Kanu: Why we never went to court over Kericho poll Kanu, which has bitterly contested the results of last week’s Kericho senatorial by-election, says its lack of confidence in the Judiciary and the Independent Electoral and Boundaries Commission (IEBC) is what forced it to resort to the media to make their complaints known. The party’s Secretary General Nick Salat said the only way their case would be known by the public was through the media. “Who trusts the Judiciary and IEBC in this country? Nobody. And it is because of this that we used the media to make our case known,” Mr Salat said. He made the remarks while responding to demands by the electoral commission that it file a formal complaint with them. CONTINUED ON PAGE 3

Chiloba also attributed the rotation of the registration kits from one centre to the other as another reason that led to the low figures which stood at 867,000 by Monday, with just two days left. “We received numerous complaints from members of the public that when they went to a particular station to register, they find the kit has been moved to another centre this discouraged them and they gave up,” he said. The CEO said they instructed their officers on the ground to come up with a schedule with details on places where the kits would be to avoid any confusion and disappointments among those seeking to be enlisted. Chiloba said the Commission is considering working with the National Registration Bureau (NRB) and the provincial administrators next time to have high number of people registered as voters. “We have also considered working with NRB so that when people collect their National Identity cards at the bureaus they are also registered on the spot, but that will only work if we get active regional commissioners,” he said.

IEBC chief executive Ezra Chiloba addresses a press conference at the commission’s headquarters at Anniversary Towers, yesterday. He is flanked by the commission’s manager for investigations Chrispine Owiye (left) and Legal Services manager Mohamud Jabane.

In general, Chiloba said there was voter apathy across the country and the commission will give a comprehensive report upon receiving full information from their officers on the ground. “The voter registration ends today, we are still waiting for reports from our officers on the ground then we will issue a comprehensive report,” he added. He also said the commission is still investigating incidents where some of its officers were harassed

and threatened by politicians and will take action upon completion of investigation. “We are not taking anything for granted and once we have evidence, we will take action,” Chiloba said. The CEO, however said the commission has learnt lessons and will strive to do better in the next voter registration exercise. “We have learnt quite a number of lessons from this exercise and the next phase will definitely be better,”

he assured. Early figures showed most constituencies in the Nyanza region were leading in the number of newly registered voters. Of the 290 constituencies, Alego Usonga, Bondo and Kisumu Central had recorded the highest turnout in the first two weeks of the registration drive, which started on February 15 with 8,824; 8,511 and 7,342 respectively. sam_x254

The Independent Police Oversight Authority (IPOA) has today commenced investigations into the death of a middle-aged woman who died in the hands of police officers after being detained at the Mariguini Administration Police station in South B estate, Nairobi. The police oversight body said that it is probing the possibility of the victim having been raped and tortured while in police custody. “We have launched investigations into alleged rape and torture of lady for mobile phone theft,” the agency said in a tweet. The woman, Mercy Nanjala developed complications in detention at the AP camp and later died while being treated at Mbagathi hospital. She had spent nine hours in the cold at the police post on Tuesday night last week. The victim was alleged arrested by the police after a complaint that she stole a mobile phone. The complainant Emily Wasike has since disappeared. On Saturday night, South B residents demonstrated and barricaded roads when they learnt of the woman’s death accusing the police of rape and murder. However, AP officers at the camp denied the claims, saying a family member had told them that Ms Nanjala had health complications. hillary_x254

Kanu: We dont trust IEBC and Judiciary

IEBC chief executive Ezra Chiloba said the commission has not received any formal complaint from Kanu and therefore the party may face sanctions for the claims they made. Kanu, which lost the mini-poll to Jubilee on Sunday claimed that their opponents used a ‘formula’ to rig the election. Party Chairman Gideon Moi termed the just-concluded by-election as a “total farce and a mockery of the democratic process”. Mr Moi said Kanu candidate Paul Sang would have won by a huge margin were it not for the alleged formula abetted by the IEBC that gave the Jubilee candidate, Mr Aaron Sang, more votes than he deserved. “It is not the first time the party is making those unsubstantiated claims against the commission. For the record, the commission has not received any complaint whatsoever of either electoral malpractice or misconduct, from the party, as required under the procedures of the Elections Act. This sustained assault is offensive to the Code of Conduct of Political Parties, which the party is a signatory to,” Mr Chiloba countered. “I have only read the complaints by KANU in the media and they have not been substantiated, we will write to them

EACC Spokesman Kairichi Marimba told Capital FM News that “plea taking has been deferred to tomorrow (Wednesday)”. “There has been a change of plan… the (Murang’a) Governor will not be charged today,” he said without giving reasons. Capital FM News however established that the change of plan was necessitated by Governor Iria’s intent to attend the funeral of former Kandara MP George Mwicigi which was to be attended by President Uhuru Kenyatta. The commission had announced that Wa Iria and his bodyguard were scheduled to be charged for obstruction and incitement on Tuesday morning, after being freed on bonds of Sh100, 000 each. They were arrested on Monday afternoon outside the Aga Khan Hospital in Nairobi over an incident in January in which Wa Iria was accused of obstructing EACC detectives who raided his house in Thika. The two were freed late on Monday after protests by their lawyer Mbugua Ng’ang’a who accused the commission’s detectives of harassing Wa Iria. “How many Governors out there are facing more serious issues than Wa Iria and yet they are detaining him this long on an offence that is bailable,” the lawyer protested before the governor was freed shortly before 8pm Monday. made, Chiloba said IEBC will give the party a formal warning, impose fine or deny them an opportunity to use public media for campaigns in the next polls. Jubilee party’s Aaron Cheruiyot won the election by 109,358 votes against Kanu’s Paul Sang who garnered 56,307 votes. But Kanu insists that their

candidate won by over 88,000 votes. Mr Chiloba however said the only complaint it received from KANU was that the Kericho by-election results were being released faster. “I think we should punish efficiency,” he remarked. Chiloba said making unsubstantiated remarks by anybody or a political

party disparages the image of the commission especially at this point when the body is preparing to conduct the general elections. He said all party agents signed forms 35A in all the polling centres an indication that they were satisfied with the results. sam_x254

Nkaissery vows to arrest Joho today

Interior cabinet Secretary Joseph Nkaissery has vowed to have Mombasa Governor Hassan Joho arrested by 2pm today if he fails to surrender his gun as was ordered. In a meeting with the Senate Committee on human rights today, Mr Nkaissery said the governor would be arrested today if the fails to heed the order. “Go tell Joho the general has said he should bring his guns by lunchtime,” Nkaissery told Senator Boni Khalwale who had asked him what next following the gun stand-off. Mr Joho has already appealed against the decision to have him surrender his guns.

