CRA backs Kidero over funds misuse claims by Auditor
Nairobi Governor Evans Kidero has today got the rare backing from the Commission on Revenue Allocation (CRA) over claims that his county government could have misappropriated over Sh20 billion of its revenues. A report by the Auditor General of the 2014/2015 financial year raised querries saying Nairobi County was unable to account for more than Sh20 billion. Cases of deaths and agony have been reported in various parts of the country as provision of healthcare in public hospitals remained paralysed as the health workers continue with the work boycott. The countrywide strike by doctors which began yesterday entered its second day today with the medics vowing to continue with their work boycott until their demands are met. Kenya Medical Practitioners, Pharmacists and Dentists’ Union (KMPPDU) Secretary-General Ouma Oluga said today that will keep off work for as long as it takes until the government yields to their demands. He maintained that Kenyans are entitled to quality and adequately paid doctors while justifying their push for promotions, better pay and a review of job groups under the terms of a collective bargaining agreement signed in 2013. Cases of deaths and agony have been reported in various parts of the country as provision of healthcare in public hospitals remained paralysed as the health workers continue with the work boycott. Patients seeking treatment were turned away even as others sought alternatives at private health facilities as the industrial action by the nearly 5,000 doctors, clinicians, pharmacist, dentists and other health professional continue to bite across the over 2,700 public health facilities countrywide. By last evening, at least seven patients had died while thousands were discharged prematurely. Today, the union officials were held up in a closed door meeting with the Ministry of Health officials in a bid to resolve the impasse that has led to untold suffering of patients.

KMPPDU Chairman Samuel Osoro insisted that the medics will continue with their strike until government meets their demands. “No amount of intimidation, no amount of propaganda will make us change our determination. We have heard lots and lots of dialogue and we are saying dialogue has to come to an end and we have to take action, and the action is doctors in Kenya will remain on strike until CBA is implemented,” he declared. The doctors are demanding implementation of a new pay package agreed on in 2013 and say they will not enter into any other Collective Bargaining Agreement (CBA) until the salary structure negotiated and
signed by the two sides three years ago is implemented. While the doctors want the revised pay package implemented in arrears and backdated to 2013, the government, through the Ministry of Health and the office of the Attorney General had cited legal bottlenecks which it says, have rendered the CBA in dispute invalid. This will see the lowest paid doctor pocket Sh342,000 and the highest pocket slightly over Sh940,000 away from the current remuneration of Sh500,000 for the highest paid and Sh40,000 for the lowest paid. Health Cabinet Secretary Cleopa Mailu told a news conference held Monday evening that police officers
have been deployed at major hospitals to protect health workers who may choose to report for duty even as their colleagues stay away. This comes after KPPMDU General -Secretary Dr Fredrick Oluga threatened to lead striking doctors and nurses to storm Kenyatta National Hospital to eject the hospital’s management and other health workers who had opted to stay behind providing emergency care. Shape the agenda for 2017 campaigns, media told
The media has been challenged to shape the agenda for next year’s elections by focusing on issues at political forums in their coverage of the campaigns. Mombasa senator Hassan Omar told journalists that they should be at the forefront in championing for issue based politics and not the normal political rhetoric as Kenyans head to the August 8, 2017 polls. “The media with the advantage they have should help this country and focus only on people who are speaking real issues affecting Kenyans instead of giving acres of space on nonissues to the usual politicians,” Omar (pictured) said today at breakfast meeting with political journalists. He said the country will never move forward in terms of development if the media fails in its critical role of informing Kenyans. “How will we have leaders with the
different ideas that can help this country if every day the media keeps recycling the sons of the same leaders we had in 1963,” posed the Mombasa senator. The forum was organized by the Centre for Multi-Party Democracy (CMD) with the aim of promoting effective political reporting as the country heads towards the general election next year. She also claimed that women politicians have been given unfair coverage in the media while their male counterparts get good coverage every day. Nominated senator Naisula Lesuda said the media deny the public a chance to be effectively informed when they focus on sideshows by politicians. “The media focuses so much on sideshows created by politicians and ignore those who are speaking issues
