MPs panel warns Mailu A parliamentary watchdog committee has warned Health Cabinet Secretary Cleopas Mailu that he risks being surcharged for misusing public resources, if goes ahead and hires external auditors to go through the ministry’s book of accounts following reports that some Sh5.3 billion have gone missing. Dr Mailu said early this week that an external auditor will be hired to examine the finance records at the ministry after an internal audit report queried the use of the funds. But the National Assembly’s Public Accounts Committee argues that the minister will be violating the Constitution by inviting external auditors.

MPs warn Mailu against external auditor hiring

From Page 1 The committee now says that he should be prepared to pay for the services should he go ahead and invite the auditors. “If he goes ahead and does it, we as the PAC will ensure he is personally surcharged of any of the costs incurred,” Committee chairman Nicholas Gumbo said. Gumbo reckoned that inviting an independent auditor will be illegal for any government institution. “Such an action clearly violates provisions of Article 226 (3) of the Constitution. Under the law, only the Auditor General is mandated to audit government accounts,” he added. According to the constitution Article 226 (4), only the office of the Auditor General Dr. Edward Ouko is mandated to audit government expenditure. Gumbo further warned that such action could lead to Dr Mailu’s impeachment as a Cabinet Secretary. Mailu had at the weekend said the ministry would call in independent auditors to verify claims the ministry had lost Sh3.1 billion. He accused the ministry’s internal auditor of leaking an incomplete report to the media, when the management had not responded to the queries raised. The opposition have already expressed fears that by inviting an external auditor the government would be trying to cover up the alleged scandal. any other audit apart from the one to be done by the Auditor General, once the internal audit is complete. On Wednesday, Narc party leader Martha Karua said the conflicting statements by Dr Mailu and his Principal Secretary Nicholas Muraguri was a clear indication of a cover up of the alleged scandal. “We find the statement by CS Health Mailu very disappointing, inconsistent

and symptomatic of a cover up, including his indication to hire a private external auditor at a public expense,” Karua said. “We remind him that the office of the Auditor General has only one client, namely the government of Kenya. To the best of our knowledge, the ministry is yet to seek the help and service of the auditor General,” she added. @hillary_x254

Senators push to amend law and clip governors powers on county spending

A senate committee wants the Public Finance Management (Amendment) Act amended to remove the gaps that they claim have allowed governors to spend up to 50 per cent of the county allocations without the approval of their respective county assemblies. Senate Finance Committee say that County Executives have identified the gap in the law and are now exploiting it to embezzle public funds in the devolved units. In meeting with National Treasury Cabinet Secretary Henry Rotich at County Hall yesterday, senators lamented that the provision has been exploited by the county governments to disburse 50 per cent of the total revenue before even the Division of Revenue Bill is passed. They are now demanding that an amendment by the CS be proposed to the National Assembly to delete the clause. “It is unconstitutional, counties should not operate independently and it is only Parliament that has powers to allocate public funds through the budget process,” Senate Finance Committee chairman Senator Billow Kerrow said. He said the law creates unnecessary avenues for governors to use public resources to push for individual interests. “Section 25 caps the counties to increase their budget by seven per cent, while 37 restricts the counties to increase by one per cent on what the national government has agreed to allocate. This is against the constitution,” he lamented. Kerrow, who is also Mandera Senator, said the county executive uses the sections to dictate county investments, without residents’ participation. In his response, Rotich defended the amendments, saying they provide opportunity for the county governments to continue with their activities in a new financial year, when funds from the national government are delayed. “I consulted the Attorney General and he saw this as a good idea so MCAs cannot hold voters to ransom when they delay to pass bills to approve the Budget,” Rotich said. However, Senator Moses Wetang’ula, a member of the committee, dismissed the argument terming the advice clumsy. “They failed the nation on Anglo Leasing and have also failed it on many other issues. That’s why all the laws from that office are mischievous,” said Wetangula, who is also the Minority leader. The committee asked Rotich to communicate back “within the shortest time possible” when they will amend or delete the sections. @hillary_x254

President Uhuru Kenyatta has told diplomats to back Kenya’s Foreign Affairs Cabinet Secretary Amina Mohamed for the position of African Union (AU) chairperson saying she is a person of who can bring people together. Mr Kenyatta who met with the diplomats at State House last fronted Ms Mohammed as a consensus builder that the African Union requires. “She is an individual who brings people together. She is an individual who is organized and will help us organize the African Union. She is a lady of courage and valor,” said President Kenyatta. The President said he nominated Mohammed after wide consultations with many other African Heads of State and Governments and believes that her candidature will promote African consensus. Speaking at the event, the CS said she will strive to ensure that Africa’s dignity is never tampered with if she gets elected as the chairperson of the AU Commission. She said she would ensure the African Union delivers a better life for Africans. “We (Africans) have been politically emancipated. We are working hard to ensure we are economically emancipated. We also need to ensure that our institutions, systems and mechanisms are emancipated and that

