Why nurses reneged on return to work deal A

power tussle among the top officials of the nurses’ union is the reason the medics have disowned a return to work agreement that would have seen them end their work boycott. The nurses reportedly signed the deal with the government on Sunday but Kenya National Union of Nurses (KNUN) Secretary General Seth Panyako swiftly disowned it. KNUN chairman John Bii, Deputy Secretary Maurice Opetu and assistant Chief Trustee Alice Oreng signed the Collective Bargaining Agreement (CBA) to call off the strike in the absentia of the Secretary-General who is constitutionally mandated to call off any industrial action. Mr Panyako yesterday rubbished the deal saying the three officials were not mandated to sign any agreements binding the union on the strike matter. He said calling off a strike is his sole responsibility and can only delegated to other union officials in writing in line with Section 2(a) of the Labour Relations Act. “One of us can move to court and challenge the deal and it will be thrown out,” he said after attending NGC at railways club. Panyako said the officials acted in greed and went against his advice not to sign the deal. Mr Panyako, together with other top officials who sit on both the national executive council and the top NGC, disowned the Sunday deal. CONTINUED ON PAGE 2

Why nurses disowned deal TUESDAY, DECEMBER 13, 2016

“The NGC has unanimously decided the strike is still on and has not been called off,” said Panyako, who read the National Governing Council’s statement said. X news, has established that NGC rejected the new pay hike worth Sh7 billion after they realised that it did not meet the union’s expectations. The return-to-work deal signed on Sunday in Nairobi follows week-long negotiations between the ministry KNUN officials since the strike began last week. In the deal, it was agreed that nurses will receive allowances of between Sh15,000 to Sh20,000. But in an interview with X News, Mr Bii accused Panyako of being dishonest, full of greed and of having personal vendetta against some officials of the union. He held that that prior to the signing of the agreement, Mr Panyako had personally authored the document that was later signed by the three top officials after he failed to turn up at Afya House to ink the deal on behalf of the nurses. He said the Secretary General had promised to be present at the signing of the return-to-work deal at Afya House but did not show up after switching off his phone. “Come December 11, the SG (Panyako) was nowhere to be found. He called afterwards quarrelling with everybody that he had instructed us to switch off our phones. This was a lie. He kept everybody guessing until we made the bold decision to suspend the strike to save the image of the union,” Bii disclosed. Bii, himself a trained nurse with 20 years of experience, gave the revelations a day after the SG accused

them of receiving hand-outs to call off the strike. The disagreements among the top officials have split the union into two camps, with Panyako’s group insisting that the strike is on even as Bii’s group declared it over. Mr Bii said members who do not resume work have only themselves to blame. “We have had numerous strikes, which have been called by the national executive council or the general secretary. In the absence of the general secretary, his deputy has absolute powers to call on or off the strikes,” Bii said. With the strike continuing into its second week, the Labour court has summoned the officials of the Kenya Medical Practitioners, Pharmacists and Dentists Union to appear before

it over the current stalemate. Judge Hellen Wasilwa had directed the Kilimani OCS to assist in serving the officials with the orders. The directions were issued after the Council of Governors moved to court against the union arguing that the medical practitioners have proceeded to go on an unlawful and unprotected strike thereby gravely affecting the health and wellbeing of patients. They had asked the court to commit the officials to civil jail for six months and those named in the petition include the chairman of the union Samuel Oroko Obegi among other officials. Meanwhile, Mr Panyako demanded that all cases against officials of the nurses’ union be withdrawn before they can suspend the strike. “We are ready to suspend the strike,

but not stop it completely,” Panyako said, adding that the Collective Bargaining Agreement must be completed by March 2 next year. The return-to-work deal signed on Sunday in Nairobi offered nurses an annual payout of Sh20,000 for those between Job groups G-L and Sh15,000 for nurses in Job Groups M and above. Sixty per cent of it will be paid in January next year and the remainder on July 1 next year. Mailu said the pay rise will cost the government Sh7 billion annually. Nurses have been asking for up to 50 per cent pay rise, new allowances and harmonisation of their grading scales. This would push the basic salary of the lowest paid nurse to Sh32,000.

Uhuru cautions foreign missions on 2017 polls President Uhuru Kenyatta has cautioned foreign countries against influencing the 2017 General Election through suspicious funding to some civil society organisations. Addressing Kenyans during the 53rd Jamhuri Day celebrations, the President said the government will not allow any external influence by foreign missions saying Kenyans must be allowed to decide the leaders they want. “There is already money coming from abroad in the guise of promoting good governance or civic education, however its true intention is to influence our electoral choice,” the President said. “I want to caution those members of the International Community taking these actions that Kenyan people do not look kindly on such actions. I urge all Kenyans to reject such interference, this is our country and no one should ever control our choices for their own selfish interest.” “Our fathers and mothers faced an empire that could import soldiers by the thousands and guns by the tone and yet because they were united, not even their might that could keep them in bondage.” He asked the said countries to support the Independent Boundaries and Electoral Commission instead, if they want to sensitize Kenyans on the need to vote. “Kenyans are the one to decide…they should not interfere with our process. Kenyans are learned,” the President said. The President has also cautioned leaders against using divisive politics to woo voters, saying the country cannot afford to slide back to its dark days of 2007-2008 post election violence, which claimed more than 1,000 lives and 600,00 people internally displaced.

