Duale said only the woes in the Judiciary can only be addressed by the Justice and Legal Affairs Committee, adding that other agencies have failed. “I expected the CJ to invite the EACC to probe the bribery allegations, not the JSC that lacks investigative capacity. We therefore want to come in as a committee,” he said.

NGO boss risks arrest for failing to appear in court

NGOs Co-ordination Board chairman Fazul Mohamed risks arrest if he fails to appear in court for the second time in a suit involving sacked ABC Children’s Aid Kenya former representative Thorrun Helgadotirr. Helgadotirr has been sued for displacing children from school and alleged misappropriation of donor funds. Details have also emerged that Helgadotirr had no work permit from Immigration Department raising questions how the NGOs board cleared her to run charity work before her sacking in May last year. A court order enjoining NGO board in the matter was issued by Justice Joseph Sergon and certified as urgent. “It is hereby ordered that the application be and is hereby certified urgent. That the NGOs Co-ordination Board being an interested party herein be and is hereby allowed to join these proceedings,” the order reads in part. However, Fazul did not appear in court as required. Duale says CJ should take blame for graft in Judiciary From Page 1

Duale compared the rot in the Judiciary with family set up, saying if a family fails, then the father is solely responsible and Mutunga being the head of Judiciary in this instance must resign. Speaking during an interview on Citizen TV, the Leader of Majority also urged Mutunga to resign for condoning corruption in the Judiciary. “From where I sit, I think the CJ should resign. We want to tell him that he is the head, and the buck stops with him, he should clearly tell us how you want to fix the corruption allegations in the JSC,” Duale said. Duale decried how the highest court in the land has sacrificed justice at the altar of bribes. “The Chief Justice has no one to blame in this case, he is the head and should bear the responsibility alone,” he said. “I think it’s now confirmed that the Judiciary is not as clean as people perceive it, justice is being bought, and that is the biggest crime you can commit against the new Constitution,” he said. “It is unfortunate that the “cancer of corruption” has spread to the Judiciary which is tasked with the responsibility of dispensing justice to Kenyans. “What the CJ and the JSC are doing is not fair to Justice Tonui, it’s not fair to the people of Kenya. If they have the evidence against him, let them present it to the investigative institutions,” he said. At the time of going to press details of the committee meeting with the embattled judge remained scanty as the meeting was held in camera. Last Friday, JSC Secretary Anne Amadi wrote to Justice Tunoi asking him to appear before the committee this morning in the Chief Justice’s boardroom. “In light of the above and in order to shed light to the allegations, you are therefore invited to appear before the committee on February 1, 2016 at 11am at the Supreme Court Building, CJ’s boardroom, ground floor,” reads part of the letter. “The allegations in a nutshell are to the effect that your honour received more than Sh200 million from Kidero as an inducement to

rule in his favour in an election petition filed by Kabete MP Ferdinand Waititu in 2014.” Both Tunoi and Dr. Kidero have denied the claims contained in affidavit sworn by petitioner Geoffrey Kiplagat, who has claimed he facilitated the payment. The committee will be probing Tunoi’s conduct, looking at the evidence gathered against him and calling witnesses before it can prepare a comprehensive report in seven days. The image of the Supreme Court is beyond repair, Senior Counsel Ahmednasir Abdullahi has said. Abdullahi said the recent bribery allegations have put the integrity of the highest court in the land to question alleging that more judges may have benefited from the alleged bribe. However, he further advised that the principles of natural justice to be adhered to in investigating Tunoi’s bribery case, cautioning that it should be handled with a lot of caution since it is a litmus test to entire judiciary’s integrity. “I have nothing personal against Justice Tunoi” said Ahmednasir. “Last year, I made a presentation that judges should retire at the age of 70 years. Maybe this rubbed others the wrong way” he noted in reference to Tunoi’s retirement age which he is currently contesting at the court of appeal.