But the CS maintains that he can only appeal once he has surrendered his firearms. Kakamega Senator Bony Khalwale pleaded with Nkaissery while calling for a truce on the standoff saying the public opinion has already engaged in politics over it. The CS however urged the Senator to place a call to Joho saying the state was serious. “By 2pm I will have arrested the governor and he will be in Jail. The law is very clear on the mandate I was given,” Nkaissery said. According to the minister, Joho’s display

of public anger may lead to misuse of his firearm. “I am saving the two (Waititu and Joho). They can shoot each other,” he told the committee. He said Waititu has already surrendered his gun which was also withdrawn by the Inspector general as well. “Waititu has no single gun,” Nkaisserry told the Senate human rights committee. The general told off Joho’s attack on his office saying the position of Deputy ODM party leaderhe holds was courtesy of him while still a senior member of the party. sam_x254

Putin orders surprise Syria withdrawal In a surprise move, Russian President Vladimir Putin has ordered his military to start withdrawing the “main part” of its forces in Syria from today. He said the Russian intervention had largely achieved its objectives. The comments come amid fresh peace talks in Geneva aimed at resolving the five-year Syrian conflict. Russia is a key ally of Syrian President Bashar al-Assad, whose office said in a statement he had agreed to the move. The pullout was “in accordance with the situation on the ground”, the statement said. Russia began its campaign of air strikes in Syria last September, tipping the balance in favour of the Syrian government and allowing it to recapture territory from rebels. “I consider the mission set for the defence ministry and the armed forces on the whole has been accomplished,” Mr Putin said in a meeting at the Kremlin. “I am therefore ordering the defence ministry to begin the withdrawal of the main part of our military force from the Syrian Arab Republic from tomorrow.” Mr Putin said that Russia’s Hmeimim air base in Latakia province and its Mediterranean naval base at Tartus would continue to operate as normal. He said both must be protected “from land, air and sea”. Syria’s opposition cautiously welcomed the Russian announcement. “If there is seriousness in implementing

Four French nationals among 21 people killed in Ivory Coast beach terror attack Four French nationals are among the 18 people who were killed by Islamist militants at a beach resort in Ivory Coast on Sunday, the French President Francois Hollande has said. intentions are,” said White House spokesman Josh Earnest. President Obama has discussed the development with Mr Putin in a phone call, the White House and the Kremlin said, giving few details. Separately, US officials said Washington had received no advance warning of Mr Putin’s statement. Russia has achieved its main goals in the intervention - consolidating President Assad’s position, enabling his forces to re-take key pieces of strategic territory and ensuring that Mr Assad remains a factor in any future Syrian settlement. Russia has long insisted its bombing campaign only targets terrorist groups but Western powers have complained the raids hit political opponents of President Assad. The UN’s envoy to Syria, Staffan de Mistura has meanwhile described the latest peace talks as a “moment of truth”. He said there was no “plan B” should the talks fail, with the only alternative a return to war. A cessation of hostilities agreed by most participants in the conflict began late last month - but there have been reports of some violations on all sides. In the latest fighting, Syrian government forces are reported to have advanced on socalled Islamic State’s (IS) positions near the world heritage site of Palmyra.

of the attack and promised that security in the country, the world’s leading cocoa producer, would be stepped up. “These cowardly attacks by terrorists will not be tolerated,” he said. He met ministers on Monday in an emergency meeting and announced three days of national mourning. AQIM has been behind two other similar attacks in West Africa in the last four months, attacking hotels in Mali and Burkina Faso. Ivory Coast has been identified as one of several countries in West Africa at risk of being targeted by Islamist militants. A witness to Sunday’s attack told AFP news agency that “heavily armed men wearing balaclavas” had opened fire near the L’Etoile du Sud hotel, which was full of foreign visitors. One of the people on the beach, Belgian Charline Burton, told the BBC she grabbed her daughter and ran to hide in a toilet. “We could hear them shooting so we could hear that they were going right next to where we were. It was a miracle the baby didn’t cry,” she said.

Italians killed on anti-poaching patrol An Italian father and son have been shot dead during an anti-poaching patrol in Zimbabwe, officials say, in an apparent case of mistaken identity. Claudio and Massimiliano Chiarelli were killed on Sunday by wildlife rangers in Mana Pools National Park. They belonged to a volunteer antipoaching unit and were shot while repairing a fault on their vehicle. The elder Mr Chiarelli worked as a professional hunter, running safaris for European tourists. Born in the Italian city of Padua, Claudio Chiarelli lived in Zimbabwe for more than 30 years, where his son was born. The President of the Zimbabwe Safari Operators Association, Emmanuel Fundiram, told the BBC his death was a “huge loss not only to the family but the hunting fraternity in Zimbabwe”. The two men had been deployed to relieve conservation officials despatched to follow the trail of suspected poachers. “The rangers... saw movement in the thicket, heard voices and opened fire, accidentally shooting and killing on the spot the pair,” the park’s authority said in a statement. The incident is under investigation. Mana Pools has long been a target of poachers who kill elephants for their ivory.