Mudavadi faults President Kenyatta on Jamhuri Day speech Amani National Congress (ANC) party leader Musalia Mudavadi has criticized President Uhuru Kenyatta saying he failed to address key issues affecting Kenyans in his Jamhuri Day speech yesterday. Mudavadi said a poor economy and unprecedented public borrowing locking out the private sector, increasing interest rates and high inflation are the issues the President ought to have addressed ‘rather than fume at the ICC and civil society’. He added that it was curious the head of state evaded the mention of the

flopped free laptops for pupils and the stuttering SGR line in the list of Jubilee achievements that the he counted. “That is a clear indication we will soon be saddled with a white elephant SGR railway – incomplete, unviable and uneconomical,” Mudavadi said the he expected President Kenyatta to personally renounce corruption that has dogged his administration in its first term in office. “I listened to the President’s speech with shock: It wasn’t just a boring recitation of Jubilee failures as

success; the President seems to believe in the deceitful “we have set aside” philosophy that is used by his government to hide incompetence. Under this philosophy, the President reels off figures in the billions only his imagination can conjure up because poor Kenyans don’t see or feel what these billions are doing,” Mudavadi said “And that is why I expected the President to personally disavow corruption. But, true to character, having washed his hands of the war on corruption, he virtually avoided all

mention of it. Not strangely, he said the theft at the NYS was a “challenge” that has instead helped NYS achievements,” Mudavadi who lost to Mr Kenyatta in the 2013 elections added. While addressing Kenyans from Nyayo Stadium during the ecelebrations, President Kenyatta said despite the corruption allegations that has dogged the National Youth Service, the programme has delivered some clear successes. “As we seek to empower our youth, I will not shy away from making reference to the National Youth

Service. Despite the challenges that our NYS programme has faced, it has delivered some clear successes,” he said. He assured Kenyans that all those involved in pilfering resources earmarked for the youth will be held to account. “I would like to urge Kenyans to draw a clear distinction between the positive impact of the NYS Programme and the deplorable mismanagement of the past orchestrated by individuals who were determined to railroad its success,” the President said. @samx254

Families of Naivasha crash victims to wait for two weeks as death toll climbs to 42 TUESDAY, DECEMBER 13, 2016

The families of those killed in the Naivasha tragedy will have to wait for two weeks before they can bury their loved ones. This is to allow for DNA test to be carried out on all the bodies to ensure they are properly identified. The request was made even as the death toll from the tragedy rose to 42 after more casualties succumbed to their injuries in hospital. One victim with over 80 per cent burns succumbed to injuries early on Sunday, while the other passed away on Monday at the Nairobi and Kenyatta National Hospitals respectively. Most family members are currently at Chiromo Mortuary where they are first undergoing a counselling session, as the identification exercise begins. Postmortem by the government pathologist began today at as collection of more DNA samples from relatives continued. On Monday, a total of 18 DNA samples had been taken from families of the deceased and relatives. Results will be received after two weeks. One of the five identifiable bodies has been claimed from the mortuary by family members. The remaining 29 bodies burnt beyond recognition will only be identified by DNA test. Priority for collection of DNA samples are mothers and children to the deceased. More

than 263 people were given counseling support to help them deal with the aftermath of the horrific incident. Multi-agency support teams at Chiromo Mortuary are seeking donations of foods and refreshments to support the families looking for their loved ones. National Disaster Operations Centre Director Retired Col Nathan Kigotho says 34 bodies are at Chiromo while six others have been taken to Kenyatta University Mortuary. “Once they have been taken through the counselling process, we will go to the next stage of identification,” he said. Ten of those who died were elite officers from the General Service Unit, who were on their way back to Nairobi after providing security services to the President during his 3 days tour in Rift Valley. The truck ferrying Premium Bond – a highly flammable substance – rammed into 13 vehicles before an explosion that resulted in a fireball, killing 39 people. The President, while addressing the Kenyans at the Nyayo Stadium, said the country cannot continue losing lives unnecessarily due to poorly placed bumps. “I ask the Transport Ministry to desist forthwith from erecting bumps without painting or even having proper signs…that must come to an end,” President Uhuru Kenyatta

stated. It has already been established that the Saturday night accident at Karai in Naivasha was caused by a bump that is not easily visible at night despite the existence of rumble strips a few metres away. The accident occurred when the Ugandan registered light truck hit the bump losing control and hit an oncoming vehicle, before a flammable substance it was ferrying exploded. The President has urged Kenyans to be cautious

while on road, especially during this festival season, that has always been characterized with serious road accidents, leading to loss of lives and injuries. “I urge Kenyans to be careful during this festival season. We don’t want to have good roads that will kill our people,” he appealed.

Only 18 convictions achieved in 2016 as DPP’s office battles corruption menace Only 18 convictions have been achieved by the public prosecutor in cases prosecuted against graft suspects in 2016. Deputy Director in the Office of Public Prosecutions Nicholas Mutuku noted with concern that while most Kenyans feel frustrated in the seemingly slow pace in the war against graft the ODPP has managed 18 convictions this year alone. “Since 2011, a total of 198 cases have been concluded with 94 convictions, 82 acquittals, and 22 withdrawals. This translates to a 54 percent corruption case conviction rate,” Mutuku noted. He said said some of the recent notable convictions in corruption cases involve a former MP and Senior County Official and as Education officials. He was speaking on Friday during the quietly marked International AntiCorruption Day. Mutuku pointed out that the ODPP has processed 64 police accountability cases, with over two thirds at different stages of trial and the reminder undergoing inquest proceedings since the inception of the Independent Police Oversight Authority (IPOA). He assured the defenders that the DPP will not bend the law to favour rogue police officers but have them convicted. “The Director of Public Prosecutions (DPP) ensures that criminal cases from the Police are screened and only

