he Council of Governors has today demanded an immediate end to orders from the national government asking the county chiefs to account for the funds disbursed to the devolved governments. The Council’s Vice-Chairman Salim Mvurya said it is insincere for

President Uhuru Kenyatta to demand accountability from governors arguing that the two are separate governments. As such, he demanded an end to such ‘lectures’. “This narrative that the national government can pile pressure on counties to be accountable is totally a

misplaced idea and misinterpretation of the constitution,” said Mvurya. “These are two levels of government that work inter-dependently and ought to be respected as such,” added the Kwale Governor. He said the counties have remained accountable for the resources they

Mvurya was speaking today morning during a joint press conference between the Council of Governors and the Ministry of Devolution on preparations of the third devolution conference to be held in Meru from April 19-22. He revealed that the scheduled conference will offer an opportunity for the two levels of government to highlight the achievements and challenges they have always faced. Last month, during the President Kenyatta’s state of Nation address, demanded accountability from county governments saying corruption has become rampant in the devolved units. He said that it is absolutely critical that every Kenyan demands accountability from those who manage public resources. “Our nation has for long time been involved in a protracted war against corruption with mixed results that do not meet Kenyans expectations,” he said. Cabinet Secretary for Devolution Mwangi Kiunjuri said the government has invested in the Ethics and Anti-Corruption Commission (EACC) to deal with on graft at both levels of government. He appealed to the anti-graft body to do their job to make sure Kenyans are not defrauded of their resources. He further called on the governors to prudently use the resources allocated to them so as to bring services closer to the people. “Our two levels of government I must say have done a great job in the last three years. Police burst fake certificates, title deeds syndicate in Nairobi WEDNESDAY, APRIL 13, 2016

Police in Nairobi on Tuesday evening raided a building in downtown Nairobi where fake academic certificates and title deeds were being processed. Several people involved in the illegal business were arrested during the three-hour raid involving a multiagency security team on Mfangano Street. Nairobi County Police Commandant Japheth Koome says undercover detectives had been trailing the suspects and even purchased a fake Kenya Certificate of Secondary Education (KCSE) certificate at a cost of Sh20,000. “This is the kind of crime we are out to fight at whatever cost. We cannot allow this to happen,” a visibly agitated Koome said. “We must secure our country from these criminals,” he added. Koome says the suspects had almost all crucial ‘certificates’ one needs in life among them those of leading higher learning institutions in the country. “A person just needs to come to this place having a few thousand shillings and get out as a graduate,” the police boss pointed out while holding assorted certificates. “Some people have acquired certificates indicating they are trained clinical officers… these people are out there prescribing medicines to

Deported Taiwanese wanted for alleged fraud A group of Taiwanese deported from Kenya to China after being acquitted in a cyber crime case are wanted for suspected fraud in China, the Chinese government has said. Their deportation has enraged Taiwan, which has accused Beijing of abducting its citizens. China’s Ministry of Public Security, in a statement released via the official Xinhua news agency, said Kenya had decided to deport 32 Chinese and 45 Taiwanese to China, of whom 10 had already arrived and another 67 would land on Wednesday. Taiwanese had been heavily involved in telecoms fraud in China and had caused huge losses, with some victims killing themselves, the ministry added, Reuters news agency reports. The group detained in Kenya had operated out of Nairobi, and were suspected of cheating people out of millions of yuan (the Chinese currency) across nine provinces and cities in China and, as most of the victims were in China, they would be prosecuted there, the ministry is quoted as saying. The Kenyan government said the people were in the country illegally and were being sent back to where they had come from. Kenya does not have official relations with Taiwan and considers the island part of mainland China, in line with the position of Beijing.

Opposition blames government for woes in the banking sector Government lack of action against corrupt individuals is entirely to blame for the misappropriation of fund by bank managers that has now driven the sector into financial woes. While debating the collapse of Dubai, Imperial and Chase Banks since August last year, opposition MPs accused the state of failing to effectively deal with corruption at the national level thus failing to deter the spread of the vice to other sectors of the economy. Suba MP John Mbadi said managers of the financial institutions have taken courage from reluctance by the government to decisively deal with graft to engage in dubious practices that now threaten to cripple the sector. “Financial institutions think it is business as usual as the Jubilee government has consistently failed to act on the corrupt individuals. Simiyu also blamed the watchdogs such as the Auditor General, the parliamentary Public Investments Committee and the National Assembly at large for laxity and failing to keep watch on most institutions. “As a house, we cannot also run away from the blame. Where was the National Assembly and the Public Investment Committee when all these was happening? As much as it is sad we also share part of the blame,” Simiyu said.

