resident Barack Obama made a fervent appeal for Hillary Clinton on Wednesday, casting the Democratic nominee as a custodian of his legacy while rejecting Republicans’ message as fostering anger and hate. Obama said his former secretary of state is a better qualified candidate than even he or her husband, former President Bill Clinton. “I can say with confidence there has never been a man or a woman, not me, not Bill, nobody, more qualified than Hillary Clinton to serve as president of the United States of America,” Obama said to a roaring crowd, and a bellylaughing Bill Clinton, at the Democratic National Convention. “This is not your typical election,” Obama said at the Democratic National Convention in Philadelphia. “It’s not just a choice between parties or policies; the usual debates between left and right. Court orders 8 students to face arson charges as crisis meeting is convened The High Court has today overruled a decision by a magistrate court and ordered eight students of Sunshine Secondary School to face arson charges. This came even as Education Cabinet Secretary Fred Matiang’i convened a crisis meeting today with members of the clergy and secondary school heads representatives to help find a solution to the escalating school fires. In the courts, Justice Luka Kimaru overturned a decision that allowed eight Sunshine Secondary School students to settle an arson case they were facing out of court. His decision followed an appeal by the Director of Public Prosecution against the lower court’s decision saying there is sufficient evidence to charge the students with arson and conspiracy to commit felony. Justice Kimaru ruled that the children’s court magistrate made an error of judgment when she allowed the parties to use alternative dispute resolution mechanism. The students will now take plea on August 2. The DPP had argued that the ruling failed to recognize the mandate of the office of prosecution while pointing out that the students were already past the age that would hinder him from instituting charges. The students drawn from form one to three were arrested last week for attempting to burn their dormitory. The developments came on a day Education Cabinet Secretary Fred Matiang’i convened a consultative meeting with stakeholders even as arson cases in schools continued unabated. incident of the chilling wave of arson cases in schools. About 100 schools have experienced the attacks with 150 students and 10 teachers being arrested as the authorities move to reign in the perpetrators. At the meeting today at the Kenya Institute of Curriculum Development, CS Matiang’i will be seeking the views of school heads and those of religious leaders as the government moves to contain the madness that has hit schools across the country.

Views of the meeting will be incorporated in recommendations of a similar one held on yesterday between the Teachers Service Commission (TSC), Ministry of Education officials and head teachers representatives. TSC Secretary Nancy Macharia said everything is being done to resolve the crisis that is threatening the country’s education system. In the meantime, she said they have agreed that in boarding schools, “all principals, deputies, teachers in charge of all boarding aspects and

other key administrative staff will reside in school at all times.” A fully fledged counselling office will be established in all secondary schools in a bid to cater for social and academic needs of a student. The office, she said, will strengthen and streamline guidance services in schools saying, “Already a policy framework is being developed to this end.” Among other measures set to be put in place include enhanced communication between students, parents and teachers more so in

addressing grievances. Cases of arson have continued despite several students being arrested and arraigned in court. Earlier yesterday, seven students were arrested following the fire incident at St Patrick’s School Iten, where a dormitory was burnt on Tuesday evening. MPs appeal to President Kenyatta to step in and end wave of fires Four Members of Parliament have appealed to President Uhuru Kenyatta (pictured) to step in and end the ongoing wave of arson attacks in schools. Geoffrey Odanga (Matayos), Florence Mutua, (Busia Woman Representative), Opiyo Wandayi (Ugunja) and Timothy Bosire (Kitutu Masaba) have asked the President to speak on the matter saying his silence is worrying. about the ongoing unrest in schools and the uncoordinated and counterproductive approach adopted by the government. In particular, we are deeply concerned about the safety of thousands of children in schools,” said Odanga. They said they will announce their next step of action should the President fail to address the matter two days time. Odanga who read the statement on behalf of the lawmakers said the government has lost control and the arsonists are in charge of schools. “We demand that the government embarks on immediate consultations with KNUT, KUPPET and school heads association to get

