Jubilee alliance top brass will meet with President Uhuru Kenyatta to make a final decision on whether to push on with the quest to withdraw Kenya from the Rome Statute or not. MPs allied to the coalition have previously said they want Kenya to pull out of the Rome Statute that established the International Criminal Court based in The Hague, Netherlands. So strong was the push such that the Justice and Legal Affairs Committee of the National Assembly already prepared a Bill to that effect. However, the Bill sponsored by Bumula MP Boniface Otsiula was put on hold as a decision on the case against Deputy President William Ruto and Joshua Sang was awaited. The two were on Tuesday let off the ICC hook as judges declared their case a mistrial. And while Otsiula believes the collapsed of Ruto and Sang case should give the MPs fresh impetus to push on with the pull-out plan, National Assembly majority Leader Aden Duale says they will wait for President Uhuru Kenyatta to come back from Germany where he is on official visit before a final decision is made. “We are waiting for the President to come back when we will consult on the way forward,” Duale said.

We will therefore continue to pursue ways to improve the delivery of international justice, uphold the rule of law and promote a just and fair global order,” he said from Paris, France where he was then on official visit. Kenya expresses gratitude to AU for ICC support President Uhuru Kenyatta has expressed gratitude to the African Union (AU) and its member states for standing in solidarity with Kenya as the country battled crimes against humanity charges that faced its citizens at the International Criminal Court (ICC) in The Hague. The declaration of a mistrial in the case that faced Deputy President William Ruto and his co-accused journalist Joshua Sang by ICC judges on Tuesday marked the end of the trials. President Kenyatta to hailed African countries, saying the victory in the case was achieved through the support of friendly countries. “The strong position taken by the African Union and its member states in support of Kenya at the ICC enabled us to succeed. Kenya will continue partnering with other countries in the continent to achieve Africa’s agenda,” said Kenyatta in Berlin, Germany during a meeting with African Ambassadors accredited to the European nation. The Group of African Ambassadors acts as an umbrella association for the envoys to advance their countries’ interests and harmonise common views on topical issues to represent

Their meeting with President Kenyatta was to discuss ways of forging greater unity and solidarity in advancing African’s common positions at the international arena. Kenyatta said Africa needs unity of purpose and a spirit of Pan-Africanism among Africans across the world to advance their interests ‘within the world’s bastions of power’. He challenged the Envoys accredited to other countries to embrace the spirit and philosophy of Pan-Africanism for the continent to raise her profile internationally and be effective at the diplomatic fronts. He emphasised that the triple threats of poverty, ignorance and disease that continued to assail Africans and weaken the social fabric of the societies can be addressed by one people with the good-will of strategic partners. “It is only through a concerted effort on the part of every stakeholder in Africa, that we will forge a stronger future for our continent, and in so doing, build a stronger world as well”, President Kenyatta said. He told countries in Africa to aim at intra-trade saying the future of the
continent lies in accelerated integration and enhanced trading with one another. “Over the past decade, Africa’s commitment to regional economic integration has grown, with the continent’s total trade (both imports and exports) tripling in value to $1.2 trillion,” he added. He cited various challenges to integration including inadequate hard infrastructure, poor transport connections, and costly and unreliable power supplies that can be mitigated through investment in infrastructural networks that link the continent and in energy. President Kenyatta said the political goodwill prevailing in the region and the continent has enabled the private sector to participate in large regional integration projects. “Integration will bring with it bigger markets for African goods, more jobs for African peoples, economic growth for African countries, and a brighter future for the youth of our continent.” The President reaffirmed Kenya’s commitment to pursuing strategic interests of the African continent through every available means and opportunity to realise the desired integration.