‘Foreign statistics on HIV/Aids misleading’ Foreign data on HIV/ Aids is inaccurate and cannot be used to inform policy formulation in fight against the visrus, National Aids Control Council (NACC) has said. According to the council, statistics being relayed by the World Health Organisation (WHO) and other foreign research bodies do not match the current situation in the country, which has been a major setback in eradicating the disease. Speaking today at the launch of the Domestic Financing of the Kenya HIV/ Aids Research Agenda forum, the NACC director Nduku Kilonzo (pictured) said that recent analysis done locally differed with those given by other external research

institutions. “As a country, we must generate our own information to inform our policies if we are to win this war, we can longer rely on foreign information,” said Ms Kilonzo. Citing statistics, WHO claims that stigma prevalence in Kenya stands at 45 per cent whereas, NACC asserts it at 75 per cent. Other contrasting figures by WHO indicate that prevalence rose by 0.5 per cent in the last two years while local research indicates a rise of 0.2 per cent. She argued that over reliance on donor funding and limited engagement of researchers with policy needs have yielded in a weak translation of research findings into policies which as a result have slammed the war against HIV. “We have over relied on donor funding and research finding that have scaled down our spirited fight against this war. We must

change tact going forward,” she added. Kilonzo said that the country requires close to 4.3 billion to fully meet the domestic financing. From the research, NACC will also target to identify feasible and practical domestic financing options including additional funding from the National Treasury and the local business community. According to Councils’ 2015 financial report, more than 90 per cent of the cost in fighting the dragon was largely donor funded, which now they want reduced to a cap of 20 per cent. “We are appealing to the government and philanthropies to direct more funding to win this deadly disease,” appealed Kilonzo. She added: “We shall work to ensure that two per cent of the GDP to the National Research Fund (NRF) and 10 per cent of total HIV spending will focus on our domestic research and policy formulation.” She urged county government to intensify the war within their ranks especially those that are recording high prevalence rates. NACC statistics reveal that HIV stigma and prevalence is still high in Nyanza at 20.02 per cent, and lowest in Wajir County with 0.2 per cent . Prevalence rates in the country has however largely dropped from 7.2 per cent to 5.6 per cent meaning there is a considerable decline in HIV infections by 1.2 per cent margin in the last two years. wilson_x254

State law office to move to counties You will no longer travel to Nairobi to access services at the State Law office as the facilities will be available in counties, Attorney General Githu Muigai (pictured) has said. Muigai said plans are at advanced stage to decentralse all the services offered by the Office of the Attorney General and by extension the Department of Justice to all the 47 counties. He said that services such as registration of marriages and businesses, legal profession oversight, litigation, advocates complaints as well as the administration of estates and trusts will soon be available at the various county headquarters. Speaking yesterday during the council of Governors Forum in Naivasha, AG Githu Muigai noted the services his office intends to devolve are those that are most sought and initial to a number of Kenyans. “In the spirit of evolution we want to bring all the facilities available in my office closer to the people here at the grassroots so that we can ease the process of service delivery to Kenyans,” said Githu. “Plans are underway to have services such as registration of marriages and businesses, the administration of estates and trusts devolved to all the

counties” he added. The AG explained that some services have already been rolled out in 16 counties in partnership with the Judiciary and Directorate of Public Prosecutions and are located within the precincts of the High Courts. “Decentralisation of the services has already started in many areas where the offices of the national government coordination (County Commissioners Offices) undertake services such as registering marriage as well as public trustee functions” he said. The AG reiterated that there would still be a challenge for the physical presence in many areas especially where internet connectivity remained a challenge in accessing government services. Improved import costs help ERC bring down cost of fuel The Energy Regulatory Commission (ERC) has marginally reduced pump prices in its latest review to be applied for the next one month. The marginal decline has been attributed to improved costs in the month of February compared to January as well as lower prices in the international markets. In the new price cut, a litre of super petrol has gone down by 92 cents to retail at Sh85.58 per litre in Nairobi, the cost of diesel has fallen by Sh2.18 to Sh65.70 while kerosene dropped by Sh2.53 to Sh42.15 per litre. ECR Director General Joseph Ng’ang’a said in a statement that there has been a resurgence in the price of crude oil in the international market, with the price retailing at $40 a barrel influencing the future pricing of petroleum products locally. “The changes in the maximum allowed pump prices are as follows; Super petrol reduces Sh0.92 per litre, diesel reduces by Sh 2.18 and Kerosene by Sh 2.53 per litre,” ERC Director General Joseph Ng’ang’a said in a statement on Monday. During the review in February

Transport ministry kicks off Mombasa Gate Bridge survey

The Ministry of Transport and Infrastructure has commenced the design for the construction of the Mombasa Gate Bridge, a move that seeks to reduce traffic congestion within Mombasa Island and to develop the Likoni Area of the Southern Coast region. The design of the bridge is being cofinanced by Kenyan government and the Japan International Cooperation Agency (JICA). The project involves constructing a bridge between the mainland and the Southern Coast in Mombasa. The first phase of the project will be conducted until July this year while the second phase will go up to February 2017. The Ministry said a survey team arrived on Monday to start their work. Financing for the actual construction work will be determined after the completion of the survey. “The design study commences on March 14, 2016 and the final report and designs will be ready by end of March 2017,” Infrastructure Principal Secretary Eng John Mosonik said. The Mombasa Gate Bridge will offer an alternative passage to the Likoni Ferry, operated by the Kenya Ferry Service that is currently the only available crossing between Mombasa Island and the South Coast. For many years, the idea of building either a bridge across the channel has been floated but implementation of the same has been put off due to various reasons, foremost among them being lack of funds. CBK to hold monetary policy meeting as lending rates soar

The Central Bank of Kenya (CBK) will hold its monetary policy meeting on March 21 to discuss, among others, the country’s key lending rate. The high rates resulted in a drop in cash lending from Kenya’s banks. The last time the Monetary Policy Committee met last year, it raised its key lending rate by three percentage points to 11.5 per cent in a bid to rein in inflation which was a result of a sharp weakening of the shilling against the US dollar. Inflation has hit consumers hard in the past year as the cost of some goods and services experienced marginal spikes. However, the cost of goods has fallen in recent weeks. Based on recent data from the Kenya National Bureau of Statistics (KNBS), the cost of housing, water, electricity, gas and other fuels also recorded a decline of 1.81 per cent in February, mainly contributed by a decline in prices of kerosene and cooking gas. KNBS numbers indicate that

electricity costs remained the same as January 2016. Transport Indices also decreased by 1.62 per cent from the previous month due to a decrease in costs of petrol and diesel. The MPC’s next meeting comes at a time when borrowers, stakeholders and the banking industry at large are set for a raft of changes set to shake up the sector. At the beginning of this year, CBK Governor Patrick Njoroge met with Chief Executive officers of commercial banks to discuss the high bank lending rates and how to keep them at manageable levels. At the time, Njoroge noted it was unfortunate that large banks were hiking their rates despite them having liquidity. The commercial banks’ lending rates hit 17.4 per cent in December 2015, up from 17.2 per cent in November 2015 and 15.7 per cent in August 2015. The rates have been described as troubling with borrowers feeling most of the pinch. Dennis_x254

