Ndemo was accused of disclosing the contents of the KCPE English Language and Composition papers to another person at Mary Joy Primary School in Nyali, Mombasa on Tuesday.

“Ombega Clive Ndemo: On November 1, 2016 at Mary Joy Academy school in Nyali sub-county within Mombasa county being an agent of the Kenya National Examinations Council willfully and unlawfully disclosed the contents of an examination paper, KCPE 2016 English language and English composition to another person without lawful authority,” the charge sheet reads.

Candidates sat the two papers at the start of the three-day national examination.

This is the first reported case of exam leaking this year after exams kicked off under tight security.

Strict measures are in place countrywide to secure test papers and exam centres and prevent all forms of cheating that plagued last year’s KCPE and KCSE exams.

Mochache said the case must be heard and determined before exam results are released in December.

Ex-CS Waiguru fights back in NYS theft saga Former Devolution and Planning Cabinet Secretary Anne Waiguru has today turned the heat on her accusers in the NYS saga, dismissing claims by chief suspect Josephine Kabura as lies and maintaining former Principal Secretary Peter Mangiti should take responsibility.

Appearing before the Parliament’s Public Accounts Committee (PAC), Waiguru defended herself against claims that she orchestrated a well-oiled plan intended to siphon public funds from the state agency.

PAC Chairman Nicholas Gumbo set the stage for an intriguing debate when he preempted Waiguru’s plea that the committee would not be used as a witch-hunt against her through insinuations.

Ms Waiguru stated categorically that she had never met Ms Kabura, telling MPs that the controversial businesswoman is being used as a puppet.

“I have it on record that I have never seen Ms Kabura live,” Waiguru said.

Kabura, who appeared before the committee on Tuesday, received contracts with the agency worth Sh1.67 billion through 20 companies in which she is a director.

It is believed that Kabura’s companies were used as conduits to loot funds from NYS through over-pricing of materials delivered in tenders to the agency.

Kabura in a sworn affidavit alleged that she had met and known Waiguru for the past 7 years, and it was through her that she had used her position as Cabinet Secretary to influence tenders in her favour.

She said that she was shocked to find out Mr Githinji was still able to make transactions with the IFMIS system, months after his revocation.

“The director general claimed that he was not in control but Dr Githinji was AIE holder when the Sh791m was stolen,” Waiguru explained.

Laptops, tablets banned from marking centers Teachers who will be participating in the marking of these year’s national examinations will not be allowed to carry laptops or tablets to marking centers.

This is according to new Kenya National Examinations Council (KNEC) guidelines to govern the marking of Kenya Certificate of Primary Education (KCPE) and the Kenya Certificate of Secondary Education (KCSE) examinations.

Access to the marking centers has also been restricted to only authorised personnel.

“Examiners are discouraged from carrying personal electronic gadgets, like laptops and tablets to the marking centres. Every person getting into/out of a marking centre shall be subject to security check/frisking at the gate,” a statement from KNEC stated.

According to KNEC, surveillance has also been stepped up in addition to limiting the marking centres to Nairobi and few other regions like Machakos and Murang’a.

“From last year, the Council has banned use of mobile phones in the marking, script and e-capture rooms. Examiners will be required to put their mobile phones off or in a silent mode and store in one desk, under the supervision of Team Leaders. They will however, use the phones during tea/lunch breaks outside the rooms,” it pointed out. The regulations further spell out the conduct of all contracted examiners whose contracts with the Council will only be honoured after successful marking and submission of the Chief Examiner’s report.

They point out that all examiners are expected to reside within the marking centres, unless with clearance from KNEC. “All examiners should report to the marking

Vote wisely, Obama cautions Americans President Barack Obama has urged Democrats of all ethnic backgrounds to get out and vote for Hillary Clinton, warning that the fate of the US republic, and the world at large, is at stake.

He said Republican candidate Donald Trump was a threat to hard-earned civil rights.

President Obama was speaking at a rally in North Carolina.

Mr Trump said Mr Obama should stop campaigning for Mrs Clinton and focus on running the country.

“The bottom line is, no-one wants four more years of Obama,” he told supporters in Pensacola, Florida.

He said Mrs Clinton had become “unhinged” in recent days.

“The fate of the republic rests on your shoulders,” President Obama told supporters in the key battleground state of North Carolina.

“The fate of the world is teetering and you, North Carolina, are going to have to make sure that we push it in the right direction.