On security and political stability, the President urged countries in the continent to invest heavily in ensuring the prevalence of peace among their people. He said Kenya remained steadfast on regional peace initiatives, contributing to stability efforts in Somalia, where the country worked with other Troop Contributing countries within the African Union Mission in Somalia (AMISOM). The President told the meeting also

Kaimenyi slams politicians over uncollected land titles Lands Cabinet Secretary Jacob Kaimenyi has lashed out at politicians inciting Kenyans against picking their title deeds leading to a pile-up of uncollected titles in land offices across the country. While addressing a surveyor’s stakeholder’s forum at Nairobi’s Serena hotel today, Prof Kaimenyi said the politicians have slurred the titles creating a false perception that they were fake and only aimed at popularising the Jubilee administration. More than 150, 000 title deeds lie uncollected in the land registries across the country despite calls on residents to collect them. “Leaders must stop politicising government’s effort aimed at ensuring all Kenyans who own land are legally licensed. They have continually discouraged the citizens from collecting what rightfully belongs to them,” warned Kaimenyi. He said land-related disputes are on the rise in the country as result of lack of ownership documents and poor land fragmentation policies. “Currently we have more than 7,000 cases of land issues that have been

Varsity chief denies students were raped during protests University of Nairobi Vice Chancellor Peter Mbithi has refuted claims that some students were raped and other seriously injured by security apparatus during the recent protests over disputed SONU elections. Prof Mbithi says only a few students suffered soft tissue injuries and have already been treated and discharged from the hospital. “No life was lost, no serious injuries…as a Vice Chancellor, I have also not received any rape case,” he said while adding that police did not invade the halls of residence within the University. The protest resulted from a SONU election that saw the re-election of Babu Owino as Chairman. Aggrieved students claim that the election was marred by malpractices. “I have ordered a thorough audit of SONU and review of its electoral process,” the VC told journalists during a briefing at his office on Wednesday. Mbithi said already an audit is being carried out to establish what exactly happened while saying the University Senate will be recommending changes to the union constitution, to seal any emerging loopholes. “A senate committee comprising of senior staff with powers to incorporate other key stakeholders have been appointed,” he said. “We regret that we had to close even the peaceful campuses and postpone our academic programs. As the management of the University, this incident provides us with an opportunity to reflect on some salient challenges and find solutions on how to deal with them.” The University is also trying to authenticate the video circulating on social media, showing GSU officers whipping students.
The committee is set to provide its recommendations in two weeks’ time. Students who destroyed property, he said will be identified and firm disciplinary actions taken against them. Among the issues being addressed include existence of gangs within the school and peddling of drugs. “There is growing tendency towards that… that’s why we needed an integrated action plan for student’s security and safety,” he said. “We are right in the CBD and quite often we are infiltrated by all kinds of crime. We are committed to root out all these vices with other partners like NACADA.” Several students who were found with weapons such as machetes and knives have been arrested and will be prosecuted. One of the students was arrested on Monday when his vehicle was found with numerous weapons which he was trying to sneak into one of the hostels. “Our work is to ensure law and order is maintained… we had information that some of the students were armed with crude weapons,” he stated. The vehicle is currently at Parklands Police Station as police carry on with investigations. Nairobi Police Chief Japheth Koome says the aim of the probe is to address the causes of such gangs and root out those behind them. Contestants are often linked to goons during elections that they use to either intimidate their competitors or use them for protection. CS Wakhungu hails cocerted efforts to stem jumbo killings Environment Cabinet Secretary Prof Judi Wakhungu said Kenya’s effort in the fight against elephant poaching had finally started to bear fruits. She said elephant poaching had drastically reduced from 184 in 2012 to 96 in 2015. Speaking yesterday at Kenya Wildlife Service (KWS) headquarters during a meeting to review the national strategy on elephant Conservation and Management, Wakhungu termed the war ‘a major victory in conservation of the rare wildlife species’. “The success in the fight against elephant poaching has been the result of increased awareness, political good will and partnerships with various stakeholders in ensuring that the elephant population is protected from marauding poachers” she said. The Cabinet Secretary said despite the increasing cases of poaching on the continent, the
