hief Justice Willy Mutunga has fast-tracked the hearing of the appeal filed before the Supreme Court by Deputy CJ Kalpana Rawal and Justice Philip Tunoi challenging their retirement at 70. Mutunga has directed that an interparties hearing will now be held on Thursday and not June 24 as earlier ordered by Justice Njoki Ndung’u, given the public interest in the matter. The parties in the case who include Rawal, Tunoi and the Judicial Service Commission are first expected to appear before Justices Ndung’u and Smokin Wanjala for further directions tomorrow morning. The CJ has also directed that the case be heard before all the remaining judges of the Supreme Court bench including himself, Justice Ndung’u, Wanjala, Mohammed Ibrahim and Jackton Ojwang’ on June 2. Dr Mutunga’s move came amid growing concerns of a looming crisis in the judiciary over the matter.

CJ Mutunga fast-tracks Rawal Appeal to halt looming crisis MONDAY, MAY 30, 2016
From Page 1 Justice Rawal who is also the deputy Chief Justice and Justice Tunoi lost a retirement case last week after the Court of Appeal upheld a High Court ruling that ordered their retirement after having attained the age of 70. But they both sought orders from the Supreme Court, where they are members of the bench, throwing the whole judiciary into a crisis. The orders issued by Justice Njoki Ndung’u were criticized by lawyers who argued that its hearing on June 24 as she had set would come at a time the Supreme Court bench will be lacking a quorum. The lawyers argue that with two of the court’s judges having interests in the case, the highest court in the land lacks the required quorum to hear the appeal because Dr Mutunga shall have retired by then. Chief Justice Mutunga is set to retire by mid next month, days before the appeal was initially set to be heard. Chief Registrar of the Judiciary Anne Amadi earlier today said Dr Mutunga would give direction on the impasse. “Chief Justice Willy Mutunga as President of the Supreme Court, will give direction on unfolding events following a crisis building up in the retirement case of his deputy Kalpana Rawal and Philip Tunoi,” Mrs Amadi told Capital FM. Dr Mutunga also chairs the Judicial Service Commission (JSC), the judges’ employer. The commission was expected to hold a crisis meeting today to deliberate and find a solution to the unfolding crisis. Both Rawal and Tunoi have contested their retirement at 70
Chief Justice Dr Willy Mutunga. He has today moved the appeal by Supreme Court judges Kalpana Rawal from June 24 to June 2 in a bid to avoid an imminent crisis that would have befallen the highest court in the land.
saying they were employed under the old constitution that capped the retirement age of judges at 74. But JSC holds that the Supreme Court in which they serve is a creation of the 2010 constitution which requires them to vacate office at the age of 70. A number of parties, the Law Society of Kenya, the Ombudsman Otiende Amollo, and JSC have since expressed concern that a failure to resolve the impasse expeditiously could lead to
a crisis. “The Chief Justice will be going on terminal leave shortly. In the event that the process of finding a successor to the petitioner is not conducted promptly or halted by the Honourable Court as the petitioner prays pending the hearing and determination of the petition, another greater constitutional crisis would arise hence paralysing the delivery of justice in the Supreme Court,” Amadi
submitted to the High Court when Rawal challenged her retirement. Article 163(2) of the Constitution stipulates that, “the Supreme Court shall be properly constituted for the purposes of its proceedings if it is composed of five judges,” and the concern is the threshold would not be met should Mutunga, Rawal and Tunoi exit office at the same time without replacements having been secured.
IEBC to create 100, 000 new jobs in 2017 Nearly 100,000 extra people will be hired to preside over next year’s General Election following plans to create an extra 12,000 polling stations during the 2017 General Election. IEBC chief executive Ezra Chiloba told Parliament last week that the commission has planned to increase the polling stations to 44,000 from current gazetted 32, 000 in bid to ease congestion during the voting process that apparently leads to voter apathy. “The increase of polling stations to 44,000 is necessary if we are going to register an additional 8 million voters,” Chiloba told Parliament’s Justice and Legal Affairs Committee. The new 12000 stations will create demand for more polling clerks, presiding officers and their deputies in what will cost the electoral agency billions of shillings in pay. According to tradition, each polling station is manned by a presiding officer, a deputy presiding officer and six clerks. This means IEBC will require 352, 000 workers on the voting day, up from 256,000 that were hired during the 2013 General Election. The commission also estimates to spend Sh4.4 billion to pay the polling staff on top of Sh3.29 billion it will require for the fresh voter listing that will happen for 30 days between February and March and will involve 30, 000 clerks. It will also require another half a billion to hire 15, 000 clerks for 30 days to inspect the voter register ahead of the August 2017 general elections. Mr Chiloba said additional polling stations mean additional electronic voter identification kits (Evids) and additional results transmission gadgets. It also plans to recruit temporary ICT staff for the 290 constituencies three months before the election, which will be conducted on August 8. @wilson_x254
Ours is a peace rally, says Cord Cord leader Raila Odinga has said they will use the Wednesday rally at Uhuru Park to only preach peace and unity and not to undermine the government. Odinga (pictured right) said the rally will not be used to disrespect the government as claimed by a section of Jubilee MPs and that its main reason will be to reconcile and urge citizens to remain peaceful ahead of next year’s General Elections. “We are only interested in preaching peace, I have heard some people claiming that we will use the opportunity to undermine the government, that’s not true,” Odinga said. “Madaraka rally will be used to reconcile, unite as well as urge citizens to be peaceful and rumors that it will be used to disrespect the government are not true, “added the Cord leader. Odinga’s remarks in Mombasa yesterday came amid confusion over who will hold their rally at Uhuru Park. Cord and Prayers Beyond Boundaries Ministries Bishop Lucy Ngunjiri have maintained that they will hold their rallies at the venue come Wednesday as both have clearance from Nairobi City
County. “I paid money to the Nairobi City County to use the venue, mine is matter of faith not political gathering,” Ngunjiri said. The Government through the Interior Cabinet Secretary Joseph Nkaissery has vowed not to let the Opposition use the venue on Wednesday for their rally. “We will not give Cord any more room to challenge the government of the day. We will rein in Cord leaders Raila Odinga, Moses Wetang’ula, Kalonzo Musyoka and Senators James Orengo and Johnstone Muthama if they continue breaking the law,” Nkaissery said. “By organizing a parallel rally at Uhuru Park on Madaraka Day, Cord is contravening the law and we will not allow them to do that. Madaraka Day is a national holiday and only the President is allowed to preside over such functions,” added the Interior CS. The Cord leader has maintained that the opposition will go on with their planned rally, saying the country needs unity especially on a special day like Madaraka day.
Kiharu MP Irungu Kang’ata yesterday said over 100 members of parliament allied to the Jubilee Coalition have confirmed that they will attend the prayers organised by Prayers beyond ministries. “I have talked to several MPs and about 100 of them have confirmed that they will attend the prayers, Cord should therefore not interfere with the prayers on Wednesday,” he said. @sam_x254

