Five police officers killed in Kapenguria gun attack

F

ive police officers including an OCS have been killed in Kapenguria after a suspected al-Shabaab militant opened fire at a police station in the area early today. Kapenguria OCS Vitalis Ochido was shot dead alongside four other officers in the 5.30am attack. Inspector general of Police Joseph Boinnet said an individual who had been arrested for terror links, grabbed a firearm from

an officer on duty and shot at those who were at the station. “A suspected terror suspect in custody seized a rifle and began shooting,” the IG said. “The station has been surrounded and efforts to subdue him are ongoing.” The suspect whose name has since been given as Omar Okwaki Eumod had been booked at the police station last evening and was set to appear in court today. Narc Kenya leader Martha Karua has questioned the criteria used by the Judicial Service Commission for the shortlisting of candidates for the Chief Justice position. In particular, Karua questioned why Prof Makau Mutua a respected individual in the legal profession did not make it in the final cut of six. Karua said the Judicial Service Commission should account to Kenyans in their criteria for shortlisting candidates as the public have a right to know. “Judicial Service Commission should account to Kenyans on their criteria for shortlisting candidates Public have a right to know. Ombudsman slams Ipoa over increased extrajudicial killings The Commission on Administrative of Justice has slammed the Independent Police Oversight Authority over the rising cases of extrajudicial killings by police. “We do not understand why IPOA is silent on such matters given that most of these complains we receive are in their knowledge yet we are not seeing any reactions,” said the commission’s chairman Otiende Amollo. Otiende said IPOA has failed in stemming the growing number of rogue police officers saying that such incidences are happening under their watch. He said cases of extra judicial killings in country are reportedly on the rise with the brutal murder of human rights lawyer Willie Kimani being the latest to be witnessed. The Commission on Administrative Justice (CAJ) has revealed that 14, 235 cases were reported in 2015 up from 10, 312 reported in 2014 and only 2, 340 similar cases in 2013. The Ombudsman further said that majority of the reported cases involved the Administration Police who are also in the spotlight for killing the Mavoko three. “The figures are growing each year with most cases involving the AP who have been linked to almost and every case,” CAJ chairman Otiende Amollo revealed during the launch of the Ombusdman 2015 annual report and Case Law in Nairobi. Out of the 117936 cases reported, 33053 were related to delays, 28328 accounted for unfair treatment while abuse of power complains were recorded at 22970. Amollo noted that his team had issued 37 Advisory Opinion and participated in more than 40 matters of public interest before the court with

the aim of promoting transparent gorvanance and protecting human rights. Meanwhile, Amollo who took office in 2011 announced he will submit his resignation in November this year, 12 months ahead of the end of his tenure. Senate Speaker Ekwe Ethuro lauded the commission for the key role they played in unmasking the foul fatalities of innocent Kenyans.

“The commission has proofed its mandate by enforcing administrative justice and constitutional values especially those touching on the maladministration of the police service,” said Ethuro. He urged the commission to continue with their systematic investigations surrounding the extra judicial killings.

It is believed that he had planned his escape from the cells moments before he seized the rifle and begun shooting indiscriminately. Reports indicate that the officer whose gun was seized had opened the cells to take in more suspects, when Omar snatched the gun from him and shot him dead before turning to other police officers who responded to the gunshots. Gun shots were heard from the police station as late as 10am. Details about the incident remained scanty. However, Mr Boinnet said more information about the number of casualties and their nature would be provided ‘soon.’ Elsewhere in Lamu, a terror suspect was killed and an AK-47 rifle recovered following a terrorist attack at the Mangai Rapid Deployment Unit (RDU) camp. Several al-Shabaab terrorists attacked the camp but were repulsed by officers in a fierce exchange of fire. Mr Boinnet said several terrorists are believed to have been killed or escaped with serious injuries. Ombudsman wants inquiry into police killings The Commission on Administrative of Justice (Ombudsman) has urged President Uhuru Kenyatta to form a commission of inquiry to probe the wanton abuse of power by police. The Commission’s chairman Otiende Amolo expressed concern that abuse of power and impunity by police has been on the rise. “We have recommended that President Kenyatta establishes a commission of inquiry to look into the legal, regulatory, and administrative and policy regime and policy regime with a view of making recommendations that would obviate extra-judicial killings, promote accountability and advice on the reparations for victims,” Amolo said. The move Amolo said will assist in reducing impunity within the police service. He said the commission of inquiry should be composed of representatives from the Independent Police Oversight Authority (IPOA), National Police Service Commission, Kenya National Commission on Human Rights, the Commission on Administrative of Justice and other interest groups. While releasing its annual report of 2015, Otiende said more Kenyans are dissatisfied with the conduct of police officers. In 2015, Otiende said the commission handled 117,936 of which 14,235 complaints were against police officers representing