number of elephants killed for their tusks is decreasing in Kenya. She said the country is making strides in protecting the elephant population, adding that more need to be done protect the jumbos. “Elephants face a myriad threats including, illegal killing for ivory, human wildlife conflict involving the jumbos, local overabundance and loss and fragmentation of habitat,” said Wakhungu. The CS who also presided over the Mid-Term Evaluation of the Conservation and Management Strategy for Elephants in Kenya (2012-2021), ahead of the planned burning of stockpiles of ivory and rhino horns on April 30, said his ministry will be in the front line to protect the elephants. France outlaws paying for sex French MPs have passed a law that makes it illegal to pay for sex and imposes fines of up to $4,274 (about Sh430, 000) for those buying sexual acts. Those convicted would also have to attend classes to learn about the conditions faced by prostitutes. It has taken more than two years to pass the controversial legislation because of differences between the two houses of parliament over the issue. Some sex workers protested against the law during the final debate. The demonstrators outside parliament in Paris, numbering about 60, carried banners and placards one of which read: “Don’t liberate me, I’ll take care of myself ”, the AFP news agency reported. Members of the Strass sex workers’ union say it will affect the livelihoods of prostitutes, estimated to number between 30,000 and 40,000. But supporters of the law have said it will help fight trafficking networks. It will also make it easier for foreign prostitutes to get a temporary residence permit in France if they agree to find jobs outside prostitution. “The most important aspect of this law is to accompany prostitutes, give them identity papers because we know that 85% of prostitutes here are victims of trafficking,” Socialist MP Maud Olivier, who sponsored the legislation, told the Associated Press news agency.
Eritrea conscripts killed in escape bid Security forces in Eritrea’s capital Asmara have killed several young conscripts who tried to escape the convoy they were travelling in, according to opposition media outlets. There were also civilian casualties after some of the recruits’ friends and family used a bus to block the road to help them escape, according to the unconfirmed reports. Conscription in Eritrea is compulsory. The Eritrean authorities have not commented on the alleged incident. Rights groups consider Eritrea to be one of the world’s most repressive states. In 2015, it ranked bottom of the World Press Freedom Index, published by media watchdog Reporters Without Borders (RSF). Conscription in Eritrea can last for decades and is one of the main reasons tens of thousands flee the country every year.
Al-Bashir ‘to step down in 2020’
Sudan’s President Omar al-Bashir has told the BBC he will step down in 2020 when his current mandate ends. Mr Bashir also denied allegations of abuses perpetrated by the Sudanese forces in renewed violence against black African villages who took up arms in the country’s western Darfur region. The president has been indicted by the International Criminal Court (ICC) on counts of genocide and war crimes. Mr Bashir has been in power since 1989. He won elections in April last year. He told the BBC’s Thomas Fessy that his job was “exhausting” and his current term would be his last. “In 2020, there will be a new president and I will be an ex-president,” he said. However, sceptics will say that he had already pledged to step down in the past and later went back on his word, our correspondent says. The UN says more than 2.5 million people have been displaced in Darfur since 2003 - with more than 100,000 this year alone. President Bashir said that there was no reason for the UN peacekeepers and aid workers to stay in the troubled Darfur region. He denied reports of recent abuses in the mountains of Jebel Marra where government forces launched an offensive in January. “All these allegations are baseless, none of these reports is true,” he said. “We challenge anyone to visit the areas recaptured by the armed forces, and find a single village that has been torched. “In fact, there hasn’t been any aerial bombing.” The president said that people who fled the fighting had gone to government-controlled areas which was “proof that the government does not target citizens”. This is why I’ve defied the tribunal, and [why] I’ve been travelling freely around the world.” Mr Bashir was re-elected last year with about 94% of the vote in an election boycotted by the main opposition parties who said it was not free and fair.
