ubilee MPs from Nairobi now want the city county’s accounts audited to ascertain whether the Sh200 million bribe alleged to have exchanged hands from Governor Evans Kidero to Justice Philip Tunoi could have been
siphoned from county funds. A petitioner had claimed that Kidero used some Sh200 million to bribe Justice Tunoi to influence the outcome of a petition that challenged his election as Nairobi governor.
A special committee constituted by the Judicial Service Commission to probe the claims last Friday recommended that a tribunal be formed to further investigate the claims against the judge noting its satisfaction that he had a case to answer. CONTINUED ON PAGE 2
Auditor General to give last word on Eurobond money
Auditor-General Edward Ouko has asked for more time to conduct a forensic audit on the use of the Eurobond proceeds. Ouko says his office will have to conduct a special audit in all ministries in the National Government before tabling the forensic report to the National Assembly’s Public Accounts Committee. We, therefore, recommend to the President that a tribunal be established to investigate the matter,” a statement read by Chief Justice Willy Mutunga said. And now, Jubilee lawmakers want the source of the funds (if at all there was bribery) used made public. The MPs led by Kabete’s Ferdinand Waititu who is also the petitioner who challenged Dr Kidero’s election, say it would be unfortunate if county funds were used to pay out the bribe as opposed to funding development. “There is no way a judgment that was influenced by money can stand the test of a fair trial. There was no fair trial in the Supreme Court under the influence of Sh200 million,” Waititu claimed. He was speaking in Embakasi North, where he had accompanied Deputy President William Ruto to a church service yesterday. “If the tribunal establishes that indeed the ruling was influenced, Kidero must vacate office to pave way for a by-election,” he said. Although Waititu has since shifted his political base from Nairobi to Kiambu where he intends to unseat Governor William Kabogo, he insisted that he will push the agenda, “until justice is delivered.” “I will pursue it to the end,” he said. Former Devolution Cabinet Secretary Anne Waiguru can now breathe a sigh of relief after she was cleared of any wrongdoing in the Sh791 million scandal at the National Youth Service (NYS). The Ethics and Anti-Corruption Commission (EACC) in a letter to Head of Public Service Joseph Kinyua said their investigations on claims against Waiguru have not yielded any evidence against her. “The Commission has conducted investigations on various allegations touching on National Youth Service and the Ministry of Devolution and National Planning. So far our investigations have not established any evidence to warrant an adverse recommendation against the former Cabinet Secretary,” the latter written by EACC chief executive Halakhe Waqo and dated February 4, stated. Lobby threatens to go to court to demand action in MPs’ allowance scam The National Civil Society Congress (NCSC) will move to court to demand accountability after a report released last year by the Ethics and Anti-Corruption Commission implicated most members in allowance scandal. The damning report released last year by the Ethics and Anti-Corruption Commission painted a grim picture of MPs claiming mileage allowance on instances even when they didn’t travel to their constituencies. The President of the Civil Society Morris Odhiambo in a statement said they will move to court soon and demand that action be taken against culpable legislators. “NCSC started its action late last year when it petitioned EACC, the Director of Public Prosecutions and the Speaker of the National Assembly to take action against the corrupt MPs. The organisation now plans to go to court in a case in which public interest is overwhelming,” said Odhiambo. He said the Constitution has given Kenyans many tools that they intend to apply in the coming weeks to demand for accountability over the saga. “Working together, citizens can apply the tools which include protests, legal action, petitioning and picketing to utilise to demand accountability in the saga involving MPs after last years’ investigations by EACC,” said Odhiambo. The report by the EACC indicated instances where an MP claimed mileage allowance