Kebs’ new system to reign in counterfeiting with IS Mark TUESDAY, MARCH 15, 2016

Kenya Bureau of Standards (Kebs) is set to introduce a new Import Standardisation Mark (ISM) to deal with skyrocketing cases involving the counterfeiting of its quality marks. NBK received the coveted Global award for excellence in BPM and Workflow which recognises excellence in automation of workflow and business process management in organisations around the world. “NBK was looking to re-invent their business processes and workflows to enable greater efficiency and client satisfaction. This full banking organisation process automation project has delivered up to 90 per cent efficiency at the bank resulting to 80 per cent overall cost reduction. This award is in recognition of superior business process systems deployed by the bank in 2015,” Boston based WfMC said. National Bank managing director and chief executive officer Munir Sheikh Ahmed said the bank continues to achieve exceptional performance following the implementation of the project and others under the transformation programme launched in 2013. ‘’Our vision remains trained on transforming

the home-grown Bank into a modern, innovative and competitive tier 1 lender,” he added. The Award certificate was delivered to NBK by WfMC member Diwakar Nigam of NewGen Software Technologies. End to end business process automation was part of NBK’s goal for a successful phase 1 of the transformation plan. In addition, the program has achieved the reorganization of skilled workforce, redesign of banking halls for airy modern feel, launch of new differentiated products and deployment of new banking technologies which has injected new efficiency and competitiveness in the 48 year old lender. Munir said the ongoing phase 2 of program is expected to achieve Top Tier status for NBK and greater returns to shareholders as Bank consolidates gains from fast expanding national branch network, customer base and improving performance. The freshly re-branded bank edged out KCB, Equity and other banks last year to win the 2015 best bank in customer service award by the Institute of Customer Service Kenya. Dennis_x254

security features, the new mark is buoyed by a tracking software technology, helping the agency to account for each and every sticker found in the market. ‘’The purpose of the new ISM is to deal with rampant faking of KEBS, providing a platform for customers to directly authenticate the validity of certification of goods online before purchase,’’ he said. ‘’The move will also help us carry onfield-real-time validation and verification of goods bearing Kebs marks,’’ he added. To validate the marks while still in the market, the new ISM has a quick response code encrypted with details about the product.

Furthermore, he ascertained that the move will also do away with harassment of other law enforcement agencies since genuine marks can easily be validated through Kebs SMS platform since each mark has its own unique number for validation. However, the new mark will be applied to all goods entering the country except medicines, medical devices, pest control products, seeds and printed material. The move comes just as Kebs has continued to intensify the fight against counterfeit products in the country where it netted and destroyed goods worth Sh20.7 million in Athi River in February 2016. enock_x254

UNCTAD meet to bolster development in the wake of global financial challenges A United Nations Conference for Trade and Development (UNCTAD) to be held in Nairobi will provide a unique opportunity for the organisation to build its legacy and address the future of development, Foreign Affairs and International Trade, Cabinet Secretary Amina Mohamed has said. Speaking during an information session at the United Nations Complex in Geneva on Monday, Ms Mohamed said recent global economic and financial crisis as well as the slowdown in international trade underscored the need for systemic reforms. She said the role of UNCTAD in promoting trade as an engine of development is critical in facilitating the integration of developing countries into the global economy. “As the first UN conference of the post-2015 era, it will represent a starting point to translate the heightened ambitions and commitments of the international community into concrete plans of action,” said CS Mohamed. The CS appreciated the honour bestowed upon Africa and Kenya in particular to host UNCTAD 14 (also known as the 14th Session of UNCTAD) and pledged to ensure a transparent and supportive role as a host. The conference will be held from July 17 to July 22, 2016 at the Kenya International Convention Centre (KICC), Nairobi.

Foreign Affairs and International Trade, Cabinet Secretary Amina Mohamed speaks during an information session at the United Nations Complex in Geneva on Monday. The theme of this year’s UNCTAD 14 is ‘From Decisions to Actions: Moving towards an inclusive and equitable global economic environment for trade and Development’. “The expectation is that this Conference being a multistakeholder event incorporating the Youth Forum, the UNCTAD World Investment Forum, the Civil Society Forum, and the Large Cities Forum should no doubt deliver on the theme,” said CS Mohamed. Present during the information session hosted by the UNCTAD

Secretary General Dr. Mukhisa Kituyi were Cabinet Secretaries Najib Balala (Tourism) and Adan Mohamed, (Industrialisation and Enterprise Development). This is the second time that the UNCTAD conference is being hosted in Kenya, 40 years since the fourth (4th) session that was hosted in May 1976, in Nairobi. The conference during the 4th session recognised that the fundamental economic challenge facing the international community was the lack of a systemic approach to the economic marginalization

of developing countries, which stemmed from their exclusion from meaningful participation in international economic decisionmaking. “One key area was, and remains, the field of commodities. A key outcome from the Nairobi conference was therefore the establishment of the Integrated Programme for Commodities in the UNCTAD Secretariat,” noted CS Mohamed. The UNCTAD World Investment Forum will continue to serve as the global forum for inclusive dialogue and policy formulation

on investment. The Forum brings together investment partners at the highest level to discuss challenges, opportunities and policy solutions to meet development goals including the Post 2015 Development Agenda. The World Investment Forum 2016 will provide the opportunity for the stakeholders to exchange ideas, forge partnerships and launch actions. The Forum will therefore facilitate engagements and effective networking through a rich diversity of high-profile events. CS Mohamed assured the meeting of the Kenya government’s commitment to ensure the Conference is a success. She said Nairobi will contribute to UNCTAD’s legacy of defining the Future of development. ”The Government is committed to ensuring that the conference is a resounding success and we look forward to your continued support. I look forward to receiving in Nairobi,” stated Ms. Mohamed. A multi stakeholder, National Preparatory Committee is spearheading the preparatory process. The preparatory team is currently addressing various logistical issues, which will be elaborated further in the presentation as well as in bilateral engagements during this session. Some of the key logistical issues relate to; Conference and Accreditation facilities; Protocol and Liaison; Visa requirements; Security, Transport and Hospitality; and Accommodation. Dennis_x254