affecting the public. Apparently those who speak non issues get more coverage hence we have leaders who are not working,” Leisula said. She urged political journalists to be fair and objective in their reporting ahead of official political campaigns next year. Daily Nation reporter Isaac Ongiri who also chairs the association of political journalists in Kenya said corruption, political leanings and biasness has infiltrated newsrooms hence political journalists should be careful in their reporting. “We need to be objective as political reporters as we head towards the general elections. From Page 1 Nairobi County collected revenues amounting to Sh11 billion in the said financial year and got a budget allocation of Sh12 billion from the CRA totaling to Sh23 billion for the fiscal year. “I read that Nairobi lost Sh20 billion. I mean how could that have happened from a budget of Sh23 billion. It is illogical,” Mr Cheserem said. He noted that 80 per cent of what the reports claim have been misappropriated are due to accounting errors. “Very soon Kenyans will start ignoring these reports because they don’t tell us the genuine loss and who was responsible,” he said. He urged the Auditor General to show exact amount of money lost in the reports instead of generalising. This, he said would make it easy for authorities to apprehend the officers involved. “I am not saying that no money has been lost. Corruption is real both at Counties and National Government ministries. But counties should two or three days before reports are released be allowed to respond to the queries,” he said. While commenting on the report Monday, Dr Kidero laughed off the auditor general queries saying it would have been impractical for the county to operate if Sh20 billion was misappropriated. “I am amazed by this report,” said Dr Kidero. “It’s not possible for the county to misappropriate all the revenue it has. The report from the auditor is impractical,” he said arguing that the county’s operations would have been paralysed as it would be unable to pay ages. Mr Cheserem spoke at City Hall where he was hosted by Deputy Governor Jonathan Mueke. Mueke faulted the Auditor’s report saying that the county undertook many projects during the year, which could not have been possible if Sh20 billion was stolen. “We have increased the number of streetlights from 20,000 to 6000. We have 105 projects that are on-going. How could these have been possible,” he posed.

CS Matiang’i issues new directives for international schools All teachers in Kenya will have to be registered with the Teachers Service Commission (TSC) before they can be allowed to render their services to students, a new government directive states. Education Cabinet Secretary Fred Matiang’i in his latest announcement also wants all international schools to start teaching the history of Kenya and Kiswahili Language in their academies from April next year. He has already ordered TSC to vet all teachers especially those in international schools to ensure the quality of education is not compromised.
The directive comes at a time a report by the Kenya National Union of Teachers (Knut) brought to the limelight poor education standards among the Bridge International academies in the country. “We cannot allow our children be taught by anyone and everyone. We must observe standards which have been set by the TSC. Together with my officers I want the TSC to ensure all teachers in our classes have the necessary requirements,” Dr Matiang’i stated. He spoke at a stakeholders’ meeting at the Kenya Institute of Curriculum Development (KICD) in Nairobi on
Monday. And while emphasizing the need for quality education, Dr Matiang’i (pictured above) said the government will make its decision on Bridge International Academies in the Country in the best interest of learners. He observed that when he made an impromptu visit to Wami and Bridge International Schools in Kawangware, Nairobi in November this year, he found the learning environment unsafe. He however remained non-committal on whether the schools with more than 100,000 learners and started in 2009 would be shut.

Teachers and parents who attended the launch of the report Concern Over Growing Commercialization and Privatization of Education in Nairobi, protested, arguing that the schools had complied with most of the ministry’s requirements. “When the schools started, they faced the challenges contained in the report, but we have since made some
progress,” said a teacher at one of the schools. Knut Secretary-General Wilson Sossion urged Dr Matiang’i to follow the example of neighboring Uganda, where the Bridge schools were closed last year for failing to teach the approved syllabus and for employing untrained teachers. Knut and the international NGO said the syllabus was sent directly from the United States, where the owners of the schools reside. They further said the “structured curriculum” was delivered on tablets, with the teachers expected not to deviate from the teaching material. “Teachers are required to recite the notes to the students and are not allowed to interact personally with the students,” said Ms Lucy Njeru, an official of Knut and a member of the research team. African nations ban Europe ‘dirty fuel’ Five countries in West Africa have decided to stop importing “dirty fuels” from Europe, the UN Environment Programme says. A recent report revealed that European companies were exploiting weak regulations in West Africa to export fuels with high levels of sulphur. Nigeria, Benin, Togo, Ghana, and Cote d’Ivoire agreed on the import ban. The UN says the move will help more than 250 million people breathe safer and cleaner air. The sulphur particles emitted by a diesel engine are considered to be a major contributor to air pollution
DR Congo tribal clashes leave at least 31 dead At least 31 people died in clashes between tribal militia and security forces in the Democratic Republic of Congo at the weekend, officials say. They say the violence in the central Kasai province was sparked by a row between an uncle and a nephew over the title of a traditional chief. Deputy Governor Hubert Mbingho N’Vula said 13 members of the security forces sent to quell the fighting were among those killed. Eighteen militiamen also died, he said. Mr N’Vula said public order had been restored in and around the city of Tshikapa in the remote province. DR Congo is beset by sporadic violence between ethnic militias. This has been enflamed further by the postponing of a presidential election due to be held before the end of the year.