Observers warn of Syrian army atrocities in Aleppo

The last of eastern Aleppo’s neighborhoods look set to fall to the Syrian regime, a bloody end to the fouryear battle for control of the city. As government forces retake rebelheld areas, they are being accused of executing people with ties to the rebel groups. Humanitarian volunteers in Aleppo issued a desperate plea for help. Relatives of Free Syrian Army rebels, including women and children, were among those executed, activist Mohammad Basbous of the Aleppo Media Center told CNN Monday. “Every hour, butcheries are carried out,” the Syrian Observatory for Human Rights said, adding evidence to earlier reports from the United Nations of atrocities against a large number of civilians. The reports come as Syrian soldiers recaptured neighborhoods of east Aleppo in what is likely to be the rebels’ last stand against government forces. CNN has not been able to verify the execution reports. “Young people especially were executed,” said Ahmad Dbais, director of hospitals for the Union of Medical Care and Relief Organizations, citing medical teams in Aleppo.

approved if they meet both the evidential and public interest tests hence only meritorious cases will end up in court,” said Mutuku. He urged state and non-state actors to protect and expand the civic space for civil society actors and ordinary citizens as provided for in the Kenyan Constitution. “Human rights and their observance are not only essential for socio-political and economic development but are arguably the centre-piece of the Kenyan Constitution (2010). They are part of our national values, bill of rights and constitute the normative structure upon which our political and economic system is underpinned,” Mutuku said. He said human rights defenders play an important role in advancing the enjoyment of human rights, speaking truth to the authority, pressing the state to accountability and building a democratic culture in the society. “In the past, criminal prosecutions have admittedly been used to clamp down on these vital civic spaces and harass human rights defenders. It is therefore important, that the State and Non-State actors protect and indeed expand the civic space for civil society actors and ordinary citizens,” he said.

Commission blamed for dismal work by MPs

The Parliamentary Service Commission is partially to blame for the poor performance by House Committees, a report indicates. The report by the Parliamentary Initiative Network claims that the commission chaired by National Assembly speaker Justin Muturi has consistently understaffed key House Committees, a factor that has stalled their work. It also claims that a majority of the clerks seconded to the committees are unqualified and do not meet the requisite requirements to handle operations of the oversights bodies. For instance, the Public Accounts Committee and the Justice and Legal Affairs committee have only three clerks each despite the laborious activities they handle in their mandate. “In the last three years, PSC has been seconding only three clerks to key committees such as PAC that handle very heavy activities. Some of them are not well versed with the activities of the committees,” reads part of the report launched today at the Sarova Stanley Hotel in Nairobi. The report gives a performance assessment of how the various House committees have performed in the

last three years. Political parties are also said to have seconded members with different academic backgrounds in comparison to the mandate of the respective committees they sit in, creating a mismatch of thought that have graduated the committees to mere rubber stamps. “Where a political party seconds members for the sake party’s competitions then you will find a majority of them are not yielding any fruits,” the states.

According to the report, committees with large membership were said to be ineffective as some members remained dormant or were overruled by their vocal colleagues. A case at hand is the PAC and the Budget Appropriation Committee with a membership of more than 50 MPs. While unveiling the report, PIN chairperson Kwame Owino observed that most the oversight bodies in the 11th parliament had performed

dismally with nothing to show for the time they have been sitting. He claimed that the investigations into the National Youth Service scandal by the Public Accounts Committee (PAC) would yield much if it was properly constituted. “If PAC was properly constituted, that is qualified to the extent of academia and skill we would get much of the NYS than we have today,” said Owino.

Step down now, Gambia’s Jammeh told MONDAY, DECEMBER 13, 2016

The Gambia’s opposition coalition has asked President Yahya Jammeh to step down immediately, after he challenged his defeat in the recent election. Mr Jammeh initially accepted the result but then reversed his decision, saying he would annul the vote. The UN Security Council met on Monday and urged him to meet international mediators who have been sent to the capital, Banjul. US Ambassador to the UN Samantha Power called the situation “dangerous”. Ms Power said they had received reports that some military officers have sided with the incumbent president. “Power to take The Gambia to its peaceful destiny lies in President Jammeh’s hands,” she told reporters after the meeting. The presidents of Nigeria, Liberian, Sierra Leone and Ghana are expected to be among the delegation that will arrive in Banjul on Tuesday, along with the UN envoy for West Africa. Mr Jammah, who has ruled the country for 22 years, has questioned the validity of the count after the electoral commission changed some results, even though it insists the outcome was not affected. “I think he should step down now,” said Adama Barrow, who was declared the election winner. “He has lost the election, we don’t want to waste time, we want this country to start moving,” he told the AFP news agency. President Jammeh went on national TV over the weekend to announce his “total rejection of the election result... thereby annulling the election”. He said “we will go back to the polls

because I want to make sure every Gambian has voted”. He said he was preparing a petition “against the flawed decision of the Independent Elections Commission”. According to the electoral commission’s latest count, as a result of the vote on 1 December: Adama Barrow won 222,708 votes (43.3%) while President Jammeh took 208,487 (39.6%). A thirdparty candidate, Mama Kandeh, won 89,768 (17.1%) They were revised by the country’s electoral commission on 5 December, when it emerged that the ballots for

one area had been added incorrectly, swelling Mr Barrow’s vote. The error, which also added votes to the other candidates, “has not changed the status quo” of the result, the commission said. However, it narrowed Mr Barrow’s margin of victory from 9% to 4%. Mr Jammeh, who has ruled the Gambia for 22 years, originally conceded victory to Mr Barrow, who used to be a security guard in chain store Argos in London. He was even shown telephoning Mr Barrow saying “you are the elected