to the bottom of the matter and prescribe remedies,” he said “We want to believe that the measures recently announced by Education CS Fred Matiang’i were products of a cabinet resolution yet we have seen studious silence by top government officials including the President and his deputy as these measures trigger unrest,” he added They said the unrest is triggered by wrong policies and demanded that the government take responsibility. “Where is our President in all these, why is he silent. Delivering point-by-point plaudits of Clinton’s record, Obama said the former top diplomat had the best view of what it takes to occupy the Oval Office. “Nothing truly prepares you for the demands of the Oval Office,” Obama said. “You can read about it. You can study it. Until you’ve sat at that desk, you don’t know what it’s like to manage a global crisis, or send young people to war. But Hillary’s been in the room; she’s been part of those decisions.” Her rival, meanwhile, is merely ginning up fear to secure votes, Obama argued. “Donald Trump calls it ‘a divided crime scene’ that only he can fix,” Obama said of the Republican nominee’s descriptions of the state of the country. “He’s just offering slogans, and he’s offering fear. He’s betting that if he scares enough people, he might score just enough votes to win this election.” “That is another bet that Donald Trump will lose,” Obama continued. “Because he’s selling the American people short. We are not a fragile or frightful people. Our power doesn’t come from some self-declared savior promising that he alone can restore order. We don’t look to be ruled.” Obama said the message at last week’s GOP convention in Cleveland “wasn’t particularly Republican, and it sure wasn’t conservative.” “What we heard was a deeply pessimistic vision of a country where we turn against each other, and turn away from the rest of the world,”

Obama said. “There were no serious solutions to pressing problems, just the fanning of resentment, and blame, and anger, and hate.” Speaking to what’s likely to be the largest remaining audience of his presidency, Obama recalled the moment 12 years ago to the day that thrust him onto the national stage. And he insisted the country was better off now than when he first entered office in 2009 . “Through every victory and every setback, I’ve insisted that change is never easy, and never quick; that we wouldn’t meet all of our challenges in one term, or one presidency, or even in one lifetime,” Obama said. “So tonight, I’m here to tell you that, yes, we still have more work to do,” he said. In his speech, Mr Obama implored voters to help continue his legacy by carrying Hillary Clinton to victory at the polls in November. He said voters faced a choice between hope and fear, attacking “homegrown demagogue” Republican Donald Trump. Vice-President Joe Biden also delivered his own spirited address, saying Mr Trump “backs torture”, “religious intolerance” and “betrays our values”. “He has no clue about what makes America great,” Mr Biden said, before the crowd started chanting, “Not a clue!” The president closed the evening by recounting his key victories over his past eight years in office and painting an optimistic future for the country. Sonko declines to apologise over Kidero ‘murder’ remarks Nairobi Senator Mike Mbuvi Sonko has maintained that he will not offer any apology to Governor Evans Kidero over remarks he made against him last month at a senate committee sitting. Sonko who appeared before the Senate House Business committee yesterday declined to apologise for calling Kidero a thief and a murderer. “I will not resign nor withdraw anything that I had said, I have evidence on everything that I said earlier,” Sonko said. Speaking to journalists after the meeting, Sonko said he is not afraid of any action that the committee might take against him. “I am not afraid of any action,

The two leaders clashed during the Senate Public Accounts Committee sitting for which Dr Kidero had been summoned to answer to audit querries raised by the Auditor General. The matter was referred to the powers and privileges committee. Kidero wrote to Senate Speaker Ekwee Ethuro to have parliamentary privilege insulating Senator Mike Mbuvi alias Sonko from prosecution be lifted to allow him seek legal redress. Sonko accused governor Kidero of murder and corruption and exchanged abusive words before the Public Accounts committee. Ombudsman: EACC boss ignored our advice Embattled Ethics and AntiCorruption Commission chairman Philip Kinisu (pictured) has only himself to blame for his current troubles, the ombudsman has said. The Commission on Administrative Justice chairman Otiende Amolo Mr Kinisu took up the job at the helm of the EACC against an advisory opinion from the commission to rescind his decision since as a company he had served as a director had transacted with the National Youth Service that had been laced with corruption allegations. Mr Amollo told X news that the commission had foreseen such an occurrence of conflict of interests despite the absence of a law that prohibits a state officer from transacting business with government agencies. “It was a lapse of judgement from Kinisu’s end to accept an appointment to head the EACC secretariat noting that he had transacted business with NYS at a time it was being accused of mega corruption,” Otiende said. However he was quick to note that