Photos of wanted criminals released Police have circulated the photos and names of eight wanted criminals terrorising the public within the coastal region. This follows the arrest of four people suspected to have been involved in Sunday’s killing of three Nyumba Kumi officials in Diani, Kwale. A statement from the Inspector General’s office pointed out that the four were arrested following a police operation targeting people linked to violent crimes in the region. “In the early hours of Sunday 29th May 2016 in Bongwe area within Msambweni Division in Kwale County, three community leaders namely Mohamed Juma Mwanguzo, Juma Omar Mwanyota, and Hassan Debe were murdered by persons suspected to be members of a known criminal gang which the police have been on their trail for some time,” it pointed out. Coast Region Police Commander Francis Wanjohi said that the three Nyumba Kumi officials were killed by suspected Al-Shabaab returnees. “Several police operations have been mounted in the recent few weeks targeting persons linked to violent crime in the general South Coast region, which led to the arrest of the following persons; Nassor Juma Mwahaga, Abdalla Jagfari Mwavyema, Athman Rama Mwanyonje and Omar Juma Dzinza.” According to the statement, the eight others are still on the run and are being sought by the police. “Those being sought and believed to be members of criminal gangs terrorising the public within the same coast area include the following: Ali Haji Kolagwa, Ali Salim Mwagutsi, Said Athman Mjinga and Said Hassan Seti,” it stated. “Others are Ali Hamisi Mwaligulu, Ali Musa Mwagutsi, Hamisi Musa Mwaligulu and Alfan Juma Mwakambirwa.” The police requested the public to report to the nearest police station should they see or have any information regarding the individuals. They further gave a warning to Kenyans living near the Kenya Somalia border to be extra vigilant as there are indications that some terrorists fleeing from AMISOM action in Somalia could be making attempts to infiltrate into the country and stage attacks during the month of Ramadhan.

State mulls scrapping exam fee for private candidates Candidates from private schools are set to benefit from the examination fee waiver programme from the government beginning next year, Education Cabinet Secretary Fred Matiang’i has said. Dr Matiang’i said his ministry is in talks with the National Treasury and other key players in the sector to have candidates from these institutions enjoy the waiver as their counterparts in public schools. “We are negotiating with the Treasury and other key players to have all students including those in private schools enjoy examinations fee waiver to ensure fairness and equity in the education sector,” Dr Matiang’i said during a thanksgiving day at Pioneer School in Murang’a County. “These candidates from private schools are also Kenyans and must also enjoy the benefits currently being enjoyed by their counterparts in public schools,” he added. Last year, the government resolved to waive examination fees for candidates in public institutions that receive free primary and secondary school funds. This year alone, the Kenya National Examination Council (Knec) has received Sh3 billion to pay the registration fee for Standard Eight and Form Four candidates. “The waiver is meant to ensure that no pupil or student misses the national examinations because they did not have money,” said the CS. He observed that the move is motivated by the increasing number of students enrolling in schools and that the
government will continue to fund all educational programs in both private and public institutions. “There are signs that the number of candidates will continue rising. The commitment of the government to fund and support education is bearing fruits,” said the CS. However, he was quick to note that the ministry had already paid the examination fees for all candidates in public schools expected to sit for their national examinations later this year. “The government instructed us to pay examination fees for all the form four candidates and the class eight candidates. We have already done that and I want all the parents to know that we have already paid the fees for the students this year,” he stated. He warned parents against paying for the examination fees and instead report any school principal asking for the money. “So no parents should be asked to pay any examination fees and if anyone is asked to do so, please let our county directors of education know and they will take the matter up,” he said. Kenya Private Schools Association chairman Peter Ndoro said the private sector welcomes the positive gesture by the Education Cabinet Secretary, saying it will bring equality among Kenyan children. “As the private sector we have always held the belief that money released by
the government belongs to the Kenyans child who are found both in public and private schools and not a section of them, we therefore welcome this new move by the Cabinet Secretary to finally consider children from the private sector,” Ndoro told XNews. Remember all children are Kenyans and deserve equal treatment from the government. Education should unite the Kenyan child and not divide them as the government is currently trying to do,” he added. Ndoro said the Kenya National Examination Act was amended allowing candidates from the private schools to also benefit from the waiver on the examination fee. “The New Kenya National Examination Act provides that all citizens both from private and public schools are entitled to the pay and therefore we really appreciate the move by the CS,” Ndoro said. “The Kenya Private schools association has always been at loggerhead with the government over their decision to only pay examination fee for candidates from public schools terming it discriminatory. Information from Knec indicate that a total of 1.5 million candidates both KCPE and KCSE will sit for this years’ national examination scheduled for November. @wilson_x254 and

