The Council of Governors has strongly opposed the bid by Devolution Cabinet Secretary Mwangi Kiunjuri to extend the term of the Transition Authority by a year. Council of Governors Chairman Peter Munya has said the Authority should be dissolved in March in accordance with the law and all county functions transferred accordingly. The failure to do so, he said, would lead to a legal battle. “All functions that rightly fall on the county government must be handed over together with the funds allocated to them,” Munya said. Mr Kiunjuri last week called on Parliament to extend the term of the Authority, which ends in March, by a year in order to allow it complete ‘pending work’. CONTINUED ON PAGE 2

Ruto, Sang depart for make or break session with ICC judges Deputy President William Ruto and journalist Joshua arap Sang left Nairobi today morning for The Hague to begin the process of convincing the International Criminal Court (ICC) judges to terminate charges against them. The two through their legal defence teams have in a 95-page document argued that they are wrongly accused of committing crimes of murder, forcible transfer of populations and persecution in the Rift Valley during the 2007-8 Post Election Violence in Kenya. They have claimed that prosecution witnesses were coached on how to fix Ruto and Sang and promised better lives abroad if they gave evidence to demonstrate their criminal responsibility. ICC Prosecutor Fatou Bensouda on the other hand has maintained that the two have a case to answer for the atrocities committed in the Rift Valley. She has accused Ruto of financing activities of a network that was in charge of recruiting, organising and carrying out attacks in the Rift Valley. Sang is accused of using his radio show at Kass FM to incite Kalenjins to attack Kikuyus and also broadcast activities of the network. Economists take Rotich to task on Eurobond proceeds explanations

Two economic experts have faulted the explanation offered by the National Treasury on the use of the Eurobond proceed in a move that will add pressure to the government to explain to Kenyans how the money was used. International Budget Partnership country manager ‎Jason Lakin and Kwame Owino, the Chief Executive Officer of the Institute of Economic Affairs have said Treasury has failed to offer convincing reasons on how Eurobond proceed was used. Lakin said even if Treasury Cabinet Secretary cannot point out specific projects financed by the Eurobond cash, he should be in a position to tell the country what gains the Eurobond has brought to the country. “The country needs to know what has been achieved out of the Eurobond proceed, this should be wholesomely explained by the Treasury,” he said. Owino faulted the explanation offered by the Treasury that the money was used by various ministries to finance various projects. “The explanation offered doesn’t add up, I’m not saying money was lost

but we need clear explanation that is convincing,” Owino said. “Situations have changed, the system has changed and, therefore, only a convincing explanation will stop Kenyans from asking questions on the whereabouts of the Eurobond proceeds,” Owino added. The two spoke during a prime time live interview on NTV last night. On Friday, the Ethics and AntiCorruption Commission (EACC) said there is no evidence of criminal culpability on the part of the government in the Eurobond saga. IEBC to hear Wetang’ula case tomorrow A special committee by the Independent Electoral and Boundaries Commission (IEBC) will hold a public hearing tomorrow on Cord Co-Principal Moses Wetangula’s elections offence case. The hearing which will take place at Nairobi’s Milimani Law Court before the commission make its decision on January 20. “This is to notify you that the commission will consider your submissions and any other highlights thereon from yourselves on Tuesday January 12. Hearing will take place at the Milimani Law Court Nairobi from 9am,” reads part of the letter from the electoral commission to Wetang’ula’s lawyer’ Siaya Senator James Orengo. Obama declines to back White House aspirants President Barack Obama will not publicly back any presidential candidate before the Democratic Party has chosen who is to lead its battle to retain the White House in November. Obama would be “out there” campaigning after the primaries are over, White House Chief of Staff Denis McDonough told NBC’s Meet the Press. Polls appear to favour Hillary Clinton for the nomination. Vermont senator Bernie Sanders is also in the running. The other remaining contender for the Democratic Party nomination is former Maryland governor Martin O’Malley. McDonough said Mr Obama’s decision was no different from “what has been done in the past”. Obama and Clinton fought each other for the Democratic Party nomination in 2008, when he won his first term. She became his secretary of state. The process of nomination for Democrats and Republicans begins in February with the Iowa caucus. The Republicans go on to choose their candidate for the presidency at the nominating convention between 18 and 21 July in Cleveland. The Democratic National Convention takes place from July 2 in Philadelphia.