criticised the Swiss for their links to the African trade in diesel that has toxin levels illegal in Europe. The study was by the campaign group, Public Eye, which said retailers were exploiting weak regulatory standards. Erik Solheim, the head of UN Environment Programme, hailed the import ban. “West Africa is sending a strong message that it is no longer accepting dirty fuels from Europe,” Mr Solheim said. “Their decision to set strict new standards for cleaner, safer fuels and advanced vehicle emission standards shows they are placing the health of
their people first,” he added For a long time African countries relied on colonial-era standards, which have only been revised in recent years. Nigeria’s Environment Minister Amina Mohamed said: “For 20 years, Nigeria has not been able to address the vehicle pollution crisis due to the poor fuels we have been importing. “Today we are taking a huge leap forward - limiting sulphur in fuels from 3,000 parts per million to 50 parts per million.” She said the move would result in major air quality benefits in Nigerian cities and would allow the country to set modern vehicle standards.
East African countries of Kenya, Tanzania, Uganda, Rwanda and Burundi are the only nations where Sulphur fuels have been limited to 50 parts per million and below alongside Morocco. The five West African countries have between 2000 parts and 5000 parts per million alongside Ethiopia, Eritrea, Madagascar, Zambia, Chad, Cameroon and Equatorial Guinea as well as Senegal and Liberia. The worst affected countries are Somalia, Egypt, Tunisia and Congo Brazzaville with over 5000 parts per million. The WHO says that pollution is particularly bad in low and middleincome countries.
US seeks to reassure China after Trump-Taiwan call The White House says it has sought to reassure China after President-elect Donald Trump’s phone call with Taiwanese President Tsai Ing-wen. The call last week sparked alarm as the US does not have formal relations with Taiwan, which China views as a breakaway province. China lodged a diplomatic complaint in response. The White House said officials had assured China of their “continued commitment to a one-China policy”. Mr Trump’s phone call was followed by two tweets in which he criticised China’s monetary policy and its operations in the South China Sea. Mr Trump has downplayed his conversation with Ms Tsai, calling it a courtesy call. On Monday, White House spokesman Josh Earnest said it was “hard to determine exactly what the aim was” behind the president-elect’s actions. But he said the US policy on Taiwan had “been in place for nearly 40 years, and it has been focused on promoting and preserving peace and stability”. “The adherence to and commitment to this policy has advanced the ability of the United States to make progress in our relationship with
China and, of course, has benefitted the people of Taiwan,” said Mr Earnest. Beijing sees Taiwan as a province and aims to deny it any of the trappings of an independent state. It has threatened to use force if Taiwan formally declares independence. Taiwan is not recognised by the US as an independent country and the two have no formal diplomatic relations, but it also does not recognise Beijing’s claim over Taiwan. China’s Foreign Ministry spokesperson Lu Kang said
US-China relations were always conducted on a “win-win” approach. “To maintain such sound momentum of development, it will take both sides to work together on the basis of upholding major principles in bilateral relations,” he said. On Tuesday, an opinion piece in the overseas edition of China’s People’s Daily newspaper said that “provoking disagreements with China will not help resolve US domestic problems, won’t help achieve the new Trump administration’s domestic agenda”. “Provoking Sino-American frictions, messing up US-China ties will also not help ‘Make America Great again’,” said the article by Jia Xiudong. Foreign Affairs CS urges leaders to establish a ‘borderless Africa’ African countries must work at establishing a borderless continent to allow for increased movement of people and goods, Foreign Affairs Cabinet Secretary, Amb. Amina Mohamed has said. Speaking during the First African Investment and Business Forum, in Algiers, CS Mohamed said African countries have to strike a balance between sovereignty and economic growth. “We must deepen our own integration and not clink to sovereignty for sovereignty sake to close our borders,” Amb. Mohamed told the Algiers gathering. She said “the burning desire to forge deeper African integration was clear in our peoples’ resolve to succeed together, and to create a better future for all Africans, where no-one is left behind.” She disparaged the miserly intraAfrican Trade which currently stands at slightly over 10 per cent in comparison to North America and Western Europe whose intra-regional trade is at 40 per cent and 63 per cent respectively, as needing serious attention if Africa is to grow its economy. CMA locks horns with former Uchumi Chief Financial Officer