Fastjet CEO quits after Sir Stelios calls for his immediate dismissal

Appetite for healthy foods now prompts Apollo to buy outlet Private equity group Apollo has agreed to pay $1.3bn (Sh132 billion) for grocery chain The Fresh Market. Shares in the health food-focused supermarket chain shot up more than 23 per cent after the announcement. The Fresh Market, which has 186 stores across the US said in October it was looking for potential buyers. The Fresh Market’s founder, Ray Berry, and his son Brett Berry agreed to roll over their 9.8 per cent stake in the company and will stay on after the purchase. The Fresh Market’s chief executive officer,

Rick Anicetti, said the deal “recognises the value of The Fresh Market’s strong brand and significant growth prospects, while providing stockholders with an immediate and substantial premium”. Apollo will pay $28.50 a share, a 24 per cent premium on the stock’s closing price at the end of last week. The Fresh Market has been working to grow its footprint and challenge high-end competitors like Whole Foods. The deal is expected to close in the second quarter for 2016.

The boss of Fastjet is stepping down two weeks after the African budget airline’s major shareholder Sir Stelios Haji-Ioannou called for his immediate dismissal. Ed Winter, the company’s CEO will leave this week following three profit warnings in the last 12 months. Fastjet appointed a head-hunter in January to find a replacement, but said Mr Winter would stay for 12 months as an advisor. Last month, in a letter to Fastjet chairman Colin Child, Sir Stelios said he had “lost faith in the management and current board”, adding that “unless the board does some serious cost cutting the company will soon run out of cash.” In its most recent profit warning earlier this month, Fastjet admitted that it may need to raise more funds. Sir Stelios, the founder of low cost airline EasyJet, holds a 12 per cent stake in Fastjet. He had also called for Krista Bates, Fastjet’s general counsel, to leave. The company announced on Monday that she will step down immediately. Mr Child will become executive chairman until a replacement for Mr Winter, who was

chief executive for four years, is found. Shares in Fastjet fell 1.1 per cent to 36 per cent.

Football fanaticism has greatly increased given the access that television has provided. Gossip and small talk has shifted from sitting rooms to bar counters and now into memes. Diehard fans geared towards having their team’s win, throng television stadiums set across the country. It is a do or die affair with high stakes in cash thanks to increased betting tendencies and emotions at play. On Sunday, there was an apt and passionate charge, spreading like bushfire across social media after the dearly beloved Arsenal lost 1-2 to Watford. Arsenal fans who had, had a small breather after the exit of Sir. Alex Ferguson, have now found themselves in a tight spot again. It is one of those moments where, shielding from funny affronts from rival fans does not work. Non-Arsenal fans had a field day on streets and on social media throwing memes left right and center and cheekily laughing at the Arsenal loss. To begin with @

You maY go from dinner with Your current partner to shooting Your ex a quick facebook message to saY hi.

For the Maasai, cattle are everything: food, material, culture, ritual. Cattle are life. “I hope your cattle are well”, they say in greeting. The Maasai believe that Ngai (God) entrusted all the world›s cattle to them for safe-keeping when the earth and sky split at the beginning of time, and this is how they justify raiding cattle from other tribes. As the Maasai traditionally eat neither fruit nor grain, milk, either fresh or curdled, is the basic food staple, and is often drunk mixed with blood (the mixture is called nailang’a) in the dry season, when milk yields are low. It is generally stored and carried in long, decorated gourds which are washed with urine (despite our western preconceptions, urine is totally sterile when fresh, and thus acts as a mild antiseptic). Milk itself - the gift ofNgai’s cattle - is symbolized on ceremonial occasions by the application of a mixture of white chalk and water to the bodies of participants. Once a month, blood is also taken from living animals, usually to be mixed with milk.. The Maasai believe the blood makes them very strong. Curdled blood is called osaroi. The living animals also provide dung, which is used as fuel and to plaster houses. The urine has some medicinal and cleansing qualities, and is also used in building. Cattle are only rarely slaughtered, and this only in times of famine, ritual purposes (such as by warriors seeking strength before a raid), or when the animal becomes too old or lame to be of other use. Instead, meat is obtained from large herds of sheep and goats (around 150-200 per family) which the Maasai also keep.

Dear Concerned,

communicate with and rely on a romantic relationship from your past. You are limiting your relationship By keeping your ex in your life, you may be limiting the potential of your current relationship. One study found that staying close with an old flame can seriously affect the foundation of an existing romantic relationship. Consider all the time and energy you put into maintaining a relationship with your ex when that time and energy should go into building your current relationship. You’re hurting yourself You may have considered how your relationship with your ex could hurt your partner and your relationship, but keeping an ex on the back burner can also hurt your own emotional growth. By not letting go of the past, you’re keeping yourself from moving forward to discover the love and intimacy you deserve..

First, What she really wants is for you to kiss the back of her neck, stroke her waist curve – slowly. Women want to have your attention all over them as if you just seen the most perfect body ever. Now this might not be entirely true to you, but that’s what she wants. If you want to make her happy, then you might want to do exactly that. Phew! Second – It is good to give her attention and she does love it. But if you want to really get into her, you need to give her some oral attention. Third – Contrary to men’s

popular belief, your woman doesn’t want to get treated like a princess in bed. What she really wants is for you to rip her clothes off, and be ravished. Save the sweet somethings while you’re in public. Fourth – Don’t ask your woman what makes her tickle. You figure it out yourself! Dip your tongue in her ear, on her neck, her hips, and play around to find out where she’s mostly tickled. When you find it, be gentle and caress her smoothly. This will arouse the wild out of her. And then of course, get ready to roll! Women are not that difficult to please. You just click the right buttons and lick the right areas and she’s already into you more than you ever know. Touch her a lot so she knows how much you want her. That simple.

