-pleasing 44 year Phoenix Aviation Ford amassed a total of 275 points, same as its 1958 VW Beetle-which registered the highest points (75) on the external finish -but the Ford carried the day by virtue of being an older

machine.

A 1934 Railton entered by Diccon Wilcock collected 273 points to seal the podium tussle behind the Phoenix Ford and Beetle.

A total of 23 foreign entries went down in history as the highest ever number of visiting competitors drawn from Rwanda, South Africa, Tanzania and Uganda.

The Vintage Motorcycle Club of South Africa were this year represented by Gerald Roelofs who competed with his 1925 Triumph, Piet Maas who showed a 1927 Raleigh and Bevan Beckmann who displayed a 1946 Harley Davidson.

Former Kenya Sevens coach Mike Friday will be returning to Kenya for the first time after parting ways with Kenya rugby Union (KRU) in July 31, 2013.

Friday will return to Kenya and reunite with his former player during the Safari Seven Rugby tournament set for between October 3rd and 4th at the Safariom Stadium.

Friday will return to the land where he was idolised by fans, but this time with Samurai International side. Samurai will pursue their first ever cup title at the 20th edition of the tournament.

Friday’s squad will include Kenyan du of Oscar Ouma and Felix Ayange whom he worked with while he was the head coach of Kenya 7’s team before leaving for United States. Other players in the Samurai squad are Spanish Ignacio Martin and Glen Rolls, Scotland’s Mike Fedo, Luke Crocker of Wales.

US athletics team at last month’s IAAF world Championship refused to take drink with Jamaican sprint sensation Usain Bolt’s image on the label. According to Jamaica observer, the US team was ‘intimidated’ by the image of Bolt on the energy fluid Gatorade, all because Bolt advertises the product. “That’s a fact. It happened that way,” the Jamaica Administrative Athletics Association (JAAA) media officer Dennis Gordon was quoted on a Jamaican publication. Serem, Muriuki win Mombasa International Marathon Little known Victor Serem and Shelmith Muriuki won the 2015 Mombasa International Marathon staged yesterday.

Victor beat his closest challenger to the Sh1.5 million prize by close to a minute when he cut the tape at 2:19:47 ahead of Joseph Biwot who came in second in a time of 2:20:50, while Philip Biwot crossed the tape in 2:21:45. To finish third.

Shelmith weathered all the storm when she beat three-time winner of the Safaricom Lewa Marathon, Fridah Ledopa after crossing the finish line at 2:30:15. Ledopa came second in a time of 2:51:45 while

Sylvia Chebet clocked 2:53:42 to finish third.

The marathon – sponsored by Mombasa county government and Safaricom as part of the Safaricom Athletics Series brought together more than 1,000 athletes.

The overall winners walked home with Sh1.5 million, a significant increase from last year’s Sh200,000. The 1st and 2nd runners up took home Sh650,000 and Sh350,000 respectively.

The 2015 edition also saw the introduction of the 10 kilometre race, where Nancy Chepkoskei won the women category at a time of 34:29:29, followed by Susan

Koskei at a time of 35:14:23 and Christine Moraa, 35:22:16. Edwin Kipsang finished first in the men category at a time of 30:15:18, followed by Patrick Mutunga and Stephen Mwendwa at a time of 30:27:21and 30:31:32 respectively.

After this, the Safaricom Athletics Series will move to Eldoret for the Ndaalat Gaa cross country race set for October 10. Other events set to take place before the end of the Safaricom Athletics Series include: Madoka Marathon, Tegla Loroupe, Kass International Marathon, Imenti South Road Race and Kisumu Town Marathon.

Battered ENGLAND NOW EYE Aussie MATCH England must stay “united” and focus on Saturday’s rugby World Cup “knockout” game against Australia says boss Stuart Lancaster.

The hosts squandered a 10-point lead against Wales and lost 25-28 at Twickenham and a defeat on Saturday against Aussie could all but end their hopes of qualifying from Pool A. “There is a lot of frustration in the changing room and that frustration has to be turned into a positive mindset.”

England, who led 22-12 early in the second half against Wales, have been criticised for the ill-discipline that allowed Dan Biggar to kick his side back into contention.

Biggar succeeded with all eight of his kicks, seven of which were penalties - including a 50-metre effort that put

Wales into the lead in the final minutes.

Lancaster said he was “hugely disappointed” after letting a winning position slip.

“We gave a couple of penalties away which allowed Wales to build belief and momentum. Wales did well to score the points at the end and we did not close out the game,” he said.

England captain Chris Robshaw’s decision to opt for touch in the final minutes instead of attempting a penalty kick, which could have secured a draw, has also been questioned.

Lancaster described the 78th-minute driving line-out that followed as “poorly executed”, and said he would review the team’s decision-making.

“Lots of decisions we made were good, but decision-making at the breakdown and to give penalties away,

and decision-making as to whether to go for goal or the corner are all things that players have to make in the heat of the battle.

“The one thing I would do is never hang any of the players out to dry for making those decisions. We will review them privately, not publicly. We stay united.”

Injury-hit Wales host Fiji at the Millennium Stadium on Thursday and should Warren Gatland’s men secure their third win, England will have to beat the Wallabies to retain any hope of progressing into the knockout stages.

“If we said to the players you can play again tomorrow, they will play because they are disappointed having lost that game having been in a dominant position so there will be no problem with their mentality,” added Lancaster.

Inter Milan’s 100 per cent start to the Italian Serie A season ended in spectacular fashion following a stunning 4-1defeat by Fiorentina.

Fiorentina took the lead at the San Siro through Josip Ilicic’s fierce penalty after Inter keeper Samir Handanovic tripped striker Nikola Kalinic.