president of Gambia and I wish you all the best”. Jammeh’s mandate ends on the 18 January but his party says it will file a petition to the Supreme Court. However, the Supreme Court cannot make a decision as they do not have enough judges. Two were sacked by the president in June and legal experts say he can’t appoint new judges for a case about himself. With no Supreme Court to rule on the dispute, the next question is how the army could get involved. And that is

not clear. The head of the Gambian army, General Ousman Badjie, pledged his loyalty to President-elect Adama Barrow after the incumbent conceded. But since Mr Jammeh went back on his words, the army appears to have gravitated back towards him. Amid the possibility for instability, Gambia’s neighbours are getting involved. Senegal, which surrounds The Gambia, called a UN Security Council meeting which condemned Mr Jammeh’s U-turn. Senegalese fighter jets have been seen flying in the skies. It is not clear whether this is a coincidence or a warning to Mr Jammeh. Last week a leading member of Mr Barrow’s coalition told the UK’s The Guardian newspaper that President Jammeh would be prosecuted for alleged crimes committed during his rule. In his U-turn rejecting the results, Mr Jammeh cited “serious and unacceptable abnormalities” in the electoral process, pointing to the errors mentioned by the electoral commission. Despite the errors, election commission head Alieu Momarr Njai told Reuters news agency that he stood by the “if it goes to court, we can prove every vote cast”. “The election results were correct, nothing will change that,” he said. President-elect Barrow said on Sunday that he feared for his safety. In his 22 years in power, Mr Jammeh acquired a reputation as a ruthless leader. ¡¡Human rights group have accused his government of stifling the press and harassing opposition parties.

Urban developer berates state over contract enforcement Efficient contract enforcement is critical for the country’s business climate as it contributes to economic development by reducing costs, delays and uncertainty, Founder and Chief Executive of Africa’s leading urban developer, Rendeavour, Stephen Jennings has said. He stated Kenya needs to improve on contract enforcement as it improves access to credit and increases trade while attracting more investors. The World Bank’s “Doing Business” ranking, released at the end of October, placed Kenya on a commanding 5th position among Sub-Saharan African countries. Kenya jumped 21 positions, from 113th to 92nd, in the overall ranking, making Kenya the most-rapidly improving country in Africa and one of the three fastest improving countries globally. The county gained 20 places in its global ranking in starting a business, getting electricity, protecting minority investors and resolving insolvency. Speaking at the Nairobi International Arbitration Conference held recently in Nairobi, Mr. Jennings noted that one area Kenya did not improve on in the World Bank Ease of Doing Business ranking was enforcing contracts. On average, across the 11 Kenyan counties surveyed by the Bank, resolving a commercial dispute takes 427 days and costs almost 40 per cent of the claim value. In terms of cost, enforcing contracts is nearly three times as expensive in Kenya as it is in Tanzania, although 10 per cent less costly than the average Sub-Saharan Africa average. “Foreign Direct Investment and investor

Construction workers replacing an old tarmac road leading to State House with a new one in Nairobi. confidence in a county are influenced directly by the enforceability of contracts in that jurisdiction and this is where the government should lay more emphasis going forward,” explained Jennings. Jennings commended the government’s decisive role in improving the business climate in Kenya and making the lives

of foreign and domestic investors considerably easier. “The Judiciary in Kenya has shown some improvement, but there are a number of areas requiring further reform including enforcing rules to limit adjournments, establishing a mediation culture, and expanding court automation to

Proposed Bill seeks to curb money laundering, increase revenue collection from gambling firms All funds made from gambling will be deposited to bank accounts once the Betting, Lotteries and Gaming (Amendment) Bill 2016 comes into law. The proposed amendments further prohibit the use of mobile money services either to receive or make deposits. It instead proposes that all betters will be required to open bank accounts and register in a national database as gamblers. Other amendments propose that betters should not use stakes that exceed Sh200 in a move that seeks to bar Kenyans from making bets using large sums of money. Sponsored by Gem Member of Parliament, Jakoyo Midiwo, the proposed Bill also seeks to eradicate money laundering thus increasing revenue collection. The Bill further proposes a reduction in the number of gaming premises in a given location, bans advertising of gambling and imposes

heavy fines against companies that allow minors to gamble. “Those who contravene the proposed amendments to the law will face fines ranging from Sh 1 million and Sh4 million, up from the current Sh3,000, or imprisonment for a term not exceeding three months or both,” said Jakoyo in the proposal. This comes after a recent survey by Consumer Insight, a Nairobi-based research firm, revealed that that seven in every 100 primary school pupils have gambled while 22 per cent of high school kids have been involved in the act, which is against the law. Internet penetration has helped popularized online betting across the country. Uhuru announces Sh2.4 billion debt waiver for coffee, tea farmers Coffee and tea farmers are set to benefit from Sh2.4 billion debt waiver extended to them by President Uhuru Kenyatta. Speaking during the 53rd Jamhuri Day celebrations, the President said the move is in line with government’s efforts in supporting farmers, boosting agriculture and deepening agricultural development. “My Administration is already applying a Sh2.4 billion debt waiver for coffee farmers with similar waivers having been extended to farmers of other crops, such as sugar. These waivers will be extended equitably,” said Kenyatta. “Most our people make their living in agriculture. We must therefore refocus on returning to the levels of productivity our predecessors had achieved and going far beyond them. It is this that will raise incomes across the country, and this is a goal to which my Administration is fully committed,” he added. The Head of State said that the government has distributed over 500,000 tons of subsidized fertilizer to farmers, cutting prices and improving productivity, ascertaining that the establishment of fertilizer-blending plants will further subsidize the cost of fertilizer. He added that the plants will have an annual capacity of 300,000 tons once they are fully operational. A recent World Bank report indicates that the industry is the country’s largest sector and has been growing at a rate of 19.98 per cent annually since independence.

