Political terrain too hostile for us, women MPs cry out Female MPs have called on the Independent Electoral and Boundaries Commission (IEBC) to bar politicians and aspirants involved in acts of violence from contesting next year’s polls. Under the banner of the Kenya Women Parliamentarians Association (KEWOPA), the MPs say the political terrain ahead of the next year’s polls is becoming highly polarised and unsafe for women aspirants.

MPs Rachel Shebesh (Nairobi) Naomi Shaban (Taita Taveta) and Millie Odhiambo (Mbita) said they also want political parties to blacklist any of their members found to have engaged in fist fights. The calls came just a day after Laikipia North MP Mathew Lempurkel meted violence against his colleague nominated MP Sarah Korere at Interior Cabinet Secretary Joseph Nkaissery’s office. The selection panel chaired by Bernadette Musundi last week shortlisted Dr Mutakha Kangu, Roseline Odhiambo Odede, Margaret Wambui Shava, David Mukii Mareka and David Kiprop Malakwen to be interviewed for the position from a list of 13 applicants. But a Jubilee MP has asked the panel to re-advertise the position saying the five candidates it listed might not be the best. Johnson Sakaja the five are ‘unsatisfactory’ and are not convincing enough to inspire confidence in the polls team which has been riddled with controversy every election year. In an interview with X-News, Sakaja said it was regrettable that the insufficient number individuals who applied for the chairperson job revealed that the advert in local dailies by the selection panel was non-responsive. The MP noted that what has always punctured the reputation of the electoral body is not a political crisis in any election but lack of confidence among Kenyans to make them believe and trust the outcome of the election results. Sakaja held though politicians have in past ‘killed’ careers of some professionals, Kenyans should not be discouraged from applying for the top jobs at IEBC. “Let Kenyans be given chance to apply, we want to get the best candidates out of the best who have applied for the job. Let’s not have a chair of the commission simply because we did not have best who had applied,” he said. bedrock of opposition chief Raila Odinga. Margaret Wambui Ngugi Shava, a

former commissioner with defunct Truth Justice and Reconciliation Commission and David Mukii Mereka both hail from Kiambu and Muranga counties respectively, two regions considered to be President Uhuru Kenyatta’s political backyard. Their affiliation with the President’s ethnic community will automatically eclipse them from the race, analysts opine. Advocate David Kiprop Malakwen hails from Nandi County, the political stronghold of Deputy President William Ruto. That leaves devolution expert Mutakha Kangu ahead of the pack in terms of regional considerations. Dr Kangu is a native of Kakamega County. But Andati believes his association with former Prime Minister Raila Odinga could hinder his chances of becoming the next IEBC chairman. While Sakaja did not mention these issues, Andati believe the factors shall play a key role in determining who succeeds Isaack Hassan. “Regional, political and ethnic considerations will be key in selecting who becomes next chair of the commission. Kangu is the best bet for the job, however, for the reasons I gave it may slip off his hands,” he explained. The political analysist says Jubilee will

not be comfortable with a ‘Raila man’ at the helm of the commission. The panel has set a two-day interview plan to gauge the capabilities of the five finalists. The interviews are scheduled for November 28 and 29, a day before outgoing chairman Issack Hassan and his team are set to leave office. Sakaja said he hoped the selection panel would be driven by the best public interest when they make their choice. Already both Cord and Jubilee have warned they will not accept the appointment of a person affiliated to a political party. As such, Mr Andati says the task facing the selection panel is challenging, delicate and awkward. Another huddle in the way of Dr Kangu could be that he comes from the same ethnic community, the Luhya, as the IEBC Chief Executive Officer Ezra Chiloba. “This exercise will be among those difficult jobs ever undertaken. I really sympathise with the panel. They will have to seriously put into consideration the issue of political and ethnic affiliations,” Andati said. “Any small mistake will stall the process because already there is a lot suspicion from both sides of the political divide,” he concluded.