Kinisu cannot be forced to step aside as he had only been accused of ‘conflict of interests’ and not corruption as no evidence has been produced against him. “Kinisu may remain in office even as investigations surrounding his dealings are being conducted by a multiagency team as he is facing conflict of interest accusations and not corruption,” he noted. Kinisu who was on Monday grilled by police over criminal culpability in a probe touching on his family company, Esaki Limited, but has vowed to stay put as the anti-graft boss and dismissed any claims of wrong doing. He has been accused of his family company suspiciously winning government tenders worth millions of shillings including Kshs 35 million with the NYS, which is under investigations by the anti-corruption agency. Calls for his resignation have started in earnest led by vocal Nandi Hills MP Alfred Keter and the Transparency International. Keter has said that

Reducing staple food prices could lift 500,000 out of poverty: WBG Reducing the price of staple foods by 10 per cent could lift nearly half a million people out of poverty in Kenya, South Africa and Zambia, a new report has confirmed. The analysis, a product of the World Bank Group and the African Competition Forum, ‘Breaking Down Barriers’, estimates the gains from tackling anticompetitive practices and reforming policies to enable competition. It indicates that reducing the prices of food staples by just 10 per cent by tackling cartels and improving regulations that limit competition in food markets could lift 500,000 people in Kenya, South Africa, and Zambia out of poverty and save consumers more than $700 million (Sh71 billion) a year. “African countries have much to gain by encouraging open and competitive markets, particularly as a means to spur sustainable economic growth and alleviate poverty. Yet in reality, many markets have low levels of competition,” states the research. It comes at a time when more than 70 per cent of African countries rank in the bottom half of countries globally on the perceived intensity of local competition and on the existence of fundamentals for market-based competition. Retail prices for 10 key consumer goods – white rice, white flour, butter and milk among them -- are at least 24 per cent higher in African cities than in other main cities around the world. While

these higher prices affect all consumers, the poor are hit the hardest. The data has stated that cartels -agreements among competitors to fix prices, limit production or rig bids -are a serious cause of low competition levels in African countries and have been found to affect products in a variety of sectors, including fertilizers, food, pharmaceuticals, construction materials, and construction services. Evidence reveals that consumers pay 49 per cent more on average when firms enter into these agreements.

“There have been a notable number of countries adopting competition laws in Africa, and this bodes well for growth and development. However, while the benefits of competition are already clearly observable in Africa, there is still considerable effort required to ensure effective implementation of competition laws and policies across the continent,” notes Tembinkosi Bonakele, Chairperson of the African Competition Forum headquartered in South Africa. In addition to explaining the costs of low levels of competition, Breaking

Down Barriers highlights the important progress many African countries are making in improving competition policies. For instance, the number of countries and economic communities like EAC, COMESA and ECOWAS with competition laws has nearly tripled in 15 years. Parliament passes law controlling lending rates