is what I hope you will allow me to work on,” she said. Amb Amina said Africa needs to speak with consensus in order for its voice to be heard and respected internationally. “We have to start talking about ourselves as Africans because that is how the world sees us,” she said. The Foreign Affairs and International Trade CS said she will bring to the AU the experience she has built in her years as a public servant in Kenya and as a senior

official of the United Nations. She cited President Uhuru’s advocacy for Africa’s integration and the fight Kenya spearheaded for Africa to be respected by institutions dealing with international justice. “If we act collectively we will be able to deliver for the continent,” said Amb Amina. Rights body calls for action against police The Kenya National Human Rights Commission wants the Inspector General of Police to initiate a disciplinary action against police officers who forcibly dispersed a peaceful anti-corruption protest in Uhuru Park on Thursday. The commission is a statement complains that the Police contravened the rights of the protesters after they violently dispersed them before they even kicked off their demonstrations. The Commission chairperson Kagwiria Mbogori says the protesters were not unruly or armed to deserve such a treatment from the Police. “The Commission is concerned at the conduct of police officers that led to the forceful dispersal of the demonstrators and the arbitrary and brutal arrest of 10 of them,” she asserts. “This uncalled for violence was extended to other members of the public who were innocently undertaking their daily businesses bringing the business to a standstill. Journalists and other members of the public who were caught in the mix were also attacked; a move Mbogori says was in blatant breach of the Constitution. “This is in clear contravention of contravention of Article 37 of the Constitution of Kenya that guarantees every person the right to peaceably and unarmed, to assemble, demonstrate, to

picket and present petitions to public authorities,” she pointed out. Police turned their guns on a group of about 30 local and international journalists, who were covering the protests. The group was violently dispersed as soon as they started marching towards Kenyatta Avenue roundabout. Earlier on before they were dispersed, Kenya Human Rights Commission Deputy Director Davis Malombe urged the President to dismiss all corrupt Government officials among other 14 demands detailed in a petition they were to hand over to the Office of the President. They called on President Uhuru Kenyatta to dismiss all public officers mentioned in any corrupt dealing as a starter. “We want the President to act now…he has powers to tame these people (the corrupt),” he stated. Other recommendations are that the President protects whistle-blowers since they are more than often attacked according to Malombe and when money is recovered, they want 20 per cent to be given to them. Assuming the Sh5 billion in the Ministry of Health was embezzled their recommendation is that the whistle blower should get 20 per cent of the amount and in this case it will be Sh1 billion.

Six months in jail for circumcision stigma

Men who tease their male counterparts that they married uncircumcised women will be liable to a fine of Sh50,000 or six months in jail, if a proposed law by the anti-female genital mutilation board is adopted. Anti-FGM board chairperson Jebii Kilimo said the proposed law also applied to women who teased their counterparts as the body moves to reign in stigma associated with the condemned tradition. Ms Kilimo has also said they will partner with the National Gender and Equality Commission in fighting the retrogressive cultural practice that has continued to dehumanize the girl child. “The new law suggests that those who tease each other especially for me that their spouses are not circumcised will be fined up to Sh 50,000 or six months in jail,” said Kilimo. Speaking at the NGEC’s headquarters where she met with the gender based violence sub cluster working group, Kilimo sought the support of the stakeholders to support the new institution as it embarks on a comprehensive plan to root out female genital cutting. The former Marakwet East legislator is an avid crusader against Female Genital Mutilation (FGM) and is credited for pushing for Kenya’s Anti FGM Bill 2011 which criminalises FGM. She said her board will begin by setting up a secretariat to facilitate the rolling out of programs to address FGM especially in communities where the practice is rampant. @wilson_x254

2 APs in hospital after opening fire on each other in Bomet Two Administration Police officers are admitted to hospital after they shot at each other while guarding the just concluded Kenya Certificate of Primary Education (KCPE) exams in Bomet. The two were deployed to guard a container with KCPE examinations at the Sub County Commissioner’s office when they opened fire on each other after an argument. Both were armed with G3 rifles and are now admitted to

the Tenwek Mission Hospital. According to police, an investigation has been launched to establish the cause of the incident in which they are likely to face charges once out of hospital. The examinations came to an end on Thursday with Education Cabinet Secretary saying special measures have been put in place to ensure the marking is above board. He said the process must be done the right way to promote