OPEC plan to cut oil supply may cause rise in local fuel prices Consumers in Kenya and other oil importing countries may experience a jump in fuel prices after Oil Producing and Exporting Countries (OPEC) plan to voluntarily cut crude oil supply by a 1.2 million barrels a day. The first deal by world’s biggest oil and producing countries, which include Russia, Saudi Arabia, Iraq and Iran, will see them cut oil supply by 1.2 million barrels a day and will be effective in the first quarter of 2017. OPEC states are hoping they will benefit from a coordinated production cut given that they will gain more revenue from higher prices than they lose in foregone output.

On Monday, the price of Brent crude rose to $55 (Sh5,600) per barrel, the highest level since mid-2015. Non-OPEC members said over the weekend they will reduce output by about 558,000 barrels a day in addition to OPEC’s commitment to cut 1.2 million starting in January. It is the first production cut in about eight years. The move comes at a time when approximately 25 per cent of Kenya’s total import bills goes to petroleum products and may expose the nation to shocks from global oil price fluctuations. Recent data from the Petroleum Institute of East Africa reveals that Kenya’s consumption of

petroleum as per the end of 2015 was 5.88 billion litres of oil, a 1.83 billion hike compared to 2010 when the total country’s consumption stood at 4.05 billion litres. Experts project slower economic growth should this happen, given that high import bills will weaken Kenya’s currency, forcing the government to spend more on imports of the basic commodity. With this likely to happen, motorists, commuters and lowincome Kenyans who rely on kerosene for cooking and lighting will be forced to dig deeper into their pockets. @enock_x254

Kenya to benefit from Sh132bn Global Wildlife Programme fund The Global Wildlife Program (GWP) has released the first-ever review of international donor funding for combatting illegal wildlife trade in Africa and Asia, which shows that over $1.3 billion (Sh132.6 billion) was committed by 24 international donors since 2010, or approximately $190 million (Sh19.4 billion) per year. It was revealed in May this year that Kenya would benefit from an estimated Sh9 billion injection that is part of the Programs fund that will be used to fight poaching. The World Bank, in collaboration with other bodies, launched the programme, approved by the Global Environment Facility (GEF), which is meant to strengthen the ability and capacity of participating countries to combat poaching and illegal wildlife trade. “While there is growing momentum from the international community to combat wildlife crime, reliable information on donor funding has been lacking,” said the World Bank in a recent report. “The Analysis of International Funding to Tackle Illegal Wildlife Trade fills this gap by showing the scale of funding by donors and the depth and breadth of activities to tackle the crisis,” added the global lender. “Wildlife crime robs countries of their natural assets and undermines sustainable and inclusive development,” said Laura Tuck, Vice President for Sustainable Development at the World Bank. “If we’re to tackle this effectively we need strong coordination of donor efforts and financing.” Key findings of the report indicated that a total of $1.3 billion (Sh132.6 billion) was committed by 24 international donors between 2010 and June 2016, funding 1,105 projects in 60 different countries and various regional and global projects.

Demonstrators hold up placards and chant slogans as they march in support of protecting elephants, rhinos and lions in downtown Nairobi. The top five donors were the Global Environment Facility (GEF), Germany, the United States, the European Commission, and the World Bank Group, who together contributed $1.1 billion of the total funding (86 per cent). Sixty-three per cent of the funds went toward efforts in Africa 29 per cent to Asia, 6 per cent to global programs and initiatives, and 2 per cent to projects covering both Africa and Asia. The top five recipient countries were Tanzania (8 per cent), the Democratic Republic of Congo (5 per cent), Mozambique (5 per cent), Gabon (3 per cent), and Bangladesh (3 per cent). Forty-six percent of the funding supported protected area management, while 19 per cent went to law enforcement including intelligence-

led operations and transnational coordination, 15 per cent for sustainable use and alternative livelihoods, 8 per cent for policy and legislation, 6 per cent for research and assessment, and 6 per cent for communication and awareness raising. “Poaching and illegal wildlife trafficking are reaching unprecedented levels and while many efforts are underway to combat the problem, reliable information on donor funding has been lacking. The analysis fills an important gap in our understanding of the collective response. It will not only provide a better understanding and coordination of the contributions of the international community, it should ultimately assist those on the ground protecting the wildlife and the livelihoods of local

communities,” said Naoko Ishii, CEO and Chairperson for the GEF. Due to the cross-border and multidimensional nature of illegal wildlife trade, the Naoko says the development community must partner with stakeholders from multiple sectors and countries to reduce poaching, trafficking, and the demand for wildlife and wildlife products. “We strongly believe that the findings and recommendations of this report will make a vital contribution to CITES Parties—be they donors, beneficiaries, or from range, transit, or destination states—in better connecting their efforts along the entire illicit trade chain to combat these serious and highly destructive crimes,” said John E. Scanlon, CITES Secretary-General.