Sanders: Clinton not qualified to be US President Bernie Sanders said Wednesday that Hillary Clinton is not “qualified” to be president, a sharp escalation in rhetoric in the Democratic primary. “Secretary Clinton appears to be getting a little bit nervous,” he told a crowd in Philadelphia. “And she has been saying lately that she thinks that I am ‘not qualified’ to be president. CBK places Chase Bank under receivership for twelve months The Central Bank of Kenya (CBK) has put Chase Bank Limited under receivership barely a day after the lenders Chairman and Managing Director resigned Chase Bank has been experiencing liquidity difficulties following inaccurate social media reports and the stepping aside of two of its directors. The lender yesterday assured customers that their deposits are safe following the resignations, which came after financial results issued last week were restated to show loans to directors and employees had more than quadrupled. Chairman Zafrullah Khan and Managing Director Duncan Kabui resigned from their positions following the release of the company’s 2015 earnings, the bank said in a statement on Wednesday. “The board would like to reassure all its customers, partners and the general public that Chase Bank is a strong, sound and transparent institution that has operated in Kenya for the last 20 years,” Chase said in the statement. In light of these concerns, the CBK has today, Thursday April 7, 2016, appointed the Kenya Deposit Insurance Corporation (KDIC) as a receiver for Chase Bank Limited for a period of twelve months. The Central Bank said in a statement released this morning that the move is pursuant to the provisions of Sections 43(1), 43(2) and 53(1) of the Kenya Deposit Insurance Act, 2012.

Chase Bank Limited was issued with a banking licence in 1996. “The appointment of KDIC as a receiver for Chase Bank Limited has been carried out in the interest of its depositors, creditors and members of the public,” reads the CBK statement. Section 43(2) of the Kenya Deposit Insurance Act, 2012 requires CBK to appoint the KDIC as a receiver of a bank. This is if an unsafe or unsound condition to transact exists; a bank is likely to fail to meet its financial obligations; a bank has substantially insufficient capital or if there is a violation of any law or
regulation. One of CBK’s primary roles as a regulator is to foster the liquidity, solvency and proper functioning of a stable marketbased financial system. Consequently, it was not able to meet its financial obligations on April 6, 2016.. “In light of the above, CBK has appointed the Kenya Deposit Insurance Corporation (KDIC) to assume the management, control and conduct of the affairs and business of the institution and to exercise all the powers of the institution to the exclusion of its Board of Directors and advise CBK of an
appropriate resolution strategy as soon as is practicable and not later than twelve months from date of appointment,” the statement added. KDIC has stated that it will release information on the progress in due course. Meanwhile, the Central Bank has added that it remains committed to fostering banking system stability and will exercise its supervisory mandate in a “fair and even-handed manner.” Chase is the latest bank to be put under receivership as the CBK intensifies its crackdown on errant lenders. Investors urged to create buffer against currency volatility Developers and investors need to shield themselves against currency volatility for them to understand how economic conditions can influence their returns. According to Gary Garrett, Head of Real Estate Finance at Standard Bank, investors will need to look at opportunities from a country and node specific perspective and also be cognisant of the dynamic regulatory environments. “Developers will need to do robust feasibilities in order to understand how economic conditions can affect their returns over time and they also need to consider buffering themselves against potential risks such as currency volatility by utilising appropriate funding structures,” said Garret during an earlier announcement. He is optimistic that growth in property development is likely to continue in many markets, if appropriate funding structures are used to manage some of the current hurdles, such as weaker local currencies. However, he says growth has slowed in many commodity linked markets in Africa, non-commodity driven markets, particularly in East Africa, have continued to perform well. State moves to set up 7,000 km of power cables to drive down cost of electricity The government is targeting to put up 7,000 kilometres of electrical power transmission lines by 2020 to scale down the cost of power. Speaking to the media yesterday, Kenya Electricity Transmission Company (Ketraco) Managing Director Fernades Barasa has noted that the power lines will ensure a stable grid for power supply. “When the grid is strong, we have reliable power for our companies that eventually reduce the cost of doing business,” Barasa said. He maintained that, for the government to achieve a power connectivity target of 70 per cent by 2017, there was need for the country to have a stable power grid. “Power is the economic pillar for 2030. For the government to achieve its 70 per cent connectivity target, we must have a stable grid,” added Barasa. Part of the 7000 km power line Ketraco