“I am not on the ballot, but I tell you what, fairness is on the ballot; decency is on the ballot; justice is on the ballot; progress is on the ballot; our democracy is on the ballot.”

The FBI is now investigating new emails that may be linked to its probe into Mrs Clinton’s private email server. The agency’s director, James Comey, has faced a fierce backlash for announcing the move just 11 days before the presidential election.

Earlier, Mr Obama implicitly criticised him over the new inquiry into Mrs Clinton’s email use.

In an interview with website NowThisNews, published on Wednesday, Mr Obama said US investigations should not operate on the basis of “innuendo” or “incomplete information”.

Mr Obama’s remarks were his first public comments since Mr Comey’s announcement on Friday that the FBI had discovered a new batch of emails that might or might not be relevant to an earlier, closed investigation into Mrs Clinton’s handling of classified information.

There are reportedly 650,000 emails to search through on the laptop, but it is unclear who sent or received the emails or what they were about.

Democrats have angrily demanded that the embattled Mr Comey rapidly make public what the agency knows about the new email trove.

Kenya withdraws South Sudan troops in protest of commander sacking

Kenya has withdrawn its peace keeping troops deployed in South Sudan in protest of the dismissal of Lt. General Johnson Mogoa Kimani Ondieki as Force Commander of the United Nations Mission in the troubled country. General Ondieki who is a Kenyan was sacked by the outgoing UN Secretary General Ban Ki Moon following a damning report showing failure to protect civilians during violence earlier this year in Juba.

And in a statement to newsrooms, the Ministry of Foreign Affairs faulted the move by the UN Secretary-General citing failure on the part of the United

Nations to conduct a transparent and consultative process in determining the matter.

According to the government, the UN’s Independent Special Investigation on the fighting in the South Sudan capital fails to address the root causes of the incidences reported while pilling the blame on General Ondieki.

Equity declares ‘death of branch banking’, posts Sh21 billion profit Equity Bank Group has posted a pre-tax profit of Sh21.5 billion for the first nine months of 2016. The 18 per cent jump from Sh18.14 billion posted during the same period in 2015, was partly driven by a correlation between foreign currencies within the region and the exchange rate being smoothened across the region.

“This shows a stable environment, which offers an enabling environment for conducting business,” the Bank said in a statement issued this morning.

During the period under review, Equity Bank grew its deposit base by 20 per cent, shifting its contribution to the group from 69.5 per cent in Q3 2015 to 80.1 per cent in Q3 2016.

“This is something we are very proud of as this shift in the market place shows the confidence of our customers to save and bank with us,” said Equity Bank CEO, Dr. James Mwangi.

Speaking during the release of the results this morning, he added that the same applied to profitability for Equity Bank Kenya, which grew from 89.6 per cent in Q3 2015 to 93.3 per cent in Q3 2016.

Dr. Mwangi lauded the lender’s Equitel mobile banking platform, describing the service as a game-changer for the entire sector.

He noted that Equitel moved Sh139 billion via mobile money between April and June 2016, moving to 2nd position in the market.

Efficiency, effectiveness of public investments declining, WB warns

Returns on Kenya’s infrastructure projects are falling due to rising projects costs and project management concerns, a new report by the World Bank has revealed.

The analysis indicates that the country has continued to heavily invest in infrastructure with little regard for the projects’ bottom line. Investments in infrastructure now average 21 per cent of the country’sGross Domestic Product (GDP). The budget for economic infrastructure sectors that include energy and petroleum, roads, railway, port and ICT has jumped from Sh100 billion to Sh400 billion in a span of six years and is estimated at Sh800 billion in the 2016/2017 financial year.

The net result of these investments means improved infrastructure quality in Kenya.

Based on the World Bank’s Logistics Performance Index, Kenya has improved its ranking on the index from being number 76 out of 150 countries in 2007 to 42 out of 160 countries in 2016.

However, efficiency and effectiveness of public investments in Kenya have been declining in recent years.

“For the period 2008-12, investment contributed 1.9 percentage points to GDP

KRA arraigns three liquor manufacturers for tax evasion

The Kenya Revenue Authority (KRA) has arraigned three liquor manufacturers before court for tax evasion. The three; Robert KibiraDirector of Tihan Limited, James Gichana Mbuthia - Director of Cryan Limited and George Ng’ang’a Thairu - Director of Kedsta Investment, were charged on Tuesday, November 1, with removing excisable goods from the factory without affixed excise stamps contrary to section 28 of the excisable duty act 2015.