Central African Region. The Group remains committed to Kenya and the wider region through its business and property investment projects,” said Dr Joe Wanjui, the UAP Old Mutual Group Chairman when he launched the themed lighting system. The 33-storey skyscraper has an advanced lighting system whose colours can be operated individually to suit various occasions, such as the Jamuhuri Day Celebrations. The Group felt that the Independence Day is a key milestone for the nation, and would be an appropriate time to unveil this unique building feature. The skyscraper has become the first light-themed building in East and Central Africa. UAP Old Mutual Group has the third largest Property and Casualty (P&C) market share

in Kenya, the second largest Health Insurance business; a substantial property investment portfolio and a fast growing Life Insurance business. It has established diverse distribution networks including via brokers, an agency force, direct sales, bancassurance, digital, and via supermarkets. The Group is in the process of fitting out their new home and the first group of staff will move in by January 1, 2017. “The move will see the UAP Old Mutual group finally host all its businesses in Kenya under one roof. This is a great milestone towards attainment of the Group’s vision to create an integrated financial services business of insurance, savings, investments and banking,” said

UAP Old Mutual Group CEO, Peter Mwangi. The Tower will also host other tenants who will benefit from its central location in the Upper Hill financial district of Nairobi. Already, key tenants have signed up to set up offices at the Tower, and discussions are ongoing with various financial institutions and multinational to take up space. Currently, the Group provides investment, savings, insurance and banking services to more than 16 million customers in Africa, the Americas, Asia and Europe. THE BITTER-SWEET WEEKEND THAT WAS

Kenya celebrates its 53rd year as a republic

As is standard with every year that passes, Jamhuri Day is accompanied with celebrations and a Presidential address. This one was no different with President Uhuru Kenyatta delivering his speech at Nyayo National Stadium. The address touched on the Naivasha tragedy that has gripped that nation, education, agriculture and the economy, admitting that “our young people have not reached the heights our founders attained is not their fault. Too often, we see leaders who exploit their energy and eagerness to reduce them to poverty, and to drive them to violence.” As a special treat the UAP Old Mutual tower was lit up with the colours of the Kenyan flag.

top news highlights from the weekend

The Naivasha road tragedy

Victims from the grissly road accident and explosion along the Nairobi-Naivasha Highway are still being identified with some burnt beyond recognition. The death toll stands at 40 and Capital reports that ‘Of the 42 lives lost, 10 were elite officers from the General Service Unit, who were on their way back to Nairobi after providing security services to the President during his 3 days tour in Rift Valley.’ It was discovered that a former Standard Group journalist, Wahome Thuku, had predicted the accident before it happened, writing, “As you go down the highway towards Naivasha just after Kinungi trading centre the govt has erected two bumps smack at the hill. They were erected on Thursday evening and now I can say that is a black spot. Expect horrible accidents there. In fact start preparing for a fatal crash.”

Jamhuri Reggae Festival

The concert held on Sunday evening at the Safaricom Kasarani Stadium was an allout extravaganza with a star studded lineup. The crowd was treated to a night-long celebration of music and culture from roots reggae and dancehall legends Capleton aka Prophet of King Shango and Queen Ifrica. Reggae and dancehall star from Kingston, Jamaica Sustane was not left out of the action and some Kenyan talent was also hit the stage in the way of local King of dancehall Wyre the Love Child, the bands Gravitti and TuneDem. The show was hosted by Jahmby Koikai.

sermons that take place at the church. Early last year Reverend Kathy Kiuna had to go on the offensive when it was revealed that she had made some disparaging remarks about JCC ‘not being for poor people.’ The reputedly false quote read, “This is not a place for poor people. If you can’t tithe, find another church, we don’t entertain poverty. There are many churches in Nairobi which accommodate poor people but JCC is not one of them.” Now her husband Bishop Allan Kiuna, while celebrating his 50th birthday, posted a picture on his Instagram account of an exterior and interior view of a private jet saying, “Thank you very much wonderful people!”

I KNOW I SHOULD PROBABLY LEAVE HIM BUT HE’S THE PRIMARY BREADWINNER AND I DO NOT WANT MY CHILDREN TO SUFFER.

Dear Dr X,

I think I’ve had about enough of my husband. He has always had a wandering eye but I perserved in the marriage because we have small children and although I know that is no reason to live with a basically useless man, I stayed. But it’s become too much. He recently confessed to having another family that I had no idea about and the worst thing about this situation is that the children from the other family are older than ours. Which means he had already started dealing with the other woman even before we got married. I have no idea what to do. I know I should probably leave him but he’s the primary breadwinner and I do not want my children to suffer.

My huz has another family that I had no idea about!

Dear Margaret,

You really have no option but to leave this man. Even though you think it might be better for the kids to stick it out, you are fooling yourself. You and the children will ultimately be happier after leaving this man behind. There is nothing left for you there unless you want to share a man who then again will not be satisfied with having two wives and probably continue wandering. This is how people get illnesses because he can’t keep dipping his pen in multiple ink pots than come back to you. To be blunt you should really be running for your life. You’ll get by and it’s better for your children to have a parent that is struggling to make ends meet than none at all.

Breathtaking wins at the 2016 National Geographic Nature Photographer of the Year Contest

W

inners of the The 2016 National Geographic Nature Photographer of the Year have been announced. With the grand prize being a 10-day trip for two to the Galápagos with National Geographic Expeditions, the following categories; Animal portraits, Landscape, Action and Environmental Issues featured three winners from each. First Place is a $2,500 cash prize, second place is a $750 cash prize and a signed National Geographic book and third place wins $500 dollars. Grand prize went to photographer G. Lecoeur who “captured an image during the migration of the sardines along the wild coast of South Africa.” Second prize went to Tori SheaOstberg who captured an image of a tornado touching down. She describes the process as, “As soon as we were safe, as the tornado roared off into the distance through a field before roping out we scrambled up the hill to check on the residents.” Third place went to Zsolt Kudich, who took a picture of Great Egrets that are a conservation success story in Hungary. In the landscape category a stunning photo depicting a tree engulfed by a waterfall by Jacob Kaptein took first place. “In autumn when rainfall is high, pieces of forest get flooded. Once I saw this little beech in the water, trying to survive under these harsh conditions. I returned sometimes to this place to take pictures,” he said about the picture. Break ups always bring out the worst in us, don’t they? There is no clear cut guide to getting over someone when it comes down to brass text. But there are instances when even time doesn’t soothe the ache and if that is where you are stuck, keep reading.