Kenya’s Parliament yesterday passed amendments to its Banking Act to cap commercial banks’ lending rates at 4 percentage points above the Central Bank’s benchmark rate, a legislator said. “The bill unanimously received 100 per cent support from the legislators,” Jude Njomo, the lawmaker who sponsored the changes, told Reuters. The move came into force just after the Central Bank of Kenya (CBK) had earlier urged banking institutions to lower lending rates but did not set a cap. Business owners have been frequently complaining of high commercial lending rates, which had tripled to as much as 18 per cent, putting loans out of reach for many consumers, especially Small and Medium-sized Enterprises (SME’s). However, financiers have expressed their dissatisfaction with the law, saying this fixed cap will force them to cut some lending to businesses that are deemed riskier thus hurting economic activity.The amendments to the Banking Act, which will be forwarded to the president for assent, also set the minimum rate for bank deposits at 70 per cent of the Central Bank’s benchmark rate. Banks cite a range of reasons for charging elevated rates, such as the difficulty of obtaining a detailed history of new clients. They also say big customers, who they know well, can secure much lower rates than those commonly cited. @enock_x254

He added that it is not clear what the outcome will be but so far, Kenyans have not yet been affected. He urged investors to be more cautious. “Our exports will be under a higher tariff regime, exporters maintain your market share there is great sensitivity to the issue,” Njoroge said. The governor was addressing the media during a bi-monthly briefing at the CBK headquarters. He said that overall inflation increased to 5.8 per cent in June 2016 from 5.0 per cent in May but remained within the government target range. “Our inflation remains out of control, it is true it has increased, this increase was largely due to prices of some food

items such as tomatoes, Irish potatoes and cabbages,” said Njoroge. Njoroge noted that no-food-non-fuel (NFNF) inflation declined to 5.0 per cent in June from 5.4 per cent in May. “This indicates that there were no significant demand pressures in the economy,” said Njoroge. He noted that the banking sector continues to stabilise with improving liquidity conditions and non-stable non-performing loans in May and June. “The ratio of gross non-performing loans to gross loans fell marginally from 8.5 per cent in May to 8.4 per cent in

June,” said Njoroge. “The CBK will continue to closely monitor credit and liquidity risks.” He added that improved security and confidence in the economy continued to support the recovery in tourism. “The MPC Market Perception Survey conducted in July 2016 shows the private sector remains optimistic for a higher growth in 2016 supported by macroeconomic stability, infrastructure investment strong agriculture performance and tourism recovery,” he added. @lenah_x254

The Kenya Revenue Authority (KRA) has missed its set collection target by a marginal Sh7 billion despite raking in a record Sh1.21 trillion during the 2015/2016 financial year. Releasing KRA’s full year results, Authority Commissioner General John Njiraini stated that the amount was against the exchequer’s target of Sh1.2174 trillion. The cash marks a 13.2 per cent rise compared to the previous fiscal year. A total of Sh810.2 billion worth of domestic taxes were collected, which was against the targeted Sh834.3 billion. Additionally, Sh386 billion worth of customs were collected. The regulator has blamed Customs for the failure to meet the target. The Secretary General, said that apart from excise duty, which performed well, import duty did not perform well at just 9.8 per cent during the period under review. Pay As You Earn (PAYE) registered strong growth in comparison to employment growth at almost 13 per cent. “The overall performance for the year is consistent with what we had expected. The areas that were strong, such as consumption taxes, continued to be strong while there was a reversal in income taxes. “We regard this as positive in the sense that despite the various challenges we faced, we were able to increase revenues with over Sh140 billion during the financial year,” Njiraini said. The challenges in question include the country’s lower performance of the GDP last year which stood at 5.8 per cent against the projected 6.1 per cent as well as a decline on import volumes and values, which declined by 13.6 per cent. The directive follow’s the Moroccan government’s re-affirmation of a statement released by the Moroccan King Mohammed VI during the AU summit in Rwanda last week. The country has not been a member because its government opposed the membership of Western Sahara as the Sahrawi Arab Democratic Republic. In the statement presented by the special envoy, King Mohammad called on the bloc to reconsider its position, assuring that a political solution is being considered according to the provisions of the UN. The statement further reads that even when it was no longer a member of the AU, Morocco never left Africa. The country has pledged to contribute to making the AU a more robust organization and strengthen its involvement in matters it feels strongly about through agendas and constructive activities. “Through this historic act and return,