13 percent. In 2014, the commission handled 10,312 complaints of which 79,693 cases filed were against the police while in 2013, the complaints stood at 2,340(12.82 percent) of the 18,257 complaints filed. “Whereas it is imprudent to condemn the entire police service, it would be reckless to overlook these incidents for they point to a much bigger problem,” Amolo said. Referring to the killing of lawyer Willie Kimani, his client Josephat Mwenda (a boda boda operator) and taxi driver Joseph Muiruri, Otiende said the increase of extrajudicial killings by police recently points a problem in the leadership within the police service. “These and many other incidents of a like nature have occurred in times past clearly speak to administration gone wrong within the police service,” Otiende said Early this week, Kiambu Senator Kimani Wamatangi suggested that police should be vetted at least after every three months as one of the measures to reduce extrajudicial killings in the country. Security expert Simiyu Werunga pointed out to lack of leadership within the police service as the major cause of extrajudicial killings by police officers. “What we are seeing as the rise in the extrajudicial killings in the country especially by the Administration Police

Two House teams clash over right to decide IEBC’s fate

Confusion, uncertainty and duplication of roles has marred two parliamentary committees looking into the process of reforming the Independent Electoral and Boundaries Commission (IEBC). Parliamentary Justice and legal committee (JLAC) and joint select committee picked by cord and jubilee to address the IEBC crisis, are embroiled in a supremacy battle of who has the mandate to look into IEBC crisis. In its first sitting yesterday, members of the select committee co-chaired by Meru senator Kiraitu Murungi and Siaya Senator James Orengo raised substantial queries of the committee exact role given the JLAC had initiated a similar process to determine the fate of the poll team. Machakos Senator Johnstone Muthama, while on a point of order sought to inquire from the session chair Senator James Orengo whether their committee was procedurally correct to duplicate the work handled by Samuel Chepkonga (Ainakmoi) led committee. “Our greatest concern is when this committee sits to deal with the same issues being handled by JLAC,” Senator Muthama said. However, Orengo ruled Muthama out of order saying that that the matter was weighty and was being dealt with by relevant parties. The Justice and Legal Affairs Committee jointly with Constitutional Oversight Implementation Committee have already set in motion a similar process that the select committee is yet to start off. The sibling rivalry between the two committees now threatens to derail the process of key electoral reforms a head of the 2017 polls. While appearing before JLAC on Tuesday, the nine IEBC commissioners led by Chairperson Isaack Hassan indicated

Given it’s the opposition that the commission it has had bad blood with. Nevertheless, the Legal affairs committee is keen at upstaging the joint select committee picked by cord and jubilee, since it has already started handling a petition by governance expert Barasa Nyukuri seeking the removal of IEBC commissioner on grounds of incompetence and lack of integrity. Article 251 of the constitution outlines the procedures of sending the embattled commissioners home. On the other hand, the select committee hopes to use its links it has with the Senate and Parliamentary leadership to compel the Chepkonga led committee to shelve its probe on electoral team. @hillary_x254

I won’t appear before House team, Wandanyi vows Ugunja MP Opiyo Wandayi has declined to appear before the Parliamentary Committee of Powers and Privileges that had summoned in relation to his suspension from parliament. Wandayi was this afternoon supposed to appear before the committee to defend himself following his suspension from house sittings over misconduct during the President’s State of the Nation Address. The Ugunja legislators had threatened to sue Speaker Justin Muturi for not allowing him to resume house sittings despite a court order. “I am in receipt of your letter. Please note that I do not wish to appear before the said committee,” responded Wandayi in a letter addressed to National Assembly clerk Justin Bundi. The Mp in his letter did not give any reasons for declining to honor the summons by the House previleges committee. The letter summoning Wandayi had been signed by National Assembly senior deputy clerk Michael Sialai. Muturi had referred the matter of the conduct of the Mp to the House committee and therefore refused to allow him back to parliament until a report is presented in parliament and deliberated by Mps. “Pending the conclusion of the matter by the powers and previleges committee, Wandayi is deemed a stranger and shall not be allowed within the precincts of parliament except for the purposes of attending summons of the committee on previleges as and when required by the committee,” Muturi said Through his lawyer Anthony Oluoch,