Nappy-less donkeys barred from Wajir town over ‘poop’ Donkeys have been banned from entering the north-eastern town of Wajir unless they wear nappies. Officials say the rule is to protect the town’s newly laid tarmac road. A letter from the Wajir County government to donkey-cart owners said they must manage their animal’s faeces “to avoid poop all over the tarmac road creating nuisance”. And the cart owners are already complying with some sharing tips on social media on how to attach nappy sacks. Donkey carts are a common sight in Wajir’s town centre. This is the second time a nappy order on donkeys is being issued in Kenya, following a similar order in Limuru in 2007 although it was never put into practice.
The authorities in Wajir, which is more than 600km north-east of Nairobi, are probably keen to protect the new tarmac road after waiting decades for such development. The new road was built last year and is 27km long. “The county government appreciates the contribution of the donkey-cart operators to the economy of Wajir. However the town must be kept clean at all times,” the order said. “In view of the above you are directed to manage your donkey poop. No donkey will be allowed in town without this poopcollecting bag,” it added. The nappy notice was issued on Monday and came into effect on Thursday last week.

Environmental Assembly was monumental, says UNEP chief
June.
The United Nations Environmental Programme (Unep) Executive Director Achim Steiner has described the recent global meet by the environmental body as ‘monumental’ and has hailed it as ‘not just another conference’. The United Nations Environmental Assembly second session came to a close last Friday with numerous resolutions agreed upon by the delegates. The over 2300 delegates from around the world came to an agreement on 25 resolutions and actions from the global meet who converged under the theme “Delivering on the 2030 Agenda for Sustainable Development” at UNEP Headquarters in Nairobi. The world’s environment ministers passed far reaching decisions on matters such as marine litter, the illegal trade in wildlife, air pollution, chemicals and waste and sustainable consumption and production. Since the main theme of the meeting was delivering on the 2030 Agenda, UNEA asked UNEP to initiate new partnerships and strengthen existing ones including with the private sector and civil society towards achievement of the SDGs. On the 2015 Paris Agreement, the highlevel summit agreed that the environmental body should work with speed to support countries, especially developing ones, to build national readiness, implementation, financial and technological capacities toward implementation of the agreement. The key issue of illegal trade in wildlife which
threatens to push species to extinction was also discussed by the participants. They urged countries to step up efforts to prevent, combat and eradicate the supply, transit and demand related to the illegal trade. This will be done through implementation of strategies and action plans, strengthening of governance systems on anti-corruption and anti-money laundering schemes. The member states were also urged to develop sustainable and alternative livelihoods for communities affected by the illegal trade. The convention also saw the delegates launch a new global campaign dubbed “Wild For Life”, which will engage the public to end the illegal trade in wildlife. The campaign will be backed by celebrities such as model Gisele Bundchen and footballer Neymar. UNEA, which is UNEP’s most authoritative decision making body on the environment, also agreed to develop research and action that could be adopted to implement SDGs relevant towards the creation of healthy environment for people to thrive in. The delegates also put to task product manufacturers to consider the lifecycle environmental impacts of their products especially plastics on the world’s seas and oceans. The outgoing director also noted Kenya’s role as the host of the conference and the entire environmental programme since its inception. Mr. Steiner’s term at the helm of the office ends in June after a 10-year stint. @harrison_x254