Seme MP James Nyikal said the government has not demonstrated seriousness in fighting corruption. “I can’t comprehend that up to this time I have not seen any major demonstration to show the anger of what has happened at Chase Bank. In other countries this would have attracted a demonstration that would have brought a country to a standstill,” Nyikal lamented. Nyikal said the country should have stiffer penalties including death sentences on corrupt individuals as one of the clear demonstration of its seriousness in fighting graft. “This incident is serious, we are talking of people who have collected other people’s money and disappeared with it, this is serious economic crime that can only be punished with death sentence,” Nyikal said. Experts sent to Nakuru after 39 Influenza deaths Disease control experts have been dispatched to Nakuru County following the death of 39 children died from Influenza after they developed medication resistance. Health Cabinet Secretary Cleopa Mailu says the team will carry out a comprehensive probe to establish the real magnitude of the outbreak, its cause and the possible risk factors. The government has also heightened surveillance for acute respiratory illnesses, especially those affecting children in the county. “We have disseminated a case definition to all county health care workers to enhance prompt case detection,” Dr Mailu said in a statement. The CS has urged the public to immediately take children exhibiting the above symptoms to hospital as well as observe hygiene practices like hand washing among other precautionary measures. Panama Papers: Police raid law firm’s headquarters Police in Panama have raided the headquarters of the law firm at the centre of a massive data leak. Prosecutors said the operation had been carried out at the offices of Mossack Fonseca in Panama City “without incident or interference”. The leaked “Panama Papers” have shown how some wealthy people use offshore firms to evade tax and avoid sanctions. The firm has denied wrongdoing. It says it is the victim of a hack and that the information is being misrepresented. Panamanian President Juan Carlos Varela has promised to work with other countries to improve transparency in its offshore financial industry. Police carried out Tuesday’s raid along with officials from an organised crime unit. Officers set up a perimeter around the headquarters while prosecutors entered the offices to search for documents. Afterwards, the attorney general’s office said the aim had been “to obtain documentation linked to the information published in news articles that establish the use of the firm in illicit activities”. The statement added that searches would also take place at subsidiaries of the firm. Panama’s government promised an investigation soon after news reports emerged more than a week ago based on more than 11 million documents from the firm. The firm tweeted (in Spanish) that it “continues to co-operate with authorities in investigations made at our headquarters”. Many other countries are probing possible financial crimes by the rich and powerful in the aftermath of the leak. Mossack Fonseca partner Ramon Fonseca says the company had been hacked by servers based abroad and has filed a complaint with the Panamanian attorney general’s office. Mr Fonseca served as a minister in Mr Valera’s government but stepped aside earlier this year after separate allegations linked the firm to the corruption scandal engulfing the Brazilian state oil company Petrobras.

Ted Cruz is US citizen, judge rules A judge in New Jersey has ruled that Republican presidential hopeful Ted Cruz is a “natural-born citizen” under the US constitution and may run in the state’s primary elections in June. A group of residents had challenged the Texas senator’s eligibility for the presidency. He was born in Canada to a Cuban father and American mother. But Judge Jeff Masin found that Mr Cruz met the constitutional requirements. New Jersey’s Lt Governor, Kim Guadagno, is now expected to review the decision. Sen Cruz’s main rival for the Republican nomination, Donald Trump, has also questioned his eligibility for the presidency. “There’s a big question mark on your head,” the billionaire businessman said at a debate in January. “You can’t do that to the party.” The South Jersey Concerned Citizens Committee and law professor Victor Williams, a presidential write-in candidate, argued in court in on Monday that Sen Cruz’s birth in Canada meant he could not be a “naturalborn citizen” as envisaged by those who wrote the US constitution. They claimed he was a naturalised citizen and that