Sunday’s answers

YOURSAY Kanu Kericho mini-poll rigging claims far-fetched It is ludicrous for Kanu’s secretary General Nick salat and his associates to claim that Jubilee coalition used ‘sophisticated’ computer programmes to rig the just-concluded Kericho Senate seat by-election. More laughable is their argument that Jubilee was using the software as a pilot programme ahead of the 2017 polls, noting how critical the seat was to the ruling coalition and more so to Deputy President William Ruto. There is no way Ruto would have risked losing the seat, perceiving the grave political consequences that would had on him. The independence party has alleged that the software used geometrical progression mathematical formula to ‘steal’ votes in favour of Jubilee’s Aaron Cheruyoit. Whereas the allegations may be true, a party that has been in existence for more than five decades should not use such excuses after losing election. Kanu National chairman and Baringo Senator Gideon Moi, should by now have learnt that Kenyan politics has taken a paradigm shift from his father’s era where he commanded and it happened. In a sober view, Gideon Moi and his cahoots still live in the 70’s and 80’s where it was all about the Mlolongo system of voting. To them rigging is still done by using already marked ballot papers,

using chiefs and creating unfavourable voting environments like Museveni would do. They must realise that Kenya is in digital era. They must wake up from Independence party hype era. Things are today done differently. If for sure they have tangible facts to prove that IEBC rigged in favour of Jubilees candidate, why did they take too long to identify and make their claims public as they have done? Probably, they had to be taught what a computer software is and how it works. In every sense I would laud the Jubilee technological experts if they have truly created the ‘sophisticated’ software to rig election. They are living in the digital era that President Uhuru Kenyatta and his Deputy Ruto promised as they assumed power in 2013. Moi and his Kanu party supported Musalia Mudavadi in the last General Election presidential bid where they performed dismally garnering close to a mere 400,000 of the total cast vote. Going by such results, he should have scaled up his political game and learned new tactics. To win any election in Kenya, promises of ‘Tutajenga barabara, hospitali na shule’ cannot add any vote in your basket. He must device new tact to conquer in future polls. — Nderitu

Jubilee must shun skewed public appointments According to the Constitution, all public appointments should reflect the face of the country and no institution should be dominated by one or two ethnic tribes. As President Uhuru Kenyatta makes more appointments, he is required to have a mosaic, bringing on board as many ethnic communities as possible. Public institutions belong to

all Kenyans not a selected few. During the Grand Coalition government, one was able to establish the ethnicity of most Cabinet Secretaries by the ethnicity of the Prime minister or the President. That was not good for national integration. The same ethnicity and tribalism has been perfected in the current government with Cabinet Secretaries taking the queue

in parastatal appointments. Kenya is ethnically diverse and with this in mind, the crafters of the law thought it wise to entrench the same in public appointments. It is high time the President and his deputy refrained from practising this divisive habit. Let jobs in public institutions be open to all citizens. — Amaya Benard

NCA must ensure all unsafe buildings are vacated National Construction Authority (NCA) and Nairobi County officials should be applauded for timely action that averted deaths after a building they had condemned collapsed on Wednesday in Zimmerman, Nairobi. Two years ago, the officials found that the building was unsafe for occupation as it lacked pillars besides having weak floors. They ensured that tenants vacated before disaster struck. Had these noble steps not been taken into consideration, families would be mourning their loved ones who could

have been trapped in the debris. The NCA should inspect all buildings in the country more so in Nairobi and raise the red flag to save lives. I am convinced that there are people who could be occupying dangerous buildings without their knowledge. The authorities should also ensure only certified contractors are employed to construct buildings. Proper training and capacity building of contractors should be their core objective as this will ensure a pool of

qualified personnel. Stringent legislation should also be put in place to guide construction sector and award of tenders for the same. The country has lost lives after substandard buildings collapsed and this should never be allowed to happen again. The National and county governments should weed out unscrupulous officials who approve construction of substandard buildings that put the lives of Kenyans at risk. — Dennis mabonga

Rampant graft in Jubilee to blame for voter apathy The apathy witnessed among Kenyans during the voter registration exercise has nothing to do with funds as claimed by the Independent Electoral and Boundary Commission (IEBC), but poor governance and runaway corruption. Since 2013 General Election, nothing tangible or good can be reported about the Jubilee government save for unending scandals. The two by-elections held recently in Malindi and Kericho did not help the commission after claims of rigging marred the two mini-polls. With MPs walking with bunches of money to buy voters in Malindi, no sane Kenyan will take the commission seriously. If indeed the low turn-out is as a result of funding, then the next question will be, why would President Uhuru Kenyatta force the commission to use over Sh800 million in by-elections by appointing

elected leaders to the Cabinet yet there are many qualified Kenyans out there? Was Uhuru and Jubilee out to make the commission broke so that they are unable to prepare for the registration exercise? Kenyans are not fools. If IEBC wanted Kenyans to take them seriously, first their handling of the mini-polls could have been above board. This could have given Kenyans more so the would-be voters confidence that the 2017 General Election would be conducted in a free and fair manner. The President knew that the commission lacked funds and there were more important exercises such as voter registration and mobilisation, why did he create not only one but two by-elections? Is the government priorities upside down?— Bukende Steve

SPORTS BRIEFS British Murray beaten by world number 53

British number one Andy Murray bowed out of the BNP Paribas Open at Indian Wells with a surprise defeat by Argentine world number 53 Federico Delbonis. Playing his first ATP tournament since becoming a father last month, Murray was beaten 6-4 4-6 7-6 (7-3) in the third round. The Scot, 28, was well short of his best, squandering a 4-1 third-set lead before losing the decisive tie-break. Johanna Conta progressed in the women’s draw by beating Denisa Allertova. In windy conditions, 25-year-old Delbonis struck first, taking the first set with a break in the seventh game. An early break in the second set appeared to have put Murray back on track as he forced a decider. And the world number two looked firmly in control when he opened a 4-1 lead in the final set, only to win just one of the next six games to fall 6-5 behind.