Shipwrecks kill “up to 700’ migrants off Libyan coast Up to 700 migrants are feared drowned in a series of shipwrecks off the coast of Libya in the last few days, the UN refugee agency says. The boats sank south of Italy on Wednesday, Thursday and Friday as the migrants tried to reach Europe in unseaworthy vessels. Spring weather has led to a surge of people attempting the perilous crossing from Africa to Europe. It is now a key migration route since a deal curbed numbers sailing to Greece. Carlotta Sami, spokeswoman for UNHCR, said Almost 100 migrants are missing from a smugglers’ boat which capsized
on Wednesday as he gave details of the shipwrecks. About 550 other migrants are missing from a boat which overturned on Thursday morning after leaving the Libyan port of Sabratha on Wednesday. Survivors said the boat had no engine and was being towed by a second smuggling vessel. And in the third shipwreck on Friday, 135 people were rescued, 45 bodies pulled from the water and an unspecified number of others are missing, he said. Meanwhile, the MSF Sea group suggested the death toll from the last week could be as high as 900.
Survivors are being taken to the Italian ports of Taranto and Pozzallo. Meanwhile, the Italian authorities have said the rescue of more than 600 migrants off Libya on Saturday by a flotilla of EU ships took the weekly total to at least 13,000. The rescues were the latest by a multinational patrol of ships operating in the Mediterranean. Carlotta Sami told the BBC: “One of the most worrying things is that all these ships have left together in just the last few days. It has put rescuers under severe pressure.”

China firm sorry over race-row ad
A Chinese firm has apologised over an advert for detergent which has provoked a storm of allegations of racism. The manufacturer of Qiaobi said it strongly opposed and condemned racial discrimination, and was sorry the advert had caused controversy. In it, a black man is stuffed head-first into a washing machine before emerging as a light-skinned Asian. In its initial response several days ago, the firm had suggested that its critics overseas were too sensitive. And in a statement of apology late on Saturday, Shanghai Leishang Cosmetics Ltd Co also blamed foreign media for amplifying the advert. It first appeared in March but was halted amid protests this week which followed extensive media coverage of the controversy. “We express our apology for the harm caused to the African people because of the spread of the ad and the over-amplification by the media,” it said. “We sincerely hope the public and the media will not over-read it.” The company says it has withdrawn links to the advert, and would like others to stop sharing it online. Within the past few days, it has been watched more than 6.5 million times on YouTube. In the advert, a young Chinese woman is doing her laundry. Then in walks a black man, with some paint stains on his face. They look at each other suggestively before she puts a tab of detergent into his mouth…and then shoves him into the washing machine. And Alas! He emerges a fair-skinned Chinese man. The lady doing the laundry is apparently delighted by this development.

Accountants’ body in bid to curb corporate malpractice in country
The Association of Chartered Certified Accountants (ACCA) has called for increased transparency within the business sector in a bid to curb corporate malpractice. A new report by the association has analysed the wide range of ‘speak up arrangements’ used by firms across the world and identified what makes them effective. The findings show that, though difficult, demonstrating commitment to deal with issues and making the outcomes visible pays off. Commenting on the report, ACCA Kenya National Sales Manager Geoffrey Ochieng said: “The report findings that centres on establishing firm and transparent channels of reporting heinous activities, is a ray of hope for organisations amid increased cases of corporate malpractices ” “It is important that potential whistleblowers have a clear view of not only the avenues available for speaking up, but also the full path ahead of them as they go through the whistleblowing journey. Simply put, people will only speak up if they believe action will be taken,” says Jo Iwasaki, ACCA’s head of corporate governance. According to Jo Iwasaki, increased transparency can be an effective way of minimising the reputational damage that can go hand in hand with potential malpractice. “If your employees feel that wrongdoing will be dealt with promptly and fairly, they are far less likely to make the
issue a public one. Many of the great reputational disasters of recent years have been made worse by attempts to sweep the issue under the carpet. A far better approach is to develop and implement robust and consistent response systems with clear and coordinated follow-up activities.” Making the tough decision to bring in outside help should also be considered says Iwasaki. “It is worth considering the use of an

Over 18,000 households to benefit from Kiambu Last Mile project
More than 18, 290 households are set to benefit from the Last Mile Connectivity Project in Kiambu County by June 2017, President Uhuru Kenyatta has said. The Kiambu last connectivity project is part of the government’s initiative to increase the number of households connected to electricity and would see 27 new transformers installed to connect more than 1,600 new customers within the County. Launching the project at the weekend, the head of the State said every Kenyan has the right to power connectivity whether he lives in a mud house, timber house or semi-permanent house. “Every Kenyan in need of electricity must be connected whether he live in a mud house or timber house. Days when electricity was a preserve for well offs are long gone,” he added. This makes it the second government milestone in ensuring each and every household is connected to the national grid by the year 2020 after the state lowered the cost of power installation to Sh15, 000 down from Sh35, 000. Upon its completion, the first phase of the project will see at least 300,000 households connected to the national grid by June next year. “When we took over, only 30 per cent of Kenyans were connected to electricity challenging us to raise the figure to 70 per cent. Now we are targeting each and every Kenyan,” the President explained as he addressed Kiambu residents. @enock_x254

According to a new survey ranking of working hours in 71 cities across the globe from the least to the longest, Kenya’s capital came in at number 65. The survey, conducted by Swiss global financial services company, UBS, found that Nairobi city residents work for up to an average of 42 hours a week. Since the average city on the index has a working week of 36 hours and 23 minutes, Nairobians work roughly 15 per cent longer than the global norm. UBS’s annual ‘Prices and Earnings’ study indicated that Paris, France’s capital, had the shortest working time with employees clocking in 30.84 hours a week. Lyon, France came second with residents clocking 31.36 hours a week, Moscow in Russia was third, recording a mere 31.67 hours a week, while Helsinki came fourth sporting 31.90