Morocco wants to work within the AU to transcend divisions,” the King said. Morocco holds membership in two of the eight regional Economic Communities of the African Union; the Arab Maghreb Union and the Community of Shel-Saharan States (CEN-SAD). It also has observer status in the Economic Community of West African States (ECOWAS). Kenya has had a standing relationship with the country for quite some time. In 2013, East Africa’s powerhouse signed an agreement with Morocco to increase trade between both countries. Kenya police to benefit from Sh 18 billion Shelter Afrique deal with Government The Government has signed an agreement worth Sh18 billion with real estate company Shelter Afrique to develop 20,000 housing units for the National Police Service within the next 24 months. This is in addition to 1,850 houses currently under construction in various parts of the country. Cabinet Secretary for Transport, Infrastructure, Housing and Urban Development Mr James Machariaon said the ground breaking ceremony for the houses will take place on October 19, 2016.

Macharia confirmed that the Government, Shelter Afrique, the African Development Bank, National Housing Corporation and Kenya Commercial Bank will fund the project to the tune of Sh 18 billion. At the time, Shelter Afrique Managing Director, Dr. James Mugawa said the current situation in the African continent regarding housing problem is a cause for concern. Speaking at the opening ceremony of Shelter Afrique’s 35th Annual General Meeting and Symposium, in Abuja, Nigeria, the MD called on African leaders to address the crisis. “It is no secret that there are huge housing deficits across the continent. In Kenya, the deficit is estimated at 2 million houses over the next 10 years. These estimates however assume that the population will remain static, and from what we can see, it will not,” he explained. UN-Habitat, the housing arm of the United Nations, estimates that half of the world’s population, a total of 3.5 billion already live in cities. By 2030, almost 60 per cent of the world’s population will live in urban areas. “Ninety-five per cent of urban expansion in the next decades

will take place in developing world, most of it right here in Africa. In real terms that means that we will require an additional 532 million units across the continent by 2030,” Dr. Mugawa explained. He added that Africa will experience a population boom in almost of all its major economies. “Nigeria is expected to have 174 million people between the age of 15-64 by 2035; in the Democratic Republic of Congo that number is predicted to be 70 million, in Kenya that number is 45 million and in South Africa that number is 40 million,” he warned. He noted that Shelter Afrique was taking steps to address housing Africa’s low income urban population. “It is not something we can do alone, nor is it something we would even want to do alone. For solutions to having a lasting impact and be sustainable they must be owned by all stakeholders, so I encourage you to participate and engage actively in discussions. Spire Bank to up SME portfolio as lender invests in low-cost housing Spire Bank has announced plans to increase its Small and Mediumsized Enterprise (SME) portfolio by investing in low cost housing in Kenya. The lender has said the move is part of its strategic plan for the Kenyan market. Spire Bank Chief Executive Tim Gitonga says the investment will be made on a 35-acre piece of land in Juja in partnership with Mwalimu Asset Managers. The firm which was formerly known as Equatorial Commercial Bank was acquired by Mwalimu Teachers Sacco who has already injected Sh1 billion capital in the beginning of the year. Gitonga says the bank is doing preliminary research to find out the cost implications of the project that is expected to start in 2017. The lender also intends to focus on Small and Medium Enterprises planning to invest Sh5 billion on this class this year. The plan is intended to increase its SME portfolio from the current 45 percent of its business to 65 percent in the next two years. “Among the issues affecting the SME sector include performance risk issues, where SMEs do not deliver to the specifications of their contracts and payments become an issue, we are seeking to do capacity building on them so as to help be the best they can be,” Gitonga observed.

