Sacked Kaindi bows out Sacked Deputy Inspector General of Police Grace Kaindi has eventually bowed out of office and allowed her replacement Joel Kitili take over at Vigilance House. Kaindi whose sacking was announced by President Uhuru Kenyatta on Tuesday had refused to vacate office saying she had not received an official letter for her dismissal. There was drama yesterday at Vigilance House, the police headquarters, where Mr Kitili had reported to take over from Kaindi. But the latter refused to vacate office forcing the former GSU commandant to spend time at Kaindi’s principal deputy’s office. This created anxiety especially when the Inspector-General of Police Joseph Boinett stormed the building in the company of Kitili and headed straight to Ms Kaindi’s office. It is reported that she locked herself up and refused to open demanding a dismissal letter before she could quit. However, Ms Kaindi did not show up today and Mr Kitili eventually took over. Her official car was withdrawn and driver and bodyguards instead asked to pick up Kitili.

Police officers at Vigilance House confirmed that Kitili reported to the office at 6am Friday. “The new boss is in the office,” a police officer at Vigilance said, “Kaindi has not shown up today.” Kaindi who was nominated as an ambassador is understood to be contesting her new nomination, insisting on being told why she has been forced to retire from the police before the end of her five year contract extension, even though she has attained 60 years. She was appointed on January 25, 2013 and insists she was legally due to leave office on January 24, 2018 on completion of her contract, which she says has nothing to do with her age. Her dismissal is now subject of a court case filed by a civil society activist, Zachary Onsongo, who argues that despite reaching the retirement age of 60, Kaindi enjoyed security of tenure and should have served out her full term. Several other gender-based organisations led by the National Gender and Equality Commission are also citing the act, and have hinted at plans to file separate suits. The commission’s chairperson Winfred Lichuma yesterday said

they have already written an advisory to the President and will consider filing a case in court if the nomination is not reversed. The case is set to be heard interpartes on Friday after Justice Monica Mbaru certified it urgent

Good riddance, IPOA says of Kaindi exit

The Independent Policing Oversight Authority (IPOA) has termed as good riddance the exit of Deputy Inspector General of Police Grace Kaindi. The authority’s Chairman Macharia Njeru says he had even called for the removal of Grace Kaindi, who was retired after attaining the mandatory age of 60, accusing her of incompetence. “We as IPOA have been of the position that the outgoing Deputy Inspector General is incompetent and has not been able to manage the Kenya Police Service to the required standards,” he said. Njeru said it is time amendments were made to remove the clause calling for gender rule in the top police leadership and instead use merit. “Do you give somebody a job just because of gender and you are dealing with matters security?” he posed. “You can’t do that … and again if you are applying that against the police, why are you not applying in the Kenya Defence Forces or Kenya Prison Service?” He said gender parity should only be reflected in the entire National Police Service without necessarily having to reserve specific positions for either gender.

Teachers ordered back to work as strike is declared unprotected The government has ordered teachers back to work on a day the court declared the strike by the tutors ‘unprotected.’ The Employment and Labour Relations Court while acknowledging that the teachers had a right to down their tools, said they ought to have first given notice to their employer. “The union members had a right under Article 41 to go on strike but they should have issued a notice as required by the Labour Relations Act,” ruled Judge Monica Mbaru who said the strike is unprotected. And after the news from court emerged, Education Cabinet Secretary Jacob Kaimenyi called a press conference at his Jogoo House office where he ordered the teachers to return to work. “I want to appeal to the teachers to go back to class and embrace dialogue with the Teachers Service Commission (TSC). Pupils are just about to sit for very important exams later in the year and it would not be fair to deny them their rights,” Prof Kaimenyi said while appealing teachers to consider the learners’ plight. Kaimenyi admitted that it is a constitutional right for teachers to demand for pay increase but he said such demands should not infringe

on the rights of parents and pupils. “Every worker, teachers included, has a right to demand for a pay rise, but children too have a right to education and no right is more important than the other and therefore we should have a common ground where all parties get their rights,” he said. He told the striking teachers to obey the earlier appeal by the Teachers Service Commission to resume duty. Kaimenyi said teachers are fully aware that TSC is their employer and should therefore respect its instruction. He said that the current strike is illegal as the teachers union did not give a notice to their employer as required by section 75 of the Labour Relations Act. However, teachers have still kept away from schools as the on-going strike entered its fifth day today. Kenya National Union of Teachers (Knut) secretary General Wilson Sossion had yesterday argued that they were not compelled to issue a strike notice. “Don’t expect us to go back and issue another seven day strike notice when there was another notice that was issued on December 28, 2014, and the strike commenced on January 5, 2015, we only opted to move to court and now that there is