Wandayi gave the speaker 24 hours to obey the court order failure to which he will sue him. The order had elapsed by yesterday. “We insist on full compliance of the order within the next 24 hours failing which we shall be left with no option but to institute contempt proceedings against you with risk to yourself, including committal to civil jail for a period not exceeding six months,” Wandayi said. Wandayi has said that in respect of court orders no immunity

can be invoked and the same does not apply so as to allow or permit disobedience of orders of the court. Muturi directed that Wandayi should not be permitted within the precincts of parliament until his case is determined by the powers and previleges committee and a comprehensive report presented for deliberations. “However, as you are aware, the court order relates to the of disciplinary proceedings raised by a house of

parliament against its member which is the previleges of the house in terms of article 117(2) of the constitution and therefore direct that the matter be taken up by the committee on powers and previleges and advice the house before Tuesday 19th July, 2016.The committee is also at liberty to re look at the events and make recommendations as may be appropriate,” ruled Muturi. Meet the UK’s new Foreign Secretary, Alexander Boris de Pfeffel Johnson, also known as “BoJo. Johnson’s career was believed to be largely over in the wake of the extended political bloodletting that followed the UK’s vote to leave the European Union. He had been seen as the frontrunner to succeed (now former) Prime Minister David Cameron. However, days after Cameron’s resignation, Johnson dramatically dropped out. Now, just two weeks later, he’s back. CFC Stanbic Bank now rolls out Yuan trading to facilitate trade Financial services provider CfC Stanbic Bank has become the first lender in the country to avail the Chinese currency - the yuan at its branches to facilitate trade between Kenya and China. The move is in a bid to further facilitate trade between Kenyan and Chinese businesses that are continuously growing regionally. CfC Stanbic Bank plans to expand its services to reach business banking and private-owned Chinese companies operating in Kenya. Speaking during the launch, CfC Stanbic Chief Executive Officer Phillip Odera said that as the level of Chinese investments continues to rise, there is need to facilitate settling of Yuanbased transactions. The launch of this new product comes just as the bank strives to positions itself to benefit from an increased flow of the Chinese currency following closer trade ties and transactions between Kenya and China. In this quest, CfC bank has partnered with the Industrial and Commercial Bank of China (ICBC) to facilitate Yuan based transactions. The bank is a member of the Standard Bank Group which is partly owned by China’s ICBC, the world’s largest bank by assets. ACCA, Standard Chartered to boost internal support services The Association of Chartered Certified Accountants (ACCA) Kenya in partnership with Deloitte and Standard Chartered Bank Kenya have organized a shared services centre (SSC) forum to drive forward the common SSC agenda in Kenyan organizations. Communication authority launches system to monitor quality of service offered to consumers The Communication Authority (CA) has launched a new platform dubbed the Radio-frequency Identification (RFID)-based Mail Quality Measurement System that will enable the organisation to independently determine and verify the quality of service offered to consumers of public postal services. Speaking yesterday during the launch at the CA headquarters, Joe Mucheru the Cabinet Secretary for Information Communication and Technology (ICT) said that the advanced system has the ability to automatically read and record timestamp movements of test mails across various postal distribution systems across the country. The technology can also monitor delivery timelines of letters at key points in the mail processing and the Postal Corporation of Kenya (PCK)’s transmission network, and can also assess the achievement of the set quality of service targets.

