MPs panel dismiss imposter claims in NYS scandal probe TUESDAY, NOVEMBER 22, 2016
The National Assembly’s Public Accounts Committee has dismissed claims that it could have interrogated an imposter in the ongoing probe into the theft of millions from the National Youth Service (NYS). Reports have since emerged that the committee could have probed an imposter hired by a key suspect in the saga. Already, the Ethics and AntiCorruption Commission (EACC) says it has opened investigations into the possibility that Mr John Kago, 58, who appeared before PAC last month could have swapped identity with the ‘real’ suspect. “We are investigating the matter. So far, we have established that there are two Kagos sharing the same name. EACC deputy chief executive officer Michael Mubea said. But PAC chairman Nicholas Gumbo has dismissed the claims as diversionary tactics meant to shift the committee’s focus from getting to the bottom of the theft of over Sh1.6 billion. Gumbo insisted yesterday that the committee probed the real Kago and that they have all the details of the transactions he did with NYS loot. “We interrogated the ‘real’ John Kago any other report suggesting otherwise is a diversionary which as a committee we will not allow to distract us from our main task of getting to know the truth behind the NYS saga,” Gumbo told X-News. EACC believes the other Kago, a younger man who was a government employee before quitting his job could be the real face behind the NYS scam. However, Gumbo yesterday maintained that they interrogated the right person whom they have all his personal details such as bank financial statements and the details of the company he owns. “We interviewed the right person, don’t listen to other things…we are making good progress over this matter,” Gumbo maintained. The NYS saga continues to elicit hot debate in the country with the committee having interviewed key suspects over the matter. Early this month, Gumbo admitted having received high octane calls from powerful individuals to ‘go slow’ over the matter. The same has also been experienced by other committee members. Last week, an aide to Deputy President Farouk Kibet and Elgeyo Marakwet Senator Kipchumba Murkomen were told to submit written submissions to the committee over their involvement with the saga having been mentioned by former Devolution CS Anne Waiguru. Murkomen has so far denied that he benefited from the proceeds of NYS and told Waiguru to carry her own cross. @sam_x254
Train commuters stranded as services are suspended
Commuters using the SyokimauCentral Business District (CBD) train were today forced to use alternative means of transport after operations were suspended due to blockage of the line after two wagons broke down. The Kenya Railways Corporation Managing Director Atanas Maina stated that the wagons broke down on the railway necessitating services to be disrupted. He told Capital FM News that efforts are ongoing to restore normalcy and stated that any inconvenience was highly regretted. “Yes it is true that services along the line have been disrupted. There were two wagons that broke down along the railway and as such, services could not go on,” he stated. He expressed hope that services would be restored by today evening. “We are however working hard to restore normalcy and to ensure that everything goes back to normal.” Passenger train services in some routes in the city are usually disrupted by small hitches putting on spot the management on their seriousness. There are also calls to make sure the services are provided all day long to address the demand.

NGOs threaten to disrupt global meeting in Nairobi Civil Society Organisations have threatened to disrupt the Global High Level Meeting to be held in Nairobi later this month to protest abeyance of the law by the government. They claim that the government continues to frustrate the much needed enabling environment for civil societies in the country by failing to operationalize the Public Benefit Organization Act which was signed into law by retired President Mwai Kibaki in 2013. Led by their convener Suba Churchill, more than 400 lobbies have said they will also rally around the city during the global meeting to demand action from President Uhuru Kenyatta against runaway corruption in his government. The protest will also cover various inhibitive laws that targets to gag the media and human rights organizations. “We cannot have a government that sits on laws and giving on one hand while taking away through the other. If they fail to operationalize the Act we will ensure that the HLM meeting does not go on,” Mr Churchill warned. He argued that even after the High Court issued a 14 day ultimatum to the Devolution CS Mwangi Kiunjuri to gazette the law, the government has remained adamant. “The High Court had directed Devolution Cabinet secretary Mwangi Kiunjuri to gazette the new law which allows formations, operations and growth of Public Benefits Organizations but has since not obeyed the court order. Chief Justice David Maraga has challenged the Law Society of Kenya (LSK) to crack the whip on errant and corrupt lawyers. Maraga said the judiciary is taking the fight against corruption seriously and that LSK, as a partner, has the duty of also ensuring their members corporate. “While the judiciary is taking the fight against corruption seriously, there is an