Work

Being stressed out about work could actually be a reprieve from being stressed out about your feelings. It’s a great way to channel your frustrations into something productive and might get you some positive attention from the boss. Plus work tends to take up a fair amount of concentration so if you are focused on work that means that you are not focused on other things. It’s way too easy to feel sorry for yourself when you are heartbroken but it’s a lot easier to move on when you are not thinking about it too much.

-Dr X

Focus on your family

When is the last time you called your parents up? It might be time to do that again. Focus on the people in your life that do love you and who are there for you instead of things that are out of your control. Your family and friends are there so that you can lean on them when things get rough so if it becomes too much talk to someone who cares for you about it.

Purge

Yes, it will be time to get rid of all of your ex’s stuff. Seeing their possessions lying around your home will undoubtedly bring feelings up no matter how innocuous ‘stuff ’ may seem. Send them back to where they came from and maybe a physical purge will lead to an emotional one. Not to say that it an assurance but at least you won’t have to keep looking at their things and being constantly reminded of their presence.

Cut off all contact

surefire ways to get over

YOUR EX

This one is particularly important because attempting to contact your ex only ever ends in disappointment which might even mean suffering a setback in your journey. If you take a second and think about it before trying to contact your ex you’ll also realize that you really have nothing to say. It will be a desperate attempt to win back something you lost for a solid reason.

Take up a hobby

If your days are taken up with office work, your night should be occupied too. So instead of getting steadily inebriated and doing something that you will definitely regret, read a book, exercise or even learn how to cook. Anything to take your mind off things is a great idea.

Arsenal to face Bayern again, City get Monaco as Foxes land Sevilla MONDAY, DECEMBER 13, 2016

Arsenal will face Bayern Munich, Leicester City will play Sevilla and Manchester City are up against Monaco in the Champions League last 16. The Gunners have played the German champions four times in the previous five campaigns and finished behind them in the group stage last season. But other standout ties of the round pits Spanish champions Barcelona against French champions Paris StGermain. Barca beat PSG in the quarter-finals en route to winning the title during the 2014-15 season. Champions and La Liga leaders Real Madrid face Italian side Napoli, who are fourth in Serie A. Leicester, who are in their debut campaign, have a tough test against Europa League champions Sevilla. Manchester City’s opponents Monaco beat Tottenham twice in Group E. Arsenal have been knocked out by Bayern the past three times they have met in the knockout stage. Gunners club secretary David Miles told BT Sport: “We are through to the knockout stage for the

first Premier League title last season.

14th consecutive season, which is testament to manager Arsene Wenger and the teams throughout that time. But the fans will think we have got the rough end of the draw again - at some stage the tide has got to turn and we will beat them.” Bayern skipper Philipp Lahm tweeted: “Tough draw as Arsenal is in really good shape. Looking forward to seeing my former colleagues from the national team again!”

Manchester City director of football Txiki Begiristain said Monaco should not be underestimated. He added: “Monaco are playing probably the best football in France now. Foxes manager Claudio Ranieri said his Leicester side were set for a tough challenge against a “big, big, big team”. “I know that Sevilla have lifted the Europa League three times in three years - it is unbelievable,” said the Italian, who led the Foxes to their

“Now they are third in the league and have lost only three so far. They are fighting to win the title with Real Madrid and Barcelona in Spain, so that tells you how good they are.” In the Europa League, Manchester United were drawn against French side Saint-Etienne in the round of last 32, while Tottenham Hotspur got Belgian team Gent. United midfielder Paul Pogba is set to face older brother Florentin, who plays for the eighth-placed Ligue 1 side. Spurs have never met Gent, who finished third in the Belgian topflight last season, in a competitive fixture. United’s first leg will be played on Wednesday, 15 February, while Spurs play the following day. The Red Devils will play on Wednesday because Saint-Etienne’s neighbours Lyon are also playing at home in the Europe League that week. Both return legs will be played on Thursday, 23 February.

Gor Mahia rivals now vow to work together

Rivals in the just concluded Gor Mahia elections have vowed to work together for the benefit of the club. Chairman Ambrose Rachier who retained his seat after the fiercely contested elections said it is time to focus on the club’s serious needs. The Nairobi lawyer who was elected chairman for a fourth term has the task of leading Kenya’s most successful club to regaining Premier League title which they surrendered to Tusker FC in the last campaign. “The work that needs to be accomplished is huge. We have to work together to achieve that,” Rachier said. His sentiments were backed by loser and critic Chris Omondi conceded defeat on Sunday. Omondi, who was until Sunday a fierce critic of Rachier finished finished third in the race for chairmanship with 157 votes, behind Dan Oketch who garnered 220 votes. Rachier had won with 570. “It is good that we don’t concentrate on what went wrong in the process. The best thing is that the elections are over and the club can continue with the projects that matter. The members have spoken and shown they are really yearning for change, I hope the chairman will build on the goodwill that the fans have shown today,” Omondi said. @amos_x254