is planning will commence with construction of Homa Bay substation at a cost of 2.3 billion by 2017. The project will be financed by a consortium fund through the government of Kenya and the government of Belgium. According to Barasa, the project will give access to power to regions that are currently off grid. “This project will enable us evacuate power, strengthen the existing grid system and interconnect nyanza region counties,” he stated adding:” This project will allow increased access to electricity, reduce power losses, increase capacity and reliability of power supply.” Sondu - Homabay -Awendo project involves the construction of 106 km 132 single circuit line. The project will also facilitate investment in the area that had been constrained by lack of electricity and
thus to contribute improved quality of life. Ketraco is the body mandated to plan design, construct and maintain high voltage electricity line grids and regional power inter connectors. The firm’s initiative comes just weeks after the Kenya Electricity Generating Company (KenGen) signed a partnership deal with Power AfricaKenya that will see it implement a holistic plan to feed the national grid with 2,500 megawatts (MW) of power over the next ten years. Oversupply hits big shopping malls, retail shops: research
A new industry research has declared that big shopping malls are in oversupply in Kenya as investment opportunities shift to the counties, the industrial sector, and residential real estate. According to an analysis conducted by Mentor Management Limited (MML) and Britam Asset Management, there is an oversupply in all types of retail space in Nairobi, and in big malls countrywide. Speaking at the ongoing East Africa Property Investment Summit (EAPIS), Chief Executive Officer for Britam Asset Managers Limited Mr. Kenneth Kaniu said once the current malls are completed, there will be an oversupply of real estate in Nairobi. “Beyond the Two Rivers Mall expected to open by the end of this year, no further retail space will be required in Nairobi, as there will be oversupply,’’ said Mr Kenneth Kaniu. “However, in areas like Naivasha, Kisumu, Nakuru, Nanyuki and Mombasa, there is a lot of opportunity for strip malls that range from 1,000 to 10,000 square feet,” he added. Based on insights and engagements with clients and market over the last few months, Britam Asset Managers real estate tracker highlighted opportunities in strip shopping malls in the counties, but said there is an oversupply in all types of retail space in Nairobi, and in big malls countrywide. He pinpointed manufacturing and logistics buildings as a rising asset category. “More industrial parks are coming up to satisfy this market, with returns fairly good at 10-15 per cent annual yield,” he said. According to the first ever Industrial report,the sharp focus on industrial
real estate has been further developed leading to industrial market in Nairobi absorbed close to Sh 3 billion annually in investments. The report further revealed that 2015 marked record levels of planning approvals by Nairobi’s County Government of multi-unit, developerled industrial, at 280,000m², the majority of which is expected to be delivered in the next two years. “The industrial market has changed markedly in the last three years,” said Mr James Hoddell, CEO of MML, who described the segment as ‘the next wave” in real estate. “Previously, almost all industrial premises and warehousing was owner occupied, but this year, two thirds of the
completions will be for sale or lease.” MML reported that Embakasi currently leads in the supply of warehouses for lease and sale, with Industrial Area leading in owner occupied warehouses. However, in 2015, warehouse take-up was as high in Kiambu County and Mavoko sub-County as in Nairobi, with land proving cheaper in the city’s outer perimeters, which are benefiting from improved accessibility to the airport as a result of the new bypasses. In residential real estate, Britam has pointed to ongoing opportunities in middle income housing between Sh7m and Sh20m, and even greater demand for homes below Sh7m. However, the market for houses below Sh7m presented a problem
in effective demand. “There are potential homeowners keen on such developments, but many do not have the ability to pay,” said Mr Kaniu. The surge in office completions, has went up 65 per cent on the previous record set in 2011and is likely to create oversupply in Upper Hill, Westlands and Waiyaki Way, for four to six years. But “the impact of the looming oversupply is set to be felt most heavily in Grade B office space, which is now more than doubling, at a time when businesses are moving to find more accessible and less congested locations,” said Mr Hoddell. enock_x254

BIZ BRIEFS Longhorn Publishers to raise Sh530mn in new cash call Longhorn Publishers Limited has received approval from the Capital Markets Authority to raise Sh530 million through a rights issue. The company, which is the largest book publisher in the East African region, has stated that it will issue 126 million newly created shares at Sh4.20 at ratio of 0.86 shares for every share held. The firm said the approval will pave way for the cash call to enable the company enhance its drive to diversify into the regional African markets, create a new range of products as well as enhance its digital offering. “We are looking into making inroads in Central, West and the South African markets,” Longhorn’s Group Chairman Francis Thombe Nyammo noted.