Eveready blames Sh90m pretax loss on low battery supply
Battery manufacturer, Eveready East Africa has reported a Sh90.89 million loss before tax for the six months ended March 31, 2016, blaming the fall on low stock supplies. Speaking in regard to the company’s earnings, Eveready Group Managing Director Jackson Mutua noted that the firm’s diversification programme has been yielding positive results but problems in stock supply weighed down the performance. He stated that revenues from these products continue to record steady growth. “The group however, recorded a drop in revenue in the half year results for the period ended March 31, 2016 compared to the same period last year as a result of changes within our main supplier of Carbo Zinc and Alkaline batteries, which adversely affected the supply of product for a considerable period of time,” Mutua added. This aspect, he explained, led to an out of stock situation, a factor that “compromised revenue performance and contributed to a loss before tax of Sh90 million compared to a loss of Sh18 million in prior period.” The out of stock situation has been addressed and recovery is expected going forward, Ms Lucy Waithaka, Board Chair and Mutua said in a joint statement. “We continue to avail to our customers our traditional products under the portable power business. Diversification into new products remains important to our strategic efforts towards achieving
sustainable growth in revenues. To ths end, Eveready will be introducing new product lines in 2016. This will broaden our portfolio mix, enhance revenues and mitigate supplier risk inherent in the business,” they added. Last year, Eveready’s bid to diversify its business gained momentum after shareholders approved two key projects. Meeting in Nakuru in May 2015 at the

ZEP-RE profit soars despite global economic challenges Regional insurer, ZEP-RE (PTA Reinsurance Company) has posted a net Sh1.99 billion ($19.9 Million) for the financial year ending December 31, 2015, despite what the company has termed as a harsh economic environment. Speaking at the Company’s 25th Annual General Meeting held in Mombasa, ZEP-RE’s Board Chairman Mr. William Erio said: “The year 2015 started with great promise but intervening negative pressures namely a slowdown in China (a key trading partner of the COMESA region), a fall in global commodity prices, uncertainty in the Eurozone (due to the Greek debt crisis) and a strengthening dollar turned the economic environment on its head. The global economic situation negatively impacted economies of the region resulting in slowdowns, reduced consumption and a weakening of local currencies against the dollar.” In addition to the economic slowdown, the Company had to deal with the effects of two major earthquakes in Nepal, one of its major markets, which resulted in gross losses which amounted

Commenting on the company’s performance, the Secretary General of the Common Market for Eastern and Southern Africa (COMESA), Mr. Sindiso Ngwenya said the company had remained true to its developmental role as outlined in its founding objectives. “I am happy to note that ZEP-RE’s performance is attracting investors from within and outside the African continent. This can only bode well for the company and its growth goals,” Mr Ngwenya said. CA in Sh72 million free internet library digitization programme The Communications Authority of Kenya, in conjunction with Liquid Telecom Kenya, is set to connect 46 branches of Kenya National Libraries Services (KNLS) to the internet via a digitization programme for the first time in the country’s history. As part of the agreement, Kenya’s public libraries are moving online as the organisations work hand-in-hand to deliver free Internet to over half a million library members from June this year. The move will see each outlet provided with additional computers, Kindle devices and tablets at a cost Sh72 million. The initiative will allow library members to gain access to fixed and wireless Internet on their own devices. “The demand for Internet services is growing exponentially in Kenya. Connecting the public libraries means everybody will now have access to digital and online information including e-government services, research, education services and employment opportunities,” said Mr. Ben Roberts, Liquid Telecom Kenya CEO. “With the Communications Authority coming on board as the main financier of the project, we have been able to connect the public libraries even in the most remote areas with high quality connections,” he said. The Internet will be free inside the libraries, which are free to enter for children under 14, and cost Sh20 per visit for adults. @enock_x254

The drive, dunned the ‘Good Breakfast Challenge’ programme is designed to encourage nutritious breakfast tradition to help children achieve healthier lives, better school performance and a more promising start to life, the margarine maker said in a statement over the weekend. Speaking during the launch, Bruno Witvoet, CEO for Unilever Africa reiterated Unilever’s commitment towards enhancing livelihoods and improving health and wellbeing through its sustainable growth agenda. “The Blueband Good Breakfast Challenge initiative is a clear testimony of our sustainability mission. Investing in an innovative program such as this goes a long way in not only shaping our children’s behaviour but also in
building smarter talent for the future,” Witvoet said. The Good Breakfast nutrition programme will engage teachers, children and parents through a series of activities in classrooms and at home. The launch of the programme comes in the wake of a new survey which linked a nutritious breakfast to better long term school performance in children. The survey, carried out by
TNS Kenya, an independent research firm based in Nairobi- between January and February, showed that students’ concentration and energy levels increase when they start their day with a nutritious breakfast while poor nutrition in children lowered their concentration span in class due to low nourishment of the brain. @Dennis_x254