Deal with your errant members, Ndung’u tells political parties Registrar of Political Parties Lucy Ndung’u has called on the political parties to deal with their rogue members. Ndung’u said her office cannot deal with the ‘rogue’ members if the various politicians that sponsored them are comfortable with them. “If political parties are comfortable with rogue members, then the registrar cannot come on board to question then,” Ndung’u said this morning. She urged political parties to tighten their internal rules and regulations to tame the rogue members who continue to go against the party rules. “Politics is about belief, if I don’t believe in my party today, I have a right to move, its provided in the Constitution, there is freedom of association,” she said. Ndung’u absolved her office from failing to crack the whip on leaders who do not champion the ideals of the political parties whose vehicle they used to get into Parliament. “Disputes are dealt with political parties’ tribunal, I only deal with registration,” she said. Matiang’i cautions varsities against increasing fees Education Cabinet Secretary Dr Fred Matiang’i has advised public universities to come up with innovative ways of raising funds to support their programmes instead of relying on government funding and tuition fees. Matiang’i argued that it was not tenable to adequately fund university education by frequently raising tuition fees to fill budget deficits but instead the public varsities should look for alternative ways of raising funds. Speaking in his office during the inauguration of the Board of Trustees for Universities Fund on Monday, Matiang’i warned that any increase of tuition fees will lock out many students from poor families. “Think widely, be innovative. Be bold and courageous to break new ground in university funding. There is no limit to innovation,’’ he said. General nabbed in Uganda ahead of elections The Ugandan military has detained a general who is a long-time critic of veteran leader Yoweri Museveni, in a move likely to raise tensions in the country in the weeks leading up to a presidential election. The spokesman said Sejusa would be charged before a court martial on Tuesday but he did not elaborate on the charges. AU abandons peace keeping plan in Burundi The African Union (AU) has abandoned its plan to send 5,000 peacekeepers to help restore stability to troubled Burundi. Officials said they would instead encourage political dialogue between Burundi’s opposing sides. Burundi’s President Pierre Nkurunziza had fiercely opposed the AU plan’s to send peacekeepers. His decision last April to seek a third term in office has led to ongoing violence and fears that Burundi is sliding into ethnic conflict. AU now endorses Uhuru mass withdrawal from Rome Statue The African Union Sunday adopted a proposal by President Uhuru Kenyatta for the AU to develop a road map for the withdrawal of African nations from the Rome Statute. The proposal was adopted together with a report by the AU Ministerial Committee of Ministers of Foreign Affairs, that draws a red line for the ICC over how it has been handling the case against Deputy President William Ruto and Joshua arap Sang. The document asks the ICC to terminate the case against the DP and Sang as the case lacks any believable evidence. President Kenyatta said Africa should make a powerful statement that reflects its refusal to be carried along in a system that has no regard for the sovereignty of nations and tramples on the security as well as the dignity of Africans. Boko Haram kills over 80 in Nigerian village Scores of people, including children, have been killed in a Nigerian town by Boko Haram fighters who shot at villagers and set fire to their homes in the latest deadly attack by the Islamist militant group. The attack took place at the weekend in the village of Dalori, which lies about 12km (seven miles) from the northern city of Maiduguri, the birthplace of Boko Haram and the biggest city in Nigeria’s north-east. Some 86 people died after Boko Haram fighters arrived in the village, initially

Nairobi to host Tokyo International Conference on African Development Kenya is set to host the sixth Tokyo International Conference on African Development (TICAD) in a move that will position the country as a leading investment destination. President Uhuru Kenyatta has said that the sixth edition of the conference, which Japan cosponsors with the United Nations and the African Union, will be held in Nairobi on August 27 and 28 this year. Making the announcement, President Kenyatta held a joint news conference with Katsuyuki Kawai, a special adviser to Prime Minister Shinzo Abe, in the Ethiopian capital of Addis Ababa. TICAD has been held in Japan every five years since 1993, but this year will mark the first time it has been held in Africa. The summit will now be held every three years following a request from the African Union. New research suggests that online businesses are tackling a crisis that “real-world” enterprises have failed to effectively address. During the last few years, the unemployment rate in Kenya has been constantly increasing. According to the World Bank, it has jumped from 17.1 per cent in 2011 to 17.4 per cent in 2014. That is three times higher compared to neighbouring countries like Uganda or Tanzania. “With most Kenyans looking for job opportunities in big cities, it is time to focus on something that requires little investment and can be done online from any place: e-commerce,” says a recent statement from leading hotel booking giant, Jovago. “What increases together with unemployment is Internet access,” explains the