CBK faults MPs move, says lending rates could fall further The Central Bank of Kenya (CBK) has said that a proposal by lawmakers to cap commercial lending rates would be “extremely harmful” and that inflation could fall further in coming months. CBK Governor Patrick Njoroge said on Wednesday that commercial banks lending rates still needed to come down and that the current account deficit in East Africa’s top economy was expected to come to down 8 per cent of gross domestic product (GDP). The announcement comes just after it was revealed that only seven banks out of 42 banks hold 80 per cent of Kenya’s cash, raising concerns of liquidity among Kenyan Banks. This is according to Governor Njoroge who says other banks are starved of liquidity. Njoroge says liquidity management issues have not started in the recent past, but has been going on for a long time.
IMF seeks action to secure growth Policymakers should confront challenges and act together in order to give the global economy a substantial boost, IMF Managing Director Christine Lagarde has said. Speaking at the Goethe University in Frankfurt ahead of the IMF-World Bank Spring Meetings, Lagarde noted that the IMF was founded on this spirit of cooperation. She said the state of the global economy will be the focus of the IMF’s 188 member countries when they meet next week in Washington. Lagarde noted that the global economy was in a state of recovery but added that the recovery remains too slow and too fragile, and risks to its durability are increasing. She said that many African and lowincome nations still face diminished prospects.

Dairy farmers from Elgeyo Marakwet are eying good returns from the sector following an appeal by the county government through the Department of Agriculture and Livestock to processing companies to consider buying milk from the local farmers. County Executive Committee member (CEC) in charge of Agriculture, Shadrack Yatich, told X News that farmers have developed interest in the sector hiking the production, which has overpowered the county initiative of providing cooling plants across dairy thriving areas in the vast county. Yatich said that the farmers are now producing surplus milk than what available chilling plants can handle thus resulting to immense losses. The fact has prompted the department to seek an alternative ways to tap from the excess milk. He said his office had reached out to the Brookside Company to buy the extra milk from farmers, explaining that Daima Company, which has been buying milk from some of the dairy farms through co-operative societies, had run short of capacity to absorb all the milk currently being produced. This comes a few months after dairy farmers from Kapteren, Keiyo North sub-county suffered major losses with over 10,000 litres of milk going to waste after Daima Company failed to collect their milk for three consecutive days. Speaking to X News, Jacob Kiptoo, a farmer said they had opted to hawk their milk in kiosks, local hotels and cafes but
the market was still not sufficient. The milk cooler at Kapteren, which has also been receiving milk from Cheptongei dairy farmers’ cooperative society in Marakwet West sub-county, had reached its full capacity. The county Agricultural wing is now calling for farmers’ patience as it seeks new markets outside the region. Through the CEC Yatich, the county expressed that it was in the process of buying a generator for Cheptongei Cooperative Society to mitigate its

Angola seeks IMF bail out as falling oil prices hit country’s economy Angola, one of Africa’s leading oil exporting countries, has asked the International Monetary Fund (IMF) for financial assistance as the nation seeks to improve economic and financial stability. According to a Finance Ministry statement the country’s government plans to work with the IMF to tackle the country’s economic challenges. Discussions are expected to begin next week during the IMF’s Spring meetings in Washington. Angola’s economy is heavily dependent on oil, which accounts for more than 95 per cent of export earnings and more than two-thirds of government revenue. International crude oil prices are now less than half the level they reached in mid-2014, according to a BBC report. As such, countries such as Angola have been hit hard. “The sharp decline in oil prices since mid-2014 represents a major challenge