NGOs threaten to disrupt global meeting in Nairobi Civil Society Organisations have threatened to disrupt the Global High Level Meeting to be held in Nairobi later this month to protest abeyance of the law by the government. They claim that the government continues to frustrate the much needed enabling environment for civil societies in the country by failing to operationalize the Public Benefit Organization Act which was signed into law by retired President Mwai Kibaki in 2013. Led by their convener Suba Churchill, more than 400 lobbies have said they will also rally around the city during the global meeting to demand action from President Uhuru Kenyatta against runaway corruption in his government. The protest will also cover various inhibitive laws that targets to gag the media and human rights organizations. “We cannot have a government that sits on laws and giving on one hand while taking away through the other. If they fail to operationalize the Act we will ensure that the HLM meeting does not go on,” Mr Churchill warned. Chief Justice David Maraga has challenged the Law Society of Kenya (LSK) to crack the whip on errant and corrupt lawyers. Maraga said the judiciary is taking the fight against corruption seriously and that LSK, as a partner, has the duty of also ensuring their members corporate. “While the judiciary is taking the fight against corruption seriously, there is an equally corresponding duty for the LSK to start taking farreaching punitive measures against advocates who are conduits of their clients in bribing judicial officers and staff,” Justice Maraga said when he presided over his first admissions of fresh advocates to the bar at the Supreme Court in Nairobi yesterday. The CJ said a corrupt legal system not only violates the basic right to equality before the law but also procedural rights guaranteed in our Constitution “Our legal system is getting corrupt when it is strictly profit driven and not driven to serve the best interest of our people. The old saying that “Lawyer for Hire, Judges for Sale” must not find a place in our legal system,” he said. “Lawyers must not believe that judicial officers must be bribed or that paying off a magistrate or a judge is the short-cut to winning cases for their clients. In such cases, both the lawyer bribing the judicial officer and the one receiving the bribe are both guilty in the same breath,” he added. Some 125 lawyers were admitted to the bar and Justice Maraga asked them to be ready to continue learning. “The practice of law in Kenya demands constant learning and you must engage with the evolving body of values that have resulted from the history our Constitutional making processes. Rebel and government forces in South Sudan have committed horrific abuses including burning a lorry-load of people to death and raping and hacking women and children, a leading rights group says. Atrocities recorded by Human Rights Watch (HRW) include suspected rebels ambushing a convoy of cars carrying civilians fleeing Yei town in October. “They started to shoot and I lay down,” an 11-year-old boy told HRW. “Others fell on top of me. One had been shot to the head.” The rebels then burned the lorry and their occupants, killing dozens inside, HRW added. Trump denies conflict of interest over his businesses Billionaire US President-elect Donald Trump has said he is not obliged to cut ties to his business empire when he takes office on 20 January. A Democratic senator is tabling a resolution calling on him to liquidate his assets to prove he does not intend to profit from the office of president. There is no legal requirement to liquidate assets but past US presidents have set aside their business dealings. One of America’s top generals, David Petraeus, has told the BBC he would be willing to serve under him. “In theory I could run my business perfectly and then run the country perfectly,” he told the New York Times in an interview. “I’d assumed that you’d have to set up some type of trust or whatever and you don’t.” However, he added that he would “like to do something” to separate his two areas of responsibility. Democratic Senator Ben Cardin would like a more formal separation. Kenya to strengthen ties with African states in land mapping technologies

Kenya has pledged to step up its partnership with fellow African states to support sustainable development in the region through geospatial science and technologies. Speaking during the just-concluded Conference of Ministers of the Regional Centre for Mapping of Resources for Development (RCMRD), Lands Cabinet Secretary Jacob Kaimenyi highlighted gains made by Kenya in the field of land and natural resource management. New Bill will allow borrowers to use household goods as collateral Kenya’s banking sector may see its client base expand after Cabinet approved a new Bill that allows the use household goods as collateral. The new law seeks to empower a largely untapped market of borrowers who do not own land, which banks prefer to use as surety. “The new Bill would create an enabling environment to lend against movable assets as collateral thus luring more new borrowers into the lending bracket as well as boosting confidence across banks,” Cabinet said in a statement. The move comes at a time when data from the Kenya National Bureau of Statistics (KNBS) shows that the rate of borrowing is dwindling despite a move by industry stakeholders to reduce lending rates to just four percentage points above the CBKs rate. Cabinet said that the Bill will provide for the creation of an electronic registry and create an enabling environment to lend against moveable assets as collateral such as cookers, fridges and other appliances. They will be listed using a unique identification

number, allowing lenders to keep track of them. If made into law, the proposed Bill will allow borrowers to use their moveable assets to secure loans from different lenders. Unlike current laws, which only allow borrowers to use either title deeds or vehicle logbooks as collateral, the proposed Bill will see virtually all Kenyans with viable assets gain access to loans. An X News spot check revealed that Kenyans have lauded the move saying they are now waiting on the new Bill to be signed into law. Financial analysts had earlier projected that lowering lending rates could lock out a majority of small loan borrowers, arguing that banks would be less likely to accommodate them. Analysts have also projected a slower economic growth in 2017, citing the forthcoming elections as a major impairment. The new Bill may add to market volatility but is in line with the government’s ongoing efforts to reach the country’s unbanked population. @enock_x254