for visiting his constituency, when he had travelled to Australia on parliamentary expense for six days. “Others travelled by air, which is a cheaper option, but still submitted mileage claims as if they had gone by road”, reads the report. The anti-graft agency also found out that the names of some former MPs were still on the payroll. One MP continued to claim sitting allowances when he had already taken per diem from Parliament to travel abroad and that MPs continued to claim mileage allowances even when they were away. It also emerged that MPs are signing attendance lists for their absent colleagues to receive sitting allowances, investigations by the Ethics and Anti-Corruption Commission have revealed. Speaker of the National Assembly Justin Muturi, however dismissed the report by EACC terming it irresponsible, premature and unprofessional publication of the names of MPs before proper investigations are done. “The position of the Parliamentary Service Commission is that in respect of the parliamentary mortgage and car loan schemes, as well as other matters reported on, no evidence of any kind has been put forward in the report linking any MP to fraudulent, dishonest or improper conduct,” he said. @sam_x254

UN condemns North Korean rocket launch North Korea launched a satellite into space Sunday, its state media reported, triggering a wave of international condemnation and prompting strong reaction from an emergency meeting of the UN Security Council. Though North Korea said the launch was for scientific and “peaceful purposes,” it is being widely viewed by other nations as a front to test a ballistic missile, especially coming on the heels of North Korea’s purported hydrogen bomb test last month. Pyongyang carried out both acts in defiance of international sanctions. At an emergency meeting on Sunday, members of the UN Security Council “strongly condemned” the launch and reaffirmed that “a clear threat to international peace and security continues to exist, especially in the context of the nuclear test.” Security Council members have previously threatened “further significant measures” if there was another North Korean launch and now will “adopt expeditiously a new Security Council resolution with such measures in response to these dangerous and serious violations,” according to a statement read by Venezuela’s ambassador to the United Nations after the meeting. UN Secretary-General Ban Ki-moon said the launch is “deeply deplorable” and in violation of Security Council resolutions “despite the united plea of the international community against such an act.
Four killed in Burundi Capital grenade attack Four people have been killed in Burundi in a grenade attack on a bar in the capital Bujumbura, officials say. Among the victims was a child selling boiled eggs. Ten other people were injured in the weekend attack. Unknown attackers also threw grenades at an army patrol and at police in Bujumbura, hurting several people. Since April, more than 400 people have died in clashes triggered by President Pierre Nkurunziza’s bid for a third term. He won a disputed poll in July. The African Union is trying to persuade the president to agree to the deployment of AU peacekeepers. He is opposed to the plan, saying this would amount to an invasion. Bujumbura has recently witnessed a string of deadly grenade attacks. The government and opposition groups have accused each other of carrying out the attacks. Last month, human rights group Amnesty International published satellite images it said were believed to be five mass graves near Burundi’s capital, where security forces were accused of killing scores of people in December. A fact-finding mission by the AU has reported arbitrary killings, torture and the “closure of some civil society organisations and the media”.

Tunisia has announced the completion of the first part of a 200km barrier along its border with Libya, designed to deter terrorism. The barrier is made of sand banks and water trenches. It was announced last summer after 38 people were killed on a beach by a gunman said to have
trained in Libya. Tunisia’s defence minister said the second phase of the project would involve installing electronic equipment with the help of Germany and the US. Security forces said the defences which aim to make the border impassable by vehicles - had already helped to reduce smuggling.
“Today we finished closing it off, and this will help us protect our border, and stop the threat,” said Defence Minister Farhat Horchani over the weekend. More than 3,000 Tunisians have left to fight with the Islamic State (IS) group and other Islamist militants in Syria and Iraq but Mr