equally corresponding duty for the LSK to start taking farreaching punitive measures against advocates who are conduits of their clients in bribing judicial officers and staff,” Justice Maraga said when he presided over his first admissions of fresh advocates to the bar at the Supreme Court in Nairobi yesterday. The CJ said a corrupt legal system not only violates the basic right to equality before the law but also procedural rights guaranteed in our Constitution “Our legal system is getting corrupt when it is strictly profit driven and not driven to serve the best interest of our people. The old saying that “Lawyer for Hire, Judges for Sale” must not find a place in our legal system,” he said. “Lawyers must not believe that judicial officers must be bribed or that paying off a magistrate or a judge is the short-cut to winning cases for their clients. In such cases, both the lawyer bribing the judicial officer and the one receiving the bribe are both guilty in the same breath,” he added. Some 125 lawyers were admitted to the bar and Justice Maraga asked them to be ready to continue learning. “The practice of law in Kenya demands constant learning and you must engage with the evolving body of values that have resulted from the history our Constitutional making processes. President Trump to scrap TPP trade pact
President-elect Donald Trump says the US will quit the Trans-Pacific Partnership trade deal on his first day in the White House. He made the announcement in a video message outlining what he intends to do first when he takes office in January, including proposals related to immigration, trade deals and defense policy. The TPP trade deal was signed by 12 countries which together cover 40% of the world’s economy. Trump promised to withdraw from negotiations on the Trans-Pacific Partnership trade deal, cancel environmental restrictions put in place by President Barack Obama, ask his national security team to buttress against infrastructure attacks, have the Labor Department investigate federal worker visas and impose broad new bans on lobbying by government employees. The six items are all somewhat easy lifts inside Washington, because they can be done with a simple signature by Trump and do not require congressional approval. But Trump left out his biggest campaign promises, including promises to build a wall along the Mexican border, establish a “deportation force,” place new restrictions on immigration from some majority Muslim countries, repeal Obamacare and spend $1 trillion on infrastructure. Unlike his items unveiled Monday, those measures would require the approval of Congress and are likely to take significantly more work. Time and speed are very likely to be key factors as the new president looks for bigger, more durable wins in his first year. Republicans control the House and Senate, as well as the White House, but Democrats struggled to pass key items, like Obamacare, when they were in a similar position eight years ago. Republicans hold a firm majority in the House, but could struggle in the Senate, where Democrats will hold 48 seats next year, enough to blockade Trump measures. Trump cast his measures as completely focused on American workers. “Whether it’s producing steel, building cars, or curing disease, I want the next generation of production and innovation to happen right here, in our great homeland: America, creating wealth and jobs for American workers,” Trump said in the two-and-a-half-minute video statement.

South Africa’s ‘Prophet of Doom’ condemned
A South Africa pastor who sprays his congregation with insecticide has been widely condemned. In a Facebook post, self-proclaimed prophet Lethebo Rabalago claims a pesticide called Doom can heal people. The company that produces Doom warned of the risks of spraying the substance, while a government commission urged anyone affected to lodge complaints. But the pastor has defended his actions, telling the BBC he is using unconventional methods to heal people. The country has seen a wave of practices where church members have been subjected to unorthodox rituals to receive healing. In photos circulating on Facebook
and Twitter, Mr Rabalago, who runs the Mount Zion General Assembly in the Limpopo province, is seen spraying the insecticide directly into the eyes and various body parts of his congregants. He told reporters in Johannesburg that he had sprayed the face of one woman because she had an eye infection and claimed the woman was “just fine because she believed in the power of God”. He also claims the spray can heal cancer and HIV. “Doom is just a name, but when you speak to it to become a healing product, it does. People get healed and delivered through doom,” a post on the church’s Facebook account reads.
Testimonies of people who have supposedly been healed by Doom have also been posted on the Facebook page. In another interview, posted on the eNCA website, the pastor is heard saying: “The truth is, Doom can heal people in the right way.” But Tiger Brands, the company that makes the product, says it finds the practice “alarming”. “We want to make very clear that it is unsafe to spray Doom or any aerosol onto people’s faces,” the company said in a statement. “Doom has been formulated to kill specific insects which are detailed on the cans, and the packaging has very clear warnings which must be adhered to,” the statement added.