Political instability, trade barriers will stifle regional growth, experts warn Political stability, fewer trade barriers and infrastructure development will be needed to help drive regional growth in East Africa, new reports from the World Trade Organization (WTO) and shipping company Maersk Line, have revealed. “To improve trade volumes in our region, the East African economies need to attract more foreign investments, which can only happen if we continue to work towards removing trade barriers and providing a conducive environment for business in general and industrialization specifically,” said Steve Felder, Managing Director at Maersk Line Eastern Africa. Felder points to two key infrastructure development projects that will aid in attracting investors. He noted that the advent of the second container terminal in Mombasa has eliminated congestion within the port, and productivity has improved. The construction of the Standard Gauge Railway linking Mombasa and Nairobi, for

which more than 75 per cent of civil works have been completed on the first phase of the KSH 420 billion project, with over 235km of track already laid. Rail has huge potential to reduce the cost of logistics, decongest roads and reduce carbon emissions. Bliss wins Sh11bn contract to provide healthcare services to 304,000 Kenyans

Bliss GVS Healthcare Ltd, the Kenyan step down subsidiary of M/s Bliss GVS Pharma Ltd, has won a Three Year Contract worth $111.4 million (Sh11.3 billion) from Aon Kenya Insurance Brokers Ltd, for the provision of medical healthcare services in Kenya. The contract covers outpatient services for over 304,060 members. Tea export earnings jump to Sh53 billion on back of weakening shilling Kenya’s tea exports to European markets recorded significant growth in the third quarter of 2016 despite tough weather condition experienced across the East African region, an analysis dubbed the Maersk Group Trade Report 2016 has revealed. The growth, according to the report, was majorly driven by the weakening of the shilling against the US dollar. During the period under review, Kenya’s tea earnings jumped 29 per cent from May 2015 to May 2016, fetching Sh53.2 billion, up from Sh41.2 billion. Meanwhile, a 3 per cent growth in exports in the Northern Corridor was largely propelled by tea, non-frozen vegetables and beans, avocadoes and animal fodder. Imports on the other hand, while positive, had a lower growth rate at 2 per cent. Purity Karau, Head of Safmarine Eastern Africa and a member of the Maersk Group, said general growth in exports from the region recorded the slowest growth rate due to introduction of new levies. “Imports were stifled by introduction of new duties

and levies on some of the import commodities such as used clothing, as well as new regulations on autoand paper imports into Kenya,” she explained. Maersk data reveals that tea exports grew by 43 per cent in the first nine months of 2016, making it one of the top export commodities from the East African region. World Trade Organization (WTO) estimates show that world trade growth has been weaker than expected in 2016, expanding by just 1.7 per cent as opposed to the 2.8 per cent forecasted in April. With experts expected a global GDP growth of 2.2 per cent in 2016, this year would mark the slowest pace of trade and output growth since the financial crisis of 2009. Tea is the second largest foreign exchange earner for Kenya, making the commodity a key pillar of the economy. Kenya is also the world’s leading exporter of black tea, a crop that provides livelihoods to thousands of small-scale growers with Pakistan being Kenya’s top export market. @enock_x254

SA plant fires up production, begins shipping Ford Everest models to Kenya WeDnesDaY, noVeMBer 23, 2016

South Africa has begun shipping its locally-manufactured Ford Everest vehicles to Kenya. The first batch of South African-built models destined for export markets in sub-Saharan Africa has been completed, with the first vehicle on its way to a new owner in Kenya. The vehicle, dubbed the ‘Moondust silver Everest 2.2 XLT 4 X 4’, left Durban about a week ago, destined for Mombasa, from where it will make its way to local Ford dealer, CMC Motors. “This is an exciting period for Ford Motor Company, as we are now seeing the fruits of the more than R2.5-billion

investment programme emerge with the first locally assembled Ford Everest models coming off the line and being shipped to their new owners across the region,” says Ford Motor Company Middle East and Africa operations VP Ockert Berry. “The Silverton assembly plant is now operating as a fully-fledged two-vehicle production facility, assembling both the Everest and the Ranger for the domestic and export markets.” Ford Motor Company of Southern Africa started local production of the Everest range in October. Localised production created around 1 200 new

jobs at the local Ford subsidiary and within its supplier network. Ford produces eight Everest derivatives in South Africa, with the vehicle available with a choice of the 2.2 l and 3.2 l Duratorq TDCi engines, XLS, XLT and range-topping limited specification levels, manual and automatic transmissions, as well as the option of two- or four-wheel drive. The move comes barely a month after Ford released its Mustang models in Kenya. Kenya is the second country in Africa after South Africa where Ford Mustangs will be available now that