I’m also soulful and I think my sound is distinct in itself. How did you get your start? I started as an actress actually. In high school I was active in drama and theatre and for me it was a natural progression to start on music. What would be the current message of your music? It’s definitely positive. It’s about the human condition and describes everyday situations. My music is easily relatable to people. The themes focus on love, justice, dreams and pain. Who inspires you? he GoDown Gig’s core principle is not just celebrating live music but celebrating authentically African music. The monthly event seeks to provide a platform to those artistes form the motherland that might not necessarily get the exposure they deserve. And every single artiste on the GoDown stage deserves to be where they are. The performances were interspersed with sets from the modest DJ Slakers, who played Congolese music, afro house, pop music and some local hits that kept the crowd on their feet. Bany is a Congolese singer/songwriter whose music is a blend of rhumba, zouk and afro-fusion with a little hint of reggae. He and his wonderful band opened the show but considering how we tend to rate the success of a performance by the level of ‘hype’ the audience has, it was a lukewarm welcome. His songs ‘African Woman’ which he dedicated to his mother, sister and girlfriend was a sweet and poignant song and ‘Home’ was a melodious triumph. The winner of the night goes to Fred from Burundi, the lead guitarist of the Zakaleo Band. Lulu’s performance was stellar but Fred gave everyone chills with his riffs and guitar solos. The band was the first one to make the crowd get up off their feet and actually get down. The song ‘Zogo’ hearkened to those Conga-tinged taarab tunes we all love so much and the line ‘leo nimelewa kidogo naskia kuleta zogo’ was The incomparable Winyo capped off the show and gave the audience a moment to reflect with the tender, soulful ‘Nakupenda’ and the upbeat but still emotive ‘Nyachula.’ It was afro-soul revived last Saturday.