SPORT 15 TUESDAY, DECEMBER 5, 2016

Leicester’s Mahrez crowned Africa’s best Riyad Mahrez has been crowned the BBC African Footballer of the Year 2016. Fans from across the world voted for the Algeria and Leicester midfielder ahead of Pierre-Emerick Aubameyang, Andre Ayew, Sadio Mane and Yaya Toure. Winger Mahrez, 25, told BBC Sport: “It means a lot, it’s something big for African players so I am very happy, I am very proud. “It’s always good to receive awards and for African players it’s a huge honour. To all the fans, thank you very much.” He added: “Also I want to thank the Algeria fans and dedicate this to them as well and for my family. “I just have to carry on and keep going with my football and see what I can do.” The award caps an exceptional year for Mahrez, who had already won the English Premier League title and was voted Professional Footballers’ Association Player of the Year. It is further recognition for his outstanding form as Mahrez, whose family comes from the small town of El Khemis in Algeria, took the Premier League by storm. He was a driving force in Leicester City’s shock title triumph, scoring 17 goals and providing 11 assists as the Foxes pulled off what had been a 5,000-1 shot before the season. Leicester manager Claudio Ranieiri was in

attendance as Mahrez received his award and paid tribute to the winger. “I want to see him continue as a fantastic player,” the Italian told BBC Sport. “ It’s very important for us, for the team. He is improving every day. “I don’t speak about his quality. I speak about his sacrifice, he has fought for the team because it’s very important for us to be together.” In May, Mahrez became the f i r s t African to be voted the best player in the league by his fellow professionals, only two years after he had joined Leicester from Le Havre for £400,000. Mahrez has made a remarkable rise from playing street football as a youngster to shining in the company of some of the world’s best footballers. In 2016 he proved he can thrive at the highest level, scoring four goals in his first five games in the Champions League. He has also excelled on the international stage. In five matches for Algeria he scored two goals and provided five assists, and helped them qualify for next month’s Africa Cup of Nations. His achievements have also been recognised by football’s world governing body Fifa, who included him on its shortlist for Player of the Year - the only African

among the 23 names. He emerged seventh with Portuguese star Cristiano Ronaldo winning the gong ahead of Lionel Messi. Mahrez now joins a list of greats, including Abedi Pele, George Weah, JayJay Okocha and Didier Drogba, to have won the BBC African Footballer of the year award.

GOR MAHIA RIVALS VOW TO WORK TOGETHER AFTER DIVISIVE CLUB ELECTIONS

Roma cuts Juve’s lead ahead of Turin clash

Second-placed Roma cut Serie A leaders Juventus’ advantage to four points with a narrow win against third-placed AC Milan at the Stadio Olimpico. Roma keeper Wojciech Szczesny, on loan from Arsenal, recklessly conceded a first-half penalty but redeemed himself by saving M’Baye Niang’s weak effort. And home midfielder Radja Nainggolan punished the visitors with a goal out of nothing after the break. The Belgium star bent a 20-yard shot into the far corner after a strong run. Roma’s fifth successive home win moves them on to 35 points from 16 games, with Milan three points behind them after their first defeat in six matches. Roma meet Juventus, who are bidding for a sixth consecutive Scudetto, in Turin on Saturday evening.

The Portuguese international beat rival Lionel Messi to the award following a stellar season in which he won the Champions League with Real Madrid before guiding his country to Euro 2016 glory in France in the summer. The 31-year-old is now one behind Barcelona’s Messi, who took the honour for a fifth time last year. Atletico Madrid’s French forward Antoine Griezmann finished third in the vote. Ronaldo has now won the Ballon d’Or in 2008, 2013, 2014 and 2016, with Messi the only other recipient of the award since winning it for the first time in 2009. “I never thought in my mind that I would win the Golden Ball four times. I am pleased. I feel so proud and happy,” said Ronaldo. “I have the opportunity to thank all of my teammates, the national team, Real Madrid, all of the people and players who helped me to win this individual award.” The former Manchester United forward has scored 19 goals in 20 games for club and country this term, to add to the 54 he got last season. Ronaldo’s Real Madrid team-mate Gareth Bale finished sixth in the vote, while Leicester City striker Jamie Vardy - the only Englishman included on the 30-player shortlist - was eighth. The Ballon d’Or is voted for by 173 journalists from around the world. It has been awarded by France Football every year since 1956, but for the past six years it became the Fifa Ballon d’Or in association with world football’s governing body and was awarded to the world’s best player. However, Fifa ended its association with the award in September. Fifa will hand out its own prize for the world’s best men’s player, along with the best women’s player and team of the year, at the Best Fifa Football Awards ceremony in Zurich on 9 January. France Football counted down the ranking on their Twitter feed, starting with West Ham’s Dimitri Payet and Real Madrid team-mates Toni Kroos and Luka Modric, who finished joint 17th in the vote. They got down to announcing Bale

in sixth at around 19:00 GMT before suddenly jumping to the winner and completely missing out fifth to second. Seventy minutes after Ronaldo was confirmed as the latest recipient of the Ballon d’Or, Messi finally discovered that he had finished as runner-up. Ronaldo was favourite to win the award after a stellar year for club and country. But Messi had also been in superb form, helping Barcelona win La Liga last season as well as scoring 50 goals in 50 games in 2016. He also played in the Copa America for Argentina in the summer, scoring five goals, but missed a penalty in the final as Chile won the shootout 4-2. He announced his international retirement following that defeat but reversed his decision in August. Eight Premier League

players had made it on to the 30-player shortlist, with five making it into the top 17. Vardy was joined in the top 10 by his Leicester City team-mate and PFA Player of the Year Riyad Mahrez, who finished seventh in the vote, with both players being recognised for their part in a stunning season for the Foxes as they won the 2015-16 title. Manchester United also had two players in the top 17, with Swedish striker Zlatan Ibrahimovic 13th and French midfielder Paul Pogba, who became the world’s most expensive player when he joined the Red Devils from Juventus for £89m, 14th. Also included among the nominees were Manchester City duo Sergio Aguero and Kevin de Bruyne and Tottenham goalkeeper Hugo Lloris.