Ford has begun producing a right-hand drive version at its assembly plant in Flat Rock, Mich., in the U.S., At the time, CMC CEO, Mark Kass said competition in the auto industry had become stiff and the Mustang is expected to position the dealership favorably in the luxury car market. CMC is Kenya’s fifthlargest vehicle importer and assembly company. Rob Johnston, Ford Regional Sales Manager for Sub-Saharan Africa, said Ford dealers in the region were flooded with queries and orders when Ford announced in 2015 that Mustangs would be coming to right-hand drive markets for the first time. Nairobi Securities Exchange poised for 25pc profit decline WEDNESDAY, NOVEMBER 23, 2016

The Nairobi Securities Exchange (NSE) is expected to record a decline of more than 25 per cent in net profit attributable to the shareholders of the Company for the financial year ended 31 December 2016 as compared to that for the same period ending 31 December 2015, its Board of Directors has said. This is due in part to a decline in equity market prices, with trading revenues accounting for 53 per cent of the Company’s income stream. “Over the course of 2016, the Kenyan economy and particularly the Capital Markets sector has remained resilient despite a challenging operating environment both locally and internationally,” NSE Chief Executive, Geoffery Odundo said. Speaking on behalf of the Board, he added that the market has recorded increased volume of traded units for the period ended 30 September 2016 as compared to the same period last year. He said that there continues to be significant interest from foreigners in the market, with increased trading activity, particularly from large institutional investors. “Though equities turnover decreased as at end of October 2016, compared to the same period in 2015, the Bond turnover increased significantly and this segment continues to register good performance,” Odundo explained. “This year has seen some new listings to boost the market, in the Alternative Investment Market Segment and the Growth Enterprise Market Segment. The Company continues to aggressively pursue new listing opportunities and the efforts should bear fruit in 2017. Going forward, whilst continuing to

Tottenham were knocked out of the Champions League as they were comprehensively outclassed by Monaco at Stade Louis II. Djibril Sidibe’s header early in the second half sparked a stunning sequence of three goals in just five minutes that saw Spurs’ Champions League hopes swiftly fade, grow and fade again. Harry Kane’s penalty, awarded when Dele Alli was pulled back, put Spurs on level terms but, just 39 seconds later, Monaco had the ball in the net again through Thomas Lemar. Victory takes Monaco through to the last 16 as deserved winners of Group E ahead of Bayer Leverkusen, who earlier drew 1-1 at CSKA Moscow. Tottenham, who have won just one of their five group matches, are three points behind Leverkusen with one game to play, against CSKA on 7 December, but cannot overhaul the German side because of an inferior head-to-head record. Spurs knew a draw would be enough to keep their hopes alive, but Monaco were by far the better side and only a superb performance by goalkeeper Hugo Lloris - who saved a penalty from Radamel Falcao - spared the Premier League side further punishment. The Ligue 1 title hopefuls cut through Spurs with ease from the outset, with full-backs Sidibe and Benjamin Mendy a constant menace. Leicester City’s remarkable debut Champions League campaign continued as they reached the knockout stages with one game to spare by beating Club Brugge. The Foxes needed a point to move into the last 16, yet secured three to ensure they will finish top of Group G. Board unveils requirements for Gor Mahia club elections