resh university graduate Edinald Atieno Nyainda was murdered on Monday by her lover identified as Maxwell Okoth. It was a harrowing sight the residents of Kahawa Wendani, Ruiru woke up to that morning. Police entered the suspect’s house to find the victim bound to the bed with multiple stab wounds in a vision of horror. The suspect allegedly contacted Edinald’s sister in the wee hours of the morning after the deed was done telling her to come pick up her body. It’s hard to believe that this was someone he was emotionally attached to in some way. After a disagreement between her and her boyfriend, Okoth murdered her in cold blood. As her family was preparing to celebrate her graduation they received the news that their daughter had been killed and it was a sad sight to see as her father, John Akelo Nyainda fought back tears while making a statement to the press. “She was the youngest and the brightest among my four children since her primary school days. She was the hope of this family. She has left a big gap in this family. I wanted a bright future for my daughter and saw to it that she lacked nothing in school,” he said to the Standard. Although this is no-doubt a tragedy in its own respect, other

It has been reported that the lecturers have not been paid since 2013 and are owed up to Sh.2 million by the university. The situation is even worse for part-time teachers as some of them have not been paid for the hours that they have spent lecturing and had actually been asked to teach without any guarantee of payment. In a statement to the Daily Nation, Secretary General of the Part Time Lecturers Association Mr Meshack Lagat said, “How do you meet your financial obligations if you are working and you can’t be paid at the end of the month? We are tired and that is why we have downed our tools.”

Chelsea midfielder Cesc Fabregas was shown a straight red card for a foul on new Liverpool signing Ragnar Klaven in a pre-season friendly in the US early today. Sundowns beat Zamalek to reach African Champions League semis THURSDAY, JULY 28, 2016

Mamelodi Sundowns of South Africa continued their impressive run in the African Champions League with a 1-0 win over Zamalek last evening, a result which put them into the semifinals. In the other group, qualification will go down to the final day of matches, after bottom side Al Ahly finally recorded a win by beating leaders Wydad Casablanca 1-0. Zambia’s Zesco are tied with Wydad after being held 1-1 by ASEC Mimosas of Ivory Coast, who have the same number of points as Ahly. An own-goal from Zamalek’s Ali Gabr in the 79th minute secured Sundowns’ qualification to complete a remarkable turnaround for the South Africans in the Champions League. Sundowns had been eliminated in the final qualifying round for the Champions League last April by AS Vita Club from the Democratic Republic of Congo. Demoted to the second-tier Confederation Cup, Sundowns were beaten by Medeama of Ghana in a play-off to suffer further African

anchester City are in talks with Everton over the possible signing of England defender John Stones. A deal is yet to be agreed but it is thought the two Premier League clubs are not far apart in their valuations. It is thought Everton want £50m for the 22-year-old former Barnsley player, who came close to joining Chelsea last summer. Stones was part of the England squad at Euro 2016 but did not feature as they were knocked out in the last 16. He made his debut for Barnsley in March 2012, 10 months before joining Everton for £3m. City boss Pep Guardiola has identified the Yorkshireman as the kind of central defender who fits his approach to the game. “Normally central defenders are strong in the air and aggressive,” said Guardiola on Wednesday. “But we need to have a good build-up to create easy passes in the midfield so they can create good passes for the strikers. I believe when the ball goes from the central defender to the striker as quickly as possible, it comes as quickly as possible back. “That is why the players in that area need quality. By 31 August we will have the right squad to play how we want.”

Guardiola used midfielders Javier Mascherano and Javi Martinez as central defenders while managing Barcelona and Bayern Munich respectively. And the Spaniard has identified a City midfielder who could step into the back four if required. “Fernandinho can play in 10 positions,” he said. “He is quick, fast, intelligent, aggressive. He is strong in the air and has the quality to play good build-up, can go right or left and can pass long.” Meanwhile, Manchester City manager Pep Guardiola has exiled some of his players from first-team training until they meet certain weight targets. Defender Gael Clichy says the Spaniard has told his squad to avoid pizza, some juice and certain “heavy food”. “They are not overweight, but I want my players fit,” said the new City boss. “The weight is so important. When you are not fit, danger is coming. You’re not fast enough or quick enough in the head. That’s why you need to be fit.” French full-back Clichy says he is fully behind Guardiola’s approach.