Former Uchumi Supermarkets Chief Finance Officer Chadwick Omondi Okumu is in court to contest a move by the Capital Markets Authority (CMA) to bar him from being a board member of publicly-listed firms for a period of two years. In a suit, Okumu accuses CMA of acting in breach his constitutional rights as sanctions imposed will affect his livelihood. He claims that he lawfully performed his duties until June 15, 2016 when the management relieved him of his duties from the state corporation. Keroche Breweries fired Okumu for his alleged role in a looting scheme that dealt a major financial blow to the retail chain. Okumu was sacked following the release of an Uchumi audit report which implicated him in the systematic plunder of the retail chain alongside former CEO, Jonathan Ciano. The matter came to light yesterday in a suit Okumu filed to stop the Capital Markets Authority from imposing sanctions on him following allegations that he benefited from the scheme. Okumu has blamed the Authority for his dismissal. The regulator found him guilty of participating in the misappropriation of funds from a 2014 rights issue, misleading Uchumi’s board and failing to ensure that the retailer’s books were accurate. Okumu was sacked alongside CEO Jonathan Ciano for “gross misconduct.”
Private sector growth rebounds as job creation rate remains solid - PMI report
Growing middle-class keeps banking sector afloat despite headwinds
Kenya’s private sector firms reported solid improvement in business conditions during the month of November after having seen growth ease to a four-month low at the start of the fourth quarter, a Purchasing Managers’ Index (PMI) survey released today by Stanbic Bank and HIS Markit has revealed. The seasonally adjusted PMI (an indicator of the economic health of the manufacturing sector) rebounded to 53.3 in November, up from October’s four-month low of 52.0. A PMI of more than 50 represents expansion of the manufacturing sector when compared to the previous month. A PMI reading under 50 represents a contraction, and a reading at 50 indicates no change. The latest figure was broadly in line with the average seen over the third quarter (53.4), although remained below the overall series trend (54.6). Contributing to growth of the sector as a whole was a sharp expansion in new work. Jibran Qureishi, Regional Economist for East Africa at Stanbic Bank said that faced with mounting capacity pressures, a number of firms chose to hire additional staff adding that the rate of job creation was solid overall. Kenya’s banking sector experienced a core earnings growth of 15 per cent for the nine months ending September 2016, despite the challenging economic environment, a new report by Cytton Investments has confirmed. The growth is attributed to new innovative products and channels as well as increased financial inclusion and growth of Kenya’s middle class. The report credits agency and mobile banking models with the reduction of operating expenses and improved efficiency. “Growth for most banks with regional subsidiaries was driven mainly by the Kenya businesses as their regional operations underperformed,” states the analysis. Deposits grew faster than loans at 7.7 per cent, but lower than the 5-year average of 14.9 per cent while non-performing loans continue to be a concern in the sector. “With the ratio of non-performing loans to total loans rising to 8.3 percent in Q3

Kenya looks to deepen bilateral ties with Saharawi Kenya’s government is looking to deepen bilateral ties with the Sahrawi, officially known as the Sahrawi Arab Democratic Republic (SADR), a partially recognized state that controls a thin strip of area in the Western Sahara region and claims sovereignty over the entire territory of Western Sahara. Kenya has affirmed her support for Saharawi’s quest for full selfdetermination and its membership to the African Union. Speaking when she made a historic visit to the Western Sahara country on Sunday, Foreign Affairs Cabinet Secretary Amb. Amina Mohamed said Kenya will not hesitate to support SADR whose section of its territory is occupied by Morocco. The SADR government is based in the Tindouf refugee camps in Algeria. It controls the area east of the Moroccan Wall in Western Sahara which it labels the “Free Zone”. “Kenya fought for its self-determination and supports the people of Saharawi whose land is still occupied. The suffering the people of this country have undergone should come to an end,” said CS Mohamed.