credibility and fairness. Matiang’i indicated that no examination leakages have occurred, attributing the outcome to the new system of administering exams. onald Trump and Hillary Clinton have made renewed attacks on each other’s fitness for office as polls suggest the race for the White House is tightening. Mrs Clinton, who has seen her national opinion poll lead shrink in recent days, targeted her Republican rival’s temperament and attitude to women. Mr Trump said she would be followed into the White House by criminal investigations. He has gained ground on Mrs Clinton in some swing states, polls suggest. Thursday’s campaigning included a rare appearance by Mr Trump’s wife Melania. In her first speech since July’s Republican convention, the former model spoke about being an immigrant and a mother and said her husband would “make America fair”. She also vowed, in a speech in the Philadelphia suburbs, to lead a campaign against cyber-bullying if she becomes first lady, and to combat a culture that has “gotten too mean and too rough”. She made no reference to her husband’s record of name-calling on social media. Mr Trump has gained ground on Mrs Clinton in a number of swing states, including Florida and North Carolina, according to polls. Some national tracker polls are now suggesting the two candidates are neckand-neck. The Reuters/Ipsos States of the Nation project estimates Mrs Clinton’s odds of winning the necessary 270 Electoral College votes on Tuesday at about 90%, down from 95% last week. The momentum appears to be with Mr Trump, who has joked about having to stay on message, as the final weekend of campaigning approaches. He has capitalised on a new FBI investigation into a Clinton aide’s emails. “Here we go again with the Clintons - you remember the impeachment and the problems,” Mr Trump said at a rally in Jacksonville, Florida, his fourth appearance in the state. “That’s not what we need in our country, folks. We need someone who is ready to go to work.” Later, at a night-time rally in North Carolina, he delivered a speech on defence in which he said he could not imagine Mrs Clinton as commander-in-chief. Mrs Clinton continued to focus on Mr Trump’s character, telling a rally in North Carolina: “He has spent this entire campaign offering a dog whistle to his most hateful supporters. “This has never happened to a nominee of a major party.” She added: “If Donald Trump were to win this election we would have a commander-in-chief who is completely out of his depth and whose ideas are incredibly dangerous.” President Barack Obama has been working almost as hard as Mrs Clinton, as he attempts to rally support among young voters and African Americans. Analysis of early voting returns suggests black voters may not be turning out in the kinds of numbers they did for Obama in 2012. Alluding to Mr Trump’s past as a reality TV show host, Mr Obama told students at Florida International University in Miami: “This isn’t a joke. This isn’t Survivor. This isn’t The Bachelorette. This counts.” Mrs Clinton also got a boost from her one-time rival for the Democratic nomination, Bernie Sanders. He appeared alongside her at a rally in North Carolina on Thursday evening, praising her commitment to increasing the minimum wage and tackling inequality. Music star Pharrell Williams was also at the event, hailing Mrs Clinton’s record on women’s rights.

Safaricom’s earnings hit Sh50 billion as telco adopts 9 SDGs Safaricom, Kenya’s biggest mobile phone service provider by market share, has seen its earnings before interest, tax, depreciation and amortization (EBITDA) for the first half of the year jump 30.8 per cent to reach Sh50.8 billion. During the same period the telco’s net income reached Sh23.9 billion, Chief Financial Officer Sateesh Kamath told an investor briefing in Nairobi. Revenue from M-Pesa, the company’s mobile money service, jumped 33.7 per cent to reach Sh25.9 billion up from Sh19.35 billion the previous year. The figures cover the period from April 1 to September 30. Announcing its results earlier this morning, Safaricom unveiled a new service dubbed M-PESA kadogo based on customer feedback. The service will ensure that all Person-toPerson (P2P) transfers and Lipa Na M-PESA transactions below Sh100 will be free. “Safaricom’s success is the result of its connection with Kenyans, which is critical to the Kenyan economy,” company CEO, Bob Collymore said in a statement issued this morning. He noted that the firm’s service revenue was up 15.4 per cent to Sh98 billion. Meanwhile, mobile data was up 46.3 per cent while voice revenue jumped 1.1 per cent. “We adopted nine out of the 17 Sustainable Development Goals (SGDs) to help guide our company into the next phase of its growth,” he explained.

Unstable rainfall threatens agriculture sector’s stability, new report warns Uneven rainfall and unstable weather patterns may have adverse effects on the country’s agriculture sector, experts have warned. This is according to the Stanbic Bank Purchasing Managers’ Index (PMI). “We remain cautious about agriculture output over the coming months owing to weather reports of uneven rainfall in the key food growing counties. Moreover, the slowdown in private sector credit growth also poses as a downside risk to the promise of the private sector,” stated the report. The Index has also revealed that Kenya’s private sector eased to a fourmonth low in October on cooling off of consumer demand. During the period under review, business conditions improved only modestly, with output and new orders rising at relatively subdued rates. The pace of growth in new work, however, remained healthy overall,

modest and in line with the overall improvement in business conditions. Activity had risen at the fastest pace since February during September, but the latest increase was the least marked in four months. New business rose at a comparatively sharp pace in October. However, the rate of growth was also the weakest in four months and below the series average. Rising exports contributed to the expansion of total new work. The respective index climbed to a sixmonth high. The overall improvement in demand was sufficient to lead to another marked rise in purchasing activity during October. The pace of expansion eased only slightly from September’s sevenmonth high. Input also eased, rising at a slower but still robust rate. Likewise, the rate of job creation remained close to that seen in September.