Rugby player now safe after scrotum tear

English rugby player who needed 11 stitches to rectify his torn scrotum after a nasty injury is finally out of danger. Haydn Peacock suffered the partial dismemberment while playing for French team AS Carcassonne last month when a player from St Esteve Catalans Dragons grabbed his groin. “I took the ball off the scrum and made a half-break, and their centre had come across from the inside and reached out in a last-ditch effort and got a hold of my turnip with one hand and pulled me down,” narrated the player who continued with the game oblivious of the damage until half-time. “In all of my career I’ve never heard of anyone having anything like that happen - 11 stitches in the [butternut squash]” “I checked on it and the skin is half ripped off and I was like, where’s the doctor? Despite the tough tackle, Haydn won’t be wearing protection for future encounters. “I remember I had to strap it all up for the next game...the coach wanted me to go out and buy a cup but I’m not going to play with a cup. I got the stitches out. No dramas.”

Fifa bans South Africa trio over misconduct Three South African football officials have been banned by Fifa following an investigation into international friendlies prior to the 2010 World Cup. Leslie Sedibe, former South African Football Association chief executive, has been banned from football-related activities for five years and a Sh2 million fine. Two former Safa referees’ chiefs, Steve Goddard and Adeel Carelse, have each received two-year bans. The sanctions relate to the proceedings against Lindile Kika, who last October was banned from all football – related activities for six years. Kika denied being involved in match-fixing. Fifa found the officials guilty of infringements of its code of ethics relating to general rules of conduct, loyalty and duty of disclosure. All bans come into force immediately. “We are glad this matter has ultimately reached this stage since Safa reported the matter to Fifa almost four years ago,” said Poobalan Govindasamy, chairman of the Safa ethics committee.

Ndiku leads Kenya to World Indoor Championship in US World Championship 500m silver medallist Caleb Ndiku and Augustine Choge will lead Team Kenya to the World Indoor Championships. The contingent of 12 runners left the country today for March 17 to 20 games be held at Portland, USA. The team will be missing potential medal winner (Silver), Hellen Obiri, after pulling out of the competition. Choge, who bagged a wild card to the event after topping the 3000m standings at the 2016 IAAF World Indoor Tour will be out to upgrade the silver medal he won in 2012 as Ndiku is set to defend his 3000m title won at the 2014 edition in Sopot, Bulgaria. But the duo will to deal with the threat posed by counterpart Isaiah Koech, a former world

bronze medallist in 5000m. US-based trio of Edward Kemboi, Saina Betsy, who recently clocked a world-leading time in 5000m and Violah Lagat will link up with the team in Portland. “We want to set the pace in Indoor running which has not been a Kenyan specialty,” said Team Manager Francis Afundi. Meanwhile, Kenya’s Daniel Wanjiru will return to the Sportisimo Prague Half Marathon to defend his crown on April 2. Wanjiru returns to Prague after his surprising victory in 2015, when he clocked 59:51 to defeat a host of his better known compatriots. Fellow Kenyans Peter Kirui, the 2014 Birell Grand Prix 10-K champion, and Geoffrey Ronoh, the 2014 Mattoni Olomouc Half

Marathon winner will line up against Wanjiru in the Czech capital as will Abraham Cheroben, the fastest half marathoner in the world in 2015. Cheroben’s best of 58:48, set in Valencia in 2014, is only one second off the race record of 58:47 set by Ethiopia’s Atsedu Tsegay in 2012. Like Wanjiru, Ethiopia’s Worknesh Degefa will be defending the women’s race. She was a revelation in overcoming a classy field to win in Prague last year, winning by over a minute in 1:07:14. The 25-year-old appears to be in fine form currently, judging by her victory on Sunday in the Roma-Ostia Half Marathon with personal best of 1:07:08. @elvince_x254

Marksman Otundo wins BM/IG Long bow shooting competition General Service Unit sharp shooter Sanford Otundo emerged top during the Bob Morgan Memorial Cup/ Inspector General Trophy long bow shooting competition at the Kenya Defence Forces Rifle Range at the weekend in Nanyuki. Otundo only missed two points from a possible 75, posting an impressive 73.3 scores in both 800m distances in the windy and sunny condition at the only long bow range in the country. In such severe conditions where the players have to fight the strong wind and the mirage, experience, gained over time and the in-depth knowledge of the sport can prove the difference and it not different for the snippers. “The windage and mirage at the range provided a lot of challenge, but generally I research a lot and try out

my findings from the research,” said Otundo who scored 514.33 points to beat his closest challenger and forcemate Christopher Saina. Saina collected 496.14 to the second place ahead of Ihugo whom seemed to have studied the weather in the second tournament to beat Siana by 489.27 points for the IG Trophy. At the BM Memorial Cup, Otundo scored 241.17 and 253.8 in the short and long range categories respectively to beat Moses Wachira to second place by 6.1 points. Defence Forces Rifle Association’s Wachira defeated Otundo in the long distances (255.14), he posted a much lower score in the short range shots. Kenya Shooting Sports Federation’s Full bore is captained by Wilberforce Kirema.