Ending fishing subsidies will safeguard millions of jobs - Kituyi Kenya, along with other developing countries, can protect millions of fisheries-related jobs by negotiating an end to fishing subsidies at a top-level World Trade Organization (WTO) meeting scheduled for December 2017, UNCTAD Secretary-General Mukhisa Kituyi has said. Dr Kituyi has argued that overfishing puts global fish stocks under pressure, and many of these jobs appear unsustainable. He says it is estimated that about $20 billion (Sh2 trillion) per year worth of harmful fishing subsidies compound the problem by enabling industrial fishing fleets to travel to the coastal waters of developing countries and to out-compete small-scale fishermen there. “We all know that the world’s marine fish stocks are either stagnant or declining, so how do we, the global community, justify these wasteful and damaging subsidies?” Dr. Kituyi said, ahead of the release of UNCTAD’s 2016 Trade and Environment Review, which focuses on the fishing industry. “Not only do these subsidies compound the destruction of small-scale and artisanal fisheries, they also export unemployment to developing countries,” he argued. The most effective way to end these subsidies, which represent unfair competition, will be to introduce legally binding trade agreements, the SecretaryGeneral affirmed. This is best done through the WTO, the main global institution for setting and enforcing the rules on global trade, he said. The WTO’s forthcoming ministerial conference, scheduled for December 2017 in Buenos Aires, Argentina, offers the best multilateral opportunity to conclude such an agreement, he added. “Instead of subsidizing the depletion

First, the multilateral trading system and regional agreements will increasingly incorporate further marine life and fish conservation measures. Second, by 2035, the wild fish catch
will grow only slightly beyond current harvest levels, while the aquaculture harvest will rise substantially to meet growing demand. Third, the fish trade will be affected less by tariffs and more by non-tariff measures such as sustainability standards, catch certificates, traceability, eco-labelling and others. @enock_x254

Kenya invests in infrastructure projects to bring oil to market Plans are under way to put in place the necessary transport infrastructure to ship the country’s crude oil to the eastern coast with first production due to begin next year at Kenya’s newly developed oilfields in the north, new data has revealed. As of mid-October UK- and Irelandlisted oil and gas producer Tullow Oil was looking to contract trucking companies to transport the crude oil taken from the South Lokichar Basin in Kenya’s Turkana County. In a recently-released statement, Tullow Oil said it was seeking to lease 100 tankers with a minimum fluid capacity of 25,000 litres to move the early production to storage facilities in Mombasa operated by Kenya Petroleum Refineries. Currently, the South Lokichar Basin in Turkana County has around 750m
barrels of recoverable crude oil in reserves, though further exploratory drilling is scheduled in the adjacent North Lokichar Basin, with estimates that total reserves could rise to at least 1bn barrels of recoverable oil, according to a report by the Oxford Business Group. The oil blocks located in both basins are held by Tullow Oil and its partners, Canadian oil and gas company Africa Oil Corporation and Denmark’s Maersk Oil. While the initial flow is expected next year, full production should come on-line by 2020, according to a statement issued by Tullow Oil in early October. The tanker trucks are only a temporary solution, as Kenya is planning to eventually construct a 865-km pipeline linking the Lokichar Basins in Turkana County to a
refinery at Lamu Port as part of the larger Lamu Port-Southern SudanEthiopia Transport (LAPSSET) corridor, a $24.5bn project designed to provide road, rail and pipeline links to countries throughout the region. A new 32-berth deep water port in Lamu will serve as the anchor of LAPSSET, with an oil export terminal and refinery allowing for the shipping of both crude oil and processed products. Onshore construction work and dredging to deepen Lamu Port’s docking area for ships began in mid-October. Rwanda – another country that has decided to step away from the project – recently announced it was looking to develop rail links through Tanzania to the Indian Ocean, rather than connecting with the Kenyan network and Port Lamu.
Though there have been some withdrawals, both the energy component of the development programme and the broader projects are still commercially viable and progressing, according to Silvester Kasuku, Director-General and CEO of the LAPSSET Corridor Development Authority. “As the pipeline connecting the Lokichar fields to Lamu Port will complement the Djibouti pipeline, Rwanda and Uganda’s pullout of Kenyan infrastructure projects still leaves the LAPSSET Corridor projects very feasible,” he told OBG. Ultimately, Kenyan authorities hope that the LAPSSET project will benefit from exploration and production efforts elsewhere in the country. The results of further exploration in northern Kenya, along with the potential for South Sudan to utilise
Kenya as an export route, will support the pipeline project and other downstream facilities, Gabriel Negatu, regional director for East Africa at the African Development Bank (AfDB), told local media in late September. However, while initial flow from the Turkana fields is expected in early 2017, global energy prices will need to stabilise before Kenya’s oil exports can be viable in the long term. The price of oil should be at least $50$55 (Sh5,100-Sh5,600) per barrel to make the exploitation of Kenya’s reserves profitable, based on data issued by the Ministry of Energy and Petroleum in early October. In the medium term, with the AfDB forecasting oil prices to stabilise at around $60 per barrel next year, Kenya should see its minimum price clear as production ramps up.