presidents had to be born on US soil. Sen Cruz’s lawyer argued that he was a natural-born citizen because his mother was American. On Tuesday, Judge Masin dismissed the challenge, while acknowledging that “absolute certainty as to this issue is

only available to those who actually sat in Philadelphia and themselves thought on the issue”. “The more persuasive legal analysis is that such a child, born of a citizen-father, citizen-mother, or both, is indeed a ‘natural born citizen’ within the contemplation of

the constitution,” he wrote in a 26-page decision. Judge Masin added that his decision might be adopted, modified or rejected by Lt Gov Guadagno, New Jersey’s secretary of state, who is authorised to make a final decision on the matter. She must transmit the names

of candidates to appear on the primary ballot to county clerks by Thursday. A similar legal challenge was rejected a court in Pennsylvania, where Sen Cruz will appear on the state’s Republican primary ballot later this month.

Two former coalition partners of Brazil President Dilma Rousseff say they will vote for her impeachment over claims she manipulated government accounts. The Progressive Party (PP), which quit the coalition on Tuesday, says most of its 47 MPs would vote for the impeachment. The Republican Party (PRB) said its 22 members had been told to vote for it. The move comes weeks after the PMDB, the largest party in the the lower house, voted to leave the coalition. Ms Rousseff says her opponents are plotting a “coup”. She faces an impeachment vote in the lower house on Sunday, amid claims she juggled the accounts to make her government’s economic performance appear better than it was ahead of her election campaign two years ago. She denies the allegations, and her supporters say the issue is not

valid grounds for impeachment anyway. A PP spokeswoman told AFP news agency on Tuesday: “The party decided to withdraw from the... alliance, by majority decision.” The PP is the fourthlargest party in the 513-seat lower house. Hours later, the leadership of the PRB confirmed to BBC Brasil that its members had been told to support the removal of the president or face sanctions, including possible expulsion. While the two developments weaken the position of the president ahead of the impeachment vote, its outcome is uncertain with many members of the lower house still undecided. A two-thirds majority - 342 MPs - is needed to send the impeachment case to the Senate. A recent poll, before the PP’s announcement, showed 300 in favour of impeachment and 125

opposed, leaving 88 MPs still undecided or not stating their position. Earlier on Tuesday, Ms Rousseff suggested that her Vice-President Michel Temer was one of the ringleaders of the “coup” attempt against her. She said a widely distributed audio message of Mr Temer appearing to accept replacing her as president, was evidence of the conspiracy. However, she did not identify him by name. “They now are conspiring openly, in the light of day, to destabilise a legitimately elected president,” Ms Rousseff said. She referred to “the chief and... the vice-chief ” of the plot, an apparent reference to Mr Temer and lower house speaker Eduardo Cunha. Brazil is “living in strange times”, she said, “times of a coup, of farce and betrayal”. Mr Temer has said that the message was released by accident.

EU to make big firms come clean on tax: Plans

Treasury, CBK to implement game-changing fiscal policies The National Treasury, in conjunction with the Central Bank of Kenya will begin implementing a raft of financial reforms by end of June 2016. The drive is part of Kenya’s Memorandum of Economic and Financial Policies, an initiative spearheaded by the International Monetary Fund (IMF). It seeks to stabilise the country’s economy while reducing debt at a time when both the World Bank and the IMF have downgraded their growth estimates for Kenya’s economy. According to a 2016 report from the IMF, the Kenyan economy has continued to perform well despite headwinds from a weaker global economic environment. The analysis indicates that real GDP growth accelerated to 5.8 per cent in the third quarter of 2015 (up from 5.0 per cent and 5.6 per cent, respectively, in the first and second quarters). Kenya unscathed as region suffers from plunging commodity prices