The company said it was trying to contact the pastor to ask him to stop the practice. Correspondent reports that the government has set up a commission to investigate motives behind these practices. South Africa’s Commission for the Promotion and Protection of Cultural, Religious and Linguistic Communities has also condemned the practice, which it says is “detrimental” to the well-being of people. “The CRL Rights Commission encourages everyone whose rights and beliefs have been violated to report such to the Commission,” it said in a statement. LMC project receives Sh2.4bn boost from Belgium
Belgium and Kenya have signed a deal that will see Belgium fund the Last Mile Connectivity Project to the tune of over Sh2.4 billion. The financial contract for the project was signed Monday evening at State House, Nairobi by Treasury Cabinet Secretary Henry Rotich, Deputy Prime Minister and Minister for Foreign Affairs of Belgium Didier Reynders. As part of the deal between the two countries, the project will involve connecting County governments to National Government Ministries through the National Fibre Optic Infrastructure (NOFBI) network, a move President Uhuru Kenyatta says will greatly contribute to transparency and accountability, especially within the County governments. “Upon its implementation period, the project will enhance government services and ensure accountability of government funds especially through the Integrated Financial Management Information System (IFMIS),” said the Head of State. Uhuru added that Belgium supports reforms in the education sector, the modernization of the energy sector and the improvement of public healthcare. The County Connectivity Project (CCP), which is in its third phase, has been ongoing since 2011. Phase one was completed in 2013 with a three years’ maintenance contract that ends in September 2016, while phase two is still ongoing.
HF Group posts Sh1.2bn profit driven by higher net interest income, increase in loans Leading mortgage services company, HF Group, has posted a pre-tax profit of Sh1.2 billion driven by higher net interest income on the back of an increase in loans during the period under review. The turnover represents a 10 percent year-onyear jump in its nine-month profit. The results come just as HFC - HF Group’s mortgage lending and banking subsidiary lowered its interest rates in accordance with the amended Banking Act 2016 effective September 14, 2016. As a result, all new loans now attract an interest rate of 14.5 per cent and the same rate will be applied to existing loans. The lender’s net interest income jumped 15 per cent to Sh3.1 billion while loans grew 8 per cent to Sh53.9 billion due, in part, to its aggressive expansion strategy for the banking subsidiary. The results come just months after the Group reported a 27.16 per cent growth in profit before tax for the first half year of 2016 driven by rise in interest income from its banking subsidiary HFC and income from housing projects by HFDI. Profit before tax increased to Sh889.7 million
in the half to June 30 2016 compared to Sh699.6 million over a corresponding period in 2015. At the time, the Group’s profit after tax and exceptional items rose 26.26 per cent to Sh612.6 million from Sh485.1 million reported in the same period in 2015. “Net interest income posted a strong growth, rising to Sh2.08 billion during the half from Sh1.71 billion in 2015,” the company said in a statement. The company’s loan book grew by 7 per cent to Sh53.5 billion from Sh49.9 billion in a similar period in 2015. Customer deposits on the other hand increased by 6 per cent to Sh39.8 billion from Sh37.4 billion in 2015 on account of increased customer numbers. HF Group increased its holding of Government securities from KSh 515 million to KSh 3.7 billion both, to take advantage of the improved yields on Government paper as well as building a sinking fund towards liquidation of the first tranche of its Corporate Bond expected in October 2017.