firm. Kenya leads the African internet and connectivity sector. It is one of the countries with the fastest speeds, the lowest rates and the best infrastructure. In 2014 alone, 43.4 per cent of Kenyans had internet access. This is more than the World’s average of 40 per cent. Bamburi reaps big from SGR cement supply Bamburi Cement Limited says it has earned close to Sh1 billion from the supply of cement to the standard gauge railway (SGR) contractor, making it one of the biggest gainers from the ongoing construction of the Mombasa-Nairobi line. The cement manufacturer, a subsidiary of French conglomerate Lafarge, is among local firms contracted by a Chinese contractor to supply materials for the Sh327 billion project. Bamburi’s commercial director Geoffrey Ndugwahas said that it has supplied more than 300,000 tonnes of cement to the rail project since September 2014, earning it close to Sh1 billion. “The SGR contract has increased our production by 10 per cent to more than two million tonnes per year,” said Ndugwa. their performance in varied respects, including, in respect of compliance with tax requirements. “In respect of the recent suspension of operating licenses for two CFSs, namely Autoport and Portside Container Freight Stations, the grounds for the actions taken have been provided in the letters communicating the decision and signed by the Commissioner of Customs & Border Control. KRA

may not publicly discuss the reasons for the actions taken, as this would contravene the rules prohibiting disclosure of information on matters touching on the tax affairs of any person,” the authority said. “We note however that recent incidents and investigations in progress, have raised serious concerns over the likely involvement of some CFSs in actions that abet tax evasion. Liberty Holdings acquires majority stake in Ugandan general insurer Pan African financial services company, Liberty Holdings Limited (Liberty), has entered the general insurance market in Uganda by acquiring a 51 per cent stake in East African Underwriters Limited (EAUL). EAUL is a local Ugandan Underwriter owned by the Madhvani Group where the acquisition enhances Liberty’s position in the East African general insurance market and positions it for growth. The group already has a general insurance presence in Kenya and Tanzania trading under the Heritage Insurance brand. These companies serve both the local and multinationals client insurance needs in East Africa. Heritage Insurance Kenya owns 60 per cent of Heritage Insurance Tanzania and is one of the leading General Insurers in Kenya. Google deal with tax authorities in UK fuels ‘sense of injustice’ The UK tax authorities’ agreement with Google has fuelled a “sense of injustice” that big businesses receive preferential treatment. Google’s £130m UK tax settlement was “not a glorious moment” for the government, Business Secretary SajidJavid (pictured) has acknowledged. His comments come a week after Chancellor George Osborne called the settlement a “major success”. Google said it was in favour of reforms to make international tax clearer. However, shadow chancellor John McDonnell warned the fallout from the tax row had damaged Google’s brand.” The reputation damage to Google, I think, is immense,” he said, and suggested the “saving they have made in tax is not worth the reputation damage they have had”. Mr McDonnell also repeated a call for Google and HMRC to release details of how the agreement was struck. He has published his tax

Barclays facing Sh 7 billion trading fine

Barclays is set to be fined Sh 7 billion ($70m) for misleading investors about its US “dark pool trading” operations, says the New York Attorney General’s office. The UK-based bank has been accused of not making it clear to its clients that particularly aggressive traders, known as high frequency traders, were using the private platform. Dark pool trading operations allow investors to trade large blocks of shares but keep the price private. However, the bank declined to comment about the scandal. A formal announcement, including a settlement with Credit Suisse also over dark pool trading, is expected on Monday from the New York Attorney General (NYAG) and the Securities and Exchange Commission (SEC). As well as the fine, Barclays is expected to admit to having broken the law and will agree to install an independent monitor to conduct a review of its electronic

trading business, according to the NYAG. Credit Suisse is likely to pay a penalty of $84.3m but will neither admit nor deny any wrongdoing. “These cases mark the first major victory in the fight against fraud in dark pool trading that began when we first sued Barclays,” said Eric Schneider man, the New York attorney general. He added that “co-ordinated and aggressive government action” had led to “admissions of wrongdoing, and meaningful reforms to protect investors from predatory, highfrequency traders”. “We will continue to take the fight to those who aim to rig the system and those who look the other way.” Meanwhile Andrew Ceresney, director of the SEC’s enforcement division said: “Dark pools have a significant role in today’s equity marketplace, and the firms that run these venues must ensure that they do not make misstatements to subscribers about their material operations.’’