Hamilton thanks ‘gentleman’ Nico Rosberg for win
Lewis Hamilton holds up his trophy after winning the Monaco Grand Prix in France yesterday. The Mercedes driver thanked teammate Nico Roseberg for the win.
Mercedes driver Lewis Hamilton thanked teammate Nico Rosberg ‘for being a gentleman’ and letting him through to help him win the Monaco Grand Prix. Rosberg struggled for pace early on and was told by Mercedes to allow Hamilton into second behind Daniel Ricciardo. A botched pit stop by Red Bull then enabled Hamilton to take a first win of 2016 and cut the drivers’ title deficit to Rosberg to 24 points. “I didn’t expect the points to shift in the way they have,” said Hamilton. Rosberg said: “The feeling I had in the car was more painful than having to let Hamilton by.” “It was very painful of course but easy to decide to do that.” There is an agreement between the Mercedes team and the drivers that if one of them is off the pace and affecting the other’s chance of a win, then he will let him by. Hamilton won his third world title last year but went into Sunday’s race 43 points behind championship leader Rosberg, who started 2016 with four straight victories.
Hamilton, who had suffered repeated technical problems in the first five races, said: “I’m just focused on enjoying the moment. “But the past five races have shown anything is possible. I’m conscious mistakes are still being made and we really need to pull together.” He added: “A swing goes both ways.” Hamilton had started third after a fuel-pressure problem had affected his qualifying session. “In the past, I would have been annoyed all night and denied myself any enjoyment in the other great things here,” he said. “But I went out with some friends, had a beer and thought: ‘Let’s see what tomorrow brings.’” He added: “I came here today thinking I’ve just got to go and do it. It’s not just going to happen. No-one’s going to give it to me. The rain definitely opened a window of opportunity. Once I got past it was hammer time.” Rosberg said he did not understand why he was lacking so much pace in the wet opening part of the race. Ricciardo pulled out a 13.1-second lead in seven laps before Rosberg let Hamilton through and the Briton then pulled out 10 seconds in five laps once he was into second place. Rosberg said: “It was pretty simple - I wasn’t going to be able to fight for the win. They gave me a warning to up my pace and I couldn’t so it was logical and fully understandable.” He said he would look into the data to see if he could understand what had gone wrong.
Okumbi’s search for maiden win continues
Harambee Stars defender Eugene Asike closes in on Taifa Stars Elias Mrigao during a friendly match between Kenya and Tanzania at Kasarani stadium yesterday. The match ended in a 1-1 draw to extend coach Okumbi’s search for a first win with the national team.
From Page 16 Four minutes later, Oluoch was called into another full stretch save to deny Ramadhani who unleashed a ferocious low shot from the edge of the box after cutting in. Okumbi threw in his first dice, bringing in AFC Leopards winger Clifton Miheso for Mieno, the change seeing Johannah shift into the number ten role from the wing, a position that was now occupied by the speedy Miheso. Tanzania’s Charles Boniface Mkwassa responded on the hour mark, throwing in three at a go with keeper Munishi being replaced by Azam shot stopper Aisha Manula while Ramadhan and Jonas Mkude paved way for Farid Musa and Mohammed Ibrahim respectively. Stars had a superb chance from the counter in the 70th minute when Wanyama released Timbe on the right and though the ball was heavy, the Belgian based winger managed to keep it in, however, Miheso miscued a kick unmarked at the far post from
the resultant cross. With goals being of essence, Okumbi turned on to SportPesa Premier league top scorer Wycliffe Ochomo, summoning him to take up Jesse Were’s place. Later, Ajax Cape Town’s Victor Ali Abondo came in for Akumu, with Wanyama now playing the defensive midfield role. There was still time for another change for Okumbi’s men with Tanzania’s defense still unlocked and he looked onto Ulinzi Stars forward John Mark Makwatta who has 10 goals in the first leg bringing him in for Timbe. Despite the increased pressure, Stars couldn’t find a way past the Tanzanian backline. Ahead of the second friendly match against Sudan on Tuesday evening, Okumbi will need to work on the side’s finishing though he is expected to field a squad of majorly emerging talent. Germany suffer defeat as Italy, Spain win in friendlies ahead of Euro 2016 Germany suffered a third defeat in four games as they were beaten 3-1 by Slovakia in the final match before their Euro 2016 squad is finalised. But fellow glory contenders at the European championships which begins in France in less than a fortnight Italy and Spain both won. Joachim Low’s world champions went ahead through Mario Gomez’s penalty after 13 minutes. But Slovakia, who are in the same group as England and Wales in France, hit back through Marek Hamsik, Michal Duris and Juraj Kucka in Augsburg. The game was played in heavy rain with concerns the match might be abandoned. Germany, who are in the same group as Northern Ireland at Euro 2016, have to finalise their 23-man squad by midnight tomorrow. Euro 2012 winners Spain meanwhile continued their preparations for the defence of their title with a 3-1 win against Bosnia-Herzegovina in Switzerland. Celta Vigo forward Nolito scored the opening two goals for Vicente del Bosque’s side. Chelsea midfielder Pedro added a late third after Emir Spahic had reduced the deficit for Bosnia. Spain gave a debut at right-back for Arsenal’s Hector Bellerin. In another friendly, Southampton’s Graziano Pelle scored the only goal as Italy beat Scotland 1-0 in Malta, while Portugal - who meet England at Wembley on Thursday - were 3-0 winners at home to Norway. Scotland were comfortably beaten by Italy, with the only saving grace that the margin of defeat could have been greater.
Liverpool’s French defender Mamadou Sakho. He has been cleared to play for France in the Euro 2016 finals after a 30-day ban ended on Saturday.
Italy dominated the match from start to finish. Scotland offered little as an attacking force and struggled to keep possession on an unforgiving surface in Malta. The Italians adapted to that much better as they continued their preparations for Euro 2016. While Antonio Conte’s side would have been expected to control the game played in Malta because the Italians are holding a week-long training camp there ahead of Euro 2016 - the ease with which they brushed their Scottish counterparts aside should be of concern to Gordon Strachan. Pelle’s goal was scant reward for their dominance but highlighted the Italians’ superior quality. Daniele De Rossi sliced through the Scots team with a typically precise pass for Eder and when the ball broke off the striker to Pelle, he curled a shot inside the left-hand post of David Marshall from 19 yards. It was a deadly strike and Scotland were fortunate Italy had failed to capitalise on a string of earlier chances to bury their opponents. Having pushed away an Antonio Candreva free-kick, which bounced nastily in front of him, Marshall reacted brilliantly to keep out Emanuele Giaccherini’s close-range rebound. Giaccherini was the main culprit in terms of passing up chances as he skied one shot when picked out unmarked 12 yards out and then stabbed wide after getting on the end of another pinpoint De Rossi pass. Incredibly, the Scots failed to hit the target over the entire 90 minutes, but could have had an ill-deserved equaliser with 12 minutes remaining. A slack clearance from Federico
Spanish attacker Nolito celebrates scoring against Bosnia-Herzegovina with teammate David Silva during their friendly match in Switzerland yesterday. Nolito scored a brace with Chelsea forward Pedro adding a third for the European Champions.
Bernardeschi fell kindly for Steven Naismith and although he was able to find Matt Ritchie, the Bournemouth forward could not wrap his left foot
around the ball sufficiently and only managed to hit the side-netting. Strachan had been certain before the match his players would be motivated
to play a team of Italy’s quality, but for the most part the gulf in class made for a tough learning experience for Scotland.
Defender Sakho allowed to play for France at Euro Mamadou Sakho could play for France at Euro 16 after Uefa opted against extending a provisional 30-day suspension for a failed drugs test. European football’s governing body confirmed in a statement that Sakho would be free to play from Sunday. The Liverpool defender, 26, was banned as a result of a test taken after his side’s Europa League last-16 second-leg match Manchester United on 17 March. Uefa added that a decision on the case will be made within the next few days. In his defence to Uefa’s disciplinary committee, Sakho questioned whether the fat burner-type substance which caused him to fail the test should be on the World Anti-Doping Agency’s list of prohibited substances.
The decision - by the chairman of Uefa’s control, ethics and disciplinary body - not to extend the ban means Sakho will be available to France coach Didier Deschamps for the European Championship finals. Teams have until Tuesday to submit their final squads for the tournament, which starts when hosts France play Romania on 10 June. Deschamps has lost Barcelona defender Jeremy Mathieu to a calf injury, with uncapped Lyon player Samuel Umtiti, 22, added to the national squad as his replacement. Sakho has not played since Liverpool’s 4-0 win over Everton on 20 April. Liverpool have declined to comment on Uefa’s decision.