The Bloggers Association of Kenya (BAKE), an organization that represents online content creators, has rebuked rogue bloggers who spread false information. BAKE, whose mandate is to improve the quality of content created on the web, made its stance known at a time when lies, misinformation and halftruths have far-reaching consequences given Kenya’s current political climate. Speaking exclusively to X News, the Bloggers Association has admonished gossips masquerading as would-be journalists. “We do not support the spreading of misleading information. We promote for people to put up information that is true and ethical,” BAKE told X News during a recent exchange. “Note that not all bloggers are our members. We however advocate bloggers to give information that is true. Also, if the person gives false information they should know they are liable to face the long arm of the law,” the Association said in a statement. Despite such moves, governments lack the capacity to regulate what people post online. In light of these challenges, some social media companies have taken it upon themselves to stem the spread of otherwise harmful misinformation. Google, one of the most prominent tech companies in the world, announced on November 14 that it is working on a policy that will restrict ads placed on fake news sites. In the run up to next year’s general elections, Kenya’s politicians have been seen to mirror their counterparts in the United States, a country that recently put

The false news issue has been a significant one in the US elections with Trump, the US President-elect, known for his debatably-outrageous statements, sometimes depicted as a victim of false reporting. One of the most common pieces of misinformation that was spread during the US presidential race was a quote, claiming that the mogul once referred to Republicans as “the dumbest group of voters in the country.” Trump later turned the tables on his detractors and started spreading his own brand of misinformation. The billionaire last week claimed credit for saving American jobs that would have been lost to Mexico had a US-based vehicle manufacturing plant been moved there. This was, however, not the case. It was later revealed that Trump had bent the truth in his favour. One US-based blogger by the name of Paul Horner said he believes he is the
reason Trump won the 2016 presidential election. Horner, who creates hoaxes and fake news on Facebook, makes $10,000 (more than Sh1 million) per month from advertisements that run with his work. Kenya-based bloggers also rely on site traffic to help attract advertisers and some have shown the capacity to spread lies in order to generate said traffic. A new report from privately-owned publisher, Medium has found that advertisers do not care if a site publishes false articles and that some website creators would willingly publish false content in order to attract more page views. The same can be said of local bloggers who use provocative headlines to draw in readers. Such tactics have roused the ire of the Bloggers Association, which has worked to hold its members to a higher standard. “We have held several workshops and trainings to train people on blogging, social media, law and the internet. We have also trained in universities
and institutions such as Daystar, Dedan Kimathi, JKUAT, USIU, Multimedia University, Technical University of Kenya, Kenya Institute of Mass Communication,” BAKE Administration Manager, Jane Muthoni told X News. “In our five years of existence, we have trained over 15000 content creators.” “Apart from training...we support them with advice on technical matters as well as improving their blogs to increase their audience and readership. KAA vows to fight graft as new MD takes office
The new Managing Director and CEO of the Kenya Airports Authority (KAA), Jonny Andersen has officially taken office, opening a new chapter for the organization. Mr. Andersen takes over from Nicholas Bodo, who has been heading the Authority in an acting capacity since July 2016. Until his appointment, he was Director of National Airports at Avinor AS, a state-owned firm that manages airports in Norway, with responsibility for seven state-owned airport hubs. Speaking during the handover ceremony, Mr. Andersen said that the task at hand is to set KAA for the future and to build the biggest aviation hub in the region. “This is a pivotal time for KAA. UK firm to assist Kenya’s DPO with regional expansion plan British firm, Apis Partners will assist Kenyan Internet payments processor Direct Pay Online (DPO) in its plans to expand its presence across the region. Apis invested an undisclosed amount in DPO in September. The British firm has now affirmed that the funding will be used to help DPO expand its local presence to more than 10 countries across Africa in the next year. Deacons signs franchise agreement with Tesco subsidiary
Kenyan fashion and lifestyle retailer, Deacons, has entered into a franchise agreement with F&F, a fashion subsidiary of Tesco. Deacons will set up two F&F stores by the end of the year. This follows the termination of a contract with Woolworths in 2015. Following the agreement, Deacons will acquire the regional franchise rights for the F&F fashion brand that caters for men, women and children. The fashion retailer will then launch the brand in two stores at the Sarit Centre and the Hub, in Karen ahead of the festive season. F&F is a global brand with presence in Europe, the Middle East and Asia and is sold in over 2000 stores across Six European markets, and Seventeen additional markets where it has franchise stores. Tusker FC had been declared 2016 Kenyan Premier League winners, on the penultimate round of the season, but the Brewers wanted to pass a message to outgoing holders Gor Mahia, which they did by beating them with their last match of 2016. After beating Gor Mahia 1-0 in the final clash of the season on Saturday, coach Paul Nkata says his side can have dominance of their own. Veteran striker and now two-time KPL winner with the Brewers, Allan Wanga, settled the battle between the incoming and outgoing champions in the 75th minute as Tusker finally lay their hands on the trophy and medals following the statement of intent at Nyayo National Stadium. As they lined to receive their winners’ medals, Tusker players decked in blue celebratory t-shirt
emblazoned with ‘2016 KPL Champions’ danced with glee before exploding to joy when captain James Situma hoisted the trophy aloft with ticker-tape and confetti descending on the delighted squad. For Gor, it was more of an exercise of passing the baton to the team they failed to reel in and secure an unprecedented fourth KPL title in a row and stretch their record to 16 in their glittering history, the small consolation of being the standard to beat locally notwithstanding. Bellerin signs new deal with Arsenal
Spain defender Hector Bellerin has signed a new long-term deal at Arsenal. The 21-year-old rightback joined the club in 2011 and is established in the starting line-up. He signed a long-term deal in July 2015 but had been linked with a move away, with his former club Barcelona - where he played in the youth teams - and Manchester City reportedly interested. “I have been here a long time, I feel like this is my home and this is the right thing to do,” Bellerin said. “I am very happy to still be a Gunner for many more years.” Bellerin has made 67 top-flight appearances, including 11 this season before he was ruled out for four weeks with injury.