Governor Kibwana endorses Makueni County dissolution Makueni Governor Kivutha Kibwana has welcomed a recommendation by a commission on inquiry to have the county dissolved saying it is a victory for the people of Makueni. Prof Kibwana who has had long-running differences with the County Assembly members is among the people who petitioned for the dissolution of the county government citing irreconcilable differences. “We accept the recommendation of the Nyaoga Commission to have Makueni County dissolved because their decision was in line with the wishes of Makueni residents,” he said. President Uhuru Kenyatta had formed the commission to probe the veracity of a petition filed by Makueni County residents that called for the suspension of the County Assembly. And yesterday, the six member committee led by lawyer Mohamed Nyaoga presented its report to the President recommending that the county government be suspended in line with Article 192 of the constitution. It said its decision was based on the fact that majority of the residents were unhappy about the constant wrangles pitting Governor Kivutha Kibwana and Members of the County Assembly which

needed to be resolved. 94 percent of the residents want the county government dissolved citing incurable differences between Governor Kibwana and the MCAs. They also want the county suspended for wastage and misappropriation of funds according to the report. According to Section 123 (8) of the County

Governments Act, if the President finds justifiable reasons for suspension he is expected to forward the report and recommendations to the Speaker of the Senate within seven days. “The Speaker shall cause a motion for the suspension of the county government to be laid before the Senate within seven days and approval by

Senate shall be by a resolution adopted in accordance with the provisions of Articles 122 and 123 of the Constitution,” the law further states. At least 24 of the 47 elected senators must vote in support of the suspension to effect it. Should that happen, then an interim management board will be appointed to run the

affairs of the county for a period not exceeding 90 days. Meanwhile the senate will be looking into the reasons fronted for dissolution should they be convinced that the issues remain unresolved, then fresh elections will be called for Governor, his deputy and the County assembly members.

Mega dams to counter El Nino

The government is planning to construct several mega dams in different parts of the country to harvest El-Nino rains as a way of countering its adverse effects. Water and Irrigation Cabinet Secretary Eugene Wamalwa said some of the dams that had stalled will also be revived in the coming days. “We are already making plans in terms of constructing more dams so that as we have heavy rains coming we can harvest and store this water instead of allowing El Nino to be a disaster,” he said. As a long-term measure, he announced that a disaster management policy was also being reviewed to give special focus on disasters emanating from heavy rains. During heavy rains, parts of the country are prone to flooding which lead to deaths and destruction of property. The recent floods experienced this year left several people dead in parts of the country, including Nairobi. According to Wamalwa, the government also plans to establish a Water Authority once the Water Bill is passed. While urging the Senate to

pass the bill, he explained that having a separate body to handle floods in the country will help in water harvesting and management of opportunities and challenges associated with heavy rains. Some of the dams that the government expects to revive before the expected rains include Umma Dam in Kitui and Badasa in Marsabit which stalled following legal tussles. Other dams to be revived include the Muache Dam at the Coast and Itare Dam in Nakuru. The Meteorological Depratment has already warned that Kenya will experience El Nino in the months of October through to December. The government has also asked those living in low lying areas to move to higher ground to avoid flash floods that are likely to come with the rains. Although the meteorological department’s deputy director Peter Ambenje said it is still too early to tell whether it would be like the El Nino experienced in 1997, they asked Kenyans to be prepared. “The implication of above-normal rains during the season is floods and flash

Majority of Kenyans back KDF stay in Somalia Majority of Kenyans at 57 percent support the continued deployment of the Kenya Defence Forces (KDF) to Somalia, according to a new IPSOS survey. Most of those supporting the continued stay of Kenyan troops in Somalia are from Central region where 80 percent of residents back the idea. It is followed by Rift Valley at 62 percent while North Eastern and Western regions recorded the least support least 39 percent and 37 percent respectively. InstItute to partner wIth polIce In capacIty buIldIng The Kenya Institute of Security and Criminal Justice (KICJ) is seeking to partner with the National Police Service in carrying out development courses to build the capacity of officers in handling investigations. KICJ executive director Joseph Ndung’u yesterday said they are ready and willing to work with the service in providing training especially in forensics to help officers carry out thorough forensic probes. “Owing to global dynamics, it is prudent that all citizens have basic understanding about security which will also help inculcate the concept of Nyumba Kumi initiative and community policing in the society. More importantly, we as Kenya Institute of Security and Criminal Justice (KICJ) are willing even to partner with the National Police Service in such training courses.” Ndung’u said. Currently, although construction of a modern Forensic Laboratory at the Directorate of Criminal Investigations headquarters has already started, lack of an existing basic forensic lab has hindered expeditious probes particularly homicide investigations which have on numerous occasion seen samples being flown out of the country for analysis. And Ndung’u adds that they will offer professional development courses such as fraud detection and investigation, fingerprints and biometric technology, basic investigations skills, criminology, forensic