Real wins after final drama with Atletico Cristiano Ronaldo fired home the winning penalty as Real Madrid won Europe’s biggest prize for the 11th time in its history. Ronaldo held his nerve to beat Jan Oblak from the spot after Real had been held to a 1-1 draw by Atletico Madrid in the Champions League final. Juanfran, the Atletico defender who had earlier provided the assist for the equaliser, was the unfortunate man to miss his spot kick, striking the post and allowing Ronaldo to fire his team to glory. It was a dramatic conclusion to a game which only caught light in the later stages. Sergio Ramos had headed Real in front after 15 minutes before Atletico hit back after the break. Antoine Griezmann, scorer of 32 goals this season, should have equalized just after the interval but the forward struck the crossbar from the penalty spot after Fernando Torres had been fouled. That miss failed to dishearten Atletico though and Yannick Carrasco, a second-half substitute, fired home from close range with 11 minutes remaining to level the tie. The contest moved to penalties and with Real leading 4-3, Juanfran became the first man to fail by hitting the post. That enabled Ronaldo to step forward and the Real man made no mistake, coolly firing home to win the club’s second title in three seasons. It also ensured Zinedine Zidane, the Real coach who took over in January, has now won the trophy as both a manager and a player with the club. For Atletico, the pain of this final defeat may yet prove more fatal than that of two years ago. This was its chance. Real was out on its feet for much of extra-time, struggling to deal with
Atletico’s extra pace and movement. And yet, Atletico could not find a way. Two years ago it was within touching distance, leading 1-0 going into injury time before Ramos scored a dramatic equalizer. Atletico never recovered as they went on to concede three times in extra time and lost 4-1 in a beating so brutal that the scars still burn bright. And now, manager Diego Simeone says he will “start thinking” about his future with the club after Saturday’s defeat. “Losing two finals is a failure,” said the Argentine, in charge since 2011. Simeone - who guided Atletico to their first La Liga title since 1996 in 2014 - was linked with Chelsea before Italy boss Antonio Conte was appointed first-team head coach at Stamford Bridge. In addition to reaching the Champions League final twice, Atletico have also won the Copa del Rey, the Europa League, Uefa Super Cup and Spanish Super Cup under the 46-year-old’s leadership. Asked if he had thought about resigning after Saturday’s defeat, Simeone added: “I am thinking that I have to start thinking. It’s a logical question for you to ask after a defeat like the one we’ve suffered today. “We had the chance to become champions, we didn’t take that chance. We need to continue working, I have to think things out on my part that’s what I’m doing now. “What is clear to me is that nobody remembers the losers. We have to get over this and heal our wounds.”

GERMANY SUFFER THIRD DEFEAT IN EURO PREP
P14
Harambee Stars head Coach Stanley Okumbi.
Okumbi’s search for first win continues Victor Wanyama’s 39th minute penalty cancelled out Elias Maguli’s early goal as Harambee Stars were held to a 1-1 draw by visiting Tanzania’s Taifa Stars in a friendly match played at the Moi Sports Centre Kasarani on Sunday. Both sides were using the match as part of their preparations for the upcoming 2017African Cup of Nations qualifiers despite both having been knocked out. Kenya plays Congo Brazzaville on June 5 while Tanzania will be at home to Egypt the previous day. The draw saw head coach Stanley Okumbi wait long for his first win since being appointed after going three matches without a win. Both sides missed some of the star names in their squad with Tanzania missing Belgium based Mbwana Samatta, TP Mazembe’s Thomas Ulimwengu and South African based Mrisho Ngassa. Kenya missed the services of defender Brian Mandela, paving a return of Eugene Asike to the starting line-up. Belgium based Johannah Omollo was out due to injury while Sweden based Michael Olunga was also unavailable. The visitors were the better side in the early exchanges with Deus Kaseke driving the side from midfield, winning possession and spraying the balls wide for their speedy overlapping fullbacks. Tanzania had their first effort in the fourth minute with skipper Mwinyi Kazimoto’s ferocious strike from the edge of the area being palmed away by Stars keeper Boniface Oluoch and Asike ensured the danger was dissolved chesting the ball back to his keeper. The visitors were mostly using the right channel, making the most of a bad day in office for
Bulgaria based left back Aboud Omar. In the 12th minute, Kaseke sprayed a ball wide to Shiza Ramadhan with the midfielder shooting inches wide from a tight angle, the entire backline caught flat footed. Stars were limited in their chances and Taifa Stars keeper Deogratius Munishi remained untested in the opening 20 minutes of the game. Zesco United defender David Owino had Kenya’s opening clear chance in the 23rd minute rising at the far post to head an Omar corner but his effort went wide. The hosts began getting more involved in the game with Wanyama and Anthony Akumu doing the work in midfield to try and open up the Tanzanian defence which had all afternoon seemed intact. Stars though found themselves a goal down in the 33rd minute when Elias Maguli rose high at the edge of the six yard box to head in a cross from Juma Abdul. The lead though lasted only six minutes as skipper Wanyama levelled matters from the penalty spot after Abdul hacked down Ayub Timbe inside the box after being turned inside out. On-form Jesse Were should have taken the score up to two at the stroke of half time but he missed a sitter with Eric Johannah laying in a decent low cross from the right that needed the simplest of touches to direct it into the net. The game resumed for the second period with as much pace with Stars knocking first on the door with Timbe having a shot fly inches over the bar after racing to pick up Omar’s cut-back from the left in the third minute.