KRA, Uganda Revenue body sign MOU on e-cargo tracking The Kenya Revenue Authority (KRA) and the Uganda Revenue Authority (URA) have signed a memorandum of understanding (MOU) to facilitate the establishment of a regional Electronic Cargo Tracking System (ECTS). The MOU was signed by KRA Commisioner General John Njiraini and his Ugandan counterpart, URA Commissioner General, Ms. Akol Doris at the just concluded East African Revenue Authorities Commissioners General (EARACG) meeting, in Nairobi. “The MOU, will facilitate the integration of a regional ECTS systems to provide real time tracking of the movement of goods under customs control along the Northern Corridor, minimize diversion of goods under customs control, provide timely response to transit alerts, identify supply chain trends and hence enhance the decision making process and to safeguard national security,” said KRA Commissioner General, John Njiraini. Phase2 to target 20,000 learners The Equity Group Foundation’s ‘Wings to Fly’ programme is set to begin the second phase of its initiative following the commissioning ceremony of the 2016 Wings to Fly class of 2,000. The move is an initiative of the Equity Group Foundation in partnership with The MasterCard Foundation established to support secondary education for top performing vulnerable children in all sub-counties across Kenya. The advent of free primary school education has enabled a large number of children to access primary school education. However, a large percentage is unable to transit into secondary school due to socioeconomic challenges, particularly financial constraints. “The commissioning ceremony of the 2016 Wings to Fly class of 2,000 scholars will mark the commencement of Phase 2 of the Wings to Fly program which targets to provide 20,000 scholarships,”
the group said in a recent address. “We are grateful to The MasterCard Foundation for anchoring Phase 2 of Wings to Fly Program with a new large gift of 5,000 scholarship valued at $62 million (Sh6.3 billion). This show of commitment to Kenya is unprecedented and we are extremely grateful for this support,” added the statement. The program provided 10,377 scholarships during Phase 1, surpassing the target of 10,000. The objective of the Wings to Fly programme is to provide financial support and leadership empowerment tools to high achieving children in KCPE from financially constrained backgrounds who would otherwise not afford to join secondary school without financial intervention. The Programme offers comprehensive support for the scholars through provision of tuition fees, accommodation, books,
uniform, shopping, pocket money and transport to and from school during their 4 years of secondary education. In addition to providing financial support, the Programme also seeks to develop the next generation of leaders through leadership mentoring and social transformation Programmes. The programme targets high achieving vulnerable children (orphans, the poor and those living in especially difficult circumstances) selected by assessing their performance at the nationally administered Kenya Certificate of Primary Education Examinations (KCPE). Economy reeling under low commodity prices Kenya’s economy will this year take a series of heavy blows due in part to low commodity prices. The country, which relies heavily on agriculture, is likely to see the cost of both its exported and imported products shift in favour of more stable economies across the globe. Sub-Saharan Africa’s economies will face a challenging near-term outlook, according to the January 2016 issue of the World Bank’s Global Economic Prospects report. The study indicates that commodity prices in countries like Kenya are expected to stabilize but remain low through 2017. “The normalization of US monetary policy is expected to tighten global financial conditions,” said the recentlyreleased report. It adds that although governments are taking steps to resolve power issues, electricity supply bottlenecks are expected to persist. These factors point to a somewhat weaker recovery in 2016 than previously anticipated. After slowing to 3.4 per cent in 2015, activity is expected to pick up to 4.2 per cent in 2016 and to 4.7 per cent in 2017-18. Kenya in itself is embarking on a nationwide electrification programme to supply the masses with power ahead of a 2017 deadline. The study has found that global growth disappointed again in 2015, slowing to 2.4 per cent, and is expected to recover at a slower pace than previously envisioned. Growth is projected to reach 2.9 per cent in 2016, as a modest recovery in advanced economies continues and activity stabilizes among major commodity exporters, according to the World Bank’s January 2016 Global Economic Prospects. “More than 40 per cent of the world’s poor live in the developing countries where growth slowed in 2015,” said World Bank Group President Jim Yong Kim in a recent announcement. “Developing countries should focus on building resilience to a weaker economic environment and shielding the most vulnerable,” he added.