An idea dubbed Virtual Platform for Agro-Weather Advisory services (Pawa-Farm) and implemented by one Mr. Sam Owilly was selected as the competition’s best pitch. S Owilly received a Sh1.5 million cash prize for the innovative virtual agro weather platform, which he says aims to provide timely, relevant and usable weather and climate information to farmers. “The Climate information prize has opened doors for new thinking, an innovative way of facilitating not only sustainable development but a resilient one as well. YOURSAY Does ICC ruling means there was no crimes? The vindication of the six suspects of the 2007/08 post-election violence dubbed the “Ocampo Six” after the recent acquittal of Deputy President William Ruto and journalist Joshua Sang can be interpreted to mean that there was absolutely no violence in Kenya, if the law of excluded middle is something to go by. The ICC Judges ruling on Tuesday, that there is no evidence linking the duo to the alleged crimes against humanity-similar to the previous rulings that vindicated the other four as the accused presented before the judges were unbelievable and is a rigid dichotomy between what the victims experienced , what the natives saw happening and what the judges were told. By bringing the entire case against humanity committed after 2007 election infinitely to rest, means that no violence took place in Kenya and no crimes were committed despite the killings and rape that visited the country. It means nobody was left homeless and no children were left fatherless or motherless. Every effect must
have a cause, and that is fact inherent within itself. If the Ocampo six did not perpetrate the violence, and nobody else has ever been convicted locally or internationally for having caused or perpetrated the 2007/08 violence, then it sounds reasonable to conclude that the violence didn’t happen and that is what the ICC judges and the government of Kenya want us believe. This has now rendered the stories told by rape victims, the maimed, those who were left homeless, the yet to dry graves of those killed in and the IDPs hitherto wallowing in camps were all lies concocted to fix President Uhuru Kenyatta, his deputy and the other four suspect. The law of excluded middle, law of contradiction and the law of identity has it all-something cannot be and not be at the same time: nobody caused or perpetrated 2007/08 violence; nobody was killed, raped or displaced and therefore Kenyans are gathering at Afraha Stadium on April 16 to celebrate the ‘no post-election violence’ in 2007. — Phabian Jr-Nairobi
Ruto’s fortunes have changed since 2013 Deputy President William Ruto could be the luckiest man on planet earth after the recent ICC ruling that acquitted him. After realising there is no tree in his father’s compound that grows money, Ruto seized the opportunity that came his way and decided to redirect the course of his economic history. Within a very short period, the DP has amassed enough wealth and this show him hire the best lawyers in the world for his
case at The Hague. With his salary, Ruto will even struggle to afford legal experts locally for a case of that magnitude, a clear indication that he used the taxpayers’ money to buy freedom. And with the 2017 polls fast approaching, Ruto still has the opportunity to acquire more wealth being in government and the fact that President Uhuru Kenyatta and his henchmen still need him in 2017. Jubilee should move in to assist PEV victims The planned celebration by Jubilee leaders and their supports after the acquittal of Deputy President William is akin to dancing on the graves of those who perished during the 2007/08 post-election violence. Holding celebrations in Nakuru where Luhyas were killed and Luo men being circumcised with blunt objects before being hacked to death by Mungiki adherents is not only a drawback to healing in the country, but also hypocrisy and a mockery to justice. President Uhuru Kenyatta and his Deputy both “got justice”
at The ICC but how about the families who lost their loved ones? How about the people who were displaced and nobody tells us whether they were able to go back to the land they once occupied? How about the Sh400,000 given to each IDPs from only two communities. Why communitities left out in the compensation list? Going to Afraha Stadium to celebrate the dismissal of a case for two individuals after over a thousand lives were lost, property destroyed and millions displaced is the highest show of inhumanity.
