KNCHR condemns barring of Uhuru Park rally meeting

he Kenya National Commission on Human Rights (KNCHR) has castigated the government’s decision to bar the opposition from holding a rally at the Uhuru Park grounds tomorrow saying it is in breach of their rights to assemble. The state yesterday announced that it will close both Uhuru Park and Nyayo National Stadium tomorrow citing security threats. Cord was planning to host its Madaraka Day celebrations at the historic Uhuru Park grounds, a move the government through National Security Advisory Council (NSC) has cancelled for ‘security reasons’.
However, KNHRC says the move by government is a breach of the constitution and in a particular article 37 which spells out the right of any citizen to assemble. “The commission finds no basis for the police to disapprove the CORD rally. The police have no authority over administration of Uhuru Park which squarely falls under the Nairobi City County. The Commission reminds the police that it’s their constitutional duty to facilitate the enjoyment of the right to assembly,” said the commission’s chairperson Kagwira Mbogori. CONTINUED ON PAGE 2