KRA operation nets illicit alcoholic products in City Kenya Revenue Authority (KRA) Investigations and Enforcement Department, through a sting operation, has recovered a package of alcoholic products destined for the local market as part of a major tax evasion scam. According to KRA Head of Market Surveillance, Caxton Ngeywothe portable alcoholic products, recovered from an illegal packaging plant in Nairobi’s Kasarani Industrial area, had not been affixed with the statutory Excise tax Stamps, which apply for such goods. Speaking after sealing off the Julijo Investment Limited plant, Ngeywo said that the manufacture and distribution of alcohol products is subject to stringent licensing conditions set by the authority. “KRA has stepped up its market surveillance efforts to nab unscrupulous traders perpetrating tax evasion crimes,’’
Ngeywo said. As part of the authority’s effort to adopt innovative approaches to enhance collection in sectors with low tax compliance, KRA, has successfully rolled out the Excise Goods Management System (EGMS); an automated excise stamps management solution. “All wholesalers, retailers and other outlets including consumers are reminded to purchase or offer for sale excisable goods from the duly licenced manufacturers and registered importers only,” he said. “It is an offence under Section 39(1) of the Customs Duty Act 2015 to be in possession, purchase or consume excisable goods manufactured, imported or sold by unlicensed persons,” he added. US economy added 151,000 jobs in January
The US economy added 151,000 jobs in January, helping to push the country’s unemployment rate down to 4.9 per cent. The number was lower than expected and is a sharp slowdown from December, when 292,000 jobs were added. Retailing saw the highest number of jobs created in January, at 58,000, with healthcare adding 37,000 and manufacturing 29,000. Despite the high job creation, some 39,000 jobs were lost in private education services. Trading on Wall Street suggests investors are concerned that the slowdown in job creation could be a further sign of a weakening US economy. Some analysts focused on the positive say that weaker job numbers meant another rise in interest rates was unlikely for now. “I’m a little surprised the markets reacted somewhat negatively to it,” said Sean Lynch at the Wells Fargo Investment Institute. “It is actually a pretty good number that should be welcomed by the equity markets, it takes some of the concern the Fed moves too quickly off the table a little bit.” President Obama highlighted the low unemployment rate as he plugged aspects of his spending bill to be proposed next week. The president acknowledged that there was still anxiety among Americans, but said the US economy was “stronger and more durable” then before the financial crisis.
Sub-Saharan Africa shift sugar sales to region as EU quotas end Sub-Saharan African sugar producers will shift sales to growing regional and domestic markets when exports to the European Union become less attractive after production quotas are dismantled in 2017, industry sources and analysts have said. EU sugar production is forecast to expand when quotas are lifted after September 30, 2017, diminishing import needs. Reuter’s reports. Gavin Dalgleish, managing director of Africa’s biggest producer Illovo Sugar, part of Associated British Foods, said that while the reform process had reduced the attractiveness of the EU market, it will have limited impact on the company’s growth strategy due to expectations of rising regional consumption. “The group’s ability to maximise capacity, and our strong sugar brands, enable access to the highvalue preferential markets in the East African region on preferential terms established through various regional
free trade arrangements,” he said. “We are also well placed to grow both our downstream production capacity of furfural, ethyl alcohol and cogenerated electricity and to further diversify into other higher-margin downstream products.” Rabobank estimates sugar production in sub-Saharan Africa in 2014 at 7.5 million tonnes, noting an average of 18 percent of output had been exported to the EU in recent years. The key exporters to the EU include Swaziland, Mozambique, Zimbabwe, Zambia and Mauritius. “With a growing population and continuing urbanisation, Sub-Saharan Africa is set to see a significant rise in sugar consumption in the coming years,” Rabobank said in a report. “Any decline in future import demand from the EU may not, therefore, necessarily be bad news, although the preferential access terms and generally higher prices in the EU market have made it an attractive destination for sales.”

YOURSAY CoB should work without Executive intimidation The summoning of Controller of Budget (CoB) Agnes Odhiambo and her deputy Stephen Masha at State House over alleged arming Opposition chief Raila Odinga with information regarding the the loss of Sh140 billion in the Eurobond scam is the height of intimidation and a clear indication that in deed there is more than meet the eye in the whole saga. The work of the Controller of Budget does not stops at the preparation of quarterly, annual and special reports to the Legislature and Executive on budget implementation matters of the National and county governments as others want Kenyans to believe. The office oversees the implementation of the budgets of both National and county governments, therefore it monitors the use of public funds and reports to Parliament on how the funds have been utilised, that is why in cases where a Cabinet Secretary has stopped transfer of funds to a State organ or public entity, Parliament cannot lift or sustain the suspension before the Controller of Budget gives a report to the House over the same. The Office of the Controller of Budget will investigate financial performance of the State organ or entity in question after which prepare and present a report on the matter to Parliament which will be used to approve or