President Uhuru and his deputy should remember that all life is sacred. Let them hit the road and visit all the regions which were affected and condole with ordinary folks whose wounds are still fresh; whose tears have not dried. Celebrating in the stadium isn’t the best way to go... Let them remember that they disbursed monetary compensations without equity. This is the best time to remedy this before late. — Joseph Nyaringo
ICC verdict bad for country ahead of polls The acquittal of Deputy President William Ruto deserves no celebration after the judges made it clear that there was massive witness tampering and influence from the State. It is sad that people can regroup to celebrate the death of fellow Kenyans, it is sad and ICC has failed miserably to consider victims of the 2007/08 post-election violence. People slaughtered like chicken, some were raped, some were displaced and many others were disabled. Of the six suspects presented to the ICC, it should have nailed one or two to serve as an example to leaders who use violence to get power. With the country geared towards the
2017 General Election, Kenyans should pray more than ever before for peace because what could have acted like a regulator to politics of violence is dead. Politicians will not stop at anything to grab power even if it means killing everyone. I am not advocating for violence, but should one broke out, it will be the worst I the country’s history because we have missed the opportunity to sanitise our politics. Those who are celebrating should know that the blood of the dead will never go unpunished. There is absolutely nothing to celebrate!!!! — Gideon Obaigwa

Tuyisenge’s fine form helps Gor beat Thika Rwandese international Jacques Tuyisenge continued his fine form in the Sportpesa Premier League by notching a brace last evening and help his team Gor Mahia come from behind to edge out ten-man Thika United 2-1 in a midweek match played under floodlights at Nyayo National Stadium. Mwinyi Kibwana sent Thika ahead in the 26th minute before Tuyisenge scored both goals in the second half after Thika United keeper Hamuza Muwonge was sent off in the 68th minute for a second bookable offence. City holds pSG as Real is stunned Fernandinho hit a deflected equaliser to earn Manchester City a crucial 2-2 draw in the first leg of their Champions League quarterfinal against Paris Saint-Germain last night. Kevin de Bruyne’s clinical finish had given City the lead after Joe Hart saved Zlatan Ibrahimovic’s penalty for PSG. But Ibrahimovic soon capitalised on Fernando’s error to equalise and young midfielder Adrien Rabiot tapped in after the break to put the French champions in front. City looked to be running into trouble at the Parc des Princes after ca-
sually allowing Zlatan Ibrahimovic to cancel out a Kevin De Bruyne strike and falling behind to an Adrien Rabiot tap-in. But after Ibrahimovic continued to atone for an early penalty miss by heading against the bar, Fernandinho took advantage of some poor PSG defending to net a vital second away goal. The second leg takes place at Etihad Stadium in Manchester on Tuesday next week. Teams who have drawn the first leg 2-2 away from home in European competition have progressed on 220 out of 277 previous
occasions, meaning the odds now favour Manuel Pellegrini’s side to progress in what will be their first ever Champions League semi-final appearance. The fixture had earlier been touted as a battle of Europe’s richest clubs, with both sides backed by wealthy Middle-Eastern owners - PSG’s from Qatar and Manchester City’s from the United Arab Emirates. While the teams have spent a reported £800m between them on players in the past five years, the game, which was entertaining, lacked the quality expected from such blue-chip line-ups. Fernando’s
mistake for PSG’s equaliser was a prime example. The Brazilian collected the ball from Hart on the edge of his own penalty area and, while trying to flick a pass with the outside of his foot, directed the ball off Ibrahimovic’s boot and into an empty net. It undid the superb work of Hart to save Ibrahimovic’s penalty low to his right - after David Luiz was tripped by Bacary Sagna - and De Bruyne’s powerful finish from a tight angle following Fernandinho’s surge forward. Former Chelsea defender Luiz will be banned for the return
leg after being shown a yellow card 12 seconds into the game, as will midfielder Blaise Matuidi. Manuel Pellegrini’s side were fortunate to be in a position to salvage a draw as the fragile defence that has contributed to their disappointing Premier League campaign continued to look unstable. Their deficiencies without injured captain Vincent Kompany have been well documented, and they have now managed only one clean sheet in nine Champions League games this term. CONTINUED ON PAGE 14