science, counter terrorism, close protection, cyber-crime investigations and anti-money laundering to boost the capacity and understanding of the police officers. “The curriculum in tertiary levels must also be inclined in offering solutions to current and future challenges. We will progressively carry out enrolment,” he said. Last year, during KICJ graduation presided over by Director of Criminal Investigations (DCI) Ndegwa Muhoro, the DCI expressed willingness of the National Police Service to collaborate with institutions in capacity building officers particularly on forensics. “The Directorate of Criminal Investigations and the entire National Police Service remain open and welcome to any possible collaboration with the KICJ in the field of training. We do recognise the central role played by forensics in modern investigations: this is one area, which we could focus on with a view to identifying possibilities of working together.” Muhoro said during the ceremony. Early this year, NPS initiated a maiden Leadership Development Course at the Kenya Police Staff College- Loresho that involved training of police officers in top and lower cadres. The program is a product of both local and international partnerships between Kenyatta University, the College of Policing (COP) in Bramshill, UK and the National Police Service.

It’s time the Kenya Airways board and management vacated office

s I sat in the passenger lounge at Jomo Kenyatta International Airport contemplating what to do after my Kenya Airways flight had been delayed by over twelve hours, I could not help but think about all that had gone wrong at the airline these past three years. Everything about my delayed flight demonstrated a company in crisis. To try and compare that to the phenomenal performance of the Kenyan athletes at the Beijing World Championships seemed like a tale of two cities, one of

real world-class performers, who succeed in spite of the circumstances and another of a company that has gobbled up millions of shareholder funds with not much to show for it. Kenya Airways (KQ) now holds the East African record for the biggest loss by a company - Sh26 billion ($275 million) for the year ended 31st March 2015. This is over six times the Sh3.8 billion ($38 million) loss recorded for the year ended 31st March 2014 and over three times the Sh7.9 billion ($75.4 million) recorded for the year ended 31st March 2013. Cumulatively, this means KQ has lost Sh38 billion ($380 million) of shareholder money in three years. By any stretch of the imagination, this is a colossal

amount of money to lose in such a short time span and represents incredible destruction of shareholder value. To put this loss into perspective, the recent salary award to teachers now confirmed by the Supreme Court, and giving the government sleepless nights, will cost the taxpayers some Kshs 15 billion ($150 million). ow does a business lose this kind of money and not one senior manager resigns or is fired and the board continues holding office? Things don’t seem well in listed corporate Kenya’s boardrooms. First it was CMC Motors, which was bought by private investors from UAE and got de-listed, then

Mumias Sugar, which has now received a government bailout, Uchumi, which squandered a government bailout and again in trouble then comes KQ also seeking a government bailout. Are Kenya’s boards out of their depth? If there ever was a case for boards to introspect, surely these cases provide ample opportunity to do so. All these appear to be symptoms of a deeper malaise in Kenya’s boardrooms at a time when the country desperately needs management depth to take advantage of emerging opportunities, fight global competitors and develop a more favorable investment and business climate. The board and management at Kenya Airways have blamed Ebola, tourists, KLM, pilots and unions for the loss. Everybody else except themselves. That Kenya Airways is a company in crisis is now a public secret. The much touted “Mawingu” route and fleet expansion plan launched under the leadership of the former CEO, the then Chief Operating Officer and now CEO, and the current board chair, has literally failed to take off. Under that plan, KQ increased its fleet to fortytwo planes and launched a number of new routes in Africa and Asia. With all that capital expenditure, passenger numbers have remained stagnant at 3.7 million travelers flown a year for the last three years. That running a profitable airline is tough is common cause. The aviation landscape is littered with the graves of failed airlines and those that