VOTER REGISTRATION ASSISTANTS The IEBC offers temporary positions of Voter Registration Assistants (VRAs) to carry out the mass voter registration exercise from February-March, 2016. The exercise will take 30 days and will involve a total of 2,878 officials who will be based at the Ward level. The VRA’s will support the Constituency Registration Officers and Deputy Registration Officers to register new voters. Pamoja Capital to hunt Sh5b ‘injection’ for ailing Uchumi Uchumi supermarket has hired Pamoja Capital as its new transaction advisor to identity a strategic investor in a bid to pump Sh5 billion to finance its turnaround. The retail chain’s shareholders are set to meet Wednesday next week to clear the decision as well as vote on the fundraising plan that proposes the use of options such as a convertible loan or equity to bail out the supermarket from further losses. Uchumi chief executive officer Julius Kipng’etich in a statement said the hiring of the financial advisor was not only aimed at to pump the multibillion financing facility but also as an exchange for a controlling stake. “We have appointed Pamoja Capital as the transaction adviser to handle the matter particularly at such a moment,” said Kipng’etich Pamoja Capital, which has offices in Nairobi and Johannesburg, will engage interested investors once shareholder approval is granted at the forthcoming special general meeting.

Multimedia firm enters film distribution market space

Local multimedia solutions firm, Planet Media Cinemas, has announced its formal entry into the lucrative film distribution market. The firm, which is part of the Nakumatt Group and currently operates the Planet Media Cinema Halls in Nairobi and Kisumu, has made its debut by distributing a just released Bollywood film, to the local market. Film distribution services, locally estimated to be valued at more than Sh18 billion annually, typically features endto-end marketing of new film releases. In its debut entry, Planet Cinemas making available the Chalk N Duster film for local distribution to other cinema hall operators on a digital format, from Planet Media Cinemas. It will also provide the necessary marketing support for the film locally. Speaking when he confirmed the development, Planet Media Director Raman Subramaniam said the firm will leverage on its existing network and infrastructure to provide worldclass film distribution services. The services, cutting across all film genres produced in Hollywood and Bollywood among other film production destinations, he disclosed, will be initially available in Kenya, with plans, now, at an advanced stage, to provide a regional film distribution solution in Uganda, Tanzania and Rwanda, in coming months. The firm, he confirmed is already courting global film distributors, seeking to act as the local partner for such firms including, Sony Pictures Entertainment and its subsidiaries. “At Planet Media Cinemas, we have made a strategic plunge into the film distribution market as we seek to expand our exemplary service in entertainment industry,” Raman said, adding that Planet Media Cinemas shall be seeking to satisfy a growing demand for digital film distribution services in this market. World Bank suspends Uganda road projects The World Bank has suspended the disbursement of funds for civil works in two projects in Uganda, following the cancellation of the Bank-supported Uganda Transport Sector Development Project on December 21, 2015. The announcement comes just as Kenya, which is still in the lender’s good books, seeks to develop its own roads as East Africa’s infrastructure continues to expand. Uganda’s projects, however, overseen by the Uganda National Roads Authority (UNRA), are the North Eastern Road-Corridor Asset Management Project and the Albertine Region Sustainable Development Project, have been suspended pending a review and strengthening of the capacity of UNRA to adhere to the required environmental and social standards. “We are continuing to work with the Government to ensure all Banksupported projects help Ugandans improve their lives while protecting the poor and vulnerable,” the Bank said in a recently-released statement. On the other hand, Kenya’s national government has promised to speed up work on a 97km section of the Kitale-Lodwar road between Lokichar-Nadapal and the 43km Southern Bypass in Eldoret at a cost of Sh71 billion.