YOURSAY It is Joho not Raila who named road after Fidel Over the weekend I read an article in one of the local dailies of Former Subukia MP Koigi wa Mwere blasting opposition Chief Raila Odinga for naming a street in Mombasa County with his son’s name. However, what I failed to comprehend is the way Koigi draw his argument on the matter. But today I wish to make it clear to Koigi that he should understand that it’s not Raila Odinga who is the governor of Mombasa, but Hasaan Joho. I know for fact that Koigi must be a very bitter man as he thinks he is more important than Fidel which is totally wrong. But I want to invite him to get a copy of Raila’s thank you speech to Mombasa County government and the reason for naming the road from Joho. We don’t dispute what Koigi did for this country, but attacking Fidel just because the latter did not have dreadlocks is uncalled for. However, it makes us think twice of why Koigi

was fighting for a just country and human rights, maybe he was high on foreign money other than a free heart to fight for the injustice. If Koigi wanted a road to be renamed after him, it is simple, let him convince one of the governors to do that. Fidel was a hero of this generation, naming the road for a person who is buried hundreds of kilometres away from the road should trigger our minds to find out why. Fidel was not tribal. He did not choose a tribe to associate himself with. Many of us including Koigi wa Mwere have always hidden behind our tribes. Supporting our own even if they are corrupt and also suspects of criminal activities. This is not what Fidel stood for. Friends without boundaries. Jubilee initiative to connect all schools laudable The Jubilee government’s initiative to supply electricity to all learning institutions, mostly targeting primary schools is laudable. This great stride will put the schools in a better position to offer quality education as well as empower them to venture into other viable cocurricular activities that shall benefit the schools. The initiative if implemented well, could also benefit local communities. At least learners, especially in remote villages, will have a chance to

study and do proper practical lessons for the various subjects that they have not been able to undertake due to lack of reliable power supply. Riding on the back of this effort, most schools will measure up to other schools ranking in best education standards. The project will also help the Jubilee government achieve one of its grand pre-election pledge in 2013, to digitalise learning, but only I they will ensure the whole initiative is not marred by other obstacles

such as tendering hoaxes. Kenya Power, Energy ministry and other stakeholders should work in collaboration to deter any further frustrations that have slow paced the project. Kenyans are only hoping that this will not be another empty promise by Jubilee after the Standard One laptop project never was and the sports stadia that were to be constructed in Mombasa, Kisumu, Nakuru and Eldoret to help in tapping talents and empowering the youth. — Nderitu, Ummoja

Pulling out of ICC will leave Kenya more exposed The Push by the Jubilee administration led by President Uhuru Kenya for Africa to walk out of the International Criminal Court (ICC) is saddening. Uhuru, Raila portraits add no value to service delivery I disagree with Siaya Governor Cornel Rassanga, it is high time Cord governors removed President Uhuru Kenyatta’s portraits from their offices and put those of Cord leader Raila Odinga arguing that governors are not presidential appointees but politicians. It is indeed true that governors are elected unlike the County administrators such as chiefs, county commissioners and their deputies, but what value will the pictures have on service delivery to the ordinary citizens? I would have supported his argument if he proposed

Guinea will take on favourites DR Congo in semis after they beat Zambia on penalties in a quarter-final thriller in the ongoing African Nations Championship in Kigali, Rwanda. Birech, Kipyegon win IAAF Cross Country in Italy The 2014 and 2015 Diamond Race 3000m steeplechase winner Jairus Birech overcame stiff opposition from Bahrain’s Aweke Ayalew to win the IAAF Cross Country Permit series on Sunday at the San Vittore Olona, Italy. Birech led Kenyan dominance in the race which also saw Faith Kipyegon grab the women’s 84th edition of the famous Cinque Mulini meeting, the sixth of this winter’s IAAF Cross Country Permit series. Birech who got stiff challenge from Ayalew right from the start eventually won by two seconds in 34:38 after a sprint finish at the end of the11.5km race. They went through the first lap mark in 8:08 carving out an eight-second lead over Kenya’s IAAF World Cross Country Championships Guiyang 2015 junior medallist silver Geoffrey Korir. The pair then forced the pace further during the second lap, opening up a huge gap of about 30 seconds over Korir, with Birech mainly running in front and Ayalew on his heels. The leaders went through the second lap in 16:28.

Birech and Ayalew increased their advantage over Korir to 35 seconds during the third lap before Ayalew went to the front at the bell as the third lap was completed in 25:55. They then duelled throughout the final lap until 300 metres to go, when Birech launched a devastating kick at the entrance of the sports ground where the finish was placed. Korir, 19, finished a distant third in 35:24 with Uganda’s 2015 world mountain running champion Fred Musobo fourth in 35:44.