Together, the accused directors owe KRA Sh1, 120, 717 duty evaded from the stamps which were not affixed on the liquor.

Tihan Limited is reported to have removed 2,169.5 litres of Bubblez vodka without stamps and with a tax liability of Sh379, 662.5. Cryan Limited is reported to have removed 2, 529 litres of Kingstone Vodka with a tax liability of Shs442, 680. Kedsta Investments reportedly removed 1, 705 litres of Shujaa gin with a tax liability of Sh298, 375.

In September, the Authority introduced a smartphone application dubbed ‘Soma Label’ that verifies whether an excise stamp on excisable products such as beer, cigarettes and wine is genuine and if the products are from a licensed manufacturer. KK invests in dog training and canine centre amid rising cases of insecurity Rising cases of insecurity in the country have prompted private firm, KK Security to invest in dog training and handling capacity as it plans to expand its canine centre. The security firm also plans to tap into the increasing market demand for security dog services.

Dr. Steve Ndurumo, Group Manager for the firm’s K9 unit said the investment is expected to raise the standards of security dog handling in the region.

The firm, which provides security solutions for commercial, residential, diplomatic, agricultural and construction sites, plans to train handlers with skills in dynamics of crime and security as per international standards prescribed by the National Association of Security Dog Users (NASDU) of the United Kingdom. This is being done through a collaboration with Malpeet K9 Academy in Wales,

where dog handlers and their dogs are trained.

The company has a specialised unit of dogs at its K9 Centre with the capacity to detect explosives in buildings, cars, luggage and open areas. Kenya has frequently faced terror threats targeting the general public and institutions, igniting the demand for explosives detection dogs to complement existing security systems in the country.

“We want to enhance our standards where detection dogs are reliable physical and psychological deterrents when teamed up with good handlers to ensure successful identification of harmful devices”, Dr. Ndurumo said.

He added that security evolves every day with criminals becoming more elusive.

“There is need to diverse resources by use of security dogs which are now adapting well to these changes”,

he explained.

Currently, the company has more than 500 dogs and plans to increase the capacity of its canine centre for a breeding programme to supplement the supply of imported dogs.

The Boerboel (South African Mastiff), imported from South Africa, is the company’s choice for General Purpose / Patrol use.

Government moves to deepen trade relations with Turkey

Kenya’s government has unveiled plans to deepen trade relations with Turkey.

Cabinet Secretary for the Ministry of Industry, Trade and Cooperatives, Adan Mohamed held a meeting with the Chairman of the Turkey Exporters Association on the sidelines of the Turkey-Africa Business Forum.

The Turkey-Africa Economic and Business Forum (TABEF 2016), which ends today, was held under the auspices of H.E. Recep Tayyip Erdogan, President of the Republic of Turkey at Istanbul Lutfi Kirdar ICEC in Istanbul from November 2 to 3, 2016. The Forum was jointly organized by the Ministry of Economy of the Republic of Turkey, African Union (AU), the Foreign Economic Relations Board (DEIK) and Turkish Exporters Assembly (TIM).

“I urged Turkish exporters to explore production in our country to serve Kenya and the greater EAC market,” Mohammed said.

Speaking on the sidelines of the Forum, the CS confirmed that Turkish Exporters Association representatives are exploring opening a Turkish Trade Center in Kenya.

During the recently-concluded fourth meeting of the Tripartite Council of Ministers in Nairobi, Mohamed had confirmed plans for Kenya to be part of a 26 member Tripartite Free Trade Area (TFTA) agreement.

He said the agreement would enhance intra-regional trade while attracting more investment and boosting production and competitiveness.

His more recent sentiments come just days after the Kenya Tourism Board and the Departmental Committee on

Budgets, Planning &Trade held what stakeholders have termed a fruitful interactive session with an emphasis on synergies. Tourism Cabinet Secretary, Najib Balala last week led key private sector players in discussing areas of synergy towards promotion of tourism.

The CS has been working round the clock to revitalize the tourism sector and has already announced

government plans to deepen bilateral ties with foreign partners.

Mohamed’s remarks also follow Kenya’s recent winning of a bid to host the Skal International Congress in Mombasa, in year 2018.

CS Balala and CS Mohamed last week announced a new plan and task force to support Kenya’s tourism sector.

The country’s real estate sector has seen a spike in nonperforming loans (NPLs) as creditors defaulted on mortgages worth Sh12 billion as of March 2016.

This resulted in the value of nonperforming loans hitting 7.8 per cent of Gross Domestic Product (GDP) in the period under review, up from the former 6.8 per cent experienced during the same period last year.