State to set up sharia board as Kenya embraces Islamic banking Kenya’s government is set to establish a national sharia board as the country continues to embrace Islamic banking services. The move will likely set Kenya ahead of other African countries aiming to develop the sector. The state’s plans to develop Islamic finance will include a wide-ranging taxation review and the establishment of a national sharia board in a bid to build up the industry as part of a long-term plan to turn Nairobi into an international financial centre. It will also serve as a way to help finance infrastructure projects by building commercial links across Africa and the Middle East. These initiatives are being led by the Islamic Finance Project Management Office (PMO), a body setup recently to coordinate efforts among Kenya’s regulatory agencies. Farrukh Raza, Managing Director of IFAAS, an Islamic finance consultancy which designed the PMO’s framework, has said the PMO has submitted an initial set of policy amendments focused on taxation of sharia-compliant products, said “This will be the first precursor to overall industry development by giving legal recognition to Islamic finance transactions,” Raza said. The move seeks to ensure neutrality of Islamic contracts in areas such as stamp duty and withholding tax, with the proposed amendments to be included in a finance bill to be presented to the parliament next year, he added. Islamic banks have traditionally practiced self-regulation in terms of their adherence to religious principles, but a centralised approach is gaining traction to help standardise contracts and address consumer perception concerns.

Eutelsat puts broadband plan back on track as firm recovers from September explosion Eutelsat Communications and Yahsat, the Abu Dhabi-based international satellite operator, have signed a multi-year capacity agreement giving Broadband for Africa - Eutelsat’s African broadband venture - access to high-performance commercial broadband services across Sub-Saharan Africa. The terms of the agreement stipulate that Broadband for Africa will use the added capacity from Yahsat to roll out broadband services ideal for community and Direct-to-User Internet access. Value of Equitel mobile transactions hits Sh250 billion in quarter 3 of 2016

Equitel more than doubled the number of transactions the mobile platform processed in the third quarter of 2016 when compared with a similar period a year before. Equitel processed 150.8 million transactions in the third quarter of 2016 up from 62.2 million a year earlier, representing a 142 per cent increase. The value of transactions over the same period increased by 476 per cent to stand at Sh250.8 billion up from Sh43.6 billion. “The Bank’s early and continuing investment in technology as well as its committed progressive transitioning from the traditional heavy fixed cost based brick and mortar operation to an increasingly digital driven variable cost based model aligns perfectly with the observed changing preferences by banking sector customers,” said Equity in a statement. Kenya Re unveils plan to set up Zambia hub in mid November

ow has this season’s process been like compared to the previous years’? I feel like this season had definitely been more relaxed than the previous seasons. For one, I’ll be here for three weeks, the other times I was here for a week each time. Before we would compose, rehearse and shoot all at once and it was hectic, now we get a day to write the song, two days to rehearse and the rest of the days to shoot. You usually work with artistes from all over the continent, how do you fuse all their collective sounds and your own sound together? I usually have to do a lot of prep work before sitting down with the artistes. I listen to their music extensively then start to get ideas about how they would sound together. It’s a lot of work but if you love it then it’s not work. What would you describe your own sound like? Hip hop, Afro beat with a little bit of dancehall in there. A little bit of everything. Where do you usually find inspiration from while crafting music?

Kane returns for London derby Tottenham striker Harry Kane could make his long-awaited return to action in the derby with Arsenal on Sunday. Tusker expecting no favours from Ingwe Paul Nkata, the Tusker FC coach is not expecting any kind of favours from AFC Leopards when the two sides lock horns at the Afraha Stadium in Nakuru on Sunday, in a match that will determine the destiny of this season’s KPL title. Tusker who occupy the apex of the log can win the title with three points against AFC Leopards, arch rivals to second placed defending champions Gor Mahia. “It is not going to be an easy match and I don’t expect any favour from them. We will approach that match just like we have done in all the other 27 matches we have played, with seriousness and we will give our all,” Nkata told Capital Sport. Gor will be cheering on their arch rivals against Tusker as a drop in points by the brewers in that match coupled with a win for K’Ogalo against Muhoroni Youth will mean the final game of the season pitting Gor and Tusker will determine the winners of this season’s title. Nkata is keeping his cool even as the brewers put champagne on ice and says it is not over until it is over hoping the side does not drop the pot at the doorstep. “I am excited of course because I am on the brink of history. I am proud of

the boys and what they have done but it is not over until it is over. We have to go into that match with our heads cool and hopefully, we finish the job then,” Nkata added.