renew the decision to stop transfer of funds. Under Article 252 (1) (a) of the Constitution, the Controller of Budget (independent office) has power to conduct investigations on its own initiative or following a complaint made by a member of the public on budget implementation matters. All these roles bestowed on the office by the Constitution requires autonomy to carry out. The Executive therefore cannot purport or accuses the office holder of insubordination when her roles are clear and independent. Odhiambo currently frequents hospital, for what sources linked could be as a result of too much pressure at work, the Executive should give the woman a break and remember she is a Kenyan like any other person out there and is entitled the job. Even though Odhiambo landed the job during the Grand Coalition government where Raila was a co-principal, it does not make her a Raila sympathiser. President Uhuru Kenyatta must allow independent offices more so those created to oversight government spending work in a conducive environment free of threats and summons. The government belongs to the sovereign republic of Kenya not Jubilee, not ODM or URP. Denying IEBC funds scheme to rig 2017 election The government refusal to disburse enough funds for the Independent Electoral Boundaries Commission (IEBC) is a pointer that Jubilee is out to rig the next polls. In the absence of the required funds, IEBC will not be able to register many voters to the disadvantage of some of regions. The proposed cut on IEBC budget from Sh 45 billion
to Sh 31 billion is a total joke because the population has skyrocketed in millions meaning more staff would be needed and more polling station set up for free and fair election. With this kind of lethargy on the side of the government, Kenyans should prepare for the worst managed election in 2017. As we speak Jubilee strongholds have registered more than
90 over cent voters, yet the opposition strongholds stand at as low as 30 per cent. For the Jubilee government to convince Kenyans that it is not trying to frustrate voter registration efforts, it should disburse enough funds to spur voter registration and to also purchase enough voter registration kits. — Legal hustler, Nairobi.
State must be swift, tough on anti-Uber crusaders Competition, they say, is healthy for business. In a largely liberalised market economy like ours, competition is a lot better not only because it offers variety, but because it guarantees quality. It is reportedly said that Taxi services in Kenya are among the most expensive in the world, yet in most instances clients do not get value for their money. More often than not, the vehicles are not in good mechanical condition and since many drivers operate as individuals, safety is not guaranteed. Many times people have hired taxis never to be seen alive again. Conversely, taxi drivers who operate loosely without checks and balances have also fallen prey to thugs who masquerade as passengers. The entry of Uber taxis seems to have changed the dynamics of doing taxi business in town
but ruffled quite a number of feathers. The good thing is that it is the sort of disruption that passes on the benefit to the customer. Notably, some of the grieved local operators are only employees of the mighty in power and are being used to oppose Uber for their selfish interests. Also to note is that most of the regular taxi operators have not scaled high in education and thus embracing technology poses as a challenge to most of them. Fuelled by high Internet penetration and globalisation, Uber and other firms are in a race to match consumers to services and products, while traditional capitalist models are being caught flat-footed, and protesting vigorously. Traditional taxi drivers who have ignored changing market trends in line with technology are venting their frustrations on Uber drivers.
Whereas the new entrants are making life convenient, they are doing so at the expense of already existing businesses. Left far behind are the regulatory authorities, which are furtively trying to catch up. The greatest worry is that regulatory authorities have been left far behind are have struggled to catch up with the worsening situation. Sadly, four deaths have been reported. This cannot be allowed to continue as it negates the spirit of competition, entrepreneurship and investment. Uber is a legitimate business and offers a better choice. The government must protect it. Kenya justice system is for commoners not the rich When the High Court issued arrest warrant against Directorate of Criminal Investigation (DCI) boss Ndegwa Muhoro for failing to comply with court orders a couple of days ago, the irony was, who will apply the order of arresting the DCI boss. It was a litmus test for the court and everyone was indeed fervently waiting to see what would transpire. But, just like yesterday, courts in Kenya are made for he commoner and not for big fish in the society. The lion doesn’t and will never lose sleep over opinions of sheep. It was not a surprise, therefore, to hear that the court has backed down the arrest order and instead ‘warned’

Yasir gets three-month ban for doping offence Pakistan leg-spinner Yasir Shah has been given a three-month ban after admitting to a doping offence. Yasir had tested positive for banned substance chlorthalidone in November last year. The International Cricket Council (ICC) said it accepted his claim of mistakenly taking his wife’s medication instead of his own, but stressed their “zerotolerance approach to doping”. The ban is backdated to December 27, when Yasir was provisionally suspended and will run until March 27. “I assure all fans and followers of the Pakistan cricket team that I have never taken a performanceenhancing substance nor have I ever had the intent of masking any such substance,” he said. “However, I it is true I should have ensured my blood pressure medication was stored separately from my wife’s medication to avoid being mistaken for my own,” he said.