Data from the Central Bank of Kenya (CBK) indicates that nonperforming loans on trade rose to Sh4 billion while the manufacturing sector recorded NPLs worth Sh3 billion.

In its ‘Kenya Economic Update’ report, the World Bank, attributes the spike to changes in accounting guidelines by the CBK requiring banks, to appropriately record their provisioning for loan losses, rather than a real structural break in the ability of corporate and households to pay back loans.

“Nonetheless it draws attention to the need to monitor much closely as there could be other economic factors at work including lagged effects from the macro turbulence experienced in the third quarter of 2015,” stated the report.

The World Bank also raised concerns over delays in payments from the exchequer that could be playing a contributory role.

The country experienced tight liquidity conditions with the placement of two commercial banks under receivership in the second half of 2015 and a third bank in the second quarter of 2016.

This created a liquidity freeze among lenders keen to minimize further exposures and to enhance recovery of existing loans. It resulted in a significant fall in credit which was accompanied by a sharp increase in non-performing loans.

At the same time, the growth of credit to the private sector is slowing down.

CBK statistics for June 2016 indicate that private sector lending growth slowed down to 7 per cent compared to a growth of 15 per cent in 2015.

The regulator states that nonperforming loans increased by 36.04 per cent to Sh147.3 billion in December 2015, with the ratio of gross NPLs to gross loans at 6.8 percent in December 2015 from 5.4 per cent in December 2014.

A requiem mass has today been conducted in honour of fallen legendary songstress Lydia Achieng Abura in Nairobi. The mass held at the all saints cathedral church saw the songstress eulogized and mourned by songs and instruments by artistes in the Kenyan music industry and beyond.

Match fixing claims rock Ingwe ahead of crucial league tie against Tusker THURSDAY, NOVEMBER 3, 2016

In the wake of wide spread match fixing accusations, Kenyan Premier League (KPL) giants AFC Leopards have terminated the contracts of four senior players ahead of this weekend’s league match against Tusker FC. The biggest causality is top scorer Kepha Aswani who besides being suspected to have played a role in determining the outcome of some key matches has also been accused of gross indiscipline.

Club chairman Dan Mule confirmed last evening the club took the decisive action ahead of their crunch encounter against the league leaders on Sunday after what officials believed was a deliberate attempt to sell the game to their title-chasing rivals.

Edwin Wafula, keeper Lucas Indeche, Yusuf Juma and Aswani, who has scored 13 league goals this season to share the lead in the race for the Golden Boot with Ulinzi Stars’ John Makwatta, have been given 14 days to appeal the decision to the Disciplinary Committee of the club.

“The action has been taken due to indiscipline cases as some have been inciting others not to attend training while others have been affected because of under-performance,” Mule declared.

He however said that Leopards have enough players for head coach Stewart Hall to select for Sunday’s match at the Afraha Stadium in Nakuru.

Tusker need just a win to be declared league Champions as they currently lead second placed Gor Mahia by four points with two matches to go.

The match in Nakuru is therefore crucial in deciding the fate of the title.

“There are some things that we are still investigating and so it’s just prudent for us to take strict measures to ensure fair play come Sunday,” Mule maintained.

Club Secretary, Timothy Lirumbi was more forthright alleging the affected players were spotted with their Tusker peers with the team ordering them to keep away from Ingwe facilities including the training ground.

Manchester United manager Jose Mourinho (pictured above) has been banned for one match and fined £58,000 for two separate offences.

The Portuguese was sent to the stands by referee Mark Clattenburg for an incident “in or around the tunnel area during half-time” of Saturday’s goalless draw with Burnley.

He will serve a touchline ban for the game against Swansea on Sunday and will have to pay an £8,000 fine.

He was also fined £50,000 for comments he made about referee Anthony Taylor.

The United boss said it would be “difficult” for Taylor to officiate their game with Liverpool prior to the match at Anfield on 17 October.

Managers are not supposed to speak about referees prior to matches, but Mourinho added that appointing Taylor for the Liverpool match had put “pressure” on the Manchester-based official.

An FA statement said Mourinho accepted that the comments “constituted improper conduct, but denied they brought the game into disrepute”.

However, an independent regulatory commission “found the disrepute element of the charge proven and as well as being fined, Mourinho was warned as to his future conduct”.