The FKF Women Premier League (WPL) is set for a big boost after Sportpesa pledged to reward the women football fraternity’s hard work by sponsoring the league. The betting firm which currently sponsors the Kenyan Premier League (KPL) alongside Gor Mahia and AFC Leopards says it will sponsor the women league in the coming seasons. Sportpesa CEO Ronald Karauri said Kenyan women side Harambee Starlets have shown that women just need people behind them to do well. “Harambee Starlets have done a good job and we will not turn a blind eye to their progress. Sportpesa has partnered with the Football Kenya Federation to help improve all the leagues under them, and the women’s league is not an exception. We will therefore consider sponsoring the Women Premier League in the coming season, talks are underway and we hope we can continue improving the standards of women soccer by supporting their league which is paramount in the development of players,” Karauri said at the Kenya School of Monetary Studies where they launched the Arsenal training camp. The 2016 season is headed for its final stages and stakeholders will be keen to see how the new deal, if sealed, translates in the teams’ preparations for the 2017 season. Crash club Chapecoense awarded Championship
Brazilian club Chapecoense have been awarded the Copa Sudamericana by South American football confederation Conmebol after most of their team died in a plane crash en route to the final. Seventy-one people, including 19 players and staff, were killed in last Monday’s crash on the way to Colombia for the first leg. Colombian opponents Atletico Nacional, who asked for Chapecoense to be awarded the trophy, have been given a Fair Play award to acknowledge their “spirit of peace, understanding and fair play”. Chapecoense will be given the $2m (about Sh200 million) in prize money while Atletico Nacional will receive $1m (Sh100 million). Chapecoense vice-president Ivan Tozzo hailed the decision as “justice”, telling a news conference on Monday: “We were sure that ‘Chape’ would be champions. It is a beautiful tribute.” Three Chapecoense players were among six people to survive the crash. Investigations are continuing into the cause of the accident but a

recording suggests the plane was out of fuel moments before the crash outside Medellin. The small Brazilian city of Chapeco held a massive funeral on Saturday after the victims’ coffins arrived home, each draped in the club’s green and white flag. While 13,000 people have applied to become club members in the just two days.
Teams from around the world, including the Premier League, paid tribute to the players over the weekend and a minute’s silence is scheduled to be held before every Champions League and Europa League game this week. Brazil’s leading football clubs have pledged to loan players to Chapecoense for free and asked
for them to be safeguarded from relegation from the top flight for the next three seasons. Chapecoense were due to play their final league match of the season on Sunday, 11 December, but have now confirmed the fixture will not be played as the outcome does not impact on the championship or relegation. As Sudamericana champions, Chapecoense get a guaranteed spot in next year’s Copa Libertadores, South America’s equivalent of the Champions League. It also means that Chapecoense will face Atletico Nacional - the defending Copa Libertadores champions - in a two-game series next year between the continent’s two club champions. Former Brazil and Barcelona forward Ronaldinho and ex-Argentina international Juan Roman Riquelme have reportedly offered to play for the club, while another former Barca player, Eidur Gudjohnsen, has offered his services. Brazil will play Colombia in a friendly match at the end of January to help victims of the air crash.

Man City, Chelsea charged over player behaviour
Manchester City and Chelsea have been charged by the Football Association for failing to control their players during the Premier League game on Saturday. The charge follows the mass fracas in the 95th minute of the game at Etihad Stadium, which Chelsea won 3-1. City had forward Sergio Aguero and midfielder Fernandinho sent off, but Chelsea midfielder Cesc Fabregas will not face any further action. City manager Pep Guardiola apologised for his team’s part in the incident. Aguero, 28, received a four-match ban for what was his second dismissal for violent conduct this season, following a high and late challenge on Chelsea defender David Luiz. Fernandinho clashed with Fabregas in the scuffle that followed Aguero’s challenge, and the Brazil midfielder will serve a threematch ban. Both clubs have until 18:00 GMT on 8 December to respond to the charge.