Man City eye maiden CL quarter-final berth Manchester City will secure their maiden Champions League quarter-final berth if they beat visiting Dynamo Kiev tonight. The Citizens hold a 3-1 aggregate lead going into the match and England goalkeeper Joe Hart said he believes his side has come of age and are capable of winning their first gong. “It’s really exciting being in this situation, going into the last-16 game with a good option of going through, doing something I haven’t done before and creating history for this club.” “It’s a really difficult tournament, but we’ve got to believe we can win it, otherwise there’s no point in turning up,” he said. City have made steady progress in the Champions League since their first debut in 2011. After group-stage exits in their first two seasons, they were knocked out by Barcelona in the first knockout round in 2014 and 2015. Manager Manuel Pellegrini who will welcome back his midfield engine, Ivorian Yaya Toure has warned against complacency and intends to field his strongest side to write the history. City however will miss the services of mid-fielders Samir Nasri, Kevin de Bruyne and Fabian Delph with injury while Rahim Sterling may start ahead of Winfred Bony upfront. City has been hit by inconsistency throughout the season, with the win in Ukraine three weeks ago and a 4-0 thrashing of Aston Villa the exceptions. City won the Capital One Cup against Liverpool, but only after a penalty shoot-out and there have been four defeats in their last eight games in all competitions including last fixture goalless draw with Norwich. Kiev will be without Mykola Morozyukwith who is sidelined with a knee injury. His absence will be a big blow for the visitors but striker Andriy Yarmolenko insisted Dynamo would fight to the end: “After we lost the first game 3-1, of course we do not have too many chances to proceed, but we are optimistic and we are

prepared to show good football which the supporters will like. If we manage to proceed, or if we cannot, we will try to show quality football.” In their previous encounters in 2011, City won the return leg 1-0 with a man down after Mario Balotelli was red carded. They lost the first leg 2-0. Elsewhere, Atletico Madrid will be without defender Stefan Savic (thigh) and midfielder Tiago Mendes (leg) when they host PSV Endhoven.

The two teams played a 0-0 draw in the Netherlands three weeks ago but Atletico have since won four La Liga games in a row and are second in La Liga, eight points behind leaders Barcelona with nine games remaining. Diego Simeone men will start as favourites to advance to the quarter-finals for the third successive season. Dutch champions PSV will be without Uruguay Under-20 forward Gaston Pereiro, who is suspended.

DANGER MAN: Manchester City hit-man Sergio Aguero will lead the line for Citizens as they search for their maiden Champions League quarter-final qualification. Man City won the first leg in Kiev 3-1 and will be favourites tonight.

Rachier dismisses calls for Gor Mahia elections Gor Mahia chairman Ambrose Rachier has dismissed calls for club elections on April 3 illegal. Rachier, who was reacting to an earlier statement sent to the news rooms on Monday evening calling for election, said those calling for the polls are not bonafide officials of the club. Rachier whose term has since expired told members to ignore the notice sent by Josiah Oliech and copied to the Football Kenya Federation (FKF), Kenya National sports Council, Stadia management Board and the Provincial Police officer as the club’s council member. “The attention of Gor Mahia Football Club management has been drawn to a “notice” on the club’s official letter headed paper dated Sunday, March 13, 2016. The said “notice” signed by Oliech

alias ‘Kwaru’ claims to be calling for an Annual General Meeting (AGM) with elections as an item on the Agenda. “Oliech has clearly stolen the club’s official letter head and used it spuriously to mislead Kenyans. The authority to convene an AGM and to call for club elections vests in the Gor Mahia Executive Committee (EC) of which the above named imposter is not a member. “I would like to categorically dismiss this purported notice with the contempt it deserves: Pursuant to Gor Mahia club Constitution, Societies Act and the Sports Act 2013, Oliech has no authority whatsoever to give such notice or even speak on behalf of Gor Mahia FC. Rachier however did not commit to any possibility of the election any time soon, he however promised that the EC

will convene an AGM in line with the constitution and the Societies Act at which meeting the EC will update the members of the club on relevant state of affairs regarding compliance with the Sports Act 2013. “I want to reassure the members of the club that the EC remains committed and determined to steer the club towards transparent and accountable management and greater success. Interestingly, Gor Mahia still operate as a society, almost two and a half years after the Sports Act came into existence. According to Sports Act 2013, all clubs and federations which were registered under the Societies Act were supposed to register afresh with the Sports registrar. @elvince_x254

Foxes restore 5-point lead

Leicester City rudely welcomed Rafael Benitez t the English Premier League with a 1-0 win over Newcastle Untied to open a five point gap at the top. Shinji Okazaki’s spectacular overhead kick earned the Foxes three points with just eight games left, moving them closer to their first league title after surviving relegation last season. An improved Newcastle went close through Ayoze Perez and Moussa Sissoko, but ultimately Leicester’s pressing foiled them and the defeat leaves the Magpies second from bottom. Before the match, Leicester boss Claudio Ranieri refused to accept his team were favourites to win the title, insisting that qualifying for the Europa League was the target. But as Ranieri gesticulated on the side-lines in the closing minutes, urging the home fans to increase their decibels, his actions suggested that he and his team are chasing more than a chance to compete in Europe’s second-tier competition. The next two games are central to Newcastle’s survival hopes as they host Sunderland, a point a drift of them in what should be a tasty derby with the Magpies off the relegation zone on goal difference only. With every passing week, the prospect of the Foxes achieving what their former striker Gary Lineker describes as possibly the most “unlikely triumph in the history of the sport” becomes more likely. Leicester travel to Crystal Palace to face

a side who have not won in the league in 2016, but have progressed to the semi-finals of the FA Cup. Ranieri’s troop are 12 points clear of Manchester City and 11 ahead of Arsenal, leaving many to believe the title is a two-way fight between the leaders and second-placed Tottenham. This match perhaps came too soon for Benitez to whip Newcastle into shape, having only taken over from the sacked Steve McClaren last Friday. The Magpies started like a team buoyed by the Spaniard’s appointment, engineering two chances early on. And their deep defensive line initially caused the hosts problems, but once Okazaki struck, the Foxes took control, attacking with pace and defending in packs. There were hints that Benitez can revive a team which has struggled all season, but the former Liverpool boss has just nine games to save Newcastle from relegation. Had Sissoko possessed the poise to find a team-mate when the visitors had a threeon-two advantage they could have equalised, while the Frenchman sweetly struck volley was blocked by Morgan later on Benitez had said he had “done the maths” and that he was positive of survival, but for that optimism to remain, the Magpies, who have now lost 17 of their 29 league matches, must beat fellow strugglers Sunderland on Sunday. elvince_x254