Police beat Nakuru to return to KHU league summit Kenya Police beat Nakuru by a solitary goal to move back to the top of Kenya Hockey Union (KHU) premier league standings. Kenya now begins bid to host 2018 CHAN tourney Kenya has exactly two years to put in place the required structures as the country prepares to host the next edition of 2018 African Nations Championship-CHAN. Sports Cabinet Secretary Hassan Wario, outgoing Football Kenya Federation (FKF) President Sam Nyaweya were handed the CHAN flag yesterday to symbolise the start of a long journey of hosting the 2018 edition. Interestingly, the construction of the five stadia promised by the Jubilee Administration are yet to begin. It will be a race against time for the yet to be constituted National body whose elections are close to two months behind schedule. Other challenges FKF will be facing is the eligibility factor after they failed to comply with Sports Act 2013. All these must be done between now and end of next year in order to host a successfull tournament like the one held in Rwanda where DR Congo beat Mali 3-0 to win their second Chan trophy. Elia scored in both halves before Bolingi sealed victory with the third later as the Leopards confirmed their status as the most successful side in the history of the tournament designed exclusively for footballers playing in their domestic leagues. The Congolese, winners of the maiden edition in 2009 made light work of a Malian side, who were completely out of sort. The two sides defied the downpour that began just before kick-off, treating the packed crowd to some good piece of football and it took Congo only 29 minutes before Bolingi headed to Elia who beat Djigui Diarra between the posts with a thunderous shot for the opener. Denver Broncos stun Panthers in Bowl final Denver Broncos produced a defensive masterclass to upset the Carolina Panthers 24-10 and win Super Bowl 50. Carolina were heavy favourites, having lost only once all season and with the league’s Most Valuable Player of the season Cam Newton at quarterback. But Newton was smothered by the Broncos defence and gave up three turnovers - including one that led to a touchdown. That opened up an early 10-0 lead for Denver, quarterbacked by veteran Peyton Manning, and they never lost it. It had been rumoured the game would be 39-year-old Manning’s last, but he said afterwards he would “take time to reflect”. “It’s been an emotional week and it’s an emotional night,” he added. Newton did not have a good game, but
he was not helped by an awful display by Carolina’s receivers, with Jerricho Cotchery guilty of two particularly crucial drops. It’s a third Super Bowl title for the Broncos, while for the Panthers, the wait for their first goes on. Broncos linebacker Von Miller was named the game’s Most Valuable Player after a superb performance in which he managed five tackles, two and a half sacks and two forced fumbles. He becomes only the 10th defensive player to win the award, and the fourth linebacker. Miller, 26, was the number two pick in the 2011 NFL Draft, in which Newton was drafted first by the Panthers. Costa late strike earns Blues draw against Utd Diego Costa scored a late equaliser to preserve Chelsea’s unbeaten record under interim boss Guus Hiddink and dents Manchester United’s top four hopes at Stamford Bridge last night. United looked set to keep themselves in touch with the Premier League top four after Jesse Lingard’s goal just after the hour mark. However, United teenage defender Cameron Borthwick-Jackson was caught ball watching in the dying minutes of the game, leaving Costa onside, and the Spanish international turned home. Manchester United Goalkeeper, David De Gea denied Chelsea three clear chance while Kurt
Zouma was stretched off mid second half. De Gea was at his magnificent best to keep out Nemanja Matic’s header, a thunderous left foot attempt by Branislav Ivanovic from close range and Fabregas right foot shot as Chelsea surged forward in the final quarter in search of an equaliser. This was the seventh time that the Blues denied United the three points in eight meetings since October 2012. United dominated early on, Thibaut Courtois producing a fine one-handed save to keep out Anthony Martial who was thorn in Ivanovic’s flesh for the entire match before Jesse Lingard’s fine

Hiddink’s sixth draw in eight league games in charge leaves the defending champions seven points above the relegation zone with 13 games remaining. This was Chelsea’s first game back at Stamford Bridge since captain John Terry announced he was set to leave at the end of the season. There was no mention of Terry leaving in the captain’s programme notes and Blues fans will still be hoping he may yet extend his stay.