Klinsmann sacked as coach of the US
Former Germany player and boss Jurgen Klinsmann has been sacked as coach of the United States. The 52-year-old, who won the World Cup as a player with Germany in 1990, took over as US boss in 2011. “We remain confident we have quality players to help us advance to Russia 2018,” said US Soccer president Sunil Gulati. “But the form and growth of the team up to this point left us convinced that we need to go in a different direction.” Klinsmann steered the United States to the last 16 at the 2014 World Cup in Brazil after finishing above Portugal in their group. However, they lost 2-1 at home to Mexico and 4-0 away to Costa Rica in their opening two qualifying matches for the 2018 tournament. The US are pointless and bottom of the six-country qualifying group, below the likes of Panama and Honduras, albeit only a fifth of the way through the qualifying process. “With the next qualifying match in late March, we have several months to refocus,” added Gulati. “We need to determine the best way forward to ensure a successful journey to qualify for our eighth consecutive World Cup.”

West Brom scored three first-half goals as they swept aside a Burnley team that is struggling away from home this season. The Clarets, now with only one point from 15 on their travels, got off to an awful start when Matt Phillips turned six yards out and fired high past keeper Tom Heaton. Like Phillips, James Morrison also scored for a second successive game when he ran on to Salomon Rondon’s pass and curled a low shot inside Heaton’s near post from the edge of the box. And the impressive Phillips provided the cross for the third, which was tapped in at the far post by Darren Fletcher for his first of the season. Forward Rondon produced another terrific all-round performance and was rewarded with a goal after the break when his strike took two slight deflections as it beat Heaton. The Baggies are back up to ninth in the Premier League, replacing Bournemouth, while Burnley move one place down to 12th. The Monday night clash was not given a big billing as two mid-table sides met on a wet evening in the Midlands. ristiano Ronaldo can become the first player to score 100 goals in European competition as Real Madrid come up against his former side Sporting Lisbon in the Champions League tonight. The forward has 98 goals, with 95 of those coming in the Champions League. The European champions need only a point from their Group F game against Sporting to progress to the last 16. Real skipper Sergio Ramos and striker Karim Benzema have recovered from injuries and could start. They were unused substitutes in the 3-0 win over city rivals Atletico Madrid on Sunday. Coach Zinedine Zidane’s team have eight points from their four group games, two behind German side Borussia Dortmund who have already qualified for the knockout stage and play bottom side Legia Warsaw at home. ottenham go into their Champions League clash with Monaco tonight knowing only a win can rescue their stuttering campaign and keep them going in the competition. Spurs lie third in Group E with four points after a similar number of rounds, two points behind second-placed Bayer Leverkusen and two further behind leaders Monaco. That means Mauricio Pochettino’s side must win tonight at the Stade Loius II in France or risk being knocked out in the group stage. But the argentine tactician says he will not “take risks” with any of his players’ fitness ahead of the game. Striker Harry Kane will be assessed having only just returned from an ankle injury, while a late decision will also be made on Dele Alli and Mousa Dembele. “We must win but we need to see whether players have fully recovered or not,” said Pochettino on Monday. Alli, 20, has been struggling with a knee injury while Dembele, 29, has a foot problem. “We have a very good team in front of us and we have to be clever,” added Pochettino. “Some players might need to start on the bench and then come on and make an impact.” Spurs go into the match on the back of a 3-2 win over West Ham on Saturday. Kane, who scored twice late on to hand his side a dramatic victory, said: “If we’d lost, it would have been difficult to get going again for Tuesday. “Now it’s the complete opposite. We’re full of momentum.