Mourinho “admitted using abusive and/or insulting words towards a match official and accepted the standard penalty”, following the incident against Burnley on 29 October, Mourinho appeared to be upset when United were not awarded a penalty during Saturday’s match, after Jon Flanagan challenged Matteo Darmian inside the Burnley box.

The 53-year-old emerged for the second half during the match but was escorted to a seat in the stands before being moved a second time, this time to the directors’ box. He declined to speak to the media after the match.

He was given a one match-stadium ban last season when he was in charge of Chelsea.

Southampton warry of Inter

Southampton manager Claude Puel said it is “difficult to prepare” for tonight’s Europa League match against Inter Milan after the Italians sacked manager Frank de Boer on Tuesday.

Youth team coach Stefano Vecchi will take charge of Inter at St Mary’s.

Puel said: “We don’t know what to expect from Inter now. We now have to show more concentration.”

Southampton will be without striker Shane Long and fullback Cedric Soares who are still injured.

Jeremy Pied, Matt Targett, Alex McCarthy, Jake Hesketh, and Harrison Reed are also out.

Two weeks ago, Inter won the reverse fixture 1-0 thanks to Antonio Candreva’s goal.

Arsenal’s Sanchez accused of tax fraud

A

rsenal forward Alexis Sanchez has been accused of committing tax fraud in Spain when he was a Barcelona player.

Prosecutors in Barcelona allege the 27-year-old failed to pay tax on 983,443 euros (about Sh111 million) between 2012 and 2013.

They say the Chile international used an offshore company in Malta to avoid paying tax on image rights earnings.

A statement published by his agent said: “Alexis Sanchez has fully obeyed the laws imposed by the countries where he has resided.” It added: “He has paid taxes to all the local tax and revenue organisations.

Furthermore, all of his personal and image rights income has been declared to all of those national tax and revenue agencies.”

Sanchez joined Arsenal from Barcelona for £35m in 2014.

Spurs left hanging, Leicester edge closer Tottenham’s Champions League hopes are now in real danger as they slumped to another damaging home defeat by Bayer Leverkusen at Wembley last night while Leicester held Copenhagen away in Denmark to edge closer to the knock out stages.

Kevin Kampl’s cool 65th-minute finish condemned Spurs to a second-successive loss in this competition at their temporary home while White Hart Lane is being rebuilt.

Spurs now lie third in Group E behind Monaco and Bayer Leverkusen and are under serious threat of failing to reach the knockout phase with two games left away to the French side and at home to CSKA Moscow.

Leverkusen were the livelier side throughout as Spurs desperately missed injured forward Harry Kane. Former Manchester United striker Javier Hernandez came close in the first half and forced a save from Spurs keeper Hugo Lloris at the end.

Spurs offered a rally of sorts after they went behind, with Kyle Walker shooting wide and Eric Dier hitting the bar with a late free-kick, but the jeers at the final whistle told their own story.

Spurs cannot complain about lack of support at their temporary Champions League home, they just cannot win any games there.

It was their sixth-successive loss at Wembley, including domestic games, and another damaging loss on the back of their opening reverse against Monaco.

The French side won 3-0 at home against CSKA Moscow with Radamel Falcao scoring a double as the principality side made a big step towards a last 16.

The Colombia striker struck his 41st and 42nd goals from 46 matches in UEFA club competitions in the first half after Valere Germain’s opener to put the Ligue 1 team on eight points from four games.

Bayer Leverkusen are second in the group while Spurs lie third on four points with CSKA in bottom place with two points.

Tottenham could not be criticised for lack of effort but they lacked a spark, and most obviously lack a marksman with England striker Kane still not fit to return against Bayer Leverkusen.

Before kick-off, they had been without Kane for

813 minutes in all competitions since he came off injured against Sunderland on 18 September.

They have scored 13 times in that period, five of which came against Gillingham in the EFL Cup. Spurs can still reach the Champions League knockout phase, but another dismal Wembley display means they have made life very difficult for themselves.

Meanwhile, Premier League champions Leicester edged closer to the knockout stages, thanks to a goalless draw at FC Copenhagen.

The best chance of a lacklustre match came in the 90th minute as Leicester goalkeeper Kasper Schmeichel pushed away Andreas Cornelius’s header.

The closest the visitors came to scoring was when winger Jeffrey Schlupp’s deflected shot dribbled into the hands of keeper Robin Olsen.

Claudio Ranieri’s Leicester, who won their opening three Group G games, need only a point from their final two matches to reach the last 16.

They have not conceded a goal in four games and remain top of the group, three points ahead of Porto who lie in second.