Kenya has been left unscathed as economic activity in Sub-Saharan Africa slowed in 2015, with GDP growth averaging 3.0 per cent, down from 4.5 per cent in 2014. Based on these results, the pace of expansion has decelerated to the lows last seen in 2009, according to a recent World Bank report. A plunge in commodity prices – particularly oil, which fell 67 per cent from June 2014 to December 2015 – and weak global growth, especially in emerging market economies, are behind the region’s lackluster performance. In several instances, the adverse impact of lower commodity prices was compounded by domestic conditions such as electricity shortages, policy uncertainty, drought, and security threats, which stymied growth. “There were some bright spots where growth continued to be robust such as in Côte d’Ivoire, which saw a favorable policy environment and rising investment, as well as oil importers such as Kenya, Rwanda, and Tanzania,” said the Bank. Kenya has also experienced the least adverse impact on its currency compared to its peers in the continent. As a result, the World Bank has lauded the Central Bank of Kenya (CBK) for protecting the economy from the effects of external and internal shocks through prudent monetary policy interventions. High Court halts privatization of sugar factories for two months

The High Court in Kenya has stopped the privatization of five sugar companies for a period of two months following an urgent case contesting the sale. Justice Weldon Korir issued the directive after Kisumu Senator Anyang’ Nyong’o and Gem MP Jakoyo Midiwo moved to court claiming the process was not procedural. The judge has thus prohibited the Privatization Commission from proceeding with the sale of Nzoia, South Nyanza, Chemelil, Muhoroni and Miwani sugar companies. It is their argument that if the process proceeds in an opaque manner it might lead to collapse of the sugar industry in the country. “Privatization is of outmost importance to stakeholders especially the cane farmers as it goes to the root of their livelihood,” the two argued. “The commission should only proceed with the sale after consultations among and participation of all stakeholders is done and thorny issues ironed out,” Justice Korir said in his ruling. According to Prof. Anyang’ Nyong’o and Hon. Jakoyo Midiwo, there are pending weighty issues raised by stakeholders on the privatization process that are yet to be resolved. Senator Nyong’o and MP Midiwo say the approval of the privatization of the said sugar companies should be on condition that any ancestral land currently held by any of the firms remains under ownership of the local community. Accountancy Board to administer online exams in three years The Kenya Accountancy and Secretaries National Examinations Board (KASNEB) plans to begin administering online examinations in the next three years as it seeks to add the number of students it examines by 20 per cent. KASNEB Chief Executive Pius Nduatih says the board is set to partner with a UK examination firm which will provide the board with the platform for online examinations. He says a feasibility study is still ongoing to provide a conclusive outlay of how much investment it will require. Nduatih was speaking on Tuesday during the laying of the foundation stone of Phase II of the KASNEB Towers – an 18 storey building. The body offers about eight courses to about 100,000 students with about 30,000 students seating for final examinations every year.

Demand for lending from the World Bank has risen to levels never seen outside a financial crisis. The rise is on track to climb to more than $150 billion (Sh15.1 trillion) between FY13 and the current fiscal year. Global economic growth is projected at 2.9 per cent in 2016, picking up at a slower pace than previously expected from an estimated 2.4 percent in 2015. However, conditions have generally deteriorated further since the start of the year. The Bank expects that FY16 will easily eclipse that record, with lending projected to rise above $25 billion (Sh2.5 trillion).

Uber, a multi-national taxi company with operations in Kenya has revealed that it provided information on more than 12 million passengers and drivers between July and December last year. According to the firm’s first transparency report, the vast majority of this was shared with US regulators such as the California Public Utilities Commission. Such requests ranged in scope - from data about number of trips to specific GPS co-ordinates for drops-offs. It received 613 requests from law enforcement agencies. Several technology companies, including Google, Twitter and Facebook, release transparency reports but most concentrate on what they share with law enforcement agencies.

Slowdown forces IMF to cut global economic growth outlook yet again WEDNESDAY, APRIL 13, 2016

The International Monetary Fund (IMF) has once again lowered its forecasts for the world economy. The IMF’s latest World Economic Outlook now predicts global growth of 3.2 per cent this year and 3.5 per cent in 2017. The downgrades reflect a widespread slowdown across all types of economies that has left the world economy more exposed to negative risks. Last month, the IMF lowered its growth estimates for Kenya’s gross domestic product (GDP) to 6 per cent in 2016 from an initial projection of 6.8 per cent. Launching the report, the agency’s chief economist, Maurice Obstfeld, described the pace of growth as “increasingly disappointing”. Before the latest downgrade, the IMF had expected global growth of 3.4% this year and 3.6% next year. The IMF’s managing director Christine Lagarde has previously described the current state of the world economy as “the new mediocre”. The new report is subtitled “Too slow for too long”. It warns of risks that could lead to results worse than the main forecast. The announcement comes just days after the World Bank decreased its 2016 sub-Saharan African growth forecast to 3.3 percent from a previous forecast of 4.4 per cent in October. The bank attributed the depreciating growth to plummeting global commodity prices. “There were some bright spots where