Aspirants for the position of Chairman at Gor Mahia FC will part with Sh150,000, the clubs elections board announced last evening. Those eying other plum positions like the Secretary General, that of Senior Vice Chairman, First Vice Chairman and Second Vice Chairman will pay Sh75,000. A press released signed by the elections board chair retired Justice Nicholas Ombija also indicated that those eyeing the positions of Organising Secretary and Treasurer will pay Ksh50,000 with the charges for deputy SG, assistant SG, assistant Organising Secretary and assistant treasurer attracting a fee of Sh25,000 each. Gor Mahia will conduct its elections on December 11, 2016. Members of the club interested in vying for positions should collect forms at the club secretariat in Nairobi between Wednesday and Saturday at noon and will be required to have Kenya Revenue Authority Compliance Certificate and Certificate of Good Conduct from police. “All candidates desirous of offering themselves for election must satisfy the requirements of Leaders and Integrity Act of the Constitution of Kenya,” the statement read. The Nomination Papers should be returned by November 30 and the Board will publish the verified Voter’s Register on December 1. “The Board wishes to reiterate its commitment to delivering free, fair and transparent election and calls for co-operation for club members,” the communication stressed. The notice to convoke the election was published on Sunday with the recruitment of members and collection of fees elapsing a day later. The Gor elections have been plagued by controversy with some stakeholders accusing the incumbent office led by Chairman Ambrose Rachier of plotting to remain in power. They further accuse Rachier and his team of amending the club’s constitution without consulting the members with a meeting called to close ranks last month at Nairobi Nyayo National Stadium ending in disarray. Dissent against the sitting office has been simmering with the club failing to hold on to their Kenyan Premier League title this season for the unprecedented @amos_x254 fourth year in a row.

rsenal boss Arsene Wenger will field a strong side after urging his players to “finish the job” in the Champions League against Paris St-Germain. The Gunners and PSG both have 10 points and have booked their place in the knockout stage with two games to spare. France forward Olivier Giroud could start after his equaliser as a substitute at Manchester United on Saturday. “It is a luxury to be qualified after four games,” said Wenger. Arsenal are level on points with PSG at the top of the group, and their manager wants a victory to ensure a favourable draw in the last 16. A win on Wednesday would secure top spot with one game to play, as it would leave Wenger’s team three points clear of PSG and with a better head-to-head record. The winners will be drawn against a runner-up from another group in the next round. Arsenal drew 1-1 away to PSG on 13 September, and Wenger added: “We have done the job in a convincing way. “Now, we have to finish the job at home. We played a draw there and now it is down to us to win the game.” Arsenal are unbeaten in 17 games, are three points off the top of the Premier League while they have breezed through to the next stage in Europe. Yet Wenger was not all buoyant at his news conference on Tuesday. The 67-year-old angrily denied suggestions he was gambling on the fitness of Alexis Sanchez after the forward played the whole game on Saturday despite injuring a hamstring while on international duty with Chile. “I’ve never demanded anyone should be injected to play,” added Wenger. “He had a bit of tightness in his hamstring, but he was checked before the game. “If a player is 100%, I make a decision. But the suggestions I have forced him to play are wrong, completely wrong.” Sanchez, 27, has scored eight goals in 16 club appearances this season. Wenger would not confirm if the Chile international would start against PSG. Two players who will

definitely not be involved because of injury are Spain pair Santi Cazorla, 31, and Hector Bellerin, 21. Defender Bellerin, who has just signed a new long-term deal, misses out with an ankle injury while midfielder Cazorla has an Achilles problem. Paris St-Germain will be without full-back Serge Aurier who was stopped from entering the United Kingdom. The Ivorian, 23, was given a two-month suspended prison sentence in September for assaulting a police officer. PSG say the UK authorities granted Aurier a visa in October but revoked it on 16 November, citing his conviction. Uefa expressed “deep disappointment” in the ruling, while PSG said the timing showed “a lack of respect”. The French champions accused the Home Office of a “tardy response” and claimed the decision was not made until Tuesday afternoon. As Aurier was born outside Europe, he was applying for a Tier 2 Sportsperson visa, which allows an individual to stay in a country for up to three years and typically takes three weeks to process. But the Home Office said in a statement: “The immigration rules clearly state that non-EU nationals who have received a custodial sentence of less than 12 months within the last five years will be refused on criminality grounds.” There is no right to appeal against a visa refusal. Aurier, an Ivory Coast international, is appealing against his initial conviction, leading PSG to believe he is entitled to be presumed innocent. “Paris St-Germain strongly regrets the presumption of innocence has not influenced Britain’s decision,” said the club in a statement. Uefa sent letters to the Home Office and Football Association supporting PSG, and said it was “regrettable” he could not play “for reasons which are not related to football and its regulations”. Aurier, who has played 40 times for PSG since making his loan deal from Toulouse permanent last year, is accused of elbowing a police officer outside a Paris nightclub in May. In addition to his suspended sentence, he was fined €600 (£521). PSG manager Unai Emery said the club “did everything in its power” to have Aurier available for their penultimate game in Group A.