London Starcom inks Sh562m deal with Pinnacle Systems London-based Starcom Systems Limited has signed a Sh 562 million contract to supply Kenyan Pinnacle systems with tracking devices and speed governors. The fleet management systems company said it had ventured into a three-year contract with Pinnacle Systems, a local company

that supplies speed governors and tracking systems to increase its supply in the Kenyan market. Avi Hartmann, the chief executive officer at Starcom, said the signing was one of its largest contract in East Africa, while other major contracts were currently under discussion. “This is our largest contract to date

and we are delighted to be working with Pinnacle Systems on this major supply and support agreement. We are working hard to win and fulfil similar large high-value contracts currently under discussion,” said Avi Hartmann in a statement. The contract comes with support for Pinnacle who will buy the Helios

brand of fleet-tracking units which additionally lets users find out how fast vehicles are being driven. “In a unique and exclusive project with Pinnacle Systems in Kenya, valued in Sh526 million we’ve created a speed logger. The speed logger enables authorities to inspect for speed irregularities for up to 3 days,” said Starcom. YOURSAY El Chapo arrest welcome, but Mexico is failing The re-recapture of Mexico’s dreaded drug kingpin, Joaquin Guzman Loera alias El Chapo, after an epic manhunt by security forces is a significant event in the history of countering organised crime. But hauling him back into prison is not in itself a solution to chronic lawlessness and insecurity. Rather, the fact that it took so long and so many sensational jailbreaks and near-misses before he was yet again pinned down means that he is more a symbol of what is sorely amiss in Mexico’s corroded legal and political systems. A man who topped charts as the most-wanted fugitive in the world, El Chapo was no ordinary thug. His legendary status as the merciless

and wily head of the Sinaloa drug cartel, his Robin Hood cult as a billionaire messiah of the poor, and the ease with which he would give chasers a slip made him a parallel authority who mocked at the flawed Mexican state that has struggled under the weight of multiple institutional flaws. Now that El Chapo is back behind bars (hopefully for good at least this time), it is worth recalling that he was the byproduct of a proverbial weak state riven by a culture of clientelismo or patronage networks wherein federal and provincial governments were integrated with local warlords to sustain themselves in power. — Sreeram Chauria

Likoni residents should not pay for land title deeds The government should not make those who settled in Waitiki pay up for the land. Just like the Internally Displaced People in other areas, were given free land and even start-up capital of up to Sh400,000 while others got 10,000, subjecting Coast residents to pay Sh1,000 for 12 years is amounting to slavery and discrimination. I am fully aware of the different scenarios between Waitiki

land and the plights of the IDPs, but the best solution would have been for the residents to be given land free of charge. Land is still a thorny issue in the country and particularly in Coast Province and this was the best opportunity for President Uhuru Kenyatta to solve it. By making the residents to pay, the government has indicated outright discrimination against the region that largely

voted for the opposition in the last General election. Soon there will be legal suits against those will fail to remit the required cash, bearing in mind that some of the families living in the expansive Waitiki land cannot even afford a daily meal. The Nairobi Senator has no rights at all to coerce members of different political parties to join Jubilee or behave in a certain

Vikings, Seahawks tie third coldest in history Fans, players and officials braved one of the coldest NFL games in recent history as Minnesota Vikings lost to Seattle Seahawks in an NFC Wild Card game. Headache for K’Ogalo as Olunga heads to Europe Gor Mahia talisman Michael Olunga is reportedly heading to Swedish League for trials. Ballon d’Or 2015: Messi, Ronaldo in race for Award Tonight, the two most influential footballers on the planet Christiano Ronaldo and Lionel Messi will go head to head this year’s Fifa Ballon d’O award. Ronaldo and Messi have dominated the gong for a few years, but this time round, the Portuguese and his Real Madrid contingent will feel outnumbered by Barcelona after Brazilian Neymar made the for the 2015 Ballon d’Or tonight. Ronaldo will be looking for his third trophy of the football’s most prestigious award while the night also represent an opportunity for the Brazilian Neymar to receive his first gong and possibly start a long trek of catching up with the duo for writing world’s football history as the greatest players that ever shared the same stage. The fact that all the three finalist will be drawn from Spanish league is something that will leave other players and coaches from other top leagues such as English Premier League, Bundesliga and French Lig 1 with an egg on the face as they draw strategies on how to produce world’s bests. The Spanish league will definitely overtake Bundesliga at the top of previous (league winner to seven).