Economically-challenged Republic of Nauru joins list of IMF member states The IMF has welcomed the Republic of Nauru as its newest member. The island adds its name to the list of 188 other IMF member countries that include Kenya, Uganda, Tanzania, Egypt, Australia, and the United States, among others. Mr. David Adeang, Minister of Finance of Nauru, signed the Articles of Agreement of the IMF at a ceremony held at the State Department in Washington, D.C. IMF officials witnessed the signing ceremony. “I am very pleased to welcome Nauru as a member of the IMF,” said Christine Lagarde, the IMF’s Managing Director. “As Nauru faces a number of challenges common to small island economies, including its geographical remoteness and climate change, it will benefit from participating fully in the economic cooperation of our global membership. The IMF stands ready to assist the government and people of Nauru in achieving their development objectives in cooperation with other partners in the international community,” she added. Measured by its quota, Nauru will be

the second smallest member of the Fund, after Tuvalu. This will be the case after it pays its quota increase under the 14th General Review (which will increase its quota to SDR 2.8 million). Nauru has an initial subscription of SDR 2 million, or about $2.81 million (Sh284 million). It has a population of about 10,500 and a land area of about 8 square miles, compared with 68 square miles for Washington DC. Nauru is also the smallest sovereign state in the world after the Vatican City in terms of both population and area. The Australian dollar is the legal tender. There had been virtually no bank in the country during the past decade until the opening of Bendigo Bank agency in June 2015. Nauru’s economy relies on phosphate mining, the Australian Regional Processing Center (RPC) for asylum seekers, and revenue from fishing license fees. In recent years, growth has been strong, mainly driven by the RPC operations and phosphate exports, although it has moderated in 2015 due to problems with the seaport that lowered phosphate exports. The country faces a number of challenges

common to small islands, including: a small population, remoteness, climate change, narrow production base, high cost of public goods, and insufficient infrastructure. The key priorities include strengthening public finances, improving basic infrastructure, and diversifying its sources of growth IMF membership allows the Fund and other development partners to help the authorities implement economic reforms and tackle the development challenges facing Nauru. The country can now benefit from an annual review of its economy by the IMF (called the Article IV consultation), cross-country analysis and access IMF lending. Nauru will continue to receive technical assistance through Pacific Financial Technical Assistance Center (PFTAC) based in Fiji. Nauru can now also attend the joint IMF-World Bank Spring and Annual Meetings as a full member of the Bretton Woods family, where the authorities can meet and exchange views with other delegations. Although the global economy has continued to recover from the financial crisis and the recession it caused, the IMF has become increasingly concerned about its lackluster nature. One danger highlighted in the report is a return of the financial market turmoil that hit the world earlier in the year. China’s efforts to shift the national economy more towards consumer spending and services are described as something that will eventually benefit China itself and the world. But given the country’s important role in world trade, “bumps along the way” could be damaging for others. Thereport says there is a risk of the world economy falling into widespread stagnation. It’s worth emphasising that there are only a few countries where the IMF predicts economic activity will actually decline. Greece, yet again, is one. Brazil, which has been beset by a widespread political crisis, is forecast to see its economy shrink by 3.8%, the same amount as last year. Russia, too, is facing another year of decline, hit by low commodity prices (notably oil) and Western sanctions over the situation in Ukraine.