“I wish to assure the players in the postal and courier sub-sector of the Government’s support, particularly in undertaking the requisite reviews of the ICT policy to ensure an enabling environment for this sector to continue growing,” said Mucheru. He noted that there is no doubt that the system will go a long way in ensuring conformity to the license terms and conditions by the operators in the postal and courier sub-sector “This roll out of this system will not only enable our designated operator to scientifically know its current performance but also provide diagnostic results coordinated by the Universal Postal Union (UPU) experts that will inform considered interventions,” he added. “The Authority sourced the system through the (UPU) who have developed it purposely for deployment and use by the global Postal Administrations. The tender was awarded to UPU on

8th May 2014 at a cost of $97,237 (Sh9.8 million),” said Francis Wangusi Director General CA. Speaking yesterday while handing over the Kenya International Convention Centre (KICC) to the UNCTAD secretariat, Tourism Cabinet Secretary Najib Balala said that the global meeting will be a key boost to the recovering industry, which has been marred with numerous challenges. Balala, backed by his Foreign Affairs counterpart Ambassador Amina Mohammed, said they expect some of the delegates to visit other tourist attractions, especially the Maasai Mara National Reserve where the annual historic wildebeest migration has started. “After the conference, we all migrate to Maasai Mara to enjoy the wildebeest migration. Take advantage of your visit to sample other Kenyan tourism products,” CS Balala said. The sector has rebounded from a fouryear slump to post a growth of 12.1 per cent in the first quarter of the year, according to the Kenya National Bureau of Statistics as of June 30. Kenyan businesses in S.Sudan to resume operations Kenyan firms operating in South Sudan are hopeful their companies will resume operations as soon as possible once the situation in the conflict-ridden country returns to normal. The unrest, which kicked off towards the end of last week, escalating over the weekend, had negatively-affected their operations, leading to closure of some of the firms as they counted billions in losses. In a statement to media houses, the Kenya Airways (KQ) had since the war broke deferred its flights to South Sudan saying it will still suspend the flights to Juba over worsening security concerns being witnessed in the country for undisclosed period. Kenyan businesses operating in South Sudan include Kenya Airways (KQ) UAP Holdings, East African Breweries Limited (EABL), and CFC Stanbic Bank, Equity Bank, Co-operative Bank among others. KQ resumes Juba flights following ceasefire

Kenya Airways (KQ) has today resumed its scheduled flights to the South Sudanese capital of Juba following a ceasefire that seeks to stabilise security in the country. The ceasefire comes after five days of unrest in South Sudan. The airline said it would resume its operation of two daily flights to Juba. The flights depart Nairobi for Juba at 0715 and at 1320 every day, the airline said in a statement. KQ has planned to make its larger capacity B737-800 aircraft available to accommodate more passengers and clear a backlog that was occasioned by the airline suspending flights from Sunday. The airline plans to clear the backlog by Friday, giving priority to passengers based on their original return dates. KQ suspended flights to Juba, South Sudan after sustained fighting between rival factions that broke out last week. The national carrier said “the move was necessitated by the uncertain security situation.

hile most of us were trying to figure out ways to debase and debauch ourselves on our 19th birthday Nobel Laureate Malala Yousafzai was still championing the rights of others towards a better world. The youngest ever Nobel Prize winner, on her recent visit to the country, had the Dadaab refugee camp close to her heart. The world’s largest refugee camp is set to have a large population reduction by the Kenyan government, which seeks to send about half of its more than 300,000 asylum seekers back to Somalia due to increased threats of terrorism. Malala, who is a survivor of terrorism herself, and a strong campaigner for the education of the girl-child revealed that there were not enough schools in Somalia, which is famously plagued will internal strife. She opined that if refugees were forcefully evicted from the camp, the girls would be married off while they were still very young. The Nobel Laureate admitted that she herself would probably have suffered the same fate, “If they (girls) do not go to school, then they get married at a very early age, and the same would have been my future if I couldn’t go to school,” she told the Thomson Reuters Foundation. In May the government announced that it would be closing Dadaab by the end of November 2016. International and public pressure made the government reassess the situation and do an aboutturn. Dadaab suffers from lack of proper infrastructure, overcrowding, malnutrition and

ormer president Daniel arap Moi apparently sold land claimed by USIU. The 20 acre piece of property in the swanky Muthaiga North Estate was reportedly purchased by a private developer known as George Kiongera, a Kenyan citizen residing in the United States. After producing documents showing the acquisition, Kiongera said he does not recognise the claims being made by the university. Students led by Vice Chancellor Paul Tiyambe and businessman Manu Chandaria took to the streets to peacefully demonstrate the sale of the land after discussions by the institution’s management board with law enforcement at Muthaiga and Kasarani Police stations. The issue first raised some eyebrows by members of the institution when they noticed people moving in and out of the property. After putting up signs by warning the public that the piece of land was not for sale, they were subsequently torn down on the morning of July 9th by a large group of armed people.