go in and out of bankruptcy protection. In Africa though, air transport is still virgin territory, which, with a wellexecuted strategy, can be quite profitable. A comparison of Kenya Airways and Ethiopian Airlines (ET) is quite appropriate. They are both East African carriers and ET also went for route and fleet expansion around the same time as Kenya Airways launched a similar strategy. Amazingly, Kenya Airways and Ethiopian Airlines (ET) were almost the same size in 2009 when they both carried 2.9 million passengers. From then on despite prosecuting a similar strategy, Ethiopian Airlines has pulled away from Kenya Airways dramatically in terms of passengers flown per year, route network and fleet size. ET now has 79 aircraft, flies to 45 destinations in Africa and to more destinations in Asia than Kenya Airways. T seems to have executed their strategy flawlessly and are now the largest airline in Africa by fleet size and will in all probability will surpass South African Airways in terms of passengers flown in 2015. Ethiopian Airlines flew over 6 million passengers in 2014 up from 5.2 million the previous year and made a profit of $113 million (Sh11.3 billion). For the fiscal year ended 30th June 2015, ET reported net earnings of $170million, a mean feat given the challenges KQ would have us all believe are afflicting the African aviation industry. Amazingly whilst shareholder wealth tanked southwards at KQ, executive pay was headed north jumping 24 per cent in 2012/13 and 34 per cent in 2013/14. Anybody who has studied the history of company failures worldwide knows that the overwhelming reason companies fail is poor management. Kenya Airways’ case is not any different. Whatever the exogenous factors may have been that impinged on the board and management’s ability to execute their strategy, they should take responsibility for this loss and do the honorable thing – ask the shareholders to elect a new board whose first business should be appointment of a chief restructuring officer to manage a turnaround program. Survey: women still not well represented in company boards Women are still not well represented in company boards, a report by the Institute of Directors (IOD) has disclosed. Though State-owned enterprises have been ranked as the top organisations in that regard, new data shows that little progress has been made in terms of gender equality. The recently released survey, which was carried out in 2014, indicates that there were 13 female chairpersons out of 84 sampled State corporations, with 230 women directors out of a total of 874. “In terms of women

chairpersons, professionals associations had 6 per cent, insurance companies had none, deposit taking micro finance institutions had 11 per cent, banks had 2 per cent, public listed companies had 8 per cent and Stateowned enterprises had 15 per cent,” said Jessie Mutura, the chair of the IOD taskforce. The report indicates that despite a slight increase compared to the 2012 report, the uptake of women in boards is still quite slow. The report has blamed the situation on the country’s corporate history and tradition.

hat inspired Miti ni dawa? Njeri would answer that question better, but when we were in studio and she played me that song I loved the beat and as she explained the song I felt why not? You know music is supposed to address societal issues. Why did you opt to collaborate with Njeri in the Miti ni dawa track? Njeri is a young and talented artiste. Working with her gave me an opportunity to be a mentor and we have to arrive at a point in our careers where we nurture younger artistes. I am glad Njeri sees me as a big sister. What makes you different from other artistes in your genre? That’s really tough. I am not sure how to answer that really but I guess every artiste is unique in their own way. What does the Miti ni dawa campaign aim at achieving? Campaign? haha not really! But honestly ‘watu wa Nyeri hio stori ya kunyofoa!’ Let’s handle disputes better please! What is your latest solo project?

Actually, I just did my video for my single Chukua which God willing will be launched this month. I feel passionately about empowering the youth and the song is basically about awakening. What is your view of the Kenyan music industry now that CMOs are working together and there is a push for 60% play of local music? That was great news, all I can say is that I hope the artistes really benefit! I really hope so! What is the concept of the Miti ni dawa video? Who is directing it? If I told you that I would be spoiling it. I’m not a snitch. ‘Mvumilivu hula mbivu’ wait and see. The video is being done by Leon Chege. He did Njeri’s other video and I liked his work that is why I’m working with him. What kind of change would you like to see in the music industry? CONDUCT OF TEACHERS AND INSTITUTIONAL ADMINISTRATORS DURING THE PAY DISPUTE PERIOD As you are aware, the Kenya National Union of Teachers (KNUT) and Kenya Union of Post Primary Education Teachers (KUPPET) have been quoted in the media threatening to call a strike with effect from 1st September, 2015 over a pay dispute which is the subject matter of an appeal in the Court of Appeal. In the event of a strike, the Commission would like to remind all teachers including those in administrative positions to observe the provisions of regulation 28 (8) (III) of the Code of Regulations for Teachers which provides that:

Ministry of Education, Science and Technology County Directors, who have been advised appropriately vide Circular MOE.CIRCULAR NO.1/2015 dated 31st August 2015 and TSC County Directors have been directed to work together to ensure that learning in all institutions is not disrupted and ensure that learning/teaching programmes are conducted irrespective of the number of learners present. Further, the TSC County Directors are required to submit a list of institutions and the particulars of their heads where learning will not have started as per the school calendar for third term 2015 for appropriate action. iv. The Government has put in place security mechanisms to ensure the safety of learners, teachers and school property. Both the Ministry of Education, Science & Technology and TSC County Directors should liaise with the respective County Commissioners to ensure security measures are in place in the learning institutions. The Commission wishes to draw the attention of all teachers to the requirements and the provisions of Chapter six of the Constitution which requires them to conduct themselves with dignity, decorum and in manner consistent with their profession. All teachers are also bound by the Law, the TSC Act (2012), Code of Regulations for Teachers and the TSC Code of Conduct and Ethics. The TSC County Directors will take disciplinary action against any Head of Institution or teacher who fails to comply with the instructions laid out above or contravenes the provisions of the Code of Regulations for Teachers.

That strike was called off on 14th January 2015 and teachers resumed duty on 19th January uncalled for and is unprotected. iii) The illegality of the strike notwithstanding, the right to strike is not absolute and should not override other rights such as the rights of more than 12 million school going children to be taught. iv) The call on teachers to participate in an illegal strike will unnecessarily put their jobs in jeopardy. As public servants, teachers are aware that they are only answerable to TSC who is their employer as provided for by Article 237 of the Constitution. One of the Constitutional responsibilities of TSC is to assign teachers to public schools. Hence no other individual or entity can give them directions or instructions on matters relating to attendance and performance of duty. v) In the 2015/2016 budget, TSC was allocated Sh 174 billion to cater for teachers’ salaries, recruitment and promotion. No additional funds have been provided towards the implementation of the salary award. Indeed Treasury has informed the Commission that it is not possible to increase salaries at this point in time. Finally, in order to normalize learning in schools, all heads of institutions where learners may not have reported are directed to ensure they are recalled so that learning resumes immediately. The Commission also wishes to appreciate teachers who have reported for duty and are performing their teaching and administrative duties.

CS tells ‘small sports federations’ to seek funding from elsewhere ‘Small Sports’ have been urged to look for other sources of income and stop depending on government for funding. Sports Cabinet Secretary, Hassan Wario told the small federations like Darts to go out and look for corporate support in order to help them catch up with the big boys in the game. Wario who was speaking on morning sports show on Nation FM said that the ‘struggling small federations’ need to revisit sponsorship. ‘I know small sports like Darts are really struggling but I want to urge them to look for funding through federations from cooperates. Let’s look how we can help,” said the Minister. However Wario could not say exactly how long it will take the government to set up a sports academy which is one of the pillars of Sport Act 2013. There have been plans to set up Kenya Academy of Sports with which was launched early this year at Moi Sports Centre Kasarani.

Kenya Hockey Union (KHU) premier league defending champions Butali Sugar Warriors will have a chance to open a seven-point gap between them and Kenya Police when they play Parklands Sports Club on Saturday at City Park Hockey stadium. Leaders Butali have only lost one match this season to 2013 champions Police, who are out to reclaim the title back from runaway leaders Butali who have 28 points.

Tribunal directs bowling association to include Nyaga in Zambia AST squad Kenya Bowling Federation has been ordered to include Njeru Nyaga in the Kenyan squad for the Africa States Tournament (AST) set to be held from September 11-19 in Lusaka, Zambia. Nyaga moved to Sports Dispute Tribunal after he learnt of his exclusion from the squad despite coming top during the trials to AST, one of the most prestigious international lawn bowls competitions in the continent Interestingly, the ruling was not read but passed through a word of mouth to Nyaga. “We are supposed to make a ruling today but unfortunately the ruling is not typed due to some

technicalities,” said one of the Tribunal member. “However this Tribunal finds the selection process was not well laid out and the tribunal was not satisfied by the explanation. We therefore direct Kenya Bowling Federation to incorporate you to the Zambia’s AST squad.” Kenya will compete for the top prize against host Zambia, South Africa, Swaziland, Namibia, Botswana, Zimbabwe and Malawi. The tournament is expected to attract approximately 100 bowlers who will compete in four categories that include Singles, Pairs, Triples and Fours.

Kiprop, clocked 3:35.79 ahead of compatriot and world Championship silver medallist Elijah Manangoi, who came in second in 3:36.01 in a tight race where Kiprop sat back until the last lap which was led by Norway’s Henrik Ingebrigtsen who dashed to the front, just before the bell and made an audacious longrange bid for home. It briefly looked as though he was going to pull off the trick as the chasing pack were slow to react. At the bell, Kiprop was back in 10th place, with Ingebrigtsen 20 metres clear. Kiprop then managed to close the gap when he accelerated to fourth place with 100 metres to go with three men still in front of him.