China offers Nigeria Sh606 billion infrastructure loan China has offered Nigeria a loan worth $6 billion (Sh606 billion) to fund infrastructure projects, theNigerian foreign minister has said. The announcement came as both countries signed a currency swap deal to boost trade between their respective regions. This follows a move by the Chinese government to loan Kenya Sh60.6 billion to help fund a budget deficit in the coming fiscal year. “We are now in the process of finalizing the financing agreement. We expect very shortly that the funds will be coming in,” announced Kamau Thugge, Principal Secretary for Kenya’s Finance Ministry. Nigeria is Africa’s largest economy and its top oil producer. But its public finances have suffered as the price of crude oil dropped across the world. Although President Muhammadu Buhari wants to triple capital spending in 2016, he also needs to plug a projected deficit of $11.1 billion (Sh1.1 trillion). “It is a credit that is on the table as soon as we identify the projects,” Nigerian Foreign Minister Geoffrey Onyeama

told reporters after Buhari met Chinese President Xi Jinping. “It won’t need an agreement to be signed. It is just to identify the projects and we access it.” Lin Songtian, director general of the Chinese foreign ministry’s African affairs department, had earlier said Nigeria would be able to benefit from a $55 billion (Sh5.5 trillion) package for Africa, which mostly consists of concessional grants. The Industrial and Commercial Bank of China Ltd (ICBC), the world’s biggest lender, and Nigeria’s central bank also signed a deal on yuan transactions. “It means that the yuan is free to flow among different banks in Nigeria, and the renminbi has been included in the foreign exchange reserves of Nigeria,” Lin said. Nigeria had said it was looking at panda bonds - yuan-denominated bonds sold by overseas entities on the mainland - to fund the deficit, saying they that would be cheaper than Eurobonds. Pastor, driver win mCHEZA millions A pastor from Kakamega County and a security firm driver from Murang’a are the first lucky winners of the Sh21.4 mCheza jackpot. Samson Juma, 46 and Amos waweru, 31 bagged a staggering Sh10.7 million each after they shared out the jackpot prize. The two correctly predicted the outcome of 13 football matches listed by the company last week. These included the 3-0 win over Manchester United by Tottenham, Sunderland loss to Leicester city and a 2-2 draw between Bundesliga heavyweights Schalke 04 and Borussia Dortmund. They also correctly predicted less glamourous fixtures such as Empoli win over Fiorentina, Valencia’s home win against Seville and Stoke City 4-1 loss at Liverpool. Waweru who was accompanied by his wife Mary and their two daughters, could not hide his excitement at the newly acquired millions. Historic starlets qualify for 2016 Nations Cup

Harambee Starlets yesterday wrote history as the first Kenyan women football team to qualify for Africa Cup of Nations after edging out power house Algeria 3-3 on aggregate to advance on the away goal rule. Following the result, Kenya booked a ticket for the final tournament scheduled for Cameroon in November. Cherish Avillia stepped off the bench to score the equalizer and help Starlets settle for a 1-1 draw in the return leg played at Nairobi’s Kasarani Stadium and as a result squeezed through after holding Algeria 2-2 in the first-leg away in Algiers. “Normally, I don’t play as a full back but when the coach gave me the opportunity, he asked me to play both the roles since we wanted more people forward. I was confident coming in and I knew we would score,” the goal scorer said after the match. Captain Mary Kinuthia said, “We are overwhelmed with joy, it was a big match for us. We never gave up even when we went a goal down and our fighting spirit pulled us through. It is a great joy for us to represent the country at AFCON for the first time and coming through against a team like Algeria gives us a lot of confidence.” Naima Bouheni put the visitors in the 21st minute, but a combination of two substitutes saw Starlets level and achieve their landmark dream. Real overturned a 2-0 first-leg deficit to beat Wolfsburg 3-2 on Tuesday. In February, the Portuguese forward walked out of a Champions League news conference after being questioned about his record in away matches this season. “Considering this has been a ‘bad’ season for me, it has not been that bad,” Ronaldo, 31, said after victory. After a 2-2 first-leg draw in Paris last week, the tie remained in the balance in Manchester thanks to Sergio Aguero’s missed penalty for City in the first half. The home side had Joe Hart to thank for three fine saves at 0-0, notably a ferocious Zlatan Ibrahimovic free-kick that the England goalkeeper clawed to safety. But, roared on by a capacity crowd of 53,039 that supplied an unforgettable atmosphere, City held their nerve at the back before De Bruyne’s decisive strike 15 minutes from time with their only shot on target. The final whistle brought scenes of pure emotion from the fans at Etihad Stadium, who were already in uncharted territory.