Marathoner Wesley Korir has taken a dig at the government and precisely the ministry of sports over the treatment of athletes ahead of the forthcoming Rio Olympic Games. Korir also said increased doping claims are only intended to slow the country down ahead of the games. The Kenyan captain also praised the increased drug testing saying that it will help clear the country’s name and the several hard working athletes. AFC new boys to expected to jet into the country AFC Leopards coach Ivan Minnaert is expecting to link up with the clubs’ three June signing in the coming one week as they prepare for an improved second leg of the season. Mousa Sissoko from AC Djoliba and Ismaila Diarra from Rwandese side Rayon Sport are alongside Rwandese left back Emmanuel Imanishimwe were not expected to be part of the team until finishing their engagements with their previous clubs. “Sissoko was supposed to arrive on Monday morning but there was some mix up in his travel ticket so we expect him early Wednesday morning. By the end of the week we should have Emmanuel and Diarra because they were supposed to come after finishing their season with Rayon,” Minnaert told Capital Sport. Diarra and Imanishimwe helped Rayon clinch the Rwandese domestic cup with Diarra scoring a 90th minute winner last week. They are expected to strengthen the Leopards side which finally found its spot on Saturday with a huge 4-0 win over Thika United, ending their run of seven matches without a win. “The future it is going to be brighter. Sissoko, Diarra and Emmanuel are all coming in and then we will have a very competitive team. Step by step we will be better. FKF ordered to pay Michel World football governing body Fifa has ordered Football Kenya Federation (FKF)to pay former Harambee Stars coach Henri Michel Sh4.5 million in salary arrears. Fifa has also warned that that it will open proceedings against FKF for violation of Article 64 of the Fifa Disciplinary Code (FDC). Part of the letter to FKF reads. “We refer to the above-mentioned matter, as we have learnt that the Football Kenya Federation has not acted in accordance with the decision (to pay the coach) passed by the Single Judge of the Players’ Status Committee on 25 February 2014. This would appear to be a violation of article 64 of the Fifa Disciplinary Code (FDC), and as such, it will be the subject of an investigation by the Fifa Disciplinary Committee,” “We are therefore opening disciplinary proceedings against the Football Kenya Federation in respect of a violation of article 64 of the FDC.” “With this in mind, we hereby urge the Football Kenya Federation to pay immediately the outstanding amounts due to the coach Mr Henri Michel, namely EUR 40,000 as well as 5percent interest per-year to be calculated in accordance with the decision of the Single Judge of the Players’ Status Committee dated 25 February 2014 until the date of effective payment, and to send us a copy of proof of payment.” FKF through its General Secretary Robert Muthomi has however said that they do not have the judgment in their possession and have requested for a copy of the decision before commenting on the matter. The ruling made in February 2014 was communicated to the federation, then, under the leadership of Sam Nyamweya but they failed to act. Michel was hired as Stars coach in August 2012 but he quit two months later after citing differences with the Federation.

Manchester United have been ranked fifth in Forbes magazine’s list of the world’s most valuable sports teams. NFL side, the Dallas Cowboys, are top with $4bn (£3.03bn), the first time a non-association football team has headed the business magazine’s list since it began in 2011. United, who topped the list in 2011 and 2012, are valued at $3.32bn (£2.52bn). Real Madrid are second with $3.65bn (£2.77bn) and Barcelona third with $3.55bn (£2.69bn). United - the only English club in the top 20 - saw a 7% increase in their value despite missing out on the Champions League after signing a £750m Adidas kit deal. However, the club have the highest debt load of anyone in the top 25. Arsenal (23), Manchester City (28), Chelsea (36) and Liverpool (41) are the remaining English clubs to make the list. The Cowboys, who made a record $270m (£205m) operating profit last season, are one of 27 NFL franchises in the list, while the Formula 1 team Ferrari have dropped out of the top 50 completely.