Ronaldo, Mou caught up in tax fraud claims
F
irst came Wikileaks, then the NSA data hack, and now a series of “football leaks” has thrown the tax arrangements of two of soccer’s biggest personalities under scrutiny. The alleged tax avoidance schemes of Real Madrid forward Cristiano Ronaldo and the Spanish’s club former coach Jose Mourinho, who is now manager of Manchester United, have been leaked to a number of European media outlets, including Britain’s Sunday Times, German weekly Der Spiegel and Spanish daily El Mundo. CNN was unable to independently verify the reports, but the Gestifute agency, which represents the two larger-than-life Portuguese figures, has denied any wrongdoing by its clients. “Both Cristiano Ronaldo and Jose Mourinho are fully compliant with their tax obligations with the Spanish and British tax authorities,” the agency, founded by super agent Jorge Mendes, said in a statement. Mendes is the agent for both Ronaldo and Mourinho. The allegations stem from the transfer of image rights fees, worth $160 million in Ronaldo’s case, to offshore companies in areas of little or no tax jurisdictions. The revelations have caused a stir in Spain, which has been in economic crisis for most of the past decade. “The tax structure was created to steal from society,” said popular Spanish radio host Jose Ramon de la Morena. “Everyone tries to do what they can within the law, but to hide money to avoid paying taxes is to steal.” The concept of separating a star player’s club payment into two revenue strands -- one considered wages for his actions on the pitch, and the other a licensing arrangement for the use of his brand, or image rights came into play about 20 years ago with the likes of Arsenal stars Dennis Bergkamp and David Platt, according to tax expert Jeremy Cape, a partner at Dentons law firm. The benefit to the split payments is that, unlike wages, image rights can be paid offshore legally without challenge from European tax authorities - as long as the player or manager is deemed to have enough stature. “Mourinho has an image, Ronaldo has an image,” Cape explained. “If you’re the third choice keeper at Watford, you probably don’t have an image.” Mourinho has deals with a car manufacturer as well as watch and casino sponsors and the start of his tenure at United was reportedly delayed by negotiations over his image rights. Mourinho was charged a penalty of about $1.4 million by the Spanish tax authorities and ordered to pay $4.2 million in back taxes for earnings on his image rights during his three year coaching stint at Real Madrid,
which ended in 2013, according to The Sunday Times. The tax bill was later reduced in a settlement. Mourinho also faced a tax probe in the UK for about $1.9 million in undeclared revenue from image rights he accrued during his first coaching spell at Chelsea, from 2004-2007. Unlike the wages paid to Mourinho directly for his managerial duties - more than $180 million since 2004, according to The Sunday Times - his image rights went through a pair of companies in Ireland and the British Virgin Islands (BVI), according to the leaks. Similar systems of fee payments for intellectual property are used by tech companies like Google and Apple, which have drawn fire for their low effective tax rates in Ireland. In the end, Mourinho paid UK tax authorities $366,000 on the undeclared revenue of over $1.9 million in 2010 a rate of 19% - although he admitted to a “failure to meet all my obligations under the taxes act.” Mourniho is unlikely to have been personally aware of his taxation misdeeds, according to Cape. “I suspect there are just a handful of people in the football business who really have an understanding of how this works,” he said. Ronaldo has used the same system to greater effect on $160 million in past and future image rights, according to The Sunday Times, which says he declared just under $25 million of it to Spanish tax authorities. In 2014 Ronaldo surprised the business world by selling his future image rights to Singaporean businessman Peter Lim, which he described as “a very strategic move for me and my management team to take the Cristiano Ronaldo brand to the next level, especially in Asia.” The deal was seen by many as a move to bank as much as possible before the 2015 closure of a Spanish tax break which charged select foreigners half of the normal rate of 48%, according to The Sunday Times, which reported that Ronaldo was subject to a Spanish tax probe that appears to have ended. The “impatriado” law became known as “Lex Beckham,” or “Beckham’s Law,” after the former Real Madrid star who adopted it during his time with the club. The source of the leaks, who released over 17 million documents, is a Portuguese whistle-blower who formerly ran the Football Leaks website. “It is time to finally clean up football,” the source told The Sunday Times. “The fans have to understand that with every ticket, every jersey they buy and with every television subscription, they are feeding an extremely corrupt system that is only in it for itself.”
